Old shutters & frames with their crumbling paint appeal to us. Those ancient garden statues with moss adorning, we can’t seem to get enough. What is it about these things from the past that speaks to our senses? “Patina”, a thin layer that variously forms on a surface, whether it be metal, stone or wood, we seem to gravitate towards anything with a natural “patina”. It is a great day, the best of best of days in fact when we find that thing with a natural patina. What if you have a “thing” but it does not have the wonderful old time worn look that you crave? Can you create it? Is there a way to bring the “look” into your home without the old basement or attic smell, without the chipping lead based paint? Well of course there is! You can transform your home, with the use of a number of creative user-friendly products, into a page from your favorite home décor magazine. Here is a simple way to create an aged time worn look on a few items you may already have in your home. Take a gold frame or bookends for instance. Start with a base coat of white paint. We like to use Old White Chalk Paint by Annie Sloan because it sticks to everything. Next begin to layer a different color, perhaps French Linen. This will begin to add depth. Try not to cover the entire piece, leave bits of Old White peaking out and don’t be perfect with the paint. At this point, you can even wipe away some paint to reveal the original color. You can layer as many colors as you like, we often use only two or three to add shadows and highlights. You can choose to add wax for protection and patina after your paint dries. Annie Sloan’s Soft Dark Wax is great for this purpose. Taking a brush, gently apply the Dark Wax to patina in some areas, remember not to be perfect, as you want it to have a time worn appearance. Buff away any excess wax and your project is complete. You can repeat paint and wax steps to achieve varied levels of depth. Chalk paint by Annie Sloan is a low VOC environmentally friendly product that can be used in your home. Clean up is with soap and water, no messy smelly products needed. Get your creative juices flowing and add some “Patina” to your home today. Paint Tip of the Month What if you want to add wax but not dark wax? Simple, take a bit of Annie Sloan’s Soft Clear Wax and add a few drops of say Old White. Now you have a white wax to add patina. You can do this with any of Annie Sloan’s Chalk Paint colors, simply mix up, apply and buff off excess.


All Business Our Creative Side: Using Copyrighted Material by Christy Schmidt, Esq.

Ah…August. As we wrap up Summer 2015, I thought I could discuss a HOT topic: Using others’ copyrighted materials in your publications and on your website. I can confidently say that this is the number one question posed to me by most business clients. You would be surprised what is copyrighted. After this summer’s 08742 articles on copyright, you realize music, plays, books, blogs, articles, photos, artwork, sculptures… are all copyrighted. Also realize “famous” people own their personal image and can sue you for using their photos. (So, do not run out and put a picture of a famous actor on your website…he or she might not be pleased!) So, here is the popular question: Can I use this (picture, song, story, quote) in my newsletter or website? The short answer: No, not without the creator’s agreement. A copyright (which we discussed in June) gives the creator several rights: • Moral rights. The right to maintain the character of the work (keeping Micky Mouse out of adult-films, for example), the right to be known as the creator, the right to withdraw or destroy the work. • Reproduction rights. The right to copy it. To reprint it.

• Derivative work rights. To create the film from the book. To adapt the film into a comic book. • Distribution rights. To sell the work. (Although once purchased, the owner can resell it.) • Transmission, display or performance rights. This means that if you find a really cool picture online and want to use it on your website, you should contact the creator and ask for the right to “display” it. You should also realize if you are using the work on your website to make money, that creator will want to get paid. (This is also why many websites use “classical” music – which is no longer copyright protected.) This is another hard and fast rule of which most website developers and publishers are painfully aware. I say “painfully” because some have suffered the result of violating another’s copyright – a cease and desist letter or an infringement suit. Typically, the infringement is caused by a freelancer: You contract a part-time writer or developer to do a specific project and he or she is not as aware (or not as concerned) with copyright law. He or she uses a copyrighted song…and you get sued. I also have helped restaurants and bars who do not know the rules for playing music or showing televised shows, concerts or sporting events. (Yes, there are rules depending on the size of the establishment…). The long answer to using copyrighted materials: Sometimes (rarely) you can find exclusions to the rule and publish copyrighted material. Basically, this limited right of “fair use” is only for the purposes of news or education (which is why professors can use quotes and handouts) or parody or social commentary. However, fair use is a very limited right – and involves the purpose of the distribution and amount of the work used. I always advise clients who are considering arguing “fair use” to discuss the matter fully with me prior to using the work.

One last comment about “fan fiction.” This is the practice of taking a famous story or work (like Star Wars) and writing your own continuing story – or a comic strip. We see this everywhere and hear very little about infringement lawsuits related to it. Here’s the reality: Creators protect copyrights so they can continue to make money on what they created. Fan fiction is typically unprofessional – (Continued on page 16)

Expungement

In New Jersey, it is quite easy for people to view your criminal records. With such unfettered access to a person’s criminal history, it can be extremely difficult for someone with a criminal record to find a job, rent decent housing, or get approved for state licenses. For these reasons, people oftentimes seek to have their criminal record expunged. What is an expungement? Expungement is the process of legally destroying or striking out records or information in files, computers and other depositories relating to criminal charges. When a person has criminal records expunged under N.J.S.A. 2C:52-1, the information on file concerning a person’s detection, apprehension, arrest, detention, trial or disposition of an offense with any court, detention or correctional center, or law enforcement or criminal justice agency is extracted and isolated. Under N.J.S.A. 2C:52-15, once an expungement has been ordered, upon inquiry, the person having control over the individual’s criminal records is required to reply that no such record exists. Under N.J.S.A. 2C:52-19, a New Jersey Superior Court, however, in limited circumstances, may order the inspection of expunged records. Expunged records may be used in sentencing for a later conviction. N.J.S.A. 2C:52-19. Finally, expunged records may also be used in determining whether to grant or deny a person’s application for acceptance into a supervisory treatment or diversionary program related to charges subsequent to the expungement, or in granting parole. N.J.S.A. 2C:52-20 and N.J.S.A. 2C:52-22. Who is eligible for expungement? Under N.J.S.A. 2C:52-1, et. seq., past criminal convictions can be erased under certain instances. Disorderly Person Offense: If a person was convicted or plead guilty of a disorderly person offense more than five years ago, and have not been convicted or plead guilty of anything subsequently, that person may petition the Superior Court to expunge the record of that conviction. Town Ordinances and Juveniles: Certain offenses can be expunged in two years. If a person was convicted or plead guilty of a town ordinance (i.e. drinking in public, urinating in public); or, a juvenile delinquent or guilty finding of a minor. Minor Drug Offenses: A person, as a result of a first offense minor drug arrest that resulted in acceptance into the conditional discharge program is eligible for expungement one-year from the date of termination of probation or conclusion of court proceedings, whichever comes first. Indictable Offenses: Certain indictable offenses are not eligible for expungement in New Jersey. Not to provide an exhaustive list here, but some of these offenses include, crimes involving public office; certain drug crimes; criminal homicide, except death by auto; kidnapping, luring or enticing; aggravated sexual assault; aggravated criminal sexual contact, if the victim is a minor; criminal sexual contact, if the victim is a minor and the offender is not a parent of the victim; criminal restraint; false imprisonment; robbery, arson; endangering the welfare of a child; perjury; false swearing; and conspiracies or attempts to commit such crimes. The complete list of non-expungable offenses is listed by statute under N.J.S.A. 2C:52-2. If you have questions about eligibility for expungement or you already know you’re eligible for an expungement you should contact an attorney experienced with handling these matters in the Superior Court. Staying Home The Friendship Vibe by Christy Schmidt

Happy August! Boy, it’s hot out there. Stay inside and read your 08742 Living! This month: Friendship and boundaries. In June and July, I focused on tools to help maintain and grow your friendships (and other relationships). This month, as summer ends, I am going to focus on when a friendship should end. I am hoping you will share this article especially with teens who often have a hard time knowing with whom to be friends. Who are we kidding? We all have that problem. No one wants to be alone. Positive psychologists know the number one way to happiness is to have a strong social network – lots of people to love and from whom to receive love. However, friendship and companionship is never a reason to forget who you are. This became apparent to me again, recently, when I dropped a business deal on which I was working for months after discovering the business partner was unethical – I caught him in a manipulative lie. That was that for me. I lost a great opportunity and some money – but not myself. Not my integrity. Not who I am. What we are discussing is called many things. Boundaries, as I stated. Vibration. Ethics. It can even be as simple as interests or opinions. “Boundaries” are guidelines, rules or limits that a person creates to identify for themselves what are reasonable, safe and permissible ways for other people to behave towards or around him or her and how they will respond when someone steps past those limits. Read that definition again. Boundaries begin with knowing your own (1) guidelines, (2) rules, and (3) limits. Let’s start there. What are your guidelines, rules and limits? Take the time to write them down. (It often helps to begin with classifying and sorting your personal values – which a coach can help you do!) Next, you need to determine what are reasonable, safe and permissible ways others can behave towards you or around you while maintaining those guidelines, rules and limits.

A lack of boundaries can be extreme: You allow your significant other to hit you or abuse you in any way. You allow your “friends” to bully others. A lack of boundaries can also be subtle: You continue to associate with or patronize a business that is unethical. You let “friends” say mean things about other people in your presence. Why would you remain close with another person who violates your boundaries when you are with him or her? Most importantly, and where we must be the most brave, is to state our boundaries clearly to others. This is typically a cause for relationship problems: Not telling the one you love what you accept and what you do not. What are your rules, limits and guidelines? They cannot honor and respect you if they do not know. Of course, expressing our boundaries can result in losing a relationship. Your “friend” may mock you and may not talk to you again. You may get shunned. You may lose business. You may be a bit lonely. Or you may give that friend the courage to examine his or her own boundaries and behavior. And the world is a better place. Or you may let others with similar standards know who you are and make true friends. And the world is a better place. I always say I appreciate knowing with whom I am dealing. The good and true, I embrace. Those who do not live to my standards, I avoid until they figure all this out. And my world is a better place. Make your world a better place. Set your values. Set your boundaries. Demand the best for yourself.

now. I just got back from practice with Sky Blue FC. There are women playing positions that they did not grow up playing. But, in order to play at the pro level, maybe your strength isn’t in the attack, so, you move to outside back. Or maybe you’re more vocal, so, you move into a central position versus out in the flank. If you handcuff yourself at too young of an age, you are closing your options.

Your bio is the definition of all around athlete. Four sports at Point Pleasant Boro and three sports at Monmouth University.

When did soccer become the primary focus?

Rampone: “Well, that was the toughest decision I’ve had to make, career-wise. I was on a full scholarship for basketball at Monmouth, and captain of the team, it was my senior year and that team was supposed to do great things. Then I get the invite to try out for the national soccer team, which was unknown how it all would go. Could I do this over the Summer? But, after some research, I found that this was a once in lifetime opportunity. I had to do it….now. But, it had to be cleared by the basketball coach, the soccer coach, administration, etc. And, it was. So, it was off to California for a ten day camp with, basically, the entire 1996 gold medal team. I returned from that ten day camp and everything seemed like it was going back to normal. Then I got the call to go to Australia. I was 22. And, I still wasn’t sure how this all would work out. Ultimately the president of the university stepped in and helped me make it all happen.

How does local fame treat you?

It’s pretty cool walking down the street and people say, “Hey, Mrs. Rampone, congrats!” My kids like the fact that people know and recognize me. That being said, I feel normal. I go to the beach, I go to the stores, I give some high fives and stop and have a little chat. I feel like I’m another person in the community, Even though they know I play soccer at a high level, they know I will stop and have a conversation with them. It all started here, I have great memories of this area. There’s nothing like being home. I love it.

So, what’s next?

So, you were born in Florida. What brought your family to Point Pleasant?

My thought right now is….am I going to go on to the Olympics? Or, will I retire in December? You can’t play forever. I know it’s definitely coming to an end internationally, but, I would like to play pro a little longer. I don’t need to necessarily go out on top. I feel like I have accomplished so much. I enjoy the game….. playing the game. Also, having my kids have the most amazing experience as well. If I can still play…. why not?

Rampone: My Dad grew up in the Beach and then met my Mom and moved to Florida, where her family lived. They decided Florida was not for them and moved back to Point Pleasant Boro when I was four.

What do you tell young women about natural born talent vs. hard work?

Rampone: You have to embrace the natural ability. But, you still have to act on it. You can’t just show up. You have to have the mentality that you can always be better.

In youth sports, kids are playing one sport, year round. What are your thoughts on this practice?

Rampone: I don’t like it. I’m all about playing multiple sports. My kids play multiple sports. It’s more on the parent. When we grew up, it was more on the child. You know, what they decided to do. I don’t want my children playing one sport. I don’t know what they are going to enjoy later in life. The more voices the better. Through my own experience, I’ve had so many different coaching styles, all over the spectrum. Especially in soccer, it’s an opinion sport. You have to earn it. I have never been able to walk on field and have the coach say to me, “You’re my one”. In my camps, I try to have as many female coaches as possible. Then, we rotate from coach to coach so they can experience the different styles. And, the earlier they can be coachable, the further they will go. They will also be open to changes in position. I was a forward, now I am a defender. I see it at the pro level right August 2015

You Go Girl “But I Just Don’t Have the Time…” by Katherine Kehoe

I’m twenty-five years old and I only just had my first pedicure a few weeks ago for my dad’s wedding.

When is the last time you could say the same? I’m not talking about just pedicures. I’m talking about making time to take care of yourself. As women, we’re constantly bombarded with demands. We don’t just have to worry about husbands or boyfriends who are hungry, or children who need help with homework, or a pile of dirty dishes or a layer of dog hair on the carpet. We also have to be aware of the jobs outside of the home; we have jobs to be on time for and employers who need us to do those jobs well. There’s never a moment in the day when we can sit down and say our work is done.

Any eyebrows go up? Anyone thinking, “How do you survive?” Here’s the thing: As a woman, I should enjoy getting pampered and taken care of every now and then, right? Nope. I don’t have the time. I don’t have the money. I know I’m not alone here. The twenty bucks that I spent on that pedicure could have gone into my gas tank, into the grocery bill, into a present for my boyfriend. That hour that I spent getting my feet massaged could have been used for running errands, cleaning the house, or doing a little extra work to get ahead. Logically, being “girly” doesn’t really fit in to the busy lifestyle of being a woman in the twenty-first century.

I challenge you to sit down anyway. While we’re caught up in the whirlwind of daily duties, we forget that we need to breathe. We forget that we need to have some quiet, some fun, some human connection that isn’t a caretaker role.

But guess what? I loved it. I got to spend time with my future stepmom, I got to giggle with the pedicurist when she hit a ticklish spot, I got to pick out a pretty color and design, and my toes look fabulous. I walked out of the shop feeling relaxed, happy, and confident.

I’m reminding you. So, think about it: what is it that you want? How would you feel most taken care of? Did the pedicure sound amazing? What about a massage? Maybe you’d like to go out for drinks with some girl friends you haven’t seen in a while. Maybe there’s a book you’ve been dying to read. Don’t let your spark go out because you feel like you have too much to get done. No one is going to slip into a coma and die because you didn’t go grocery shopping today. Make the time to remember how awesome it feels to do something you want. You’re worth it!

What would you do if you had the opportunity to make a difference in the lives of shelter animals? After five years of being in the animal rescue industry, I have seen my fair share of stories. Animals are left at our doorstep due to of divorce, moves, or new babies. We receive the victims of abuse, neglect, and dog fighting. That being said, I’ve seen scared and nearly feral dogs and cats turn into the greatest companions and create the strongest bonds despite how they’ve been treated.

back with us to New Jersey. After sizing them up for crates, we ventured out into the island heat to give them the love they’d been deprived of for so long. The first dog curled up in my lap in seconds. There’s something about rescue dogs; they know you’re saving them. They appreciate everything humans do for them. The bond formed with adopters is extra special. The dogs needed lots of walking and attention, but, we only had a few days. On transport day, we bungee tied the crates into the truck and loaded up the dogs. Then at the airport, we had to unload each dog and bungee the crates into the rented jet. After all the smaller crates and dogs were onboard, we climbed on, each with a large dog in tow. We arrived in New Jersey with eighty-seven dogs and five cats split between three shelters. As soon as the dogs stepped out of their cages, they knew they were home. They were safe.

Life is a learning experience. There’s always room to grow and expand our horizons. When I received the opportunity to travel to Puerto Rico last month, I couldn’t say no. I knew traveling there would be a drastic culture shock, but making a difference in the lives of so many dogs made it more than worth it. Animals in San Juan, Puerto Rico aren’t treated like our pets here; they’re property. Strays roam the streets, cattle are chained up in backyards, and chickens are locked in very tiny coops.

Not everyone has the time to travel across states or oceans to transport dogs. There are other ways you can help shelters. They (shelters) are always in need of blankets, toys, food, bones, medication, monetary donations, and volunteers. One hour in your week may not seem like much, but for the dogs it makes their year. Releasing a dog from a cage may even help you escape your own.

But, thanks to generous individuals, rescues, and foster groups, these animals have a second chance. They get the opportunity for a family that will cuddle with them on the couch, take them for long walks, and play with their favorite toys. We pulled dogs from two shelters, along with a few cats. When we arrived, we found the dogs that had been chosen to journey

Beer Corner Section The Student For the Love of Beer — The Hopfather by Matt Connelly

A couple of years ago a local friend invited me to what he described as a “beer-tasting” at Firefly in Manasquan. I was told to bring a 6-pack of stout and an appetite. As I walked into the private front room overlooking Main Street, I was greeted by Chadd and Jay – the event organizers. Surf videos played on a TV in the background and a couple dozen guys talked sports, politics and beer. What took place over the proceeding 3 hours was amazing and unexpected; I haven’t missed a Hopfather since. Chadd Smith and Jason Turton were drinking craft beer at a New York Giants game in 2012 when Jay told Chadd about an article he read in the Ale Street News describing a March Madness-style home brewing competition. What evolved from this discussion was an idea – bring together people from diverse backgrounds with a common love for great beer and stage a tournament-style blind beer-tasting until just one participant is crowned “The Hopfather”.

At its core, The Hopfather is about great beer. Smith and Turton, along with co-organizers Jason Austin and Andrew Tufts, carefully select a diversity of beer styles for each event. Although most styles are chosen based on seasonal influences, recent Hopfathers have included a NJ-brewed only event and a “Can-Slam” (only canned beers). What is not evident in this succinct description is that great food is an essential part of each event. From those first events at Firefly (I recall ossobuco chicken wings, pork belly and stout ice cream) to the most recent event at one of the participant’s houses (roast pig, anyone?), the food has always been amazing.

The concept is perfectly simple:

A style of beer and a location are selected for each event. This information is sent out to an email list of dozens of past-participants and interested parties.

In an effort to promote local shore area businesses, Chadd and Jay have selected different locations to host the events. Hopfathers have been hosted in 08742 at Jason’s Organic Pizza and Prime 13, as well as locally in locations such as Jersey Shore BBQ and Turnstile Coffee Roasters in Belmar. They plan to expand their reach by hosting future events in Asbury Park, Seaside Heights, and the Kane Brewery. The most important part of The Hopfather, according to its organizers, is the camaraderie. “I love the community aspect that the event creates,” says Turton. “Everyone has an opportunity to let go of their busy lives and relax with some chill people, eat some tasty grub and, of course, drink great beer.”

The first 24 guys to respond with their beer selection are invited to attend. Three tables of 8 guys participate in three rounds of blind tasting until their table has selected one beer to advance to the finals. The fourth and final round of tasting involves the winning beer from each table (3 total) from which a new Hopfather will be chosen. (Our Creative Side: Using Copyrighted Material, Continued)

Shore Recipes Frequent readers of 08742 have probably figured out by now that I’m a huge fan of salads. But for good reason, they are versatile, easy to make, light, and healthy. I love this one because it gets better the second day, and it doesn’t have a lot of mayo or oil. I’ve also experimented with using a wild rice mix for anyone who wants a Glutenfree version, or just prefers rice to pasta. Use the same proportions of your favorite brand, and decrease the salt to taste. Hint...Don’t refrigerate your limes and roll them with moderate pressure on your countertop prior to juicing for easy extraction of the juice.

Orzo Salad

Makes 12-14 servings 1 lb orzo pasta cooked al dente or under cooked by 1 minute Juice of 2 limes Craisins dried cranberries 2 stalks of celery finely chopped 1 medium red onion finely chopped 3 carrots peeled and finely chopped 2 cups frozen peas rinsed

Dressing: 3 TBSP honey ½ cup olive oil 2 ½ tsp. table blend Mrs. Dash 1 ½ tsp. sea salt black pepper ½ tsp. garlic powder

Cook your pasta and drain. Rinse immediately with cold water to stop the cooking process. Drain again and place in a large bowl. Drizzle with a few tablespoons of olive oil and mix to prevent sticking. Add remaining ingredients and toss again with the dressing until it is evenly distributed. Chill 3-4 hours before serving.

Our featured business of the month is Crist Containers. I was completely blown away by the innovation that is being done in the shipping containers business. The options for use are endless. I talked in depth with the owner, Gus Crist about his new business.

When did Crist Containers become a business?

I started in 1994 in the shipping container business with steamship liners. I worked for 15 years with Triton selling shipping containers in North America. I started Crist Containers in Point Pleasant in 2013 with access to steamship lines, again, all over North America. We started out as a wholesaler, selling 50 containers at a time. Fast forward to today, we rent or sell standard 8 foot by 20 foot airtight containers anywhere in the Tri-state area. But, we are also designing homes, tiny homes, offices, restaurants, coffee houses, produce and growing houses, refrigerator boxes, ….all built to spec. These units can easily be built out with electric, heating and air conditioning, water, plus, skylights, windows, doors, separate rooms, siding, whatever is needed to make it look the way you want it. The pictures are proof of what these steel containers can look like.

What is the benefit of using steel instead of typical building products?

One of the huge benefits of steel is that it can last 30 years with one coat of marine grade paint. We use Hempel paints. Plus, steel doesn’t absorb any allergens. One of our clients’s needed a non-allergen absorbing material, which steel is, for her living space. Above all that, you are recycling steel. Even unpainted, steel is a material with years of sustainability.

I see all the modifications you are making here, they are so innovative. What are you working on as we speak?

Our containers are currently being modified for farming, microbrews, police and fire departments, coffee house kiosks, offices, and much more. The storage and space options are endless.

You mentioned a favorite type of modification you are working on…what’s that?

Next on my list of upcoming modifications is the self-contained tailgate/dj/dance party modification. The space can be designed to have DJ equipment, a bar, pullout dance floor and much more. All built in and ready to roll to your event.

Parental Guidance Back to School Basics By Maureen Whelan

It’s mid-August at the Jersey Shore and throngs of people are still bustling about our towns and crowding our beaches. It’s hard to imagine that in a few short weeks the crowds will dissipate and our kids will be heading off to a new school year. While many children are excited for school to start, they can still benefit from some assistance in transitioning to this change in their routine. If you have a child who is less than thrilled about the idea of school, it is even more important to provide structure and assistance in dealing with this change. Schedule Adequate Shut Eye — Start by understanding how much sleep your child requires. Sleep schedules should be changed gradually, so if you currently have a night owl, begin waking him up 15-30 minutes earlier in the morning so that he will be tired earlier in the evening. The National Sleep Foundation released the following guidelines** for sleep. Toddlers (1-2 years old): 14-17 hours of sleep Preschoolers (3-5 years old): 10-13 hours of sleep School age (6-13 years old): 9-11 hours of sleep Teenagers (14-17 years old): 8-10 hours of sleep Adults (18-64): 7-9 hours of sleep Get Organized — Establishing routines before school starts will help your child understand his expectations, and decrease stress overall. Use calendars and charts to provide visual reminders of routine activities. At least a week before school starts, have your child wake–up early, get dressed, eat breakfast and brush his teeth before you start your day.

Talk About the Family Plan — This is especially important if back-to-school involves changes for other family members. Will your child be riding the bus without an older sibling? What is your emergency plan? Is a parent returning to work? Talk about aftercare, who is meeting your child at the bus, and what days are “OK” to schedule a play date. Routines will decrease before and afterschool meltdowns if adhered to. The Week Before — Avoid telling your child, “Don’t worry”, as this may add to feelings of insecurity. Acknowledge that it’s normal to be nervous when starting new activities Reassure your child that you wouldn’t send him someplace you didn’t believe was safe. Talk about positive new experiences that might interest him, and share your own positive experiences about school. Make a point to attend orientation days for new students as these can provide a great deal of helpful information and put your child in contact with positive peers and adults in his school. Explore age appropriate stories, such as The Kissing Hand by Audrey Penn- it’s a personal favorite for preschool to kindergarten age children. First Day of School Jitters — This is normal, but you need to put on a brave face yourself, if you want to convince your child he will be fine. Remember that transition develops your child’s social growth, knowledge and security. Make your separation brief and remind him of how you can’t wait to hear about his day. Plan some down time to reconnect after school so he can process his experiences with you. **These are revised guidelines originally published in SleepHealth, February 2, 2015.
