CóMO REALIZAR TU PEDIDO A HISBALIT En el pedido deben de precisarse todos los datos de identificación del producto. Los pasos a seguir son: 1 - Elige la colección de nuestro catálogo, y dentro de ella una referencia de color (UNICOLOR, NIEBLA, AQUALUXE, CENEFAS, etc… y sus referencias y modelos, por ejemplo MAR, CAPRI, SICILIA etc...) 2 - Elige un formato. (2,5x2,5, 4x4 o HEXAGONAL). 3- Elige un acabado (brillo, antideslizante ó antideslizante B3). 4 - El sistema de pegado del mosaico será siempre HTK. Para sistema de pegado en papel, consultar con el departamento comercial. 5 - Detalla los m2 del pedido, siempre en cajas completas. 6 - En caso de duda consultar nuestro packing list en los catálogos, tarifas o en la web. 7 - Envía tu pedido por email a: ventas@hisbalit.es Te recomendamos encargar una cantidad de HISBALIT para una extensión un 10% superior a la superficie que se vaya a revestir. Esta cantidad se deberá calcular de manera exacta en el momento del pedido, puesto que en caso de tener que efectuar un pedido posterior de ampliación, no existen garantías de que el producto disponible resulte perfectamente homogéneo en tono y calibre al utilizado hasta el momento. También te recomendamos conservar, al final de la colocación, algún m2 para posibles reparaciones o arreglos en un futuro.
HOW TO PLACE AN ORDER TO HISBALIT We must specify in the order all the material identification data’s, the steps to follow are: 1/ Choose the collection from our catalogue then choose the color reference (UNICOLOR, NIEBLA, AQUALUXE, BORDERS, and its reference models MAR, CAPRI, SICILIA etc... 2/ Choose a format (25x25, 40x40, Hexagon) 3/ Choose a finish (Glossy, Non-slip, ….etc). 4/ Adhesion system will be HTK. 5/ Always detail the order m2 in complete boxes, in case of doubt, check the packing list and the prices either in our catalogue, price list or web. 6/ In case of special orders clearly specify all the characteristics that were agreed with our commercial department. 7/ Send an email to export2@hisbalit.es We highly recommend ordering an amount of Hisbalit mosaic enough to cover a 10% more than the real extension of the surface to be covered; this amount must be exactly calculated at the moment of making the order because in case of a further ordering for more material there is no guaranties that the available product is completely homogeneous in shade and clarity with the one from the original order It is also convenient once the placement work is finished to keep some sqrd. meters (m2) for any possible repairs.

Export ex-works prices. Prices in euros per squared meters (€/m2). VAT not included.
Precios para material situado en PENÍNSULA. En los pedidos INFERIORES a 150 € (IMPORTE NETO del pedido) se cargarán 16 € adicionales en la factura. Los portes no llevan descuento. Solo se aceptarán pedidos por email a: ventas@hisbalit.es o pedidos realizados a través del área de cliente (http://clientes.hisbalit.com/) Hispano Italiana de Revestimientos S.A. (HIRSA) confirmará la aceptación de estos pedidos por los mismos medios. Tanto el envío como la facturación se ajustarán a las condiciones acordadas en los apartados anteriores. Existen certificaciones técnicas de los materiales a disposición de los clientes que lo soliciten a nuestro departamento de calidad (Teléfono: +34 942 578 006). HIRSA no se responsabiliza de los costes generados por la anulación de los pedidos que ya hayan sido aceptados. Las anulaciones por anomalías o defectos de fabricación habrán de ser pactadas y deberán contar con el expreso consentimiento de HIRSA. El revestimiento vítreo HISBALIT se suministra emplacado sobre HT-K o papel y embalado en cajas de cartón. No deberá ser almacenado a la intemperie ni en locales muy húmedos. En ese caso, HIRSA no es responsable del deterioro que el producto pueda experimentar.

(HIRSA) will confirm orders using the same form of communication. Both shipment and invoices will conform to the above conditions. Clients may request our technical specifications by contacting our Quality Department (Telephone: +34 942 57 80 06). HIRSA does no accept responsibility for costs resulting from cancellation of previously accepted orders. Returns due to anomalies or manufacturing defects must have the prior authorization of HIRSA. HISBALIT tiling is supplied glued on HT-K or paper and in cardboard boxes. It should not be stored outdoors or in damp locations. HIRSA will not accept responsibility for damage caused by improper storage.

Las pérdidas, retrasos o roturas de materiales deberán reclamarse a la agencia de transportes antes de aceptar la mercancía, aún cuando ésta vaya a portes pagados.
Claims for product loss, damage or delays must be made to the shipper before shipment is accepted, even if transport is paid by HIRSA.
No se admiten devoluciones. En caso de que HIRSA admita una devolución motivada por causas no imputables a defectos de fabricación o errores de expedición, el cliente correrá con los gastos de transportes, tanto de envío como de retorno. La devolución de las mercancías solo será admitida si se produce dentro de los tres días siguientes a su recepción, siempre que estas se encuentren en su embalaje original y estén en perfecto estado de conservación. Previa autorización de la devolución mediante documento de RMA. Las notas de abono correspondientes a devoluciones aceptadas por HIRSA se extenderán sobre los materiales recibidos en fábrica en perfecto estado. No se admitirá ninguna reclamación para material ya colocado. Es responsabilidad del cliente comprobar las cajas antes de su instalación. En caso de reclamaciones en materiales ya colocados, no deberá realizarse ninguna modificación previa a la visita de nuestro equipo técnico, salvo autorización escrita por parte de HIRSA. Las operaciones de compra, independientemente del lugar de entrega de la mercancía, se entienden realizadas en el domicilio social de HIRSA. El vendedor se reserva el derecho de seleccionar la vía y el medio de transporte. Los gastos adicionales debidos a indicaciones de envío especiales por parte del comprador correrán por cuenta de este. Reserva de dominio: El comprador no adquirirá la propiedad de las mercancías hasta que no haya pagado todo el precio del objeto de la compraventa o suministro. Mediante la confirmación de cualquier pedido, el cliente se somete a la jurisdicción de los jueces y tribunales de Santander, con renuncia a su propio fuero.
No returns allowed. In the event that HIRSA accepts a return due to causes other than manufacturer’s defects or shipment errors, the client will be responsible for all shipping costs. The return of materials will be only accepted if it happens during the period of time of three days since the receipt of it, always in the original packing and in perfect shape of conservation, with previous authorization by means of RMA document. Credit notes for returns accepted by HIRSA will be issued upon reception of materials in good condition. No claims will be accepted for materials already installed. It will be the client’s responsibility to check all boxes prior to their installation. Regarding claims about materials already installed, no changes should be made before the visit of our technical team without written authorization from HIRSA. Purchases are considered performed at the registered office of HIRSA, regardless of the place of delivery of the materials. The seller will keep the right to select the ways and means of transport. Any additional expenses due to special delivery indications made by the buyer will be assumed by him. Retention of title: The buyer won’t acquire the property of the materials until he has payed for the total amount of the object of sale or supply. The confirmation of any order will entail that the client expressly submits himself to the authority of the judges and courts of Santander, Cantabria, Spain waiving his own jurisdiction.

ALGUNAS NOTAS ANTES DE REALIZAR EL PEDIDO DE HISBALIT ¿CUANTO MOSAICO DEBO ENCARGAR? Para decidir la cantidad de HISBALIT que hay que pedir debemos de tener claro: 1 - La extensión de la superficie que vamos a revestir 2 - Haber establecido la técnica y el dibujo de colocación. Deberemos tener en cuenta que: Algunas placas de HISBALIT deberán ser cortadas para rematar esquinas, mochetas y otras zonas, por lo que deberemos prever cierta cantidad de material sobrante. Tal cantidad dependerá de las características de las superficies a revestir, en particular de la existencia de irregularidades y de la técnica de colocación. Es conveniente conservar, al final de la colocación, algún m2 para posibles reparaciones o arreglos en un futuro. También será conveniente para disponer en caso de reclamación de una muestra representativa del material. Recomendamos encargar una cantidad de HISBALIT para una extensión un 10% superior a la superficie que se vaya a revestir. Esta cantidad se deberá calcular de manera exacta en el momento del pedido, puesto que en caso de tener que efectuar un pedido posterior de ampliación, no existen garantías de que el producto disponible resulte perfectamente homogéneo en tono y calibre al utilizado hasta el momento. ¿CÓMO COMPROBAR QUE EL SUMINISTRO ES EL CORRECTO? En el pedido deben de precisarse todos los datos de identificación del producto. Los pasos a seguir son: 1 - Elige la colección de nuestro catálogo, y dentro de ella una referencia de color. (UNICOLOR, NIEBLA, AQUALUXE, etc….) 2 - Elige un formato (25x25, 40x40, Hexagonal) y un acabado (brillo, antideslizante, antideslizante clase 3). 3 - El sistema de pegado del mosaico será siempre HTK. Para sistema de pegado en papel, consultar con el departamento comercial. 4 - Detalla los m2 del pedido, siempre en cajas completas. En caso de duda consultar nuestro packing list en los catálogos, tarifas o en la web. 5 - En caso de pedidos especiales detallar claramente todos las características acordadas con nuestro departamento comercial. LA CALIDAD 1ª está definida dentro de las normas. Concretamente en lo que se refiere a los defectos de aspecto, se admiten como máximo 5 mosaicos con algún pequeño defecto visible por cada 100. (ver norma UNI EN 14411, ap. G) Las calidades inferiores a la primera (2ª, comercial etc) pueden contener un número mayor de defectos. A esta calidad inferior, le corresponde un precio inferior de venta. POSIBLES DEFECTOS Y RECLAMACIONES. Si pensamos la enorme cantidad de mosaico que se venden cada año el número de reclamaciones que se detectan debido a defectos de fabricación son muy pocas. Ello demuestra que por lo general, la calidad de los materiales, el acierto en el proyecto, el esmero en la colocación y el cuidado en el uso y el mantenimiento son tales que garantizan la plena satisfacción del usuario. Sin embargo cuando algo falla pueden aparecer los defectos. A veces se trata de defectos sólo estéticos, en otros casos pueden darse defectos que pongan en peligro la funcionalidad de la superficie alicatada, por lo que no habrá mas remedio que destruirla y sustituirla, con los costes y molestias que ello conlleva. Sin entrar en una casuística detallada de los defectos posibles, a continuación nos limitamos a ofrecer algunos consejos y sugerencias útiles para el usuario. ¿QUÉ DICE LA LEY? El Código Civil, en los artículos en los que se regulan las relaciones contractuales entre el vendedor y el comprador, establece los términos y las formas de la determinada “acción de garantía”, es decir, la acción que el comprador emprende contra el vendedor en caso de que el producto, en este caso el mosaico HISBALIT, no posea las cualidades prometidas o presente defectos. Esta acción de garantía sólo se puede ejercer dentro de un periodo de tiempo y con ciertas condiciones. geral@carvalhoafonso.pt
Concretamente: 1 - En el plazo de un año desde la entrega del material. Al año de la entrega se agota el plazo denominado “plazo de prescripción”. 2 - Siempre que la denuncia se haya presentado en el plazo de ocho días desde la detección del defecto. Estos ocho días constituyen el llamado “plazo de vencimiento”. “Hay un puntito en el mosaico, o un a esquinita despuntada!” Cualquier efecto es efectivamente un defecto. Puede o debe presentarse reclamación por el mismo solo cuando comprometa efectivamente el aspecto o la funcionalidad de la superficie en condiciones normales de uso. Por ejemplo, los efectos que resulten visibles únicamente desde una muy corta distancia, o incluso con lupa o con una iluminación muy especial no pueden ser considerados ni reconocidos como defectos. (ver Norma UNI EN ISO 10545, parrafo 2) “El revestimiento se ha estropeado, así que es culpa del mosaico.” Cualquier defecto en una superficie alicatada aflora siempre en el revestimiento (Los mosaicos se rompen, se caen, etc) pues constituyen la última parte visible de la instalación. Sin embargo esto no significa que los defectos deban achacarse siempre y de todas las maneras al revestimiento existente. Al respecto, no debemos de confundir el “lugar” donde se manifiesta el defecto con la “causa” que lo determina. Del mismo modo que la calidad de una superficie alicatada depende de lo buenos que sean los materiales utilizados, el proyecto, la colocación, el uso y el mantenimiento los defectos pueden ser ocasionados por cualquiera de estos tres últimos. Así por ejemplo un mismo defecto, como el deslizamiento y limpieza de un suelo, puede deberse a: - La mala calidad del mosaico en caso de que éste no cumpla las características técnicas y mecánicas prometidas en los ensayos. - Una elección equivocada del mosaico (serie, acabado etc…) realizada sin tener en cuenta el lugar de instalación. Este caso lo consideramos un error de “proyecto”. - Una colocación efectuada sin un debido cuidado. Por ejemplo una limpieza de la junta demasiado tardía de un acabado antideslizante, o un error en la lechada tapajuntas a utilizar. - Debido a un mal mantenimiento, como por ejemplo el uso de materiales de limpieza químicos excesivamente agresivos o con productos abrasivos. Así pues el diagnostico de los defectos suele ser complejo y todos las partes involucradas, incluido el usuario final pueden estar involucrados. “Me han vendido un mosaico defectuoso, lo he colocado y ahora reclamo daños y perjuicios”. Cuando abrimos los embalajes y nos damos cuenta que el mosaico es defectuoso (de manera evidente) no hay que colocarlos, sino ejercer enseguida y antes de la colocación, la acción de garantía contra el vendedor. (Recuérdese que esta acción prescribe en el plazo de ocho días desde la detección del defecto). HISBALIT no acepta reclamaciones por “defectos evidentes” una vez realizada la instalación. Debe de reconocerse la equidad en esta medida que no contempla sino la prevención de costes añadidos muy onerosos. La sustitución del mosaico defectuoso antes de la colocación comporta únicamente un breve retraso en la obra, mientras que con el picado de una superficie alicatada, extracción de escombros, preparación de nuevas superficies y nuevo alicatado, los costes aumentan de manera exponencial. TRIBUNALES En caso de aparezcan defectos no visibles en un principio, el usuario deberá de dirigirse de inmediato al vendedor y/o alicatador para pedir explicaciones y eventualmente que se tomen las medidas de reparación oportunas. SOME NOTES BEFORE PLACING A HISBALIT ORDER HOW MUCH MOSAIC SHOULD I ORDER? To decide the amount of Hisbalit mosaic plates that we have to order, we must know: • The surface extension to be coated. • Established the techniques and the placement draw. We must have in mind that: Some Hisbalit plates must be cut to finish off corners, quoin and other parts, so we should consider a certain amount of excess material, this amount depends on the characteristics of the surface to be coated specially the existent surface irregularities and the placement techniques. It is convenient once the placement work is finished to keep some sqrd. meters (m2) for any possible repairs; also it is convenient to have a sample of the material in case of any possible claims. We highly recommend ordering an amount of Hisbalit mosaic enough to cover a 10% more than the real extension of the surface to be covered; this amount must be exactly calculated at the moment of making the order because in case of a further ordering for more material there is no guaranties that the available product is completely homogeneous in shade and clarity with the one from the original order. HOW CAN WE CONFIRM THAT THE ORDER IS WELL DONE? We must specify in the order all the material identification data’s, the steps to follow are: • Choose the collection from our catalogue then choose the color reference (UNICOLOR, NIEBLA, AQUALUXE….etc). • Choose a format (25 * 25, 40 * 40, Hexagonal) and a finish (Glassy, Non-slip, Non-slip class 3). • Materials always come in HTK. For products with paper adhesion method type, consult our commercial department. • Always detail the order m2 in complete boxes, in case of doubt, check the packing list and the prices either in our catalogue or web. • In case of special orders clearly specify all the characteristics that where agreed with our commercial department. The 1st quality materials are defined in our norm, specifically in terms of shape defects, is admissible a maximum of 5/100 mosaics with a small visible defect (see the standard rule UNI en 14411, ap, G). The (2nd, commercial etc…) quality material may contain a bigger number of defects and for that there is a lower price for these quality materials. POSSIBLE DEFECTS AND CLAIMS: If we consider the huge amount of mosaic that is sold every year, the claims due to the manufacturing defects are few, which demonstrate the quality of the materials, the success of the project and the great care in the placement, the use and the maintenance all of these, guaranties the full satisfaction of the client. None the less if something goes wrong some defect may appear, in some cases are esthetic defects in others the defects may put in danger the tiled surface functionality, in this case the only solution is to remove it and replace it with all what it brings of costs and inconvenience. Without detailing all the causes that may lead to the possible defects, we will give some useful advice and suggestions for the client. WHAT THE LAW SAYS? The civil code establishes in the articles that regulate the seller and buyer contractual relationships the terms and forms of the action of the guaranty, it means, the action that the buyer commit against the seller in case the product (Hisbalit mosaic) does not has the promised quality or presents any defects, the action of the guaranty can be used into a specific period of time and in a certain conditions, which are: • Within one year since the delivery of the materials. The limitation period expires after the year since the delivery. • As long as the denunciation is filed within eight days since the detection of the defect. “There is a spot in the mosaic or there is a blunt corner in one of the mosaics” Effectively any effect is a defect, the claim for it can or must be filed only when the appearance or functionality of the surface become compromised in the normal use conditions, for example: the effects that become visible only from a very short distance or with a magnifying glass or with a very special illumination won’t be considered or recognized as defects. “The covering has been damaged and it’s because of the mosaic.” Any defect in the tiled surface always appears in the covering (the mosaics broke, fell…etc) that’s because they constitute the last visible part of the installation. None the less it doesn’t mean that every defect that appears is due to the existing covering, on that subject, we must distinguish between “the place” where the defect has appeared in and “the cause” that has led to the defect. In the same way that the quality of the tiled surface depends on the quality of the used materials, the project, the placement, the use and maintenance, the defects may be caused by any one of them too. Thus for example, a same defect, as gliding and cleaning the floor, may be caused by: - The quality of the mosaic in case that it does not fulfill the technical or mechanical requirements promised in the tests. - A bad choice of the mosaics (series finishes…etc) made without considering the place of installation. This case is considered a project mistake. - A placement made without care, for example a late clean of a non-slip finishing gaskets or a mistake in the used grout cover gaskets. - Due to bad maintenance like: an excessive use of aggressive chemicals cleaning materials or abrasive products. So the diagnose of the defects is always complex and all the involved parties including the final user of the product may be involved. “A defective mosaic have been sold, I have installed it and now I am claiming for damages.” When we open the packaging and we realize that the mosaic is defective in an obvious way, do not place them and use the action of the guaranty against the seller as fast as possible(remember that the maturity date of the action of the guaranty is eight days since the detection of the defect). Hisbalit does not accept claims for obvious defects once the placement is done. Equity should be recognized in this measure, which only takes into account the prevention of onerous added costs, the substitution of the defective mosaics before the placement contemplates only a brief delay in the work, while the chop of the tiled surface, the debris removal, preparation of the new surfaces and new tiling, increases the costs in an exponential way. THE COURTS: In case that no visible defects at first appears, the user must immediately contact the seller and\or the tiler to ask for explications and eventually to take the appropriate measures of reparation, in case of lack of satisfaction or a friendly agreement the user may apply for his rights before the competent court. In this case, the client will submit to the jurisdiction of the judges and courts of Santander, waiving his own jurisdiction, this action will carry out the obligation of hiring a trusted lawyer and technicians.
