Well I'm back with another exciting report.

Last weekend, I went to the AzCMC meeting to listen to Double D's talk about the AntiProfiling bill that the state of Washington passed and learned a lot. He made us a new and better way of reporting profiling so it can better be dealt with. He also talked about the need to reach out to the independent motorcycle riders who are not already on

And this past weekend there was a meeting of all the lobbyists in Strawberry where we discussed the possible course of action for the up coming session. I will continue to pursue the AntiProfiling bill with JohnnyD from the AzCMC while waiting for direction on a course of action from A.B.A.T.E. of Arizona.

As we are all preparing for Too Broke, please everyone be careful on your way there, remember to hydrate, use sun block because a sunburn can ruin your weekend. I hope you all had a great time at this years’ Too Broke for Sturgis Event!!!

As of this writing the event has not even occurred. I along with many others will be giving a report along with many photos of this year’s event in the September issue of the Master-Link.

Recently I was approached by some of our Member Patch holders. Their question was; Can we change the size and color of ABATE of Arizona membership patch so we can wear it on our club cut? The answer is YES. If your club wants to pay for the patch ABATE of Az. does not object. I took this question before our BOD last year and it was approved for any member club to change the size and color(s) of the patch so long as the club pays for the changed patch.

Well here it is August already. Chapter Coordinators will be seeking volunteers from their members to fill vacancies in their Chapters’. Nominations for chapter officers will start at the August meeting. If your chapter still has officer vacancies now is the time for YOU to seriously think about supporting your chapter in filling those vacancies. Becoming a chapter officer is the first step in supporting, ABATE of Arizona. An organization is only as strong as its membership. Occasionally it may be necessary for one person to hold more than one officers’ position for the chapter, but this should not be an ongoing situation. ABATE of Arizona has approximately 632 members and 55 Business members. (In 2011 ABATE of Arizona had approximately 1000 members). Our organization needs members to support your right to ride free. Currently we have 6 Chapters throughout Arizona. Each Chapter potentially has; Chapter Coordinator, Vice Coordinator, Secretary, Treasurer, Sergeant-at-Arms, Run Coordinator, Safety Coordinator, Communications Officer, Political Action Coordinator (PAC Officer), Membership Officer, Board of Directors Representative and Merchandise Officer. That’s 12 positions each Chapter needs filled. Chapter Officer, positions are for 1 year and many of these chapters have had the same offi-

cers in various positions year after year. When this happens people get burned out. Many chapters’ officers are holding more than one officer position, while some have never held an officer position within their chapter, why?

When members take on more than one position those people have to work twice as hard to fulfill their obligations. Being a chapter officer places you directly in the planning stage for your chapter’s events and decisions concerning chapter business. I personally have found it rewarding and usually fun. If you haven’t volunteered for a chapter officer position give it some thought. The best way is to contact your Chapter Coordinator at your next meeting, and volunteer for an open position. I can almost guarantee an open position in your chapter for next year.

Additionally, this year is State Officer elections. Every State Officer position is open. State Officer Positions are 2 year commitments. The only qualification is that one must have held a Chapter position for at least 1 year. State Officer Positions, are no different than Chapter Officer Positions. No one should have to hold more than one officer position at one time. If you have the minimum qualifications get involved in supporting your Motorcycle Rights Organization by running for an Officer position.

November’s General membership meeting and State Officers Election Rally will be held November 3, 2013 from 11:00 AM until 3:00 PM. Location will be at Kid Chilleen’s on I-17, Black Canyon City. * ACMC meeting was held at the Alma Clubhouse. Speaker Double D from Seattle Washington spoke about the anti-profiling law. *Handle bar height. *Ethanol in AZ, still at federal level. *Lane splitting. Lanes vary in size making passage of a Lane Splitting Law for motorcycles more difficult in Arizona. Currently there is no width standard for traffic lanes. *Left turn arrow traffic lights are governed by municipalities. Scottsdale uses a left turn arrow after a red light. Other Municipalities currently do not have Green arrows following a red light. Traffic planning department handles the programming of the lights. ENGINE NOISE - REASONABLE IS AS REASONABLE DOES

Q. I live in an apartment complex in St. Charles, Illinois. I pay my rent and follow the rules. I am a good tenant and have an excellent job. Here is the problem. My lease says that I can not have a motorcycle in the complex unless I get prior written consent from the apartment manager. With the price of gas, I want to ride my motorcycle and park it in the complex. I put on my best face when I paid a visit to the apartment manager seeking permission to ride my bike onto the apartment parking lot per the lease. I even offered to shut the engine off outside the boundaries of the complex and push my cycle to a parking place. I have never given the manager any problems and there has never been a complaint about me. I did not even get to first base as the manager refused to give me permission to park my motorcycle in the complex. I do not believe the apartment management is being reasonable. What can I do? What about the Fair Housing Act? Isn’t this discrimination? Robert Swisher, ABATE MEMBER.

A. It is discrimination, but remember that not all types of discrimination on private property is against the law. You have a better argument under the lease. In Illinois and most states your contract/lease presumes that the parties to that document are dealing in good faith and are being fair. Your lease allows motorcycles, IF you get written permission. When you signed the lease, it was reasonable for you to believe that the land-

EMISSIONS TESTING NO LONGER REQUIRED FOR MOTORCYCLES The U.S. Environmental Protection Agency has dropped its requirement that Phoenix-area motorcycles undergo annual emissions inspections, the last place in the country to require such testing. The federal agency has approved a request from state environmental officials in Arizona that motorcycle tests be discontinued, effective immediately.

lord would not unreasonably withhold permission for you to park your motorcycle in the apartment complex. You have not had any noise or speed infractions. For the apartment owners to arbitrarily withhold permission to park your motorcycle on the complex property is unreasonable and is a violation of the lease. But you have gone even further than the lease requires by offering to shut off the engine and push the bike onto the property. That defines your fairness and good faith. If the complex had wanted to bar all motorcycles from the property, they could have said so in the lease. They chose not to and by allowing motorcycles with permission, implied that they would except motorcycles from those who operated their cycles in a reasonable fashion. My recommendation is that you take a copy of this article and have a talk with them about how good a tenant you have been and that they should give you a chance to prove it. If they have questions, have them call me on my cell 317 727 4599, and I will do my best to appeal to their better angels. I have a feeling they will go along with the program.

STAND YOUR GROUND IN ILLINOIS?

Q. I just had a bad experience with a motorist who went after me with his vehicle. I was on my bike and almost replied in kind, but cooled off and let it go. For a minute, I thought the guy was going to kill me. Does Illinois have a “stand-yourground” law governing the right of self defense?

A. Illinois does not have a so called “standyour-ground” law on self defense, but Illinois and about 25 states that do not have the “stand-your-ground” law, permit individuals to use deadly force if they believe they or others are in imminent danger of bodily harm. Without a “stand-yourground” law and you use deadly force to defend yourself or others outside your home, odds are that the prosecutor will be tempted to pass the buck and have your case reviewed by a grand jury - not a good place to be.

HOOSIER MOTORCYCLISTS GETS WEDGED BETWEEN THE DUALS AND A HEATED FUEL TANK - A CROCK POT LIKE EXPERIENCE

Brandon Allen had a bad day a few months back. On the way to work a semi driver pulled his truck into Brandon’s path of travel. With nowhere to go, he actually managed to wedge his motorcycle between the semi’s left duals and the heated fuel tank. Did I say “heated fuel tanks?” A well cooked and busted leg followed with weeks of hard core rehab. He did a great job of avoiding a more serious injury or even death. As Isaac Newton once said, “Whatever you hit, hit it as slow as possible.” Maybe he did not say those exact words, but you get the idea. As in many motorcycle cases, when the person who causes the problems has nothing else to say, they always cry speed - always. I guess they feel compelled to say something - anything. These are what I call excuses for their screw up. Well in this instance, we had a secret weapon as to their charge of “speed” on Brandon. It seems Brandon’s

The request to drop the testing requirement came in response to a 2008 state law requiring the Arizona Department of Environmental Quality to do an analysis of pollutants emitted by motorcycles and make a proposal to the federal agency. “Our analysis has determined that the cost and inconvenience is not providing a significant environmental benefit,” said Trevor Baggiore, deputy director of air quality at ADEQ.

Even though motorcycles account for 3.5% of vehicles on the area’s roads, the department’s analysis determined that

they emit “insignificant” amounts of pollution, accounting for less than 1% of total emissions in the Phoenix metro area.

Pima County (Tucson) and Maricopa County (Phoenix) were the only areas in the United States that required motorcycles to pass yearly emissions inspections at a cost of $19 per test, and Pima County halted motorcycle testing in 2007.

During intense negotiations with the adverse insurance company, the adjuster convinced herself that speed was a cause of this crash, and on, and on she went. At a meeting with this adjuster, we let her ramble on about it without interruption. Then the time came for our secret weapon Brandon’s mom. Remember all of that speed claimed by the insurance company? At the scene, mom calmly walked over to the motorcycle, started it, backed it out of its wedged position and drove it up the ramp of the trailer that she had towed to the scene. Some even said she could have ridden it to California in its crashed condition. I looked at the adjuster and invited her to explain to a future jury all about this excessive speed and gave her a few snippets of what I would say to them along the following lines. “When have you ever heard of a motorcycle crashed at excessive speed that incurred so little damage, the mom of the rider was able to do what she did in this case? I told the adjuster that I would suggest that the speed story was a bad case of excuses and that more likely than not, they would feel like the insurance company was trying to hoodwink them into believing something silly. When I suggested that the jury would get mad at them, the case settled.

East Valley Chapter

Our last chapter meeting was held on Sunday, June 23rd at the Fraternal Order of Eagles (FOE), 1712 W. Broadway Road in Mesa. “The Eagles” new home is shaping up nicely and worked out great for our annual Spaghetti Feed dinner held Saturday, June 1st. We sold about 90 dinners. With all of the components and ingredients being donated by our generous members, we raised $836 for our chapter. Our Vice Coordinator/P.A.C. Officer Mary K., will be attending the MRF conference “MEETING OF THE MINDS” in Columbus, OH to be held Sept. 26-29, 2013. The chapter voted to reimburse her up to $750 of actual expenses incurred for hotel, airfare and conference fee. Jim Silk is also considering attending this conference, if work permits.

By sponsoring members to attend these national conferences; 1) we help support the MRF and national motorcycle rights 2) We educate our members on current events/issues 3) Attendees learn how to deal with legislators and current issues 4) Invaluable resources and partnerships are made 5) It invigorates those members to continue in ABATE and be leaders/officers, perpetuating our existence. The goal of each chapter should be to send at least ONE OFFICER to Meeting of the Minds every year. It’s is a worthy investment.

With TOO BROKE FOR STURGIS coming up next month, we reiterated our chapters’ responsibility Friday morning 7:30 a.m. – 12:30 p.m. However, whenever a volunteer can contribute some time, we can use the help to relieve another volunteer. Phoenix/Shadow Mountain Chapter

Our July meeting was called to order at 10:30. Attendance was very good. We also had several guests and 2 people transferring from another state. The meeting was relativity short due to the planned TBFS packet stuffing that followed. Since the Senate and Congress are in break there was not much PAC news, however we did discuss the push for a federal antiprofiling bill. There is a new simplified form to use if you are involved in or witness profiling. It should be available on the website soon. Also get video of profiling or other incidents if possible. Following the meeting we prepared over 2000 packets for Too Broke for Sturgus.

We opened our meeting with a remembrance of the fallen hot crew from Prescott. This greatly affected the entire community and really brought a lot of people together to grieve and give thanks to the brave men who gave all in an attempt to save the people of Yarnell. Thanks to all the M/C community for standing up to the Westboro assholes who dared to defame the fallen 19 at the vari-

Good news from our treasurer Paul. The Run to the Hills event made a profit. Mostly thanks to the Ruger 1911 raffle. We did our best to not conflict with other events, and ended up having the event later than we wanted, and it was hot. Thanks those of you that did attend to support our cause. We have had our last two meetings at Doreen's in Chino Valley and would like to thank them for their hospitality and great service. Our August 11th meeting will be held at the Gurley Street Sports Pub located on 801 E. Gurley in Prescott. Our meeting was mainly centered on our fall membership run planning. The run will be held on October 6th and will have the Grand Canyon Caverns. This will include a significant portion of the ride on historic Route 66.

The monsoon has hit in Prescott, and 44Dan gave a timely safety report on how to ride in wet weather. He detailed some the dangers of aqua planning, and how to prevent it from happening and what to do if it happens to you. This is one time in which speed can definitely kill or significantly alter your life, not to mention your scooter. Stay safe and aware always.

Treatment for Heat Exhaustion

- Drink plenty of fluid (avoid caffeine and alcohol). - Remove any tight or unnecessary clothing. - Take a cool shower, bath, or sponge bath. - Apply other cooling measures such as fans or ice towels.

Q. Rod, on 6/26 of this year, I was involved in a accident on my motorcycle going south on Broadway in Alton. As I was riding by the TEN PIN LOUNGE a patron of the establishment backed out into the street into the side of my motorcycle as I rode by. Only by the greatest of luck I did not go down. I was able to control the low speed wobble and bring my motorcycle to a stop. The motorist was sorry that he hit my bike and was not too happy when I called the Alton city police. He was issued three tickets; expired sticker on his plates, expired insurance card, and improper backing. I got the police report today after work and found out he did not have insurance. I would like to know my options. ABATE MEMBER.

might be able to use a good watch as well. Since he has admitted fault, he may be more than willing to try and do the right thing. Find out where he works. If you get a judgment against him in small claims court, you can garnishee his wages. Let him know you have a lawyer to guide you through this. Get an estimate for repairs and present it to him. He might pay it, or at least make payments. If he agrees to make payments, have him sign a note. We have a form that you can use. He may even agree to a judgment with interest and attorney fees if he fails to pay. Check the internet as to real estate he may own. If he owns this property in his name, you have leverage in getting your damages paid. Don’t forget that Illinois law and most states allow you to collect for loss of use, so calculate the reasonable rental rate for your bike and the time it is down for repair - tis the season. PLACES TO RIDE BEFORE YOU DIE GETTYSBURG AND PICKETT - THE CHARGE THAT MADE US AMERICANS.

As I write this, Pickett made his famous charge exactly 150 years ago to the hour. As many of you have heard me say, “All good Americans should ride to Gettysburg before they die”, and take your children, friends and anyone else you can talk into going with you. You will never forget it. Having been there myself around a half dozen times, I can say first hand that every road into and out of that place is wonderful on a motorcycle, and for that matter anything else with wheels.

The Wall Street Journal, in an article just last week, reminded us how special this place is, was and will always be. It seems that on the 50th anniversary of the battle in

1913, 50,000 of the survivors of that battle made it back to camp out and visit with each other, North and South. The world had never seen such a gathering of veterans of a particular battle before. Most were in their 70s and 80s, and eight of them died during the week of the reunion. Since 1863 this place and Lincoln’s two minute speech have largely defined what it means to be an American. Appropriately, over 200,000 visitors are expected to be on hand to celebrate the 150th anniversary of this battle. That says it all about the meaning of that place.

While I am on the subject, I have a theory on Pickett’s charge. If Lee had followed this advice, I suspect that we would have had a divided United States if that charge had been successful. If so, the Union Army would have been routed, Congress would have requested a truce, and the South would have done its thing as would have the North. Here is the theory. In 1863

Alma Adams (D). "No input from stakeholders, no public scrutiny, no transparency, no fiscal note."

The final vote was 74-41 on July 13; the bill now heads back to the GOP-led state Senate for approval, then on to Governor Pat McCrory (R) who says he will sign the measure into law if it reaches his desk.

After a lengthy public hearing and receiving input from the community, Bill No. 87 “Limited Helmet Law” passed unanimously, and also requires new riders to first complete a defensive driving/motorcycle safety education course prior to being licensed and prohibits licensees from operating a motorcycle or scooter of larger engine size than that which they take the motorcycle exam on. In order to operate a motorcycle with a larger engine, the operator must apply and test for a new license under that engine size.

"Our members have reported an increase in motorcycle tourism since the enactment of the rider choice law," added Scott Ellis, executive director of the Michigan Licensed Beverage Association, which represents more than 1,800 restaurant, bar, party store, hotel and casino establishments across the state. "From Monroe to Muskegon to the Keweenaw Peninsula, more out-of-state motorcyclists are stopping, staying and spending money at our restaurants, hotels and attractions," he told the Midland Daily News.

AMENDED HELMET LAW HAS POSITIVE ECONOMIC BENEFIT IN MICHIGAN Changes last year in Michigan’s mandatory helmet law have had a positive effect on motorcycle riding in Michigan, according to ABATE of Michigan. There has been an increase in motorcycle travel in Michigan since April of 2012, said ABATE in a recent press release.

Motorcycle sales also are up in Michigan, and ABATE says that 2012 was the safest riding season in 10 years for licensed motorcyclists in the state.

Napoleonic tactics were king - the bible so to speak with generals. Night warfare was an enigma; avoided like the plague. For good reason; no one knew where anyone was at night. Lee followed this maxim and decided to attack the Union center with a daylight, high noon frontal assault - Pickett’s charge. The yankees held Cemetery Ridge, and the rebs, were charging from Seminary Ridge, about 1.5 miles South of the yankee position. Between them, Emmitsburg Road crossed and lay in a depression that the yankees could not see. On both sides of the road were unexpected well built split rail fences, like the unexpected hedgerows faced by our troops in Normandy on D-Day.. Meaning that Pickett’s troops, during the actual charge, had to stop at the first fence, crawl over it or try to disassemble it, cross the road, and then do the same thing on the other side. Imagine what that does to the enthusiasm of several thousand troops on a charge of over one mile?

Here is what Lee could have done. At around 3 a.m. on the morning of July 3rd, send out the caisson horses and mules to hook onto the split rail fence; a few ropes and tugs and you are done. Then remove 1200 yards of that fence so the path to the Union position is wide open for the charge the next morning at just before dawn. While the yanks can hear you, it is dark and they can’t see you. Besides they were scared to death and would not coming out from behind their fortifications. Next, you say hell with the rules on night warfare and send Pickett’s men to lay down in the road an hour before daylight. Remember,the yanks can hear you but they can not see you. At night all Pickett’s men had to do was to go to the road from their position on Seminary Ridge. To those naysayers about not being

able to see where they are going, reply: “ it is easy; go till you hit the road right in front of you and lay down”. Remember that road lays in a depression - almost impossible to hit with artillery, and the yanks could not see them anyway. At 15 minutes before daylight, order Pickett’s men to stand up and charge. They are already halfway to the Union center and had not suffered one casualty. Contrast that with what really happened. Under the new plan, you have the cool of the morning and there is no fence to deal with. All you have to do is rebel yell yourself silly all the way to Union center. I say the Union center would have been overwhelmed and Lee would have had another brilliant victory. As a postscript, the South almost took the Union center doing it Lee’s way. MOTORCYCLE CLUB SUES CITY OVER DISCRIMINATION A local motorcycle club said it was just doing things by the book when it filed a permit to hold a BBQ fundraiser at a local park in Rio Vista, California, but the city and the police chief turned that simple request down. Now, the motorcycle club is filing suit, claiming it was discriminated against.

"No one other than us has ever tried to put in a permit," Saxon Creed MC President Rob Anderson told News 10/KXTV. "We thought we were doing the right thing."

Last July, the club wanted to hold its fundraising pig roast at Blackwelder Park, the same park where dozens of other community events have been held. So, the group filed for a permit with the city. But, the request was declined by the police chief and the city.

The group held their pig roast this year without problems at a Veteran's Hall, right next door to the park they applied to last year.

Members of Saxon Creed MC say they feel like the request was denied because they are bikers. The group has filed a discrimination lawsuit, claiming its civil rights were violated. They're suing for $250,000 in damages on behalf of their 15 members. "It makes me very angry," Anderson said. "This is America. We all have rights. I don't like seeing anyone's rights trampled on."

VERTICAL MOTORCYCLE LICENSE PLATE BILL CLEARS PA HOUSE Legislation allowing the vertical display of registration plates on motorcycles was recently passed by the state House and now heads to the Senate for consideration.

House Bill 1060 is sponsored by state Rep. Mark Keller (R-86). “This legislation is specific to motorcycles,” explained Rep. Keller. “Currently, the state vehicle code does not specify how a vehicle registration plate may be mounted. However, regulations in Title 67 of the Pennsylvania Code require horizontal mounting of vehicle registration plates and do not give the option for vertical mounting.”

MORE RULES PROPOSED FOR CANADIAN RIDERS Saskatchewan is considering more requirements for new motorcycle licensees, supervision for new riders and the possibility of mandatory gear. The ideas are among more than a dozen changes to motorcycle safety, training and insurance rules proposed by Saskatchewan Government Insurance as it looks for ways to reduce claims, save money and quell the roar of angry riders.

One suggestion is for potential riders to pass a basic skills test or complete a motorcycle training program before they're issued a learner's license. New riders who don't take the training courses could see an additional $500 a year fee or be restricted on the size of the bike they use.

Helmets and eye protection are currently the law in Saskatchewan and similar rules apply across the country, but no other jurisdiction in Canada has mandatory rules for wearing gloves, anklecovering boots or clothing that cover arms and legs, according to SGI.

The review was launched earlier this year after a proposed rate increase which would have seen insurance costs for motorcycles go up by an average of 73% to cover a $9 million gap between what SGI takes in from motorcyclists in fees versus what is paid out for collisions. The public has until the end of July to

comment on the proposals and SGI is to report to the government in the fall. The goal is to have the new rules in place for next year's riding season.

MOTORCYCLE BAN LIFTED IN PAKISTAN After five years, Pakistani authorities have lifted ban on motorcycle riding in Bajaur tribal region. The ban on motorcycle riding was imposed in 2008 when the Taliban stepped up their activities in the region, and the ban was aimed at controlling insurgency and preventing targeted killings because motorcycles were being used for attacks against antiTaliban forces.

The announcement about lifting the ban was made by Brig Ghulam Haidar, a sector army commander, during his speech through the security forces-run FM radio channel (Radio Aman FM 88). “The lifting of ban on motorcycle riding is a gift for the tribesmen on the eve of the holy month of Ramadan. This good news may enhance happiness of Ramadan,” he said. Brig Ghulam said that imposing the ban on motorcycle riding was a difficult decision but it was taken only in the larger interest of people of the tribal agency. “Owners of custom-made or vintage motorcycles are sometimes reluctant to mount the registration plate horizontally on the rear fender because doing so interferes with the custom paint job or other custom work done on the cycle,” according to Keller. “Many of these owners have approached ABATE of Pennsylvania, the motorcycle advocacy group, about making this legislative change, and ABATE supports my legislation.”

Booming Sales of Novelty Helmets Boost Toll of Motorcycle Deaths

The results were tragic but not surprising last May when Suzanne Randa and her fiance, Thomas Donohoe, crashed while riding Donohoe’s Harley Davidson on Highway 79 near the Southern California city of Loma Linda.

Donohoe, who was wearing a helmet meeting federal safety standards, escaped injury and walked away from the accident. Randa, 49, who wore a so-called novelty helmet that was cheap and stylish but offered no real protection, died at the scene after the strap broke and her head slammed onto the pavement.

“All analyses gave a 100-percent probability of brain injuries and skull fracture, indicating that the person wearing the helmet will sustain fatal head injuries,” the evaluation found. It added: “Motorcycle riders who wear novelty helmets and believe that ‘something is better than nothing’ have a false sense of security regarding the protection afforded.”.

“I just don’t think these helmets should be permitted,” said Randa’s 23-year-old daughter, Kelli Meador, who still has her mother’s scarred turtle-shell headgear.

It remains legal to make and sell novelty helmets as long as they aren’t falsely represented as meeting federal standards. Wearing them is clearly against the law only in a dozen or so states that require motorcyclists to wear helmets meeting the federal standard.

It’s not because the National Highway Traffic Safety Administration, which sets safety standards for helmets, is ignorant of the problem. Six years ago NHTSA

The lack of resolve by NHTSA to tackle the threat troubles doctors, safety experts and families of crash victims. “It is a huge loophole,” said David Thom, an El Segundo, Calif., engineering consultant and helmet expert.

Numerous tests have shown that certified helmets – those meeting federal standards — save hundreds of lives every year, and cut the risk of a deadly accident by more than a third. They are widely considered the best tool available to prevent fatalities. Novelty helmets, by contrast, account for hundreds of deaths. That is contributing to a troubling trend, as FairWarning has reported, of rising motorcycle fatalities in recent years while traffic deaths generally have declined. The latest federal figures, for 2011, show motorcycle crashes taking 4,612 lives, more than doubling since the mid-1990s and now accounting for one in seven U.S. traffic deaths.

Arguably the most effective strategy in combating substandard helmets has been limited by legislation promoted by rider groups. States including California and Virginia have prohibited state and local police from using motorcycle checkpoints to ticket violators of helmet laws and other rules of the road.

What’s more, even in some states where helmets are required, enforcement is often lax or inconsistent. It typically is left to the discretion of individual officers, many of whom don’t see it as a priority or who have trouble distinguishing the novelty helmets from the certified ones.

Consumer advocates say the situation cries out for changes. “There needs to be more done in eliminating the supply but also in making sure that states with helmet laws are going to crack down,” said Henry Jasny, general counsel of Advocates for Highway and Auto Safety, a Washington-based watchdog group. “People just don’t want to touch it. It is hard to get leadership. It is too political.”

Novelty helmets first became popular as a symbol of resistance in states that required bikers to wear certified helmets. A fight to have California’s helmet law struck down in court was for years led by a man who was repeatedly arrested for violating the helmet law by wearing a baseball cap with a bogus “DOT,” or U.S. Department of Transportation, safety label on the back.

One group, BOLT of California, still takes the position that a state law requiring head protection can be met “so long as you have an object on your head that you claim is a helmet, and it has the letters ‘DOT’ on it.”

But other people also buy the helmets, drawn by the low cost and the misconception that they provide a measure of safety. “I am sure there are lots of people out there who do not appreciate the fact it does not provide any protection,” said Thom, the engineering consultant.

NHTSA’s helmet standard for manufacturers, known as Federal Motor Vehicle Safety Standard No. 218, has been in place since 1974. As with other motor vehicle equipment regulations, it’s enforced through a kind of honor system. Manufacturers determine whether their helmets meet the standard, and attach a “DOT” sticker certifying compliance. The agency conducts spot checks only after the helmets are on the market, with help from independent labs. The numbers of those inspections were halved by NHTSA recently due to budget cuts.

The many helmets that, because of poor performance or false labeling, have gotten failing grades – as many as 30 percent to 40 percent every year – do little to inspire confidence that bad products are kept off the market. (Officials say the percentage is high because they focus testing on suspect helmets.) Critics also say the agency is slow to respond when problems are detected; it issued a consumer alert last year about a helmet made by a California manufacturer that was deemed defective more than three years earlier. (The agency has said that a bankruptcy filing by the helmet firm delayed the notice.) Sales of novelty helmets have climbed

even as the number of states requiring riders to wear helmets has declined. That’s partly because more and more riders are hitting the road. Also, the novelty helmets usually are about one-third the cost of a certified helmet. Some riders find comfort in their lighter weight, even though that is also what makes them dangerous. -

It has also been relatively easy to pass them off as legal. The simple stickers NHTSA has required on certified helmets are easy to reproduce for anyone with a computer and printer, while other counterfeit versions are widely available over the Internet. For example, riders can buy two for a dollar at www.chopperstickers.com. The website says customers are responsible for how they use the stickers. The site’s operator anonymously goes on to tout the product, saying: “I have had one on my helmet for about a year now and it has held up fine in [sic] through all kinds of weather and abuse.”.

A rule that NHTSA hopes will make the stickers harder to copy by requiring that they be more detailed — first proposed during the Bush

Administration — goes into effect in May. Yet people debate the difference the rule will make, and even NHTSA acknowledges it is unlikely to significantly reduce the annual death toll from motorcycle accidents.

NHTSA has estimated that as many as 754 people die each year in states with mandatory helmet laws because they wore novelty helmets instead of safe headgear, which amounts to nearly one in six rider fatalities nationwide. Yet in the 19 states that require riders of all ages to wear some form of protection, the novelty versions account for about one of every five helmets sold.

Cheap imports from Asia have dominated the novelty market in the U.S., even as some Asian governments have started cracking down on the headgear in their own countries. Another big distributor of novelty helmets, Voss Extreme Sports, is based in the Canadian province of British Columbia. Concerned about rising deaths, provincial officials last year banned motorcyclists from wearing novelty helmets.

Novelty Helmets are sold over the Internet by companies with names such as “Helmets Gone Wild” and “Iron Horse Helmets.” Iron Horse sells German World War II-styled novelty helmets, available in camouflage, gun metal, leather and chrome finishes; a “Bone Yard” model with skull-and-crossbones design, available in pink, blue and red; and a “Gladiator” helmet with spikes. Prices start at around $30, and top out with a glittery three-quarter shell model for $305.99 that resembles a ’70s disco ball. Marketers of novelty helmets are unapologetic, dismissing safety concerns and saying they simply are accommodat-

ing consumer demand.

Todd Sobel, the founder and president of Birmingham, Ala.,-based Iron Horse, says that people who buy his helmets know what they are getting into. Most of his helmets, he says, are sold to people in states that do not require headgear, and who just want to look good. “They are not bought for safety. They are bought for style,” he said. He also makes the muchdisputed assertion that the headgear provides at least some protection for people who otherwise would not wear anything on their head. Novelty helmets are usually sold with disclaimers that they are not intended for highway use. But NHTSA is skeptical. The agency said in a notice two years ago that novelty helmets are “minimally used” by groups other than motorcycle riders, and are often sold online on the same websites as motorcycle gear. Its authority to regulate novelty helmets appeared bolstered last year by a change in federal law that puts motor vehicle equipment sold “with the apparent purpose” of safeguarding users within its jurisdiction. The agency seemed to be getting serious about novelty helmets in 2007 when it subjected seven popular brands to testing by an independent lab. Six of the seven models, distributed by such firms as “Helmets R Us” and “Helmets, Etc.,” failed every phase of the three-part evaluation. In some cases the products allowed more than twice the legally permissible energy impact to the head from a hard fall. Much of the problem was due to the flawed design of the outer shell and flimsy liners inside. But the straps didn’t work, either, separating on impact — meaning that even if the helmets were more substantial, they were unlikely to stay on a rider’s head and provide critical protection during a crash.

Since April 2011, NHTSA says, it has considered developing a rule to crack down on the importation and distribution of novelty helmets. The agency has gone so far as to set an internal timetable for issuing a proposed rule and obtaining public comment. But it has twice postponed plans, most recently citing a need for “additional coordination.” The agency now says it intends to submit a proposal for review to the Office of Management and Budget by late this month. Meanwhile, around the country, people continue to die and suffer grievous injuries. In Vermont, Jeff Miller, a truck driver who taught helmet safety for a local Harley dealer, crashed his bike into the back of an SUV last September, suffering multiple skull fractures; he was wearing a novelty helmet. “It is not like he didn’t know that the helmet he was wearing was not safe,” said his wife, Dawn. “He thought it was cool.” His medical bills already total more than $500,000 with more surgery and therapy to come. The family is looking to

California has also seen a rise in accidents involving novelty helmets. “It’s a trend we see quite often up here,” Ariel Gruenthal, deputy coroner in Northern California’s Humboldt County, said of a surge in novelty helmet- related deaths last summer. “We have had straps rip, helmets pop right off.”

“I realize it is a very personal decision, and a lot of people who ride motorcycles don’t want to be wearing a helmet at all, so they wear the bare minimum,” Gruenthal said. “I really encourage people to think about their safety and think about their family and everybody who will be left behind if something happens.” Randa was a free spirit, who got married as a teenager, divorced, and then lived for a time raising her family on a chicken ranch. She told friends the best job she ever had was working the graveyard shift as a waitress at Denny’s. In a tragic irony, the father of two of her children was killed years ago in a head-on collision on the same road where she perished, just a few miles away. According to her children, she struggled with alcohol, drug and gambling addictions, but lately seemed to have found happiness with Donohoe, 69, a retired electrician.

Motorcycles were a new adventure, and the experience both exhilarated and terrified her. “My mom was not what you call bike literate,” said Meador, her daughter. “She said it was fun. But then there were a couple of times when she said it was scary because [Donohoe] drove like an idiot. … She loved being on the back of the bike.” Donohoe was headed to a doctor’s appointment at the VA hospital in Loma Linda when the crash occurred. “He was basically cutting through traffic, misjudged a car … and went down,” said Darren Meyer, a spokesman for the California Highway Patrol. “As she tumbled down the road she took more impacts. … He did not even go to the hospital.” Meyer said the choice of helmets “absolutely” made a difference in their fates.

Randa’s son, Tyler Meador, built a sevenfoot cross, which he erected as a memorial near the crash site, with handprints of three of her children, in turquoise, her favorite color. Her children, to cover the cost of her funeral, raised money through an appeal on the Internet.

Donohoe was charged with vehicular manslaughter and with having a provisional motorcycle permit that did not allow him to carry passengers. He said he had purchased the novelty helmet from a roommate. “I tried to get her to get a helmet like mine,” he said, but Randa did not like how she looked in the DOT-certified helmet. “Of course I feel a sense of responsibility,” he said, adding that he has a new point of view about novelty helmets following the tragedy. “I think they should be regulated. I don’t think they should ever be sold, period.”

Motorcycle medics saving lives by reaching patients faster SALT LAKE CITY — When there's a medical emergency, seconds can make the difference in saving a life. And because of that, the Davis County Sheriff's Office is putting its paramedics on motorcycles, ensuring they're first to the scene to treat the patient immediately.

Deputy Christopher Pope has been with the Davis County Sheriff's Office for six years, but an average day at work is more than issuing citations, making arrests and keeping the peace. That's because he's also a paramedic.

Pope is part of a select few in the state who are cross-trained to be both law enforcement and lifesaver.

"We can carry everything we need to treat a critical patient and a regular patient immediately, and then we have a partner that shows up in a regular SUV with full gear in the next few minutes," Pope said.

Being on a motorcycle allows the 42 countywide deputy paramedics access in hard-to-reach places like bike paths and extra maneuverability in traffic.

"We've treated someone in the middle of a parade where we had to break off from doing our tricks and go and treat a patient," he said.

The Davis County Motors Division was actually inspired by the Miami-Dade Fire Department where it was able to decrease response times from about 15 minutes down to three minutes. Now the Davis County Sheriff's Office has a similar goal.

Although the department hasn't studied how its response time has improved, Pope said he knows the program saves lives; most recently with a woman suffering a massive heart attack.

"We transported her to the hospital and skipped the ER, and she could go straight to surgery," Pope said. "She came out with no problems at all, no side effects."

The motorcycles are equipped with IVs, an oxygen tank, breathing tubes and pain medication.

"It doesn't look like it can carry a whole lot, but we carry a bit more than what the average person would think," he said.

If Pope comes across an emergency situation where a patient broke the law, the protocol is clear.

"We separate the two. We tell them, look I'm a paramedic. I'm here to treat you, I'm not worried about law enforcement right now,'" Pope said. This helps to keeping the department's main goal front and center and hopefully sharing its idea with other departments. "Treating patients, getting to them fast and getting that treatment on board as soon as we possibly can," he said.

Cases were registered against three motorcyclists also, police said.

In the first day of the drive on Saturday, 84 motorcycles were challaned and eight were impounded.

The drive was a joint effort of New Delhi police and traffic police during which more than 40 check points were set up at India Gate, Mandir Marg, Connaught Place, and others.

"The drive is aimed at stopping youngsters from performing dangerous motorcycle stunts as they are life threatening. Our motive is to ensure safe road environment for the citizens," said Deputy Commissioner of Police (New Delhi) SBS Tyagi.

"Parents should not give vehicles to the under-aged, even grown ups should drive their vehicles responsibly," he said.

There have been a number of incidents in the past in and around India Gate where stunt junkies have either lost their lives or injured others. Even a police constable was seriously injured in a similar incident recently.

A motorcycle racer trying to top 300mph died yesterday after losing control and zooming off a runway at a former air base in northern Maine. Bill Warner, 44, was clocked at 285mph before he lost control, says Tim Kelly, race director for the Loring Timing Association. Warner was conscious and talking after the crash but died about an hour and 15 minutes later, Kelly says.

Riding his modified turbocharged Suzuki Hayabusa, Warner previously hit 311mph on the same course in 2011, using 1.5 miles of pavement. That's considered to be the world land speed record for a conventional motorcycle, Kelly says. "No one will touch Bill's achievements or be the type of racer he was," he says. This time, Warner was trying to hit 300mph using just a mile of pavement. ============================ Harley-Davidson vs. Polaris: Who has better upside?

Harley-Davidson Inc. and Polaris Industries Inc. are unquestionably the American leaders in motorcycle manufacturing and powersports vehicle manufacturing, respectively. But who has the better upside?

Don’t take it personally, Milwaukee, but that would be Medina, Minn.-based Polaris, according to Morningstar Inc. financial analyst Jaime Katz in Chicago.

Katz expects both to maintain their leading market share in their core businesses. For existing rivals to threaten crossing the “moat” and overtaking Harley-Davidson and Polaris, it would require “the introduction of a compelling, innovative product in a new category,” she said in a note to investors this week. Polaris is taking a run at Harley-Davidson in the motorcycle market with the revived Indian Motorcycle, which I blogged about last month. Polaris assembles engines for the Indian Motorcycle at its plant in Osceola, in northwestern Wisconsin. Katz upgraded Milwaukee-based HarleyDavidson’s “moat status” to stable from negative after she bought into the iconic motorcycle manufacturer’s post-recession plan. “While we originally thought Harley would face tenuous headwinds as its core consumer (white men older than 35) became a smaller proportion of the total

Consumer Reports magazine, on its list of "10 motorcycles we most want to ride this summer" didn't include a HarleyDavidson. The magazine has a Suzuki Boulevard C90T B.O.S.S. on its list, and a BMW R 1200 GS. It also has a Triumph Trophy SE and a Star 1300 Deluxe, billed as the "world's first production midsize bagger," but no Harley. Was this too much of an oversight by Consumer Reports not to include even one Harley-Davidson?

Harley-Davidson Adelaide factory to stay open, saving 110 jobs THE world's most famous motorcycle maker, Harley-Davidson, has saved 110 jobs by reversing its decision to close its Adelaide manufacturing plant.

The Advertiser can reveal the Milwaukeebased firm has struck a four-year extension to the lease of its New Castalloy factory at North Plympton as workers voted yesterday to accept a new four-year wage agreement, securing their future. The State Government, which owns the Mooringe Ave plant, waived rent at the site to help secure the deal after months of talks in a major boon for manufacturing in SA. Harley-Davidson had announced in December 2011 it would close the component- and wheel-making plant by the middle of this year .

It has already shed about 90 of 212 workers since that announcement. Harley-Davidson vice president of manufacturing, John Dansby II, said it had determined that New Castalloy can be competitive at producing low-volume, high-finish specialty wheels.

Harley-Davidson saved New Castalloy from extinction in 2006 to secure its supply of wheels and wheel hubs after previous supplier Ion went into receivership in 2004.

It leased the site from the Government, which bought the land for almost $9 million in return for New Castalloy's continued operations guaranteed until November 2011. The firm was producing about 1450 wheels and 500 wheel hubs per day for Harley-Davidson before restructuring began in 2009.

News of New Castalloy's survival came the same day as Manufacturing Minister Tom Kenyon said he feared Holden might close its manufacturing operations in Australia before the end of the year.

Mr Kenyon said New Castalloy now had time to explore future business innovations and staff skills development.

"The employees at New Castalloy are already highly skilled but it's important that people have the opportunities to continually improve their talents," he said. Harley-Davidson had flagged a 2013 closure of New Castalloy to become more cost competitive in face of the global financial crisis.

Australian Workers' Union SA branch president Peter Lamps said workers had overwhelmingly voted to accept a new, four-year Enterprise Agreement, which preserved all conditions, including improved redundancy and shift penalty entitlements and guaranteed annual wage rises of 3.25 per cent. ============================

TEMPE, Ariz. -- A 3TV viewer snapped a picture of a Tempe police officer texting while riding his motorcycle on U.S. 60 near Stapley Drive in Mesa earlier this week. The man who took the photo said the motorcycle officer was on his phone for several minutes while traveling more than 80 mph at about 6:30 p.m. Tuesday.

"I kind of looked over and I saw it and it dawned on me what I just saw and I looked again and that's when I took the picture," Justin Argall said.

In fact we have instituted specific policies prohibiting texting while operating police vehicles. Texting while driving or performing any activities that take away attention from the driving task are extremely dangerous and should be avoided whenever possible. Training will be provided to reduce the chance of our officers putting themselves in similar dangerous situations in the future." The Tempe Police Department did not publicly identify the officer but said he has been counseled and this incident is now considered closed.

Washington, D.C.: Motorcyclists and federal lawmakers spoke out about their concerns over E15 fuel in a rally at the U.S. Capitol on June 19. The riders gathered to urge their senators and representatives to call for independent testing of the E15 ethanol fuel blend in motorcycle and allterrain vehicle engines before it is widely distributed nationwide.

The riders attending the American Motorcyclist Association's "E15: Fuel for Thought" event represented the millions of Americans who are fearful about the high potential for inadvertent misfueling with E15 and the subsequent engine damage that could occur in their motorcycle and ATV engines.

Several U.S. representatives at the event questioned the EPA's decision to allow the sale of E15, calling it "not good to put in anyone's gas tank," "a disaster in the making" and "bad policy."

The AMA E15: Fuel for Thought event began with a motorcycle ride around the U.S. Capitol, followed by a rally with numerous federal lawmakers speaking. Participants then visited their congressional delegations' offices to ask for support for legislation that calls for inde-

El Dorado County, Calif.: Sheriff John D’Agostini is taking the unusual step of pulling the police powers from the U.S. Forest Service because he says he has received “numerous, numerous complaints.”

In a recent letter to the U.S. Forest Service, the sheriff informed the federal agency that Forest Service officers will no longer be able to enforce California state law anywhere in the county. The sheriff declined to provide specifics, but says he is concerned about the number of complaints his department has received against the federal officers. D’Agostini’s order goes into effect on July 22. Tallahassee, Fla.: Ethanol is no longer required to be put in gasoline, under a new law that takes effect July 1. The law is the result of House Bill 4001, sponsored by Rep. Matt Gaetz (R- Fort Walton Beach). The law removes the requirement that all gasoline offered for sale in the state include a percentage of ethanol, subject to specified exemptions, waivers, suspensions, extensions, enforcement, and reporting.

Springfield, Ill: House Resolution 312, introduced by Rep. Dan Beiser (D-Alton), urges Congress to suspend the sale of

gasoline blended with ethanol at levels above E10 until motorists are better protected. The resolution cites numerous problems with gasoline containing greater than 10 percent ethanol by volume, including the potential of fueling unapproved vehicles and engines, and voiding manufacturer warranties

Also sponsored by Schaefer, Senate Bill 73 prohibits roadside checkpoints or roadblocks based upon a particular vehicle type, such as motorcycle-only checkpoints. Other types of checkpoints or roadblocks, established and operated in accordance with the provisions of the United States Constitution and the Constitution of Missouri, are still permitted. The bill passed both House and Senate votes and was sent to Gov. Jay Nixon on May 22 to be signed into law or vetoed.

Many of us have come back from yet another action packed and fun filled Too Broke weekend. Hope everyone arrived home safe and sound.

Since it is mid-year, I’ve been asked to report on ABATE’s safety activities so far this year. Here is what I know so far:

August Safety Article - Governor’s Proclamation designating May as Motorcycle Safety and Awareness Month - So, what does that do for us? By submitting the request every year, it keeps the Governor’s office aware that there are motorcyclists in Arizona who are concerned about safety. Along with our lobbyists, it keeps us visible to the legislature.

- White Bandana Project – The biker that is stopped along the road ties the bandana to the left handlebar signaling passersby that help is needed. The project promotes safety as well as promotes ABATE as an organization. ABATE members have been distributing the bandanas everywhere they go! If you want to do your part, contact me and we’ll get some to you.

Call for MAP Instructors

The Motorcycle Awareness Program (M.A.P.) is an educational program aimed at the target audience of high school students in driver’s education classes. There has been a small group of instructors who have volunteered to present the M.A.P. to students throughout the state. But, we need more instructors.

Remember, that ABATE stands for EDUCATE. Our purpose is to spread the word about safe motorcycling and promote a positive image of motorcyclists. What better way than to speak to the future drivers of our state. The students hopefully, will not only be better equipped car and truck drivers but will also be more aware and watch out for us.

To become an instructor you must:

1. Be available during the day: The presentations in the high school driver’s education classes last about an hour during the school day. There may be as many as 5 classes in one day.

2. Be willing to stand up in front of a group of about 30 high school students and speak: That sounds easier than you think. You need to be able to gently maintain control of the group.

3. Know the material being presented: There is an outline for all presenters to follow so there is uniformity in

the material presented.

4. Commit to teaching at least 2 classes per school year: We hope to have at least one volunteer instructor in each ABATE Chapter. That person will attend and instructor class (about 4 hours), attend a M.A.P. with an experienced instructor, teach a class with an experienced instructor in attendance. When the new instructor is comfortable and the experienced instructor assesses him/her to be ready the new instructor may begin teaching alone. The mentor program assures that everyone is teaching the same material and everyone has support.

5. Provide record of teaching to the M.A.P. Coordinator on a consistent basis.

This is your opportunity to get the word out to new drivers about the importance of sharing the road with motorcyclists. - Chapter events – East Valley participated in a community event in the spring to promote motorcycling in a safe and positive manner. I’m sure other chapters have participated in but so far Chapter Safety Officers are not telling the rest of us about the good work they have been doing.

- MAP – The Motorcycle Awareness Program is quiet for the summer. However, during the school year instructors throughout the state have been actively presenting to high school driver education classes. Jim Silk has been particularly active in the Phoenix metropolitan area. He has also provided presentations to driver education instructors across the Valley. All instructors are reminded to send their activity reports to the State Safety Officer (that would be me). There will be an Instructor Update/Orientation on Saturday, August 10, 9:30-11:30 at the State Office (the American Italian Club) in Phoenix. If you are interested in becoming a MAP instructor contact me by August 8th. Additionally, we are working with the state to provide presentations at defensive

PAGE 19 driver classes. Hopefully, that will be happening this fall.

- ASM – Accident Scene Management is an educational program that is taught throughout the country. I am a certified instructor for ASM in Arizona. The Basic class is 4-6 hours long and costs $50 per student. ABATE of Arizona will pay have the student fee for ABATE members. So, if you’re a member of ABATE the course costs you $25. That’s quite a bargain! Contact me for more information. So, that’s was your ABATE Safety Committee has been doing this year. The Committee is dedicated to fulfilling the mission of ABATE, to promote motorcycling in a safe and positive manner, by working with other ABATE members and officers as well as the community at large.
