Abuse Prevention and Reporting
Older adults are a valuable and vital part of our society and deserve to be treated fairly and with dignity. According to the Elder Abuse Task Force of Santa Clara County, the economic and social can be significant, leaving them more at risk for financial, physical and emotional mistreatment, neglect and abuse.
Elder justice is important to all of us, and everyone is encouraged to report known or suspected abuse and neglect. Most professionals who work with the elderly are required by law to report any signs of abuse.
Under current California law, professionals required to report elder or dependent adult abuse and neglect include care custodians, health practitioners, clergy members, officers and employees of financial institutions, broker-dealers and investment advisers, Adult Protective Services staff, and law enforcement agencies, among others.
Types of abuse include:
Physical Abuse
Direct physical harm Lack of medical care or over-medication Sexual exploitation Unreasonable physical or chemical constraint Prolonged deprivation of food or water
Financial Abuse
Theft (including identity theft) Misuse of funds, assets or property Extortion Duress Fraud (including mortgage or real estate fraud) Undue influence Forgery
Neglect/Self-Neglect
(denial of basic needs) Failure to provide basic needs Lack of personal hygiene Signs of malnutrition or dehydration
Abandonment
(by caregivers or custodians) Unreasonable desertion or willful neglect
Isolation
Acts that prevent receipt of mail, phone calls or visitors false imprisonment
Other Treatment
(Resulting in Physical Harm or Mental Suffering) Threats Harassment Intimidation Creating emotional distress Withholding of goods and necessary services
Elder Abuse Task Force of Santa Clara County thanks everyone for helping identify and report suspected abuse and neglect to help protect our valuable elder and dependent adults.
Filing a Report
Filing a report of abuse is not limited to professionals. Anyone may make a report if any type of abuse or neglect is reasonably suspected by calling 9-1-1, especially if someone is in immediate danger.
For suspected adult abuse NOT occurring in a Santa Clara County longterm care facility, call Adult Protective Services (408-975-4900 or 800-4142002), or visit sccgov.org.
In any long-term care facility, call Long-Term Care Ombudsman Program (408-944-0567 or 800-231-4024), or visit catholiccharitiesscc.org/ long-term-care-ombudsmen
For suspected elder and abuse occurring outside Santa Clara County, visit cdss.ca.gov/adult-protective-services for a list of telephone numbers by county.
