INVESTING TOGETHER Whether it’s getting help to buy your first investment, growing your portfolio, or helping someone else become an investor, sooner or later you may consider buying a property with friends or family. It can be fraught with danger, but can also work well if you plan carefully.
Questions arise as to how you should structure the arrangement – would a family trust be a good option or a joint venture arrangement? What happens should one person pass away, will their share pass to the other investor or to their heirs?
To succeed, you need to pay close attention to your goals, exit strategies, tax, finance and estate planning.
Finally, after all of the scenarios have been explored, you need to document everything that you have agreed upon. It is important to get legal advice as well as financial advice before buying a property with another party. Investing with a partner can be a minefield, but if everything has been discussed, agreed on and put in writing, then the arrangement can work very well and be very profitable for all involved.
Firstly are your goals similar? Why are you investing, does one person want quick capital growth while the other is thinking long term? Do you have similar attitudes to risk? Will one person want to buy a family home in an established suburb, while the other wants an off the plan apartment in the CBD? Problems will arise if your goals and attitudes aren’t similar. Finances are a main concern and you need to consider all scenarios including how any profit and costs will be split. This may be easy if you each have an equal share in the property, but what if one person paid 70 percent and the other person paid 30 percent. Will this split apply to maintenance costs, or will you each pay half? What if the property is vacant, do you each pay 50 percent of the mortgage, or will one pay 70 percent and the other 30? If the original investment is unequal, but you have equally shared all costs, how will any profit be split? You need to check your loan situation. Even if you are sharing the investment, most lenders would consider 100 percent of the debt as yours, but only take into account your share of the rent and capital value – you automatically have negative equity. At least one bank allows friends and family to purchase property together, but keep their finances separate, and this may be worth investigating. You also need to consider potential financial problems. For example, what would happen if the other person sharing the investment loan suddenly finds themselves in financial difficulty and can no longer pay their share of the mortgage? What if they need to sell? What if you cannot afford to buy them out, would you be forced to sell the property or would you be able to sell the other person’s share to another party?
