Is it damage?

One of the more contentious issues between a landlord and tenant is the condition of the property. It is especially an issue for landlords who haven’t seen their properties for some time and find that the current condition doesn’t match their memories. Has the property been damaged, or is it just normal fair wear and tear, and who is responsible? Fair wear and tear can be considered as the deterioration that occurs over time with the use of the premises, even though the premises receive reasonable care and maintenance. The deterioration could be caused by time, exposure, or just ordinary use. The Department of Commerce (Consumer Protection) gives the following examples of fair wear and tear:  Curtains faded from years of sun.  Carpet in hall or other areas worn because it is used frequently.  A lock broke because it was old and had worn out.  Paint flaking because it is old or not applied properly. The tenant is not liable for damage that is considered fair wear and tear. However the tenant will be considered responsible for damage that is considered to be neglectful or malicious. An example might be scuffed wooden floors (the landlord’s responsibility) versus badly scratched or gouged floors (the tenant’s responsibility). Other examples include:  The tenant’s cat tears the curtains.  Stains or burns from things dropped or placed on carpets.  The tenant forgot the key and broke a lock to get in.  Mould/mildew formed because the tenant didn't properly air the dwelling. When it comes to determining responsibility, the age of the material under consideration is a major factor.

For example, carpets are usually depreciated over ten years, so any repair or replacement required for carpets older than that may still be the landlord’s responsibility, even if there is damage that may otherwise have been considered the tenant’s responsibility. While being obliged to address fair wear and tear issues may seem unfair, it is worth remembering that landlords are able to claim depreciation on the property in their annual tax return. Unfortunately many landlords do not claim any or all of the depreciation they are entitled to. To cover all your bases it is worth having a depreciation scheduled prepared (and then using it) as well as ensuring your insurance covers you for damage as well as issues associated with damage – such as the inability to lease the property while damage is repaired. Regular inspections by your Property Manager, as well as a thorough review of their reports, will also make sure you have a good understanding of the condition of your property and can address any problems quickly. Insurance pitfalls

A lot of coverage has been given to the sales side of the market lately, but what has been happening with rentals over the last 12 months?

An e-book, 12 Most Common Pitfalls When Insuring Your Rental Property, highlights key mistakes investors make when buying, or not buying in some cases, insurance. Polices are not the same, so it can be difficult to compare like with like, but it is worth spending time researching your choices.

For the first six months of the financial year vacancies were very low, multiple applications were often received by Property Managers and rents were rising. The market was said to be in crisis and one recent report has suggested it still is, noting that the Perth market was tight, with rents having increased 14 percent over the financial year. While the median rent has definitely increased when compared with figures from 12 months ago, it has been fairly stable over the last three to six months. The vacancy rate has also risen, with the number of properties available for rent almost doubling. Many tenants have made the most of low interest rates and reasonable prices to buy their own homes, while more investors have also taken advantage of the conditions to purchase an investment property. Most statistics paint a very general picture and when it comes to the state of the local market, investors are advised to speak to their Property Manager. They will notice that some areas, particularly those with lower rent rates, are finding that any vacancies are filling quickly, and there is still some upward pressure on rents. Other areas might find that demand has slowed, tenants are becoming very choosy, and rents are falling. In particular, regions that were experiencing high demand as a result of the mining boom are now finding that demand is declining as this sector experiences a slowdown. Like sellers a few years ago, some investors may find that they can no longer get the price they want and may have to revise their expectations. You might even find that in one location, properties in a particular rent range are very popular, while those just $50 or $100 per week more are sitting vacant for longer. Every suburb is experiencing different conditions, to get a more accurate idea of the state of the market where you invest, speak to your Property Manager. Accidental damage — some insurers limit cover to the contents not the building. 7. Check the qualifying (or disqualifying rules) — beware the fine print. 8. Check for complete cover — some combined house and landlord policies offer less cover than specialist landlord policies. 9. Court orders — do you need a court order to claim for rent default? 10. The Body Corporate already insures my property — not for liability if someone hurts themselves inside. 11. Periodic tenancies or lease continuation — some won’t pay out for claims if the written lease has expired. 12. When you figure out “you don’t need insurance” — a reliable tenant and a good property manager is not enough to protect you.
