SWIM IRELAND INSURANCE INFORMATION SHEET INTRODUCTION There have been a number of questions relating to the insurances that Swim Ireland have in place and in order to provide some limited information regarding same we have prepared this brief document for your information:Please note that this document is only a very brief outline and it is not the intention of this document to replace or alter anything that might be contained within any of our policy documents including but not limited to terms, conditions, exceptions, restrictions and limits of liability etc. Our principal insurance classes fall into the following categories:Employers Liability Indemnity to Swim Ireland/Regional & Affiliated Clubs for its liability for Bodily Injury to its employees. Public/Products Liability Indemnity to Swim Ireland/Regional & Affiliated Clubs for its liability for Third Party Bodily Injury/Property Damage. Professional Indemnity Indemnity to Swim Ireland/Regional & Affiliated Clubs for its liability for Third Party Bodily Injury/Property Damage. The following areas are covered: 1. Employers Liability – Bodily Injury to those considered to be Employees of Swim Ireland/Regional/Affiliated Clubs where we are deemed to be negligent/legally liable. Limit of Indemnity €13m and one event. 2. Public Liability – Bodily Injury to Third Parties incl. subsequent Financial Losses incurred as a direct result where Swim Ireland/Regional/Affiliated Clubs are deemed to be negligent/legally liable. Limit of Indemnity - €6.5m and one event. 3. Public Liability – Indemnity in respect of Third Party Property Damage incl. subsequent Financial Losses incurred as a direct result where Swim Ireland/Regional/Affiliated Clubs are deemed to be negligent/legally liable. Limit of Indemnity - €6.5m and one event. 4. Products Liability – Bodily Injury to Third Parties/Third Party Property Damage incl. subsequent Financial Losses incurred as a direct result and caused by defective products where Swim Ireland/Regional/Affiliated Clubs are deemed to be negligent/legally liable. Limit of Indemnity - €6.5m and one period. 5. Professional Indemnity – Indemnity is provided in respect of claims made by Third Parties against Swim Ireland/Regional/Affiliated Clubs and notified during the period arising out of any act or omission/libel and slander committed in good faith. Limit of Indemnity - €2.5m. 6. Child Protection – Indemnity is provided to Swim Ireland/Regional/Affiliated Clubs in respect of claims for negligence or alleged negligence causing harm to a child. Cover does not extend to the Perpetrator. 7. Pollution or Contamination – Insurers shall provide indemnity to Swim Ireland/Regional/Affiliated Clubs where they are deemed to be legally liable for the costs of removing, nullifying or clearing up any actual or alleged sudden and unforeseen Pollution or Contamination. Limit of Indemnity - €6.5m and one period. 8. Legal Defence costs – Included within the limit of indemnity where indemnity is provided. Fines and other penalties are not included.
9. Directors & Officers Liability – Indemnity is provided in respect of Claims made against Directors & Officers of Swim Ireland/Regional/Affiliated Clubs for actual or alleged wrongful acts committed as part of their committee activities. 10. Open Water Swims – Indemnity is provided in accordance with points 2 and 3 above subject to details of all Open Water Swims being provided to our Insurers each year. 11. Sports & Social Activities – Please note that cover provided only provides indemnity to Clubs for the provision of sports, social and welfare for the benefit of employees only. 12. Travel Insurance – Please note that Swim Ireland does not automatically organise Travel/Personal Accident insurance for Regional & Affiliated Clubs. Cover can however be arranged through our nominated Brokers by providing the following details:Name / Address of Swimming Club Contact Name Destination of Trip Nature of Trip Travel Dates No of Adults travelling No of Children travelling Premium must be paid to Arachas before commencement of the trip to avoid cancellation. Material Facts All Regional & Affiliated Clubs are reminded of their duty to voluntarily disclose any matter that might be deemed to be material to their insurance programme. For your information, a “material fact” is anything that might affect the judgement of an insurer in accepting a risk of in fixing a premium for such risk. Therefore, if you have any doubt as to whether a matter must be disclosed to insurers please bring this to the attention of Swim Ireland immediately who shall liaise with our Insurance Brokers. 14. Claims/Incident Reporting It is essential that all incidents involving bodily injury / third party property damage be brought to the attention of Swim Ireland as quickly as possible @ admin@swimireland.ie (title incident notification). 15.
