WHEREAS the Municipal Council has authority pursuant to the provisions of the Municipal Government Act, being Chapter 68 S.A. 1968 and amendments thereto to prescribe, regulate and enforce standards respecting any materials, equipment or appliances installed or used in the construction of buildings or structures; and WHEREAS the Municipal Council has pursuant to the authority granted to it enacted the Building Code being Bylaw No. 3084 and amendments thereto; and WHEREAS the City Architect is responsible for the administration of the Building Code, being Bylaw No. 3084 and amendments thereto; and WHEREAS the Municipal Council on the 23rd day of March 1970 has adopted a recommendation of the City of Edmonton Commissioners to transfer the responsibility of administering the Building Code being Bylaw No. 3084 and amendments thereto from the City Architect to the Director of Planning. NOW THEREFORE, THE COUNCIL OF THE MUNICIPAL CORPORATION OF EDMONTON DULY ASSEMBLED ENACTS AS FOLLOWS: I.
The Building Code being Bylaw No. 3084 and amendments thereto
is hereby amended. 2.
The following sections are amended by striking out the present
definition of "authority having jurisdiction" wherever that definition appears in those sections, and substituting therefor the following definition:

BYLAW NO. 3584 FINALLY PASSE A Bylaw to Amend Bylaw No. 3084 the Edmonton Building Code WHEREAS the Revision Committee of the City of Edmonton Building Code have concurred in a recommendation to the Municipal Council that a certain amendment to the Building Code is considered by them to be expedient; and WHEREAS the Municipal Council deems it advisable to approve that certain amendment: NOW, THEREFORE, THE MUNICIPAL COUNCIL OF THE CITY OF EDMONTON ENACTS AS FOLLOWS: 1.

A Bylaw to Amend Bylaw 3084, The Edmonton Building Code by the inclusion of Regulations Respecting Swimming Pools WHEREAS the Municipal Council has authority pursuant to Section 150.1. of The Municipal Government Act being Chapter 246 of the Revised Statutes of Alberta A.D. 1970 and amendments thereto, to require the owners of outdoor swimming pools to erect and maintain fences and gates around the swimming pools and to prescribe the minimum height and specifications of, and the manner of erecting and maintaining the fences and gates; and WHEREAS the Municipal Council pursuant to the authority granted to it by The Municipal Government Act, being Chapter 246 of the Revised Statutes of Alberta A.D. 1970, enacted the City of Edmonton Building Code being Bylaw 3084 and amendments thereto; and WHEREAS the Municipal Council of the City of Edmonton has by motion resolved that appropriate safety regulations respecting outdoor swimming pools be adopted; and WHEREAS the Revision Committee of the City of Edmonton Building Code, being Bylaw No. 3084 and amendments thereto, has prepared certain regulations respecting outdoor swimming pools and has recommended that an amendment to the City of Edmonton Building Code be made so as to include these regulations in the City of Edmonton Building Code as Part 16 of the said Code; and WHEREAS the Municipal Council deems it advisable to approve the amendment recommended. NOW, THEREFORE THE MUNICIPAL COUNCIL OF THE CITY OF EDMONTON ENACTS AS FOLLOWS: 1,

That Bylaw 3084, being The City of Edmonton Building Code and amend-
ments thereto is amended by including in and making a part of, the said Bylaw, the following: PART 16 - SWIMMING POOLS
Section 16.1.
PURPOSE AND SCOPE
The purpose of this part of the Bylaw is to provide minimum standards to safeguard life, health, property and public welfare by regulating and controlling the quality of materials, construction, location and maintenance of private swimming pools.
16.2. 16.2.1.
DEFINITIONS AND ABBREVIATIONS (a) APPROVED means approved by the authority having jurisdiction. (b) AUTHORITY HAVING JURISDICTION means the Building Inspection Director or his authorized representative. (c) FENCE means a barrier constructed of chain link metal or of wood, stone, metal or material having an approved degree or strength. (d) GATE means a swinging or sliding barrier or door used to fill or close any access. (e) PRIVATE SWIMMING POOL means a privately owned indoor or outdoor pool of water, other than a wading or reflecting pool, (f) WADING OR REFLECTING POOLS shall be considered as those capable of containing water to a depth of 18" (eighteen inches) or less at any point. ENTRY RESTRICTIONS Every private swimming pool shall be secured against entry of the public ocher than owners, tenants or their guests. No privately owned outdoor swimming pool shall be constructed or maintained unless there is erected and maintained entirely

Every fence enclosing an outdoor swimming pool shall be at least 6 (six feet) in height above the level of the grade outside the enclosure and shall be of close boarded, chain link or other approved design such that it will reasonably deter children from climbing over or crawling through or Gates in under it to gain access to the fenced in area. the aforesaid fence shall provide protection equivalent to the fence and shall be equipped with a self-latching device and lock located near the top and on the inside of the gate. Every gate shall be locked except when the fenced in area is actually being used and supervised by the owner of the premises or other adult person authorized by the owner to supervise the use of the pool.,
16.3.4.
No barbed wire no device for projecting an electric current shall form part of a fence or gate.
16.3.5.
No fence shall be required around that part of a private outdoor swimming pool where the top of the outside wall of the pool is at least 6' (six feet) above the level of the grade abutting the wall and where such wall is so constructed and maintained as to provide for access only by the gate or gates construted in accordance with Section 16.3.3.

TREATMENT OF WATER
16.7.1. The method and degree of treatment of water for all private swimming pools shall be to the satisfaction of the Medical Officer of Health.

BYLAW NO. 3833 A Bylaw to Amend Bylaw 3084, The City of Edmonton Building Code WHEREAS the Municipal Council has, pursuant to the authority granted to it by the provisions of the Municipal Government Act, being Chapter 246 of the Revised Statutes of Alberta, A.D. 1970 and amendments thereto, enacted the City of Edmonton Building Code, being Bylaw No. 3084 and amendments; and WHEREAS the Permanent Revisions Committee for the City of Edmonton Building Code has by motion recommended that the City of Edmonton Building Code, being Bylaw 3084 and amendments thereto be amended so as to ensure that the procedures by which a sign permit is obtained are the same as those by which a building permit is obtained and that prior to the issuance of a sign permit by the Director of the Building Inspection Branch of the City Planning Department, the applicant for the said permit has complied with all other relevant bylaws and regulations and has obtained all other required permits; and WHEREAS the Municipal Council deems it advisable to approve the amendments recommended. NOW THEREFORE, THE MUNICIPAL COUNCIL OF THE CITY OF EDMONTON
ENACTS AS FOLLOWS: 1.

The purpose of this part of the Bylaw is to ensure that all bylaws and regulations pertaining to signs and sign structures and the erection thereof are complied with, and

- 2 to provide minimum standards to safeguard life, health, property and public welfare by regulating and controlling the quality of materials, construction, location and maintenance of all signs and sign structures excepting signs erected under the Traffic Bylaw to regulate and control traffic. This section applies to signs located within malls, but does not apply to other signs located within a building.
