A murder charge has finally been laid in the case of a Mountain Institution inmate found dead in his cell shared with another prisoner. Michael Wayne McGray, 45, is charged with first-degree murder in the death of 33-year-old Jeremy Michael Phillips on Nov. 23, 2010. While the case of one dead prisoner found in a locked cell with another live prisoner might seem open and shut to the public, police

investigators did not have the luxury of jumping to conclusions, an RCMP spokesman told Black Press. "Nothing is really open and shut in homicide or law enforcement anymore," RCMP Cpl. Dale Carr, spokesman for the Integrated Homicide Investigation Team, said to explain the lengthy six-monthlong delay in laying a charge. "We just needed to have the forensic analysis to ensure that somehow, somebody else didn't get in that cell," he said. And the suspect, McGray, wasn't

going anywhere, he added. Had the murder happened in the community, police would have put a higher priority on the evidence sent to the forensic lab for analysis. "We felt comfortable in taking out time, using our favours from the lab for other priorities," he said. Prison officials have refused to disclose why McGray, a serial killer from Moncton, New Brunswick with six murder convictions, was transferred from the maximumsecurity prison at Kent to the medium-security facility at

Mountain. Phillips reportedly asked prison officials to move him out of the cell shared with McGray because of concerns for his safety. Phillips was halfway through a six-year, nine-month sentence for aggravated assault when he died. He was also reportedly from the same Moncton area as McGray. It's not certain when McGray will make his first court appearance in Chilliwack. He is not currently housed in B.C., according to prison officials.

Be safe in the woods RCMP issue safety list for hikers

Local RCMP have issued a safety reminder for those heading to the outdoors, following a spike in reports of lost and injured hikers. “Hiking is a great form of exercise and can be a great outdoor event for friends and family,� a press release said. “Recently in the Upper Fraser Valley Regional Detachment area, there have been many reports of hikers being lost or injured.� While they say hiking is generally not considered a dangerous activity, there are times that you may find yourself a long way from “civilization� and an injury or something else could occur. In order to keep your hiking safe, Upper Fraser Valley Regional Detachment RCMP would like hikers to consider the following safety tips: T Do not hike alone – This is not always needed, such as when you are taking a short hike through your local park. If you are going to hike into the forest, a canyon or some more hazardous area you should never go alone. Hiking with a partner has many advantages. You are less likely to become anxious when confronted with a problem or setback. You can also assist each other on getting up steep inclines or across streams that could prove dangerous if you were alone. There is also the consideration that if one of you get injured the other will be there to help or go for help. T Plan ahead – Make sure you know as much

as you can about the area you will be hiking. Study the latest guidebooks and maps. Make sure you check the weather for the area on the planned day of the hike. T Leave word of your destination and schedule – This is very important. This can help in locating you in an emergency. Make sure you tell someone where you are going and when you should be back. T Exercise common sense – Do not get overconfident when on the trail and do things that are risky or foolish. Do not take risky chances that could turn your hike deadly. T Dress appropriately - Make sure you dress for the season and wear the right hiking shoes or boots. Layered clothing is the best to meet changing weather conditions. If cool or wet conditions

are expected, it is recommended that you avoid cotton clothing, which insulates poorly when wet and dries slowly. T Take along the right equipment – A day pack containing rain gear, extra warm clothing, high energy food, water, first aid kit, pocket knife, matches in a waterproof container, and insect repellent are recommended. A flashlight or pen light and a GPS unit proved useful in locating a lost hiker recently. T If you get lost keep calm, stay dry, keep warm and if possible stay put. If you have to stay overnight, build a campfire for warmth, light, and safety. Most dangerous wild animals will not go near campfires. If an aircraft is used in a search, the smoke of a campfire can be spotted. If the weather is cold or bad and you must spend the night there, also build a small

shelter. You can use dead branches, hemlock boughs and leaves. This will shelter you from the elements. Set up camp before darkness falls if possible. If you feel you can find your way out of the woods, remember that following a stream downhill will usually lead you back to a habitated area. “Recently, the UFVRD RCMP has had to call upon Search and Rescue (“SAR�) for several incidents regarding lost hikers or injured persons in remote areas,� said Cpl. Tammy Hollingsworth. “Although SAR is a wonderful resource, we would rather not have to call them. More trees destroyed in Agassiz District says they’ll replant in the fall

More trees have been destroyed throughout downtown Agassiz, and District of Kent staff are hoping someone can help them find the culprit. At least four trees have been snapped in half over the past six weeks, in various areas around town. One was a golden black locust in Pioneer Park, which the District’s gardener Scott Hurst said was a replacement tree planted last fall. Another two trees were destroyed on Vimy Road, which Hurst also planted last fall. And the fourth was an ornamental plum on Morrow Road, across from the townhouse development that’s currently in construction. That tree wasn’t just snapped in half, but had each branch pulled

Hurst said the destruction won’t keep the District from planting more trees, and they are planning to replace the damaged ones in the fall. “We are trying to keep our tree canopy growing,” he said. “Whatever’s destroyed, we’re replacing.” Trees are best planted in the fall, he said, so they can gain good root growth through the winter.. This is not the first time vandals have killed trees within Agassiz. Last Remembrance Day, Hurst was disheartened by the destruction of several trees in Vimy Park. They were planted just in time to show off the new cenotaph for the ceremonies, but were destroyed the day before. The District is asking that anyone with infor-

Opinion A step toward Senate reform

Are you prepared to care for yourself in a flooding emergency?

There is some irony that as Liberal MLA John Les introduced a bill that might lead to the election of Senators in B.C., Prime Minister Stephen Harper was appointing new members to the upper house. Ironic because it was the Reform Party – precursor to the current Conservatives – that brought the idea of substantial Senate reform closer to reality than ever before. It was, in fact, a key part of the Reform platform: A Senate that was equal, elected, and effective. Although that concept of the “Triple E” Senate has since been tempered by political realities (like reopening the constitutional debate), reform remains a goal for many politicians. Of course, what to do with the Senate has been a Canadian pastime for decades. Many, including the opposition NDP see little use for this “house of sober, second thought” and would rather see it abolished. Others see it as a chance to improve the democratic process in Canada. John Les is one of those. “I think by far the majority of people would prefer to elect a Senate,” Les says. He’s right. For too long the Canadian Senate has had all the appearance of a private club, where its promise of lifetime membership was seen as the ultimate reward for party fidelity. It has been political tradition for the Prime Minister of the day to stock the Senate with selections who were sympathetic to the governing party’s views. Prime Minster Harper faced that same accusation when he recently appointed three new members to Senate – all Conservative candidates who were defeated in the recent federal election. Still, there is hope. It is expected that the Conservatives will introduce changes that will give provinces greater say over how candidates are chosen. The Private Member’s Bill introduced by MLA Les serves as an important step toward that necessary reform. – Black Press

B.C. VIEWS Tom Fletcher I recently bought a used vehicle. Bitter experience with used cars sold privately led me to make the purchase at an established, reputable dealership, and I’m pleased with the result. The first car I ever bought was a private sale. A young man showed off the old car he had painted himself, while his mother smiled and offered homemade lemonade. Sold for $600. The choice of drink proved appropriate when the engine clattered to a final halt a week later. It was then I discovered that the crankcase contained mostly STP Oil Treatment, to conceal the engine’s true state. At the dealership this spring,

the harmonized sales tax was not a hot topic. Like most goods, new and used vehicles were subject to 12 per cent PST and GST before, and they are subject to 12 per cent HST now. When I mentioned this in a news report last week, an astute reader in Nanaimo reminded me that it’s not quite that simple. Vehicles, boats and aircraft sold by private individuals are exempt from GST. This was one of the populist concessions the Mulroney government made in an effort to placate angry voters 20 years ago. In B.C., prior to July 2010, private sales were subject to seven-per-cent PST only. During the hubbub over the implementation of the HST in its 2010 budget, the B.C. Liberal government also increased tax on private vehicle sales by five per cent, from seven to 12 per cent. The stated reason was to

provide “comparable treatment” for private and commercial sales of used vehicles. This provoked an exchange of partisan accusations that typically passes for debate in the B.C. legislature. It’s a payoff to

Municipal governments call them “curbers.” They use their garage, driveway and street to repair and market an endless series of used cars. Whether they are crooks or not, their efforts are every bit as appealing to the neighbourhood as the guy with multiple illegal suites whose tenants plug up the parking for the whole block. In each case, they violate zoning rules and hog services for personal benefit. And if you think they pay income or other taxes on their home businesses, I have a 1973 Pinto you might want to test-drive. Apparently he’s having second thoughts about letting Bill Vander Zalm set NDP tax policy based on a world government

The homeowner dismissed the $350 HST rebate he has been offered to offset costs such as summer camp for his two kids, saying that will be gone several times over if he buys a used car. This clearly implies that HST has been extended to used cars. This is the sort of claim that drives much of the rage against it, as people simply scan their bills for those hated three letters. There are signs that people understand their taxes better, however. An Angus Reid poll last week found that 58 per cent of British Columbians now prefer to pay taxes on their consumption rather than their income. Mailbag HST good for tourism It’s no secret that the tourism industry in B.C. has struggled with how to respond to the harmonized sales tax. However, in light of the proposed two per cent reduction, it is clear to the Tourism Industry Association of B.C. that the HST will be good for B.C.’s tourism economy in the long run. This was not black or white for us. As soon as the new HST was announced our association, which represents all of the major tourism industries in B.C., immediately began work, not to oppose the new tax, but to identify

and implement ways to mitigate the effects of the tax on our sector. Part of our challenge was that the impacts of the new harmonized tax were different for different parts of tourism both by business type and by location: hotel prices went down, the cost of restaurant meals went up, and businesses closer to Alberta which does not have a provincial sales tax were particularly sensitive to HST. Like other concerned sectors of the B.C. economy, we noted decreased consumer confidence around the time HST

was implemented in B.C. and Ontario in July 2010. This occurred in the early recovery period after a recession. We have been relieved to see that domestic consumer confidence has begun to trend in a positive direction. We are very pleased that the provincial government has promised to reduce the HST by two per cent and is actively championing improvements to a federal visitor rebate program that will encourage foreign buyers to choose Canada and B.C. We now share the growing concern of the

The main stumbling block is the way the government brought it to life. Lies and deceit. This "revenue neutral" tax is going to be a boost of $1 billion for the year to government coffers. Taxpayers' money, as was as the $1.6 billion from the feds. The governments of this country have it backwards when they think they can just up the ante when they need more revenue to cover their

outlandish spending when they should be looking at reducing the expenditures instead of increasing the taxes. Heaven help us if this HST boondoggle gets the NDP elected next time out. I think the populace has to vote yes in the referendum to show government that we have been pushed far enough. If, as Fletcher suggests, haircuts and restaraunt meals stay taxed if we go back to the PST, that might cause a bigger kerfuffel that this one. Jim Anderson

Go ACE Go! On Tuesday, June 7 there was a special seniors and teens lunch. This was a gift from the students of ACE, paid for with the money they earned during the year through various events like barbecues, silent auctions and garage sales. The students decided, without any input from the school staff, that they would provide the entire lunch themselves including preparation, cooking and the serving of the food. There were over 60 people there which made it really busy but the students were able to cope with everything.

The seniors were full of praise for the students and the professional manner in which they conducted the whole event. These students are regular teenagers, that with the support and guidance of the ACE staff are becoming responsible & respected members of our community. Last week, the Federal government made it the law to reduce the HST in BC. The HST will drop from the current 12% to 10% in two stages -- if BC doesn't go back to the 12% GST/PST. The BC Government asked Ottawa to reduce the HST to reduce the cost to families. According to an independent report, this will save the average BC family $120 compared to going back to the higher 12% GST/PST. Since 2001, the BC Government has decreased provincial income taxes by 37%. Last week we learned BC gained 5,200 jobs in May and that 30,000 more people are working compared to last year at this time.* Lower taxes and more jobs. Talk, laugh, share at Write on Bowen 2011 Workshops will be led by notable Canadian writers If you can talk, you can write. If you can spin life’s whimsical moments into stories that make friends laugh, you might want to incorporate humour into your writing. And if you want to try crafting prose for children or young adults – perhaps the toughest audience of all – you could turn your hand to picture books or young

adult novels. Ambitious? Absolutely. But those disparate options for encouraging and engaging the writer within are among the eclectic offerings of Write on Bowen, coming soon for a fourth year – July 8 to 10 – to Artisan Square in Bowen Island. Shelley Rae Harrison, author of Life Leaves Stains and an instruc-

tor at The Wordlink Lounge on the Sunshine Coast, believes that “when you talk, you don’t stop to choose the perfect word.” Her workshop will encourage want-to-be writers to break through their inhibitions in order to start telling stories. In his workshop, Neil McKinnon, author of Tuckahoe Slidebottle – droll portraits of the

denizens of a small Canadian Prairie town, and a finalist for the Stephen Leacock Humour Award – will explore how to transform everyday life experiences and the world at large into comic prose. Writing what makes people laugh out loud, or even smile quietly, is serious work, but McKinnon aims to put the fun into funny.

Three writers of books for an audience ranging from toddlers to teens will shift the focus from imagining a whole book to creating powerful scenes within a book – the elements of drama that propel a story and hook readers into following the plot and the characters. Setting the record straight on flood risk

Looking to get re-hitched? Canada Day on Harrison’s shores may be just the place to get that done. Harrison Councillor Dave Harris says that any couples who want to renew their vows can do so at the Canada Day celebrations. “This will be very informal,” he says, with the hopes that people who got married at the lake will come out to renew their vows. The

marriage commissioner in charge of the service will be Mary Dams, who Harris says has performed numerous beachfront weddings through the years. They’ll start at about 10 a.m. at the Harrison Plaza, and depending on the number of couples who attend, it will take about 15 to 20 minutes, Harris says. The ceremony will include everyone at once, and there is no need to bring a marriage certificate.

There is no registration, and no cost. “And we’ll be giving out a certificate saying they renewed their vows, signed by the mayor and Mary Dams,” he says. Other Canada Day celebrations on the beach include the parade, a performance by Todd Richard (see page 17) at 3:30 p.m., Treble Hook at 7 p.m. and the fireworks show at dark. After the fireworks, Treble Hook will play for about half an hour, to entertain people who choose to wait out the traffic.

In last week’s Observer, a story about flood risk may have improperly implied that a flood was not possible in the Agassiz area. Roger Poulton, the District of Kent’s emergency coordinator wrote an email to remind people to always be ready for an emergency, despite the current levels of the river. “To clarify things, let me say this, the potential for flooding always exists, and is dependant upon the snow load and weather conditions. The snow load has been considerable and spring late. Consequently the onset of freshet has been retarded by as much as four weeks. The Fraser, as is evident, is high. This may continue for some time. “Weather driven flucuations in the flow are to be expected.” Poulton monitors the river, weather, and snow load daily. As of press time Tuesday, the provincial website for flood risk information (emergencyinfobc.gov. bc.ca) was reporting that the flood risk across the province is stable for now, with no major rainfalls or hot spells in the immediate forecast. It’s been a long few months on the road for Ann Vriend, promoting her most recent album Love & Other Messes. But for the next few weeks, she’s taking a break from life on the road, and tending to business at home in Edmonton. “It’s been a very intense tour,” she told the Observer. “I’m taking some time to take care of the other side of the business.” Music is a full-time gig for the singer/songwriter these days. With five records under her belt, and a steady stream of performances on her calendar, there would be little time for anything else. “I get criticized for pushing myself too hard,” she said. “And I’ve definitely been called a workaholic. But I really like doing things. I think of things and I want to record them, and play

shows.” What she’s wanting to play right now, is the music off Love & Other Messes, her first selfproduced album. Like most artists, Vriend is passionate about her current work, and constantly striving to improve her craft. “Every (record) I change it up and do a different genre,” she said. “But this one I kind of think of as an Americana solo record. There’s some old school and very acoustic songs. We did a lot of stuff live off the floor. It’s a very acoustic and organic sounding record.” And if she has to pick a favourite, it would be the single Tin Man. “I’m happy with a lot of them,” she said. “We were most excited about that one when it finally came together.” While all the music on Love & Other Messes

Hi everyone, our names are Marika and Simone van Reeuwyk. Some of you may know us from when our dad owned the local bakery that was in town until 2006, Kent Pastry & Bakery. This year we have decided to take on the challenge of participating in the Ride to Conquer Cancer — a two-day bike ride from Vancouver to Seattle to raise money for cancer research, education and treatment. Neither of us have ever done this long of a ride before, let alone any large fundraiser, and we are far from avid cyclists. But by participating in this ride, we’ve decided to take a step out of our comfort zone

to do something that will make an impact on cancer, in return for the impact cancer has had on our lives. So to show you just why this ride is so important to us, here’s our story: Our mother passed away when we were very young. Be-

and the doctors said it was likely it would not return. This is one memory we both remember vividly- we were holding her hands on either side, while walking through the markets in Singapore. As any four year old would be, we were incredibly curious in this new place, and would stop every few seconds to inspect these fascinating ferns that curled up with the touch of a finger... in our minds we cal recall the humid air on our skin, the bright, colorful patterned shorts we were all sporting, and our mom’s glowing smile. That was a happy time, but it was when we came back from that trip that we found out the tumor in her liver had in fact returned- to a terminal state. On September 1, 1994, our mom, Diana, lost her two year battle with liver cancer. 50 Years Ago, 1961 T A bad cheque artist came to grief when he tried to pass a cheque to Al Marshall at the 5 Cents to a Dollar Store. Mr. Marshall became suspicious and refused to cash the cheque. He subsequently reported the incident to police. The culprit’s illegal activities in Agassiz and previous record brought a six month term imposed by Magistrate A.M. Naismith. T In 1961 the District of Kent was contemplating numbering the houses in Agassiz. Two councilors argued for the proposal, but Reeve James Fraser contended that it had been looked into and appeared to be more trouble than it was worth. T The Atkins Stage Lines purchased a miniature, nine-passenger bus in an attempt to resume the Chilliwack to Agassiz to Harrison Hot Springs bus service on a permanent basis. T The Chehalis ladies #2 war canoe team made comeback at the Lummi Island races when they tied for first place. T The 1961 local girls softball teams were named the Comets, Untouchables, Bombers and Oddballs.

‘Cancer has affected so many people in our lives’ From 18

put together photo albums, home videos, even recorded cassette tapes of us talking with her, and we couldn’t be more grateful for them. Though we only got the chance to know her for four years, we often hear from people, especially while we worked in the bakery, how she touched their lives and what a charming, vibrant and personable woman she was.

Our dad always says she loved everyone she met, and everyone she met loved her right back. A little while ago we were looking through some old mementos, and came across a box. Inside, we found a stack of documents from the hospital, covering the details of her diagnosis and hospital procedures. Reading them for the first time was so refreshing- it finally gave us

a clear understanding of what went on those 17 years ago. Along with it were many get well soon cards she received, from almost everyone we knew from our childhood, and many more people whose lives she had impacted. We had known that there were many people that supported us through those years, but reading all of their kind words was really heartwarming. Several years after

our mother passed away, another family close to us was also faced with the hardships of cancer, losing their father to a brain tumor. we remember Mark as being a cheerful, kind man who was easy to talk to and always willing to lend a helping hand. Mark losing his battle to cancer was another tragedy to hit our community, and the relatedness of our situations inevitably brought our two fami-

lies closer than ever. Our parents formed a strong bond, and in time, got married and brought us a brand new brother the following year. Now we are proud to be members of the van Reeuwyk/Bridgefoot clanwe are a unique and talented bunch; all nine of us! We also have a wonderful sister-in-law and a brand new baby niece, both who we love dearly. Though we’ve been through a

FAMILY PREPAREDNESS: Is Your Family Prepared?

Preparing for an emergency is important and something the whole family can do. By taking a few simple steps, you can become better prepared to face a range of emergencies and minimize the impact on yourselves and your families. Here are three simple steps to better prepare your family to face a range of emergencies: Know the risks – Although the consequences of disasters can be similar, knowing the risks specific to our community and our region (like what to do in the case of floods, tornados, earthquakes, storm surges, hurricanes, and technological or environmental accidents such as chemical spills and power failures) can help us better prepare. Make a plan – Every Canadian household needs an emergency plan. It will help you and your family know what to do if disaster strikes. We should all practice what to do in different emergency situations. Get an emergency kit – During an emergency, we may need to get by without power or tap water. We will all need some basic supplies (items such as three-day supply of water, nonperishable food, a flashlight, batteries, , batteryoperated or wind-up radio, first aid kit, pocket knife, prescriptions, extra set of keys and money, and copies of important documents). Be prepared to be self-sufficient for at least 72 hours in an emergency. Checklists for what goes into a basic kit and extra items, how to write an emergency plan and details on hazards across Canada can be found on the Emergency Preparedness web site at www. Eligible homeowners must complete and submit home owner grant applications to our office by July 15, 2011. Homeowner grants should be claimed whether taxes are paid or not, and will apply to current taxes only. If your tax payment is arranged through a financial institution, they do not claim the grant on your behalf. The property owner must make the claim before the due date. If payment is made at your financial institution, please ensure payment is made at least 5 business days prior to the deadline, as there is a transit time before the funds are received by the District. Bank or postmark date stamps are not accepted as payment date. Payments delayed in the mail are subject to penalties. It is recommended that taxes are paid at the Municipal Hall.
