Tips to Handle a Consumer Fraud Categories: Cases, Tips Unscrupulous companies committing fraud against consumers is nothing new and honestly, it will happen again with many customers. However, you can prevent such frauds if you are aware of your rights as a customer and are vigilant when buying products or services. It is true that legal firms can help restore your consumer rights but quite naturally, legal firms are an afterthought, after you have been duped. So, the keys to having your consumer rights restored are valid documents and evidence that you have been duped. Here are some tips to prevent or handle a consumer fraud.
Know the promises the company makes Promises, in this context mean the promises the product or the service makes to its buyer. Is it a cloth washing powder which claims to remove all kinds of stains off the clothes? Is it an over-the-counter pill which claims to cure headache in five minutes? Before buying, carefully read the promise the product or service makes.
Read the disclaimer For each promise or claim, a product manufacturer or service provider usually provides a disclaimer. A disclaimer states the conditions under which the product or service can fulfil its promise. So, if the conditions are not present when the product or service is used, then the promises may not be fulfilled. It is not that the disclaimer cannot be challenged legally but that is a rare case.

Read the label carefully before buying Read the product composition, expiry date, price and other details – whichever is applicable before you buy the product. This way, it is easy to point out any problem before buying a product. You do not want to feel harassed and run back to the merchant afterwards. If possible, before buying the product, read the brochure or any materials that are available either online or in hard copy. The idea is to know about the product as much as you can and make an informed decision.
Carefully preserve the money receipt and bills It is time to contact a legal firm after you have been duped. But you need to first give the product or service seller one or more opportunity to redress your grievance. You should first lodge your complaint with the product or service seller and wait for a reasonable time period for their response. Normally, every company has its own customer grievance cell. So, if the company does not address your problem within a reasonable time, you should contact a reputed legal firm. Carefully preserve all the documents such as money receipt and bills, emails and responses from the company, if any.
Organise your case documents It helps if you chronologically organise your documents and present to your legal firm. It is easier for the firm to bolster the case. Make your expectations clear to the legal firm. The lawyer should be able to clearly tell you what you can expect if you win the case. It could be compensation or the entire money back. Your lawyer, after consulting with you, can determine the compensation amount.
