We spoke to them about their services in class action recovery, and how they continue to maintain the exceptional standards they set for themselves.

This is where groups of shareholders file a joint claim against a company to recover investment losses stemming from corporate fraud and misgovernance.

Goal estimates that settlements in securities class actions outside the US will reach USD 8.3bn annually by 2020. If non-participation rates are similar to the US market, then USD 2.02bn of investors’ rightful returns could be left unreclaimed each year by the end of the decade. There is even evidence that some custodians are restricting the geography of their class action recovery service provision, indicating that non-participation rates may even be higher.
Institutional investors stand to boost returns substantially if they claim their rightful share of a class action settlement. Goal has recovered hundreds of millions of pounds in compensation for its global client base. The “Best for Global Securities Class Action Recovery” award recognises Goal’s achievement in leading the industry from the emergence of US-centric class actions in early part of the twenty-first century to the globalisation that is taking place today.
Stephen Everard, CEO, says: “Many global investors and their financial advisors believe that the cost and time taken to participate in class actions outweighs the benefits of potential settlement recoveries. This is often not the case, if they work with a trusted outsourced service provider. Many also do not realise that they can claim compensation from historical cases – this is one area that we frequently advise new clients on.”

Mr Everard cites the example of one client – a UK-based asset management firm - that had not previously participated in class actions because they assumed they would not have incurred any such losses.
This has been Goal’s best year to date, with record class action filings and substantial new client wins achieved through strategic alliances and directly through its global network of offices in London, San Francisco, Philadelphia, Melbourne and Hong Kong.
Goal carried out a free of charge Proof of Concept, cross-checking the portfolio’s assets against its in-house database to identify any historical or current class action cases in which the client could have participated, and those where deadlines had recently passed.
Mr Everard says that the company “offers a truly global service, delivered locally”. Experts in each office combine their in-depth legal and procedural knowledge with Goal’s global research team and market-leading software, to provide an ‘end to end’ outsourced claims filing service.
It emerged that 23% of the portfolio’s assets were eligible for a class action lawsuit – representing potential recoveries of £4 million.

Tax reclamation continues to represent a huge opportunity for investors, fund managers and custodians across the world. Goal estimates that around a quarter of reclaimable withholding tax still lies unrecovered each year, which in 2013 amounted to global losses of £13.2 billion. This opportunity becomes yet more significant in light of major increases in market capitalisation, rising proportions of portfolios devoted to cross-border investments, and increasing numbers of companies paying dividends.

Goal’s proprietary software is available on a licensed basis (GTRS), or outsourced (Goal TaxBack). The company estimates that GTRS, its flagship solution, is used to recover about 30% of all withholding tax that is reclaimed on cross-border income annually. It is a modular system, featuring three elements - Tax Calculation Engine, Forms Generator, and Tracking and Reporting.
Mr Everard cites the example of a London-based, global asset management firm who have reclaimed over a billion pounds in withholding tax for their cross-border clients since starting work with Goal three years ago.

We are constantly updating and upgrading our thoughts about risk, how to define risk, how to assess risk, how to manage risk and how to best quantify and qualify risk. We then assign possibilities and probabilities to an array of possible outcomes and then determine how much risk to assume and not to assume for each individual client.
As for the award, recognition of this nature is something that my partners and I have worked hard to achieve throughout our careers. It is a testament to the success of our business model that allows each partner to narrow their focus towards their greatest aptitudes and deepen that focus into those aspects of our business where they are most effective. While working in an industry that is constantly changing, we always look to adapt and innovate our services to best suit each client. In life, we find that the more things change, the more they remain the same. The construct of managing risk is no different.
