OTSEGO COUNTY JURIST SERVED ON HIGH COURT
W hile it’s not known what other U.S. Supreme
Court justices may have visited Cooperstown – perhaps attending a Hall of Fame Induction – Otsego County’s bar can claim Samuel Nelson, a justice in 1845-72, among its own. Nelson, who practiced law and lived at 70 Main St., Cooperstown, where Shoeless Joe’s Hall of Shame is located today, was appointed by John Tyler in the president’s waning months in office. His 27 years on the court were mostly uneventful, but he did host a surreptitious meeting locally during the Civil War between Secretary State William Seward and ambassadors from European nations that the federal government was trying to keep from picking sides.

t’s been less than two months since Dean and Emily Roberts put the solar panels on the roof
of the Green Earth health food market, and they’re already starting to notice the difference in their electric bill. “Our July bill was half of June bill,” said Dean. “We use a lot of power, with AC and refrigeration.” The 132-panel system captures
sunlight and transmits it to the converter in the basement. If they capture more than they use, it’s “sold” back to NYSEG as credits. “The big savings isn’t in what you sell,” Dean said. “It’s in what you don’t buy.” For the Robertses, the choice to
go solar was in line with the Green Earth’s holistic philosophy. “Do no harm,” said Dean. “We want to live as lightly as we can.” “Our electrician is in the solar business,” Emily said. “He told us about grants and why it’s good Please See SOLAR, B2

Revolution Solar designed outfitted the roof with the panels, including two separate ones that heat the water used in the bathroom and kitchen. Federal and NYSERDA grants helped offset the cost. Diffusing the energy back onto the grid is also environmentally friendly, Dean said, as it decentralizes the grid. “It’s a way of creating energy without pollution,” he said. “The more people create generators, the less

Justice Ginsburg Draws Parallels Between Opera, Courts To Packed House JUSTICE/From B1 were little evident, wearing loosely fitting sports shirts and recognizable only by their earpieces and, at the end, when the phalanx escorted her from the crowded venue to a standing ovation. On the dias, the Supreme opera fan – she and Antonin Scalia, on opposite sides of the spectrum philosophically, have found common ground in a love of the art – engaged in a friendly give and take for an hour with Francesca Zambello, Glimmerglass Festival artistic & general director. There were some humorous exchanges. When Ginsburg told how the justices, when scheduled to make decisions on Thursday mornings, arrange musicales for each other’s amusement on Wednesday nights, Zambello remarked, “It sounds like we had the right singer before the health-care vote.” Friendly, but Ginsburg, as someone whose every word is subject to scrutiny, said no more than she wished. Zambello twice asked if Tosca, in the Puccini opera, was right in murdering Scarpia, the chief of the Roman guard who offered her freedom in exchange for sexual favors (with no intent of following through). Seamlessly, the judge simply went on to another topic and Zambello got the point. Still, the two covered

a lot of territory regarding what Ginsburg, who was greeted with a standing ovation when she Ginsburg entered as well, termed “the Theatre of Reality,” where – as she put it in her opening remarks – so much of opera equals the courts, and so much of court business equals opera. As in society at large, lawyers aren’t treated particularly fondly in opera. Bess’ lawyer in “Porgy and Bess” plans to charge her $1 to handle her divorce; on discovering she was never married, he raises that to $1.50. Voltore – the lawyer (his name means “vulture”) in George Antheil’s 1952 “Volpone” – is described in the libretto as thin and balding, with oily hair, “stooped like a vulture.” One of his lines: “How dare you have the audacity to question my veracity?” Zambello – she produced “American Ring” in San Francisco, then in D.C., where it will be staged again in 2016 – observed “the theory of contract is played out in (Wagner’s) ‘Ring Cycle’,” and Ginsburg agreed. (The judge also observed the male hero,
IF YOU GO: While in the county, Justice Ginsburg attended all four operas: “Aida,” “Armide,” “Lost in the Stars” and “Music Man.” The season runs through Sunday, Aug. 25. Siegfried” was “very handsome, also very dumb,” and the two further agreed it was a woman, Brunhilda, who saved the day by returning the gold taken by Voton, King of the Gods, to the Rhine Maidens.) In Billy Budd’s trial in Benjamin Britten’s opera of the same name, the needs of a lawful society transcend justice. Zambello pointed out “the dilemma of Captain Vere: Should he enforce this law, or somehow find a way to save Billy?” who is the personification of good. In the end, Ginsburg observed, Vere’s “overwhelming fear of mutiny” caused him to allow Billy’s execution to go forward. In discussion of Giordano’s “Andre Chenier,” a poet guillotined during the French Revolution, Ginsburg observed, “Perhaps that” – the Reign of Terror, when innocents and guilty alike were similarly dispatched – “is why it was easier for the French to get rid of the death penalty than here in the United States.”
When the justice began recounting her life with opera, ending with her story about Albie Sachs, prejudice emerged as a recurring theme. At 11, she was introduced to the art form in Brooklyn when an aunt took her to Ponchielli’s “La Gioconda,” produced by James Depriest, a black conductor who, with a cast recruited mostly from Harlem, toured the country seeking to introduce young people like the young Ruth to opera’s joys. “In his years in the U.S.,” Ginsburg said, Depriest “was never called ‘maestro’.” Eventually fed up, he moved to Europe, where he was esteemed and heralded for the rest of his career. At 16, the future justice saw Kurt Weil’s “Lost in the Stars” on Broadway for the first time, the opera based on Alan Paton’s “Cry the Beloved Country,” which climaxes in a trial. (Bader Ginsburg attended “Lost” that evening at Glimmerglass.) At the time, Zambello said, none of the performers would have been black; famed diva Marian Anderson (Depriest’s aunt) broke the color line in 1955 when she performed at the Metropolitan Opera, eight years after Jackie Robinson was allowed onto the Brooklyn Dodgers. Weil’s disillusionment with the Jim Crow
U.S. after leaving his native South Africa eventually caused him to leave this country too, she said. “I remember thinking” said Ginsburg as she recalled sitting in that darkened theater, “that this” – Apartheid – “won’t end in my lifetime.” She paused. “One of the most exhilarating things to happen in my lifetime is that Apartheid did end.” After 50 minutes, the justice, appointed by Bill Clinton in 1993 after a career in public-interest law, took questions, and was asked if she had presided over any case that would
