The Newz Magazine volume #7 is the perfection and continuation from the previous edition, as a Magazine which tells us about many informations of the Local Board of ALSA LC Unsoed, everything about Purwokerto and it's culture so the reader of this Magazine can know well about us and Purwokerto more clearly .

This time the Editor brings ”Glorius of Locality” as the theme with the title is “Heroes” which will uplift the struggle of Local Heroes when they struggled for the freedom. Also, we are going to talk about the marvelous and the greatness things which did uphold this city so it can not be considered as an ordinary city, because the Purwokerto itself holds a magnicent story that will make the reader nd out more and more interesting stuffs about Purwokerto.

By creating this Magazine, we hope it can be a good knowledge for all the readers out there that reading. Through this we can share deeper story and event that held in our beloved and lovely city “Purwokerto” which most people do not realize about and its existence.

Speaking about this Newsmagz Volume #7, we are carrying the theme “Glorious of Locality”, with the background of Purwokerto which has been known as Kota Ksatria, where there are many interesting disccusions related to local wisdom from this Bumi Ksatria, with the title “Heroes” . For your information, when we are talking about heroes even UNSOED's name itself was taken from the name of national heroes, guerrilla heroes, a ve star Major Generals Indonesia, that is Jenderal Soedirman.

By creating ALSA LC Unsoed Newsmagz vol #7, I hope in the future it will Prof. Dr. Tri L. S.H., M.H., Ph.D become useful for all of us for knowing that the Newsmagz creating a better progress and development through the creation from each time to time with so many ideas and creativity that uplift the way thinking of people, especially in this modern era and more exclusively for Law Student.

My biggest hope to the dearest ALSA LC Unsoed, not only become an organization where the togetherness will not dissapear as the time goes by, but MAULIDAR I hope that all of you can be a big and solid family who always give guidance to make a better ALSA LC Unsoed.

or the term Purwokerto it is originated from word “Purwo” means “Wiwitan” or origins, and word “Kerto”which means wealth, so Purwokerto has a meaning the origin of wealth.

At the date of February 21st-23rd 1861 Banyumas city as a capital city of Banyumas regency had stricken by a great flood because of serayu river are overflow. On the next progress, Purwokerto regency was erased, and then joint up with the Banyumas regency with Purwokerto as a capital that also became a Banyumas karesidenan capital city on year 1936. With the initiative from Adipati Aryo Sujiman Gondosubroto (third Banyumas regent) pendopo “Si Panji” at the date of 5th January 1937 was removed from Banyumas to Purwokerto.

Re g u l a t i o n s o n local government that had undergone several changes were not quite affected m a n y r e g i o n distribution (districts and village) in B a n y u m a s r e g e n c y.

atria in here contains two meaning. First, Satria is an abbreviation or acronym of the Prosperus, Fair, Orderly, Neat, Beautiful and Safe. The motto that contained in the phrase is in line within the development efforts that keep running and continue to be implemented by local goverment. Satria role as a motto, work ethics for apparatus and society also as a target or development direction. Second, Satria has a meaning about characteristic of Banyumas people that “Cablaka”. It means honest, straightforward, whole-hearted, genuine, have high loyality, big dedication and brave as a character of a knight. Bawor gure as a unique puppet characters from Banyumas that became a trademark.

Heroes From MAIN ARTICLE

General of the Army Raden Soedirman was born in Purbalingga on 24 January 1846, and grew up in cilacap.He was the hero of Independence defenders who did defend the Republic of Indonesia which he loved. He noted as well as the first General Commander and the youngest in this Republic.Soedirman was one of the fighters and exemplary leader of this nation. Personal firm on principles and beliefs and always put the interest of the people and the nation above his personal interests. He had always been firmly in defending the interests of the homeland, nation and state.

This may be seen when the Dutch Military Aggression II. He was in a weakened state due to illness remains determined to go jump in guerrilla although stretchered. In sickness, acute tuberculosis gnawing his lungs. He led and encouraged the soldiers to take the fight against the Dutch. That was why he was mentioned as one of the great figures by the revolution of this country. He also was a teacher who could improve children's desire to learn.

Lt. Gen. Suprapto along with the great Commander General Sudirman also had lead and became his aide in the fight against the British. Upon his return to Indonesia, he was often assigned sedentary. The job he waistband was very heavy, because he had to be careful so the incident that occurred before that rebellion would not recur. On the morning of October 1, Suprapto, attended by a flock of people who claimed to be a presidential guard (Cakrabirawa), who said that he was called by president Soekarno. Suprapto then put into a truck and was taken to Lubang Buaya, a suburb of Jakarta, along with 6 others.

In the evening, General Suprapto and six others were shot to death and thrown into an old well. New on 5 October, the bodies of the victims of the killings could be removed and buried at Kalibata Heroes Cemetery. On the same day, President Sukarno issued Presidential Decree no. 111 / KOTI / 1965, which inaugurated the joint Suprapto Lubang Buaya other victims as heroes of the revolution with a given rank of lieutenant general in memory.

Who does not know the General Gatot Subroto, a hero of freedom fighters has a very significant role in the struggle

to defend the independence of Indonesia from the Dutch attack. Since childhood, he had shown the leadership character. He had natural sense of courageous, assertive, responsible, and abstinence of arbitrariness. He stood up to the Dutch children who were considered as "higher". Gatot known as introspective and frankly leader. He also as the favorite field general of the army. He was able to crush the rebel army and returned home to bring the victory home by bringing the rebels back into the ranks of the security forces of the people. Gatot Subroto biography is not only impressive courage of a military soldier, but also the person who has the soul of a high empathy. Although he was a good soldier in the colonial era, but he paid attention to the little people are oppressed. No doubt, he had donated his salary to help the families of the prisoners who were under his supervision.

Soeparjo Roestam Supardjo Roestam was an aide-1 of General Gatot Subroto.

He was a loyal army of the general. He managed to break the blockade and brought other forces logistics of food, but he gained only limited logistics and he shared to increase energy. In his real life, he was a respected person because he was an authoritative figure. He has a persuasive nature and an easy going person. He was a leader and the first governor of Central Java who was trusted by the president to serve as Ministry of Home Affairs. While he served as a governor, he received the highest award for a region because of his success in all development.

This is why we as editor, choose this word to be our title of Newsmagz volume 7. Because we want to give a beautiful impact toward the society especially to the readers, and through this magazine, readers will get more to know about Purwokerto, especially ALSA LC Unsoed. We're also inspired by Purwokerto as known as Kota Ksatria (re: City of hero). It reminds us to bring back the glorious that Purwokerto has.

Lot of things that you can find in Purwokerto which majority people less know about.

HERO. “JAS MERAH! Jangan sekali-kali meninggalkan sejarah!” berikut merupakan sebuah kutipan dari pidato Bung Karno, Prokalmator RI pada HUT RI 1966. Pada Pidato tersebut Bung Karno bermaksud agar setiap orang baik masyarakat Indonesia maupun secara global jangan pernah untuk meninggalkan atau melupakan sebuah sejarah, karena sejarah merupakan sebuah proses yang harus dihormati dan diapresiasi setinggi-tingginya. Apalah daya sebuah insan terbentuk tanpa melalui sebuah proses.

iap-tiap aspek di muka bumi memiliki sejarah atau prosesnya masing-masing. Mulai dari sejarah bagaimana bumi ini dibentuk, sejarah sebuah peradaban, sejarah terbentuknya sebuah negara, dan sebagainya. ALSA Local Chapter Universitas Jenderal Soedirman sebagaimana sebuah organisasi dibawah naungan Asian Law Students' Association tentu memiliki proses bagaimana organisasi ini terbentuk.

Tidak hanya proses bagaimana organisasi ini terbentuk melainkan juga orang-orang yang berjasa dibalik pembentukan proses dari awal hingga membangun ALSA LC Unsoed hingga menjadi organisasi yang besar dan disegani.

Berbicara tentang orang-orang dibalik proses membangun ALSA LC Unsoed, tentu banyak sekali loyalis-loyalis ALSA LC Unsoed yang menyediakan tenaga, waktu, serta buah pikirannya untuk membangun organisasi ini. Namun seorang pemimpin adalah orang yang memiliki peran cukup besar atas proses pembangunan tersebut. Dibawah komando dari seorang pemimpin, atau yang dalam hal ini ALSA LC Unsoed

menyebutnya seorang Director, tahun demi tahun memberikan arahan kepada jajarannya untuk membangun ALSA LC Unsoed dan terus menambah prestasi serta menjaga eksistensi organisasi ini.

NATIONAL ALSA LC UNSOED's EVENTS S

elain Director atau pemimpin Local Chapter yang menjadi 'pahlawan' tahun demi tahunnya, para penggiat organisasi ini pun kerap kali mencetak sejarah-sejarah besar dalam proses membangun ALSA LC Unsoed. Salah satu prestasi besar yang mengukir sebuah catatan sejarah adalah menjadi host atau tuan rumah acara nasional ALSA Indonesia. Selang dua tahun dari kelahirannya, ALSA LC Unsoed pun pernah dipercaya untuk menjadi tuan rumah MUNAS X pada tahun 2003. Selain itu ALSA LC Unsoed juga pernah dipercaya menjadi tuan rumah National Moot Court Competition pada tahun 2011, dan yang terakhir kembali dipercaya menjadi tuan rumah Semunas XXIII pada Maret 2016 lalu.

NMCC 2011 Pada NMCC 2011, tender diambil pada Rapat Pimpinan Nasional tahun 2010 di Unair, Surabaya, Jawa Timur. Pada saat itu Angga Mulki dan Nunu yang menghadiri Rapat akbar tersebut. Dan pada tahun 2011 ALSA LC Unsoed didaulat menjadi tuan rumah NMCC di Munas ALSA LC Universitas Jember.

Pada kala itu melibatkan kepanitiaan dari Keluarga Besar Mahasiswa Fakultas Hukum (KBMFH) – sebutan untuk mahasiswa fakultas hukum Unsoed— total panitia kurang lebih 110 orang.

Dalam persiapan dibantu KBMFH dan instansi seperti Polres Banyumas K e j a k s a a n N e g e r i P u r w o ke r t o, Banyumas dan Purbalingga serta PERADI Banyumas dan akademisi Unsoed.

“Untuk dana anggaran sekitar 90 jutaan, pas proses 2010 bersama mas Angga Mulki ke Mahkamah Agung untuk memperpanjang MoU dan pembaharuan dengan Mahkamah Agung, untuk m e n g a j u k a n ke r j a s a m a d e n g a n Mahkamah Agung, namun untuk Piala tidak di ACC, tapi MoU di ACC. Dan Piala NMCC ALSA Mahkamah Agung pertama kali dibuat oleh ALSA LC Unsoed.” ujar Rizky Adam AH, Director ALSA LC Unsoed 2010-2011.

“Dukanya saat menjadi panitia banyak perbedaan pendapat karena mengatur banyak orang, banyak perselisihan yang terjadi dan juga Pencarian dana, sulit sekali namun dibantu Koordinator Usaha Dana dan Ibu Rochani selaku dekan FH Unsoed kala itu. Sedangkan sukanya, ALSA secara tidak langsung memberi banyak kontribusi dalam kampus, salah satunya fasilitas di kampus menjadi semakin baik. Berbaur dengan kbmfh, menyatu seperti keluarga dengan adanya NMCC ini. Bisa kenal dengan orang orang disekitar kita selain dikampus seperti jaksa, polisi atau instansi instansi lain.” Tambah Rizky Adam.

SEMUNAS XXIII SEMUNAS XXIII di Purwokerto tentu masih mengikat kuat dibenak kita, karena baru dilaksanakan pada tahun 2016 ini. SEMUNAS XXIII mengambil tender pada masa ke pengur usan Rakhmat Fandika Timur periode 20142015 sedangkan pelaksanaannya pada tahun kepengurusan Zarka Fawdhi periode 2015-2016. SEMUNAS XXIII dibuka di Gedung Roedhiro Fakultas Ekonomi Unsoed sekaligus pelaksanaan Seminar Nasional terkait e-commerce.

ndonesia sudah resmi terjajah secara ekonomi oleh China. Penyebabnya pemerintah Indonesia kembali berutang senilai US$3miliar, atau setara Rp40 triliun kepada China. Tiga bank Badan Usaha Milik Negara (BUMN), yaitu Bank Mandiri, Bank Negara Indonesia, dan Bank Rakyat Indonesia mengajukan utang ke China Development Bank (CDB) dengan diinisiasi oleh Menteri BUMN Rini Soemarno di Beijing, pada 16 September 2015 lalu.

Masing-masing bank plat merah tersebut mendapat US$1 miliar dengan jangka waktu pinjaman selama sepuluh tahun dengan komposisi 30 persen dalam mata uang renmimbi dan 70 persen dalam dolar Amerika.

Suntikan pinjaman dari CDB nantinya akan dipakai untuk financing dan refinancing berbagai prog ram pembangunan dan perdagangan selama periode Presiden Joko Widodo.

Pengamat politik Muslim Arbi dalam pernyataan, beberapa waktu mengatakan, “ H a r u s n ya P r e s i d e n Jo kow i b i s a mencegah tiga Bank BUMN utang ke Cina,” papar Muslim.

Menurut Muslim, sebenarnya ketiga bank BUMN tersebut sangat sehat dan tidak perlu mendapat utangan dari negaran manapun. “Ini menandakan ada kepentingan tersembunyi dari Menteri BUMN Rini Soemarno. Utang itu beban bagi bangsa Indonesia khususnya bankbank tersebut,” jelas Muslim.

Kata Muslim, Cina sangat berkepentingan menguasai p e r e ko n o m i a n I n d o n e s i a d e n ga n memberikan utangan. “Kalau Bank BUMN sudah dikuasai Cina, maka dengan mudah negeri Tirai Bambu itu menguasai Indonesia,” papar Muslim.

Seharusnya Kementerian Badan Usaha Milik Negara berkonsultasi dengan DPR RI sebelum melakukan pinjaman, karena risikonya juga sangat besar bagi ke u a n ga n n e ga r a . R a k y at h a r u s mengetahui bahwa utang swasta dan BUMN sedang meroket dengan angka yang fantastis. Totalnya di atas 80 persen dari utang luar negeri.

Resiko dari utang jangka panjang tersebut bisa menjalar kemana-mana.

Pe r t a m a y a i t u a k a n m e n g g e r u s pendapatan ketiga bank BUMN tersebut karena harus membayar cicilan pinjaman dalam jangka panjang. Otomatis dividen juga ikut menurun. Kedua, proyek infrastruktur yang belum jelas hingga kini menyimpan kegagalan. Bila sudah gagal bagaimana utang itu bisa dibayar?

Ketiga, tingkat pengembalian utang itu s a n gat b e r ga n t u n g p a d a p r o ye k infrastruktut. Idealnya dipastikan dulu proyek infrastruktur itu punya nilai ekonomis yang berimbang, jika tidak maka hanya akan menjadi beban negara.

n Purwokerto City, there are two roads that quite famous, those are Ragasemangsang street and Pekih street.

Ragasemangsang street located at east of the Banyumas' government ofce, exactly between PLN and BNI Purwokerto. In the mid of the street, there was a tomb (not tugu) called Ragasemangsang Tomb.

Reputedly, people in these areas live in safety and peace under the leadership of a Kyai, the Kyai known as Kyai Pekih. Kyai pekih was not only a wise and prudent, but also intelligent and had a supernatural powers.

He was deeply respected and honored citizens of this area.

Once the authority of Kyai Pekih was tested.

The area where was safe and secure, changed.

Almost every night had always been a commotion mainly by thieves disorders.

Turned out the culprit was a very powerful thieves. The thief was never caught by the citizens. Because of the incidence was very protracted, Kyai Pekih that very powerful was intervened.

One night Kyai Pekih out of the house and around the village (formerly this area was a village). The powerful thieves who every night disturbing the village, was caught by the Kyai on a street. A ght happened tremendously.

Kyai Pekih and thieves were mutually compete their magic. As well as the ght of the day, the battle ensued for a long time, the powers were deployed each other mutually. Moment-bymoment, skill-by-skill did turn out. Kyai Pekih on the side of right nally won the deadly battle.

The thief got beaten and was thrown then stuck in a tree and died instantly. Then his body was burried under the tree. With the deaths, the area was safe and peaceful ever after.

But the night's incident continued to be a subject of conversation among the citizens and nally the grave of thief later was named TOMB RAGASEMANGSANG, roads that pass through so-called Jalan Raga Semangsang (from java language: RAGA = Body, SEMANGSANG = stuck above). And residence Kyai Pekih Pekih was later named Dukuh Pekih and The road was later named Jalan Pekih.

egalan is one of the many traditions that inherited from generation to generation by the society in Banyumas regency region, Middle Java. Begalan became a part of tradition which is doing in marriage reception sequence. Various meanings and message for the society is implemented in this tradition. Begalan comes from word Begal in Banyumas language that has a meaning pirate or robber. Begalan means a deprivation or robbery in the middle of the road.

Begalan performance in marriage reception is believed can bring goodness for the married couple when later they undergo domestic life.

Begalan comes from the story on Adipati Wirasaba. At that time Adipati had taken a princess from Adipati Banyumas as a wife in

Saturday pahing. As much as men who wanted to take a girl as his wife, Adipati Wirasaba with his line brought the knick knacks that was needed in the wedding. In the middle of the way, Adipati Wirasaba line met with the garong or robber that in Banyumas called as Begal.

The ghting could not be avoided between Adipati lines with the begal. The ghting was won by the line of Adipati Wirasaba and his lineup. The place where it happened later named Sokawera, because Adipati Wirasaba that did ght with rawe-rawe rentas malangmalang putung.

Later the lineup was resting for a minute in the middle of the jungle with checking their belonging, and unfortunately there was something missing or odd with the belonging.

That's why the place was called or named Pegalongan. And in the middle of the way when they wanted crossing the river, the lineup found a dead body from the robbery that named Suradilaga. The place that the dead body found from the robbery named Suradilaga, later named and called Cindaga.

Then the journey continued until in the place that wedding was held on, until the wedding was done well.

This short story was part behind the tradition begalan of Banyumas society. This story was also seen in the Begalan performance show, which is actored by two people, one people is acted as carrier of the goods (kitchen equipment) that named Gunareka, and one another is acted as robber or pirate that named Rekaguna. This story is also believed by some p e o p l e o f Banyumas Society that still holding on to the custom and tradition to avoiding going faraway place in Saturday pahing. They believed if people go to faraway place on Saturday pahing that they will be in dangerous.

Biografi Rodrigo "Rody" Roa Duterte (lahir 28 Maret 1945; umur 71 tahun), yang berjuluk Digong, adalah seorang politikus dan pengacara Filipina keturunan Visayan. Duterte adalah salah satu walikota yang paling lama menjabat di Filipina dan merupakan walikota Kota Davao, sebuah kota yang sangat tinggi urbanisasinya di pulau Mindanao, selama 7 masa jabatan, dengan total lebih dari 22 tahun. Ia juga menjabat sebagai wakil walikota dan anggota kongres di kota tersebut.

Pada 21 November 2015, Duterte mendeklarasikan pengkandidatannya untuk Presiden Filipina dalam pemilihan 2016.

Kehidupan awal Duterte lahir pada 28 Maret 1945 di Maasin, Leyte, Persemakmuran Filipina dari pengacara Cebuano Vicente G. Duterte, yang menjabat sebagai Gubernur (pada waktu itu belum dibagi) Davao dan Soledad Roa, yang berasal dari Cabadbaran, Agusan yang merupakan guru sekolah dan pemimpin civic. Ayah Duterte, Vicente, sebelumnya menjadi gubernur provinsi Davao, yang sesekali menjadi walikota Danao di Cebu. Sepupu Rodrigo, Ronald, di sisi lain, menjabat sebagai walikota Kota Cebu dari 1983 sampai 1986. Ayah Ronald, Ramon Duterte, juga memegang jabatan tersebut dari 1957 sampai 1959. Keluarga Duterte dianggap menjadi keluarga politik dari klan Durano dan Almendras sebagai kekerabatan.

Duterte, 'Si Bengal' dengan Beragam Julukan Rodrigo Duterte adalah seorang Wali Kota Davao, sebuah wilayah terbesar di Filipina, yang memenangkan pemilihan Presiden Filipina pada Senin, 9 Mei 2016. Selama berkarier di politik, Duterte meraih sukses dengan jabatan penting di Kota Davao, antara lain pernah menjadi Kepala Eksekutif Politik Mindanao 1988-1998, 2001-2010, sebelum diambil alih oleh putrinya, Sara, pada 2010-2013. Ketika masih belia, Duterte menempuh pendidikan di Kota Davao tapi dia sering membolos untuk jalan-jalan, sehingga dua kali dikeluarkan dari sekolah. Ayahnya, Vicente Rodrigo, seorang gubernur Davao pada 1950, marah melihat perilaku anaknya sehingga mengungsikannya di sebuah kota kecil, Digos City, sekitar 57 kilometer dari Davao, untuk menempuh pendidikan.

Meskipun dikenal bengal dan temperamental, tapi ada sisi humanis dalam diri Duterte. Jika dia memiliki masalah yang sulit dipecahkan, Duterte suka pergi ke kuburan orang tuanya. Di pusara kuburan tua Kota Davao itu, Duterte berdoa untuk kedua orang tuanya seraya menyampaikan keluh kesahnya.

Kini, pria 71 tahun itu akan dilantik sebagai Presiden Filipina menggantikan Benino Aquino pada 30 Juni 2016.

Hal penting dari sosok Rodrigo "Digong" Duterte Nama Rodrigo Duterte mulai mencuri perhatian publik ketika dia maju sebagai calon Presiden Filipina dalam pemilu bulan Mei lalu. Walau tidak diunggulkan, rupanya Duterte berhasil keluar sebagai pemenang dengan meraih 14,8 juta suara. Dia mengalahkan saingan terberatnya, Manuel Roxas.

1. Awali karir dari Walikota

Sebelum menjadi Presiden, Duterte pernah menjadi Wali Kota Davao hingga tahun 1998. Sejak menjadi wali kota, julukan “the punisher” telah melekat di sosok Duterte.

Alasannya, Duterte sangat tegas dalam mengatasi tindak kriminal di kota tersebut sehingga membuat ciut nyali para pelaku kriminal di Davao.

Alhasil, angka kriminalitas di kota Davao menurun secara signifikan hingga tahun 2000. Sayang, cara yang dipilih Duterte tergolong kejam. Di bawah kepemimpinannya, banyak orang yang tewas dengan cara misterius.

Beberapa aktivis mengaku bahwa mereka memiliki dokumentasi ratusan pembunuhan yang dilakukan oleh kelompok penjagal saat Duterte masih menjabat walikota. Dia diduga yang menginstruksikan pembunuhan tersebut.

2 .Gaya bicara ceplas-ceplos Selain terkenal tegas dalam menjalankan kebijakannya, popularitas Duterte meroket karena gaya kepemimpinannya yang tidak formal. Gaya bicaranya ceplas ceplos dan kerap melontarkan sumpah serapahnya. Salah satu makian yang sering dia lontarkan yakni “putang ina” atau yang bermakna “anak seorang pelacur”.

Akibat gaya bicaranya ini yang membuat publik ragu terhadap kemampuan berdiplomasi Duterte. Dia pernah memaki siapa pun, mulai dari Presiden Amerika Serikat, Barack Obama, hingga pemimpin tertinggi umat Katolik, Paus Fransiskus.

Nyalinya yang besar membuat Duterte tidak gentar menghadapi kelompok militant Abu Sayyaf yang berbasis di bagian selatan Filipina. Bahkan, dengan gayanya yang khas, Duterte mengancam akan memakan tubuh para teroris itu dengan menggunakan cuka dan garam.

“Kalian bisa merekrut orang, memperkosa, atau memotong leher tapi kami tak akan membiarkan itu. Kami bisa lakukan itu 10 kali lebih brutal. Saya pertaruhkan kehormatan saya, hidup saya dan jabatan saya selaku Presiden!,” ancam Duterte.

3. Gagas perang terhadap narkoba Duterte berjanji kepada rakyatnya akan mengakhiri perdagangan obat-obatan terlarang di Filipina dalam kurun waktu 3-6 bulan mendatang. Hal ini terbukti sejak dilantik dan menjabat pada tanggal 1 Juli, selama pemerintahan Duterte, hamper 3.000 orang telah tewas.

Sementara, lebih dari 4.400 orang yang terkait narkoba telah ditangkap. Duterte juga mengiming – imingi hadiah sebesar 2 juta peso atau sekitar Rp 570 juta kepada siapa saja yang berhasil menangkap polisi atau pejabat yang melindungi gembong narkoba di Filipina.

Namun karena aksi kerasnya ini, Duterte diprotes oleh kelompok pembela HAM seperti Human Right Watch and Amnesty International. Dia dianggap melanggar hak asasi manusia dengan membunuh orang tanpa melalui proses hukum terlebih dahulu. Kampanye anti narkobanya ini juga pernah diprotes oleh organisasi PBB yang mengganggap program, tersebut ilegal.

Dalam kampanyenya pada 7 Mei lalu di Manila, Duterte menyatakan, "Lupakan hak asasi manusia. Jika saya berhasil masuk istana kepresidenan, saya hanya akan melakukan apa yang telah saya lakukan sewaktu menjadi wali kota dulu.

Kalian para pecinta narkoba, tukang sembunyi dan tak mau berbuat apa-apa, lebih baik enyah saja kalian. Karena saya akan bunuh kalian. Saya akan buang kalian semua ke Teluk Manila untuk menggemukkan perut ikan-ikan di sana,”.

Dia bahkan mengancam jika ada yang berani menuduh telah membunuh para pengedar narkoba, maka Duterte bersedia digugat.

“Tetapi, saya juga akan membunuh kalian,” kata Duterte.

rganizing, Leadership, and Management of ALSA and Outward Bound (OLMA-OWB) is an annualy agenda of every Local Chapter of ALSA with difference theme ini every year. This program is held as a sequence to induct new mempers of ALSA LC Unsoed.

For OLMA, was held from October 12th – 14th 2016 at Room 15, Justisia 1 Building, law faculty, with materials such are organizing, leadership, and management which had delivered by Zufranur Fauzi, Abyan Kurniawan, and Annisa Ifandari.

For OWB itself, was held from October 15th-16th 2016 at Pondok Indah Villa, with several agendas such are History of ALSA LC Unsoed; presentation of competitions; material presentation from National Board of ALSA NC Indonesia; story sharing from members, demissioners, Advisory Council, and Alumnies of ALSA LC Unsoed; also an outbound activity around Baturraden. In this program, also held an inauguration which had became a special agenda from sequences of OLMA-OWB, thus every paricipant legally inducted as member of ALSA LC Unsoed.

Automatically they joining into the big family of ALSA LC Unsoed.

TINJAUAN PERATURAN RANCANA DERATIL TATA RUANG KOTA PURWOKERTO DARI PERSPEKTIF HUKUM ADAT DAN KEARIFAN LOKAL

L

egal Coaching Clinic (LCC) is one of all porgrams of National Board of ALSA NC Indonesia, with aim to make people realize about law, especially for law students, formly into socialization and elucidation. This is a mandatory program which should be held in every Local Chapters on Indonesia, also ALSA LC Unsoed. This year, LCC has a grand theme, it is Custom Law and kearifan lokal, and LCC of ALSA LC Unsoed entitled as “Review of Regulation of Plannatory about Detail of Landmark city of Purwokerto, by Custom Law perspective and kearifan lokal�

This LCC had background about Custom Law and kearifan lokal, with its relativity toward the effectivity RDTR Regulation of Purwokerto, had meaning to give participants (students and society) so can understand about the implementation of the regulation itself and values of custom law itself.

LCC of ALSA LC Unsoed had been held on Saturday, November 19th 2016, at Pendopo Wakil Bupati Kabupaten Banyumas. It started at 09.00 and participated by 99 participants, who are Law Faculty students of Unsoed, students from other universities, also society. The speakers are Mrs. Rochati, S.H., M.Hum as lecturer of custom law from Law Faculty of Unsoed, Mr. Sugeng Waluyo as Budayawan, and the moderator is Mr. Sulyana Dadan S.sos, M.A as lecturer of Soc-pol Disciplines Faculty of Unsoed.

The event were started by sang the National Anthem of Indonesia, Indonesia Raya and continued

by ALSA Anthem. After that, there were greetings from Mr. Narindra Abi as the Project Officer, Mr. Ilmawan H. Mughni as the Director of ALSA LC Unsoed, Rizky Rachmadina as the representative of National Board of ALSA Indonesia, Rizky Maulidar as the President of Student's Executive of Law Faculty of Unsoed, and we had Mr. Dr. H. M. Isplancius S.H.,M.Hum as the representative of Dean of Law Faculty of Unsoed, also for the last greeting, we had the expert staff in Politics and Law field, Mrs. Heni Sulasti S.H representing Bupati, and open the event symbolically by banging the gong.

Saman dance also took a role to entertain participant before entering the main agenda of LCC 2016. To open the first session, it started with explaination from the first speaker, who was Mrs. Rochati S.H., M.Hum and moderated by Mr. Sulyana Dadan S.sos, M.A. in this session, there was also a question-answer segment.

The second session, continued by explaination from from the second speaker, who was Mr. Sugeng Waluyo.

Question-answer segment also existed in this session. All the questions from participant could be asked directly to the speakers through the moderator.

The first session, the explination was about custom law and kearifan lokal generally, and suddenly jumped to the main topic, then found the correlativity between culture of Banyumas with this main problem, with all its values by the existance of the regulation. At the second session, the explaination was about history of Banyumas generally, then specifically why did exist the regulation about prohibiting to build the building not as high as main Pendopo in this city, and it was regulated by the local goverment.

Right after all explainations and question-answer session, there was an awarding for the best participant who gave the best question, and the award went to the representative from society.

n the date November 26, 2016, ALSA (Asian Law Student Association) held an event that is ALSA CARE. This event is held by student activity unit ALSA from Law Faculty Jenderal Soedirman University. ALSA CARE is a form of sequence activity as an implementation of our care toward the general public. ALSA CARE this year theme “Budayakan Teknologi Kreatif dalam Menghadapi Dunia Tanpa Batas�. The event was held in the Village Kedondong, District Sokaraja, Banyumas Regency. This event was attended by the Head Village Kedondong Village that replaced by the Village Secretary that is Pak Wiwit, the Leader of ALSA LC Unsoed student activity unit that is Ilmawan Husain Mughni, and the Project Officer of ALSA CARE that is Shahrandy Prakoso. Beside that the event was also attended by some of the sides from every speaker that is Edy Prayitno, S.IP, M.M from BAPERMAS Banyumas Regency Government, then Supriyanti, S.E. from Klampok Ceramic Craftsmen, and Puspo Santi, S.H. from Telkom Indonesia.

This ALSA CARE event was formed with disscusion panel that lead by Andika Bayu Aji Pratama as a Moderator. The first event from ALSA CARE is Socialization about Society Empowerment. The Seminar was brought by Pak Edy Prayitno as the speaker representatives from BAPERMAS Banyumas Regency Goverment. This Seminar goals was to increasing the spirit of every people in Kedondong Village to be more active on using the natural resources around us in optimal way.

And then continued with the practice of making potter y that fill up by Bu Supriyanti from artisan ceramics. The point of this practice was held, because in the area of Kedondong Villagein their usage of the clay is just for making brick.

With this practice we hope the society of Kedondong Village is able to utilize the clay to become a valuable craft compared to brick. For example, wall accesories, ewer, statue, and etc. After that the event was ended with e-commerce seminar and Internet Education that is Positive and Useful Internet.

After the society made a pottery, we hoping the society around us can sell the craft not just only in Kedondong Village area and around it, but also include more wider area, city, or even country. Beside that the using of the internet is also important, so that the society around the area or village will more realize about the importance of internet capability. The society can find information, buy and sell, and etc so that the society of Kedondong Village will not left behind with another area that already been using the internet.

Last event from Kedondong Village that representated by Pak Wiwit receive poster along the certificate on his participation in ALSA CARE Event. And then continued with the giving of the poster itself along with the certificate to each speaker including Edy Prayitno, S.IP, M.M, Supriyanti, S.E., and Puspo Santi, S.H. The event was closed with the certificate awarding to moderator, Andika Bayu Aji Pratama. And also ALSA left the WiFi for Kedondong Village and left a printout to make ceramics for Kedondong Village. Within the hope later Kedondong Village society could empower the usage of clay continuosly.

NATIONAL | SEMWORKNAS 2016

S

eminar & Workshop Nasional or National Seminar & Workshop is one of the annual academic activities of ALSA Indonesia. This event formed to a series of activities, the Seminar presented by speakers from various law fields (government, professional, and tourism organization) f o l l o w e d b y Ta bl e D i s c u s s i o n r e s u l t i n g a l e ga l recommendation and ended by the closing ceremony.

The schedule of the first day was Opening Ceremony that held on site area Lawang Sewu. Many people assumed Lawang Sewu as anchor and mystical place. But now, Lawang Sewu transformed into the most beautiful place in the city of Semarang. All the delegates were required to wear Batik as their dresscode at Opening Ceremony. And this event was officially opened by the Governor of Central Java, Mr. Ganjar Pranowo symbolic with the beating of gong. After the opening had done, the 13 Local Chapter delegates were presented with a fancy dinner with a display of Video Mapping by the committee that also introduced cultures of each Local Chapters.

On the second day of SEMWORKNAS 2016, was continued with the agenda of National Seminar which held at the Paramartha Hall, Police Academy in Semarang. This event took theme: "Implication of Indonesia Investment List of I nve s t m e n t o f Fo r e i g n I nve s t o r s i n I n d o n e s i a " .

Lawfirm) Moderator: Mohammad Reza Widodo., SH On the 3rd day, was continued with agenda SEMWORKNAS 2016 Workshop which had been held at Patra Jasa Hotel Ballroom. Workshop is where the delegates began to practice what the seminar discussed on the second day, but before the workshop began, the delegates had been divided by the discussion of each team. Then once creating teams, it b e g a n t h e discussion of each agenda, first was an informal discussion which w a s t h e discussion by the committee to test how well the participants prepared, whether the delegates followed workshop.

ALT is an ALSA National Chapter Indonesia annualy event which was held by ALSA Local Chapter Universitas Indonesia on September 26-29 ago.

National Seminar is a starting event that usually held on the first day. The seminar was divided into two sessions. First Session with theme “Understanding Legal Profession Ethics and its Application in Practice : An Insight for Your Future Career”. On this seminar, they had disscused about proffesion's ethics and how was the application in practice from every job in law field. The speakers on the first session of the Seminar was Narendra Jatna as prosecutor, M. Idwan Ganie as advocate, and Buntario Tigris as notary. Then, on the second Seminar session was continued by the very interesting speaker, who was Abraham Samad a n d A n d y Mattalata, with theme “Law Practitioners As Our Nation's Leaders”. They explained how to become law practitioners with leadership qualities with high integrity.

Pre-Munas or Pre-National Conference is a national annualy event. This activity disscused some substansial things as a

preparation for Munas (Musyawarah Nasional) or National Conference that held to disccus about AD/ART ALSA Nasional Chapter Indonesia, so that it can increase the disscusion effectivity when the Munas time will be held on.

Pra-Munas or Pre-National Conference was held on the second day and by three delegates from each Local Chapter.

Leadership Motivation Seminar is an coincident activity with Pre-National Conference. This activity was brought by James Gwee from Singapore with theme “Bring Out Your Leadership Potential.” From this activity we could obtain the benefit that we can recognize every different personality, interesting way to reach our goals and dreams, as well as how to obtain success to become a leader.

ALSA Division Sharing was an sequence activity about sharing divisions from each Local Chapter. It was divided into 5 divisions such are Law, External, Internal, English, and Funding. In this activity, the delegates became more aware about every division from each Local Chapter.

Closing Ceremony was a closing activity at night with a theme Masquarade Ball. Whereas each delegation obligated to wearing a dress code that had been determined by committee.

Each delegation obligated to bring a partner for entering the ballroom where the event was held on.

City Trip was an event held on Thursday, September 29, 2016.

Delegates were invited to take a look around the Jakarta city, exactly in the Pantai Indah Kapuk and later headed to Tsu Chi Buddhist Foundation Indonesia to conduct charity.

PROSES PEMERIKSAAN PERKARA PIDANA DI INDONESIA PENYELIDIKAN | PENYIDIKAN | PENUNTUTAN | PEMERIKASAAN

Seorang penyidik dalam melaksanakan tugasnya memiliki koridor hukum yang harus di patuhi, dan diatur secara formal apa dan bagaimana tata cara pelaksanaan, tugas-tugas dalam penyelidikan.

Artinya para penyidik terikat kepada peraturanperaturan, perundang-undangan, dan ketentuanketentuan yang berlaku dalam menjalankan tugasnya.

Dalam pelaksanaan proses penyidikan, peluangpeluang untuk melakukan penyimpangan atau penyalagunaan wewenang untuk tujuan tertentu bukan mustahil sangat dimungkinkan terjadi. Karena itulah semua ahli kriminalistik menempatkan etika penyidikan sebagai bagian dari profesionalisme yang harus d miliki oleh seorang penyidik sebagai bagian dari profesionalisme yang harus dimiliki oleh seorang penyidik. Bahkan, apabila etika penyidikan tidak dimiliki oleh seseorang penyidik dalam menjalankan tugas -tugas penyidikan, cenderung akan terjadi tindakan sewenang-wenang petugas yang tentu saja akan menimbulkan persoalan baru.

Ruang lingkup penyelidikan adalah serangkaian tindakan penyelidik untuk mencari dan menemukan

suatu peristiwa yang diduga sebagai tindak pidana guna menentukan dapat atau tidaknya dilakukan penyidikan menurut cara yang mengatur dalam undang-undang No 26 tahun 2000 pasal I angka 5.

Penyelidik karena kewajibannya mempunyai wewenang menerima laporan, mencari keterangan dan barang bukti, menyuruh berhenti orang yang dicurigai dan menanyakan serta memeriksa tanda pengenal diri, dan mengadakan tindakan lain menurut hukum yang bertanggung jawab.

Berdasarkan ketentuan Pasal 16 ayat (1) KUHAP, untuk kepentingan penyelidikan, penyelidik atas perintah penyidik dapat melakukan penangkapan.

Namun untuk menjamin hak hak asasi tersangka, perintah penangkapan tersebut harus didasarkan pada bukti permulaan Barang Bukti.

Penyelidikan yang dilakukan penyelidik dalam hal ini tetap harus menghormati asas praduga tak bersalah (presumption of innocence) sebagaimana di sebutkan dalam penjelasan umum butir 3c KUHAP. Penerapan asas ini tidak lain adalah untuk melindungi kepentingan hukum dan hak-hak tersangka dari kesewenang-wenangan kekuasaan para aparat penegak hukum. Selanjutnya

kesimpulan hasil penyelidikan ini disampaikan kepada penyidik.

Apabila didapati tertangkap tangan, tanpa harus menunggu perintah penyidik, penyelidik dapat segara melakukan tindakan yang diperlukan seperti penangkapan, larangan, meninggalkan tempat, penggeledahan dan penyitaan. Selain itu penyelidik juga dapat meakukan pemerikasaan surat dan penyitaan surat serta mengambil sidik jari dan memotret atau mengambil gambar orang atau kelopmpok yang tertangkap tangan tersebut. Selain itu penyidik juga dapat membawa dang mengahadapkan oarang atau kelompok tersebut kepada penyidik. Dalam hal ini Pasal 105 KUHAP menyatakan bahwa melaksanakan penyelidikan, penyidikan, penyelidik dikoordinasi, diawasi dan diberi petunjuk oleh penyidik.

Pengertian penyidikan diatur dalam Kitab Undangundang Hukum Acara Pidana yang terdapat Pada Pasal 1 butir I yang berbunyi sebagai berikut: "Penyidik adalah Pejabat Polisi Negara Republik Indonesia Atau Pejabat Pegawai Negari Sipil tertentunyang diberi wewenang khusus oleh undangundang untuk melakukan penyidikan". Dalam penjelasan undang-undang disimpulkan mengenai pajabat yang berwenang untuk melakukan penyidikan yaitu: Pejabat Polisi Negara Republik Indonesia (POLRI); dan Pejabat Pegawai Negari Sipil yang diberi wewenang khusus oleh Undang-undang untuk melakukan penyidikan.

Selain penyidik, dalam KUHAP dikenal pula penyidik pembantu, ketentuan mengenai hal ini terdapat pada Pasal I butir 3 KUHAP, yangmenyebutkan bahwa: "Penyidik pembantu adalah pejabat Kepolisian Negara Republik Indonesia yang karena diberikan diberi wewenang tertentu dapat melakukan penyidikan yang diatur dalam undang-undang ini".

Selanjutnya mengenai pengertian penyidik pembantu diatur dalam Pasal 1 Butir 12 Undang-undang No.2 tahun 2002, yang menyatakan Bahwa: "Penyidik Pembantu adalah pejabat Kepolisian Negara Republik Indonesia yang diangkat oleh Kepada Kepolisian Negara Republik Indonesia berdasarkan syarat kepangkatan dan diberi wewenang tertentu dalam melakukan tugas penyidikan yang diatur dalam Undang-undang". Mengenai Penyidik Negari Sipil Dijelaskan lebih lanjut dalam penjelasan Pasal 7 ayat (2) KUHAP, Bahwa "Yang dimaksud dengan penyidik dalam ayat ini adalah misalnya pejabat bea cukai, pejabat imigrasi, pejabat kehutanan yang melakukan tugas penyelidikan sesuai dengan wewenang khusus yang diberikan oleh undang-undang yang menjadi dasar hukumnya masing-masing."

Berdasarkan ketentuan perundang-undangan mengenai penyidik dan penyidik pembantu di atas, dapat diketahui bahwa untuk dapat melaksanakan tugas penyidikan harus ada pemberian wewenang.

Mengenai pemberian wewenang tersebut menurut Andi Hamzah, berpendapat bahwa: "Pemberian wewenang kepada penyidik bukan semata-mata

didasarkan atas kekuasaan tetapi berdasarkan atas pendekatan kewajiban dan tanggung jawab yang diembannya, dengan demikian kewenangan yang diberikan disesuaikan dengan kedudukan, tingkat kepangkatan, pengetahuan serta ringannya kewajiban dan tanggung jawab penyidik." Tugas penyidikan yang dilakukan oleh Penyidik POLRI adalah merupakan penyidik tunggal bagi tindak pidana Umum, tugasnya sebagai penyidik sangat sulit dan membutuhkan tanggung jawab yang besar, karena penyidikan merupakan tahap awal dari rangkaian proses penyelesaian perkara pidana yang nantinya akan berpengaruh bagi tahap proses peradilan selanjutnya. Sedangkan pada Pasal I butir 2 KUHAP menjelaskan mengenai pengertian penyidikan, sebagai berikut: "Penyidikan adalah serangkaian tindakan penyidik dalam hal dan menurut cara yang diatur dalam undang-undang ini untuk mencari serta mengumpulkan bukti yang dengan bukti itu membuat terang tentang tindak pidana yang terjadi dan guna menemukan tersangkanya".

Sehubungan dengan hal tersebut Yahya Harahap memberikan Penjelasan mengenai penyidik dan penyidikan sebagai berikut: "Sebagaimana yang telah dijelaskan pada pembahasan ketentuan umum Pasal I Butir I dan 2, Merumuskan pengertian penyidikan yang menyatakan, penyidik adalah pejabat Polri atau pejabat pegawai negeri tertentu yang diberi wewenang oleh undang-undang. Sadangkan penyidik sesuai dengan cara yang diatur dalam undang-undang untuk mencari dan mengumpulkan bukti, dan dengan bukti itu membuat atau menjadi terang suatu tindak pidana yang terjadi serta sekaligus menemukan tersangkanya atau pelaku tindak pidananya".

Sedangkan Andi Hamzah dalam bukunya Hukum Acara Pidana Indonesia menyimpulkan defenisi dari Pasal I Butir 2 KUHAP, sebagai berikut: Penyidikan (acara pidana) hanya dapat dilakukan berdasarkan undang-undang, hal ini dapat disimpulkan dari katakata...menurut cara yang diatur dalam undangundang ini. Ketentuan ini dapat dibandingkan dengan Pasal 1 Ned.Sv. Yang berbunyi: Strafvordering heeft allen wet voorzien. (Hukum acara pidan dijalnkan hanya berdasarkan Undang-undang). Acara pidana dijalankan jika terjadi tindak pidana hal ini dapat disimpulkan dari kata membuat terang tindak pidana yang terjadi, hal inilah yang tidak disetujui oleh Van Bemmelen, karena, katanya mungkin saja acara pidana berjalan tanpa terjadi delik; contoh klasik yang dikemukakan ialah kasus Jean Clas di Prancis yang menyangkut seorang Ayah dituduh membunuh anaknya, padahal itu tidak terjadi namun proses pidannya sudah berjalan.Selanjutnya Andi Hamzah kembali bahwa Penyidikan ialah ialah suatu istilah yang dimaksud sejajar dengan pengertian Opsparing (Belanda), dan Investigation (Inggris) atau Penyisatan/Sjasat (Malaysia). Defenisi penyidikan dalam KUHAP. Menurut bahasa Belanda adalah sama dengan Opsporing. Berikut ini Andi Hamzah mengutip pendapat De Pinto ang menyatakan bahwa; Menyidik (Opsporing). Pejabat-pejabat yang untuk itu oleh undang-undang segera setelah mereka dengan jalan apapun mendengar yang sekedar beralasan, bahwa ada terjadinya suatu pelanggaran hukum Penyidikan merupakan aktivitas yurisdis yang dilakukan penyelidik untuk mencari dan menemukan kebenaran sejati (Membuat terang jelas tentang tindak pidana yang terjadi.

Dalam hal penyidik telah selesai melakukan penyidikan, penyidik wajib segara menyerahkan berkas perkara tersebut kepada penutut umum. Dan dalam hal penutut umum berpendapat bahwa hasil penyidikan tersebut kurang lengkap. Penutut umum segera mengembalikan berkas perkara tersebut kepada penyidik disertai petunjuk untuk dilengkapi.

Apabila pada saat penyidik menyerahkan hasil penyidikan, dalam waktu 14 Hari penutut umum tidak mengembalikan berkas tersebut, maka penyidikan dianggap selesai.

TAHAP PENUNTUTAN

Dalam Undang-undang ditentukan bahwa hak penututan hanya ada pada penututan umum yaitu Jaksa yang diberi wewenang oleh kitab-kitab Undang-undang Hukum Acara Pidana No.8 tahun tahun 1981. Pada Pasal 1 butir 7 KUHAP Tercantum defenisi penututan sebagai berikut; “Penuntutan adalah tindakan penututan umum untuk melimpahkan perkara pidana ke Pengadilan Negeri yang berwenang dalam hal dan menurut cara yang diatur dalam undang-undang ini dengan permintaan suapay diperiksa dan diputus oleh hakim di sidang pengadilan."

Yang bertugas menurut atau penuntut umum ditentukan di Pasal 13 jo Pasal butir 6 huruf b yang pada dasarnyan berbunyi : “Penuntut umum adalah Jaksa yang diberi wewenang oleh undang-undang ini untuk melakukan penututan dan melaksanakan penetapan hakim “ Kemudian Muncul undang-undang No. 5 tahun 1991 tentang Kejaksaan Republik Indonesia yang selanjutnya tidak diberlakukan lagi dan diganti oleh Undang-undang No. 16 tahun 2004, yang menyatakan bahwa kekuatan untuk melaksanakan penuntutan itu dilakukan oleh kejaksaan. Dalam Undang-undang No. 16 Tahun 2004 tetap Kejaksaan Republik Indonesia yang memberikan wewenang kepada Kejaksaan (Pasal 30), yaitu: · Melakukan Penuntutan; · Melaksanakan penetapan hakim dan putusan pengadilan dan telah memperoleh kekuatan hukum tetap; · Melakukan pengawasan terhadap pelaksanaan putusan pidana bersayarat, putusan pidana pengawasan, dan keputusan lepas bersyarat · Melakukan penyidikan terhadap tindak pidana tertentu berdasarkan undang-undang; · Melengkapi berkas perkara tertentu dan untuk itu dapat melakukan pemeriksaan tambahan sebelum dilimpahkan ke pengadilan yang dalam pelaksanaannya dikoordinasikan dan penyidik.

Mengenai kebijakan penuntutan, penuntut umumlah yang menentukan suatu perkara hasil penyidikan,

apakah sudah lengkap ataukah tidak untuk dilimpahkan ke Pengadilan Negeri untuk diadili. Hal ini diatur dalam pasal 139 KUHAP. Jika menurut pertimbangan penututan umum suatu perkara tidak cukup bukti-bukti untuk diteruskan ke Pengadilan ataukah perkara tersebut bukan merupakan suatu delik, maka penuntut umum membuat membuat suatu ketetapan mengenai hal itu (Pasal 140 ayat (2) butir b (KUHAP). Mengenai wewenang penutut umum untuk menutup perkara demi hukum seperti tersebut dalam Pasal 140 (2) butir a (KUHAP), Pedoman pelaksanaan KUHAP memberi penjelasan bahwa “Perkara ditutup demi hukum” diartikan sesuai dengan buku I Kitab Undang-undang Hukum Pidana Bab VIII tentang hapusnya hak menuntut yang diatur dalam Pasal 76;77;78 dan 82 KUHP. Penuntutan Perkara dilakukan oleh Jaksa Penuntut umum, dalam rangka pelaksanaan tugas penuntutan yang diembannya. Penuntut Umum adalah Jaksa yang diberi wewenang oleh undang-undang ini untuk melakukan penuntutan dan melaksanakan penempatan hakim. Dalam melaksanakan penuntutan yang menjadi wewenangnya, penuntut Umum segera membuat surat dakwaan berdasarkan hasil penyidikan. Dalam hal didapati oleh penuntut umum bahwa tidak terdapat cukup bukti atau peristiwa tersebut bukan merupakan peristiwa pidana atau perkara ditutup demi hukum, maka penuntut umum menghentikan penuntutan yang dituangkan dalam suatu surat ketetapan. Apabila tersangka berada dalam tahanan tahanan, sedangkan surat ketetapan telah diterbitkan maka tersangka harus segera di keluarkan dari tahanan.

Selanjutnya, surat ketetapan yang dimaksud tersebut dikeluarkan dari tahanan. Selanjutnnya, surat ketetapan yang dimaksud tersebut dibertahukan kepada tersangka. Turunan surat ketetapan tersebut disampaikan kepada tersangka atau keluarga atau penasihat hukum, pejabat rumah tahanan negara, penyidik dan hakim. Atas surat ketetapan ini maka dapat dimohon praperadilan, sebagaimana diatur dalam BAB X, bagian kesatu KUHAP dan apabila kemudian didapati alasan baru, penuntut umum dapat melakukan penuntutan terhadap tersangka.

Nebis in Idem berarti tidak melakukan pemeriksaan untuk kedua kalinya mengenai tindakan (feit) yang sama. Ketentuan ini disahkan pada pertimbangan, bahwa suatu saat (nantinya) harus ada akhir dari pemeriksaan/penuntutan dan akhir dari baliknya ketentuan pidana terhadap suatu delik tertentu.Tujuan dari asas ini ialah agar kewibawaan negara tetap junjung tinggi yang berarti juga menjamin kewibawaan hakim serta agar terpelihara perasaan kepastian hukum dalam masyarakat. Agar supaya suatu perkara tidak dapat diperiksa untuk kedua kalinya apabila; Pertama Perbuatan yang didakwakan (untuk kedua kalinya) adalah sama dengan yang didakwakan terdahulu. Kedua Pelaku yang didakwa (kedua kalinya) adalah sama. Ketiga untuk putusan yang pertamateri terhadap tindakan yang sama itu telah mempunyai kekuatan hukum yang tetap.

juga mengenai peristiwa yang tertentu telah diambil keputusan oleh hakim dengan vonis yang tidak diubah lagi. Putusan : Pertama Penjatuhan Hukuman (veroordeling) Dalam hal ini oleh hakim diputuskan, bahwa terdakwa terang salah telah melakukan peritiwa pidana yang dijatuhkan kepadanya;atau kedua: Pembebasan dari penuntutan hukum (ontslag van rechtvervoging) Dalam hal ini hakim memutuskan, bahwa peristiwa yang dituduhkan kepada terdakwa itu dibuktikan dengan cukup terang, akan tetapi peritiwa itu ternyata bukan peristiwa pidana, atau terdakwanya keadapatan tidak dapat di hukum karena tidak dapat dipertanggung jawabkan atas perbuatannya itu, bahwa keslahan terdakwa atas peristiwa yang dituduhkan kepadanya tidak cukup buktinya.

Dalam Pasal 77 KUHP yang berbunyi: Hak Menuntut hukum gugur (tidak berlaku lagi) lantaran si terdakwa meninggal dunia. Apabila seorang terdakwa meninggal dunia sebelum putus ada putusan terakhir dari pengadilan maka hak menuntut gugur. Jika hal ini terjadi dalam taraf pengutusan, maka pengusutan itu dihentikan. Jika penuntut telah dimajukan, maka penuntut umum harus oleh pengadilan dinyatakan tidak dapat diterima dengan tentunya (Nietontvankelijk) umumnya demikian apabila pengadilan banding atau pengadilan kasasi masih harus memutuskan perkaranya.

Pasal 82 KUHP yang berbunyi : Ayat (1) :” Hak menuntut hukum karena pelanggaran yang terancam hukuman utama tak lain dari pada denda, tidak berlaku lagi bagi maksimun denda dibayar dengan kemauan sendiri dan demikian juga di bayar ongkos mereka, jika penilaian telah dilakukan, dengan izin amtenaar yang ditunjuk dalam undangundang umum, dalam tempo yang ditetapkannya”.

Ayat (2): ”Jika perbuatan itu terencana selamanya denda juga benda yang patut dirampas itu atau dibayar harganya, yang ditaksir oleh amtenaar yang tersebut dalam ayat pertama”. Ayat (3):” Dalam hal Hukuman itu tambah diubahkan berulang-ulang membuat kesalahan, boleh juga tambahan itu dikehendaki jika hak menuntut hukuman sebab pelanggaran yang dilakukan dulu telah gugur memenuhi ayat pertama dan kedua dari pasal itu'.

Ayat (4);”Peraturan dari pasal ini tidak berlaku bagi orang yang belum dewasa ,yang umumnya sebelum melakukan perbuatan itu belum cukup enam belas tahun”. Penghapusan hak penuntutan bagi penuntut umum yang diatur dalam Pasal 82 KUHP mirip dengan ketentuan hukum perdata mengenai transaksi atau perjanjian.

TAHAP PEMERIKSAAN

Apabila terhadap suatu perkara pidana telah dilakukan penuntutan, maka perkara tersebut diajukan kepengadilan. Tindak Pidana tersebut untuk selanjutnya diperiksa, diadili dan diputus oleh majelis hakim dan Pengadilan Negeri yang berjumlah 3 (Tiga) Orang.

Sistem pembuktian yang dianut oleh Kitab Undang-

undang Hukum Acara Pidana adalah sistem pembuktian berdasarkan undang-undang yang negatif (Negatif wettelijk). Hal ini dapat disimpulkan dari Pasal 183 Kitab Undang-undang Hukum Acara Pidana. Pasal 183 KUHAP menyatakan: Hakim tidak boleh menjatuhkan pidana kepada seseorang kecuali apabila dengan sekurang-kurangnya dua alat bukti yang sah ia memperoleh keyakinan bahwa suatu tindak pidana benar-benar terjadinya dan bahwa terdakwalah yang bersalah melakukannya.

Berdasarkan pernyataan tersebut, nyatalah bahwa pembuktian harus didasarkan apad alat bukti yang disebutkan dalam undang-undang disertai keyakinan hakim atas alat-alat bukti yang diajukan dalam persidangan, yang terdiri dari: Keterangan saksi; Keterangan Ahli; Surat; Petunjuk; dan Keterangan terdakwa.

Disamping itu kitab Undang-undang hukum Acara Pidana juga menganut minimun pembuktian (minimum bewijs), sebagaimana disebutkan dalam Pasal 183 tersebut, yaitu minimal dua alat bukti disertai oleh keyakinan hakim.

Tahap memeriksaan perkara pidana dipengadilan ini dilakukan setelah tahap pemeriksaan pendahuluan selesai. Pemeriksaan ini dilandaskan pada sistem atau model Accusatoir, dan dimulai dengan menyampaikan berkas perkara kepada Public prosecutor. Pemeriksaan dimuka sidang pengadilan diawali dengan pemberitahuan untuk datang ke sidang pengadilan ynag dilakukan secara sah menurut undang-undang. Dalam hal ini KUHAP pasal 154 telah memberikan batasan syarat undang undang dalam hali KUHAP pasal 154 telah memberikan batasan syarat syahnya tentang pemanggilan kepada terdakwa, dengan ketentuan; Surat panggilan kepada terdakwa disampaikan di alat tempat tinggalnya atau apabila tempat tinggalnya tidak diketahui, disampaikan di tempat kediaman terakhir. Apabila terdakwa tidak ada ditempat kediaman terakhir, surat panggilan disampaikan melalui kepala desa yang berdaerah hukum tempat tinggal terdakwa atau tempat kediaman terakhir dalam hal terdakwa ada dalam tahanan surat panggilan disampaikan kepadanya melalui pejabat rumah tahanan negara. Penerimaan surat panggilan terdakwa sendiri ataupun orang lain atau melalui orang lain, dilakukan dengan tanda penerimaan apabila tempat tinggal maupun tempat kediaman terakhir tidak dikenal, surat panggilan ditempelkan pada tempat pengumuman di gedung pengadilan yang berwenang mengadili perkaranya.

“WHAT IS UR UNFORGETABLE MOMENT IN ALSA?”

T

here are lot of moments actually, all that I did through in ALSA i certainly always be remembered! Moreover ALSA always took a part of my life since I was a freshman until I graduated and now in the working world. But the most unforgettable moment was being a part of Local Board 2013Meyssa Ratna Juwita - 2011 2014, which was in Dading's board, because at that time I had felt the struggle with the batch of 2011 to lead ALSA LC Unsoed.

here are so many unforgettable moments. One of them is the support from my second family, it was ALSA. Family is the greatest power that ALSA had. ALSA had supported me in every way, especially in achieving the unforeseen target, for example, I'd become the rst presidium of Munas in Manado and I was also the rst National Board from ALSA LC Unsoed. At rst, I wasn't sure and thought everything was just a dream. But it was not, because ALSA was always there by my side to reach those all, and what I had got, it was not for me but I dedicated it all to ALSA LC Unsoed.

The impact for now, is obviously very positive of each process in ALSA what I had been going through, for example, after graduation day, I did thank to God because many offers of job came to me, particularly in the law rm, because parties who offering me the job seeing my ability were good and also I got job offers from senior of ALSA and from my friend both Unsoed and National. However, my earlier target was getting magister degree and thank God i had been accepted in UI. Beyond expectation, it still be useful, because lecturers more interest to me than my other friends, and because learning systems in Magister are discussion and settlement of the cases. Again knowledge of ALSA is very useful, especially the ability of public speaking which I used to learn in ALSA. It has proven when I was on training at the professional public speaking with lot of senior lawyers, again because public speaking is a habitual in alsa, I nally was chosen as the best graduates in its professional public speaking training haha.

Start from the rst time I became the member of ALSA, the rst time joining a commite in ALSA, following English Festival (Efest) competition, become a board in ALSA LC Unsoed and many more. But the most impressive thing and hard to forget is that when me following the ALSA international event! It is a worthy experience and one of the most things I will never be forgoten. Because when I followed the ALSA international event was like me having a new family and could get to close also knowing each other with ALSA Indonesia that coming from another university. The point is always a pleasure and happy that I had joined with ALSA LC Unsoed family and another big family of ALSA Indonesia. ALSA Always be one!

hen Semunas in Manado, because basiclly I'd love to do backpacking and also because there is an ALSA event so that I can implement my hobby to travel up to Sulawesi which was never had on there before. Not just travelling but there I learn to discuss and to rhetoric . Travelling plus widen the knowledge!

ell, the Unforgettable moments from me is when I was given the responsibility to become a coaching manager both in EChall when the director was Mr. Timur and E-Comp when the director was Mr. Zarka. That time, I as a coaching manager should to manage whether it was the scheduling or even the delegates itself, actually that was not easy because every person meant different personalities.

But from it, I got a learning to achieve success, it did need procces and struggle which were good and serious. So it could delivere us as winner in Storytelling and Newscasting competition—The feel of E-Comp was quietly the same, just have a little bit frills if E-Comp is a more Prestigious Competition, even if we were not as lucky as when we were on E-Chall but even in E-Chall the intensity of the competition was not far behind the E-Comp. I want to say that the delegates from ALSA LC Unsoed are really smart, they can go to through until the Final of Newscast competition and Semi-Final on speech competition.

I personallly choose to date a girlfriend from the same major, because there are lot more benets than dating a girl from different majors. Why? Because if my girlfriend in the same major, we could take a same class, go home and go somewhere together, also could greet on campus and certainly can understand the bustle of ALSA. Because both mutual understanding and oftenly meeting. I think it could be a long lasting relationship.

I prefer dating a law student's boyfriend!

ermula dengan diterimanya undangan untuk mengikuti English Competition kategori Debating Competition (Debat Bahasa Ingg ris) dan Paper Presentation Competition (Presentasi Makalah Ilmiah) yang akan diselenggarakan pada sekitar minggu akhir Juli 1999 dari ALSA-KLI Fakultas Hukum Universitas Indonesia (FH-UI) yang diterima oleh Senat Transisi Fakultas Hukum Universitas Jenderal Soedirman (FH-Unsoed) sekitar bulan Juni 1999. Senat Transisi FH-Unsoed segera meneruskan undangan tersebut pada Unit Kegiatan Mahasiswa (UKM) yang memiliki kompetensi dibidang kompetisi itu yaitu Justitia English Club (JEC). JEC pada saat itu segera mempersiapkan latihan dan semua yang diperlukanuntuk mengikuti kompetisi dan menjelang kompetisi diselenggarakan sekitar minggu akhir Juli 1999 semuanya pun telah siap sedia. Tim yang berangkat ke Jakarta terdiri dari 13 Mahasiswa dari UKM JEC dan seorang dosen advisor yang sekaligus bertindak sebagai salah seorang adjudicator pada kategori Debating Competition.

Pada saat Tim dari FH-Unsoed registrasi di FH-UI untuk mengikuti kompetisi tersebut baru diketahui bahwasanya kegiatan English Competition merupakan bagian dari kegiatan pokok yang diselenggarakan oleh ALSA Indonesia dan pada saat itu rupanya ada kegiatan utama, yaitu The 11th ASEAN Law Students Conference (ALSC) yang akan diselenggarakan pada tanggal 30 Juli – 07 Agustus 1999 dan rupanya ditahun 1999 tuan rumah untuk kegiatan tersebut adalah Indonesia, dan kegiatan tersebut dipusatkan di ALSA KLI FHUI. Setelah melobi panitia 11th ALSC ternyata Tim dari FH-Unsoed dapat mengirimkan satu orang w a k i l n ya g u n a m e n g i k u t i ke g i at a n 1 1 t h ALSC.Maka setelah melalui rapat intern singkat Tim FH-Unsoed sepakat mengirimkan wakilnya yang paling muda yaitu Wiku Krisnamurti dari angkatan 1998 untuk mengikuti kegiatan tersebut.

Setelah 11th ALSC selesai dan hasil-hasilnya dipresentasikan kepada rekan-rekan di JEC maka pada Musyawarah Kerja 1999 JEC diputuskan bahwa dalam JEC ada satu divisi yang bernama divisi ALSA guna sebagai usaha untuk mendirikan ALSA di FH-Unsoed. Divisi tersebut dikoordinatori oleh Wiku Krisnamurti yang sekaligus bertindak sebagai Formatur ALSA KLI FH-Unsoed yang tugasnya untuk selalu menjalin hubungan dengan ALSA Indonesia dan KLI-KLI ALSA lain demi berdirinya ALSA KLI FH-Unsoed dikemudian hari.

Pada saat itu untuk menjadi KLI ALSA sebuah FH harus memenuhi syarat-syarat yang telah disepakati dalam Musyawarah Nasional VI ALSA Indonesia Tahun 1998 di Malang yaitu antara lain : 1. Mempunyai struktur Organisasi yang jelas.

2.Memiliki pengesahan Badan Eksekutif Mahasiswa dan dari Dekan.

3. Mengikuti Musyawarah Nasional (Munas) ALSA Indonesia sebanyak dua kali berturut-turut.

Dengan dukungan dari semua anggota JEC dan Dekanat Fakultas Hukum Unsoed dan tidak lupa juga ALSA Indonesia maka pada 7 – 13 Maret 2000 FH-Unsoed diundang untuk mengikuti Munas ALSA VII sebagai peninjau. Namun amat disayangkan pada saat itu terjadi konflik internal sehingga FH-Unsoed hanya dapat mengirimkan seorang anggotanya yaitu Wiku Krisnamurti untuk mengikuti ke giatan Munas ALSA VII di M a k a s a r. D a l a m M u n a s t e r s e b u t t e l a h dipresentasikan kesiapan FH-Unsoed menjadi anggota KLI ALSA Indonesia dan hal-hal apa saja yang telah dilakukan dalam persiapan menjadi anggota KLI ALSA Indonesia. Pada Munas ALSA VII tersebut juga telah mengangkat secara resmi FH-Universitas Gadjah Mada, FH-Universitas Sam Ratulangi dan FH-Universitas Jember sebagai anggota KLI ALSA Indonesia.

Setelah mengikuti kegiatan Munas ALSA VII keadaan internal ditubuh JEC dan kemahasiswaan FH-Unsoed berangsur semakin kondusif dan JEC pun aktif mengikuti kegiatan ALSA Indonesia yaitu ALSA English Competition 2000 di FH-UI dan dan rekan-rekan dari Biro Konsultasi dan Mahasiswa FH-Unsoed pun turut berprestasi mengikuti kegiatan ALSA Indonesia yaitu Kejuaraan Peradilan Semu atau ALSA Mootcourt I di FHUniversitas Diponegoro tahun 1999 dengan predikat Juara II dan ALSA Mootcourt II di FHUniversitas Airlangga tahun 2000 dengan predikat Juara I. Aktifnya FH-Unsoed dalam mengikuti even-even nasional ALSA Indonesia semakin membuat rekan-rekan di KLI Indonesia semakin percaya akan niat baik FH-Unsoed untuk menjadi bagian dari KLI ALSA Indonesia.

Sehingga ditahun 2001 FH-Unsoed mendapat undangan dari ALSA Indonesia untuk mengikuti kegiatan Munas ALSA VIII yang berlangsung dari 16 – 22 Maret 2001 di Sarijadi Bandung dan tuan rumah kali ini adalah KLI FH-Universitas Padjadjaran. Dikarenakan kondisi kemahasiswaan telah kondusif setelah JEC berkoordinasi dengan Badan Eksekutif Mahasiswa maka diberangkatkanlah tiga orang mahasiswa untuk mengikuti kegiatan tersebut mereka ialah : 1. Wiku Krisnamurti sebagai Formatur ALSA. 2. Charis Ismail (Angkatan 1998) sebagai perwakilan dari Badan Eksekutif Mahasiswa.

3. Ari Wicaksono (Angkatan 2000) sebagai anggota JEC . Pada Munas VIII ALSA 2001 terdapat 2 FH yang mengajukan diri menjadi anggota KLI ALSA yaitu FH-Unsoed dan FH-Sriwijaya Palembang.

Setelah melewati presentasi dan fit and proper test yang diajukan oleh KLI-KLI ALSA Indonesia maka puji syukur pada Tuhan YME pada tanggal 21 Maret 2001 hari Rabu malam sekitar jam 22:30 WIB FH-Unsoed disahkan menjadi KLI ALSA Indonesia oleh presidium sidang dan ditandatangani oleh KLI-KLI ALSA Indonesia lainnya.

Setelah melewati presentasi dan fit and proper test yang diajukan oleh KLI-KLI ALSA Indonesia maka puji syukur pada Tuhan YME pada tanggal 21 Maret 2001 hari Rabu malam sekitar jam 22:30 WIB FH-Unsoed disahkan menjadi KLI ALSA

Indonesia oleh presidium sidang dan ditandatangani oleh KLI-KLI ALSA Indonesia lainnya.

Setelah Munas ALSA VIII selesai dan hasilnya dipresentasikan baik ke JEC dan Badan Eksekutif M a h a s i sw a m a k a d i m u l a i l a h ke g i at a n mempersiapkan Musyawarah Lokal I KLI ALSA Unsoed. Tahapan demi tahapan dimulai seperti kesepakatan dengan JEC bahwa ALSA KLI FHUnsoed akan dibentuk secara mandiri dan terpisah dari JEC serta pengumuman umum ke mahasiswa FH-Unsoed tentang rekruitmen anggota ALSA KLI FH-Unsoed dan rapat-rapat persiapan lainnya.

Musyawarah Lokal I ALSA FH-Unsoed disepakati berlangsung pada tanggal 3 – 4 Juni 2001 di Gedung Bapendik FH-Unsoed lantai 2 dan berlangsung cukup seru dan meriah serta menghasilkan kesepakatan tentang struktur organisasi ALSA KLI FH-Unsoed dan program-program awal dari ALSA KLI FH-Unsoed.

Tidak lupa acara tersebut juga menghasilkan Director ALSA KLI FH-Unsoed yang pertama yaitu Lia Rahmawati dari angkatan 1999. Periode kepengurusan pertama ALSA KLI FH-Unsoed yang dipimpin oleh Lia Rahmawati menjadi suatu periode yang cukup kritis karena disaat inilah ujian pertama harus dihadapi berupa konflik intern hingga pencarian identitas karena bagaimanapun juga ALSA KLI FH-Unsoed harus bisa memisahkan identitasnya dengan JEC disamping itu ALSA KLI FH-Unsoed juga terus dimonitor perkembangannya oleh Komite Nasional Indonesia ALSA dan harus memberikan laporannya 3 bulan sekali dan hal-hal tersebut nantinya akan dijadikan pertimbangan pada Munas berikutnya apakah ALSA KLI FH-Unsoed layak diteruskan ataukah dinyatakan tidak layak dan harus ditutup. Namun Lia Rahmawati dan segenap pengurusnya mau berusaha keras dan cukup sukses membawa KLI ALSA FH-Unsoed hingga pada Munas ALSA IX yang berlangsung pada tanggal 11 – 16 Maret 2002 di Surabaya Lia Rahmawati berhasil mempresentasikan kemajuan yang dicapai ALSA KLI FH-Unsoed ditambah lagi pada Munas tersebut FH-Unsoed dipercaya sebagai tuan rumah Munas ALSA X Maret 2003.
