Plaintiff and Defendant entered into an Employment Agreement on March 1, 2022, for Plaintiff to provide nurse practitioner services in and around Taylor County, Texas in exchange for payment from Defendant. Defendant operated under GAPS Collaborative TX, PLLC and GAPS Health, Inc., of which Jamison Feramisco was a member of both entities. Beginning in March 2023, Defendant began making the required monthly payments to Plaintiff under the contract late. These late payments continued through July 2023, which caused Plaintiff to submit her written resignation to Defendant on August 25, 2023. Plaintiff was owed a payment for the month of August 2023 in the amount of $9,583.33, and a bonus of $500.00 that was due on July 31, 2023, based on Plaintiff meeting the requirement of over 250 visits in the month of July. Defendant failed to ever make the August 2023 payment or the bonus payment due. Due to the fact that the August monthly payment and July bonus payment were not paid, Plaintiff sent over an immediate resignation email on September 11, 2023, as she had been working for over a month without receiving payment, a material breach under the Employment Agreement. To date, Defendant owes Plaintiff the July bonus payment, the August monthly payment, and the pro-rated September payment through her last day on September 11, 2023. Plaintiff sent follow up emails and made numerous attempts to contact Defendant about the amounts due to her under the Employment Agreement, none of which were successful. These actions were a direct breach of Plaintiff and Defendant’s Employment Agreement. The actions by Defendant left Plaintiff working for Defendant for more than a month with no payment for her services. Additionally, this caused Plaintiff to incur late penalties on bills and credit cards because of Defendant’s breach of the Employment Agreement as is more fully shown by Plaintiff’s Petition on file in this suit.
The officer executing this process shall promptly execute the same according to law and make due return as the law directs.
