If a planned referendum in Cataluña takes place in November then the president of the region could face prison for prevarication , disobedience and sedition .Comments from Spain´s five professional associations of judges followed a massive pro-separation rally in Barcelona . One of the judges has said that the Catalan leaders decision to ignore the Spanish constitution and the Constitutional Court and to proceed with the vote on November 9 could lead to serious charges of disobeying he Spanish National government . Whether the leader would be accused of sedition would depend on the Catalan government .Using the regional police force to assist in conducting the referendum would constitute sedition .This would have a 15 year prison sentence . Last week it was Cataluña´s National Day and half a million people gathered in Barcelona to celebrate .On that same day the Scottish referendum was taking place but that was a legal affair . Sr Rajoy understandably regards any such move to have a referendum as illegal .Citizens have a right to march but not elected officials have to obey the law . The only way in which this could be permitted legally , would be to change the Spanish constitution and that is not going to happen soon .
