The Superior Court of Justice in Valencia is now sentencing immigrants to pay the costs of their appeals against deportation . If the sub delegate decides to expel an immigrant from Spain and the immigrant decides to appeal against the decision then they are being charged 375 euros to cover their defence costs which is the same as would be paid to a State lawyer .The payment is based on an article of law which states that the person losing a case must pay the costs .The payment is only waived by a judge in special circumstances .Usually this cost is levied after the appeal has been lost and the person has left the country so it is impossible to collect that money .Equally these cases generally involve people who have no money in the first place . Once you have a debt with the State then it is always be there and it will raise its ugly head at some time in the future if that person returns to Spain . Now a judge has instituted a system where the money has to be paid even before thwe appeal has been heard .This can cost as little as 218 euros and as much as 900 euros depending where the case is heard .The government is in talks with the Supreme High Court to try and get an exemption from payment should a case be lost .
