Since Dearth does not have a state of residence, he cannot legally complete a firearms transaction. SAF filed the case against Attorney General Eric Holder, seeking to enjoin him from enforcing the law. The lawsuit also contends that the gun law violates Dearth’s Fifth Amendment right of equal protection.

The case was filed in March 2009. SAF and Mr. Dearth challenged the law’s constitutionality because it prevents Dearth from exercising his Second Amendment rights. SAF is represented by Virginia attorney Alan Gura. “This is a significant ruling in our favor,” said SAF Executive Vice President Alan Gottlieb. “Many American citizens face the same dilemma as Mr. Dearth. They are good citizens, they’ve committed no crimes, and they would certainly be allowed to exercise their Second Amendment rights, except for the fact that they live in another country.” The district court dismissed the case, contending that plaintiffs have no standing. This morning’s ruling reverses that court, and remands the case back for further action. In its ruling, the Appeals Court agreed with Dearth’s argument that he suffers an “ongoing injury” because the government continues to deny him the right to purchase a firearm. The court said “we conclude his injury is sufficiently real and immediate to support his standing to

Pryal of Northboro – both legal resident aliens – have been specifically denied the ability to obtain a Firearms Identification Card or a License to Carry of any kind. Before moving to Massachusetts, Fletcher lived in California, where he had a Basic Firearms Safety certificate and Handgun Safety certificate, which allowed him to purchase and own firearms including handguns. Pryal, who is married to a citizen of this country, and had a shotgun certificate and international dealer’s license while living in the United Kingdom.

The trap still had its original anchor chain – also heavy and massive – and a slickpan with raised letters that read, “S. Newhouse Oneida Community, N.Y.,” with “No. 6” in the center. The trap folded up for storage and was an impressive 44 inches when fully opened out. It still had a good deal of the original black paint and the rest showed old surface rust that patina’d out well.

The trap was one of about 1,700 lots that changed hands in an auction that featured ammo (600 lots), guns (50 lots), militaria (350 lots), advertising items (50 lots), and coins (50 lots, all silver and copper). The auction attracted over 25,000 registered online bidders, from as far away as Australia, New Zealand, France and Canada. Phone, fax and absentee bidding was also brisk.

“I really do believe the economy is picking up,” Mr. Reichle observed. “This was easily the most active auction of the last three we’ve held, and bidding was spirited across the board. I just came back from the Wannamaker’s Gun Show in Tulsa, and that place was jammed with gun enthusiasts and fans of militaria. You’d never have guessed there’s a recession going on.” Following are additional highlights from the auction. All prices quoted include a 13 percent buyer’s premium. The top lot of the sale was a gorgeous and quite stunning fancy double eagle coin necklace in a coronet setting, the centerpiece of which was a rare U.S. $20 gold coin set in 14kt gold. The coin was flanked by 43 diamonds, totaling 2.03 carats. The necklace even had a nice storage pouch, as well as a dated jeweler’s appraisal sheet. A determined bidder paid $3,995.

The First Day of Sale Ceremony for the 2011-2012 Federal and Junior Duck Stamps will be held on June 24 at the Bass Pro Shops Outdoor World at the Katy Mills Shopping Center in Katy, Texas. It is free and open to the public. Both the Federal and Junior Duck Stamp artists will be available to sign stamps at this event, and the U.S. Postal Service will have a special cancellation for collectors.

The design for the new stamp, painted by 17-year-old Abraham Hunter of Vienna, Ill., was chosen by a panel of judges at the national Junior Duck Stamp Art Contest, held at the John Heinz National Wildlife Refuge in Philadelphia.

The proposal identifies the Western Great Lakes Distinct Population Segment (DPS) of wolves, which includes a core area of Minnesota, Michigan, and Wisconsin, as well as parts of adjacent states that are within the range of wolves dispersing from the core recovery area. After reviewing the latest available scientific and taxonomic information, the Service now recognizes the presence of two species of wolves in the Western Great Lakes: the gray wolf (Canis lupus), the wolf species currently listed under the ESA, and the eastern wolf (Canis lycaon), with a historical range that includes portions of eastern Canada and the northeastern United States. Recent wolf genetic studies indicate that what was formerly thought to be a subspecies of gray wolf (Canis lupus lycaon) is actually a distinct species (Canis lycaon). To establish the status of this newly recognized species, the Service is initiating a review of C. lycaon throughout its range in the United States and Canada. Wolves in Michigan One Step Closer to State Management The Service is seeking information from governmental agencies, Native American tribes, scientific community, industry and any other interested parties on threats, population size and trends, and other data that could affect the long-term survival of the Western Great Lakes DPS of the gray wolf. America had just cast off the authoritarian rule of England and was in absolutely no mind to allow such tyranny and despotism to rise again … from whatever quarter.

To realistically achieve this “détente” or “balance of power” with the Federal government and the heavy handed bureaucracies under its control, the American citizenry must now have, as much as ever, some semblance of parity in regards to weaponry. The Founders’ distrust of government has proven true on an international scale. Governments gone bad have been far too frequent, most horrifically in the last hundred years of world history. The death toll of citizens disarmed and then murdered by their own governments, or factions supported by those governments, is simply appalling. See:”Innocents Betrayed” The Second Amendment, unarguably meant to establish and maintain a widely armed citizenry, is the guardian against home grown tyranny. It is the only true guarantee that the power resides with the people, regardless of the moral fiber of the politicians in power. Elections are only effective if they remain honest. The somber truth is that freedom’s “bottom line” remains the “bullet box”, not the ballot box. Were it not so, but it is.

Jews For The Preservation Of Firearms Ownership Washington, DC --(Ammoland.com)- After having formally launched JPFO’s “High Capacity Freedom” campaign (aka “High Cap Freedom”), JPFO’s Rabbi Dovid Bendory listed five reasons why you would WANT (not “need”) a high capacity ammunition magazine.

This is why the Second Amendment made no limitation on the type of personal firearms it covered. It was obvious and understood that the citizens’ standard would at least be equal to the standard of a common soldier.

We purposely held back at that time the crucial “Sixth Reason”. It has “stand alone” significance, and is probably the most important reason for an armed citizenry to “keep and bear” significant weaponry and ammunition capacity.

Our soldiers can pack 30 round ammunition magazines with their AR15s. Why shouldn’t we? Parity of weaponry was the standard in 1791, when the Bill of Rights was penned, and it remained the standard for more than 140 of our nation’s first years.

It has been called the “elephant in the room” of American gun rights. Few in the Second Amendment movement are comfortable contemplating this critical issue. The matter is simple: “We the People”, as a coast to coast and border to border conglomerate, must retain the armed might to, FAILING ALL OTHER RECOURSE, overthrow our own government. It is a gut wrenching and heartbreaking option, but an option that must be potently retained for the sake of our liberty and the liberty of our descendants.

The irony of this modern debate over so-called “assault weapons” and “high capacity ammunition magazines” is accentuated by the fact that, up until 1934, American citizens could lawfully own unregistered machine guns! Again, that’s more than 140 years of American history wherein the citizen could arm him or herself on equal to a foot soldier. How come, all of a sudden, this historical parity, this absolutely logical “balance of power”, is in question today?

The Declaration of Independence spells out this unalienable right to revolt, and lists some of the basic reasons for which it might be exercised. Despite what the liars of the ADL and Southern Poverty Law Center might blather, this concept is not something new that has sprouted from the minds of “seditionists” and “insurrectionists” (their new code words for determined American gun owners).

The answer? Because the elitists and authoritarians who lust to rule over us want the citizenry, “We the Little People”, completely disarmed. They want a neutered flock of disarmed and obedient subjects, a state of affairs

similar to that of Britain, France, Germany or Japan.

This is why the elitists and the authoritarians in our government and burgeoning bureaucracies want the (their?) cops and soldiers to have high capacity ammo mags … but not you. The Schumers and Bloombergs (and a disgusting line up of big city police chiefs) yelp all day long about “protecting our police”, but conveniently forget the fact that few American gun owners want the cops hindered by magazine limitations or rifle function limitations. We simply demand the same for ourselves.

But what are the elites in America stuck with now? As citizens, en masse, our combined might comprises at least EIGHTY MILLION GUN OWNERS. This somber reality remains an armed deterrent, a deep and rumbling reminder to the police forces and military forces that, at present, still loyally serve us.

So, the next time someone skirts the issue of the “elephant in the room”, quietly and somberly remind that person what the Second Amendment really intends.

No, nuclear weapons and other “WMDs” would not be part of the parity equation. This is a flippant red herring bandied about by the shills of the victim disarmament crowd. A Second American Revolution would not take place on battle fields. It would take place door to door, block to block, rock to rock, and tree to tree.

Now, in conjunction with JPFO’s “High Cap Freedom” campaign, keep buying those “high capacity” magazines for your pistols and rifles. Let’s get millions upon millions of them into citizens’ hands. A magazine ban is coming, either now, or when the inevitable “Loughner II” occurs.

No treasonous cop or treasonous soldier would feel safe anywhere. There are THREE HUNDRED MILLION privately owned firearms out here. And billions of rounds of ammunition. No other nation’s citizenry presents that quiet and steady warning to its government. No other nation’s citizenry (except perhaps Switzerland) has so many civilians capable of one-inch groups at one hundred yards.

Since 1968, modern “gun control” legislation has depended upon the acts of “crazed lone gunmen” to achieve its insidious goals. There will unfortunately be another “crazed lone gunman”. Whether propitious or programmed, an act of lunatic mayhem would seem as inevitable as the next earthquake.

To attempt to counteract this obvious state of affairs, there has arisen a faction of the liberal wing arrayed against gun ownership that embraces the psychological warfare tactic, the “roll over and die” mind set.

Congressional Sportsmen’s Caucus, are to be congratulated for their leadership in this historic move towards delisting of wolves and rightfully returning the species management to professional state wildlife managers,” said Congressional Sportsmen’s Foundation President Jeff Crane. “We will continue to support efforts in Congress and work with Administration to return all recovered wolf populations to the states.” “I am confident that this language gets us closer to our ultimate goal, which is seeing the entire Northern Rocky Mountain wolf population taken off the endangered species list and managed exclusively by the states,” said Rep. Simpson. “Not only do wolf populations in the west far exceed recovery goals, but without proper management they have become so robust that they are adversely impacting other wildlife populations in the region and are spilling into other states not in the original recovery area. This language takes an important first step by allowing for a wolf hunt this year in Idaho and Montana and allowing Wyoming to move closer to developing an approved state management plan.”

“This is more than a victory for Montana,” said Tester. “It’s a win for rural America, for jobs, and for our wildlife—and it’s what’s right for the wolves themselves. This was never going to get done with partisan games or grandstanding. We fixed this problem with Montana values—by putting aside our differences and working together on a responsible, common sense plan.” The Congressional mandate applies to only a part of the area where wolves have exceeded recovery goals. Wyoming’s wolves remain under federal ESA protection. Only parts of Washington, Oregon, and Utah are included in the delisting although wolves are moving into other parts of those states. The Western Great Lakes area is excluded from the provision, where a fourth round of rulemaking is expected to begin soon.

Congressional Sportsmen Washington, DC --(Ammoland.com)- The United States Congress passed legislation today to remove certain populations of gray wolves from the Endangered Species Act (ESA) and return management of fully recovered wolf populations back to state wildlife managers.

As part of the FY 2011 budget agreement reached last Friday and passed today, the rider introduced by Congressional Sportsmen’s Caucus (CSC) member Rep. Mike Simpson of Idaho and CSC Senate Co-Chair, Sen. Jon Tester of Montana, directs the Secretary of the Interior to reissue the latest (2009) ruling declaring the wolf recovered and to return wolf management to state agencies in Montana and Idaho, as well as portions of Utah, Washington and Oregon. Additionally, the provision precludes further lawsuits and preserves the decision made by Wyoming U.S. District Judge Johnson in November 2010, that the U.S. Fish and Wildlife Service (USFWS) wrongfully rejected Wyoming’s wolf management plan. “Rep. Simpson and Sen. Tester, as well as others in the
