LEGAL RIGHTS for COLLECTORS by Len Waska

Every day in America, there’s a collector who is unhappy with a purchase. Whether it is a case of the item not being what it was portrayed as being, or it had some other problem, there are several Federal and State laws that are specifically designed to protect buyers from unscrupulous dealers or auctioneers. NOTE:None of these laws cover a situation where the buyer is just “unhappy” with the purchase. This is known as “Buyer's Remorse” and is not covered. It’s just the buyer’s problem. The most important of these laws is the “Universal Commercial Code” and Article 2 contains 104 statutes that are the nuts and bolts of ALL commercial sales, whether by brick and mortar shops, internet sales or auctions. This statute has been enacted into law in all states except Louisiana, which still operates under Napoleonic Law. Apparently, Napoleon never had a bad purchase.

AUTHENTICITY

Probably the most common problem arises when an item is sold as being in a certain condition or made by a specific artisan, and later proven not to be as the seller claimed. The former case is most obvious on Ebay when an item is described as being “in perfect condition” and it arrives with a big part missing, while the other case is more common in the field of Fine Art where hundreds of paintings are sold every year that were not made by the artist whose name is on the bottom. Most auctioneers begin their auctions by stating that all goods are sold “as is, where is, with no warranty or guarantee”, believing these disclaimers as being “bulletproof” and giving them umbrella protection for anything they might say or do during the auction. This is far from the truth! The UCC provides that “any affirmation of fact or promise made by the seller to the buyer which relates to the goods and becomes part of the basis of the bargain creates an express warranty that the goods shall conform to the affirmation or promise”. This means if the seller says the piece of furniture was made by John Henry Belter and is later proven not to have been made by Belter, the seller must take the piece back. One problem here is that buyers usually hear what they want to hear, rather than what was actually said. The case being when the seller offers an opinion or a guess as to the item’s authenticity and the buyer takes that to be a fact rather than a guess, he has no recourse. If a panting is sold as having been painted by Rembrant, that is the guarantee. If it is sold as being “in the Rembrant style” or “by a student of Rembrant”, that is only a guess and the buyer has no recourse. The best way to avoid this problem is for the buyer to have the seller write the name of the artist or manufacturer on the invoice. An honest dealer or auctioneer will gladly add the name to the invoice. A seller who really doesn’t know or one who is not completely honest will hesitate or refuse. Continued on Next Page

STATUTE OF LIMITATIONS In most states, the statute of limitations runs for four years and a claim cannot be made after that time has expired. A famous case of this type was when a Massachusetts collector paid $11,500 for a painting from a New York Art Gallery in 1961 that the gallery claimed was by French artist Edouard Vuillard. In 1985, an appraiser told her that the painting was a fake. She filed suit against the gallery but the case was thrown out by the judge who ruled that the statute of limitations invalidated her suit. She probably should have had her appraiser look at the painting before she bought it.

PROPER TRANSFER OF TITLE Before an item can be sold, the seller must either own it or be empowered to sell it. This is seldom a problem, but, when an item is stolen, it often changes hands several times before coming back on the market. In 1969, a lady who had fled Germany when the Nazis were invading her native Belgium discovered that a Chagall painting she left behind when she fled was found in a New York city collector’s gallery. The Nazis had confiscated it and it changed hands several times before ending up in the hands of a Parisian art dealer who sold it to the collector. She sued the collector who, in turn, sued the dealer he bought it from. The court ruled that the collector should be paid the current value of the painting ($22,500) rather than the $4000 he had paid for it many years earlier.

REPORTING A THEFT Failure to report a theft to the police within one year may result in not being able to recover it. Painter Georgia O’Keefe failed to inform the police of the theft of one of her paintings for 25 years. Actually, she hadn’t even noticed that it was missing until it turned up on another person’s collection. Because it hadn’t been reported as stolen, she could not get it back.

LIMITED EDITIONS Eleven states (Arkansas, California, Georgia, Hawaii, Illinois, Maryland, Michigan, Minnesota, New York, Oregon and South Dakota) have print disclosure laws requiring sellers to tell the buyer whether or not the work they are buying is part of a limited edition, the size of the edition and if the printing plate is still in existence to make more editions. Print collectors in other states are asking the dealers for similar information. Who wants to pay thousands of dollars for a print when there may a million copies of it in the future? In 1991, New York amended their law to include cast sculpture priced over $1500. In most of the eleven states, their law is limited to graphic prints and does not include sculpture or photographs which can also be re-issued in large quantities. Collectors should ask a lot of questions and try to get the answers in writing from the dealer. Be very cautious about spending a lot of money on something that may exist in large quantities.

NATIVE AMERICAN OBJECTS A Federal law, the Indian Arts and Crafts Act of 1990, protects buyers of Native American objects by requiring that the artists be certified by their tribes in order to verify that they are “authentic Indians”. Sellers of these objects can be fined up to one million dollars for violations and uncertified artists may be penalized up to $250,000 and face a five year jail term. Laws tend to follow generally accepted conduct and the collector and dealer must negotiate an agreement. sSome dealers will agree to buy back any work they sell for the original price within certain time period, providing the piece has not been damaged.

RESTORED ITEMS Dealers may be more reluctant to discuss any repairs or restoration work, particularly in the area of Fine Art. It is extremely rare to find a painting more than 100 years old that has not had some type or repair or “touch up” work in the past. In the field of furniture, unless it was made before the Industrial Revolution of the Mid 1800s or made by a famous cabinet maker such as Stickley, restoration work does not diminish the value, because most items like that are put into daily use, not in museums.

OTHER CONCERNS

Insurance If selling an object through a dealer, the dealer should agree in writing to insure the item at its full market value and agree to pay all restoration costs in case of a fire or accident. Commission There is no customary percentage for the dealer’s commission. It may range from 10% to as high as 50%, depending on the value of the piece or its rarity. A very rare piece that will probably sell in a short period puts the seller in the position of being able to demand a lower dealer’s commission. If the item is sold in a public auction, the consigner should attend the auction to be sure of the selling price, because, as in all businesses, there are some “shady characters”. Bankrupt Dealers Since there are a lot of dealers who use today’s sales to pay yesterday’s bills, twenty one states, including Texas, have passed laws to protect artists and consignors to prevent the consigned works from being seized in the event the dealer files bankruptcy. Another step to take is to file a UCC-1 form, available from your County Clerk’s office's office. This stipulates that the consignor has a prior lein on the item in the event of a dealer’s bankruptcy. Note that this does NOT apply to a case where the dealer just closes his shop and leaves the state without returning the items or paying what is owed. It is a good move to ask around about the dealer before you consign anything. WATT POTTERY by Len Waska

With the hundreds of pottery companies that have come and gone in America over the last 200 years, even the most serious collectors occasionally have to look at the bottom of a piece to identify the maker. Not so with Watt pottery. It is one of the few companies whose products can be easily recognized from across the room. This is because almost all pieces are hand decorated with bright colors on a cream colored background. W. J. Watt founded the Brilliant Stoneware Company in 1896 in Rose Farm, Ohio, making salt glazed stoneware which was hand turned on a kick wheel and fired in a coal burning kiln. Their wares were distributed by traveling salesmen through Ohio, Northern Kentucky and Indiana. Selling the business in1898, Watt worked with some family members at Ramsbottom Brothers Pottery in lronspot, Ohio from 1903 until June of 1922 when he bought the Globe Stoneware Company in Crooksville, Ohio. He renamed the company Watt Pottery but continued to produce the items Globe had made. One internet source says he made them in the Burley Pottery’s plant. It is up to the reader to figure out if he actually bought the Burley company or if Globe’s plant was too small and he bought Burley’s plant for more space. Or we could just blame it on the inaccuracy of internet information. From 1922 until 1935, Watt produced the stoneware jars ,jugs, dutch pots, milk pans, preserve jars and mixing bowls that Globe (or Burley) produced and in 1925 they added jardinieres, chicken waterers, mixing bowls and churns. Beginning in 1926, their jars and crocks were marked either with an eagle or a cobalt blue heart or a blue acorn with the size of the crock written inside. The Depression was rough on Watt Pottery, but they managed to pay their bills, keep the doors open,and their employees working, something that thousands of other companies were unable to do. In the 1930s and 40s, housewives began replacing their cast iron stoves and wooden ice boxes with gas and electric stoves and electric refrigerators. This created a need for kitchenware that could be moved directly from the refrigerator to the stove without breaking. The demand was so great that Watt discontinued their stoneware lines and upgraded their equipment to produce 15,000 pieces per day. They made molds to produce bean pots, pie plates, covered casseroles, pitchers, cookie jars, salt and pepper shakers, spaghetti bowls, cream and sugar sets, mugs, grease jars and more. By the late 1940s, Watt began focusing on dinnerware glazed in solid colors in patterns named Arcs, Diamond, Groves, Loops and Moon and Stars. All of these names were designated by collectors, rather than the company. In 1949, Watt began hand decorating its wares using simple patterns in bright colors on an ochre colored clay base. To minimize the cost of producing these wares, decorators used as few brush strokes as possible. Housewives loved the country charm and, because they were so inexpensive to make, Watt began appearing as premiums in grocery and department stores.

THE PATTERNS The first hand decorated patterns are known as the “Classic Patterns”, and were produced from 1949 until around 1953. They are “Rio Rose”, “Cross Hatch”, “Dogwood”, “Moonflower”, and “White Daisy”. They experimented with a few patterns that were soon discontinued, making them rare and sought after by today’s collectors. The first one was made in 1950 when they applied rose colored clay in the shape of a flower with yellow in its center and green leaves on either side.The factory named it “Wild Rose”, but collectors call it “Raised Pansy”. It was too time consuming to make, and it was discontinued. Their next attempt was a hand painted rose colored pansy with a yellow center and green leaves. The “veins” in the leaves were cut in with a stylus, but left rough edges of raised clay. The factory called it “Rio Rose”, but collectors call it “Cut Leaf Pansy”. It was also soon discontinued. The most popular patterns are : 1951 - “Starflower” Came in either a four petal or five petal version. Flowers were red, light green, or pale pink. 1952 - “Apple” This pattern was made for about ten years and was their best seller at the time and is their most collected pattern today. It came in several variations. Earlier pieces have two leaves but most pieces have three. Other variations have two apples, or one showing the apple’s core. In 1958, the factory produced a divided plate which now brings about $800. 1952 - “Cherry” Has cherries on the right side and a flower on the left. 1953 - “Silhouette” 1955 - “Rooster” Has a rooster outlined in black with green and red feathers. 1956 - “Dutch Tulip” (”Tulip”) Came in two versions, the “Tulip” pattern having a Royal Blue tulip leaning left and a deep red one leaning right. The “Dutch Tulip” version had a single cobalt blue tulip and green and red leaves. 1957 - “American Red Bud” (”Tear Drop”) Drooping rose buds with small green leaves. Continued on Next Page

1958 - “Morning Glory” Made for a short time and hard to find. Made with red flowers with green leaves on a cream background or cream colored flowers on a light brown background. 1959 - “Autumn Foliage” Another of their best sellers. Easy to locate. 1959 - “Double Apple” 1975 - “Kathy Kale Royal Dutch” This pattern was introduced just before the fire that destroyed the factory and only a few pieces were manufactured. It was sold through Kroger’s stores. Brown with a white dripped edging. Marked “Kathy Kale” Through the years, Watt experimented with other designs. They would make about 1000 pieces and take them to New York City brokers in hopes of having a chain store pick them up. If there was no interest, the line was dropped. This explains why there seem to be so many unidentified Watt pieces around. A lot of Watt pieces had advertising on them because they were inexpensive enough that stores could give them away as promotions, and they made several pieces for other companies with that company’s name on them, not Watt’s. Some of them. were marked “R.F. Spaghetti”, “Esmond”, “Heirloom”, “Orchard Ware”, and “PeeDeeCo”. In the 1960s, Watt produced over $750,000 worth of pottery per year, with about 50% distributed in New York and New England, about 25% in the Chicago area, and the rest scattered in the Midwest and Northeastern states by traveling salesmen. Watt Pottery had close to a hundred patterns and over four hundred molds during their time producing pottery.

REPRODUCTIONS As it is with so many other successful products, someone is bound to copy them in hopes of making money with their fakes. This is almost true with Watt pottery. In 1994, Four Rivers Stoneware of Hazel, Kentucky began making reproductions of Watt’s molds and patterns except there was no intent to defraud the buyers. Each piece is clearly marked with a green ink stamp saying “Four Rivers Stoneware”.They made copies of the Apple, Rooster, Tulip and Dutch Tulip designs. Most buyers have no problem detecting the Four Rivers works but not all dealers are as honest. If the bottom surface of the piece looks disturbed , repainted or looks off color, pass it up because it may be a Four Rivers piece being sold as an original Watt piece. The folks from the now defunct publication “Antique Collectors Reproduction News” covered the Four Rivers products shortly after they hit the market and showed how to tell the original Watt pieces from the Four Rivers products. Building of the library building began in 1912 and was completed in 1915. It was designed as an adaptation of the Foundling Hospital for Children of Florence, Italy which was designed by Brunelleschi. It became the city library after a time as a post office.in 1968.

The wonderful Hill County Courthouse built in 1890 from Bell County limestone The cost was $83,000. The architect was W. C. Dodson from Waco who designed a number of public buildings. After the massive fire in 1993 on New Years Day, the citizens of Hill County decided to restore the structure. Willie Nelson held two concerts to help raise money for the restoration.

Hill County Cell Block Museum is located one block north of the Courthouse in the old county jail house (1893-1983). The museum was also designed by the architect who designed the courthouse, W.C. Dodson. It is open each Saturday from 10 a.m. till 4 p.m. from April through October and by special appointments.
