The Benefits of Membership Being a member of the Nevada State Apartment Association (NSAA) definitely comes with incredible benefits and I want to share our amazing progress in 2011 and our outlook moving forward.
Progress • Beginning September 5th, the 2011-2012 Nevada State Landlord Tenant Handbook will be available for purchase. It has been newly updated with the current NRS Laws and is available on the NSAA website (as an electronic download). Most State and local city forms are also available on the Website. The NSAA also offers its members the Blue Moon Lease, the most widely used lease in the country. Currently, over 30 properties use the Blue Moon Lease in Nevada. • The 2011 Salary Survey will be available for purchase on September 22nd. This highly anticipated survey, utilizing information provided by major management companies and over 100 communities throughout Nevada, has been absent This Associa on only works since 2007. • The NSAA has received over $7700 in donations for the Nevada Street Teens Charity and it is only August! Look for a BIG check (no pun intended) to be presented to Street Teens at this year’s Jewel Awards. • Our Legislative Committee had a very, very positive year. AB226 was amended thanks to the hard work of Christopher A. Karsaz, ESQ (Karsaz & Associates) and the legislative committee. • National Night Out was a very successful event, despite the humidity and unbearable heat. This event was held at Molasky Family Park. Our Community Outreach committee did an outstanding job and deserves the highest praises. Thank you, Rhonda Sikes (Avion at Sunrise Mountain) and the Community Outreach committee.
Only a few years ago we were able to become a local affi liate of the NAA. In 2011, our association became a State Charter of the NAA. In turn, this gave us a seat as a Vice President for Region 7. Recently, past President Bret Holmes was nominated for this position and has accepted the position. Congratulations to Bret and our association. What I have learned in the last few months as your President is the sky is the limit. As we grow our membership, our ability to take advantage of what the NAA can offer also grows. The NAA membership provides us with education, research, resources, solutions, and of course nationally recognized certifications. I urge every member to take advantage of the resources offered by the NAA. We are part of a great organization that is bigger than many of us can imagine.
• The NSAA had the largest attendance ever for our Fair Housing class, 252 attendees. Special guest and Speaker, Nadeen Green of For Rent Media Solutions, was incredible and had one “novel” approach to Fair Housing.
This Association only works because of the willing individuals who serve our membership. A special thank you goes out to all of you who volunteer regularly and work so hard to make every event a huge success. It has been an exciting year thus far, with only unlimited expectations to follow because of you.
Outlook • We have several exciting events coming in the next few weeks. The Certified Apartment Manager (CAM) Certification and Certified class is scheduled for September. • The NSAA Bowling Event is sure to draw a great crowd on September 23, 2011 at the South Point Bowling Center. Leaders Hire Top Employees, Not Top Candidates By Lou Adler
Imagine that a top candidate comes in for an interview, and within five minutes you know you have a star si ng across the desk from you. What are the “wow!” factors that excited you? (Pause and reflect before reading further.) Aside from a good resume, they probably include many of these traits: positive first impression, great appearance, articulate, ent husia st ic , a f fable, prepa red, ontime, assertive, inquisitive, poised, and confident, with a strong handshake and great eye contact. What did you do next? If you’re like most interviewers (especially hiring managers), you relaxed a bit, believing this would be an enjoyable interview, and gave yourself a mental high-five, knowing you’ll get a pat on the back from your client. You probably became less discriminating, and unknowingly started over-talking, underlistening, and maybe doing a little too much selling. SEPTEMBER | OCTOBER 2011
Now, fast-forward six months and you’re giving your new employee his or her first review. It’s not necessarily the person described above, but a truly outstanding person most likely found through some great networking technique or proactive employee referral program. What traits does this person possess if they really are a top performer? (Pause and reflect before reading further.) Most likely the person has many of these traits: extremely competent and highly motivated to do the work required; extremely effective working with, motivating, and managing other people; courageous enough to take initiative and implement change; strong in the face of adversity and tough

challenges; great at problem solving and decision making; committed to goals and deadlines; great growth potential; and a balanced ego. With these two people in mind, who would you rather hire — a top employee or a top candidate? The right answer is the top employee. Now consider this: Are all top candidates also top employees? My direct personal experience in over 1,000 different hiring situations (and many more indirectly with my clients), and in reading Peter Drucker (The Essential Drucker) and too many Hunter and Schmidt research articles in the Journal of Psycholog y, clearly indicates that top candidates are not the same as top employees. Top candidates make great presentations, yet great presentations don’t correlate with top performance (even for salespeople). TOP EMPLOYEES | continued on page 8
consideration, or went outside of your company’s normal hiring practices in some way? For more proof, consider how many top employees now apply for your current openings. If you’re not seeing enough top people, you might want to redesign your hiring processes to meet their needs rather than the needs of top candidates. This is what is meant by doing better things, not doing things better.

On the other hand, great employees are frequently not great candidates. The overlap is about a third of the time. So if you hire based on presentation, two-thirds of the time you’ll be wrong. While hiring errors caused by undervaluing performance and overvaluing presentation are a significant issue (indications of this problem include hiring people who are competent but unmotivated, or hiring people who talk a good game), this is really just the tip of the iceberg.
Here are some ideas to get you started: • Make it as easy as possible to apply. This means no upfront questions, no application process — just a cut-and-paste resume, at most. You must use technology to determine if the person is strong rather than a questionnaire.
The real problem is that the hiring processes at most companies are designed to find and hire top candidates, not top employees. So even if you to want to hire top employees, you won’t be successful if you assume top employees and top candidates look for and accept jobs the same way.
• Make your job titles more descriptive, visible, and compelling in order to attract the attention of top people. Ask your most creative marketing people for help with this. For example, “Become Our Next Rookie of the Year” will attract more top salespeople than “Sales Rep - Eastern Ohio.” Then, in the first paragraph of the job description, talk about the opportunity in the job rather than list the requirements. In fact, the first two sentences of the first paragraph are the most important. Make every job unique, tying each job in some way to the company strategy. This is what is meant by job branding. It will take a lot of time to change every one of your job descriptions, but it will instantly change the caliber of the people applying. Try this just a few times to see how effective it is.
Top employees, for example, are more discriminating. They want more information. They won’t waste their time. They want a better job, not another job. They decide with others, and they don’t want to be sold during the interview. They want a chance to be heard and challenged. If your hiring processes aren’t designed to cater to the needs of these top employees, you’ll never be able to consistently hire them. For validation, consider some of the really top people you’ve recently hired. How many needed some special hand-holding, extra

• Develop sourcing strategies designed around the needs of your target audience. This should be a combination of great online advertising, a robust career website, and advanced networking leveraging using your top current employees and related connections (alumni, associations, vendors).
let company policy, culture, or some PhD or lawyer stand in your way. This is actually the hardest part of the whole process. Doing better things can have a far more significant impact than doing things better. But it takes a top employee to make it happen. These are people who will challenge conventional wisdom, have the courage to take personal risks, and who keep on pushing despite the challenges.
• Set up systems to identify and call these top people within hours after applying. Make sure that your best recruiters make these calls to ensure that the person doesn’t opt out for the wrong reasons. Then, even if the person is not appropriate for the current job, use proactive networking to obtain three or four more names of other top people from them.
Not only do you want to hire more top employees, you must become one yourself. And of course, that is the real point of this article. There are a few more hidden lessons here as well, but I’ll leave those up to you to find.
• Evaluate how your recruiters and managers interview these candidates. Top employees don’t want to be sold, nor do they want to discuss their behaviors. They want a chance to describe their accomplishments and find out about the challenges in the new job. This is how you use the interview to both recruit the candidate and assess their competency and motivation.

Not Just Your Team, But Yourself Too By Joelle Jay, Ph.D.
As a business leader, you know one of your key tasks is to keep your team mo vated. To do so, you need to constantly remind your people of the company’s vision, hold them accountable to targets and goals, mentor them, and support them in their work. But how does the one who motivates others every day stay motivated as well? When it comes to leaders, motivation is really about engagement. How engaged are you in your work? How committed are you to the results you’re supposed to be getting? Are you pushing forward with a sense of purpose and drive, or are you simply going through motions? To be your best, you need to give serious thought to what makes you flourish and succeed. When you are motivated, you are a wholehearted participant in your own life. You know what’s important to you and you use it as a guide. You feel confident, energized and engaged. However, when you are de-motivated, you “lose your edge.” Your energy goes down. Your stress goes up. You may even feel guilty and resentful. You might be bored, either in an “I-can’ttake-this-anymore” way or in a dull, channel-surfing kind of way. Whatever way a lack of motivation hits you, one thing is for sure - it’s not a fun place to be. Whether you feel your motivation waning or you want to keep your current high level of motivation on a roll, the following suggestions will help you stay at your best.
Stay Connected to What You’re Doing It’s one thing to do the work you’re paid to do; it’s another thing to be fulfilled by the work you do. If you’re strictly doing your job for the money, or the title, or the company car, you could find that over time it’s harder and harder to actually do the job. However, if you’re connected to what you do - if you’re connected to what excites you - you’ll feel motivated to keep going because you’ll be achieving a bigger purpose for yourself.

Staying motivated in today’s economy and work reality can be difficult for anyone. But when you take responsibility for motivating yourself and others, you become a true inspiration and can better reach your goals.
The key is to know your values - the principles, standards, and qualities that guide you. To uncover your values, recall a time in your life when everything was “just right.” You could choose something from your personal life or your work. You might revisit a moment, a particular event, or a whole phase of your life. Once you’ve allowed yourself some time to explore the memory, ask yourself what it was about that memory that made it so memorable, so significant, so right. What made it a peak experience? Write down any ideas that come to mind - words, phrases, images, and symbols. When you’ve finished with your notes, circle the words that meet the definition of values as principles, standards, and qualities. There’s no right or wrong during this process. Simply use your own words and your gut to tell you what your values are.
Know What it Takes to Get BeƩer Motivation comes from constant learning on how to be better. Therefore, you should always be asking yourself, “What am I trying to achieve?” and “What do I need to learn to reach my goal?”

Realize that this isn’t about taking a workshop or reading a book. It’s about challenging yourself to take on something new and to stretch yourself into a new level of results. The fact is that when you practice learning as an element of personal leadership, you stay motivated and you get better results for yourself and for your work. By learning, you empower yourself to have, do, and be whatever you choose. And with empowerment comes confidence. You don’t second-guess yourself or worry you’ll fail, because you know if you get it wrong, you’ll be able to figure out how to get it right. How motivating is that!
Find the Right Support System When you’re a leader, all the people below you lean on you. You guide them, support them, and tell them what to do. However, when you’re on top, you don’t have anyone above

you to lean on. That’s when you need to look outside of your organization, your role, or even your industry for the people who can cheer you on, mentor you, and help you be your best. To do so, look for people whose style you like - people who inspire you by the way they lead and the results they get. Seek out people who resonate with you and who seem to mirror parts of yourself. Connect with them to see what’s possible for you as a leader. Learn how you can become more with the help of others who have already done what you want to do.
they have. The key is to define what that balance looks like for you. If you’re a senior leader, balance may not look very traditional. It might not be 9-5, Monday through Friday, with holidays and weekends off. You need to understand what works for you and what fulfills you in your personal life. What helps you restore your energy and find that sense of peace, rest, and renewal? Depending on your lifestyle and personal preferences, that could be taking a morning job, sleeping in on days off, reading a fiction book, or spending time with family. Even if you can’t carve out chunks of time, at least create some mental space where you can relax, turn off distractions, and let yourself go.
MoƟvate the MoƟvator The more carefully you build your support team, the more powerful it will be. You don’t just ask people to mentor you because you like them; you make them a part of your team because they enhance you. The people on your support team help you stay motivated because they expand you by giving you access to what you don’t know. Remember, it doesn’t have to be lonely at the top.
Maintain a Sense of Balance While maintaining a work/life balance is not a way to stay motivated, it is a way to keep from becoming de-motivated. When you’re serving everyone else you have to remember to fi ll your own tank. Remember that being an effective and motivated leader should not come at the expense of quality of life, and quality of life should not come at the expense of business results. Work and life should be able to co-exist, happily and successfully. They can and

A Basic Understanding of Nevada Landlord/Tenant Laws Could Make “Cents” To Your Bottom Line By Michael Fazio, Kate Fogle and Linda Shoenberger
The Nevada Fair Housing Law, which applies to any property-related transaction, prohibits landlords from discriminating against potential or current tenants. The Nevada Residential Landlord and Tenant Act, Chapter 118A of the Nevada Revised Statutes, details the rights and obligations of individuals in a landlord-tenant relationship and provides legal remedies that address a failure by either party to meet these obligations.

Tenant ObligaƟons Truly understanding and following the established laws in NRS 118 can save you and your owners money in the long run. The following “common cents” parts of the NRS Code, at times, are overlooked and can be detrimental to your bottom line:
Applicability • The Landlord and Tenant Act generally applies to any rental agreement for property to be used as a dwelling place, but the law excludes a number of specific situations. The law does not apply to mobile home park rentals or publicly operated low-cost housing programs. The law also excludes hotel or motel rooms occupied for less than 30 days, premises occupied primarily for agricultural purposes, premises occupied under a rent-to-own agreement, condominium units and college dormitories.
Landlord ObligaƟons • The landlord must maintain the premises in a habitable condition that complies with housing and health codes (which are potentially changing soon, NSAA will keep you informed of SNHD’s future plans). Specific requirements include providing building and grounds maintenance, hot and cold running water, effective sewage disposal, effective waterproofing and weather protection, adequate heating and a working electrical system. The landlord must provide the tenant with 45 days’ notice SEPTEMBER | OCTOBER 2011
• The tenant must comply with the rental agreement and must maintain the dwelling unit in a clean and safe condition. The tenant must use the provided facilities and appliances in a reasonable manner, including electrical, plumbing, heating, air conditioning and sanitary devices. The tenant must dispose of garbage properly and keep plumbing fi xtures as clean as possible. The tenant and her guests may not engage in any conduct that disturbs other tenants.
Rights • The landlord has a right to enter the rented premises to inspect, make repairs or show the dwelling unit to prospective tenants or other interested parties. Except in emergencies, the tenant is entitled to at least 24 hours’ notice that the landlord intends to enter and may limit the landlord’s entry to normal business hours. The tenant has the right to display a United States’ flag made of cloth or paper within the area that he occupies.
Remedies • A landlord may terminate the rental agreement after giving five days’ notice to a tenant who violates the agreement. If the tenant does not vacate the premises, the landlord must file a civil action to regain possession. A tenant may make repairs and deduct the cost from his rent if the landlord

Rental agreements can include this clause any number of times in the paperwork. The landlord or property manager can say it several times while the tenant is signing it. Oftentimes in the excitement of moving to a new apartment the tenant doesn’t pay close attention. They act quite surprised and/or angry when they call in and say they are moving and the property management company or landlord doesn’t accept this.

does not respond to written notice of the problem within 14 days, but this remedy does not apply if the tenant is responsible for the damage.
Special Clauses • When meeting with a new tenant to sign a rental agreement it is common for the tenant to be in a hurry and pay little or no attention to the terms of the agreement. This includes, but is not limited to the 30-day notice clause.
Even if it is in the house rules several times, many people don’t pay attention.
The 30-day notice clause is important for 2 reasons: 1. It applies to the tenant and; 2. It applies to the landlord. When a tenant gives notice to move out it should be stated in the agreement that they must give the notice in writing. A phone call in not acceptable because it cannot be documented. Arguments can ensue if a 30-day written notice is not given. No one wants to go to court but it does happen often because the tenant either didn’t give 30-days notice or gave it verbally. A judge cannot refer to any documentation if the written notice is not presented in court. Should the landlord or tenant desire a different time frame other than the 30 days it is usually ok if it is agreed upon by both parties and is included in the rental agreement. So if the landlord and tenant think 20 days is sufficient, it can be spelled in the rental agreement.
In Nevada a landlord can give 30-days written notice to a tenant to move out if the tenancy is a month to month tenancy. No reason is necessary to give a tenant 30-days notice to quit. This often surprises tenants and makes them angry. However, the landlord does have the right to reclaim the property with proper notice. In conclusion, it is a great idea to regularly visit the NRS Codes and ensure you have a firm grasp on what the laws mean. It could save you in the long run in more ways than you know.
