This Request for Qualifications (RFQ) is issued by Martin County Economic Development (“MCEDC”) to acquire the services of a Construction Manager at Risk (“CMR” and/or “Proposer”) for development of site plans, Civil engineering and construction administration of site improvements for a future proposed shell building (“Project”) in at the North Carolina Rail and Commerce Park located on US Highway 64, near Everetts, NC.
The ultimate goal of this scope of work is to have a site that is “shovel ready” with the building pad on grade, site drainage and erosion control measures in place with site graded and seeded as required.
This project consists of initial conceptual site drawings which include location of an approximately 50,000 square foot shell building. The drawings will refer to a topographic survey dated July 31, 2024 for said property. Orientation of the building should consider existing site grades in order to efficiently allow for access to the site by all vehicular traffic including trucks accessing loading docks.
When the collaboration between the selected CMR and MCEDC is complete, the CMR shall engage a geotechnical firm to perform soil borings. After receipt and review of the soil borings, the CMR shall solicit multiple bids for civil engineering for said site. After the receipt and review of civil engineering bids, the CMR shall make recommendations to MCEDC to award the civil engineering contract to the lowest responsive bid.
The CMR shall collaborate with contracted civil engineering firm to establish building pad grades, orientation of building considering vehicular access, review of existing soil conditions, establish grading plans, site drainage and soil and erosion control. Review of all existing park utilities shall be performed in order to allow efficient site access for water, sewer and electricity to the site.
Upon completion of the civil engineering plans and specifications, the CMR will review the plans with the MCEDC for acceptance. CMR shall then advertise the project to responsible site contractors to install proposed site improvements.
The CMR shall review the proposed site improvements bids and shall make recommendations to the MCEDC to accept the lowest responsive bid.
The CMR shall assist the MCEDC with the formation of an AIA Contract between the MCEDC and site contractor. When the contract between both parties is accepted by both parties, a Notice to Proceed Date will be established.
The CMR shall review and coordinate any product submittals required. CMR shall observe the installation and implementation of all piping, grading, soil and erosion control measures, testing by a third party as well as all aspects as indicated on the approved civil engineering plans and specifications.
The MCEDC intends to use the Construction Manager at Risk delivery method for the Project.
• The MCEDC expects that the design and Project development work prior to construction will benefit greatly from the continual and collaborative involvement of the CMR with the MCEDC during the Pre-Construction Phase as the CMR provides constructability reviews, cost estimates, schedule summaries, and value engineering recommendations.
• The MCEDC acknowledges that the CMR proposers will include a Preconstruction Services Fee, CMR Fee, Overhead, and General Conditions. The MCEDC will negotiate fees with the most qualified firm. If these negotiations fail, the Owner will then proceed to negotiate with the next most qualified firm until an agreement can be made. Initial negotiations will be for a lump sum fee for preconstruction services. Percentages will also be negotiated for the CMR fee, overhead, and general conditions. These percentages will be established as lump sum figures and will be part of the GMP if approved.
• The owner reserves the right to reject any or all SOQs, or to waive any informality within any SOQ received and be the sole judge of the SOQ received.
• The MCEDC reserves the sole right to select the most qualified firm(s) deemed to be in the best interest of the MCEDC. Statement of Qualifications will not be evaluated unless they address a Participation Plan for minority businesses
• SOQs will be evaluated based on the firm’s responses to the requirements of this RFQ. Evaluations will focus on relative strengths, weaknesses, deficiencies and risks associated with SOQ. Interviews with firms will be held at the option of the MCEDC. The MCEDC reserves the right to obtain clarification or additional information with any firm regarding its SOQ. The MCEDC reserves the right to select a responsive and responsible firm based
on best overall value that is most advantageous to the MCEDC. Firms who submit SOQs will be notified of the selection results.

Statements of Qualifications are due and must be received by the POC no later than 4:00 PM, Friday, October 4, 2024.
Interested Proposers must submit at least two (2) original SOQs, including all required forms and one (1) CD containing a digital copy of the complete SOQ package in PDF format. SOQs are limited to a maximum of forty (40) pages, excluding blank pages, required forms or resumes. SOQs should be printed on 8-1/2” x 11” paper only. Type size should be no smaller than 11 points for narrative sections, but may be reduced for captions, footnotes, etc. while maintaining legibility. Non-conforming submissions may be removed from consideration.
This Section shall include a brief description of the Proposer’s firm as well as the organizational structure. The Proposer firm shall outline their financial stability, capacity, resources and bonding capabilities.
Judgments: Has your firm or any officer, director or owner thereof had a judgment(s) entered against him/her within the past ten years for breach of contract for governmental or nongovernmental construction, including, but not limited to, design-build or construction management? If so, please explain.
Noncompliance: Has your firm been in substantial noncompliance with the terms and conditions of prior construction contracts with a public body without good cause? If so, please explain.
Convictions: Has your firm, any officer, director, owner, project manager, procurement manager, or chief financial official thereof been convicted within the past ten years of a crime related to governmental or non-governmental construction or contracting? If so, please explain.
Debarment: Is your firm, any officer, director or owner thereof currently debarred pursuant to an established debarment procedure from bidding or contracting by any governmental or nongovernmental entity? If so, please explain.
The MCEDC reserves the right to request additional information to explain any of the above citations/violations.
This SOQ Section shall include a brief description of the Proposer’s qualifications and previous experience on similar CMR projects. Specifically discuss the following:
Guaranteed Maximum Price (GMP):
Provide a specific plan regarding how your firm will maintain initial budgets to help ensure that the final GMP for this project will be within the funds available. Provide examples from past projects where your firm was able to provide the Owner with a final GMP that was within the Owner’s budget.
Profile Similar Projects that your firm has completed. Include:
• Project description
• Owner representative information including contact name, phone, email, address Contract dollar amount and total time period involved
• Discuss the methods, approach and controls used on the project in order to complete it in an effective, timely, economical and professional manner.
• List a maximum of five (5) relevant projects
This SOQ Section shall present a work plan, specific to your Construction Manager at Risk approach. Discuss the firm’s understanding of the project objectives and describe the proposed project approach to deliver the services in an effective, timely, economical and professional manner. Include a full description of tasks to be completed. This section of the SOQ shall establish that the Proposer understands the MCEDC’s objectives and work requirements and Proposer’s ability to satisfy those objectives and requirements. Also, describe the proposed approach for addressing the required services and the firm’s ability to meet the MCEDC’s schedule, outlining the approach that would be undertaken in providing the requested services. Outline the project plans, structure and services to be provided and how and when these services shall be provided. This description should fully and completely demonstrate the Proposer’s intended CMR methods for servicing the requirements of all aspects of the Scope of Work set forth herein.
Provide an organization chart of key team members to be assigned specifically to this Project. A resume may be provided for each proposed key team member.
Provide a list of projects citing the proposed key team members’ or subcontractors’ experience working with government entities and list those projects, when possible, specifically list Construction Manager at Risk projects.
Discuss successful collaboration by key team members on past projects.
Describe how your firm’s plan to comply with all anti-discrimination and equal opportunity statutes and regulations.
Describe your firm’s familiarity with local conditions, codes, and permitting offices.

The person executing the SOQ, on behalf of the Company, being duly sworn, solemnly swears (or affirms) that neither he/she, nor any official, agent or employee of the Company has entered into any agreement, participated in any collusion, or otherwise taken any action which is in restraint of full and open competition in connection with any SOQ or contract, that the Company has not been convicted of violating North Carolina General Statute 133-24 within the last three years, and that the Company intends to do the work with its own bona fide employees or subcontractors and is not proposing for the benefit of another company.
Submission of a response to this RFQ constitutes certification that the Company and all proposed team members are not currently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this Project by any State or Federal department or MCEDC. Submission is also agreement that the MCEDC will be notified of any change in this status.
