Man reports car stolen after leaving keys inside FORSYTH COUNTY, Ga. — A man reported that his car was stolen from his driveway on Winding Lakes Drive sometime in the early hours of July 20. The owner told deputies he had parked his car in the driveway late the night of July 19, leaving a pair of keys hidden

Noise complaint leads to arrest on warrant FORSYTH COUNTY, Ga. — A suspect in a noise complaint call was arrested July 21 after authorities discovered the woman had warrants out for her arrest in Dawson County. Deputies were called to Summit Overlook Way after a resident reported loud yelling coming from a nearby apartment. When deputies arrived at the apartment where they suspected the noise came from, they spoke to the two people inside, who said they were just watching TV. When deputies ran their names through the system, the woman’s name came up with the warrants out of Dawson County. She was arrested and turned over to the Dawson County Sheriff’s Office.

Deputies arrest driver on suspicion of theft FORSYTH COUNTY, Ga. — A Cumming man was arrested July 22 on Ga. 400 for a theft that was reported out of Gwinnett County.

Police were driving on Ga. 400 near the Majors Road overpass when they ran the license plate number of the car in front of them. The search came back showing the man had an outstanding warrant out of Gwinnett County for theft. The man was pulled over and arrested without incident and was transported to the Gwinnett County Jail.

Woman reports touching while swimming at lake FORSYTH COUNTY, Ga. — An off-duty deputy responded July 19 when a swimmer at Mary Alice Beach Park reported she had been touched inappropriately by a stranger. The woman told authorities the man would repeatedly swim close to her underwater. At one point, the man grabbed her inner thigh as he swam by. The deputy made contact with the man as he exited the water and ques-

tioned him regarding the incident. The man responded, through Spanish translator, that he did not realize he touched the woman, and it was an accident. The woman told police she did not want to press charges and just wanted the man to leave.

Police investigate report of bathroom Peeping Tom FORSYTH COUNTY, Ga. — Authorities were called to Kroger on Peachtree Parkway July 23 after a man noticed a Peeping Tom in the adjacent bathroom stall. The victim said he was using the restroom when he noticed a cell phone being pointed at him over the partition. He said the same thing also happened the week before with the same cell phone. Authorities documented the incident, and the victim told police he was not sure if he wanted to proceed with the case.

Officials may pass on grant funds By JOE PARKER joe@appenmediagroup.com FORSYTH COUNTY, Ga. — Forsyth County is set to cash in on significant grants to help fund its courts and behavioral health systems, but talks about accepting millions in HUD dollars bogged down at the Board of Commissioners’ July 28 work session. With a total match of $63,000 in local funds, the county is set to receive around $668,000 from grants to support its judicial and behavioral health operations. The first part was simple. A $100,000 grant requiring no county match will support the county’s behavioral health provider, Avita. Forsyth was selected as one of 20 cities or counties nationwide to receive the award through the Aetna Foundation’s Healthy Cities & Counties Challenge. The funds will be used to form an

information collection process and storage system that will assist the coordination between county agencies, mental health providers and organizations on how to best serve those with serious mental illness and substance abuse issues in the county. The bulk of the grants were awarded to the county’s courts through the Council of Accountability Courts Judges State of Georgia Grant Program. The Adult Felony Drug Court is set to receive over $260,000, with a $29,000 match from the county. More than $163,000 will go to the C.A.R.E (Changing, Assisting, Restoring and Enlightening for Mental Health Offenders) program. Family Drug Court is set to receive $40,586 with a $4,500 match from the county, and $102,000 will go toward the DUI Court with an $11,000 contribution from Forsyth. Forsyth’s matches for the grants will come from its personnel fund.

While commissioners welcomed the grants with open arms, they tiptoed around the strings attached to proposed funding from the U.S. Department of Housing and Urban Development. Forsyth is eligible to receive $910,000 from HUD each year over the next three years. The county has been eligible to receive HUD funding previously but has denied the dollars. Commission Chair Laura Semanson explained the stipulations attached with accepting the HUD funds takes away some local control related to planning, housing, transportation and land use. In 2017, that was not a sacrifice the commissioners wanted to make because they wanted to chart their own course of growth. “Even landing one very large, significant economic development opportunity would far outstrip that influx of cash

Forsyth Chamber proposes CARES Act allocations By JOE PARKER joe@appenmediagroup.com FORSYTH COUNTY, Ga. — Approximately 1,700 Forsyth-based small businesses could soon receive some financial support through the $2.2 trillion federal Coronavirus Aid, Relief, and Economic Security (CARES) Act. The county has charged the Forsyth Chamber of Commerce with leading a program to get those dollars into the hands of local business owners. The Chamber outlined its proposal at the Board of Commissioner’s July 28 work session. The county is set to receive around $12.4 million through the program, and after paying off its own coronavirus-related expenses, around $8 million could be left to dole out as it sees fit. A significant portion will be awarded to local small businesses. Scott Evans of the Forsyth Chamber outlined which businesses could be

eligible to receive financial aid and how much they could expect. The Chamber’s proposal would allow a single-owner business with no employees $2,000 in relief funds. Companies with two to five employees could receive $5,000 and businesses with 6-25 workers would be granted $7,500. Companies with more than 26 employees would be eligible for $10,000. Companies receiving funds would be required to have their primary location in the county, including sole proprietors and contractors. They would also need to be operating on March 1, 2020 and be able to show a reduction in sales due to COVID-19. The allocations would be on a firstcome-first-served basis. The Chamber’s proposal also outlines companies that would be excluded from receiving funds. passive sale or investment with no active ties to a for-profit business at that location • Adult businesses as defined by local ordinance. • Businesses owned or operated by the Forsyth County government or Forsyth Chamber • Corporate-owned franchises • Companies with active code-enforcement violations • Companies with legal actions against them from Forsyth County • Any owner, operator or partner in a business found with financial mismanagement Commission Chair Laura Semanson suggested the Chamber eliminate the provision that adult businesses be excluded. She said the county does not have any adult businesses that most think of when they hear the term, like strip clubs, but some companies do fall under the category under the county’s codes. Each commissioner will name a volunteer to oversee the Chamber’s allocation of the funds. The volunteers will not seek out or identify businesses that could receive assistance. Under the CARES Act, at least 30 percent of the county’s funds must be spent or allocated by Sept. 1. The remainder must be used by Dec. 31. The Chamber will receive about $45,000 paid through the relief funds for directing the small business payment initiative, including $20,000 for software. The organization has also requested a 5 percent administration fee. The Chamber’s proposal could go before commissioners for a vote at their next regularly schedule meeting on Aug. 6.

Early voting ends Aug. 7 for runoff election

FORSYTH COUNTY, Ga. — Registered voters still have time to cast ballots at either of two early voting sites in Forsyth County for the Aug. 11 runoff election. Advanced voting runs through Friday, Aug. 7. Voters must cast ballots at their assigned precincts on Aug. 11. The runoff includes two Republican races and one Democratic race. Two early voting polling places — the Forsyth County Elections Office at 1201 Sawnee Drive, Cumming, and Hampton Park Library at 5345 Settingdown Road, Cumming — are open from 9 a.m. to 5 p.m. for in-person voting through Aug. 7. Voters can also request an absentee ballot for the runoff. Ballots must be mailed no later than Aug. 7. Ballots can also be deposited, any time, at an absentee ballot drop box at the Forsyth County Elections Office. Absentee ballots for the Nov. 3 General Election and potential runoffs for Dec. 1 and Jan. 5, 2021 can also be requested now. There are no nonpartisan races in the Aug. 11 runoff. Voters who chose a Democratic ballot in the June 9 primary election may only fill out a Democratic ballot in the runoff. Those who completed a Republican primary ballot must fill out a Republican ticket. Those who did not vote in the June primary election may still choose a Democratic or Republican ballot. The race for Georgia’s 9th Congressional District will feature a runoff for the Democratic and Republican candidate. The district covers the northern portion of Forsyth County and is currently represented by Doug Collins, who has held the seat since 2013. Democratic voters will choose between Brook Siskin and Devin Pandy.

Commissioners table discussion on parks funding By JOE PARKER joe@appenmediagroup.com FORSYTH COUNTY, Ga. — Talks to divert $12 million away from the development of Denmark Park have been put on hold. The Forsyth County Board of Commissioners recently voted to table discussion of funding for the park, set to be constructed along Mullinax Road near Denmark High School. The issue, which sparked a lively debate among commissioners at a July work session, stems from a priority list of park improvements primarily funded by SPLOST 8 tax revenues. After the optional sales tax passed, the county Parks and Recreation Board presented commissioners with a list of parks projects ranked by priority. The list included 11 undertakings divided into Greenway improvements, new developments and renovation projects. While the parks priorities list gives estimated costs, Parks and Recreation Director Jim Pryor said the figures are also placeholders, and the true cost isn’t known until a master plan is developed. Now that some of the projects have undergone that process, some are showing higher projected costs at a time when revenues may be falling. The park

But with the present economic uncertainty, Pryor said there is speculation revenues could be lower than anticipated. While some commissioners argued the county should use funds for renovations and upgrades to other parks rather than investing in a new build, District 3 Commissioner Todd Levent disputed those calls. Levent shared concerns that around

1,800 soccer players — about 1,300 kids and 500 adults throughout the county — could be left without fields to use. Forsyth leases the soccer fields at Polo Fields off Majors Roads and subleases their use to United Futbol Academy. The county recently extended its lease with the owners of the property until May 2021, but included in that agreement was the right for the property owners, the county or UFA to end the agreement at any time with a 120-day notice. There is also uncertainty how long the fields will be in place with a potential residential development proposed for the area. Levent said if the county plans on “defunding” Denmark Park, it needs to have a contingency plan for providing soccer fields if the Polo Fields complex closes. Phase 1 of Denmark Park development does not include rectangle fields. It does call for a parking lot, restrooms, a pavilion and pickleball and basketball courts, which Levent said were sought after by residents. A later phase does include rectangle fields that could potentially be used for soccer. Commission Chair Laura Semanson said she would “work with the soccer people all day long,” but the county should focus on improvements to its existing parks before shelling out funds for the construction, staffing and maintenance of a new space.

She also disputed that $12 million had already been earmarked for Denmark Park. “The idea we are defunding something, it was never funded to begin with,” she said. At the commissioners’ July work session, board members voted 4-1, with Levent opposed, to reallocate the $12 million called for to begin construction on Denmark Park to cover overages on park improvement projects. “It’s just removing a project from the list and making it 11 projects down to 10,” Pryor said. “And yes, it does remove $12 million from the list, but it doesn’t necessarily save $12 million due to the unknowns of the revenue collection rates over the next four years.” Pryor added that all costs are still estimates. He said the county is hoping the bidding process could result in lower costs on initial projects and some other plans could be added back to the list. Because the vote occurred at a work session and was not unanimous, the item was placed on a recent commissioners’ agenda, but the item was tabled without discussion. The 2019 priorities list calls for just over $17 million for the master plan and renovation of Bennett and Sharon Springs parks. Also outlined are improvements to Midway Park and Coal Mountain Park with a proposed $3.325 million renovation of Sawnee Mountain Park. The development of Denmark Park was listed as the top priority under the new development projects in the rankings. Other new construction that may join Denmark Park on the back burner are improvements to Sawnee Mountain Preserve and Lanierland Park and a recreation center at Matt Community Park. The priorities list also includes two Big Creek Greenway projects — $6.8 million for an expansion and $5 million for the boardwalk renovations near McFarland Parkway. election, Matt Gurtler led all candidates with 21 percent of the vote. Gurtler will take on Andrew Clyde, who received 18 percent of votes cast, in the runoff. Republicans will also select either Steve Leibel or Will Wade for the Georgia House District 9 seat. Wade outpaced the six-candidate field in the primary with 34 percent of the vote. Leibel garnered 20 percent. The winner of the runoff will face Democrat Sharon Ravert in the General Election.

Homeowners sway Planning Commission on plans for 44-acre senior living complex By JOE PARKER joe@appenmediagroup.com FORSYTH COUNTY, Ga. — Neighbors of a proposed 44-acre senior living facility received a win at the July 28 Forsyth County Planning Commission meeting, but there is at least one more round left in the bout. Forsyth Senior Living, LLC has requested a rezoning of 44 acres along Ga. 9, Shiloh Road, and Mars Hill Road in south Forsyth. The group’s plan calls for 339 total residences, including 130 assisted living/memory care beds. Also included in the request is 90 apartments, 24 stacked flats and 95 condominiums designated for independent living. A half-dozen residents who live along Mars Hill Road spoke out strongly against the proposal. Though the large complex would abut many of their homes, the residents were not taking aim against the facility itself. Rather, they sharply disagreed with how it could be accessed. The site plan includes three entry points — one each along Ga. 9, Shiloh Road and Mars Hill Road. Nearby residents said that allowing an entrance along Mars Hill Road — even while limiting traffic out of the complex to right turns only — would create catastrophic traffic issues along their neighborhood’s roadway. “Unless you stop that entry on Mars Hill Road, it’s going to be a disaster for our neighborhood,” one resident said. Another neighbor said she was agreeable to a previous site plan presented around five years ago, one that included an entry along Mars Hill, that offered nearly 100 fewer units on 17 fewer acres. However, her feelings had shifted since the complex had ballooned in scope. Residents also shared concerns about senior facility residents making left turns onto Mars Hill, adding to traf-

fic in front of their homes, and drivers using the road as a cut-through from Shiloh Road to the entrance. Attorney Ethan Underwood, representing Forsyth Senior Living, said the intersection could be designed as a sweeping, right curve with raised concrete that would prohibit the turns residents were concerned with. Forsyth Senior Living said the current zoning of their property along Mars Hill has a mandate that only right turns can be made onto Mars Hill and they wanted to “preserve the status quo.” Steve Rowe, an engineer representing the senior living complex, said the Mars Hill entrance to the site is necessary for emergency vehicle turnaround, and he disagreed with a nearby resident that a cul-de-sac could replace the entry point while accomplishing that goal. “If we had a cul-de-sac down there, it’s too far of a run from the front entrance to that point to turn around and come back,” Rowe said. “Fire trucks don’t like to do a lot of dead-end runs.” After an hourlong discussion, the Mars Hill residents got the concession they had sought. District 3 Planning Commissioner Jessica Thorsen, who represents the area, said she was conflicted, stating at one point she was on the verge of tears. She ultimately decided to recommend approval of the rezoning, with conditions that included disallowing the entrance along Mars Hill Road. The motion passed unanimously. North Fulton Chamber retools as pandemic endures Business group plans more timely initiatives to aid area employers By PATRICK FOX pat@appenmediagroup.com NORTH FULTON, Ga. — Stoked by a widespread surge in coronavirus cases, the Greater North Fulton Chamber of Commerce has stepped up efforts to assist local businesses weather an uncertain economy. The chamber hosted its first in-person event in three months July 16 at the Chattahoochee Nature Center — outside, of course, celebrating the center’s butterfly exhibit. The Business After Hours event was limited to 50 people, and there was a standby list. “People are ready to get back to inperson visits,” said Chamber President Kali Boatright. “We want to make sure our business members are confident that if they come to one of our events, that we’re following all the right guidelines and doing all the right things.” The Greater North Fulton Chamber BOATRIGHT mounted initiatives in the early stages of the pandemic, teaming with the Forsyth County Chamber to present a series of virtual job fairs throughout May and June. It also assembled a series of business workshops online free to members and non-members. The topics were timely, dealing with topics like financing, securing Payroll Protection Program assistance and how to promote consumer confidence. One event featured a town hall with all five mayors from major North Fulton cities.

Charity group names new executive ROSWELL, Ga. — North Fulton Community Charities has named Marten Jallad the new director of operations. In his role, Jallad will oversee all operations and lead the facilities management and thrift shop teams. Jallad has extensive experience in retail store management with big box retailers and thrift stores. His skill set includes the management of both large facilities and teams. “It’s an exciting time for Marten to join NFCC,” said

The Chamber also teamed with economic development heads from four cities to survey local businesses about conditions, layoffs and sentiment. The first survey was conducted in April and drew responses from more than 500 local businesses. Another survey was conducted in May, and a third survey just wrapped up in late July. “I believe, and what I’m hearing from other chambers all over, is that the economy, at this point, is really in the hands of consumer confidence,” Boatright said. “Are folks ready to get back out there?” On July 28, Lt. Gov. Geoff Duncan spoke at the monthly Wellstar Chamber Luncheon series, outlining highlights of the unusual 2020 Legislative Session that had been interrupted by the pandemic. Boatright said the free seminars, keyed toward business interests, will continue through August. “As a regional chamber, one of the blessings is we have connections to a lot of excellent speakers and knowledgeable experts,” she said. “There’s so much information out there, it’s very difficult to cull through all of it.” More recently, the Chamber has formed its own Economic Recovery Task Force made up of public and private leaders from throughout North Fulton. It has five functions: • Cash flow and liquidity – advising businesses on current sources of funding, such as the Payroll Protection Plan and other assistance. • Small business and entrepreneurism – a group of legal and financial experts available to assist those wishing to start their own business. • Workforce and unemployment – repurposing NFCC Executive Director Holly York. “He brings years of experience in facilities management to our team and has expertise in retail and thrift operations.” Jallad said he is looking forward to the challenge. “I am so very excited to join such an organization that provides so much to our community and look forward to

A shade of grey or beige always affords a great look or painting them black definitely makes a nice statement. Brass shower doors can be changed to brushed nickel, even better rimless glass when the budget allows is the perfect choice. Some showers are big enough to remove the door completely guaranteed to give you a nice open look, while being maintenance free. When updating a tub/ shower, choose an oversized custom shower curtain hung from ceiling to floor.

Amid the coronavirus pandemic and uncertainty of the season, the shift in Denmark’s opponent comes with a string of scheduling alterations to the annual event that kicks off the state’s high school football season. The Danes were originally scheduled to face Tucker in their debut Corky Kell appearance and inaugural game as a member of Class 7A. Following the July 27 announcement, Denmark will now take on Greater Atlanta Christian Sept. 3 at Dacula High School. It will be the first meeting between the teams. The game will feature a new-look Danes team now under the direction of

The Wolverines will also be under new direction this year with Dave Svehla replacing Shawn Cahill as head coach. Svehla comes to West after leading Etowah from 2012-19, racking up a 49-41 record. West will look to use its Corky Kell matchup to bounce back from the program’s 2019 campaign, the first losing season (4-6) in program history. Their opponent, Mays, won 60 games from 2014-19 with a playoff appearance in each year competing in Class 5A and 6A. The Raiders were placed in Class 4A with the 2020-21 classification updates. Games initially scheduled to take place at Mercedes-Benz Stadium in Atlanta will now be contested at Mill Creek High School. Two games that were to take place Sept. 4 at Rome’s Barron Stadium were cancelled and replaced by a Walton vs. Kell matchup at Walton. Alabama’s Hoover High School was slated to be the first out-of-state team to compete in the kickoff event by taking on Lowndes, but scheduling conflicts and the GHSA’s ban on facing non-Georgia teams forced a change. Commissioner Molly Cooper said the termination of the Affirmatively Furthering Fair Housing regulation by HUD Director Ben Carson allows for more local control. But, Semanson said if the regulations are similar to those in 2017, she would be opposed to the HUD dollars. Commissioner Todd Levent said he had concerns over getting into the program and being “stuck” with it, especially considering the possibility of a new administration next year that could change the regulations. Commissioner Cindy Jones Mills said the annual $910,000 award is needed. “I’ve talked to non-profit groups that say, we need this for non-profits, we need it for creative enterprise, we need it for the elderly…I would love to see us have a mental health day treatment center,” Mills said. “There are a lot of needs in our community that are not being met.” She said the funds do not have to be used for housing.

The press, and who’s going to know? Covering city council and county commission meetings tends to be, let’s say, tedious at times. With some exceptions — like when a developer is asking for a multitude of variances to increase RAY APPEN the number of units Publisher Emeritus they want to build — ray@appenmediagroup.com covering government meetings tends to be routine, quiet, and frankly, a snooze. Attendance tends to be sparse. Today, most council and commission meetings are streamed, so you can sit in your home and check out what your elected representatives are up to. I will suggest however, that in normal times the number of people who actually watch online is less than the number who attend in person. Hatcher Hurd who reported for Appen for so many years, always used to sit in the front row, week in and week out, notebook in hand, listening to every detail. For many meetings, he was part of an audience of less than five. But he always showed up. Sitting in the front row, Hatcher became something different than just a body in a chair. He became a “check and a balance.” Council members always knew that he would check up on their decisions and would make sure that everything passed the smell test — the balance. Because he had more institutional knowledge than most council members, there wasn’t much that slipped past him. He knew the rules. He knew the history. He knew who to call. He knew enough of the law to know when it was being manipulated. For all practical purposes, his function at those council meetings was akin to a referee at a football game. Everyone abides by the rules, or he calls it. Over the past 30 years, we’ve had an Appen reporter at around 4,000 city council meetings by my estimate. And we’ve reported on every single one. We’ve had to throw that yellow flag onto the field more than a few times. Recently we threw one on the City of Roswell for withholding information that, by law, belonged in the public domain. It ended up in court, and ultimately the information became available once again to the public. Last year, we threw the yellow flag when the Forsyth County Commission approved an item in open session — a matter earlier discussed in executive session— that they provided no details for. Nothing. They subsequently reintroduced the item, providing more details before casting a second vote.

Over the past 30 years, we’ve had an Appen reporter at around 4,000 city council meetings by my estimate. And we’ve reported on every single one. We also wrote an article last year on Forsyth County’s plan to finally make their agenda documents available to the public online in advance of meetings. We were told it was “in the works,” but now, over a year later, still no agenda packet available online. Gwinnett County made their agenda packets available online more than 10 years ago. Fulton has had its agenda documents available online before meetings for years, as well. So has Cherokee County. The public needs reasonable access to public business. If access to online agenda items were ever needed, it is now when everyone is sheltering in place or avoiding unnecessary crowds. We’ll keep you posted on Forsyth County’s online agenda packet availability. Meanwhile, we’re still awaiting word from the Georgia Attorney General’s Office over a request we made two months ago. It related to Forsyth County’s probe into a commissioner’s alleged circumvention of open records protocols. The county has yet to release the emails we requested. City councils, county commissions, school boards, all public institutions make decisions that impact your lives. They spend your tax dollars as they see fit. They award contracts paid for with your money and they do this in compliance with established law. One primary reason they comply with the law is because there is a newspaper reporter sitting in the front row listening. Years ago, after a city council meeting had ended, our reporter was getting ready to go home. It was late. Two council members were still in chambers having a conversation. One councilman said to the other, “Why don’t we just go ahead and approve that? Who is going to know?” In response, the other council member replied, pointing to our reporter a few feet away, “he will.” If the day arrives when there is not a reporter sitting in that front row, it will be a game with no referee. How do you think that will go? Support your local press. It’s the only one you’ve got.
