County approves vaccine incentives citing ‘significant impact’ on services

FORSYTH COUNTY, Ga. – At a work session on Sept. 7, commissioners discussed a county-wide rise in COVID-19 cases and approved a proposal to incentivize vaccinations for county employees. In his presentation to the commission, County Manager Kevin Tanner said that widespread COVID-19 outbreaks have damaged the service and productivity of the county government due to rampant exposure and resultant quarantine requirements. Tanner said employees have reported more than 4,000 hours of lost work due to the virus since July 25, marking a “significant impact” on the continuation of county services. Based on these numbers and after looking at surrounding jurisdictions, Tanner proposed a $500 incentive for full-time county employees and a $250 incentive for part-time employees to get fully vaccinated. Employees who are symptomatic or have tested positive for COVID-19 would be required to be fully vaccinated. Tanner’s proposal comes with an estimated $700,000 price tag which he said could be covered by funds the county received through the American Rescue Plan. With the incentive program, Tanner said, the county hopes to get 75

to 80 percent of employees vaccinated before the next spike in cases which he expects to occur after Thanksgiving. Currently, they estimate that fewer than 50 percent of county employees have been fully vaccinated. The proposal also called for countyemployee vaccination clinics which would be facilitated through the Forsyth County Emergency Management Agency. Additionally, Tanner requested that employees be granted paid leave to receive the vaccine. The Board approved the measure as presented with Commissioners Cindy Jones Mills, Alfred John, Todd Levent and Laura Semanson in favor and Commissioner Molly Cooper absent.

CUMMING, Ga. — Qualifying for the city’s Nov. 2 election closed Aug. 18, officially setting the race for mayor into motion. Residents will see two candidates for mayor on the ballot as Cumming attorney William Allen Stone III seeks to unseat first-term Mayor Troy Brumbalow. Meanwhile, incumbents Chad Crane, Post 1, and Jason Evans, Post 2, are running unopposed for City Council and will also appear on the ballot. Along with the city’s election, there will be a county-wide referendum on whether to continue a 1-cent special purpose local option tax for education, or E-SPLOST, for Forsyth County Schools. Brumbalow was first elected in 2017. He is both a builder/remodeler and owner of a tanning salon. One of the cornerstones of his first campaign was the building of the City Center, which is set to open in the coming months. When it opens, the City Center will feature local restaurants, retail shops and entertainment. According to Brumbalow’s campaign website, it will bring “significant benefits” to the city, including an estimated 20 percent increase in additional revenue to the city’s budget. expenses and a police department that has doubled in size since he took office. However, when his challenger announced he was running in July, Stone said it was because of the “high-density development and uncontrolled growth” in the city. Stone added that although the City Center will be built regardless of who wins the mayoral election, his issue is with how it will be managed when it is finished. Stone is a 2006 Forsyth Central High School graduate. He went on to earn degrees from the Terry College of Business at the University of Georgia, Georgia State College of Law and received an LL.M. in Taxation from the University of Florida’s School of Law. Advance voting will begin Monday, Oct. 11, and run through Friday, Oct. 29. It will include two Saturdays — Oct. 16 and Oct. 23. The Forsyth County Board of Elections and Cumming City Hall will be open from 8 a.m. to 5 p.m. during those dates. Additional polling sites will open at Midway Park, Sharon Springs Park and Hampton Park Library starting Saturday, Oct. 23, through the final week of advance voting. Voting on Election Day will run from 7 a.m. to 7 p.m. Only city residents will be allowed to vote in the City of Cumming General Election. Florida man accused of spitting on deputy FORSYTH COUNTY, Ga. — A Florida man spit on a deputy during an Aug. 30 arrest on Peachtree Parkway, according to the Sheriff’s Office. Lawrence Allen Sutton, 66, was charged with simple battery against law enforcement officer and obstruction of law enforcement officer. According to deputies, an officer was arresting Sutton for an active warrant out of Orlando, Florida. Sutton resisted while being taken into to custody and spit on the deputy.

Cumming couple arrested for suspected card fraud FORSYTH COUNTY, Ga. — A Cumming man and woman were both arrested Sept. 3 after deputies alleged they used a local landscaping company’s fuel card to make fraudulent purchases. Jamie McPherson, 40, was charged with five counts of fraudulent use of transaction card. Diana Temples, 39, was charged with transaction card theft, fraudulent use of transaction card and being party to a crime.

PUBLIC SAFETY Investigators said Temples worked for Upgrade Landscaping and managed the Cumming business’ Wex fleet cards. She turned all the cards in when she left the company but made a copy of one of them. Deputies said she continued using the card to buy gas and McPherson also used the fuel card several times.

Hacker attempts to steal $300,000 from contractor FORSYTH COUNTY, Ga. — A computer hacker reportedly tried to steal $300,000 from an Atlanta contractor on Aug. 30. An employee of Exovations told deputies an unidentified suspect hacked into the company’s bank account and attempted to wire $300,000 to a fake email. The employee cancelled the transaction before it fully processed and managed to keep the money from being wired out of the business account, according to deputies.

Man shoots at tires, claims self-defense

FORSYTH COUNTY, Ga. — Deputies responded to reports of an altercation along Knight Lane in Gainesville that involved gunshots Sept. 2. The victim told officers someone tried to run him over and he feared for his life. The man said he pulled out his gun and fired three shots at the vehicle’s tires. Deputies said no one was injured during the incident and the suspect drove away from the scene. No arrests were made.

County to reimburse state for utility relocation on Ga. 9 widening By PATRICK FOX pat@appenmedia.com FORSYTH COUNTY, Ga. — County commissioners signed off on nearly $7 million in reimbursements to the Georgia Department of Transportation for utility relocation during widening work on Ga. 9. GDOT’s plans to add another northbound and southbound lane to the state route from the Fulton County line north about 10 miles to Ga. 20. The work will require moving the water and sewer pipes farther out to make way for the new lanes. Under terms of a longstanding agreement with the county, GDOT supervises the work for its own projects, including utility relocation. Whoever owns the pipes reimburses the state for that portion of the contract. Money for the Ga. 9 widening project reimbursement comes from the Forsyth County Water and Sewer Department, which receives no taxpayer dollars and is funded almost solely through fees it charges customers. Department Director Barry Lucas

said the expense should have no impact on rates, because line relocations are a regular part of the job, and their expense has been built into the budget. Forsyth County Commissioner Todd Levent said the county knew for a long time the day would come when Ga. 9 would grow. “Water and sewer lines are our responsibility,” he said. “GDOT wants it to be bundled so their contractor does the whole project, including moving the water lines. Once that’s broken down in the state bid, and we see what it is, then we draw up the agreements to reimburse them.” The county was notified of the estimated costs in August in a letter from Shajan Joseph, assistant state utilities administrator. The requests broke the project reimbursements into three segments, along with the utility relocation costs: • From the Fulton County line to McFarland Parkway, $1.7 million • From McFarland Parkway to Post Road, $4.7 million • From Ga. 141 to Ga. 20, $470,000

Police arrest woman in stabbing death of husband JOHNS CREEK, Ga. — Police arrested a Johns Creek woman after they discovered her husband dead inside the couple’s home Aug. 24. The woman, 51-year-old Stephanie Ferguson-Levin, is in custody facing a murder charge. Police allege she fatally stabbed her husband, William Neil Kennedy, while her two children, ages 9 and 11, were in the home. Kennedy was 51. The Police Department released preliminary details about the incident on social media Aug. 25. Officers were dispatched to the couple’s house in the 600 block of Mount Victoria Place around 11:30 p.m. Aug. 24.

An out-of-state family member called 911, telling dispatchers about a frantic phone call they received from someone in the home. The caller said they feared someone there was seriously injured and asked police to do a welfare check. Ferguson-Levin was at the home when police showed up and found her husband dead from an apparent knife wound. Investigators determined that Ferguson-Levin was responsible for his death and took her into custody. She was charged with murder and third-degree cruelty to children. Green organization puts work into name

By JEFFREY ALBERTSON newsroom@appenmedia.com ALPHARETTA, Ga. — A non-profit agency, founded to better the local environment, is putting in work toward its mission and helping to satisfy appetites along the way. Green Cell Inc. was founded in 2018 by Pankaj Rajankar and Sandesh Shinde who wanted to bring about community change. The organization seeks to raise awareness about environmental issues and address them with sustainable solutions. The mechanism behind that approach is awareness, action and activism, fueled by volunteers from Fulton and Forsyth counties. “I have a 13 year son (who) was my motivation to get (Green Cell) started because I could see the big problems all over the planet, but I did not see real ground level work happening around me,” Shinde said. “I could see that there is so much waste happening in many different ways, and I wanted to tackle that by my own hands and ideas with likeminded people.” The community outreach includes neighborhood composting sessions in Johns Creek and Cumming, education webinars and a beautification project at the Autrey Mill Nature Preserve in Johns Creek completed by Green Cell’s youth group. The latest initiative is food rescue, a program that gets food that would otherwise be discarded into the hands of the needy. The initiative recently posted a 2-ton score from a Hindu temple in Alpharetta. The food, consisting of rice, beans, spices, cooking oils and other nonperishable items, had been donated to the Sri Hanuman Mandir Hindu

Temple in Alpharetta as an offering. As attendance tapered off, the foodstuffs sat dormant. A Green Cell volunteer approached temple leadership about putting the items to better use — all 4,050 pounds. “One of our volunteers, who also volunteers (at the temple) talked to the management, and we were able to convince them to get the food from their kitchen storage and take it over to three different organizations,” Rajankar said. Data from the Georgia Environmental Protection Division indicates wasted food makes up 12 percent, more than 800,000 tons, of the waste sent to state landfills each year. About 48 percent of the waste originates from the greater Atlanta area. Wasted foods include unsold items from retail stores, restaurants or households and processing facility by-products. The recovered food was trucked to North Fulton Community Charities (NFCC), Food4Lives and Raksha, Inc., where it will provide sustenance to the hungry and homeless. Green Cell volunteers collect between 100-200 pounds of food and produce from a grocery store on Monday and Friday each week. The produce is then distributed at NFCC’s food pantry. Additional food items are picked up each week from a local bakery. “What we try to do is bring change within ourselves, our family and then we try to change our community,” Rajankar said. “It is a mindset change, that I have to do something, that I have to change something in my lifestyle.” Additional information about the organization is available at: greencellatl.com. Mayor of Roswell hopes to share results from Oxbo investigation soon By CHAMIAN CRUZ chamian@appenmedia.com ROSWELL, Ga. — Mayor Lori Henry said she is hoping to receive the final report from the investigation into the circumstances that led to delays and cash settlements in the Oxbo Road realignment project by the end of the month. While some in the community are calling for more transparency, Henry said in an email Sept. 1 she will continue to take a hands-off approach until the investigation is completed. “As soon as I receive the final report from Jarrard & Davis (the law firm conducting the investigation), I will share it with the City Council and Roswell citizens,” Henry said. Henry announced in February she was launching an independent investigation to find out why the project had fallen behind schedule. The delay forced the city into a $2.5 million settlement agreement with the White family who owned a hardware store at 685 Atlanta Street. In 2017, Roswell paid the family $3 million for 0.36 acres of land containing right-of-way for the project and agreed to provide them with a pad-ready site to relocate their business on or by Oct. 25, 2020, a deadline the city failed to meet. To date, Roswell has paid Jarrard & Davis $71,507.32 using funds from the city’s legal department, but it has shared few details about their findings. During a public hearing Aug. 30, Jason Yowell, a 25-year Roswell resident, asked the mayor and City Council why they had not released any interim reports from the investigation to the public. Yowell is one of three candidates, including Henry, running for mayor in the Nov. 2 general election. Kathy Baker, the mayor’s executive assistant, previously said the city had not requested interim reports from Jarrard & Davis, so they could not be released because they did not exist. law firm sent to Henry March 16 shows the investigators had offered to provide the city with interim reports. The Herald obtained a copy of the letter through an open records request. “Upon completion of each of the phases of the investigation,” it states, “a detailed report will be prepared and presented to you to include a full synopsis and chronology of what occurred with respect to the progress of the project from its inception to the current and also recommendations for best practices for future projects.” Henry said she told the law firm from the start the reports would not be necessary for several reasons. “I knew the investigation was going to take time to complete because the Oxbo project dated back to 2006,” Henry said. “Interim reports were only going to slow down the timeline of my office receiving the final report. I wanted the investigation and the final report to be completed as quickly as possible.” “I did not want to receive the report piecemeal,” she continued. “I wanted to receive the complete report once the whole investigation was completed with Jarrard & Davis’ findings and recommendations. I also did not want there to be the perception that I was, in any way, trying to influence or interfere in the investigation. I have taken a hands-off approach to this process, and I have let them conduct their investigation. I am looking forward to receiving their final report.” According to the engagement letter, Jarrard & Davis were not given a deadline to complete the investigation but had “an internal goal” of completing it in May, depending on the availability of materials and witnesses. Henry said she received a letter in May informing her the firm would not meet the May deadline goal. The engagement letter states Jarrard & Davis charges Roswell an hourly rate of $250 for attorney services and an hourly rate of $100 for paralegal services.

Jarrard & Davis, a law firm specializing in local government, is conducting the investigation into the circumstances that led to delays and cash settlements in the Oxbo Road realignment project. It is based in Cumming. The project is being reviewed in three phases. Phase one consists of investigators reviewing documents from the Roswell Department of Transportation, Clerk of Court, Human Resources director and more. In phases two and three, investigators are interviewing both internal and external parties involved in the project. Still, Yowell is asking for more transparency. He said he believes the project was delayed due to a series of bad planning, bad contracts and bad oversight. “It seems to me you’re approaching governance here as hear no evil, see no evil, and we’ll have the final report after the election, thank you very much,” Yowell said. “This is unacceptable. There should be interim reports. These interim reports should have been shared with

Council and yet what do we have? Nothing. A lot of talk, a lot of money. I can’t believe you spent $71,000.” Neither Henry nor members of the City Council responded to comments following the open forum, but Henry said in August that the investigation was in its final stages. “I am committed to finding the answers so that the city does not have similar delays with future projects,” Henry said. Overall, the Oxbo Road realignment project is supposed to eliminate the staggered intersection at Ga. 9 and convert the portion of the Oxbo Road near Mimosa Boulevard into a two-way street. It should also provide a traffic signal and new turning lanes on Ga. 9 and Oxbo Road.

Local cadet completes basic training at West Point WEST POINT, N.Y. – Cadet Jackson W. Vagner, son of Mr. and Mrs. Oliver Vagner of Cumming, Georgia, completed Cadet Basic Training at the U.S. Military Academy. Vagner entered West Point on June 28 and has successfully completed six weeks of Cadet Basic Training. The initial military training program provides cadets with basic skills to instill discipline, pride, cohesion, confidence, and a high sense of duty to prepare them for entry into the Corps of Cadets. Areas of summer instruction included first aid, mountaineering, hand grenades, rifle marksmanship and nuclear, biological, and chemical training. Vagner began classes Aug. 16. The West Point curriculum offers 36 majors balancing physical sciences and engineering with humanities and social sciences leading to a Bachelor of Science degree. Vagner graduated from West For-

By CHAMIAN CRUZ chamian@appenmedia.com ROSWELL, Ga. — The search for a suspect of a double homicide ended Sept. 4, when detectives were notified that Duane Hall had been found dead in the driver’s seat of a stolen vehicle in Henry County. Police had been searching for the 30-year-old man since early August. He was wanted for two counts of murder for allegedly stabbing his parents, Delroy and Murline-Gregory Hall, to death. Police spokesman Tim Lupo said the Toyota Camry stolen from the scene of the murders — believed to have belonged to the victims — was in the woods near a reservoir off Indian Creek Road. The deceased male inside the vehicle was positively identified as Duane Hall. “At this time, there is no information on Duane Hall’s cause of death,” Lupo said. “However, there is no indication of suspicious activity, and detectives are not searching for any other involved individuals.” On Aug. 2, officers responded to a home on the 1000 block of Barrington Landing Court, where they found Delroy and Murline-Gregory Hall dead in their home. The motive behind the

Alpharetta to move ahead with local road projects in face of express lane delay By PATRICK FOX pat@appenmedia.com ALPHARETTA, Ga. — Alpharetta officials are watching closely as the Georgia DOT regroups from a setback on its plan to add express lanes along Ga. 400 through North Fulton County. The project, which was scheduled to begin late next year, hit a snag last month when the State Transportation Board rejected the only qualified bid for the work. MW 400 Partners’ proposal came in far higher than the $1.7 billion GDOT had budgeted. GDOT Commissioner Russell McMurry says the project remains active despite the setback. Plans call for two toll lanes in each direction running 16 miles from the North Springs MARTA station in Sandy Springs north to McGinnis Ferry Road in Alpharetta. The project has major ramifications for Alpharetta where two Ga. 400 overpasses will be replaced, and the city will inherit a new interchange where none existed before. Roswell also will be affected.

GDOT plans to add an express lanes interchange at Grimes Bridge Road allowing northbound vehicles to exit and southbound vehicles to enter the express lanes. It also will construct a new bridge over Holcomb Bridge Road that could accommodate a future bus rapid transit station. Alpharetta Assistant City Administrator James Drinkard said the city has made no formal moves to postpone or shift priorities on its own set of road projects because of the delay. “Until they announce a new schedule, we don’t know what to adjust to,” Drinkard said. While most big-ticket transportation projects on tap in Alpharetta were planned long before the express lane initiative kicked off in earnest two years ago, some do have significant tie-ins. In the current 2022 budget, the city has set aside $23 million in transportation sales tax dollars to widen Webb Bridge Road to create wider sidewalks along both sides of the road, adding bike lanes and a roundabout at Webb Bridge Way.

The GDOT plans to add a new interchange just north of Webb Bridge Road for exclusive use by Ga. 400 express lane traffic. City officials anticipate the exchange will add to traffic in the area, although neither the state nor the city can predict how much. Alpharetta has two other major transportation initiatives it plans to launch if the transportation sales tax is extended for another five-year term in this November’s referendum vote. The city is estimated to receive $61 million in funding over five years if the ballot measure passes. It’s top-tier projects include: Webb Bridge Road improvements — $13 million: The project focuses on the section of Webb Bridge Road between Morris Road and the Big Creek Greenway and would continue design elements to be constructed to the east that are being funded by the 2016 TSPLOST. Tradewinds Parkway ripple effect — $6.5 million: The project is meant to address possible congestion problems created by the new Tradewinds interchange for express lane travel-

ers. The city plans to construct a series of improvements on North point Parkway, Westside parkway, Morris Road and Webb Bridge Road/Academy Street. Alpharetta Mayor Jim Gilvin said the city has its own timetables set for its road projects, but the express lane delay is disappointing. ““It’s disappointing that the first round of trying to work out that business model wasn’t successful, but I think when you try something new, especially on a project this large, you’re going to have some challenges along the way,” he said. Everyone involved in the process, he said, understood from the beginning that the Department of Transportation has been working on this for more than a decade, and that this was a business model – a public/private partnership – the agency had never attempted before. “I think GDOT is continuing to try to figure out how they can get this done in a timely manner and in a way that’s respectful of the taxpayers,” Gilvin said.

Upgrades coming to Roswell DoubleTree after $13 million acquisition By CHAMIAN CRUZ chamian@appenmedia.com ROSWELL, Ga. — An Atlanta real estate investment company has purchased the DoubleTree by Hilton Atlanta Roswell hotel for $13.75 million. RADCO Companies is planning to modernize and upgrade the hotel for an additional cost of about $6.25 million. These plans will largely focus on the hotel’s guestrooms and guest bathrooms, common areas, mechanicals and technology. The property, located on Holcomb Bridge Road, is currently the only full-service hotel between the Perimeter and Alpharetta. It was constructed in 1985 and sits in a prime location adjacent to Ga. 400. The DoubleTree by Hilton Atlanta Roswell hotel consists of 76 double-double and 98 king rooms, more than 7,800 square feet of meeting space, a full-service restaurant and bar, fitness center, mini market and outdoor pool. During the COVID-19 pandemic, the hospitality sector, in general, saw a major decline, resulting in drastically reduced occupancy and average daily rates. In response, RADCO launched a hotel division in early 2021. The deal is the division’s first acquisition. Andy Williams, executive director of the Roswell Convention and Visitor’s Bureau, said although the acquisition is interesting, it is not unexpected, as RADCO

is taking advantage of an opportunity to add an asset to their portfolio. “Investment in hotel product that elevates the guest experience, whether in exterior aesthetics, interior spaces, meeting spaces or onsite amenities, is generally going to net a positive result and create a higher demand for that property,” Williams said. Should RADCO move forward with its plans to invest in improvements to the hotel, Williams said, it would only make it better. “Since our destination attracts leisure travelers, business travelers, weddings and other types of group business, we would expect this to have a positive impact on our community and the transient business we are able to attract to the city,” Williams said. The Ga. 400 corridor is growing rapidly. It is home to major employers such as State Farm, Mercedes-Benz, UPS, Kimberly Clark, Verizon and more than 700 tech companies based in Alpharetta. Norman Radow, CEO of RADCO, said the company’s move into the hospitality sector is a return to its roots. “We seek to invest in assets with a compelling acquisition story, and RADCO’s purchase of the DoubleTree by Hilton in suburban Atlanta employs all of RADCO’s investment criteria, representing an attractive opportunity in an excellent location,” Radow said. historic downtown to move forward. The project has been in the works for about five years and is estimated to be a $90 million investment for Roswell. The developer, West Alley LLC, expects to begin construction of the boutique hotel in 2022 or 2023. Once built, the boutique hotel and DoubleTree by Hilton Atlanta Roswell hotel will sit less than three miles apart from each other.

Let me tell you a story Along time ago - it feels like a hundred years - when I was in college, I took karate classes. After returning to Vietnam in 1973, he became president of a community college and local organizer. Towards the end of the war in the early 70’s the Viet Cong had his family under house arrest. They fled Vietnam and were one of “the boat people” who left Vietnam in a small boat to escape. One thing that I will never forget about Cuong Nhu was meeting the founder. O’Sensei Dong was a not a large man and probably never weighed more than 160 pounds, if that. He held elite black belt rankings in multiple styles - Wing Chun, Vovinam, Shotokan, and Judo. Later in life, he took up distance running and completed 23 marathons, 8 ultra-marathons (of 50 miles), and 14 100 mile ultras. That is, this man was not like you or me; he was more like some superhero from Marvel, but in real life. He feared no man. When he began declining from early onset Alzheimer’s Disease, his son Quynh took over the leadership of Cuong Nhu. I only met his son Quynh a couple times. Like his father, Quynh was not a big guy. Think of someone a cross between Bruce Lee, Mohammad Ali, and Roger Federer - lightening fast, fearless, intense, and intimidating —someone who walks into the room

and his father’s mission. Dead at 57 just made no sense when I heard the news. No way. Afterall, he was too strong, too fit, and too special for anything like a virus called Covid-19 to catch up with him, much less kill him in less than a few weeks. He died like so many others, struggling for each breath. Imagine that for yourself. Yes, even the mighty Quynh (pronounced “Quin”) was a weakling compared to this insidious virus and, yes, his number did come up, didn’t it? I can forgive him for leaving us at such a young age. But I cannot forgive him for completely missing what this whole thing is about and that it wasn’t all about him — in fact it had almost nothing to do with him. Getting vaccinated is all about everyone else - Quynh’s family, his children who may have been infected or their school mates or their teachers who may have infected or ultimately killed. I can’t forgive him for possibly infecting the people he worked with in the office, or the clerk he talked to at the grocery store, or the next-door

neighbor’s kid who came over to speak with him. I can’t forgive him for possibly infecting and killing the waitress at the restaurant he dined in or his neighbor’s mother who he greeted. Why did this amazing, talented, disciplined, intelligent man think that vaccinations have anything at all to do with just him? How is that possible? It’s not all about you. It is about respect for everyone around you - for humanity. And, it’s not about your “rights.” In relative terms, you don’t have this right. It’s not about who you vote for or who you are. It’s about the fact that you don’t have the right to potentially infect and kill other people because you think you have the right not to get vaccinated. You don’t have that right, sorry. I am so sorry. We all are. Maybe Quynh’s legacy will be that his death at 57 will inspire some of the almost 40% who are not vaccinated, to wake up and go do the right thing — and get vaccinated. Rest in peace Grandmaster Quynh.
