The properties are at 2545 Bethany Bend and add up to 7.08 acres in one of the more population-dense parts of Milton. The plan is to turn them into an active park with facilities and recreational programming that align with the 2027 Parks and Recreation Master Plan. Parks and Recreation Director Tom

McKIveen said there will now be a 90day due diligence period to allow the city to conduct surveys and inspections, followed by the closing date 30 days later. In the meantime, the owners of the properties – Cagle & Cagle Real Estate

ATLANTA — Younger students may have been less vulnerable to the COVID-19 virus, but they were hit hard academically, according to a recent Georgia State University report. The study, conducted by the Metro Atlanta Policy Lab for Education, reviewed data from three area school districts, including Fulton County Schools, to measure student achievement in math and reading over the course of the two-year-long pandemic. MAPLE has been collecting this data from the three districts since the start of the pandemic in March 2020. It released its first findings in spring 2021 which looked at data in the first year of the pandemic. The recent update states, “Student Achievement Growth During the COVID-19 Pandemic,” found many students have begun to recover academically in the second year

Caller scams resident with fake electric bill MILTON, Ga. –– A man who claimed to be with Sawnee Electric Company swindled a woman out of $355 over the phone June 14. The victim said she received a call from a man – with a Connecticut area code –who said she had an outstand-

PUBLIC SAFETY ing electric bill, and that a crew was enroute to shut the power off. The victim stated she already paid her electric bill and never received an email about missing a payment. The caller assured her no payment had been made, and she’d need to settle the bill immediately or have her power shut off. The victim said she was convinced the caller was with Sawnee because he’d provided the last four digits of her account number. He’d told her she could either pay the outstanding bill via Zelle or drive to the Sawnee site in downtown Atlanta the following day. The victim then transferred the outstanding balance

to a number the caller told her was a Sawnee account. After the transfer was completed, the victim realized it had been a scam because her daughter had called Sawnee customer service and confirmed the caller did not work for the company.

Suspect arrested in Roswell murder case By CHAMIAN CRUZ chamian@appenmedia.com ROSWELL, Ga. — An Atlanta man has been charged in connection with the death of a 45-year-old Roswell woman found unresponsive at the Economy Hotel on Old Dogwood Road June 11. Roswell police spokesman Tim Lupo said the victim, Kimberly Briggs, had visible injuries consistent with a recent assault. Roswell police and the North Fulton SWAT arrested 38-year-old Benjamin Donald Gunby at his home without incident on June 11. He is being held at the Fulton County Jail, where he faces two counts of murder, battery, aggravated assault (family violence) and aggravated battery. Gunby was denied bond at his first court appearance on June 14. Lupo said investigators learned that in the days prior to the incident, Gunby had physically assaulted Briggs at an apartment they shared in the 200 block of Old Holcomb Bridge Way. According to online court records, Gunby was charged with battery on April 29. He was released four days later on a $3,000 bond. “A subsequent autopsy confirmed that

the injuries Briggs sustained during the earlier assault led to her death,” Lupo said. According to the incident report, Roswell police responded to a medical call at the Economy Hotel at approximately 10:35 a.m. on June 11. That is when they found Briggs lying unresponsive on a bed. The report states she was already cold to the touch. There were also visible bruises on Briggs’ eyes and arms as well as an injury to the back of her head, the report states. Briggs is believed to have checked into the hotel at 8:34 p.m. on June 9 and was supposed to check out the next day. However, when an employee tried to enter the room on June 10 for “pest control purposes,” they stated they could see Briggs lying in the bed in the same position as she was later found but assumed

she was asleep. Since the interior latch was locked, the employee moved on to the next room. Then, on June 11, another employee reportedly entered the room to clean and found Briggs dead in the bed. Investigators estimate Briggs had been dead for less than 12 hours. According to Facebook, Gunby is a sports fan known for making remarks and judgments on Twitter under the handle @ guuuumby. He also blogs about sports on bengunby.wordpress.com. Appen Media obtained a copy of all incident reports filed for the Economy Hotel between June 1 and June 16 through an open records request and received eight reports, ranging from alleged criminal trespass to simple battery and theft by taking and aggravated assault with a firearm. There was also an incident on June 16 in which a 36-year-old Atlanta woman was administered two doses of Narcan because of an overdose. Her fiancé stated in the report she had shot up heroin and that he believed it could be laced with fentanyl. The incident report states she was transported to the North Fulton Hospital after a pulse was established.

Milton sees first draft of development bible By CHAMIAN CRUZ chamian@appenmedia.com MILTON, Ga. — The City of Milton is finishing what it started. On June 20, Caleb Racicot, a principal planner with Atlanta-based TSW, presented a draft of the city’s first Unified Development Code to the City Council. A UDC offers consistency, clarity and cohesion by laying out land use and other zoning regulations in a single policy document for an entire community. The adoption of a UDC is one element within Milton’s 2040 Comprehensive Plan the City Council approved in October 2021. The City Council hired TSW in 2017 to begin drafting a UDC, but after it had been about 95 percent completed, officials put the plan on hold in May 2019. Racicot said the analysis and approach phases had already been done, so when the city reactivated TSW’s contract, all that was left was the code writing phase. TSW’s contract extension does not

include any additional fees or services. The first of two public meetings to present and discuss the proposal will be held on July 13. The second meeting is slated for September. The City Council is expected to consider adopting the UDC in March 2023. At the June 20 Milton City Council meeting, Racicot said that part of the reason the city had been created in 2006 was precisely to control land use and development. “As you know, the primary tool for that is your local zoning ordinance and your development codes,” Racicot said. “So tonight, we are here really to talk about the unveiling of the draft of Milton’s first from-scratch Unified Development Code, which has been put together to specifically implement the needs of the city.” Racicot said that along with conducting a series of stakeholder interviews with residents, businesses, property owners and elected officials, as well as a techni-

cal review of the city’s codes, he’s also looked at Milton’s history of variances and assembled a diagnostic report. The report, he said, is intended to serve as a roadmap for creation of the UDC, which can then be handed to applicants, so they know what all the city’s rules, expectations and codes are. The UDC can also be easily modified to support different public policies as the will of the City Council changes. The document itself is 13 articles, ranging from legal statutory requirements to current zoning regulations. Racicot said what’s unique is that TSW used the 2040 Comprehensive Plan as a guide and recognized that there are different kinds of development patterns in Milton to put chapters in the articles for similar districts. “[Community Development Director Bob Buscemi] was just mentioning perhaps creating future types of ag,” Racicot said. “Well, those can go in the agricultural part of the code, so that all

of those districts have similar standards and protections within reason. There’s a residential area, there’s a business area, special purpose, form-based code, use provisions.” Racicot said one area where the City of Milton code needed a lot of work was in its use provisions, which TSW has spent a lot of time cleaning up. “It’s all over the place,” Racicot said. “… We kind of consolidated every use-related definition into the code and created new ones for things that you didn’t have defined. We’ve also put in place all of the standards into a single place.” Racicot said he doesn’t foresee there being much controversy because no policy changes are being made. TSW is also not rezoning anyone’s property, increasing or decreasing their density or changing the regulations they’re required to follow. “This is really a relatively simple technical cleanup process,” Racicot said.

Alpharetta agency advances tax breaks on 2 projects By JAKE DRUKMAN jake@appenmedia.com ALPHARETTA, Ga. — The Alpharetta Development Authority moved forward on about $645 million in bonds for two large-scale mixed-use developments at its June 21 meeting. The Development Authority first approved a bond inducement for redeveloping North Point Mall into a mixed-use residential and commercial area known simply as North Point. The inducement is a tentative agreement and does not guarantee the bond issuance, but Economic Development Manager Lance Morsell said the bond is estimated to be worth around $550 million. The bond would act as a temporary property tax abatement for the property developer, Texas-based Trademark Property Company. The Development Authority would hold the property title for a term of 10 years. Trademark would pay 50 percent of the assessed property tax in the first year and would increase its share of tax obligations by 5 percent each year until they assume the full tax obligation. After 10 years, the property title would transfer to Trademark. The redevelopment calls for demolishing a large portion of the 100-acre North Point Mall to make way for 900 units of for-rent multifamily housing,

Baseball, tomatoes and the ‘Mater Man’ When James Ray Bagwell (1929–2021) passed away last year, our area lost a colorful and appreciated citizen. Born in Alpharetta, James attended Milton High School and the University of Georgia where he played outfield for the Bulldogs’ baseball team. He led the team in RBIs and home runs in his senior year. In 195,0 he signed with the Detroit Tigers and played with the Jamestown, N.Y. Falcons and the Thomasville, Ga. Tigers, both Tiger farm teams. He spent the BOB MEYERS next four years in the Army at Ft Rucker, Alabama, where he played baseball while earning the rank of lieutenant. He was married to Sarah Hughes Bagwell (1920–2015) in 1954. James was a baseball player at a time when baseball was king in Alpharetta, Milton and the surrounding area. Boys raised on farms played the game with bats or sticks on ball fields or open pastures. Some, like George Napoleon “Nap” Rucker (1887 – 1970) and his nephew Johnny Rucker (1917–1985) were born in Crabapple and are the stuff of legends. Nap pitched for the Brooklyn Superbas/Dodgers and led the league in shutouts during his 10-year career. Johnny, “The Crabapple Comet,” played outfield for the New York Giants for six seasons. James Bagwell, on the other hand, decided that being a farmer took precedence over baseball. After serving in the Army, he returned home to his 30-acre family farm in Webb, Georgia, where he started a dairy business. With 200 cows he produced milk for the Atlanta Dairies cooperative until 1974 when Ga. 400 construction cut James Bagwell played through the dairy, making it necesbaseball at Fort Rucker, sary for James to sell his property. His daughter, Selena Bagwell Turner, Alabama, in the early operated a feed store on the adjacent 1950s, playing outfield during his four years in property until 1994 (Atlanta Dairies the U.S. Army. closed in 2004). Next, he bought his family’s current 15-acre property on Tidwell Road in Alpharetta adjacent to his mother’s parents’ property. He planted a few tomato plants in his garden, which through word of mouth grew to become a substantial business, earning him the title of “The Mater Man.” He grew several varieties, especially Big Beef, accounting for about half of his crop, Parks Whoppers and Early Bird. Today 1,200 to 1,500 plants are put into the ground every year by his descendants who run the tomato business. James had the gift of gab and loved to talk about baseball, politics and local family history with his customers. His grandson, Kyle Turner, says “people quickly learned that they could not out talk him.” Sometimes, folks would stop by just to chat – or listen – and pick up a few tomatoes of course. Somehow baseball and tomatoes seemed to go together when gabbing with James. Carlos Lee Bagwell, a cousin and close friend, describes

Triple Crown Softball Nationals return to Alpharetta in July ALPHARETTA, Ga. — More than 100 fastpitch girls’ softball teams will head to Alpharetta in mid-July as the Triple Crown Softball Southeast Nationals return to the city. The four-day tournament will run from July 14-17 at multiple North Fulton sports facilities, including Alpharetta’s North Park. Top-ranked teams from 14 states will compete for the Southeast Nationals title. “Triple Crown Fastpitch feels it is a priority to run a premier tournament in Alpharetta every year, and we are thrilled to have an exciting event ready to go for 2022,” East Coast Fastpitch Director of Triple Crown Sports Carrie Rivera said. “The skilled and customerfriendly staff with the Alpharetta Convention & Visitors Bureau, and the excellent Parks and Recreation divisions, are great to work with and deliver on every promise. The project is the second phase of a larger, 60-acre development in the area, which the City Council approved in 2021. The bond for the Lakeview development is structured with a 10-year property tax abatement, identical to the terms of the North Point redevelopment bond. Morsell said the Development Authority uses tax abatements to incentivize developers to invest in the city. Kimball Bridge Venture Partners,

the group finalizing plans to redevelop the former Bailey Johnson School into a 160,000 square-foot office complex also presented project updates to the authority on Tuesday. The developers are partnering with Crescent Communities on the venture. The Development Authority approved a $70 million bond inducement in January, though plans for the project are still being finalized before the bond receives final approval. The complex, which will include an adaptive reuse of the existing school building and gymnasium as well as a new timber-frame office building, will be called The Garren. The name combines the first names of Warren Johnson and George Bailey, the Bailey Johnson School’s two namesakes.

Avalon developer plans new Johns Creek project JOHNS CREEK, Ga. — Mark Toro, the mind behind Alpharetta’s iconic Avalon shopping center, announced plans June 22 to create a new mixeduse destination in Johns Creek. Toro Development Company plans to redevelop a 43-acre site on Johns Creek Parkway at the intersection with McGinnis Ferry Road, currently occupied by two mid-rise office buildings formerly occupied by State Farm. The company aims for the development to support the city’s vision for its recently passed Town Center project and bring new retail, dining and entertainment to the area. Toro Development Company plans to develop the office campus into “a vibrant, walkable mixed-use environment” and energize community building with public events and “exceptional” retail and restaurants at the street level and residential units above. Concepts for the development include chef-driven restaurant patios, greenspaces with soft seating and an event plaza for weekly live music and entertainment. The company will purchase the parcel from New York-based U.S. Realty Advisors, which has been seeking a partner to redevelop the site since State Farm moved out of the area. “Suburban office campuses are a dying breed,” Toro said. “We will transform this property by introducing a mix of uses that will buzz with energy, excitement and connectivity. • At all other times, any noise louder than 55 decibels (including those produced by many fireworks) are prohibited per Milton’s City Code.

• Even on allowable days, fireworks cannot be set off

on a public road, a City park, or within 100 yards of a nursing home, health care facility, gas station/fuel tank, electric substation or historic site.

• Any fireworks used should be U.S.-government approved.

Final design nears on new campus for Forsyth offices By R.J. TURNER newsroom@appenmedia.com CUMMING, Ga. – Forsyth County officials are heading into the final design phase for a new Administration Building campus on Freedom Parkway near Ga. 400. The new government complex, with an estimated price tag of $95 million, is needed because the government and the services it provides have outgrown the downtown Cumming headquarters, county officials say. “The county has had to rent space on West Maple Street paying $400,000 in rent per year,” Forsyth County Manager Kevin Tanner said. The new campus will be a one-stopshop service facility, where “everyone will be under one roof,” Tanner said. The campus will occupy 42 acres and include the Administration Building and Employee Center, the Whole Health Building and greenspace amenities. The new four-story Administration Building headquarters is approximately 130,000-square-feet, enough space to house nearly 14 county departmental functions, such as bill payment, per-

mitting, business licensing and other administrative services. The first floor single-story Commissioner Meeting Room will occupy a large wing of the building, with an above outdoor roof deck. With public and secured access areas, room interiors include commissioners and administrative offices, conference, training facilities, and other services rooms. The facility will have state-of-the-art capabilities for the county’s broadcasting operations., “The Communications Department will have a quality system for in-person and virtual meetings,” Tanner said. The Employee Center, located in the same building, will be approximately 25,000-square-feet and is designed to attract and retain long-term employment for Forsyth County. “Having a healthy work force in mind…the county sent out a survey to employees on what they would like to see,” Tanner said. “The center is a place where employees can go and get a PA (physician assistant) nurse, medication, 24-hour gym, attend nutrition classes, the wellness center, and lounge.” County officials are reviewing the results of the surveys received.

After relocation, the County Health Department will continue offering services such as healthcare, vaccines, WIC and dental services in another. Greenspace on the campus includes a passive park with walking trail and picnic area. Ample parking will be available onsite.

However, progress is uneven across student groups. “The impact of the pandemic on student achievement growth has been greater in math than in reading… [and] students who were in elementary school when the pandemic hit, have fared worse than students who were in middle school,” wrote Tim Sass, the MAPLE faculty director who led the research.

Effects in middle schools

Middle school students still faced challenges, however. According to the research, the pause in learning growth averaged more than seven months for seventh grade reading across the three districts, and it ranged anywhere from zero to seven months for eighth grade math. “The pandemic undid much of the progress schools and communities had made pre-COVID to reduce historic disparities,” Sass noted in the report. In addition to Fulton Schools, data is being pulled from Clayton County Schools and a district which has chosen to remain anonymous. In the May 2021 report, researchers found widespread learning “pauses” in math and reading across the three districts. Students were not necessar-

ily losing knowledge, but they were not advancing academically to where they should have been. The news was no surprise to officials with Fulton County Schools. The district had reported a stall in learning that set in almost immediately after schools shut down in March 2020. By August 2020 when school resumed, some Fulton County Schools students were several months behind where they should have been academically, based on testing data. The MAPLE report noted achievement trends across the three districts were influenced by geography, economic status, race and ethnicity. Most were disparities and factors in place even before the pandemic, creating academic disparities. Students eligible for free and reduced lunches and minority students fared worse than any other group in the first year of the pandemic.

In-person teaching is key

A year into the pandemic in 2021, MAPLE researchers found COVID-related issues continued to disrupt learning. However, student achievement was boosted when instruction returned to the classroom as quickly as possible. On average, elementary students who returned to in-person instruction during fall 2020 had significantly higher learning growth than their peers who continued to learn remotely, according to Sass.

Of the three districts in the study, only Fulton County Schools opened for in-person instruction in the fall of 2020. Fulton County Schools officials say the decision to quickly resume in-person instruction likely helped stem further learning loss during the pandemic. “The return to face-to-face instruction, coupled with our accelerated curriculum and intensive supports like small group tutoring, extended day sessions, and a more robust summer school, all related to the [academic] recovery,” said Brian Noyes, chief communications officer for Fulton Schools. Fulton County Schools also directed most of its COVID relief funding to implementing a comprehensive “Bridge to Success” program to get learning back on track. With only two years of data to review, MAPLE researchers say there is still a lot to be learned as far as best practices and strategies. But it recommends attention be focused primarily on the most vulnerable students. “Recovery efforts ought to target students who experienced the greatest declines in national rankings and have been the slowest to recover,” Sass wrote. “Participation [in these efforts] may need to be mandated or incentivized and is key to the programs’ success.” To read the full report, visit gpl.gsu. edu/, and click on “Publications.”
