BishopswantI changesinthe FamilyLawAct

Thefactthatacouplecancommencelegalseparationimmediatelyaftertheirmarriageandhovetheirdivorcecompleted12months latergiveslittlesupporttotheidealofmarriage,according totheAustralianBishops.

Reviewingtheeffectof theFamilyLawActthat wasintroducedin1975.the Bishopsstatedrecentlythat theexpectationsofthose abouttomarry,immediatelyorinthefuture,mustbe affectedbytheeasewith whichobligationscanbe soeasilyshed.

InalettertotheAttorneyGeneral,theAustralian BishopsConferencesays thatpresentlegislationin practicegivesverylittle senseofstrongcommunity supporttoayoungcouple abouttomarry.

INRETROSPECT

Lookingbackontheperiodofpreparationforthe legislationovertwoyears ago,theysaythattherewas toomuchemphasisplaced ontheharrowingeffectsof marriagebreakdown. Correspondinglytherewas insufficientattentionpaidto stepsdesignedtomakemarriagebreakdownlesslikely.

TheBishopscallonthe Governmenttogiveattentiontotwomatters:making thecouplepauseasufficient timebeforeundertakingdivorceandtheprovisionof long-termcounselling.

Speedinthehandlingof processeswiththepossibilityofdivorcebymailindicatethattheoriginalphil-

osophyofthelegislation buttressingmarriagehas beenforgotten,theysay. Risingdivorceratesmay notheareliableindexon thestabilityofmarriage, butAustraliansocietyhas beenlulledintoafalsesense ofsecurity.

COUNSELLING

TheGovernment,they say,assumesthateveryone wouldbehappywiththe FamilyLawActasit stands.

TheBishopswantthe FamilyCourttotakegreateradvantageofapproved marriageguidanceorganisationsforcounsellingand alsotoappointmorecounsellorstogivelongterm attentiontoacouple. Theysaythatthestatutoryperiodofseparation shouldbelengthenedso thatcoupleswilltakeadvantageoflong-termcounselling.

Theyalsowantageneralreviewoftheworking relationshipbetweenjudges andcounsellorsandtheway inwhichdecisionsaremade aboutwhichcounsellorsa couplewillsee.

BIRMINGHAM(NC).-InalettertothebishopsofEnglandand WalestheVatican'sDoctrinalCongregationhasinsistedonceagain thatthreeconditionsmustbesimultaneouslyfulfilledbeforegeneral absolutioncanbegivenwithoutindividualconfession.

Itrecalledthatitwas quitepossiblethattheappropriateoccasionforgeneralabsolutionmightnot existinEnglandandWales.

Theletterwasreadtothe NationalConferenceof Priests,holdingitsannual meetinginBirminghamthis month,by Archbishop GeorgeDwyerofBirmingham.presidentofthebishops'conference.

Itwasinanswertohis lettersaskingforclarificationofthethreeconditions laiddowninthenormsregulatingthenewriteof Penanceandstressingthe pastoralbenefitsthathad resultedfromtheexperimentaluseofgeneralabsolution.

ServicesofPenancewith generalabsolutionwerefirst introducedduringLent, 1975,bythediocesesof ShrewsburyandNottingham.

Thethreeconditionsare: Thattheremustbea greatnumberofpenitents. Thattheremustbe toofewconfessorsavailabletohearindividualconfessionsproperly.

Andthatthosecomingtosuchaserviceof Penancewouldotherwisebe deprivedofthesacraments foralongtime. QuestionsputbytheEnglishandWelshbishopsincludedaskingwhatwas

meantbytalkingaboutthere notbeingenoughconfessors availabletohearconfessions "properly".

IntheirletterstoRome theyquotedpriestshorrified attheideaofrevertingto the"slot-machinementality"andspeakingofthe "irreverentadministration ofthesacraments"involvedingettiingthroughpeople'sconfessionsatarate ofoneaminute. TothistheDoctrinal Congregationrepliedby merelyreferringthebish-

opstotheapprovedauthorswithoutmentioning thembyname.

TheDoctrinalCongregationalsoinsistedthatgeneralabsolutionwasnotto beseenasanalternative toindividualpersonalconfessionbutwasstrictly somethingforemergency useonly.

Thecongregation'sreply, whichwasdatedJuly26,is tobediscussedbytheEnglishandWelshbishopsat theirnextmeetingtobe heldinNovember.

RHODESIANBISHOPCOMING

BishopDonalLammont,formerlyofUmtaliinRhodesia,IscurrentlyinAustraliaat theinvitationofthe AustralianHierarchy. InAugust,1976,BishopLamontwascharged bytheRhodesianGovernmentwithhavingfailedtoreportthepresence ofterroroists. Ofcome,thereareothergroupsoftribalaborigines likeus.Muchofwhatsaywouldapplytothem. PortKeatshasapopulationofalmost1,000Aborigines.Ninety-ninepercentofthemareCatholics. Thepeoplearemadeupofthreemaintribalgroups, namelyMurinbata,MuringnarandMurinjabin. Beforethemissioncame42yearsago,thepeople livedintheirowntribalareas.Theywerenotthe bestoffriends.Tribalfightswereverycommon. Whenthemissioncametheybegantolivetogether. Theystartedtowork,atfirstinthegarden,andlater instockwork.Theywenttothehospitalwhenthey weresick.Theyletthechildrengotoschool.Most ofthepeoplereceivedinstructionintheCatholicfaith,

Manyoftheoldpeoplekeptuptheoldways. Theywerenotforcedtostopthem.Myfatherhad threewives,buthewantedtohavemebaptised. IwasthefirstbabybaptisedattheMission.My fatherWarbaptisedonlyin1966.Hediedayear later. TheoldpeoplecalledtheCatholicFaiththe"New Way",Theycalledtheirownreligion"theOldWay". Sometimesomeofmypeoplespokeaboutreturning totheoldway.

Theyhadargumentsaboutthis.Evennowargumentssometimesstartaboutit.

Fifteenyearsago,therewasabigmeetingatwhich myfatherandtwootheroldmenstoodupagainst othersonbehalfofthe"NewWay".

Theysaidthe"OldWay"wastoodangerousfor youngpeople.Itwasclearforthemthatthetwoways wouldnotgotogether.Sotheoldceremonybegan todieout.

Priests,Brothers,Sistersandlaymissionarieshave workedveryhardforus.Thishasmadeusrealise howmuchrespectandconcerntheChurchhasforus. Infact,themissionsavedourpeople.Theywere dyingout.Nowtheyaregettingbigandstrong.

THEPOPE'SWORDS

Inthepastfewyearsespecially,havenoticedthe ChurchsayalotaboutAboriginalculture.Iheard theHolyFather,PopePaul,speakofhisrespectfor ourcultureatNorthSydney. heardhimagainspeakofitwhenwesawhimin Romeduringourpilgrimage.Ihavereadhiswords inhisletter"EvangelisationintheModernWorld", (Ch.2,par20.)

TWOCAUSES

ThetragedyoftheAboriginalpeoplehascomein twoways:

First,theyhavelostortheyarequicklylosingtheir religiousfaith.Secondly,theyaregettingnoother faithtotaketheplaceofthefaiththeyarelosing. Theonlythingthatistakingplaceoftheirlostfaith ismaterialism.

SotheAboriginalpeopleneedtheChristianfaith urgently.Theyneedtohaveitplanteddeeply,"right totheveryroots",asthePopesays. Theyneedtohaveitsothatitispartofthemlike theiroldfaith.

TRADITIONAL

havebeenspeakingoftraditionalAboriginal religion.Iwanttomakeitclearthatamawareof thebadthingsintraditionalreligion.Itwasnot somethingfullofgoodthings. donotwanttopaintitupinthewrongway. EventheDreamtimefigureshadtheirvicesandtheir veryhumanfailures.
