ButtheChurchdoesnotrecogniseasvalidthe marriageofaCatholicwho,withoutadispensation fromthebishop,marriesbeforeanyoneotherthan aCatholicpriest(oradeacon). Toavoidallconfusion,thisappliesonlyto Catholics.TheChurchrecognisesasvalidthemarriageoftwopersonswhoarenotCatholics,providedofcoursethattheyarefreetomarry. Inallowingthebishopstodispensefromthe obligationtomarrybeforeaCatholicpriest,Pope Paulaskedthatthebishopsofeachnationagree ontheparticularcriteriaaccordingtowhichthey wouldgivesuchdispensationintheirowncountry.

TheBishopsofAustraliahaveadoptedtwo generalcriteria:

(1)WhenthepersonwhoisnotaCatholicis closerelativebybloodormarriageofaministerofanotherChurch;or (2)When,intheinformedjudgmentofthebishop, therefusalofthedispensationcouldcausea gravedangertothefaithoftheCatholicpersonortothepeaceandharmonyofthecouple. Thissituationcouldbeverifiedinthefollowingexamples:

(a)Avoidanceofstrainedrelationsbetween thetwofamilies,sothatbothmayofferbetter supporttothecouple;

(b)activeparticipationofthepersonand/or hisfamilyinthelifeofhisownChurche.g. SundaySchoolTeacher,Elder,Warden; (c)tokeepthepersonwhoisnotaCatholic frombreakingwithhisownChurch; (d)aclosepersonalrelationshipofthecouple withaministerofanotherChurchwho,because ofthisrelationship,willbeinagoodposition toassisttheminanydifficultiesthatcould ariseintheirmarriage.
