His Excellency Ban Ki Moon UN Secretary General United Nations Plaza, NY, USA June 21st 2012 Dear Secretary General, As you may know the Iraqi parliament has in its possession numerous cases which have brought the MPs to the conclusion that the current government will bring our nation to the brink of total failure and defeat of our democratic process. One of the most irritating cases is the extent of freedom the Iranian regime enjoys in its meddling in our internal affairs, signified in suppressing its opponents at camp Ashraf. The coalition of majority now attempts to confront the Iranian political pressures and pursue the peaceful transfer of power based on the will of elected representatives of Iraqi people. It is no secret that UN handling of Ashraf has increased our anxieties regarding this challenging issue. It is particularly worrisome because the inhumane treatment of camp residents during and after the relocation to Liberty and their incarceration in the new location was carried out with UNAMI's absolute silence and consent. At the outset, your special representative gave profound guarantees to MPs and political leaders whom had deep suspicions that relocation is an Iranian agenda, assuring them of the observation of resident's maximum rights. The special representative was stressing on the fact that UNAMI with the backing of United States Embassy with round the clock surveillance will prevent nuisance and harming of the residents, unlike what was already going on in Ashraf. Now six months into the process, 2000 of the residents have become trapped in Liberty, they have to transfer their water from a distant location with much hardship, are not connected to state electricity, have been deprived of transferring their own property and are prevented from any visit to the outside world. The camp "Liberty" is managed by someone wanted by international tribunals for his involvement of two previous massacres of the residents. Now you definitely give us the right to assess the previous UNAMI's golden picture of the situation as seriously inaccurate, tainted with political considerations and false and to conclude that the evaluation of many Iraqis describing the relocation project, an Iranian agenda has proved itself right. The relocation had unfortunately no aim other than involuntarily driving the residents from their home and to pile them up in an unprepared place to facilitate their repression. Is it rational for families and supporters of the residents to spend one Million dollar in three months for provision of their fuel only? If this conclusion is invalid why repeated request by Iraqi MPs, Human Rights Commission and international institutions for visiting Liberty has remained unanswered? Dozens of our letters to Mr. Martin has had the same destiny. It is really unclear what the UN mandate in this dossier is? If it is to observe the rights of the residents, the UN should announce this project a failure. On June 11th Mr. Martin Kobler, announced: "I urge the remaining residents of Camp Ashraf to relocate to Camp Hurriya without delay. The relocation process should not be stalled. I am concerned that there will be violence if the relocation doesn’t recommence". The real question is why there is no mention of harassments and violations that has caused the relocation to stop? Who will be responsible for a possible violence? It is obvious that the residents are asked to relinquish their rights and relocate at any cost. The question is why such an aim has become the UN mandate? was annulled on June 1st 2012 by the US Court of Appeal in District of Columbia and there is no justification for violence against the innocent residents who have been made homeless. Noteworthy to say that any mention of violence against Ashraf residents and their intimidation is a violation of international conventions. Mr. Secretary General, A glance at demands of Ashraf residents is saddening because they are all short of the basic rights stipulated in the Universal Declaration of Human Rights. Because of these demands we are convinced that insistence on continuation of relocation is an intentional violation of human rights and assisting in collective punishment of this large group of human beings. Please take note of these demands and their basic nature: - Receiving the body of a person who died because of heart attack due to inhumane pressures - Buying shades to screen off the severe sun heat in an open area - Transfer of special trailers and vehicles belonging to the handy capped, suffering in Liberty - Transfer of six utility vehicles which were returned from midway to Liberty by deceiving the residents - Transfer of air conditioners from Ashraf to Liberty to confront the summer heat and replace the nonfunctional air conditioners that the government does not allow their repair - Not preventing sale of their property - Not preventing the visit by human rights delegations While none of Ashraf residents have been resettled, whereas the relocation not only has not improved their situation but it has led to their homelessness and an increase in their suffering, the UN should either announce the relocation plan as terminated and seek another solution for the residents or by announcing camp Liberty as a UN refugee camp, relieve the residents from the current torments. Our hope is that the case of Ashraf will become an example for priority of international law and human rights over political agendas and political pressures while many around the world carefully observe the resolution of this issue and evaluate the performance of all parties involved.
