The Swiss Garde Presence ensures optimum energy management with 2 independent relays. Relay no 1 connects and controls the lighting depending on persons present and on brightness. Relay no 2 connects heating, ventilation or gongs, etc., potential-free and brightness-independently. Both relays can be set to pulse function or follow-up times via the time controller. According to requirements, the light (relay no 1) can be completely switched on and again off via the remote control provided. The automatic can thus be disconnected for lectures or on leaving the room, and be connected again later on, according to requirements. With the predefined reach and 2-channel system, individual devices can also be controlled via hand-held transmitter selectively. The Swiss Garde presence detector can be applied as a fully automatic machine with a make contact switch or as a semiautomatic machine with a standard light switch. This unique technology allows simple retrofitting of existing lighting systems!

Light control channel: Following detection of a movement, the detector sends a 1-frame or a configurable dimming value (0…100%). In case of absence of movement the presence detector sends a 0-frame or a second configurable dimming value (0…100%) on expiry of a configurable followup time. Heating / air conditioning / ventilation control channel: this output switches only after checking 2 to 20 consecutive observation windows of equal length, in each one of which at least one movement has been detected. Master/slave mode: can be configured by setting the parameters via ETS3. With the optional IR remote control, the lighting channel can be switched on or off unconditionally. After expiry of the configurable release time or by activating the AUTO button, the detector returns to its normal state.

Newly available is the Swiss Garde 360 presence detector KNX/EIB with EIB interface for application within building system engineering. With 4 pyrodetectors and a high-resolution lens, it detects the smallest movements and evaluates each signal with first class electronics operated via a microcontroller. The following operating modes are programmable with the use of our presence detector application software:

Swiss Garde 360 Presence Easy

The Swiss Garde 360 Presence Easy is a 1-channel presence detector detecting the smallest movements with 4 pyrodetectors. It is suited for offices, schoolrooms, lounges and corridors, etc., and features a large detection area with 16 m diameter as well as an integrated short duration pulse function. The highperformance relay allows the direct connection of fluorescent lights, and the high electronic control gear switching capacity ensures a long life cycle. The Swiss Garde Presence Easy is remote controllable with the PIR hand-held transmitter, with just a push of the button to set the preferred parameter values.

The Swiss Garde Presence Mini ensures optimum energy management. The sensor head is small and inconspicuous. It can be fastened in the ceiling quickly and easily by means of the spring clips provided. All parameters can be set via remote control at the push of a button! The follow-up time can be set to pulse function or 1–12 mins via the time controller. The light connected to relay no 1 is switched off automatically as soon as the natural brightness exeeds the value set in the device.The Swiss Garde Presence monitors rooms up to 60m2, and with an additional sensor up to 120 m2. Assembly The Swiss Garde MZ 5000 Bidirectional features interactivity between two detectors and bidirectional information exchange with a control pad. For maximum radio reach, the MZ 5000 should not be mounted on or near metal and iron, and the mounting height should be at least 2 – 2.5 m. Due to the interactivity, two MZ 5000s can be connected wirelessly in parallel, and this across different fuse groups.

Bidirectional module can be applied at the standard model with a few hand movements. Bidi module + Bidi pad = Bidi set

Before final installation we recommend to check the radio transmission by means of the control pad and to remove parasitic frequencies and also materials and devices reducing the reach.

The Infra Garde presence detector detects the smallest movements with 4 pyrodetectors and a high-resolution lens, and evaluates every signal by means of first-class electronics. The Infra Garde Presence ensures optimal energy management through 2 independent relays. Relay no 1 switches and controls the lighting depending on persons present and on brightness. Relay no 2 switches the heating, ventilation or gongs, etc, potential-free and independently of brightness. Both relays can be set to pulse function or follow-up time via time controller. The light connected to relay no 1 is switched off automatically, as soon as the natural brightness exceeds the value set on the device. Depending on requirements, the light (relay no 1) can be entirely switched on and again off via the remote control provided. In this way the automatic can be disconnected for talks or on leaving the room and again be reconnected later on according to requirements. With the predefined reach, individual devices can also be controlled selectively via a hand-held transmitter. The Infra Garde Presence monitors rooms of up to 100 m2 and can be switched in parallel for additional surfaces without any problems. The two first-class power relays switch up to 2000 W and ensure flawless functioning even with FLs or energy-saving lamps. Properties/Assembly The light or other consumer loads can be switched on or off wirelessly with modern high frequency technology. The radio signal works with distances up to 30 metres across doors and walls! In this, hand-held transmitters, radio motion detectors, radio gongs and 10A receivers can be freely combined. Choose yourself whether the radio motion detector is to activate the light, the gong or both together at the same time! Or whether the light is to be controlled automatically by the sensor in the garage and the sensor at the entrance! Different codings with 256 combinations allow distribution into different groups. Disturbances from the outside can this way be prevented and the functions be optimised!

Properties/Assembly The Infra Garde 12V is operated with 12 V AC or DC and is ideal in combination with a solar system, for camping, on a ship or in a summer house, wherever no electric supply is available or a low current cable is desired. The mounting base allows both wall and ceiling installation. The low current device can be connected to a 12V battery and is mostly found with solar systems or in summer houses (Please note: the voltage must be at least 11Volt!). Assembly and the laying of extensive electric power lines in gardens or buildings can be saved with the Infra Garde 12V!

In wet rooms and toilets little light is used. The current saving potential is therefore particularly great. Please note: The entry must be located within the closer-up detection area of the motion detector. Avoid any mirrors within the closer-up detection area of the sensor. This could lead to disturbances in conjunction with the lighting. If this is the case, cover the respective lens part with a blind. Ventilators close to the motion detectors can lead to draught leading in turn to an undesired switch-on of the light. Place the device within sufficient distance from the ventilator and insert the gasket for concealed installations. Make sure that the toilet cubicles are located within the detection area also. For this, ceiling motion detectors would be highly recommended.

Garages and multi-storey car parks Due to the lighting in garages and multi-storey car parks being necessary only temporarily and in certain areas, the savings potential is particularly high. Please note for your planning: Avoid installation of the motion detectors directy above the vehicle bonnet. The engine heat can lead to small turbulences which could trigger a switching pulse in the motion detector. 2. The entrances and the staircase and lift accesses should be located within a close-up range of the sensor. We recommend this to be within a 5 m range. The Swiss Garde Premium is ideal for monitoring larger surfaces, such as in multi-storey car parks, etc. Position the motion detector in a way so as not to allow persons or cars to approach it directly. This would otherwise lead to a decrease of the reach. If more than 4 detectors are switched in parallel, we recommend to use the short duration pulse function model which is provided with a time switch. On using the Swiss Garde 360 Premium we recommend, if ever possible, to monitor the car park area within a 12 m detection area, as sometimes only small movements occur in there over a longer period. Within the cruising range, the distance to the next motion detector can well even be 16 m!

In various light measurements at the ceiling, approx. 20 lux were measured for dark or black floors, respectively, and approx. 50 lux for white floors, all against the same natural exposure to light. Set the twilight controller to the minimum of 5 – 10 lux for white floors!

Installation example 5: wet rooms

In order to make the largest possible saving on current, care should be taken in big lighting installations not to connect all lights in parallel. Often enough it is sufficient to switch on a smaller lighting group, as only part of the area is driven in or passed. In the present case 4 lighting groups were provided for. Given that each arriving or departing vehicle passes the drives, a small lighting group with a Swiss Garde 360 Premium (max 30 m diameter) was installed, which is switched on permanently. In this case only the left-hand or the right-hand car park half is often used. For this reason 3 further lighting groups of Swiss Garde 360 Premiums were provided for, of which one is on the left and the other one on the right. The staircase and lift accesses are within a close-up range.

Make sure that free visibility of the motion detector is provided for in wet rooms. The detection applied here above the partition wall crosses is only applicable if the toilet cubicles are not entirely secluded by the partition walls (height of the partition walls up to 2 m max). In individual secluded cubicles, Swiss Garde 360 Plus or 180 Concealed can be used. Set the follow-up time at the motion detector to at least 5 – 10 mins, as over certain periods there is only little movement. The movements to be detected in this case are all within close range of the motion detector.

Staircases

Corridors and halls are transit places in which the operation of the light is often forgotten about. The saving potential is therefore great. Please note: Entries and exits and also lift and staircases accesses must be located within close range. For long corridors without doors on the sides a detection gap in between would do no harm. Front detection in case of direct approach reduces the reach by over 50 %. If ever possible, allow for the sensor to be shifted sideways to the walking direction. For larger installations we recommend the application of the short duration pulse function or the switching of several groups with max 4 motion detectors in parallel.

Use a Swiss Garde 360 Premium Concealed for 1b, c and 1d. These ceiling motion detectors can be installed concealed or exposed, and they are in this case combined with a Swiss Garde 180 Concealed for wall installation at a height of the manual control switch for 1a.

Lighting control in staircases is mostly effected via an external time relay. For optimum control of the time relay we recommend to use the short duration pulse function. Please note: The entries to the staircase must be within close range (within 5 m) of the detector. In case of several floors we recommend to switch in parallel max 2 floors with 4 motion detectors. In staircases, wall or ceiling detectors can be used. As there are numerous and quick movements, a concealed detector at the height of the pushbutton before the entry or exit, respectively, of the stairs will be sufficient in most cases. Due to the difference in height, ceiling motion detectors, such as the Swiss Garde 360 Premium, are suited for large staircases with mezzanines.

With the wall switch, you can keep as an option in special cases to switch the light on or off entirely with the manual control switch of the Swiss Garde 180 Concealed. The manual control switch of the Swiss Garde 180 Concealed can be locked and, according to requirements, be made to be operated by certain persons only.

Motion detector at the height of the manual control switch

Please note: In halls and corridors of over 12 m length we recommend to apply a motion detector at the beginning and at the end of the corridor. Such installation proves itself better than a motion detector in the middle, particularly if any doors lead into the corridor at the beginning and at the end. Use a Swiss Garde MZ 2000 above the door at the corridor beginning and end, or a Swiss Garde 360 Wall Installation Concealed for perfect elegance. In this, make sure that the motion detector is provided for in the middle above the door or, even better, at the opening side above the door, and never at the side of the door hinge!

As detection at the height of the manual control switch is basically weaker, we recommend to provide for an additional concealed detector every 8 m in a long corridor, as lateral detection is reduced every time to approx. 4 m in case of direct approach.

Set up different lighting groups with one connection in parallel, as often the light in parts of the warehouse is used not at all or only a little. With the new Swiss Garde MZ 5000 you can switch in parallel different lighting groups flexibly and thus achieve optimum saving of energy savings! (see p. 78)

In order to detect the small movements produced by sitting persons in schoolrooms, presence detectors are used exclusively. To achieve optimum energy saving, the Swiss Garde 360 Presence can be set to fully automatic. In this, the light must be operated via the On/Off manual switch as usual. The light will, however, be switched off if someone forgets to switch it off by hand.

The Swiss Garde 360 Presence as a ‘fully automatic machine’ switches the light on automatically in case there is not enough natural light available. The fully automatic machine can also be activated manually via the R-terminal with a make contact switch. After that, the set follow-up time at the presence detector expires and the light is switched off in case there is no more movement around. According to requirements, the Swiss Garde 360 Presence Mini or the Infra Garde 360 Presence (Exposed) can also be applied.

In small and not very clearly arranged warehouses we recommend an HF motion detector. It also watches ‘around the corner and switches the light on if free visibility is obstructed by many stored products. The interactivity between 2 Swiss Garde motion detectors allows wireless connection in parallel even across different fuse groups.

The Swiss Garde MZ 5000 can be extended with a few hand movements by means of the bidirectional function. Remove the cartridge at the back of the sensor head and insert in its place the bidirectional cartridge (with aerial).

To produce the interactivity, both MZ 5000s must be equipped with a bidi module. After connection of the motion detectors to the 230 V mains supply, press the programming keys of the bidi module applied. After that the programming time of 5 minutes will start, during which the two MZ 5000s can be coupled. For the coupling, each one of the two detectors requires a signal from its counterpart, which is done by the detector being switched on (the light being switched on). To this end, activate the respective detector by stepping into the detection area. Switching on the relay effects the bidi module applied sending its specific signal to the other detector, which also works as initialisation.

Different groups can be connected wirelessly in parallel via the interactivity, this across different fuse groups. In this, the connection in parallel is flexible and can be effected one-sidedly or two-sidedly! 4 Swiss Garde MZ 5000s with bidi module can be connected wirelessly in parallel. Each one of the 4 detectors can additionally be connected in parallel with further detectors in a conventional way.

One-sided connection in parallel: The first detector can switch on the second detector through onesided initialisation, but not the other way round.

4 channels are available for coupling, which allow you to link a maximum of 5 devices between themselves via radio.

Only coupled devices (with 64k possibilies of coded transmitters) can switch on a receiver. If equipped with the bidi module, two areas that are independent of the fuse groups, can (subsequently) be interconnected.

Two-sided interactivity: Connection in parallel in a conventional way; in case of movement within the detection area, the ‘coupled’ device, along with the directly connected lights, is activated as well! Activation is effected both ways.

One-sided initialisation If activation of both detectors has been carried out, both detectors will also be switched in parallel, that is, they switch each other on if a movement is detected. If required, a one-sided initialisation can also be effected, so that only one of the two motion detectors can switch on the other detector. To this end, activate only one of the detectors during the 5 minute programming time by stepping into the detection area, and make sure the second detector cannot send a signal to the first one. The first MZ 5000 can now switch one the second one automatically, if, however, a person steps into the detection area with the second MZ 5000, the first detector will not be switched off. Wireless and flexible connection in parallel The light in warehouses, workshops or garages can be controlled optimally with the flexible interactivity between 2 Swiss Garde MZ 5000s. Depending on circumstances, little frequented areas can be provided with separate lighting group to allow this to be switched on if required, while the light in the more frequented area is controlled by several MZ 5000s switched in parallel. In this, the connection in parallel is flexible and can be adjusted if the warehouse contents are rearranged. If later on all lights are to be switched on, the new combination can be set up in a few minutes.

(Un-) Installation of a bidi module Disconnect the detector from the mains before installation. Gently push the locking plate (e.g. with a screw driver) and pull out the cartridge from the detector downwards. Then insert the bidi module from below into the detector until it engages in the snap fit. After that your MZ 5000 Bidirectional is ready for programming. Press successively the programming key at the bidi module and the one at the control pad (or at another motion detector), then the bidirectional couple is in programming mode for 5 minutes.

As soon as the MZ 5000 with bidi module and the control pad have each received a signal from the counterpart, the couple is initialised. During these 5 minutes programming mode, press additionally e.g. the ‘Auto’ key on the control pad and activate the motion detector by stepping into the detection area.

By switching off the transmitting function of the bidi module, oneway communication is possible as well, e.g., first detector within the out-side area, second detector in the office. The light in the office is also switched on automatically if someone steps into the detection area outside. If the monitored area is stepped into in the office, only the light in the office will be switched on. Upon each command received by the CP, the detectors sends back an acknowledgement sign (indicated acoustically or optically on the CP).

Each detector can redirect the command of its motion detection to a maximum of 4 devices. A repeater function is, however, not possible!

Please note: ensure each time a distance of at least 2 m approximately between radio, transmitter and receiver units.

The maximum reach is 100 m in the fields. The reach is damped down depending on local circumstances (such as an interior, depending on brickwork or ceiling).

Activation of Electronic Control Gears, FL and PL Lights Electronic control gears, FL and PL lights generate high inrush currents which shorten the lives of the relays integrated within the motion detectors. For this reason Züblin applies a special high-performance relay in the Swiss Garde models which carries out many switchings in spite of high inrush currents. The relay which is certified as per EU standards, performs more than 40,000 switchings, if you follow our recommendations. Short duration pulse … Technology by Züblin The short duration pulse models by Züblin were specially developed to control larger lighting groups via an external time relay (staircase switch or time switch). These devices replace conventional illuminated buttons or can be freely combined with the same. The use of short duration pulse models has many advantages: The relay of the motion detector is being preserved. In rooms with many movements over longer periods, the relay of the motion detector is activated over many hours. In case of larger lightings (e.g. many fluorescent lights with high switch-on current) the heavy load on the relay can shorten its life. This is not the case with the short duration pulse function. Here, the relay is loaded only every 20 or 60 seconds during the short duration period of approx. 1 second, and the life of the relay is thus multiplicated. Retrofitting of well proven installations with a time relay (staircase switch) and illuminated buttons. In anterooms, corridors and staircases, the lighting control via time relay and pushbuttons has proved itself for many years. The combination of pushbuttons with short duration pulse motion detectors has proved itself in an outstanding manner. The switches can be connected in any order in parallel and can be connected to the same time relay (staircase switch, time switch). However, we recommend to connect in parallel only a maximum of 6 Swiss Garde short duration pulses. Continuous currents harm time relays and time switches. We therefore strongly recommend not to connect any motion detectors with long follow-up time to the time relay directly. Should this still be necessary, the switched phase of the motion detector should be connected at the output of the time switch! With the Swiss Garde and the adjustable pause time, larger lighting controls can be provided optimally through time switches or time relays: switching noises are reduced to a minimum and the life of the relay is increased to a maximum!

Installation at a height of 2.5 m Despite the high switching capacity of the relays used, we recommend to connect a relay or air gap switch upstream of inductive loads, energy-saving lamps and fluorescent lights, and to activate these via the short duration pulse function. This way you will increase the life of the relay by many years! 2,5 m

The mounting height of 2.5 m is optimal for a motion detector within the outside area. The metered values indicated were recorded at an ambient temperature of 20 °C against side approach.

Short duration pulse generator Conventional motion detectors can be connected to a time relay via a short duration pulse generator. Several standard motion detectors can be connected in parallel to a pulse generator. Recommendation We recommend to connect in parallel only a maximum of 3 – 4 motion detectors. From a technical point of view it is perfectly possible to switch in parallel up to 10 motion detectors or more. In this, however, parasitic couplings, such as high switch-on currents, interferences, etc, are summed up, and in case of malfunction of one or more motion detectors, trouble shooting becomes very time-consuming. In case of a small and clear switching, the cause is found out quickly.

1. The motion detector must be mounted to a fixed wall, as any movement of the motion detector itself has the same effect as a heat movement within the monitored area. 2. On determining the place and the mounting height, the distance from the street and neighbouring lots, etc., should be taken into account in order to avoid any unwanted parasitic couplings. (Reaches for trains/trucks up to 50 m!) 3. Installation sideways of the walking direction ensures the safest functon. In case of direct approach, the reach is partly reduced considerably (to 5 m). As infra-red rays cannot permeate firm objects, free visibility of the motion detector should be ensured. 4. All passive infra-red motion detectors react to rapid changes of the locally present temperature beams. For example, moving raindrops on the lens can deflect the temperature beams, disturb the local conditions and trigger a connection. All motion detectors should therefore be installed, if ever possible, with a protection against rain, wind and direct solar radiation on installation in order to prevent undesired connections. The casing of the motion detector is, however, sufficiently splash-proof to allow for the device to be mounted without protection against rain.

6. The reach can be influenced by rotating and pivoting the sensor part or through partial cover of the lens with the blind. If mains parallel inductances, such as relays, air gap switches, fluorescent lamps or transformers are switched, the application of an RC quenching circuit (item no 33260) is recommended in parallel with the consumer load. Parallel inductances can generate overvoltages on switch-off in the region of 3,000 – 4,000 V. 7. After installation the setting controllers must always point downwards, as otherwise the detection is directed upwards. Lateral detection can then no longer be carried out! 8. Motion detectors are not suited for use with burglary and holdup alarm systems, as the prescribed sabotage safety and a multiple pulse counter are missing. 9. Ceiling installation: For installation, for example, under projecting roofs or under balconies, motion detectors Professional LINE and Alarmtech are suitable. By simply rotating the sensor casing, the device can be prepared for ceiling installation. After installation the setting screws must again point downwards. Important: bear in mind a mounting height of max 6 m!

Control of a time relay via a pulse generator

With a pulse generator, it is possible to connect a standard motion detector to a time relay. In this, the desired phase and neutral conductor are connected to the pulse relay. In case of activation of the switched phase for the set time, the potential-free contact is closed for approx. 0.3 – 0.8 secs. After a pause time of approx. 50 secs, a further pulse is released until there is no person left within the detection area of the sensor. Standard motion detectors can be connected to a short duration pulse generator in parallel without any problems. If required, motion detectors with short duration pulse can also be connected to the output of the generator additionally.

5. Between the motion detector and the connected lighting, a minimum distance of 1.5 m must not be gone below. Lights within the sensor area could otherwise trigger the pulse for renewed switch-on after switch-off due to the change of heat. Emitters must not be directed straight towards the motion detector. Extraneous light can impair the functioning (e.g. twilight sensor).

Disturbance Sources Disturbance Sources, Causes and Trouble Shooting Several factors can impair the correct functioning of a motion detector, such as changes of temperature and reflexions within the detection area or the connection of inductive loads. Below are briefly listed the most common disturbances, their causes and applicable trouble shooting.

4. The light does not switch off. Causes: – inductive loads, interference – reflective surfaces, etc. – constant movement within the detection area – daytime operation (not possible within the outside area: sunlight!) Inductive loads:

1. The reach is too small or the switch-on of the light is too late, respectively. Main causes: – The sensor / detection area is directed downwards too steeply. – Front and direct approach towards the detector – Rain, fog or damp air – Reach controller set to minimum To remedy these disturbances, we recommend to check the detection area. Please bear in mind that a person’s head eradiates the most heat and should therefore be within the detection area. As the heat rises, the upper detection area should be situated at the height of the forehead or above! In case of front approach the installation place should be corrected. Installation in the middle above the door facilitates direct stepping up towards the detector. It is better to fasten the detector at 2 m sideways of the door! In damp air, such as in showers, the reach is shortened. Do bear this in mind in your planning. All Swiss Garde 360 ceiling detectors and all Busch-Wächters are provided with a reach controller. Set the reach to maximum within the interior area, provided there is no draught! 2. Variations of reach The main causes are fluctuations of temperature or direct approach. High outside temperatures and bad ‘conditions of visibility’ due to fog,rain or snow can temporarily shorten the reach. Excessive reaches occur if very hot heat sources, such as trucks, trains or buses, pass by at high speed. With these hot air twirls, reaches of up to 50 m can be generated! In such cases, incline the outdoor detector downwards to a sufficient extent. The automatic stabilisation of the reach of the Busch-Wächter reacts against the abovementioned effects, but for physical reasons it cannot guarantee 100 % values under al circumstances! 3. The light switches on and off for no reason. Causes: – light bulb within the detection area – draught, wind – mains variations, interferences – daytime operation within the outside area: not possible! Constant movements within the detection area, such as vehicles, winds moving bushes and trees, ventilators, light switching on and off, can cause the motion detector to switch on and off or to trigger it, respectively. Cover up the entire motion detector with a box (e.g. packing of the motion detector) and check whether the motion detector switches off entirely. In this, make sure that the box is placed correctly and is not held onto by hand! If the light switches off, you will be certain that there is an external disturbance source and that the motion detector works correctly. If not, the cause might be in the connected load. Redirect the motion detector again in case of external disturbance sources or cover the respective lens parts with clips or blinds. Please note: during daytime operation the sunlight can trigger a switch-on! Turn the controller to nighttime operation.

Fluorescent lights, energy-saving lamps, electronic control gears, transformers, etc., are inductive loads which generate inverse voltage and cause the motion detector to start the dead time again. Switch on an RC quenching circuit between switched phase and neutral conductor for the protection of the motion detector. Electronic control: In some motion detectors, resistance/condensers protect the integrated relay against interference voltage peaks of the connected load. Such protective circuit causes a small capacity standby current of below 1m A to flow if the relay is open (light switched off). If the motion detector is not loaded, a residual voltage can be measured at the switched phase. In case of several motion detectors connected in parallel, the currents will add up. In conventional loads no difficulties would arise from this, but in electronic loads, such as an electronic time relay with small control current, this can lead to permanent switch-on. To minimise the residual voltage, an RC quenching circuit can be installed in parallel to the load on each motion detector, the residual voltage, however, will basically not be eliminated completely. Such residual voltage can also be minimised or even eliminated by switching in parallel a resistance or small electric bulb (also applied as control lamp). For the reasons mentioned, we recommend for electronic relays and time switches, to only switch in parallel a maximum of 4 motion detectors or to use a mechanical relay. Reflective surfaces:

Mirrors, glass cabinets, light marble and sometimes even waterdrops on the lens can cause disturbances. IR radiations are reflected and trigger circuits. Cover up the respective lens parts. Heated floors can reduce the reach! 5. The light does not switch on Causes: – the lamp is not working – there is no mains voltage – twilight value is set too low (dark) – connected incorrectly Check the illuminant, the power supply and the twilight controller. Rotate the twilight controller to a very bright 1000 lux. Draught, wind: The gasket must be inserted for the 360° concealed models because of possible draught caused by ventilators. Please note: For inductive loads or time switches, switch in parallel only up to a maximum of 4 motion or presence detectors.

General Terms of Delivery and Payment of Züblin Elektro GmbH 1. Scope The following terms apply exclusively for all deliveries and services (hereafter called only ‘services’), including future ones, unless otherwise agreed in writing. The terms and conditions of our customers only apply as far we have agreed to these in writing. 2. Conclusion of Agreement Our offers are without engagement. Agreements only materialise following our written confirmation of order or delivery. Members of our staff, in particular, are bound to confirm in writing any verbal additional agreements or promises which would go beyond the content of the written agreement or would alter the present General Terms of Delivery and Payment to our disadvantage. The illustrations, drawings or details of colours, weight and measurement relating to our offer are only approximate values, unless explicitly specified as binding. DIN tolerances apply in case of complaints about DIN standardised products. 3. Prices Our prices apply on an ex works basis excluding packing and turnover tax as valid each time. 4. Payment Payments are to be made within 30 days from date of invoice strictly net into our designated account. Payments are deemed effected only to the extent to which we can freely access the monies at our bank. Cheques and drafts are accepted for payment only; bank service charges are for the customer’s account. These are payable immediately. In case of late payment, we will charge interest to the amount of 8 points above the base rate, but mininum 10 %. Retention of payments or offset against counterclaims is only admissible to the extent to which the counterclaims are undisputed or legally ascertained. 5. Passing of risk and short deliveries The risk is passed over to the customer as soon as we have handed over the product to the carrier or, should the dispatch be delayed through no fault of our own, notified he customer of the readiness for dispatch, even in case we have accepted the costs of further services, such as forwarding charges. 6. Delivery period The delivery period commences with the dispatch of the confirmation of order, but not before clarification of all details relating to the execution of order and technical issues and also receipt of an agreed down payment. The delivery period is deemed met if the product has left the factory by the expiring date or readiness for dispatch has been advised, should the dispatch be delayed through no fault of our own. Shipments are charged the cost of postage and packing costs to the amount of Euro 6.00. For express deliveries the standard postal rates apply. As regards late delivery, in case of simple negligence our liability is limited to a flat-rate compensaton to the amount of 0.5 % per complete week, but to no more than 5 % of the late delivered order value. A claim for damages in lieu of delivery in accordance with item 9 remains unaffected by this. Our delivery is subject to timely and correct supply to ourselves by our subcontractors. 7. Retention of title We retain title to the delivered product until receipt of all payments due and the irrevocable credit entry of all accepted cheques and drafts arising from the business connection with the customer. Should a current account with business partners be in place, retention of title refers to the recognised balance. The customer has the right to resell the product that is subject to retention of title, in an ordinary course of business; he will, however, assign to us in advance with immediate effect all claims to their full amount, which might arise from the resale or subsequent use on behalf of a customer, against the same or third parties. The customer has the right to collect the claims assigned to us, as long as he meets his payment obligations from the proceeds collected. If the customer no longer meets his payment obligations, we have the right to require the customer to advise us of the claims assigned and their debtors, to provide us with all necessary details to enable us to make collection, to hand over all respective documents and to advise his debtors of such assignment. Redemption of product that is subject to retention of title, does not mean withdrawal from the Agreement. In case we declare withdrawal, we will be entitled to our discretionary utilisation of said product. If the value of the securities exceeds our claims by more than 10 %, we will insofar release our securities at our own option on the customer’s request. 8. Liability for defects Any defects are to be advised to us in writing without delay, but not later than 8 days following receipt of the product, and latent defects not later than 3 days following their detection. If such time limits are exceeded, all claims and rights arising under our liability for defects will lapse. The limitation period is 12 months from delivery, unless we have breached our obligations intentionally or in a grossly negligent manner or have maliciously concealed the defect. In case of justified complaints we will deliver a substitute or rectify the product at our own option. The costs of supplementary performance arising from the fact that the purchased product was transferred upon delivery to a place other than the commercial premises of the customer, will not be borne. The violation of the rights of third parties is only deemed a defect if such industrial property rights exist within the European Economic Area (EEA). 9. General liability Any claims of whatever nature for damages against us are excluded if we, our legal representatives or auxiliary persons have caused the damage through simple negligence. Such exemption from liability does not apply in case of bodily harm or in taking over a contractual guarantee or in case of violation of essential contractual obligations which would jeopardise performance of the purpose of the agreement. In this, our liability is, however, limited to the scope of the guarantee or, in case of gross violation of essential contractual obligations, to contractually anticipated damages, respectively. Any claims under the Product Liability Act will remain unaffected. With the exeption of claims arising from liability for defects, under the Product Liability Act and for injury to life or limb or damage to health, claims for damages will lapse one year after the customer has become aware of the damage and his liability to pay damages or should have become aware of the same without gross negligence. 10. Place of performance, court of jurisdiction, applicable law Place of performance for all services arising under the delivery contracts is our registered office. For all disputes arising from the delivery contract, court of jurisdiction is the one in charge of our registered office. We have the right, however, to also take legal action at the court of jurisdiction covering the registered office of the customer. German law is applicable. The United Nations Convention on Contracts for the International Sale of Goods dated 11.04.1980 is excluded.
