Moki is an antiquated Navajo term for the Pueblo Indians, but it became a popular term and, in the nineteenth century, Pueblo Indians were referred to throughout the southwest as the Moki Indians. In regard to southwestern textiles, Moki refers to banded background textiles that are most often brown and indigo blue striped. According to Joe Ben Wheat in his book, Blanket Weaving in the Southwest, “Moki was a design introduced by the Spaniards probably by the 1630s. It can result only after you get indigo and the different natural colors of wool. The pattern consists of alternating blue and black, or brown, stripes, usually separated by white (bands). It was a standard Spanish pattern. Some of the Pueblos began to take it over—Rio Grande, Pueblos, Zunis, Lagunas, and Acoma.”

The Transcendental Painting Group (TPG) was founded on the principles of creating and promoting a pure abstract painting style imbued with spiritual intent. The group was formed in Taos, New Mexico in 1938 and in their original manifesto they stated the group was: “…composed of artists who are concerned with the development and presentation of various types of non-representational painting; painting that finds its source in the creative imagination and does not depend upon the objective approach.” Further, they stated that their purpose was "to carry painting beyond the appearance of the physical world, through new concepts of space, color, light and design, to imaginative realms that are idealistic and spiritual." Emil Bisttram was a co-founder of the group which also included Raymond Jonson , Agnes Pelton, Lawren Harris, Florence Miller Pierce, Horace Pierce, Robert Gribbroek, William Lumpkins, Dane Rudhyar, Stuart Walker, and Ed Garman. Man the Unknown was painted by Bisttram in 1961 and is an iconic example of his belief that the supreme experience comes at the moment of transcendence, which for an artist, occurs at the time of the original creation. 51 EMIL BISTTRAM (1895 – 1976) Man the Unknown, 1961 oil on canvas 48 x 32 in. The original plasters for these sculptures were bequeathed to Syracuse University by the estate of Laura Gardin Fraser, the widow of James Earle Fraser. Her Estate authorized limited castings to be made from these original plasters. James Earle Fraser worked as an assistant to Augustus Saint-Gaudens on the Sherman Monument (1892 - 1903), for the Grand Army Plaza in New York. His sculptural entries in major early twentieth century expositions, such as the 1904 Louisiana Purchase Exposition in St. Louis, the 1915 Panama-Pacific Exposition in San Francisco, and the 1939 New York World’s Fair, earned him medals, as well as public and critical acclaim. The design of the Indian head and buffalo nickel for the United States Treasury in 1912, the figure of Theodore Roosevelt on horseback for the entry to the American Museum of Natural History, and numerous other public sculptures, including the Department of the Treasury, the Commerce Building, the National Archives, and the Supreme Court, in Washington D.C., are among the sculptor’s most notable public commissions. The sculptor was also one of the organizers of and contributors to the famous, avant-garde International Exhibition of Modern Art, known as the Armory Show, of 1913. 83 JAMES EARLE FRASER (1876 – 1953) White Eagle, modeled 1919, cast 1967 bronze 14 ½ x 9 x 11 in. (45.72 x 60.33 cm.) signed, inscribed and dated lower left: J. S. Churchill - / Chartwell 1948. inscribed verso: W.S.C. / Chartwell 48 John George Spencer-Churchill (1909 –1992) was an English painter, sculptor, and stockbroker who was the nephew of Sir Winston Churchill. He sketched during the Spanish Civil War for Illustrated London News, and painted for Lady Churchill, his Uncle Winston’s wife, at Chartwell on many projects, doing murals and friezes that exist today. Winston Churchill purchased Chartwell, in Kent, in 1922, and it remained the family home for the rest of his life. He constructed a studio at Chartwell in the 1930s, laying the bricks himself. The house and its gardens became a frequent source of inspiration for his paintings. This intimate portrait by Spencer-Churchill of his Uncle at his most favored pastime in this setting recalls the tranquility the former Prime Minister sought and found in his art, and has remained in private family hands since first painted in 1948. Winston famously declared, “When I get to heaven I mean to spend a considerable portion of my first million years in painting, and so get to the bottom of the subject...” Provenance: The artist By descent in the family to present owner $3,500 – $5,500

SESSION II

Charles Loloma was an artist of astonishing creative energy, who found fame as a jeweler, ceramist, painter, and poet. His bold, innovative designs departed dramatically from Hopi cultural beliefs yet he was intensely traditional and served as a religious leader in his native community of Hotevilla. He was a renowned instructor and teacher, whose most notable pupils include Eveli Sabatie, Sherian Hohongva, and Verma Nequatewa. He was also a passionate collector whose brilliant eye extended to the work of his peers as well as his talented students. Starting in the 1970s Charles began buying Manfred’s dolls, and Georgia continued the tradition leading to the remarkable collection presented here. Charles’ fascination with and admiration for Susunkewa’s work is evident in the drawings he made of the katsinam, also presented here for the first time alongside the dolls.

Session II Loloma Katsina Collection (Lots 95-199) Saturday, June 25 10:00 AM MDT

KATSINA CARVINGS BY MANFRED SUSUNKEWA FROM THE GEORGIA AND CHARLES LOLOMA COLLECTION BY BARRY WALSH This auction from the Santa Fe Art Auction features a remarkable collection of 87 Hopi katsina dolls by master carver, Manfred Susunkewa. They come with impressive provenance: the Georgia and Charles Loloma collection. Manfred has been one of the most influential artists in the history of Hopi katsina art. He has long been acknowledged as the initiator of the return to “traditional style katsina carving,” which he began in the 1970s. Manfred was born in 1940. Into his mother’s Spider and Bear Strap Clan and his father’s Sand Clan. In 1961 Manfred won a prestigious Rockefeller scholarship to attend the “Southwest Indian Art Project” at the University of Arizona. He did so well in this program that he was invited to participate for three consecutive summers (1961-1963). His experiences at the U. of Arizona led to his involvement at the soon-to-be launched Institute of American Indian Arts (IAIA) in Santa Fe. He was invited to participate in its development (as a student) by innovative artists, Charles Loloma and Lloyd Kiva New. Manfred had known Charles since childhood because Charles was married to his aunt, Otellie. He noted that as a child he and Charles would plant corn together on the reservation and Manfred would assist Charles in making pottery. While Manfred was clearly gifted as a painter, jeweler, and textile artist, eventually he found his real mission in returning to paint and wood. He is the originator of the “old style” or “traditional katsina movement.” He told me that he started making dolls in his minimalist, provocative way “as a protest.” He said he “wasn’t the first to make katsinam in this way, but the style had disappeared.” He explained that what he began in the 1970s “was a revision.” He said the real katsina carvings were “being forgotten.” Referring to the elaborate action and ultra-realistic style dolls that were all the rage with collectors by the 1970s, Manfred said the dolls “were becoming too pretty.” He said his “revision or return was designed to recapture the spirit of the carvings in relation to the Spirit Beings.” He elaborated, “I took some things from the past and made them contemporary.” This sale features broadly representative examples of Manfred’s work and reflects his prodigious output. There are many katsinam that have become signature representations of Manfred’s art. These include: a Matyaw or Handprint (Lot 170), an Ewtoto or Katsina Father (Lot 118), an exceptional Angwusnasomtaqa or Crow Mother (Lot 145), a male Kóonin or Supai (Lot 102), two Sösööpas or Crickets (Lots 125, 126), and an eerie and utterly distinctive Maasaw or Death Spirit (Lot 133). The highlights of this exceptional group are several large and creative masterpieces by Manfred. These include: a 17 ¾” Aholi or Katsina Lieutenant (Lot 95), a 17” Yöngö or Prickly Pear Cactus (Lot 140), a 15” Wuyaktaywa or Broadface (Lot 108), a 22 ¾” Hemis or Home Dance katsina (largest in the auction, Lot 128), and perhaps the two most striking and innovative figures, a 19 ¾” Palhikwmana or Water Drinking Maiden (Lot 123), and a 17 ¼” Sa’lako done in a 19th Century style (Lot 139). This auction truly offers a thorough selection of Manfred’s exceptional katsina oeuvre. Manfred’s artistic and spiritual decision to carve in the old style has made him successful in the art world. Over the past 40 years he has received much recognition for his work. His katsina carvings have become highly collectible art objects. His work is in the permanent collection of the Heard Museum, Museum of Northern Arizona, Haffenreffer Museum, Arizona State Museum, Denver Art Museum, etc. He has won many prizes at diverse Indian markets, especially in Santa Fe. Perhaps his greatest honor is that he was designated an “Arizona Living Treasure” in 2002.

SESSION III

Session III Loloma: The Artist (Lots 200-327) Saturday, June 25 1:00 PM MDT

Hailing from Hotevilla on the Hopi Reservation Third Mesa, Charles Loloma was born in 1921, the oldest of five children. His mother, Rachel was badger clan and that influenced his jewelry making later in his career. Both of Charles’ parents were accomplished artists—his father Rex was known for his weaving and Rachel made baskets in an ancient style associated with their Third Mesa home. Such was Loloma’s early talent that he was only seventeen when legendary Hopi artist Fred Kabootie asked him to work as an assistant on a set of murals based on the Awatovi site on the Hopi Reservation for the Museum of Modern Art in New York City. Loloma served in the US Army from 1942 to 1945, and through the GI Bill went on to Alfred University in New York to study ceramics. A fellowship from the Whitney Foundation allowed him to continue research in ceramics on the Hopi Reservation from 1949-1951. In 1954, Loloma and his first wife, Otellie Pasiyave opened a ceramics shop in Scottsdale, becoming the first tenants of the Kiva Craft Center founded by Lloyd Kiva New. While Loloma first met New at the Phoenix Indian School in 1938, this friendship would last for the duration of Loloma’s life. In 1962 when New became the Director of the newly formed Institute of American Indian Arts in Santa Fe, he invited Charles to become one of the school’s first instructors, appointing him Director of the Plastic Arts Department. It was in the mid-1950s when Charles would first turn his creative talents to jewelry, and this would gradually take over all his art output. In his introduction to the exhibition, Loloma: A Retrospective View held at The Heard Museum in 1978-79, Edward Jacobson wrote of the artist, “His experiments with form, material and color literally revolutionized the public concept of Indian jewelry. He was unfettered by a strictly traditional approach and developed a unique concept of design that combines elements of his Hopi background with a less tangible, contemporary sense of aesthetics.” A key moment in Loloma’s career came in 1963 when he traveled to Paris and was introduced to the European Fashion scene. His jewelry was worn in numerous fashion shows and private exhibitions and Loloma used the trip to conceptualize some new and innovative designs for his jewelry. It was in Paris at this time that Charles first exhibited his famous, single long earring. By 1966, Charles was able to work full-time on his jewelry—all from a new home and studio near his beloved Hotevilla. He had a variety of solo exhibitions for his jewelry throughout the 1960s and 70s, notably at Tom Bahti’s shop in Tucson. By the late 1970s, Loloma was one of the most popular and influential Native artists on the market, exhibiting throughout the United States and broadly traveling the world. At one show in Denver, in 1979, he met Georgia Voisard. Voisard had a master’s degree in secondary art education and was studying southwestern Native American jewelry through a doctoral program at the University of Northern Colorado in Greeley. According to Loloma, Beauty is his Name, the catalogue for the 2005 Exhibition at the Wheelwright Museum, “Charles soon insisted that Georgia moved to Hotevilla to become his partner and manager. In January 1980 she abandoned her studies and teaching career and gave up a new home to join him; several years later they were married. With Georgia’s encouragement, Charles began investing in a broad range of the finest materials available, selecting the highest quality turquoise, large pieces of the best coral, and minerals from Russia, South Africa, and the Middle East. Loloma’s designs of the 1980s represent some of his boldest and most elaborate compositions, involving bigger stones and exhibiting strong sculptural qualities.” Following an accident late in 1986 however, Loloma’s health had steadily deteriorated, and in 1988 the Loloma studio closed. Jewelry of the Southwest: Pueblo Tradition and Innovation, in part a celebration of the jewelry of Charles Loloma and Charles Lovato, was presented at the Wheelwright Museum from May to September 1991. It was an exhibit that Charles was destined not to see, for he died in Phoenix on June 9, a few weeks after the show opened. In an undated, handwritten note that Georgia kept among his things, Charles wrote, “It has just been lately, that the American people are beginning to be aware about an aesthetic facet of Indian life. My feeling is that for me this direction has a more secure impact on my life. It is so rewarding to express what I really know best, which is the depth of the Hopi Way. It certainly expresses the desire of happiness, that it provides strength, and the security of the life of our being on Earth.”

Eveli Sabatie was one of Loloma’s most famous apprentices. She lived and worked in Hopi with Charles between 1968 – 1972. Born and raised in Algeria, she moved to San Francisco in 1968, from where she was invited to visit Kykotsmovi. She later wrote, “At the very instant I touched the Hopi soil and got a glimpse into its ceremonial life my searching stopped: this was the authenticity of the human heart which I had been looking for. I longed for that way of life.” She soon met Charles there who offered to teach her how to make jewelry. She credited him: “My teacher Loloma had the talent and skills to unlock my creativity and help me deliver all the treasures I had amassed in this already long journey. In his presence and in the midst of Hopi songs and dances, a door was swung open through which thousands of pieces were about to gush out.”

SESSION IV

Session IV Loloma: The Collectors (Lots 328-408) Saturday, June 25 3:30 PM MDT

At the time of Charles Loloma’s memorial, N. Scott Momaday wrote, “Charles Loloma was a Hopi man. The Sacred landscape of his life and death is the ancient world of Hopi; his life was of its life, his spirit of its spirit. From that world he came, and to it he returned. From his first breath to his last, he was true to it. He was a definition of the word, Native. And yet, as much as any man of his time, he was a citizen of the world. In his art he achieved universal expression. The vision that informed his work is, and will remain, beyond our understanding… By any name, it is inspiration raised to the highest level; it has its being in terms of wonder and delight and the deepest reverence for the essentially beautiful. Beyond other men, Charles Loloma perceived beauty in the earth, in the water, and in the sky. And with great precision and boundless imagination, he reflected it truly in the nearly perfect things that came from his hands…..” Over the course of their lifetime, Charles and Georgia together amassed a collection of more than 1500 objects, ranging from fine works by his long-time respected peers and students alike, including Fritz Scholder, Lloyd Kiva New, Kevin Red Star, David Bradley, Shonto Begay, and Allan Houser, to early works by Roxanne Swentzell and Rose Simpson, Diego Romero, Virgil Ortiz and Anita Fields, as well as examples of many of the great, historic Native potters, weavers, and of course jewelers, both contemporary and classic. His inimitable eye for color, design, and modernity was enthralled by the European scene he first encountered in the early 1960s, and he went on to travel the world, frequenting Asia in particular. Notable in their home were exquisite examples of ‘finds’ along these travels including tonal sculptures by Harry Bertoia, turned wood bowls by Edward Moulthrop, which held places adjacent to fanciful folk art, baskets, wood carvings, retablos and santos – including a remarkable group made entirely of found computer circuit boards. Their capacity for discovery and aesthetic pleasure never dimmed. This final session of the sale features a select few of the highlights from their collection. Upcoming Santa Fe Art Auction sales in July (New Mexico Now: Spanish Colonial to Spanish Market), August (American Indian Arts), and September (Contemporary Art, Design + Photography), 2022 as well as March, 2023 (Prints + Works on Paper) will all feature further selections from Charles’ and Georgia’s life journey through beauty.

A gifted polymath, Edward Moulthrop was both successful modernist architect as well as a pioneer in the craft of modern American wood turning. He had a sensual feel for his materials and a "sixth sense" for the beauty hidden in ordinary chunks of wood. In 1976 he gave up architecture to devote himself to wood turning. Moulthrop made many of his own tools, and developed polishes and preservatives to enhance the wood. His bowls can be found at the Metropolitan Museum of Art and the Museum of Modern Art in NYC, as well as in museums across the country and around the world.

$20,000 – $30,000

In 1960, Harry Bertoia began the exploration of tonal sculptures. Many metals were used for the rods, the most common being beryllium copper known for its wide range of color variations and rich tones. Some rods are capped with cylinders or drops of metal, resembling cattails, which, by their weight, accentuate the swaying of the tonal rods creating deep resonant tones. Harry and his brother Oreste both loved music and spent endless hours experimenting and finding new sounds to incorporate into Sonambient, the auditory and visual environment created by the tonals.

TERMS & CONDITIONS OF SALE The following Terms and Conditions of Sale are the Santa Fe Art Auction Limited Co.’s (“Santa Fe Art Auction”) and its agents’ and consignors’ entire agreement with the prospective bidders, bidders and buyers relative to the lots listed in this catalogue. The lots will be offered by the Santa Fe Art Auction as agent for the consignors, unless the catalogue indicates otherwise. 1. The Santa Fe Art Auction operates as an agent of the seller only. It is not responsible in the event any buyer or seller at the auction fails to live up to their respective agreements, including failure of the seller to deliver any property to buyers. The Santa Fe Art Auction assumes no risk, liability, or responsibility beyond the limited warranty contained herein. (a) All property is sold “AS IS.” There are no representations or warranties that extend beyond these Terms and Conditions of Sale. All works shall be available for examination prior to the sale. The Santa Fe Art Auction, and its agents and consignors, make no representations or warranties as to merchantability, fitness for a particular purpose, correctness of the catalogue or description, including, but not limited to, the authenticity, the physical condition, size, quality, rarity, importance, medium, provenance, dates, exhibitions, literary or historical relevance of any property, and, no statement anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere shall be deemed such a warranty, representation or assumption of liability. Nor are there any representations and warranties, express or implied, as to whether the purchaser acquires any copyrights, including, but not limited to, any reproduction rights in any property. Contents of this catalogue are subject to change or supplementation before or during the sale, including the sale of any lot. 2. Prospective bidders should inspect the lots before bidding to determine condition, size and whether or not the lot has been repaired or restored and to investigate all other matters relating to the lot that is of material importance to the prospective bidder. 3. A buyer’s premium will be added to the successful bid price and is payable by the purchaser as part of the total purchase price. If paying by cash or check, the purchase price will be the sum of the final bid price plus a buyer’s premium of 22% of the final bid price of each lot up to and including $1,000,000 and 12% of the excess of the final bid price above $1,000,000, plus any applicable sales tax, shipping and handling charges. The buyer’s premium is calculated separately for each lot. If paying by credit card, the purchase price will be the sum of the final bid price plus a buyer’s premium of 25% of the final bid price for each lot up to and including $1,000,000, and 15% of the excess of the final bid price above $1,000,000, plus any applicable sales tax, shipping and handling charges. Successful Online bidders with LiveAuctioneers.com or Bidsquare.com will be subject to a 25% buyer’s premium of the final bid price of each lot up to and including $1,000,000 and 15% of the excess of the final bid price above $1,000,000, plus any applicable sales tax, shipping and handling charges. 4. Unless exempted by law, the Buyer will be required to pay all applicable state and local sales, gross receipts, and compensation tax. Proof of exemption in the form of a current Non-Taxable Transaction Certificate must be provided at registration. In the event of deliveries outside the state, it is the Purchaser’s responsibility to pay any applicable compensating use tax of another state on the total purchase price. • Why Santa Fe Art Auction Collects Sales Tax: New Mexico requires a seller of goods to register with the New Mexico Department of Taxation and Revenue and collect and remit sales tax if the seller maintains a presence within the state. More specifically, tax laws require an auction house, like Santa Fe Art Auction, with a presence in New Mexico, to register as a sales tax collector, and remit sales tax collected to the state. Unless exempted, New Mexico sales tax is charged on the hammer price, buyer’s premium and any other applicable charges on any property picked up or delivered in New Mexico, regardless of the state or country in which the purchaser resides or does business. • Since the 2018 South Dakota v. Wayfair, Inc. ruling, most US states have implemented legislation requiring remote sellers to collect sales tax when the total dollar value of purchases sent to that state exceeds a set threshold, known as an economic nexus. Each state sets its own threshold or nexus. Like all other remote sellers, Santa Fe Art Auction is now required to collect Sales/Use Tax from buyers in any state when the total dollar value of purchases sent to that state creates a nexus. When this occurs, you will see sales tax included on your invoice. The sales tax rate is determined by the state, county, and city where purchases are shipped. As of June 1, 2022, SFAA has met the nexus in the following states: Arizona, California, Colorado, Florida, Illinois, Massachusetts, Missouri, New York, Oklahoma, Pennsylvania, Texas, Utah, Washington, Wyoming. However, any purchases made in person and/or picked up in person, are subject to applicable New Mexico sales tax instead. • Certain Exemptions: New Mexico allows for specified exemptions to its sales tax. For example, a registered re-seller such as a registered art dealer may purchase without incurring a tax liability, and Santa Fe Art Auction is not required to collect sales tax from such re-seller. As sales tax laws vary from state to state, Santa Fe Art Auction recommends that clients with questions regarding the application of sales or use taxes to property purchased at auction seek tax advice from their local tax advisors. 5. The Santa Fe Art Auction reserves the right to withdraw any lot before or during the sale and shall have no liability whatsoever for such withdrawal. 6. Except as may be announced by the auctioneer, all bids are per lot, as numbered in the catalogue. 7. The Santa Fe Art Auction reserves the right to reject any bid. The highest bidder acknowledged by the auctioneer will be the Buyer, subject to reserves. In the event of any dispute between bidders, or in the event of doubt as to the validity of any bid, the auctioneer will have the final discretion to determine the successful bidder, cancel the sale, or reoffer and resell the lot in dispute. If any dispute arises after the sale, the Santa Fe Art Auction’s sale record shall be final and conclusive. The Santa Fe Art Auction, in its discretion, may execute orders or absentee bids as a convenience to clients who are not present at the auction; however, the Santa Fe Art Auction is not responsible for any errors or omissions in connection therewith. 8. If the auctioneer, in his or her discretion, determines that any bid is below the reserve of the lot, he or she may reject the same and withdraw the lot from sale, and, if having acknowledged an opening or other bid, the auctioneer decides that any advance thereafter is insufficient, he or she may reject the advance. 9. On the fall of the auctioneer’s gavel, the highest bidder acknowledged by the auctioneer assumes full risk and responsibility for the offered lot, subject to all of the Terms and Conditions of Sale set forth herein, and is immediately obligated to pay the full purchase price. All sales are final and there shall be no exchanges or returns. Payment shall be made by cash, check or wire transfer. As set forth in paragraph 3, above, for an additional percentage Santa Fe Art Auction will also accept credit cards as a form of payment. (Visa and MasterCard only).

In addition to other remedies available to Santa Fe Art Auction by law, we reserve the right to impose, from the date of sale, a late charge of 1.5% per month (18% per annum) of the total purchase price, if payment is not made in accordance with the conditions set forth herein. (a) All lots must be removed by the Buyer at his or her expense not later than ten (10) business days following the sale, and, if it is not so removed, (i) a handling charge of 1% of the total purchase price per month, or a portion thereof from the tenth day after the sale (until its removal) will be payable to us by the Buyer, with a minimum of 5% of the total purchase price due for any lot not so removed within 60 days after the sale, and (ii) Santa Fe Art Auction may send the purchased lot to a public warehouse for the account of and at the risk and expense of the Buyer. (b) If any applicable conditions herein are not complied with by the Buyer, the Buyer will be in default, and in addition to any and all other remedies available to the Santa Fe Art Auction and its agents and consignors by law, including, without limitation, the right to hold the Buyer liable for the total purchase price, together with all fees, charges and expenses set forth in these Terms and Conditions of Sale, the Santa Fe Art Auction, at its sole option, may (i) cancel the sale of that, or any other lot or lots sold to the defaulting Buyer, or (ii) resell the purchased lot or lots, whether at auction or by private sale, or (iii) effect any combination thereof. The Buyer will be liable for any deficiency, any and all costs, handling charges, late charges, expenses and commissions of both sales, legal fees and expenses, collection fees and incidental damages. The Santa Fe Art Auction and its agents and consignors shall have all of the rights accorded to a secured party under the New Mexico Uniform Commercial Code. The Buyer of each lot agrees that each lot is unique and that Santa Fe Art Auction, in its sole discretion, shall not be required to sell or otherwise seek to mitigate damages should such Buyer fail to pay the total purchase price. Payment will not be deemed to have been made in full until the Santa Fe Art Auction shall have collected good funds. The Santa Fe Art Auction reserves the right to hold all purchases pending collection of the total purchase price, together with all additional fees, charges and expenses incurred pursuant to these Terms and Conditions of Sale. 10. All lots (unless otherwise indicated by the letters “nr”) are subject to a reserve, which is the confidential minimum price acceptable to the consignor. The Santa Fe Art Auction, or its agents or consignors, may implement such reserve by opening the bidding or they or either of them may bid up to the amount of the reserve by placing successive or consecutive bids for a lot or may bid in response to other bidders. In instances where the Santa Fe Art Auction has an interest in the lot, it may bid up to the reserve to protect such interest. 11. Santa Fe Art Auction is the owner of images of each lot offered for sale and may use such images for its own archival purposes, as well as for advertising and publicity in connection with this or future sales by the Santa Fe Art Auction. 12. These Terms and Conditions of Sale, together with the parties’ respective rights and obligations hereunder, shall be governed and construed and enforced in accordance with the laws of the State of New Mexico, without regard to New Mexico’s rules concerning conflicts of laws. 13. Prospective bidders, bidders and Buyers agree that, in the event of any controversy or claim arising out of or relating to a sale of any lot, the party asserting such controversy or claim shall provide written notice thereof to the other party; that any such controversy or claim not settled within fourteen (14) days of delivery of notice by the other party, including, without limitation, any controversy or claim arising from, or relating to, the sale of any lot or any of these Terms and Conditions of Sale, including the terms of this paragraph, the sole and exclusive means for resolving the dispute shall be by binding arbitration in Santa Fe, New Mexico. Said arbitration shall be confidential and shall be pursuant to the New Mexico Uniform Arbitration Act, shall be conducted before a single arbitrator, and shall otherwise be guided by the then extant New Mexico Rules of Arbitration. This Agreement is deemed made in Santa Fe, New Mexico, and is subject to the internal substantive law of the State of New Mexico without regard to conflicts of laws. The award of the arbitrator shall be final, and may be entered into any court having jurisdiction thereof. Each party shall bear that party’s own costs of arbitration and attorney’s fees. 14. The Santa Fe Art Auction is pleased to present to art purchasers shipping options which are explained in the shipping form enclosed in this catalogue. If you misplace this form, call or send an email and another form will be provided. 15. Results are posted on the Santa Fe Art Auction web site and, upon request, may be sent to Buyers, catalogue subscribers, absentee and phone bidders, and other registered bidders. 16. If any part of these Terms and Conditions is held invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. 17. These Terms and Conditions are not assignable by any buyer without the prior written consent of the Santa Fe Art Auction. However, these Terms and Conditions are binding on the buyer’s successors, assigns and representatives. 18. No act, omission or delay by the Santa Fe Art Auction shall be deemed a waiver of its rights and remedies under these Terms and Conditions. 19. The Santa Fe Art Auction shall use reasonable efforts to contact prospective buyers who have made prior arrangements to place telephone bids in order for these buyers to participate in the auction. The Santa Fe Art Auction shall not be liable for its failure to contact said bidders or for any errors or omissions made in connection with telephone bids since telephone bids are offered as a free service that is undertaken subject to the other commitments of Santa Fe Art Auction during the sale. 20. Santa Fe Art Auction shall use reasonable efforts to execute online bids in order for online buyers to participate in the auction. Online bidding is provided as an alternative bidding service and should not be considered a replacement for bidding in the room. Santa Fe Art Auction encourages its buyers to weigh the advantages and limitations of live online bidding when deciding whether to bid in the room or online. Santa Fe Art Auction shall not be liable for any errors or omissions made in connection with online bids or the online bidding process. Although Santa Fe Art Auction will do everything in its power to assure all online bids are recognized, Santa Fe Art Auction has no way of guaranteeing that the internet and the online bidding process will be free from technical malfunctions. In the event of a tie between an online bid and a “room” bid, the “room” bid generally will take precedence. “Room” bids include those bids taken from the live auction room(s), telephones, absentee bidders, or bids made by the auctioneer to protect the reserve. Santa Fe Art Auction will not be responsible for errors or failures to execute bids placed on the internet, including, without limitation, errors or failures caused by (i) a loss of connection on Santa Fe Art Auction’s or on the Buyer’s end, (ii) a breakdown or problems with the online bidding software, and/or (iii) a breakdown or problems with a Buyer’s internet connection, computer or system. Santa Fe Art Auction does not accept liability for failing to execute an online internet bid or for errors or omissions in connection with this activity. SANTA FE ART AUCTION
