Hey Sis, I just seen one of your paintings on a poster down town and on some pamphlets.
Where at? I‛ve never let anybody use my paintings like that.
At that Health Centre, it sounds like infringement* of your copyright to me.
I always put the Š with my name and year that I did it to let people know I painted the artwork and own the copyright.
* Infringement means doing things without permission
Yeah, what are you going to do?
I‛ll go and have a look. I‛ll ask the Health Centre about it and ask them to give the posters and pamphlets to me.
LATER ... How did you go? What did they say?
They reckon they can use the painting, but I only gave it to them for display not for anything else without my permission.
So you fair dinkum, didn‛t let them use it, in return for any moolah.
Sis, I didn‛t get no moolah, I was clear that I left it there on loan for display only.
This happened to my brother, his painting ended up on a greeting card. He called up the Arts Law Centre of Australia for some free legal advice on their toll free number. And what did they say?
That Jimbo owned copyright as he painted it, he has Š on it for his life plus 70 years after, if he sells the original painting, he still owns copyright. Arts Law told him that if people want to use it for anything they have to get his permission first.
Solid, that‛s important that permission.
The Arts Law Centre helps out all us Indigenous artists, and they can turn you in the right direction if you need further help. Sweet, I don‛t want this to happen again to me or other Indigenous artists.
Give them a call and see what free legal advice and help they can give you.
I will. Thanks for that deadly info. I‛m not getting ripped off by anybody again.
