Workers at the company have claimed that Workhuman has committed an offence by issuing some staff with notices of redundancy before the end of a 30-day consultation period it is obliged under Irish legislation to conduct as part of 60 job cuts it is seeking to make. They are planning to write to the WRC next week and have written to Simon Coveney, the Minister for Enterprise, asking him to intervene and “pause” the 30-day consultation period to ascertain whether Workhuman has violated the collective redundancy process. Workhuman was founded by Dublin entrepreneur Eric Mosley in 1999 as Globoforce, and achieved unicorn status in 2020 when it was valued at over $1 billion after Intermediate Capital Group took a 10 per cent stake. It employs around 1,300 staff and has offices in Dublin and Framingham, Massachusetts. The company operates employee reward and incentive schemes on behalf of some of the world’s biggest companies, including Cisco, Eli Lilly and BP, and says its software can help clients celebrate their staff and improve the culture of their workplaces. In March, however, Workhuman announced plans to lay off 10 per cent of its global workforce, of which around 600 people are employed at its Dublin offices. Some 128 staff were informed their roles were ‘at risk’, and up to 60 people will lose their jobs. Internal documents show that relations between emthe 30-day consultation process. Workers have claimed the severance package offered by the firm “trails far behind other tech companies” and taken issue with its refusal to contribute to the legal fees of those being laid off. They also say the company has breached its statutory obligations relating to the llective redundancies. On April 17, during the 30-day consultation process, Conor Mahony, Workhuman’s financial controller, inadvertently” emailed some staff, who had been told their roles were at risk, with information relating to severance packages. Under the Protection of Employment Act 1977, it is an offence for an employer to issue notice of redundancy to any employees during the 30-day period of consultation with employee representatives. The employee representatives subsequently wrote in an email to the company that they believed Mahony’s correspondence representcess. They told the company they would be complaining it to the WRC over the issue. Responding in an email, Jim O’Dea, Workhuman’s vice president for operations, disputed the representatives’ interpretation of events. O’Dea said Mahony’s email had been sent “inadvertently” to 11 staff and was only a draft calculation of the severance package that would be paid to impacted staff. “Yesterday evening as Conor was preparing enhanced severance payment calculations for employees who are at risk of redundancy, he inadvertently t email messages to 11 employees containing draft severance information and calculations,” O’Dea wrote. “These emails were generated accidentally by Conor using the mail-merge function and were recalled by him immediately. We contacted the 11 employees and told them that they should ignore the email which was sent in error,” O’Dea said. Workhuman declined to comment on the situation, BY KILLIAN WOODS A “legal problem” encountered by An Bord Pleanála has placed the planning permissions of up to 27,000 homes, already delayed, in jeopardy, the Business Post can reveal. The agency has admitted that it may have no option but to refuse permissions on large housing developments which are already delayed in the planning system for nearly a year. Oonagh Buckley, the interim chairperson of An Bord Pleanála, has said due to the changes in recent development plans published by local authorities, there is “a legal problem as to whether we're going to be able to grant” permission for up to 77 large housing projects. She said due to planning law, there is no scope for developers to tweak their applications to make them compliant with changes to development plans. As a result, An Bord Pleanála will be forced to outright refuse permission. “There could well be circumstances where we have no choice but to refuse permission in those circumstances legally,” Buckley said. The legal issue will force many developers already waiting on planning applications to be approved for up to 12 months to reapply and face further delays. One project that could be refused on a technicality is an application made by property developer Gerard Gannon to build 473 houses and 2,054 apartments in Belcamp, Dublin 17. Gannon’s firm lodged that application in May 2022 and a decision on the project has been overdue from An Bord Pleanála since August 2022. A flagship project by the Land Development Agency (LDA), a state-backed body tasked with building affordable homes, could also be impacted. Its application for 977 homes on the Central Mental Hospital site in Dundrum is unprocessed by An Bord Pleanála. The LDA was meant to get a decision from An Bord Pleanála in July 2022. An Bord Pleanála has already been forced to pay out more than €1 million in fines to developers because it did not meet the deadlines to make decisions on these cases. The cases affected by the legal issue are all Strategic Housing Development (SHD) applications, a fast-track system created in 2016 to allow developers to bypass councils and apply directly to An Bord Pleanála for approval for large housing projects. In2021,MinisterforHousing Darragh O’Brien committed to phasing out the SHD process, but developers still had until the end of 2022 to make an application. O’Brien has created the Large Residential Development (LRD) scheme to replace the SHD system, with developers now required to apply to councils once again for large housing projects. A spokeswoman for An Bord Pleanála said: “It is not possible at this stage to determine how many such applications will be affected by a possible legal difficulty. That will depend on an individual analysis of each SHD application relative to the revised development plan and will be subject to legal advice.” Buckley, who raised the legal issue at the Irish Planning Institute conference last week, said An Bord Pleanála still has 27,000 units associated with SHD cases left to process and a further 1,300 students units. She added the planning board will prioritise making decisions on LRD applications and not SHD cases. She told planners at the conference, “if you're talking to your employers in the private sector and they have an SHD sitting with us … you might want to think about whether that's something you want to proceed with anymore”. An Bord Pleanála has estimated it has a year's worth of cases in its backlog. The backlog emerged last year after several of its high-ranking board members who adjudicated on planning cases left their positions and replacements have only recently been put in place. Sebastian Barnes, chair of the Irish Fiscal Advisory Council (Ifac), the state’s budgetary watchdog, warned the recent boom in corporate tax receipts could drive further inflation in the economy, with “two much money chasing too few resources”. “We already have a tight labour market in Ireland. Inflation is already fairly high. Spending this money in that context would basically risk overheating our economy, distorting it by driving higher inflation, even higher house prices and rental costs,” Barnes told the Business Post. “So, we have to be very careful about putting this money into the economy, because it’s likely it would unbalance our economy,” he added. The warning comes after the Department of Finance published new forecasts last week, which estimated that corporate tax receipts will hit a record €27 billion by 2026. My name is Luba Healy, I am originally from Ukraine, from a town called Gaivoron (Haivoron), at 17 years old I left to study in Belay Tserkov, where I got my degree as a Veterinarian Doctor, after working as a vet in Ukraine, I decided to come to Ireland to improve my English, I have lived in Ireland now for the past 22 years, I have met my husband here, we now have a beautiful family of 5 children, and the rest is history as they say. I have made two humanitarian trips to Ukraine since war started, one to rescue my mother and grandmother and others and a second trip bringing vehicles packed with humanitarian aid to donate to those desperate for our help. The people who can’t leave for various reasons are now mainly the women, children, old people and people unable or unfit for military duty, these are the silent suffering majority that really need our help. I have set up this iDonate page and have called it “Love Ukraine Benefit Alliance”. My name translated means love, and really that is all we can do for the people of Ukraine, given the devastating and heart-breaking situation that my country of birth finds itself in.
