Honouring Innovative Legal Practitioners Charity Partners Peter McVerry Trust was founded by Fr Peter McVerry in 1983 in response to the growing problem of youth homelessness in Dublin. The charity is committed to reducing homelessness and the harm caused by drug misuse and social disadvantage. Peter McVerry Trust provides low-threshold entry services, primarily to younger persons with complex needs, and offers pathways out of homelessness based on the principle of the Housing First model and within a framework that is based on equal opportunities, dignity and respect. The services which the charity provides include prevention services, drug treatment services, homeless and housing services and under 18s residential services.

Much of our work is heavily reliant on the generosity of individuals, communities and companies and fundraising events which are run throughout the year. So far, 2014 has been an exciting and positive year which saw the awarding of the Freedom of the City to Fr. McVerry. However, there is still so much work for Peter McVerry Trust to do and we can point to many positive developments that will help ensure that more people exit homelessness and fewer ever have to experience it at all. For more information on these and the work of Peter McVerry Trust please visit www.pmvtrust.ie.
Barristers and their families, like all others, often have to face the financial consequences that can arise as a result of sudden illness or change in economic circumstances. The Bar Benevolent provides temporary financial assistance to Barristers and/or their families who find themselves in financial difficulties. The Society often provides assistance with the payment of mortgages, rent, utility bills and otherwise. The work which the Society does is entirely confidential. The finance to do this work comes almost entirely from contributions that are made by members of the Law Library.
For futher information contact: Charles F. Meenan Email: cmeenan@lawlibrary.ie
S O L I C I TO R S ' BENEVOLENT ASSOCIATION
The administration of the Society is carried out by a Chairman and Committee whose work is voluntary. Apart from minimal bank charges there are no administrative costs in running the Society so that every euro that is donated will find its way to a worthy cause. The severe economic recession is impacting on Barristers and their families as it is on everybody else. The Society welcomes any contributions that can be made.
The Solicitors’ Benevolent Association is a voluntary charitable body consisting of all members of the Law Societies of Ireland and Northern Ireland. It assists members or former members of the solicitors’ profession in Ireland and their wives, husbands, widows, widowers, families and immediate dependents who are in need. The Directors who provide their services on a voluntary basis are from throughout the 32 counties. Assistance is provided on a confidential basis. Grants to beneficiaries are funded by annual subscriptions from the profession, and by donations and bequests. Due to the present economic difficulties demands on the Association are rising. Additional subscriptions, donations, legacies and the proceeds of any fundraising event are very welcome.

Commending Excellence in Irish Law
Welcome to the ceremonies for the Irish Law Awards (now in their third year) celebrating excellence in the law during 2013. Ireland is emerging from a dark and wicked night! Never in our history has there been such financial turmoil that affected the ‘ordinary’ citizen and the ‘ordinary’ business man and woman. The Wall Street Crash of 1929 principally affected the wealthy classes. Today, the spectre of negative equity has visited our sons, daughters and family members. The ‘Depression’ has taken its toll on all. But Ireland is emerging from that dark and wicked ‘night’ of economic horrors. We have not lost our nerve. Lawyers have played a significant role in the re-shaping of a new era. While it is trite to say that life is complex, it is a comfort to many to have good lawyers fighting the client’s ‘corner’ in difficult times. Lawyers have helped so many by taking ‘ownership’ of the problems and somehow sorting out the problem issues. It has been heart-warming and a great privilege to witness the outstanding achievements, expertise and capabilities of lawyers in Ireland as evidenced by the legal services performed by the finalists of the Irish Law Awards in 2013. I thank my fellow judges for their dedication, commitment and generosity. Gratitude is expressed to the sponsors of the Irish Law Awards, and to the Wall Street Journal, the Financial Times, the Sunday Business Post and the superb staff at Ashville Media Group.

Dillon Solicitors Dillon Solicitors are delighted to be included in the nominations for Legal Website of the Year. In designing the website, we have tried to make it visually attractive, while also providing useful information to browsers interested in researching any aspect of law. The website provides information in relation to the services provided by the firm, as well as the standards which the firm aspires to, its team, and also provides an updated legal information section which is regularly updated.
Woodshogancorporate.com is securely restricted and accessible solely by clients, enabling them to exchange information, issue case instructions including opening cases, and access ‘live’ case data and reports 24/7. THE INTERNATIONAL BAR ASSOCIATION. FOR LAWYERS WHO WANT TO GO PLACES.
In the legal profession, there’s only one thing more important than what you know. Knowing the right people is often crucial but, when you have international clients or clients with international dealings, it can be of great advantage if your friends in high places are also in far-flung places.
Whatever your field of specialisation, we can provide you with instant access to a global network of fellow lawyers who are used to applying their local knowledge to the same or similar issues.
As an International Bar Association member, working confidently across international borders presents no problems. You are able to draw on the world’s most extensive expertise base to achieve the best possible outcome for both your client and your practice.
The IBA’s on-going series of conferences and specialist meetings provides the perfect forum for convivial and constructive networking. Many an international merger or acquisition has been conceived at an IBA meeting and there are more than a few lawyers who say that joining the IBA was probably one of their more astute career moves.
IBA membership offers the opportunity to meet, to interact with and to learn from like-minded lawyers and leading practitioners in many jurisdictions, right across the planet. Our membership roll runs to over 55,000 of the world’s top lawyers and 206 Bar Associations and Law Societies worldwide.
What is more, the ability to market their firm in the right international circles has proven invaluable in many cases. With membership of the International Bar Association, you can be sure of having all the right friends in all the right places, worldwide.

Commending Excellence in Irish Law litigation case of the year Michael Nuding Denis I Finn Solicitors
Burns Nowlan Solicitors Burns Nowlan succeeded in obtaining the first judgment against the State where a prisoner, while in custody, sustained personal injuries from an assault by another prisoner. The significance of the case is that it imposes a duty of care on the State in certain circumstances for the safety of prisoners while in their custody.
A modern day David Vs Goliath involving the payment of music royalties. Its precedential value has been felt across the nation and continues to provide welcome relief for many struggling business traders.
P. O’Connor & Son
ByrneWallace ByrneWallace advised former Waterford Crystal employees in a key pension case resulting in a successful outcome and a landmark decision of the CJEU in 2013. The case, of significant public interest, led to positive changes to pensions law in Ireland which will benefit Irish employees in the future.
William Fry William Fry acted for Thema International Fund Plc in proceedings against HSBC in one of the largest claims ever to arise before the Irish Commercial Court and the first case to commence from the infamous Madoff $50bn Ponzi scheme.
Holmes O’Malley Sexton Solicitors
P. O’Connor & Son challenged the practice adopted by many lawyers of raising unnecessary Particulars in Litigation actions. The judgement in Armstrong v Moffatt [2013] IEHC148 narrows the scope of what information can properly be sought. Judge Hogan concluded his judgement: “the fox is more likely to prevail than the lion”.
Colman Bermingham, Aisling McCarthy and Peter Hennessy Noel Smyth & Partners The Barge Inn Limited v Quinn Hospitality Ireland Operation 3 Limited [2013] IEHC 387 The High Court had to consider whether or not a landlord should be allowed to re-enter the premises on foot of a forfeiture notice served after the landlord had unilaterally withdrawn a concession previously given, demanded the increased rent and the tenant had failed to pay.
This year, HOMS has gone from strength to strength in relation to its thriving litigation practice, excelling in all areas but, in particular, in relation to professional indemnity work. The firm has received sterling feedback from existing clients whilst adding further professional indemnity insurers to its impressive client base.
