extort P30,000 to P80,000 from them. The NBI used as evidence a footage showing Cena and Garcia handling White’s luggage at the X-ray machine area and calling his attention to alleged presence of a bullet in a bag that White was carrying.

Mother and stepson, however, refused to shell out money, causing White to be detained for several days at the airport jail. The case reached the Pasay City Prosecutor’s Office. Zoleta and her stepson were also invited to testify in a Senate hearing where she showed the video she took.

They personally filed the case at the Department of Justice on Thursday, December 10. The two were accompanied by NBI agents and Zoleta’s husband, Michael Ryan White. “We are very happy because the NBI has shown how we were made victims of these people,” Michael Ryan told The Manila Times. The two OTS personnel were charged with violation of Article V, Section 38 (Liability for Planting Evidence) of Republic Act (RA) 10591, or the Comprehensive Firearms and Ammunition Regulation Act. While he had already expressed his preference to handle the Department of Labor and Employment or the Department of Transportation and Communications to fix the gargantum problems hounding these agencies once he is already the Vice President, Marcos said he won’t turn down a Housing Agency assignment if offered to him by the next President.

The case stemmed from a complaint of Zoleta and her stepson that they were victimized by the tanim-bala (bullet-planting) extortion scheme at NAIA in Pasay City. The NBI probers, in a letter to Prosecutor-General Claro Arellano, recommended that the case undergo preliminary investigation before the Justice department to enable the six respondents to give their side. No syndicate involved The DOJ earlier confirmed in-

volvement of airport personnel in the alleged extortion scheme. “The full force of the law would be brought upon you,” Caparas said in a news briefing. He said while “corrupt” airport officials may be behind the scheme, “I believe, based on the data gathered, the NBI cannot rule that there is a syndicate behind these incidents.” The bullet-planting scheme involves the sneaking in of live ammunition into bags of unsuspecting travelers by airport personnel for extortion purposes. Caparas said the NBI task force interviewed several indi-

viduals and reviewed documents on reported cases over the past five years. President Benigno Aquino 3rd as well as Transportation Secretary Joseph Emilio Abaya earlier drew flak after they attempted to downplay the incidents by saying the cases were just isolated and that media hype blew the whole thing out of proportion. I applied.” During a community forum at UC Riverside on Thursday, Dec. 10, Pasquil demystified the procedure involved in serving on a board or commission under Brown’s administration. “If you have the passion to want to serve, and you want to learn, and you want to ask questions, and you want to think about making some change, this is the administration … to do that with,” she said.

In addition to filling out an application, applicants will be subject to a background check and follow up with provided references. Pasquil also said making a personal case in the application as to why one wants to be an appointee can help improve chances of becoming one, as this section is read and shared with the governor and chief of staff. “That helps us, in a crazy world with a lot to do to really get a feel for who you are,” she said. She also suggested reaching out to elected officials, as the governor runs into them and may ask about appointee applicants, as well as practicing for the interview. Applicants who move forward in the process will have about three conversations: the deputy, the subject matter senior advisor to the governor, and then Pasquil, before moving on to Brown. Although Brown is a Democrat, Pasquil said party affiliation is not the first concern, but rather whether the individual wishes to be a public servant who will participate and is not afraid to ask spirited questions. People should also be prepared to deal with conflicting ideas and opinions, which are found across many boards. “The governor will say you have to have an opinion, and why do you have that opinion? [Gov. Brown] doesn’t want us all to agree.... If you are on the opposite side of an issue, the governor will just want to know why

you feel that way and what’s the background,” she said. Some positions will require Senate confirmation, and some will require appointees to be US citizens. Additionally, all appointment positions are in Sacramento, so appointees will not be able to work out of a Southern California office or elsewhere if they accept the position. Throughout the application process, Pasquil said her office is available to help. For instance, if someone interested in serving has scheduling conflicts that limit the number of meetings they are able to attend, or if one wishes to serve on a medical board but have a spouse that is a doctor, she encourages people to talk to her. Even when an appointee is on a board or commission, Pasquil said her office is also available to provide assistance. If an appointee finds themselves unhappy with where they are serving, she says, “don’t quit. Just call and we’ll see what we can do.” The Inland Empire is a region from which a lack of applications are received. Pasquil said of the 12,000 applications her office has received, 800 are from Riverside County. Other areas that lack representation on the governor’s boards include the southernmost and northernmost parts of California, the Central Valley and Central Coast. There are also always fewer women applicants than men. “My team and I, we always feel

that in order to do a good job for you, for the people of the State of California, we have to be out there finding people who are not expecting our call to serve,” Pasquil said. Young people are also encouraged to consider applying for these appointee positions, as Pasquil said Brown does ask about where they are in the boards and commissions. “I really believe it’s really important for any of these citizen boards to be successful that we have people from all over the state. So if its not you, then please think about who. Who from this area [can serve]?” she said. Pasquil has previously served as Chief of Staff to California Lt. Gov. John Garamendi from 2008 to 2009. She was also appointed as Acting Lieutenant Governor when Garamendi was elected to Congress in 2009, marking the first time a woman, Asian Pacific Islander or Filipino-American served in the role. Supervisor Mark RidleyThomas, who co-authored the motion with Supervisor Sheila Kuehl, said the vote reaffirms the board’s commitment to celebrating diversity, as it did with its decision to commemorate the Armenian Genocide and when it revocated the 1942 vote of the Board of Supervisors that supported Japanese internment in World War II. “We simply choose to push back on every vestige of bigotry that threatens the best of what it means to celebrate democracy,” Ridley-Thomas said, the

Los Angeles Times reported. “We should not tolerate racial antagonism, prejudice or bias in any shape, form or fashion in our own space.” The board also approved to send a letter to President Barack Obama indicating its support of federal efforts to help Syrians and others fleeing violent countries come into the United States and resettle throughout the next two years. Obama has vowed to admit 10,000 Syrian refugees throughout the next fiscal year. Supervisor Hilda Solis approved the motion along with Ridley-Thomas and Kuehl, while

We cannot say that the whole incident is [over],” Caparas said. Police welcome probe result The Avsegroup on Thursday welcomed the outcome of the NBI task force’s investigation. “The Avsegroup will not tolerate any members who are involved in illegal activity,” the Avsegroup spokesman, Chief Insp. Samuel Hojilla said, adding that they respect the result of the inquiry. Meanwhile, the lawyer of an overseas Filipino worker (OFW), who was detained for several days at the Avsegroup office for allegedly carrying a bullet at the airport, is calling for the resignation of Manila International Airport Authority (MIAA) general manager Jose Angel Honrado. Lawyer Spocky Farolan insisted that Honrado should resign out of delicadeza [sense of

propriety] to “allow a more competent and qualified manager to manage the airport.” Farolan, a pro-bono lawyer of Gloria Ortinez, the OFW and alleged bullet-planting scam victim, believes that the scam at the NAIA involving OTS and Avsegroup personnel is a syndicate. “It is impossible that Honrado did not know all about [the syndicate’s] operation. It’s just on the tip of his nose,” the lawyer said. He told reporters that Ortinez and the other victims were not convinced with the result of the NBI investigation that there is no syndicate behind the scam at the premier airport. The lawyer said the NBI should also include all officials of the Avsegroup and the OTS in the cases they filed against the two OTS personnel and four policemen. He added that Honrando should not be spared from the case since “he is causing pain and anguish to the entire nation.” n

Antonovich said he believes the screening process is inadequate and could put Americans at risk, ABC 7 reported. “The deaths of 129 French citizens at the hands of at least one known Syrian refugee show that the refugee crisis is different from others in history,” he said in a statement. Multiple news agencies and publications, however, have reported that the passport was fake and that all attackers were identified as European nationals.

She and her assistant director, Corwin Porter, had planned to speak to the department employees about the year’s accomplishments and upcoming goals at the party. Following the massacre, where 14 people were killed and 21 wounded, Farook and Malik escaped in a black SUV and were killed by police hours later in a shootout. Raymundo said she was in the back of the conference room at the Inland Regional Center in San Bernardino around 11:00am, when the violence started. Officials said around 300 people were in the building of the Inland Regional Center, which is a staterun center for over 30,000 people with developmental disabilities. “I was at the table getting coffee and checking out the goodies that were sitting there. And it was that point in time, you know, when we all heard gunfire right outside the door and all turned to look at the door to watch [Farook] come in,” Raymundo said. “People throughout the room went diving under tables set up for the holiday meal.” Officials said the couple, who were both dressed in black tactical clothing and carrying AR-15 rifles purchased by a friend of Farook, fired 65 to 75 rounds. “It seemed like it was forever,” Raymundo, who had been appointed Public Health Director in early 2012, said. “He burst through the doors, firing and walking toward the middle of the room, just indiscriminately.” “As it goes on, desperation kicks in and I kept hoping, it’s an exercise, right? Why does he keep shooting?’” After the rampage, Raymundo recalled emergency responders arriving to the conference room on the scene. “The police were telling everyone, ‘If you’re not injured, get out.’ We weren’t going to leave anybody behind, and so we went out as a group. We tried to help those that we knew were injured. We needed to get them to safety...we needed to take care of them.” The San Bernardino Environmental Health Services division also recently attended an activeshooter training in the same conference room where the attacks took place. “We made sure all of our staff had that training,” said Porter. “It was pushed out county-wide that we have this training for all of our staff just in the event that something might happen. And so they responded quite well. Farook’s co-workers in the environmental health division said they had thrown him a baby shower about six months earlier, when his daughter was born. “It’s a complete sense of betrayal,” Raymundo told ABC News. “It amazes me every day how close this group is, how tight-knit they are, and it’s nothing but betrayal.” “The fact that they gave him a baby shower is just indicative of the whole group. That’s how they treated everyone,” Raymundo added. “I want to make it clear that this is a very tight, close-knit group,” she shared of her colleagues, according to Inquirer. “They have always supported each other. They are beyond coworkers. They are friends and they are family. We are holding onto each other right now and will continue to protect each other through what will be unimaginable weeks and months ahead.” Raymundo also thanked law enforcement officials and medical personnel for their immediate and professional response to the emergency. “I want to thank all of the first responders and all of the EMS personnel who were treating our injured and wounded…I want to thank the incredible outpouring of support nationally and internationally…we have received your offers of condolences and help, and we are grateful for them.” In an emotional press conference, she asked people to join in mourning “the loss of our colleagues, of our friends, of our families and our loved ones.” “I ask that you come together and hold each other strong, because it is this strength that will help us heal. And I want you to every day be grateful for those of us that were spared, those that are still with us today.” County supervisor Janice Rutherford urged the community and its employees to “fight to maintain that ordinary. We can’t be afraid of our lives, of our community, of our neighbors, of our co-workers. We stand with them to tell the terrorists, ‘You may not have our fear, you may not have our liberty, and you may not have our love’.” As a wounded San Bernardino

Marquez also admitted to investigators about a plot that he and Farook conceived, but did not carry out due to fear, in 2012. Investigators are still trying to corroborate information and other potential suspects, and have not verified details of the alleged plot. Marquez, 24, has not been charged with any crime, and has told investigators that he did not know about the couple’s plans for the attack at Inland Regional Center. On Dec. 10, an FBI dive team searched for electronic devices or other evidence possibly left by the couple in San Bernardino’s Seccombe Lake, reported the Los Angeles Times. The search is still ongoing. Investigators are also looking at the couple’s digital electronics, which were found in their Redlands home, leading FBI to believe the shooters were planning an even larger assault. “There is no belief that there

is anything dangerous as a result of this case in this place,” said David Bowdich, assistant director of the FBI’s Los Angeles branch office. Officials do not know if the attack was directed by an overseas terrorist organization like the Islamic State, but believe the Muslim couple was “selfradicalized and inspired…than actually told to do the shooting.” Malik had pledged allegiance to an Islamic State leader on her Facebook. “I felt very much demoralized,” Mustafa Kuko, director of the Islamic Center of Riverside, told NBC News. “Let’s be frank—these days when a Muslim does something wrong...all of us are going to be implicated in it.” Muslims United for San Bernardino raised more than $180,000 in funds to help the families of the shooting victims. “To simply say that we love you from the bottom of our hearts and they should know that they are not alone in this calamity. We share their sorrow,” said Shakeel Syed, executive director of the Islamic Shura Council of

Southern California. Members of a mosque in Culver City said the fundraising is an example of what Muslims believe. Abdel Hamil Barraj said Muslims are peaceful Americans. “There’s a minority that are calling for violence and all of that. We don’t go with it. We’re against it, all the way,” Barraj said. In Corona, the Islamic Society of Corona-Norco, which condemned the attack, hosted a dinner program and evening of prayers on Dec. 11 with residents, law enforcement and public officials. “We extend our heartfelt condolences and prayers to the families and loved ones of all those who lost their lives and ask Almighty God to grant full recovery to the injured,” the organization said in a statement. “The Muslim community stands shoulder to shoulder with our fellow Americans in repudiating any twisted mindset that would claim to justify such sickening acts of violence. Supreme Court refuses to hear case challenging assault weapons ban by Agnes

THE Supreme Court has declined to review an appeal of an Illinois ordinance banning assault weapons and large-capacity magazines, marking a victory for gun control advocates. The decision on Monday, Dec. 7, comes after a mass shooting in San Bernardino, California and nearly a month after such an incident in Paris, which have fueled fierce arguments over gun regulation in the United States. In 2013, the City of Highland Park in Illinois issued an ordinance that bans the sale, purchase, or possession of a number of semi-automatic weapons, including the AR-15 and AK-47. It also bans magazines containing over 10 rounds of bullets, as well as semiautomatic guns with a grip for the nontrigger hand. The measure was challenged by the Illinois State Rifle Association and Dr. Arie Friedman, a pediatrician who kept guns and magazines that were banned by the ordinance at home for selfdefense. They told the justices that the term “assault weapons” is “an imaginary and pejorative category,” according to The New York Times. Two conservatives on the ninemember court, Justices Clarence Thomas and Antonin Scalia dissented, saying the Supreme Court should have heard the case to

prevent the appeals court “from relegating the Second Amendment to a second-class right.” A key component to the argument was a 2008 Supreme Court decision that said the Second Amendment of the Constitution gives an individual the right to possess a handgun for self-defense. The ruling, however, also said there could be restrictions for “dangerous and unusual weapons.” “The overwhelming majority of citizens who own and use such rifles do so for lawful purposes, including self-defense and target shooting,” Thomas wrote in a sixpage dissent. “Under our precedents, that is all that is needed for citizens to have a right under the Second Amendment to keep such weapons.” A supporting brief filed by 24 states urging the Court to strike down the ordinance said the weapons banned are commonly used and protected by state laws that prohibit local communities from restricting them. Decision previously upheld In April, the 7th Circuit Court of Appeals in Chicago upheld the ordinance in a divided vote. “A ban on assault weapons and large-capacity magazines might not prevent shootings in Highland Park (where they are already rare), but it may reduce the carnage if a mass shooting occurs,” Judge Frank Easterbrook wrote on behalf of the majority. He added, “if a ban on

semiautomatic guns and largecapacity magazines reduces the perceived risk from a mass shooting, and makes the public feel safer as a result, that’s a substantial benefit.” Judge Daniel Manion wrote the dissent. “By prohibiting a class of weapons commonly used throughout the country, Highland Park’s ordinance infringes upon the rights of its citizens to keep weapons in their homes for the purpose of defending themselves, their families and their property,” he wrote. Highland Park lawyers defended the ban, citing it was issued after a series of mass shootings across the United States, including the 2012 shooting at Sandy Hook Elementary School in Connecticut, where 26 people were killed. They also noted that seven states, including California and New York, have similar laws. Attorneys for the Rifle Association said that in the seven years since the landmark gun ruling in 2008, “the lower courts have assiduously worked to sap it of any real meaning. They have upheld severe restrictions on the right to keep and bear arms that would be unthinkable in the context of any other constitutional right,” NBC News reported. The Supreme Court last heard a major gun case in 2010, when it ruled in McDonald v. City of Chicago that its ruling in 2008 applied to the states. n

Study: Binge watching TV as a young adult could lead to decline in brain function by Agnes

WATCHING excessive TV can lead to cognitive decline over time, a new study has found. Researchers from the University of California, San Francisco (UCSF) conducted a study on more than 3,200 participants throughout a 25-year period starting when they were young adults. They checked in with them every five years to ask for an estimate of how much TV they watched every day; every two to five years, researchers examined the amount of physical exercise participants got. After the 25-year period concluded, participants were in their 40s and 50s and were tested on their memory, focus, and mental and physical quickness. “Participants with the least active patterns of behavior (i.e., both low physical activity and high television viewing time)

were the most likely to have poor cognitive function,” said the study, which was published in the Journal of the American Medical Association (JAMA) on Wednesday, Dec. 2. One of the researchers, Tina Hoang, said the inactivity linked with binge watching has an effect on cognitive function earlier than has been realized. Previous related studies have found that sitting for too long and watching TV for three hours or more per day puts individuals at a higher risk of premature death. However, studies have not examined people who engaged in such activity at younger ages. Dr. Kristine Yaffe, a professor at UCSF, found that those who watched a lot of TV and exercised little had weaker working memories, slower processing speed and a lesser ability to plan and complete tasks. However, their verbal memory appeared to be unaffected.

the findings, Yaffe said the decline in cognitive abilities wasn’t enough to have an impact on an individual’s daily life. “The question is what does it mean if you’re 50 and you’ve got these slight changes? Does it mean you’re on a path to greater changes down the line or does not make a difference? I don’t think we really know the answer to that,” Yaffe said, according to NPR. The study’s results are not conclusive, and some possibilities include that those with low cognitive functioning are more likely to sit and watch a lot of TV, or that sedentary activity and a lot of TV could result in other conditions, like obesity or poor heart health. Looking forward, because sedentary behaviors are on the rise, alongside time spent in front of screens, Hoang said she hopes to further examine the relationship between them. n

Poll: Solid opposition to ban Muslims entering US, but Islamophobia strong

NEARLY six-in-10 Americans say the US should not temporarily ban Muslims traveling to the US from other countries, according to a CBS News poll. The survey also revealed two-thirds (67%) of citizens across party lines who believe that such a ban, like the one Republican presidential frontrunner Donald Trump proposed, would go against the founding principles of this country. Over half of Republicans responding (54%) support such a ban, while most Democrats and Independents do not. The survey found mixed views on whether keeping incoming Muslims from entering the US would make the nation safer from terrorism, but a majority of those surveyed in favor of the restrictions feel that it would. Overall nationwide, anti-Muslim sentiments are strong, with 29% of people viewing the religion unfavorably.

Record-low abortions in the US ACCORDING to a report from the Centers for Disease Control and Prevention, abortion in the US is at an all-time low among all major racial and ethnic groups. In 2010, the number of induced abortions was 1.1 million, the most recent year of statistics reported, and is down from a high of 1.6 million in 1990. The abortion rate was highest for black women, with 47.7 abortions per 1,000 women of childbearing age. Asian American women were not surveyed. The progress in reducing the number of abortions also comes amid an overall decline in American women’s pregnancies, and the pregnancy rate is the lowest since its peak in 1990, the report said.

AFP to receive 100 ‘excess’ armored vehicles from US by Julie

THE Armed Forces of the Philippines (AFP) will receive by the end of the year more than 100 M113 armored personnel carriers (APCs) from the United States government as excess defense articles, according to AFP spokesperson Col. Restituto Padilla. Of the 114 M113A2 APCs, 77 units arrived at the port of Subic on Wednesday night, while 37 more are scheduled to arrive on Dec. 14. “It’s a most welcome development, particularly for the Philippine Army, as it energizes and strengthens its mechanized division. If the Philippine Air Force has entered the supersonic age, the Philippine Navy has gone wet and wild, then the Army is now macho,” Padilla said on Thursday. The United States has pledged to deliver 114 M113A2 APCs to the Philippines under the Excess Defense Article Program. Under the program, the United States gives its excess military equipment without cost to qualified allied countries. The AFP earlier made a formal request to the United States to upgrade its defense modernization efforts. Some of the M113A2 APCs are are scheduled to take part in the AFP Day Parade on Dec. 21.

Earlier this year, the AFP purchased six upgraded M113A1 APCs with remote controlled weapons systems from Elbit Systems in Israel. The six delivered in September were the first of 28 APCs, which came at a P882 million price tag. All of the APCs will be armed

Deeper probe needed SO it wasn’t merely a case of bullets used as amulets being in vogue among travelers. The other day, the National Bureau of Investigation recommended the filing of charges against six security personnel assigned at the Ninoy Aquino International Airport in connection with an alleged bullet-planting extortion scheme victimizing travelers. The six are accused of planting a bullet in the luggage of a visiting American missionary last September and then shaking him down in exchange for his freedom. The American and his Filipina stepmother testified at the Senate about the alleged extortion scheme. This probably put pressure on probers to look closely at his complaint and hold the six liable. But the tanim-bala scam has other complainants. One of them, a woman who lost her job overseas after she was accused of illegal possession of a bullet at the NAIA, believes the NBI is covering up a wider operation. The woman’s lawyer noted that the NBI, in denying the existence of a syndicate engaged in the extortion scheme, echoed what President Aquino had said about the scandal. The President had also pointed out that only three out of 38 million passengers appeared to have been

victimized and the story had been blown out of proportion. The overseas worker wants airport officials held accountable for the scandal that has aggravated the image of the NAIA as one of the worst airports in the world. Even if airport officials may not be direct participants in the scheme, the worker believes they should be held liable for negligence. Yesterday the Department of Justice corrected the NBI and said it was still looking at the possibility of a bigger group involved in the extortion scheme. Rather than being in denial, the administration that professes to tread the straight path must see to it that every effort is made to promote the welfare of travelers. Any extortion scheme at the nation’s principal airport must be eliminated and the perpetrators caught and punished. (Philstar.com)

When will Congress pass sensible gun control laws to keep high-powered firearms out of the hands of people who are not fit to own guns? Republicans argue against this -- contending that because of these series of mass killings in the United States, people should absolutely be armed to protect themselves against bad guys who do have guns. Besides, they say that any infringement of the right to bear arms is in violation of the Constitution. But is it really? I read this interpretation of the Second Amend-

Ronald Cortez: Parable of talents spurred his art to excellence

Be- DelAcruz, J.D. hind these graceful, expressive, sometimes dignified and sometimes earthy dances, lay years of study, meditation and prayer.” —Nona Beamer Much like the hula dancer swaying her hips as she moves, the fish on the canvas of Ronald Cortez’s paintings appear to swim and to glide. Even the tomatoes appear so ripe that you want to pluck and slice it. The salted egg has that characteristic yolk -- with a hint of oil on it -- and whiteness. The peso is realistically portrayed. “It is about remembering the Php 10 and Php 20, no longer in circulation, for this, I am remembering something from the past – ano ang pinagmulan mo (what are your roots)?,” Ronald said. Ysabel Grace Simon, a 17-year-old high school student at the Fiorello H. LaGuardia High School of Music & Art and Performing Arts, shared her feelings of being back in the Philippines. “We took trips to Baguio, and I remember the orange sky, and with fishes. The faded look at the edges of the painting and the use of natural light. I was just 7 years old when I left the Philippines,” she said. If the painting, Tinapa 2, reminded Ysabel of her Philippines as a 7 year old, then it worked. It seemed so real that it reminded me of the masterful works of Fernando Amorsolo, Ben Cabrera and Thomas Kinkade. I once had the privilege to talk with Ben at two sites: one at AndrewShire Gallery on Wilshire Blvd. in Los Angeles, and another at his Ben Cab Museum in Baguio, Philippines. I first heard of Ben, the National Artist of the Philippines who has been painting for five decades now, from a bookseller. She described how in the morning she woke up with views of the sea and the mountains from her guest bedroom. A walk outside led her to an organic garden and a fish pond, the museum with various exhibits of contemporary artists, a café and a museum shop. I posed questions to Ben, but his one vivid answer was distilled into its es-

sence: “Learn how to draw and draw well before you paint,” he said. I looked at paintings now, with a discerning eye, distinguishing the amateurs from the masters. I met Ronald Cortez on the eve of Halloween this year while visiting the Philippine Consulate on Fifth Avenue in New York. Courtesy of a friend’s iPhone, I viewed Ronald’s paintings and had an immediate gut reaction: “Oh my, your paintings belong in the category of Fernando Amorsolo and National Artist Ben Cabrera.” It was an exclamation, for sure. But the truth was confirmed by a photographer with an eye for details, who said, “Look at that painting, do you see how the fish is swimming? Yes, he is in the league of Amorsolo.” Fernando Amorsolo was a celebrated painter of portraits and rural landscapes, well-known for his mastery in the use of light, much like America’s Thomas Kinkade, the Painter of Light. Self-taught painter Raised by a single mother, Nanie Ratio Cortez (a dressmaker who is now 79 years old), Ronald lost his father to an aneurysm when he was two months old. “Walang laruan, pag may pencil ako, masaya na ako. (No toys, but with a pencil, I was happy).” He learned not to ask for toys, as money was just enough for rent, food, and school fees. “My mom’s paper bags ang una kong naging sketch pad at that time. Natutuwa ang mga customers ng nanay ko. Malikot ako, bibigyan ako ng lapis, mabait na ako. (My mother’s paper bags became my sketch pad. Her customers were pleased. Restless, I would be given a pencil. I would behave).” He grew up in Lucban, Quezon. “Baon ko ang bundok. Nasa imahinasyon ko. (I stored mountains in my imagination).” He went to school in Taytay, Rizal, near his mother’s dress shop. By fourth grade, his care was entrusted to his aunt, while his mother worked in Saudi Arabia. From 4th to 6th grade, he drew portraits, fascinated by facial features. First, he drew the eyes, then, nose, and mouth. “Unlike what they teach us in school,” Ysabel noted.

Ronald lingered in malls, where he watched others do charcoal drawings. He then saved his allowance and bought his supplies. Friends spurred on his art by asking him to paint their crushes, and got more charcoal, as an in-kind payment. In high school, a cousin asked him to paint a portrait of his girlfriend, and in return, Ronald got a set of oil paints. It was at this point that he decided he wanted to be a painter. He went to Southern Luzon Polytechnic College for arts and sciences, without a declared major. But, his mother encouraged him to be a seaman, following the example of a cousin, Marcelo Raneses, who is a boat captain. So, he took seaman classes. Craving art and the Parable of Talents While studying in Manila, Ronald craved for art, and satisfied his hunger by browsing books at the National Bookstore on Avenida Rizal. There, he met Loreto Racuya, another artist, who introduced him to the owner of an art supply store. Loreto also told him that he has potential and needed to focus on his art. He shared his insights on the Parables of Talents, “Ipagpapalit mo ba ang 4 na taon sa pag-aaral, habang buhay kang hindi masaya? (Will you exchange 4 years of going to school and a lifetime of unhappiness?)” The Parable of Talents taught him first, that his artistic talents must be used to glorify God and to be shared with mankind. Second, he would be given what he needs to further his talents, and realized that his friends supplied his art materials to improve his skills. Third, we are all endowed with different talents, some with one talent, others five. He became concerned that

he might lose his ability to paint if he did not focus on painting. Fourth, that we work for the Master who gave us the talent. Fifth, that we will be held accountable for our work. Developing realism in his paintings With spiritual direction – “Let the bees, the trees, and the birds teach you to paint” – he painted nature. Every year, he set a goal to learn new materials and new techniques. He learned how to paint with pencil, pen and ink, watercolor, oil pastels, oil and mixed media. That experimental period continues to today, “Even today, I am learning as I paint, kasi pag sinabi mong hinog ka na, ang susunod doon, bulok ka na. (Because when I say I am ripe, the next stage is decay).” So when fine arts majors say, “Why realism, that is obsolete now, why not switch to abstract?” He responds, “if that is the case, folks are also obsolete now and they would be abstractions.” In painting, he paints by series. Just like the rice painting, he had three to four series. It allowed him to change canvasses, to focus on another view. “I can’t afford to rest, lalong tatagal, kaya lilipat ako sa kabila. (It prolongs the process, so I just move to another canvas).” “I respect the time given by God, I respect that. I also consider the viewer and balance the composition. Nature is

truly beautiful – I want to give justice to nature, that is what I want to achieve,” he said. Much like the hula dancer who pays homage to the Divine Master and Nature, Ronald Cortez does the same in his paintings, dignifying Nature and God, daily through his artistic expressions. VICE President Jejomar Binay on Friday said Liberal Party standard bearer Mar Roxas is the person behind the “demolition by perception” plot to charge him of corruption. In an ambush interview after a forum in the Ateneo De Manila University, Binay hit back at Roxas for claiming that the vice president is an expert on graft and corruption. “Talagang labis na nagpapatunay na si Mar Roxas ay kasama sa conspiracy ng demolition by perception, yung pagdidiinan at pagsisinungaling na ako ay expert sa graft and corruption,” Binay said. On Thursday, Dec. 10, Roxas said Binay seemed to be using his personal experience when the opposition leader explained the difference between graft and corruption at a student forum in Dumaguete City. During the said forum held last Tuesday, Dec. 8, Binay said that graft was the abusive use of power while corruption was about

mishandling money. “It’s a good thing that he (Binay) explained the difference between graft and corruption because he is an expert on it. He probably has personal experience on it that’s why he knows the difference,” Roxas said. Binay’s camp said Binay was only speaking as a lawyer in explaining corruption. “The Vice President was speaking as a lawyer. The difference between graft and corruption is something clear to lawyers and those who understand and respect the law,” Atty. Rico Quicho, Binay’s spokesperson, said. Binay urged Roxas to answer the allegations that he as former transportation and interior secretary failed to curb criminality and ease traffic woes. “Ang sagot namin, sagutin niya muna yung sinasabi naming pagkukulang niya. Hindi niya sinasagot eh. Binabaling niya sa pagbintang,” Binay said. In a statement Friday, Rico Quicho said Roxas does not respect the rule of law in making a statement about Binay’s supposed expertise in corruption.

Binay is under graft indictment by the Ombudsman for the alleged rigging and overpricing of the Makati Parking Building II. “This is something that is lost to Sec. Roxas and the LP administration, who do not respect the rule of law and twists the law to advance their narrow and selfish political agenda.” Quicho said. Binay was indicted for graft by the Ombudsman for allegedly rigging the procurement for the design and construction of the P2.28-billion Makati City Hall Building II, deemed the country’s priciest car park building, when he was Makati mayor. Binay also faces four other plunder and graft complaints before the Ombudsman over the alleged anomalies involving the Makati Science High School Building, University of Makati, a Fort Bonifacio property, and over an allegedly anomalous land deal between Alphaland and the Boy Scouts of the Philippines, where Binay is long-running president. Binay decried political harassment by his detractors who intend to derail his presidential bid. n

The Philippines slightly improved in the RSF’s World Press Freedom Index for 2014, jumping eight notches up to 141 from last year’s 149 out of 180 countries. However, Mihr noted that the country is still near bottom of the list and considered as among the countries where journalists face a difficult situation in terms of press freedom. Mihr scored the lack of a freedom of information law, which Aquino failed to pass during his six-year term despite initial support for it when he was campaigning in 2010. “We were always demanding that this should be established,” said Mihr. Journalist killings The RSF said there were at least three confirmed journalist killings in the Philippines in 2014. “(The list) includes only cases in which Reporters Without Borders has clearly established that the victim was killed because of his/her activities as a journalist. It does not include cases in which the motives were not related to the victim’s work or in which a link has not yet been confirmed,” it said. The organization has yet to release its data for 2015 killings in the country. Meanwhile, the Committee to Protect Journalists (CPJ), which ranked the Philippines as the third country with most journalists killed since 1992, said there are six unconfirmed cases of journalist killings in the country this year. MANILA – China might lose its influence over smaller states if it will defy the decision of the Permanent Court of Arbitration on the arbitration case regarding the South China Sea dispute, according to the Philippines’s lead counsel in the case. Manila lead counsel Paul Reichler said in an interview with the Asia Maritime Transparency Initiative that China is expected to “vent quite a bit” if the tribunal sides with the Philippines. “By defying a judgment, particularly if it’s a unanimous judgment, particularly if it’s well-reasoned, if it’s well-explained and if it is understood and supported by the international community... China will be branded... an international outlaw state,” Reichler said. Reichler added that this would cause a “loss of prestige” and loss of influence, particularly over Southeast Asian nations. The international lawyer, however, noted that China’s initial reaction might not be its final reaction. “There is a strong possibility

THE Supreme Court has allowed former President and now Pampanga Rep. Gloria Macapagal-Arroyo to spend Christmas and New Year’s Day at her house in Quezon City. High Court’s Information Chief Theodore Te said Arroyo’s furlough starts at 8 in the morning of Dec. 23, 2015 until 5 in the afternoon of Dec. 26, 2015; and 8 in the morning of Dec. 30, 2015 to 5 in the afternoon of Jan. 2, 2016. Te said the furlough will be “spent exclusively at her residence at La Vista Subdivision in Quezon City.” “The petitioner shall remain under preventive custody of the law,” Te said. The high court ordered Sandiganbayan acting Chief of Security and Sheriffs Services Alberto Dela Cruz to implement the resolution and coordinate with the Philippine National Police (PNP). The high court required Dela Cruz to submit a report of his full compliance to the Supreme Court on Jan. 11, 2016. The high court gave the furlough pending resolution of her urgent motion for house arrest. Te said the high court ordered government lawyer to comment on Arroyo’s urgent motion. In 1986, the International Court of Justice ordered the US to stop violating international law by supporting military and paramilitary activities against Nicaragua, Reichler said. The US Congress later on decided to comply with the court’s decision. Reichler also cited the Arctic Sunrise ship case between Russia and the Netherlands. In 2013, Russia seized Greenpeace ship Arctic Sunrise, which was sailing in international waters in the Russian exclusive economic zone, and arrested the crew. The Netherlands filed a case before the International Tribunal of the Law of the Sea, which later on ordered Russia to release the crew and ship. Russia initially refused to accept the ruling but eventually released the crew and ship. Reichler said that the Philippines, along with other ASEAN countries, might help China in finding a way to “save face” and bring itself back to the community of law-abiding nations that contribute to regional peace and stability. The Philippines recently concluded its arguments before the United Nations (UN) arbitral tribunal at The Hague, Netherlands. The UN tribunal is set to issue a ruling on the arbitration case between the Philippines and China by 2016. n

Duterte vows to protect cops who kill criminals By Robertzon Ramirez (The Philippine Star) MANILA – Yes, presidential aspirant and Davao City Mayor Rodrigo Duterte will protect policemen accused of human rights violations for killing criminals if he is elected president. In an interview over radio dzMM on Wednesday afternoon, Duterte said that he will provide legal and financial assistance to police officers who would be charged with human rights violation cases after killing criminals while on duty. Duterte added that he would provide a lawyer and allowance to the relatives of the policeman who will be suspended due to the charges to help the family buy their needs. He said that police officers usually face human rights violation charges after they have killed criminals in an encounter while on duty. “Hindi ako papayag sa Davao diyan (I won’t allow that in Davao), when they are charged and they are prosecuted, eventually in court then sa fiscal, I provide a lawyer, ako ang magbibigay ng (I will give) allowance nila,” Duterte said. “Every police who did something wrong… if at all, but duty connected or in the performance of duty, I back them up,” he added. Duterte also said he would allow policemen to kill criminals should he win in the 2016 elections, but warned erring police officers that they would “go first” should they commit wrongdoings. “Sinasabi ko sa mga pulis, pag gumawa kayo ng masama, mauuna talaga kayo (I told policemen that if they do something bad, they will be the first to go). You have to go first,” he said. When asked if he has killed erring policemen, Duterte said: “May tatlong pulis (there are three policemen), the latest was about four months ago, patay (dead).” He, however, did not directly respond to the question if he was the one who killed the police officers. “Patay,” he said, when asked if he killed the police. Tough-talking Duterte is the recent top choice based on opinion surveys recently conducted in the National Capital Region (NCR). He said that his style of leadership in Davao may probably lead him to the top post, but asked the public to consider other presidential candidates first before him. CHR case The Commission on Human Rights (CHR) admitted that the previous human rights violation case filed against Duterte did not prosper in court despite his admission on killing criminals in Davao City. CHR spokesman Banuar Falcon told The STAR that the commission had recommended administrative charges against Duterte and criminal charges against Davao policemen before the Office of the Ombudsman in connection the alleged Davao Death Squad (DDS) that was accused of killing suspected drug dealers and other criminals in Davao City. Falcon explained that an administrative case was recommended against Duterte, as he

allegedly neglected to perform his duty to prosecute the DDS members after several investigations were conducted in 2009 to 2010. He explained that only an administrative case was recommended as they failed to present evidence that would link Duterte to the DDS. “We did trials, but no case prospered,” Falcon said. He said the ombudsman eventually dismissed the administrative case against Duterte while the criminal charges against the policemen went to trial but were later dismissed by the Court of Appeals. Falcon explained that the court cited that “statistical crime incidence” in Davao could not be a basis in charging government officials. The CHR only has recommendatory powers and has no authority to directly file charges against a government official accused of a crime. The CHR has conducted an investigation over the alleged DDS when the United Nations special rapporteur on extrajudicial executions Philip Alston visited the Philippines in 2008 after receiving reports that more than 1,000 people had been killed between 1998 and 2008. This prompted Judge Roline Jinez-Jabalde to issue another order Tuesday evening committing the American serviceman to the Camp Aguinaldo facility. Justiniano, who resigned from his DOJ post last October, also confirmed discussions as early as last August on the possible place of detention for US personnel convicted in the country. “There was an agreement that in case Pemberton would be convicted, he would be detained in AFP Custodial Center in Camp Aguinaldo… but I did not see if there was a signed agreement,” he added. Justiniano said Jabalde was not aware about the agreement when she ordered the transfer of Pemberton to the NBP. “It was premature for the judge to know since there was still no judgment when the agreement on his detention was done. Why would you presume that he would be convicted?” he explained. In its decision, the RTC found Pemberton guilty of homicide— not of murder as charged by the prosecution—and sentenced him to six to 12 years in prison. n

You see the price paid in tension, harassment and preoccupation. If she cannot diet nor exercise, she is lost to fashion. Any woman familiar with clothes in larger sizes knows that if you have to get into these, you might as well give up. They are the shrouds of sex, the sacraments of abdication. Now this is nonsense. There is no reason why a woman, who is either heavier or broader than an adolescent and falls outside the dimension of a slender girl, cannot be dressed both fashionably and seductively. Designers and dress manufacturers could see to it—if they wanted to. It would militate against the hacksters of exercise, the slenderizing salons, fat farms and pill producers of the nation.

“Have you been putting on a little weight, dearie?” For me, I consider both in bad taste, since they are not the business of the speakers. A woman’s shape and size are entirely her affairs. If she’s happy and hippy, she should be left alone. Some of art’s greatest nudes have been fleshy, wide and beautiful. And based on experience, their radiance was the reflection of masculine appreciation. It is only fairly recently that men are supposed to prefer the bony splendor of the pelvis cradle. I am not defending obesity nor doubting the beauty of a slim young body. I do not take issue with the same prevailing conviction that there is only one acceptable feminine outline for all ages of her life. If you like the grotesque mammalian exaggeration from certain film stars, then basically no beauty of face, excitement of the mind or warmth of spirit can excuse or nullify the “sin” of widened posterior. Have fun, eat well and be kind to your fellow. And the next time a woman makes a remark on your weight, tell her what she can do with it!

MANILA—Gab Valenciano has been receiving death threats after expressing he is not supporting presidential aspirant Davao City Mayor Rodrigo Duterte, his brother Paolo Valenciano revealed on Wednesday, Dec. 9. On Thursday, Dec. 10, Paolo posted a series of Tweets claiming that his barother has been getting “death threats because he doesn’t like Duterte.” “Iba opinion niya so death threat agad agad?” he asked. He then clarified that he has “very good history with Davao,” but was bothered to see “some Davaoeños saying, ‘Sana ma-rape asawa mo.’” Paolo also said that he likes Duterte, but asked some of his supporters to “show more respect.” Gab earlier defended singer Kitchie Nadal bashers after she expressed her thoughts on Duterte admitting he’s a “womanizer” and has “killed 1,700” people. In the deleted post by Nadal, she said that “we should keep in mind that men and women should uphold marital law as seriously as

IN this article, I have summarized the nutrition tips recommended by the American Heart Association. I hope it helps our readers eat healthy, prevent sickness, and live longer. 1. Choose lean meats and poultry without skin. The American Heart Association recommends eating no more than six ounces of cooked lean meat, poultry, fish or seafood a day (about the size of two decks of cards only per day). a) The leanest beef cuts usually include sirloin, chuck, loin and round. Choose “choice” or “select” grades rather than “prime.” Select lean or extra lean ground meats. b) Lean pork cuts include tenderloin or loin chops. c) Remove all visible fat from meat and poultry before cooking. d) Duck and goose are higher in fat than chicken and turkey. e) Grilled, baked or broiled meats are healthier. f) Organ meats, such as liver, sweetbread, kidneys, and brains, are very high in cholesterol. g) Cut back on processed meats that are high in sodium and saturated fat. 2. Fish is healthier than meat. a) Recent studies show that eating oily fish containing omega-3 fatty acids (for example, sardines, mackerel, and salmon) may help prolong your life. b) Prepare fish baked, broiled, grilled or boiled rather than breaded and fried. c) Fish can be fatty or lean, but it’s still low in saturated fat. 3. Read nutritional labels. Make reading food labels a habit. They’ll help you choose foods more wisely. Choose items that don’t have added sugars in their main ingredients. 7. Salty isn’t healthy. Aim to consume less than 2,300 mg. of salt or sodium per day. Some people with high blood pressure

should have less than 1,500 mg per day. • Choose foods that are labeled “reduced sodium.” • Limit high-sodium condiments and foods such as soy sauce, fish sauce, bagoong, steak sauce, Worcestershire sauce, flavored seasoning salts, pickles, and olives. • Replace salt with herbs and spices or some of the salt-free seasoning mixes. Use vinegar, calamansi or hot chili to add flavor. 8. Fiber is good for you. Fiber is classified as either soluble or insoluble. Soluble fiber has been shown to help lower blood cholesterol while insoluble fiber may help reduce the risk of colon and rectal cancer. • Foods high in soluble fiber include oat bran, oatmeal, beans, peas, citrus fruits, and apple pulp. • Foods high in insoluble fiber include whole-wheat bread, wheat cereals, wheat bran, cabbage, carrot, and apple skin. • Replace low-fiber foods (white bread, white rice, candy, and chips) with fiber-containing foods (whole-grain bread, brown rice, fruits, and vegetables). • Try to eat more raw vegetables and fresh fruit, including the skin when appropriate. Cooking vegetables can reduce their fiber content, and skins are a good source of fiber. • Be sure to increase your fiber intake gradually, giving your body time to adjust, and drink at least eight eight-ounce glasses of fluids a day.

AS expected, there is incessant buzzing about the future plans of TV host Luis Manzano—namely, his supposed wedding with girlfriend Angel Locsin and his delayed foray into politics. The persistent question on everyone’s mind concerned a possible change in marital status. He was quick to deny the marriage rumors—made louder by his coming holiday in Las Vegas, city of instant weddings, with Angel. “No we are not getting married in Vegas,” Luis told the Inquirer. “Let me be the first to quash that gossip.” He did say that they are talking about settling down. “It’s coming. We don’t feel pressured because, in the end, it’s our decision.” Luis explained that he and Angel are too busy with their respective careers to get hitched anytime soon. “We each have our own priorities,” he clarified. “I am set to do four to five shows next year and, for now, Angel’s main concern is to take care of her health.” The actress recently went public with her ailment, a “slipped disc.” “She is considering undergoing an operation,” he said. “I’d rather not go into details, but what I can say is that she has studied the options and has decided on one or two procedures.” But before that impending surgery, they are going on a preChristmas vacation. “We will meet up with my dad (Edu Manzano) and siblings in Miami before heading to Cuba. Bongbong Marcos’ political repertoire

OS ANGELES—Campaign coverages swing like a pendulum. Sometimes the candidates give the media grudging respect; sometimes they give us no latitude for what they think is grossly generous press treatment (which does not do quite well in terms of credibility factor). At the Bongbong Marcos Movement -USA’s (BBMM -- USA) gathering of friends, this was what we saw: Call it a benign stampede to the FACLA Social Hall in Historic Filipinotown. It was everything -- an exhilaration produced by many things that looked like a spontaneous event. What transpired was so good natured, considerably light and simple, yet lavish. The armada of Senator Bongbong’s veteran campaign started vibrating like turning forks, ticked off by the excitement of the mind and warmth of experiences clamoring for a change of collective collaboration -- that dream of organized unity, a wide culture of acceptance and inspiration, with Sen. Marcos progressively leading the Philippines. The crowd consisted of a mix of celebrities, individuals of power and authority

and everyday Filipinos. The mood was electric, with so much excitement happening around the scene -- red carpet arrivals by reigning beauty queens; the happy, yet serious government employees and the young ones, so carefree. Those in the crowd perceived the senator to be someone who believes dignity is knowing what to do with one’s life in a way of combining goals and dreams in a commitment that never ends. He is not affected by a slice of power, but is looking at results, acquired skills for a better existence collectively. As Fernandico Q. Gonong, Jr., chairman of BBMM--USA, said, “I believe in the dignity of the individual, in government represented by the law, in respect for truth and God.” Gonong has taken this huge responsibility to project the senator’s platform and marshal allies, here in this city and all over the US. “Our goal to victory for BBMM--USA needs no cheerleading. We need change, which is the essence of progress -- a tough leader who we could count with independent values,” he said. It was a gathering of courage and determination -- and only the beginning for what is to come this election season.

Your Immigration Solution Atty. RobeRt Reeves GReGoRy J. boult And nAncy MilleR MANY individuals seeking an immigration benefit in the United States encounter inexplicably long delays in receiving a final decision on a pending application or petition. Too often, individuals who find themselves experiencing such a delay are frustrated and uncertain as to what, if anything, can be done to pry loose their case and get a decision. Many simply resign themselves to waiting for the government to act. However, there are options beyond simply waiting indefinitely. One such option is to sue the government in the United States District Court (USDC) aka federal court. Not all petitions and applications for immigration benefits in the United States are processed in the same fashion. Some petitions or applications require interviews. And no decision is made until all the applicant’s files are located and given to the adjudicating officer. As a result, some cases will naturally take longer than others. However, that does not mean that United States Citizenship & Immigration Services (USCIS) has carte blanche to take as long as it sees fit to process a request for a benefit. Ultimately, there comes a point in time when a petition or application has simply been pending too long. And while administrative means exist to follow-up a pending matter with USCIS, often such action yields little or no results. It is at this point in time when an individual should consider exercising his or her rights in federal court. When an individual files a petition or an application for an immigration benefit, there is an expectation and a requirement that the government will timely process the submission. In effect, the government cannot simply let an application or petition languish – the government must make a decision within a reasonable period of time. USCIS posts its normal processing time on its

official website. These processing times typically state how many months it is currently taking to process various petitions and applications at its numerous offices. When a petition or an application is pending beyond its posted processing time, it is appropriate to consider additional action, including a lawsuit in federal court. Unreasonable delays and erroneous actions by the U.S government are nothing new. In fact, Congress passed the Administrative Procedure Act (APA) in 1946 to deal with these same problems. This act was specially designed as a “bill of rights” for individuals who have been aggrieved by certain conduct by the government. Specifically, the APA entitles individuals to sue the government when it unlawfully withholds action or when it unreasonably delays action. As an agency of the government, USCIS can be sued by an individual when it unlawfully withholds action, or unreasonably delays action, in rendering a decision on an individual’s pending petition or application. In addition to suing the government under the APA, an individual can also seek to compel the government to act upon an unreasonably delayed petition or application through a lawsuit for a Writ of Mandamus. When filing a Writ of Mandamus in federal court, an individual must establish a clear and certain claim, an administrative duty which is

plainly prescribed, and establish that no other administrative remedy through governmental process is available. In most instances this legal standard is met by showing the unreasonable delay by USCIS. While a Writ of Mandamus is a separate and distinct legal action from one undertaken under the APA, the result sought in both of these types of actions is identical - to compel the government to act when it has failed to do so in a reasonable period of time. Unfortunately, too many individuals who are victims of unreasonable delays by the government are unaware of their rights or afraid to exercise them. However, prompt action can save months or even years of unnecessary waiting. Filing a U.S. District Court action for relief under the APA or a complaint for a Writ of Mandamus are both very effective in compelling USCIS to act on an unreasonably delayed petition or application. It is important to note that neither an action under the Administrative Procedures Act nor a Writ of Mandamus orders USCIS to make a specific decision. The U.S. District Court Judge orders the USCIS to make a decision. That in itself is beneficial because, even if the decision is not positive, the applicant may be able to appeal it or renew it in another venue. An action seeking that the federal court Judge

Joe SAyAS, Jr. THIS column has often stressed the general rule that most employees should be paid overtime rate if they work more than 8 hours per day or 40 hours per week. However, there may be exceptions in the case of some who work in certain industries. It is in this instance that the employers’ classification of workers is important as it determines whether employees should receive higher wages. For instance, consider the case of Nick Cancilla, who worked as a service specialist for Ecolab, Inc., which provides pest elimination services to commercial and non-residential customers. Cancilla sued Ecolab, claiming that the company misclassified him and others as exempt from overtime, and thus failed to pay them overtime at a rate not less than one and one-half times their regular rate of pay for all hours worked over 40 hours in a workweek. The employees asked the court to proceed to trial as a class on behalf of over 1,000 service specialists. The employer objected, and argued that under the law, certain employees are exempt from overtime pay if they receive “bona fide” commission payments and are paid at least 1 1/2 times the minimum wage for all the hours they work in a week involving overtime hours, and that there remains a debate over whether the service specialists in Ecolab’s pest-control unit received that type of pay. Despite this, the court certified the class to allow the jury to determine (1) whether Ecolab correctly classified its employees as exempt; and (2) whether Ecolab’s compensation policy enables employees to actually earn twice the minimum wage. After intense litigation, both sides eventually agreed to settle the employees’ claim for

Misclassification of workers Maximizing recovery in personal injury cases is a form of wage theft $7,500,000. Another case involves an investigation by the U.S. Department of Labor (DOL) into DirecTV’s pay practices involving its cable installers. The DOL accused DirecTV, and its installation subcontractor, Advanced Information Systems, of violating the minimum wage, overtime and recordkeeping laws. DOL investigators found that DirecTV and Advance Information Systems paid employees on a piece-rate basis, which resulted in their hourly rates falling below the federal minimum wage. Installers were not paid for all hours worked nor paid an overtime premium of time and a half for hours worked beyond 40 per week. They did not get paid for time spent on unsuccessful installations, for travel time, for time in the office. They were not reimbursed for business expenses. DirecTV claimed that it was not the installers’ employer and therefore not responsible for any violation. DirecTV subcontracted with Advanced Information Systems, the company that hired the installers. However, the DOL established that the installers worked only on DirecTV installations, had all conditions of employment specified by DirecTV, drove DirecTV vans, and wore DirecTV clothing. DOL accused DirecTV of structuring the installers’ employment relationship to try to avoid employer liability and responsibility. Because of these and other facts, the court ruled that DirecTV was a joint employer of the installers and was therefore responsible for any violations of the FLSA law that the installers suffered. DirecTV was ordered to pay $395,000 in back wages and damages to 147 installers. The Cancilla case outlines the misclassification of non-exempt employees into exempt employees. Under California law, em-

ployees who are not employed in an executive, administrative, or professional capacity are entitled to overtime pay. True exempt status is determined primarily by an employee’s duties. Exempt employees primarily have managerial duties, such as managing the business, hiring, firing, and disciplining employees, deciding on employee salaries and wages, and creating work policies and procedures. The DirecTV case outlines the misclassification of employees into independent contractors. True independent contractors have the right to control the manner and means of performing their job. If the employer dictates how the worker should do the work, what tasks to accomplish and how to accomplish them, then the worker is an employee and not an independent contractor. Unlike employees, independent contractors do not have to be paid minimum wage, overtime, or missed meal and rest breaks. They do not have the same protections as employees do. Misclassification results in loss of significant wages to the employees. Misclassification is against the law. UNDER Howell v. Hamilton Meats & Provisions (2011) 52 C.4th 541, the California Supreme Court ruled that persons who are injured and who are pursuing a personal injury claim cannot recover the full amount of medical bills incurred if an insurer paid a smaller, negotiated amount to the medical provider. The Court’s ruling further limited an injured person’s right to recover for past medical expenses. In light of the Howell decision, it is even more important for a person who suffered injury to develop his/her claim for other economic damages. The term “economic damages” means “objectively verifiable monetary losses including medical expenses, loss of earnings, burial costs, loss of use of property, costs of repair or replacement, costs of obtaining substitute domestic services, loss of employment and loss of business or employment opportunities.” Civil Code Section 1431.2(b)(1). A person’s claim for economic damages apart from medical expenses are often overlooked and not pursued by inexperienced counsel. Loss of earnings are often a significant part of an injured person’s claim for economic damages. Damages are recoverable for both past and future lost earnings. To recover for past lost earnings, a person must prove the amount of income or earnings that he/she has lost to date. To recover damages for future earnings, a person must prove the amount of income or earnings that he/she will be reasonably certain to lose in the future as a result of the injury. CACI No. 3903C. How are past lost earnings proven? Medical records, which show the doctor authorizing a release from work or giving instructions to restrict work activities, can support the time taken off from work due to the injury. For those self-employed, medical providers typically do not provide a release from work; however, medical records should record work restrictions placed by the medical provider. After showing that the time off was justified, the next step is to value the lost earnings. A letter from a person’s employer that outlines the amount of time that one has lost as a result of his/her injury, the loss of benefits, and the rate of pay during the time of loss is evidence of the value of one’s loss of earnings claim. Other supporting documents include pay stubs, time cards, and tax returns. The monetary value of sick leave and vacation time that are used due to the injury are also recoverable. For those self-employed, earnings history as reflected by tax returns and profit and loss statements can help prove the value of lost earnings. Debt Relief Atty. LAwrence yAng NO one has anything good to say about the IRS. Tax collectors were much hated even during the time of Jesus two thousand years ago. Jesus was walking along the street when He saw Matthew sitting in his tax collector booth, then Jesus called Matthew to be His disciple. Client had a confirmed Chapter 13 plan since 2013. The plan paid for her 2013 income tax owed of $10K, and $50K arrears in her mortgage. These are the only creditors that she owed. She had a 2nd trust deed of $100K, which was fully forgiven by Bank of America after we filed her motion to avoid the 2nd trust deed. She had $60K credit card debt which all got discharged in her Chapter 7 case the year before. This was really an extreme reorganization of her financial affairs that we were doing. Phase 1, she discharged all unsecured debt. Phase 2, was to handle the IRS and the $50K arrears on the mortgage. Things had gone quite well. The $100K second trust deed had completely disappeared in an instant right after we filed the LAM motion. We really did not expect that Bank of America would just forgive the entire 2nd mortgage. Our strategy was to argue that client did not have to pay Bank of America anything as unsecured debt upon approval of the motion to avoid lien because the previous chapter 7 discharge wiped out the promissory note, so there was nothing to pay even as the lien was stripped. I wasn’t sure that the court would buy this argument but it was logical and legally correct.

IRS seeks to dismiss client’s chapter 13

Client with good income wants chapter 7 to discharge $70K credit cards The next step we took was to work on a loan modification for the first mortgage. This worked out really well too. Not only did Nationstar reduce payment by $800 a month, it updated the loan such that there were no more arrears. Therefore, the loan modification cured the $50K arrears. With the LM in place, client was now completely current on her mortgage. Nationstar wrote a letter to the trustee saying that the LM cured the default and no more payments in the plan to Nationstar were needed! So, the only debt left unpaid was the IRS of $10K. However, client failed to pay IRS her 2014 tax liability, which was $14K. This created a big problem because non-payment of the 2014 tax liability is a violation of the terms of the confirmed plan. A violation of the terms of the plan is legal ground to dismiss the case. Thus, the IRS filed a motion to dismiss case. To set things right, we had to oppose the IRS motion to dismiss on the ground that if Nationstar withdrew its prepetition proof of claim which showed a $50K default which no longer exists, the plan could be modified to pay the IRS in full over the rest of the life of the plan. We also filed an objection to the proof of claim of Nationstar because the loan modification wiped out the arrears of $50K. Hopefully, these will all combine to prevent the case from being dismissed. Second client is 57 years old. He had a good paying job for 20 years. He cleared $150K a year every year for the last 20 years

working 18 hours a day because he was so dedicated to his work. Although he was paid well, the kind of work he did was very stressful and it affected his mind. He would have nightmares involving what he saw at work. A lot of gore and blood, and he saw the evil that men do. He decided that it was time to start again in life without too much stress. Anyway, he had already qualified for a good pension. He said the money wasn’t worth the stress that he had to go through every day. The guy was a nervous wreck. He still owed $70K of credit cards. He owned a house with a reasonable mortgage payment of $1800 and two-car payments total of $1,000. He takes it easy nowadays. Does a little part time work here and there. His wife still works. With his pension and part time income, there’s enough to cover monthly expenses, but there is no money left to make minimum payments of $2K on his $70K credit cards. These have to go. With his fresh start in life, he will have no more $70K of credit card debt. To Live With Faith reverend rodeL g. BALAgtAs It’s hard not to be affected by the recent terrorist attack in San Bernardino, California. It’s so close to home, only less than a hundred miles away. It makes us think of our own security and that of our children. Are we all safe even to worship in our churches and to shop in public places during this holiday season? Is it safer to shop online and not experience the joy of walking and looking for the right gifts in shopping malls while listening to Christmas carols? Is this how bad it is now—to live in fear of another active shooter, another terrorist attack? This is the world that we live in now, a world gone awry with violence, terrorism, fear for life, and escapes from massacres in one’s motherland. It is a horrible state of affairs. One cannot help but become afraid, nervous and disappointed about it. A priest-friend calls the global situation we live in as a “messy manger” in reference to Ralph Wilson’s reflection, “Lord of the Messy Manger.” I would not just call it messy; I would call it diabolical. Of course, similar atrocities had happened in human history such as the killings of Muslims

Should we even celebrate Christmas this year? during the time of Crusades and the massacre of millions of Jews during the Nazi War. But some citizens of this world have never learned any lesson from this painful human history. It seems hard to fight extremists’ minds who have been brainwashed to think that it is noble and heroic to kill people in the name of God and religion. So, should we even celebrate Christmas during this horrific time of the world? I think that we still should celebrate it, keeping in mind that what we need now is divine intervention. We need God’s power over these diabolical atrocities. We need his urgent assistance to remove hatred from the hearts of men and women who cause these murderous attacks. We need God to send someone like Cyrus the Great during the time of the Babylonian Exile to defeat the enemies of our faith and to bring back peace in all lands. We need the angels of heaven to protect us and our children; we need the saints to intercede for us. We need the world leaders to come together to defeat terrorism and to end all strifes between nations. We need citizens and netizens of the world to be vigilant about people wanting to harm us; we need to pray for peace. We need one another now in this time of terror.

And we should not stop preaching about peace, justice, love and mercy either. Like John the Baptist, we’re called to be prophets to denounce all forms of suffering and injustice, to straighten all crookedness in this world. We can’t stop listening and fulfilling the longings of our hearts; otherwise we’ll let the devil win. We’ll keep longing for what is noble, righteous, joyful, loving and peaceful and all that is valuable to build the Kingdom of God in this world. Our ancestors did it and we too must do it, not just for our own sake, but for the sake of the next generations of inhabitants of this world. MANILA—For the Philippines to become the next Asian miracle, the World Bank challenges the local business community to embrace integrity in their operations and eradicate corrupt practices. Speaking at the Integrity Summit 2015, World Bank country manager Motoo Konishi said the country is currently on track to becoming the next Asian miracle as declared last year by World Bank president Jim Yong Kim. “The Philippines has done really well and will continue doing well with the right policies. I really hope that now, businesses take the role in making sure that corrupt practices do not come back. We see a new Philippines to come and lead the next Asian miracle,” Konishi said. Konishi, however, warned the country that advancing to the next stage of development is no easy task, saying it takes both public and private sector cooperation to do so.

“Everybody has to be pulling in the same direction in order for you to go to the next stage and this political fighting cannot be. Development is a very, very serious business. I really hope that the business community really enhances their services to project a new image in the economy and grow much faster than other countries in Asia,” he said. In the Philippines, these estimated illicit flows peaked at $11.6 billion in 2005 and went on a downtrend in following years, only to peak again in 2011 during which an estimated $10.5 billion in dirty money flows were recorded. The level declined to $8.7 billion in 2012, and further to $7.9 billion in 2013 which was the latest year for which data was available. Tetangco Jr. said current rules on individuals carrying cash when they travel were now out of date. “We’re looking at increasing [the limit] to a substantially higher amount,” Tetangco told reporters this week. “There’s a need to take into account more recent developments as well as increasing requirements of people traveling abroad,” he said. According to existing rules, anyone planning to take P10,000 or more out of the country—denominated in pesos—should first seek authorization from the BSP. This ceiling is set by the BSP’s Monetary Board. This little-known rule stands today. Tetangco said very few

people comply with these disclosure rules. Violations are almost never found out, and penalties are equally rare. If money is denominated in any other currency such as the dollar, yen or euro, prior authorization is required when bringing into or out of the Philippines any amount worth the equivalent of $10,000. Speaking separately, BSP Deputy Governor Diwa C. Guinigundo said rules covering the $10,000ceiling for the movement of foreign currencies were also being reviewed. Unlike the rule regarding pesos, the ceiling for which is set by the BSP, the rule for foreign currencies is part of an existing legislation, which means any attempt at liberalization would be more difficult.

MANILA—The rise of China as a world superpower can only bring prosperity to Southeast Asia and countries integrating in the region—including the Philippines—should attach themselves more with Asia’s largest economy, Singapore’s former top diplomat has said. “Historically, every time you have a vigorous China in a period of domestic ascent, it put prosperity to Southeast Asia… The rise of China (now) will bring great opportunities to Southeast Asia and a new wave of prosperity,” said George yeo, former foreign minister of Singapore. Heading the city-state’s foreign policy from 2004 to 2010, yeo considers as one of his milestones the US-led Trans-Pacific Partnership (TPP), a trading bloc of 11 countries in the Asia-Pacific which was recently finalized after five years of negotiations. Now serving as chairman of Kerry Logistics, with a network of over 550 satellite offices from Southeast Asia to Greater China and the Americas, yeo said the 10member Association of Southeast Asian Nations (ASEAN) would do well separating politics from economics. In general, relations between ASEAN and Beijing are “proceeding at peace,” yeo said, and both sides realize that benefits of cooperation far trump the costs of conflict, especially in the sea of navigation where at least three ASEAN countries and China are holding claims. According to ASEAN data, China now is the leading trade partner of the region, accounting for 11.6 percent of total exports and 17.5 percent of total imports last year. In comparison, US only accounted for 9.5 percent and 7.3 percent of shipments, respectively. China’s influence has also spread through various deals it has been sealing across the region. Last October, the country edged out Japan on bidding for Indonesia’s first high-speed rail network, while a $2.3-billion deal between a Chinese firm and troubled 1MDB investment company made the country the largest foreign stakeholder in power assets in Malaysia. Vietnam and Cambodia, on the other hand, are bound to benefit from the Maritime Silk Road China is pushing, which promotes trade across the Mediterranean Sea, including India and Africa. The case is currently being heard despite the Communist nation’s non-participation. Any possible retribution economically has been largely unfelt, thanks to the country’s minimal exposure to China. But yeo said this has a downside especially with the Philippines’ growing investment needs as its young people get more educated, as well as China’s diversification to the services sector that saw factories based there exploring ASEAN for opportunities. “The result is a big outflow of companies from China to Southeast Asia. Those countries which are best placed to receive those factories, they would grow quickly: Vietnam is a major beneficiary so to increasingly is Cambodia, maybe Indonesia,” yeo explained. “For the Philippines, too much growth driven by consumption, not by investments. The court order issued by Arenas of the QCRTC Branch 217 dated Nov. 27 was received last Friday by the parties’ respective counsels. The wording of the TRO, however, created confusion and Arenas was compelled to explain to reporters that it covered only the “accepting, processing and approving of applications.” “I’m not amending the TRO,” Arenas told Erro as he added that he was willing to inhibit himself from the case if the latter disagreed with him. In Southeast Asia, the other largest sources of illicit financial flows were Thailand (ranked 8th globally with an annual average of $19.1 billion), Indonesia (9th with $18.1 billion) and Vietnam (18th with $9.3 billion). To combat this problem, GFI said governments “should establish public registries of verified beneficial ownership information on all legal entities, and all banks should know the true beneficial owners of any account opened in their financial institution. It also urged authorities to fully implement all anti-money laundering recommendations of the Financial Action Task Force (FATF), and that “laws already

in place should be strongly enforced.” “Policymakers should require multinational companies to publicly disclose their revenues, profits, losses, sales, taxes paid, subsidiaries and staff levels on a country-by-country basis,” it added. “All countries should actively participate in the worldwide movement towards the automatic exchange of tax information as endorsed by the OECD and the G20.” GFI also said that customs agencies “should treat trade transactions involving a tax haven with the highest level of scrutiny” and that “governments should significantly boost their customs enforcement by equipping and training officers to better detect intentional misinvoicing of trade transactions, particularly through access to real-time world market pricing information at a detailed commodity level.”

ASEAN, as a whole, would need $8 trillion in infrastructure financing over the next five years, according to the World Economic Forum. Yeo said only a “fraction” of that could be provided by current multilateral institutions, hence, additional financing being promised by the Asian Infrastructure Investment Bank (AIIB) should be welcomed. The Philippines and Kuwait are the only two countries left that have not joined the AIIB. however, Manila may have been left with no choice. The Regional Comprehensive Economic Partnership, China’s answer to the TPP, has put the entire ASEAN as a bloc as its member. For Yeo, while trade agreements are attractive to most countries for its benefits such as lower tariffs and easier trade access, individual nations should be given power to decide whether or not to join. Nonetheless, this should not pave for “exclusivity” in any groupings, which will not only be in violation of the World Trade Organization rules, but could also further complicate tensions among nations. “The idea is when we can work together, we work together. When we are unable to move together, but others are able to, let’s not stop them,” he explained. Over 200 free trade agreements are present in Southeast Asia and the Pacific and for Yeo, their existence is proof that nations and their leaders are able to look past political misunderstanding for the greater good. “The South China Sea is a problem but I don’t think it is, by any means, an insoluble problem. It cannot be resolved because the Philippines cannot renounce its claims. China cannot renounce its claims and each claim is incontrovertible,” Yeo said.

The importance of on-road emissions testing by AidA

THE importance of on-road emissions testing was highlighted last week when the United States Environmental Protection Agency (EPA), the California Air Resources Board and Environment Canada discovered illegal software in some Volkswagen, Audi and Porsche diesel cars with 3.0-liter V6 engines encompassing model years 2014 through 2016. Audi and Porsche are the premium brands of Volkswagen, which disputed the findings and pledged to cooperate with the EPA “to clarify the matter in its entirety.” In September, VW admitted that it had installed deceptive software in 11 million diesel vehicles to make it appear that they met air quality standards for nitrogen oxide, which is harmful to the lungs. VW acknowledged its scheme after a year of disputing the findings of the EPA, which on September 18 ordered the recall of nearly half a million VW 2.0liter TDI diesel vehicles in the United States. Subsequently, the German government ordered VW, Europe and Germany’s largest auto manufacturer, to recall 8.5 million cars in Europe with the

tainted software. In the new tests, the cars found to have the software installed are the diesel versions of the VW Touareg, the 2015 Porsche Cayenne and the 2016 Audi A6 Quattro, A7 Quattro, A8, A8L and Q5. Regulators have not found similar illegal software on diesel models produced by other automakers. The new tests were conducted randomly and in real-world conditions on the road rather than in traditional laboratory settings by automobile industry regulators in the US and Canada. US regulators believe that while road tests cannot match the precision of lab results at detecting nitrogen oxide and other fine particles and pollutants, they do validate lab findings by catching cars whose road performance reveals higher emissions readings. Road testing involves capturing exhaust gases with a machine the size of a pair of large suitcases that fits in the trunks of most cars, with a few pieces hanging off the back. The technology developed by an EPA engineer is decades old and until now has been used mostly to test diesel trucks. Explaining its findings, the EPA said VW’s devices were set up to defeat a federal emission procedure known as FTP 75. The EPA

described how once the vehicle’s electronic brain detected the car was being tested, it would direct the car to operate emission control parameters- including injection timing, exhaust gas recirculation rate and fuel pressure – to reduce nitrogen oxide emissions. Once back in normal driving conditions, the car would increase the release of nitrogen oxide up to nine times EPA’s standard. Also, VW admitted it had understated emissions of carbon dioxide for about 800,000 of its vehicles sold in Europe and overstated the cars’ fuel economy, including a limited number of gasoline-fed cars. Most of the cars with the carbon dioxide problem have an engine known as the EA 288, of which there are 1.4-liter, 1.6-liter and 2.0-liter versions. Meanwhile last September, VW Philippines announced that none of the vehicles it sells has the deceptive software and that all its vehicles comply with the Euro 4 air quality standard (50 parts per million), which takes effect on January 1. As the only Philippine affiliate of the FIA (International Automobile Federation), the Automobile Association Philippines supports the FIA’s global campaign for clean air and sustainable, environment-friendly motoring.

AT least 1,500 people a year could avoid getting injured or killed on the road, government and university researchers say, if road rage could be eliminated. How to stop it One way to do that, according to study.com, is to reduce tailgating, especially by young drivers. The Hartford Courant found the most common “contributing factor” noted by police in crashes caused by new drivers was following another vehicle too closely. Most crashes where tailgating was the primary causal factor happened between 2 and 3 p.m., about the time high school classes are done for the day. In other words, the typical crash caused by a 16- or 17-yearold driver doesn’t involve a car careening off the road during a boozy, late-night joyride. The cause Tailgating is so high on the list of accident causes because stopping involves more than just applying the brakes. It also includes perception time (realization that you need to stop) and reaction time (moving your foot to the brake pedal). At 60 mph, by the time the vehicle begins to slow down, it will have traveled more than 130 feet. Most drivers know they should maintain a minimum of three seconds between a car and the vehicle in front. However, depending on factors such as vehicle condition, size and type, speed,

time of day, road and weather conditions, and visibility, the time it takes to fully stop can vary dramatically. For example, a wet road can quadruple the time required to fully stop, and increasing speed from 35 mph to 55 mph nearly doubles the required stopping distance. What you can do If you find that another vehicle is tailgating you, remain calm and don’t let ego get in the way of safety. Do not slam on your

brakes, honk your horn or use angry gestures. Instead, if there is an alternate lane, safely move over so the other car can pass. If you can’t move over, slowly increase the distance between your car and the one in front of you. That way, if the tailgater hits you, you’re less likely to hit another car.
