ARCO/Murray Laundry Division gets TV show spotlight
DELRAY BEACH, Fla. — How2Media, producers of the TV show World’s Greatest!..., have selected ARCO/Murray Laundry Division to be part of the ION Network series.

How2Media sent a film crew to Miami to meet with the ARCO/Murray team at the site of one of its recently completed projects. The objective was to learn the story behind the story of the growing company.
World’s Greatest!... is a 30-minute show dedicated to highlighting the “world’s greatest companies, products, places and people,” How2Media says.
Each episode features behind-the-scenes footage, informative interviews, and exciting visuals.
The episode featuring ARCO/Murray had not yet been scheduled as of press time.

Alliance Laundry Holdings to acquire Primus Laundry Equipment Group
RIPON, Wis. — Alliance Laundry Holdings LLC, the parent company of Alliance Laundry Systems, has signed an agreement to acquire Primus Laundry Equipment Group. Terms of the pending transaction were not disclosed.
Primus Laundry Equipment Group is headquartered in Gullegem, Belgium, with production facilities in Pribor, Czech Republic, and Guangzhou, China;
and sales offices in France (Lyon), the United Arab Emirates (Dubai), Spain (Barcelona) and Hong Kong.
Primus Laundry Equipment Group markets commercial washer-extractors, tumbler dryers, ironers, and feeding and folding equipment under the Primus, Lavamac and Deli brands. It has annual revenues of approximately 87 million euros (approximately $120 million).
“We are very pleased to have the Primus organization join our company,” says Mike Schoeb, Alliance Laundry’s president and CEO. “We view their management team, product breadth, distribution, quality focus and commitment to reliability as complementary to our global reach.”
Primus Laundry Equipment Group CEO Eddy Coppieters says the company is “...excited to join the world leader in commercial laundry. Joining the Alliance team at this point is good for our employees, our customers and the industry.”
Completion of the transaction, which is expected to close prior to the end of this month, is subject to customary closing conditions.

ALEXANDRIA, Va. — The start of a new year affords many opportunities for businesses, among them the acquisition of new customers.
At the heart of these partnerships lies a document outlining the responsibilities that both parties must adhere to—a contract.
The Textile Rental Services Association (TRSA) explored this topic in relation to the textile rental services industry in a recent webinar titled What’s New in Customer Contracts for Textile Services Companies, which featured Steven John Fellman, member of TRSA’s general counsel and attorney with GKG Law.
CONTRACT BASICS
Speaking in general terms, Fellman defined contracts as a written document describing the agreements that both parties enter into, and should explain to the
customer what is expected from them, and what they can expect from the business.
“The responsibilities of each
[party] should be clearly laid out in the contract and it should be signed and dated by authorized representatives of the parties to the

CHICAGO — Many laundry/linen operators are on the move, as 88.1% of industry managers polled say their laundry transports goods to/from the plant by truck or van, according to results from February’s American Laundry News Your Views survey. Just 11.9% of respondents do not transport laundry/linen to/from their facility.
Of those that deliver, 71.2% say they “transport all goods [they] process,” while 18.6% say they only transport “a portion of goods [they] process.”
Roughly 10% of respondents do not transport any goods they process off their premises.
When it comes to their fleet of trucks/vans, some operators transport the goods they process with just one van, while others deliver their laundry/linen using larger vehicles.
“Basically we have airport shuttles,” one says, while another operator explains that his/her facility utilizes a fleet of nine tractor-trailers and two straight trucks.
While some only spend $400 a month to fuel their vehicles, others spend as much as $45,000 on diesel fuel for their trucks.
Even in the face of rising fuel costs, 93.2% of laundry/linen operators say they do not utilize alternative-fuel or hybrid electric delivery vehicles for their operation, while only 6.8% say they operate such vehicles.
And in terms of whether they plan on buying or leasing alternative-fuel or hybrid electric delivery vehicles within the next year, 77.6% say they have no such plans, while 19% say there is a possibility. Only a sliver of respondents (3.4%) say they are interested in making such an investment.
One operator has taken a different approach in an attempt to lower his/her operation’s fuel costs. “We installed a bulk diesel tank last year and began fueling our fleet on-site. We realized a 20% savings to fuel cost.”
In lieu of purchasing new vehicles, many operators say they’ve reconfigured their route schedules to cut fuel expenditures.
“We rerouted our delivery schedules and are reducing the delivery frequency from seven and six days per week, to six and five [days],” one says.
“New vehicles use more diesel fuel than older vehicles,” explains another operator. “This is due to all of the added emission features that are now required on newer trucks. We have modified routes in an effort to drive less miles.”
While the Your Views survey presents a snapshot of readers’ viewpoints at a particular moment, it should not be considered scientific.

Cintas clears up top Hazard Communication misconceptions
CINCINNATI — OSHA recently revised its Hazard Communication standard to adopt the Globally Harmonized System of Classification and Labelling of Chemicals (GHS). To help organizations navigate HazCom requirements, Cintas Corp. says it has debunked six popular HazCom/ GHS myths:
1. Only people using chemicals need to undergo training.
Training is required for any employee who will be exposed or potentially exposed to chemicals under normal workplace conditions. People who are only “occasionally” in the vicinity of chemicals are exempt from the rule. If it’s unclear whether employees need to be educated about hazardous chemicals, organizations should conduct training to be safe.
2. Temporary workers don’t need to be trained.
OSHA is making a big push to ensure organizations train temporary employees properly. Oftentimes employers solely focus
on educating full-time employees or assume that temp agencies have trained outside contractors. However, there are certain details that temp agencies can’t prepare these workers for, such as the location of Safety Data Sheets (SDS).
3. HazCom violations won’t break the bank.
OSHA bases violations on the seriousness of the offense, ranging from “general” to “serious/willful.”
The average fee per violation will likely be $900-$1,100, although OSHA is considering increasing fees to encourage better compliance. If a chemical-related injury or death occurs, an organization will face severe fines and brand perception issues if employees were not properly trained, Cintas says.
4. HazCom violations occur infrequently.
HazCom violations are actually frequently included in OSHA’s top 10 violations each year.
Preliminary estimates for 2013 ranked HazCom violations second with 6,156 incidents and once all
data is collected, this number is expected to rise due to noncompliance with GHS guidelines.
5. Current chemicals must be disposed of because they lack the proper labels.
The deadline for applying new chemical labels will not arrive until June 2015. This gives organizations time to use up current chemicals and reorder new inventory. These new shipments will arrive in containers with the revised labels. Employers should wait for the chemical manufacturer or distributor to provide the new labels.
6. All HazCom/GHS training is the same.
Not all training is created equal; employers must ensure they provide effective education. It’s best to offer a blended approach that relies on DVD, online and instructorled courses in multiple languages, Cintas says.

Take care not to fall into ‘life traps’
Many years ago when I lived in Milwaukee, one of my friends drove for the local bus company. Whenever we got together, he talked about how much he hated his job and could not wait until he got enough years in so he could retire and move out West. He did not like what he did for a living nor the area of the country he lived in. His unhappiness made it difficult for me to be his friend.
When I worked in Memphis, Tenn., there was a plant manager by the name of Charlie Barnes. He was full of energy and always looking for a way to improve our operation. Charlie normally came up with two or three ideas a week. This volume of suggestions can get annoying at times but through his efforts we found one or two great ways to improve our operation each year. I decided early on that the benefits created by his enthusiasm and drive were well worth whatever efforts were needed to manage his never-ending supply of ideas.
I learned two important things from these two men. The first lesson is that life is too short to be stuck in a job you cannot stand.
We all need to work to pay our bills, and we will all work a majority of our lives. It is important that we find a career in something that we enjoy. We should look forward to going to work and facing the challenges of a new day. When we like our job, it is easier to put in the extra effort to excel. When we like our job and have a positive attitude, it is easier to make the workplace enjoyable for us and our fellow employees.
The second lesson I learned is that we must constantly strive to improve our performance. Never be happy with the status quo.
It is easy, after five or 10 years on the job, to say that you have perfected the operation of the laundry and there is nothing new or different that needs to be done.
Charlie never accepted the status quo; he was always looking for a better way to process laundry. The majority of his ideas centered on new ways to sort, wash or process the linen. His emphasis was not on new or additional equipment, but on how he could use what was available to do a better job.
Too often, managers fall into the trap of believing what is needed to improve operations is a new or different piece of equipment, then throwing up their hands after learning the money is not available, exclaiming nothing more can be done to improve operations.
I know of managers who so wanted a new laundry or a new major piece of equipment that they said they had to have it or the laundry could not continue to operate. Administration believed them and decided it was better to close the laundry and farm out the work to another laundry on their timetable than to wait for that predicted breakdown.
I have also learned that one of the greatest challenges any manager can face in his/her personal development or laundry operation is the notion that he/she knows it all.
Our industry is constantly changing. The educational levels of new managers continue to increase. Finding a manager with the correct mix of formal education and hands-on experience is still a challenge. The pendulum on which is more important swings back and forth on a regular basis.
I have been writing articles on laundry-related topics for more than 20 years. My greatest challenge is to avoid the feeling that I know all there is to know about the laundry business. I watch the emerging trends, identify technologies or political events (such as the new minimum wage of $10.10 per hour for federal contracts), and look for opportunities and how they will impact my laundry and our industry.

“You’re going to be agreeing to purchase and install substantial inventory of uniforms and linen, and you need to be able to protect that investment,” says Fellman.
“The only way [to] properly protect that investment is if you have a contract, and the contract is one that can be enforced by a court.”
Being straightforward in defining a contract’s terms and agreements is crucial, according to Fellman, who stresses that if the contract is not enforceable in court, it “really isn’t worth anything.”
CONTRACT DISPUTES
Not every partnership that a customer and a business enters into will be “smooth sailing.”
Somewhere along the way, a customer may complain about various aspects of the service, among them its price.
“Once a consumer believes that they can buy the same service at a cheaper price, the customer is going to look for a way to go with the competitor, provided that the customer isn’t really happy with your services,” says Fellman.
In other cases, according to Fellman, it could be about the quality of the service itself.
“There are many cases where the customer is really not getting the service to which he or she is entitled. If the customer is not getting the service, the customer will look at ways to see how they can get out of that contract.”
In cases of dispute, Fellman explains, “The judge assigned to look at that contract reads the contract and asks himself, ‘What are the responsibilities of the parties, and is the contract reasonable?’
You may say that that’s not what the judge is supposed to do [but] the judge is supposed to apply the law.”
“The judge will look to be fair and will try to settle disputes on a basis of what’s fair for everybody, what’s the best thing,” he adds.
“In many cases, what’s a middle ground that’s reasonable?”
CURBING CUSTOMER DISPUTES THROUGH CONTRACT TERMS
Though he advised that laws can vary from state to state, there are various contract terms and clauses that a textile services provider can add when drafting a contract for a prospective customer to curb contract disputes.
Among them, a notice of breach requirement with an opportunity to correct a problem.
“Under this type of clause, the contract provides that if the customer feels that your service is not what it should be, or your delivery is not according to the schedule that’s necessary, the customer has
to notify you of the problem,” says Fellman. “Then, you have a certain amount of time to correct it.”
If the clause is present in the contract, Fellman explains, the judge will ask if the customer has ever notified the operator in writing regarding their dissatisfaction with the service.
“If the customer does not notify you, then the judge will very well hold that the customer had an obligation to notify you.”
One other clause highlighted was in regards to an operation’s pricing and delivery updates, saying that operators should have the right to be able to increase service price periodically.

“If you don’t provide that right in your contract, then the price that’s set in your contract is the price that’s going to be there the entire term of the contract,” Fellman says. “There have been some states where law says if you increase your prices, you have to provide notice to the customer, and then the customer has an opportunity to object. If the customer objects to the price increase, then you have to either keep the price where it is, or decide you have the right to cancel the contract.”
In relation to pricing, he also spoke about surcharges. “If you have pricing terms such as energy surcharges, or surcharges relating to environmental matters, you have to be sure that those charges are based on energy usage or environmental cause.”
One other aspect Fellman touched on was the importance of keeping a contract up to date.
“In this respect, we recommend you have all your contracts that are basically one-year contracts resigned at least every three years,” he says. “Generally, the court likes to see a fairly recent document.”
In terms of a contract’s duration, some operators and customers may enter into an automatic renewal, or an “evergreen” contract, which Fellman says operators should be mindful of.
“Some states now have prohibited evergreen clauses [which is] basically an automatic renewal without any notice, and it goes on forever,” he says. “Courts have reasoned that that’s unfair. Some courts have provided that before an evergreen clause goes into effect, you have to notify the customer a certain amount of times to object.”
KEEPING RECORDS
“When negotiating agreements, you’re going to have complaints,” says Fellman, stressing the importance of keeping records of complaints, and most importantly, how the company responded.
“It’s important that you have this kind of record, because in the event that somebody sues you or alleges breach or failure to provide adequate service, you want to be able to [provide proof].”
Another way to eliminate litigation would be to periodically visit the customer and create a line of communication, adds Fellman, saying that linen customers should be given the name of a specific point of contact.
“Giving the customer that kind of information is something that the customer wants to see,” he says.
OTHER LEGAL ISSUES
One legal issue that operators can run into is a third party inducing a customer to breach his/her contract with a current service provider.
“This means that you cannot go to an account served by another textile services company and offer that customer a lower price if the customer throws out the competitor,” according to Fellman.
However, there can be special cases. “If the customer initiates
the contact, that means if the customer calls you up, you don’t have to ask whether the customer has an account with a competitor. And, legally, you can serve the customer even if you know that the customer has a contract with a competitor.”

Something else that operators can do is visit a customer and express interest in serving their account once their contract with the competitor expires. In this case, however, Fellman advises operators to not act as a lawyer for the prospective customer.
“Let the customer get his own lawyer. What’s going to happen in those cases is the competitor is going to sue you and … the cus-
tomer. And the customer is going to realize that unless he proves that you’re the problem, the customer is going to be liable and … is going to turn on you.”
Another legal issue to avoid: violating allocation and antitrust laws.
“You can’t sit down with a competitor and say, ‘I won’t take your customers if you don’t take my customers,’” says Fellman. “You can’t sit down with a competitor and agree on a price … and say, ‘You take the east side of town and I’ll take the west side of town.’”
THE MOST VALUABLE ASSET
“In litigation, the only winners are the lawyers,” says Fellman, saying that lawsuits are expensive and require use of valuable company resources, and may take years to resolve.
To curb this, Fellman stressed the importance of creating “a system for identifying potential problems before the customer becomes so unhappy [he/she] wants to quit,” as well as addressing customer concerns promplty and fairly.
“You have to know that in dealing with your customers, they’re your most valuable asset and you have to protect them and have contracts that are reasonable, that are meaningful, that are enforceable.”

COLUMBUS, Ohio — John Osborne Eckhardt, former owner and CEO of laundry and drycleaning supplier EJ Thomas Co., died Jan. 30 at the age of 83, the Textile Care Allied Trades Association reports.

AmeriPride implements initiatives to celebrate 125th anniversary
MINNEAPOLIS, Minn. — Marking 125 years of dedication to product excellence and customer service, AmeriPride Services is implementing several 2014 initiatives to celebrate the company’s anniversary and recognize its customers, employees and communities served.

AmeriPride will celebrate its milestone anniversary in a variety of ways. Highlights will include a 125th anniversary logo to signify and celebrate the company’s rich heritage of service; events at the company’s local branches; customer appreciation and employee recognition efforts; and community service and outreach activities.
It has also developed a corporate history book, and will host
an anniversary celebration for company leadership, business partners and family shareholders in June.
“We’re proud of our longevity in the industry and growth as a company, as well as the positive impact we’ve made on the businesses and communities we serve,” says Evans. “Through it all, our commitment to the customers, personalized service and innovation has sustained the company for more than 125 years. And there are not a lot of businesses that can say they’ve been around that long.”
George and Frank Steiner founded the company in 1889 in Lincoln, Neb., making deliveries using a green and white handcart. The cart was upgraded to a horse-drawn wagon and eventually the brothers moved to separate cities to expand the company. The business expanded into Canada in 1925 and consolidated its branches in 1948. AmeriPride now has more than 115 branches and service centers across the U.S. and Canada.
