I

’ll be the first to admit this… I do not make an attractive female. How do I know this? Well… I once wore a wig. I’ve seen the pictures and according to urban legend, a video exists. Why would I do that you ask? For a wonderful and worthy cause, of course! Annually, the Austin Apartment Association plays host to a talent show that serves as a fundraiser for the American Red Cross of Central Texas. During crisis situations, The Red Cross gives back to our community and residents and quite simply, this is our opportunity to give back to them. I can think of no better way of doing this than to watch some talented individuals perform for us from within our Association Family! We’d love to see you and your friends there; and if you have a talent that you’d like to share with us we’d love to witness it! Remember this is open to anyone and everyone and this year the event will take place April 28th; plenty of time to get it on your calendar! The talent show is just one of numerous events during March and April that we have going on for our members. This one raises money for a worthy cause and our annual Spring

Golf Outing will take place at Top Golf for the second year and raises money to benefit our Political Action Committee (PAC). Our PAC funds have definitely been given a workout over the last few years as the Austin Apartment Association navigated the turbulent waters associated with the Source of Income Ordinance. Make sure that you show your support for the AAA PAC and in the process show us what you can do on the Top Golf Course. PAC dollars are critical to the ongoing well-being of the rental housing industry and will help us maintain a strong and ever-present voice at all levels of government. So far this year we’ve discussed holding other events to specifically raise funds for our PAC and we hope that these will be welcomed warmly as we expect them to be fun and social events in an informal setting. We still think that the best way to be directly involved in our effort to stay relevant at all levels of government is by joining Club MED, where MED stands for Making an Economic Difference. Our industry is vulnerable to adverse action by state and local government and joining Club MED is one way to show your direct

support for the efforts placed forth for the benefit of all members of the Austin Apartment Association. For more information about joining the club you can check out AAA’s website or simply ask any staff member. As always, I’m available to help answer any questions that you may have, so if you see me around please feel free to stop me and ask anything. I’m here to help. I would love to say that as the temperatures start rising that outdoor events will start to ramp up, but the truth is (with the exceptions of a few days) it never really got too cold in Central Texas this winter. With Austin providing more and more avenues for entertainment, I hope you guys continue to keep showing up to association events in record numbers. I’m amazed at the ability of our membership to continue to show up and support our association. The volunteers who donate their time to AAA are second to none and are a huge reason this association is so successful. To all of our membership, thank you for all you do; your efforts definitely do not go unnoticed.

he past two years have produced the most prosperous and active development cycle in recent history. And while construction in 2015 was tempered by weather and permitting constraints, the year ended with over 9,300 new unit additions and absorption levels that covered almost 96% of the net unit additions. Rental rate increases were unparalleled with an annual average gain of 6.4%, to reach $1.34 psf, while occupancy remained quite stable, ending the year as it began at 94% – despite the plethora of new units entering the market.

While 2015 met many forecasted expectations, it has actually been a remarkable six-year cycle. During

this time, rent growth has averaged an increase between 5-8% and absorption has nearly equaled or rose above completions. However, many wonder how long this will last, especially since new completions are expected to increase dramatically. During 2016, it is expected that new deliveries will increase 37%, putting nearly 15,000 new units into the market. Thus far, developers do not appear to feel threatened by the general market or financial changes, as new submittals doubled over the prior year and new starts pushed forward. For now it seems the true demand is in the more affordably priced Class B and C units

that are averaging around $1.26 psf. Occupancy in these units is hovering near 96%. However, these prices are steadily increasing, as over a third of the market has or is upgrading to at least faux wood floors, 2” blinds, brushed nickel hardware, new appliances, ceiling fans, granite counters, cabinets, paint, hardware and lights. The expense seems to be paying off. Currently, stabilized Class A product reflects an occupancy rate near 95%. A potential threat to that is the recently added (and more to come) new product with an excessive price point (~$1.66 psf) that could deter new renters. Look for 2016 to bring about additional sales, rent challenges in pockets, heightened completions and positive absorption to continue.

focus on compliance with the austin energy audit program

I

n 1990 the Austin Green Building Program was born and it helped usher in a new era of green building and sustainability trends across the country that continues today. In 2009, after successfully altering construction practices, the City of Austin took aim at excising structures and again set precedent by adopting an ordinance implementing its Energy Conservation and Audit Disclosure (ECAD) program. The ECAD program began by stipulating that all single-family homes must have an energy audit prior to the sale of the property and provide a copy of the results of the audit to prospective purchasers. A report to Council dated August 1, 2014 indicated that more than 10,000 homes had an ECAD audit. In 2011 the ECAD requirements extended to apartment buildings. ECAD defines multifamily properties as any property with five or more residential units. The rules require that apartment buildings greater than 10 years old must have an energy audit or perform an audit within 10 years of the completion of construction. The same 2014 report cited above stated that nearly 850 apartment communities had an energy audit and were in compliance with the ordinance. The Austin ECAD audits investigate air conditioning and heating system efficiency, air filtration, duct performance, air sealing in plumbing areas, weather stripping, windows and attic insulation. The aim of the ordinance is to find inefficiencies and spur energy efficiency improvements such as air sealing and insulation in order to provide more comfortable and desirable spaces for tenants. Tenant surveys indicate that tenants living in an energy efficient unit are more comfortable in their units, more confident paying rent and utility bills on time and likely or very likely to renew their lease. present a tremendous opportunity for energy savings. Comprehensive, costeffective upgrades in multifamily buildings can improve efficiency by 15-30%, representing an annual sectorwide savings of almost $3.4 billion. To help offset the cost of improvements; Austin Energy provides a wide range of rebates to owners for making energy and water efficiency upgrades. The aim of the ordinance is also to help educate tenants. The City of Austin promotes the ECAD ordinance as a way to help tenants avoid the surprise of high energy bills in the unit before a lease is signed. Austin Energy publishes a guide that provides residents with an estimated average monthly energy cost and encourages renters to use the guide as a tool to compare properties. The City also offers an online data portal to help tenants search for energy-efficient apartment properties in the Austin Energy service area. In 2016 the City of Austin will focus on ECAD compliance to ensure that that Austin multifamily properties ten years or older have completed an energy audit of the residential units. A review of the ECAD requirements is as follows: • The property owner or manager is responsible for making sure the ECAD audit is done. • Energy audits must be done for all properties within the city limits served by Austin Energy the year the complex turns 10 years old. New audits must be conducted every 10 years thereafter. • A qualified ECAD Energy Professional must conduct the audit. ECAD audits are comprehensive and require specialized equipment. The Energy Professional provides a copy of the energy audit to Austin Energy as well as Audit Results to provide to residents. ECAD energy professionals set their own prices and it is recommend that properties you get at least three estimates and check references.

• Energy audit results should be posted at the complex for all current and prospective residents to review. • For current residents, the property owner or manager must give a copy of the audit results when requested or automatically provide it before current lease is renewed. • For a prospective resident, the property owner or manager must provide copy of the audit at lease application before any application fees are paid. An apartment community is exempt from the ECAD requirements if it received an Austin Energy Rebate within the past 10 years for comprehensive duct remediation work and /or replacement of air conditioning equipment for all units. If your community is exempt it will receive an Energy Audit Exemption Certificate proving the exemption. If, after the ECAD audit, the property is tagged a “High Energy Use” property it must take measures within 18 months to reduce energy use by 20%. A high energy use property uses more than 150% of the average energy of other comparable multifamily properties in the Austin Energy service area. High Energy Use properties must provide tenants and prospective tenants a High Energy Use report before any lease is signed or renewed. As with any adopted ordinance, there are penalties for non-compliance. Non-compliance with ECAD is a Class C misdemeanor with fines from $500 to $2,000. Anyone may file violations with the City of Austin Municipal Courts for review and action. aaa part of real estate coalition INDUSTRY UPDATE

I

n attempt to secure needed changes to the Parkland Dedication Ordinance proposed by city staff, the Austin Apartment Association was invited to join a coalition of organizations that included the Real Estate Council of Austin (RECA), the Greater Austin Home Builders Association (HBA), the Downtown Austin Alliance and the Austinites for Urban Rail Action (AURA). This coalition of property management, land planning, real estate and development organizations worked to overcome provisions in the proposed ordinance that would have made it difficult for apartment communities with greater than 375 units to be constructed due to exorbitant land dedication and fee requirements. The coalition also took aim at other issues such as credits for privately maintained park land open to the public and the criteria used by the City to exact land and fees. Changes to the ordinance were crafted and these changes were communicated to member of the City Council at faceto-face meetings involving all members of the coalition. At these meetings, Council members vowed to make the changes and expressed their respect and appreciation for all for the work done by the organizations involved and stated a strong desire to see similar cooperation in the future. This partnership with allied organizations will be useful in the near future when addressing concerns related to the pending Tenant Relocation Ordinance. At this time it is not clear what impact the pending ordinance will have property managers and land developers, but when those impact do become known the Austin Apartment Association is prepared to engage our allied organizations for the betterment of the industry. Functional Zero

As recently reported, organizations involved with housing veterans as part of the Mayor Challenge to End Veterans Homelessness now claim that Austin had reached “Functional Zero” in its effort to place veterans in permanent housing. This important “Functional Zero” milestone was achieved through the work of many stakeholders and in strong partnership with apartment owners and managers, many of whom are you - our AAA members. “Functional Zero,” (a term used by the Veterans Administration and the Housing and Urban Affairs Department), means at any point in time, the number of veterans experiencing sheltered and un-sheltered homelessness will be no greater than the current monthly housing placement rate for veterans experiencing homelessness. To keep Austin at Functional Zero, AAA will continue its outreach efforts to find units to house veterans. Housing veterans has many appealing aspects including: • Knowledgeable help with how veteran housing programs work • Strong support services for the veterans being housed and direct connections to case managers to ensure rental success • Funding for any make-ready repairs needed and for any damage caused by the tenant • Expedited procedures by all involved • Up-front rent “Buy Down” payments It is important to note that for 2016 an increase has been made to the individual housing assistance provided veterans. Veterans housing assistance has been increased to $992 for a one bedroom unit and $1,239 for a two bedroom unit.

“Point in Time” Count

Members of the Austin Apartment Association were among the 500 volunteers who fanned out before sunrise on January 23 searching for those sleeping outside in the cold. The volunteer effort was part of the annual “Point in Time” count of homeless. The United States Department of Housing and Urban Development requires cities to count the homeless as it is tied to federal housing programs. The preliminary results of the count are promising. The 2016 count continues the downward trend of homeless people found and among those found the percentage of veterans found greatly decreased. The Point in Time count illustrates that homelessness continues to exist for veterans. However, the good news is that while veteran homelessness continues the placement of veterans in permanent housing is occurring at a rapid pace. The number of veterans housed in Austin has increased by fivefold between 2011 and today, and that the wait time for veterans to get placed in housing has been reduced from 238 days to 83 days.

he “Millennial Generation.” It’s those born in the late 70s through 2000. Those coming into young adulthood in the digital age. Why are we so concerned with the “Millennial” label and this generation? Because they make up 25% of the U.S. Population. Because they have over a trillion dollars in direct buying power. Because they are some of the most tech-savvy, driven workers in the work force. Because they are the future of our association. That’s why. The AAA Young Professionals group has been around for a little over a year now and is ably headed by chairs Josh Nichols, Westlake Home & Commercial, and Brian Hackworth, CAS, Impact Floors. Both gentlemen feel a passion for the YP group and see it as a way to engage the new crop of AAA members. Brian sees the Young Professionals helping the association grow because they “bring a new energy and insight into this fast growing market.” He says, “Getting an individual involved at an early point in their career, before “LIFE” really hits, will help ensure their involvement for years to come.” Brian also mentions the YP group helps “educate and excite the next generation of professionals into being the best in their field, thus

WENDY DUNNAM TITA, AIA, LEED AP Page Principal nesters with the most financial flexibility on the high end make lifestyle choices about location and urban connectivity. The following are elements we see at the forefront of successful developments targeting these audiences.

Urban Minded Planning.

W

henever I discuss trends in a market niche, I first like to set a little groundwork with the “why”s. In every story about “what is hot in multifamily” you hear about market differentiation and being “one step ahead of the comps”. A really interesting development in the current multifamily market is a “bookending” of sorts in user demographics, their definitions of value, and how developers respond. The mid-twenties segment, (I refuse to use the “M” word), makes choices about what their “lean essentials” are in terms of location and size, and empty

Residents are increasingly aware of the impact of their housing choices on transportation (commute), daily connectivity to urban centers and sustainability. Developers are responding by re-thinking their planning relative to transportation, walkability, access to biking paths and access to retail, with the most important type being a grocery store. It will be interesting to see how new modes of transportation affect related parking ratios, as many people are trialing the option of going “carless” and instead relying on services such as Car2go, Uber and Lyft. When developers experience increased land costs, that translates to higher rents which are often proportional to the proximity to urban centers. In order to make these units more affordable, there has been a growing movement to increase efficiency as well

as the percentage of smaller units. On the more dramatic end of this trend are units referred to as micro apartments.

Micro Units vs the Typical Efficiency.

“Efficiency” units are a standard in the multifamily mix that merge the living and bedroom spaces. However, even in these smaller units, the kitchen, bathroom and closet spaces are comparable if not identical to one bedrooms. In the micro unit, no square foot is taken for granted. Kitchen millwork (cabinetry) often differs from the standard apartment layout by taking advantage of high ceilings instead of linear space. Occasionally a smaller appliance package is used and many times, micro units rely on a common laundry room in lieu of a washer/dryer in the unit. Bathrooms are planned with more efficient vanity space, minimal storage and often have only a shower. In the most efficient of these micro unit plans, Murphy beds replace traditional beds. High ceilings and sliding and pocket doors are very important to keep the overall space feeling generous and uncluttered.

Pet Friendly vs. No Pet Policies.

Multiple sources estimate pet ownership among renters in Austin to be between 70-75% with dogs of all sizes comprising a majority of pets. Instead of begrudgingly allowing these furry residents upon payment of a wide range of deposit requirements, properties are now being developed with pet owners in mind. Increasingly, we are seeing a number of related changes to both planning and materials that benefit all residents. Designated pet-friendly areas are being created in desirable locations that serve as a second type of park and act as “social hubs” much the way that outdoor kitchens and pool areas do. Thoughtfully placed, there are still areas for residents that do not want to experience the joys of frolicking puppy pals. Paths are also planned for quick entrances and exits so that indoor accidents are minimized. In addition, interior spaces are designed to withstand traffic, with hard, cleanable surfaces wherever possible, but especially in many hallways and elevators. Paw wash and pet spa areas help keep pets clean and the grooming outside of the unit keeps air and interior materials “fur free” longer.

Co-work vs. Business Center, Lounge vs. Lobby.

In many workplaces and multifamily properties, the traditional conference room is a space of the past. We’re also seeing traditional “lobby” spaces nearing extinction. Due in part to the fact that many of today’s residents grew up co-working in coffee shops and nontraditional work environments, we see they are far more comfortable using lounge-type environments instead of enclosed business centers. Long gone are the obligatory “study carrel” style rooms that leasing agents pointed out during tours. Today, residents working or studying outside their unit are more likely to be in a lounge space that feels like a boutique hotel

Community Gardens.

These spaces for residents to grow herbs and vegetables are very often contained in attractive, raised beds. Previously more of a trend in condominiums, this recently has been crossing over into the rental market. These areas are especially popular with the “empty nester” demographic, which is an increasingly strong market. The success of these areas is dependent on good planning, landscape design that incorporates plantings that will complement the changing garden content and continued support from property management.

Maker Spaces.

These are flexible, airy spaces that have large durable tables with plenty of circulation and access to power for tools. Deep stainless steel basins are provided for washing out non-hazardous material containers such as paint cans, ventilated spray booths that allow residents to use paint and adhesives in a contained area, and lockers for projects and tools which save residents from having to transport works in progress. These are often near bike storages and work areas so that people can easily maintain their equipment.

However, they are consistent with the move to provide increased value to people living in densified urban environments who are not interested in home ownership.

he first thing you notice about Nicholette Lindsay is her smile. It’s Cheshire long and as warm and inviting as a sunny day. Then she speaks and you realize her character is as genuine as her smile, overflowing with clever wit and natural charisma. She speaks to you as a friend and you find yourself wondering how it’s possible that this talented, interesting woman found herself amongst America’s homeless. HER FUTURE WRITTEN

Raised in Herndon, Virginia, Nicholette developed a passion for the military at an early age due to the influence of her Air Force father. Her head and heart filled with patriotic fervor, she joined the United States Army in 2000, quickly finding work as a Signals Analyst. Her job was to detect and identify foreign electronic intelligence insuring the safety of U.S. troops by providing strategic and tactical intelligence to her superior officers. Her security clearance levels were not identified with letters or numbers but with whispers and various iterations of “Do Not Discuss”. Then the events of 9/11 came to pass and the importance of her job became even more meaningful. She frequently participated in secret meetings with joint service teams and a variety of three letter agencies to analyze intercepted data of the most sensitive kind. Her success saved countless lives but there were times the information was used to target enemy combatants and during many of those times, lives were lost. It was a weight that she carries with her to this day and the foundation of the Post Traumatic Stress Disorder that would eventually upend her life. LOVE IN THE TIME OF WAR

Nicholette’s time in the army brought her rewards both professional and personal. In early part of the new century, she met and fell in love with a fellow Signals Analyst. That relationship gave her the single most important thing in Nicholette’s life, a baby boy born in 2005. “Amazing,” she says flashing that bigger than life smile, “I never understood how monumental every kick,

Nicholette Lindsay every heartbeat was until he was born.” War waits for no one, so Nicolette found herself trying to balance the demands of motherhood with the life and death dealings of her military post. Calls in the middle of the night could not be waived off or ignored. “The mission came first,” Nicholette remembers, the look on her face impossible to decipher. The missions may have come first but, unfortunately for Nicholette, the mission did not last forever. In 2011, the Army started downsizing. The loss of her job hit Nicholette hard but it was not without benefits. Untethered and open to a new adventure, she made her way to Austin with her now six-year-old son in tow to be closer to her son’s father. After getting settled, Nicholette began working on a degree in medical administration from The University of Phoenix and the future began to take shape. In late 2012, Nicholette ran into difficulties with her financial assistance and opted to leave school and enter the workforce full-time. She did contract work for Microsoft beginning in March 2014 and for over a year, she did quite well for herself. In May of 2015, though, the seeds of PTSD that had been planted a decade earlier took root and Nicholette found herself in a downward spiral of grief and depression.

The depression came quickly, incapacitating Nicholette and causing her to be hospitalized in May 2015. Her employers understood and her contract work was put on temporary hold but, with no work and no safety net, Nicholette and her son were soon evicted from their apartment. For a time, her now ten-year-old son lived with his grandmother while Nicholette lived in various shelters and tried to find work. Eventually they were reunited at the Salvation Army Shelter for Women & Children. Although not ideal, Nicholette and her son made friends and tried to develop a community with other ex-military families. Homeless shelters are not the safest places to raise a family, though, and Nicholette’s son’s safety was always a concern.

Nicholette now has a job in residential security and would one day like to become a nurse, public speaker or advocate for women in harassment situations. In the future, she would love to have more children. Right now, she wants her son to be healthy and have a happy, memorable childhood. Most of all, she wants to be present in her son’s life. Nicholette’s housing goals include home ownership. One day, she would like to have a couple of houses and become a landlord. Maybe she will become a member of the Austin Apartment Association. ousing providers have certain obligations with respect to animals that provide assistance to individuals with disabilities. This is not news to anyone reading this article. The challenge is to correctly determine when there is a legitimate need, accompanied by the appropriate animal. Multiple federal laws address housing issues pertaining to a service animal. There are state laws in Texas and local ordinances in Austin that also impact housing issues arising in connection with assistance animals. If you comply with the federal laws, you will have little difficulty also complying with the substantially equivalent state and local requirements. Yet there are noteworthy differences among the “big three” of federal housing laws, which will be discussed throughout this article. The most common federal law affecting assistance animals at rental housing, (such as apartments), is the Fair Housing Act (FHA). The FHA applies to virtually all multi-family rental housing, whether privately owned or federally assisted. The second most common federal law affecting assistance animals at rental housing is Section 504 of the Rehabilitation Act of 1973 (Section 504). This law typically applies to programs which receive federal financial assistance from the U.S. Department of Housing and Urban Development (HUD). Landlords whose only federal financial assistance is Section 8 rental assistance, however, are not subject to Section 504. The third most common federal law affecting service animals in the multi-family context is the Americans with Disabilities Act, also known as the ADA. The ADA will cover, for example, public accommodations at privately provided housing, like rental and management offices. It will not, in most situations, cover an individual rental unit, and certainly not a privately provided one. The scope of the foregoing three laws differs quite a bit. The FHA prohibits

Discrimination might arise, (with regard to assistance animals), in connection with the denial of an accommodation request from a person with a disability. Attempts to avoid policies prohibiting pets, and restricting breed, size and number of animals, are frequent topics of such requests. Section 504 prohibits landlords from excluding a person with a disability from, or denying such a person participation in, services, programs and activities in the rental housing context. Issues concerning the degree of access are common here. Must property management, for example, allow an assistance animal unrestricted access into the swimming pool with its mobility impaired owner? Under the ADA, businesses, nonprofit organizations, and state and local governments that serve the public generally are required to permit persons with a disability to be accompanied by their service animal in all areas of the facility where the public is normally allowed to go. One does not need to live at your community, for example, to enter your leasing office. Certainly an applicant or a prospect, along with delivery persons, postal workers, and other members of the general public, may have the need to enter your leasing office. The management office, therefore, is an area where the public is normally allowed to go. One’s apartment, on the other hand, is not such an area. The ADA is not readily applicable to apartment communities, from a residential rental perspective, since even common areas like the pool and fitness center restrict use by the general public. There is a great amount of confusion among apartment communities, and landlords in general, about the extent to which an animal which serves and assists is welcome at the community. In fact, according to the U.S. Department of Housing and Urban Development (HUD),

Defleaing Potential Dilemmas Posed by Animals That Serve and Assist disability-related complaints, including those that involve assistance animals, are the most common discrimination complaint HUD receives. On April 25, 2013, HUD issued its most current notice on the subject of service animals and assistance animals for persons with disabilities in housing. The scope of the notice included both housing in general and HUD-funded programs. This HUD notice specifically addresses each of the three federal laws mentioned above. It points out that in certain situations, the laws may apply simultaneously. In discussing the FHA and Section 504, HUD notes that an assistance animal is not a pet. HUD defines “assistance animal” as an animal that works, provides assistance, or performs tasks for the benefit of a person with a disability, or provides emotional support that alleviates one or more identified symptoms or effects of a person’s disability. Since assistance animal issues at residential rental properties, (notably apartment communities), are most affected by the FHA and Section 504, let us focus on those two federal statutes first. Both laws use multiple terms interchangeably for the term “assistance animal.” These include service animals, assistive animals, support animals, and therapy animals. HUD points out that these type of animals perform many disability-related functions, including but not limited to guiding individuals who are blind or have low vision, alerting individuals who are deaf or hard of hearing to sounds, providing protection or rescue assistance, pulling a wheelchair, fetching items, alerting persons to impending seizures, or providing emotional support to persons with disabilities who have a disability-related need for such support. Individual training or certification is not required for an animal to be an “assistance animal” under the FHA or

however, much more. Despite the scenario where both Question One AND Question Two are answered YES, if modifying or providing an exception to your “no pets” rule or policy would impose an undue financial and administrative burden, or would fundamentally alter the nature of the housing provider’s services, the request may be denied. For example, a landlord is permitted to refuse an accommodation for a service animal, based upon that animal’s breed, if allowing that particular breed of animal would result in the landlord’s insurance carrier dropping the landlord’s insurance coverage if that breed of dog is allowed to remain on the premises. This loss of insurance coverage creates an undue burden on the housing provider. The request for an accommodation may also be denied, despite YES answers to both Question One [is there a disability] AND Question Two [is there a disabilityrelated need], if: (a) the specific assistance animal in question poses a direct threat to the health or safety of others that cannot be reduced or eliminated by another reasonable accommodation. Additionally, in the situation of two YES answers, if: (b) the specific assistance animal in question would cause substantial physical damage to the property of others, which cannot be reduced or eliminated by another reasonable accommodation, the accommodation request will not be “reasonable” and may also be denied. A determination of the presence of a direct threat of harm, or the likelihood of causing substantial physical damage to the property of others, must result from an individualized assessment, which in turn relies on objective evidence about the specific animal’s actual conduct. Mere speculation or fear about the types of harm or damage an animal might cause cannot be considered. Evidence about harm or damage that someone else’s animals caused may also not be considered. Is it safe for your animal policy to have breed restrictions? In the majority of situations, the answer is NO. Should your animal policies restrict the size or weight of animals which you may be asked to consider as assistance animals, service animals, assistive animals, support animals, or therapy animals? Again, in the majority of situations, the answer is NO. Neither breed, size, nor weight limitations may, in and of themselves, be applied under the guidelines of the FHA and Section 504 to deny an accommodation request for an assistance animal. Yet do not overlook the undue burden [e.g. loss of insurance coverage] exception.

Section 504. HUD notes that dogs are the most common, although not the exclusive, type of assistance animal. The definition of the animal which serves and assists under the ADA, however, is significantly different. To begin with, the ADA does not even refer to an “assistance animal.” Under the ADA, it is a “service animal.” ADA regulations define “service animal” narrowly as any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability. Under the FHA and Section 504, assistance animals include dogs, cats, rabbits, chickens, snakes, monkeys, and many, many more. Under the ADA - and only since 2010 - the only animal besides a dog and that can qualify as a service animal is a miniature horse. You read that correctly: a miniature horse. In case you are wondering, a miniature horse is generally 24 to 34 inches tall, measured to their shoulders, and between 70 and 100 pounds. To qualify as a service animal under the ADA, in addition, the dog or horse must be individually trained to assist, housebroken and able to be controlled by their owner at all times. Neither the FHA nor Section 504, on the other hand, requires any training or certification for the animal. Under the ADA, emotional support animals are expressly precluded from qualifying as service animals. Not so with the FHA or Section 504. Determining the applicability of the ADA to a covered housing provider is relatively easy. Under the ADA, a covered entity shall not ask about the nature or extent of a person’s disability. To determine if an animal is a service animal, only two inquiries may be made. A housing provider to which the ADA applies may first ask: (1) is this a service animal that is required because of a disability? It may then ask: (2) what work or tasks has the animal been trained to perform? These are the only two inquiries that a facility covered by the ADA may make, even when an individual’s disability, and the work or tasks performed by the service animal, is not readily apparent. Under the ADA, moreover, a covered entity may not even make the two inquiries stated above when it is readily apparent that the animal is trained to do work or perform tasks for an individual with a disability. Examples of this are where the dog is observed guiding an individual who is blind or has low vision, pulling

a person’s wheelchair, or providing assistance with stability or balance to an individual with an observable mobility disability. Do not become too enamored with the foregoing paragraphs talking about the ADA. More likely than not, your concern with the ADA in the multi-housing context will be minimal. The two federal laws which primarily impact assistance animals for a provider of residential rental housing are the FHA and Section 504. When a resident or applicant wants to have a particular animal on your property, they will probably make a request for a reasonable accommodation, in which they will ask you to permit them to possess what they identify as an assistance animal in a dwelling. When this type of request is made, and the request will be analyzed under the FHA or Section 504 rather than under the ADA, you will again have the opportunity to ask two initial questions (although different from the two ADA questions above). Question One (under the FHA and Section 504): Does the person seeking to use and live with the animal have a disability (that is, physical or mental impairment that substantially limits one or more major life activities)? Question Two (under the FHA and Section 504): Does the person making the request have a disability-related need for an assistance animal? In other words, according to HUD, does the animal work, provide assistance, perform tasks or services for the benefit of a person with a disability, or provide emotional support that alleviates one or more of the identified symptoms or effects of a person’s existing disability? Knowing what to do when faced with requests to permit animals is much more complex than posing these two questions. Nonetheless, your inquiry should always begin with the foregoing two questions. If the answer to Question One OR Question Two is NO, then the FHA and Section 504 do not require a modification to your “no pets” policy. If the answer to either question is NO, moreover, the accommodation request may be legally denied. Let us consider a different scenario. When the answers to Question One AND Question Two are YES, the FHA and Section 504 require the housing provider to modify or provide an exception to a “no pets” rule or policy. In this situation, you must permit a person with a disability to live with and use assistance animal(s) in all areas of the premises were persons are normally allowed to go. This sounds simple enough. There is,

Remember the earlier discussion of the ADA definition of service animal? Remember how, under the ADA, individually trained dogs and miniature horses and are the only species of animal that may qualify as service animals? Remember how the ADA expressly precludes an emotional support animal from qualifying as a service animal? None of that is true under the Fair Housing Act or Section 504. Earlier in this article, two exceptions known as direct threat and fundamental alteration were mentioned. Direct threat can mean, for example, a dog which has exhibited tendencies to attack, knock someone over, and bite them. A direct threat like that is obvious. But direct threat can also have a more subtle definition. For example, when an assistance animal is permitted to deposit fecal material in a common area, and that waste is not promptly removed and cleaned up, it can be argued such a situation poses a health threat to people using that common area, particularly when the common area is where children might play on the ground. That health threat may, depending on its severity, become a direct threat. If the disabled resident is not able to clean the

waste from their assistance animal from the common area themselves, it falls on the tenant, not the landlord, to secure the services of someone to do the cleaning for them. If the owner of an assistance animal repeatedly fails to meet the cleanup burden, this could result in the landlord seeking removal of the animal (and perhaps its owner). Use of the detailed TAA Animal Addendum, for example, when an assistance animal resides at the multi-family community, is of critical importance. The concept of fundamental alteration can also be a slippery one. First, analyze a fundamental alteration from the standpoint of the goods and services offered to other tenants. When animals are not involved, a good example of a fundamental alteration is a request to maintenance staff to run errands for elderly tenants who are mobility impaired. This can be considered a fundamental alteration to the goods or services offered to the tenants by a typical apartment community. When animals are involved, a good example of a fundamental alteration is a situation where a dog “incessantly nuisance barks” and therefore keeps neighbors awake at night. This situation, arguably, results in a fundamental alteration. If not eliminated, this situation could result in a landlord becoming authorized to ban an overly noisy and uncontrolled animal, even an assistance animal, from the premises. Go back to the two permissible initial inquiries under the FHA and Section 504. They deal with whether the person making the request has a disability, and whether the person making the request has a disability-related need for an assistance animal. How do you gather the information to answer the first question, the existence of a disability? If the disability is not readily apparent or known to the housing provider, the person claiming to have the disability may be asked to submit

reliable documentation of a disability (as well as their disability-related need for an assistance animal). On the other hand, if the disability is readily apparent or known, but the disability-related need for the assistance animal is not, the housing provider may only ask the individual to provide documentation of the requesting person’s disability-related need for an assistance animal. A housing provider may not ask the tenant or applicant, however, to provide documentation showing either the disability or the disability-related need for an assistance animal if the disability, or the disability-related need, is either readily apparent or is already known to the landlord. Two important key phrases, then, are readily apparent and known to the landlord. Each is to be applied to both the disability and the disability-related need for the animal. You are within your rights to ask someone who is seeking a reasonable accommodation for an assistance animal to provide documentation from a professional in the medical or social services area. When the request which is made to you is for an assistance animal that provides emotional support, documentation may be requested from a physician, psychiatrist, social worker, or other mental health professional. You may insist, within reason, that such documentation address how, and conclude that, the animal provides emotional support that alleviates one or more of the identified symptoms or effects of an existing disability which the requesting individual currently suffers from. Such documentation will generally suffice if it establishes that the particular individual has a disability, and that the specific animal you are being asked to permit will provide disability-related assistance or emotional support. The disability and the need must correspond. There must be a clear nexus between the two. This type of documentation, however, may not be requested from the tenant or applicant if the disability, or disabilityrelated need, is readily apparent or already known to the provider. In addition, no housing provider may ask an applicant or tenant to provide them access to the requesting party’s medical records. No housing provider, moreover, may ask medical providers of an impaired applicant or tenant to provide detailed or extensive information or documentation of the person’s disabilities. When you make those inquiries, you often find yourself on a slippery slope. The www.austinaptassoc.com


determination you must make involves an individualized assessment; but your ability to gather information to make such assessment is greatly impaired. Know this: Animal restrictions (e.g. affecting breed, size, weight, and number) alone cannot be used to deny or limit housing to people with disabilities who require the use of an assistance animal because of their disability. HUD states that housing providers must grant reasonable accommodations in such instances, in accordance with the law. That law does have some exceptions. Direct threat and fundamental alteration are two of the most obvious. Causation of an undue burden is another. One more thing is critical. Once the accommodation request has been granted, and the animal which is to serve and assist begins living on the property, there is a continuing possibility that a once qualified assistance animal may forfeit its ability to remain on your property. The examples given above, involving direct threat and fundamental alteration, can easily arise once the request for accommodation has been granted, and the animal is living in your community. Where the animal becomes out of control, and its handler does not take effective action to control it, is another example which frequently arises in connection with the concept

of direct threat. Once again, use of the TAA Animal Addendum, with its leash and control requirements, is of critical importance. Stated another way, analysis of the accommodation request for a service animal does not end once the decision is initially made to permit the animal to live at the community. The owner of that animal has an ongoing duty to ensure that the health or safety of others is not directly threatened by the assistance animal. The animal’s owner must continuously ensure that the assistance animal is not causing physical damage to the property of others. Simply because an assistance animal lives on your property, you and the others who live in the multi-family community are neither required nor expected to tolerate direct threats, severe damage to the property of others, or situations which require fundamental alterations. Assistance animals are vitally important in reducing barriers, promoting independence, and improving quality of life for people with disabilities, notes HUD. This is absolutely true. Yet, as this author has previously commented in his Law in Order: The Warren Report, entitled More Than Meets the Seeing-Eye Dog (published in the July/August 2014 issue of Window magazine), fake service dogs have become a common and rapidly

growing problem. By understanding the concepts set forth in this article, you won’t become the next victim of a service animal scam.
