In the chill of the early morning hours of Jan. 24, 1955, members of the Gila River Indian community found the body of one of their friends, lying cold near a canal on a patch of desert near Bapchule, a small reservation town south of Phoenix, Arizona's capital city. A reluctant hero who became a sacrifice during a terrible war.
His tormented life was over. He was only 32 years old. But his last few years were a living hell, ignited by the horrors of combat and fueled by well-intended but misplaced homage. Now, those who knew him best silently hoped that in his death, he might find the peace that had eluded him for so many years. The coroner's report listed alcohol
and exposure as the major causes of death. It made no mention of either grief or torment, but they also were instrumental in this American tragedy. History may record Ira Hamilton Hayes as a hero but, in his own eyes, he neither deserved nor wanted the designation. The government and the military promoted him as an idol and a grateful America accepted him as one. Then, once his time in the national spotlight was over, he became a victim, a man who never asked for public acclaim but

had it thrust upon him. And it ruined his life.
Ira Hayes was a Pima Indian first, then a Marine, then an unwilling hero. The act that ushered him into an unwanted lifestyle was a chance occurrence, not a brave deed. He just happened to be there when a single moment was immortalized and, as a result, he was forced to go along for the ride, regardless of where it took him. A short timeline leading up to what

would become his downfall began on Feb. 19, 1945. American military forces invaded Iwo Jima, a small but strategic island in the South Pacific about 700 miles south of Tokyo, Japan. It was a possible supply point for the allied forces, who considered it important that they prevent the Japanese from using it as such. Hayes was a part of the landing team that was met with withering, never-ending fire from the Japanese forces who held the tiny piece of land. Four days later, on Feb. 23, the invaders had captured enough ground to take control and the officers in charge ordered a flag-raising ceremony atop Mount Suribachi, the highest point on the island at 516 feet above sea level.
But the flag they hoisted was deemed too small so the higher-ups gave the order for a second ceremony. This time, armed with a larger flag and accompanied by photographer Joe Rosenthal and about 40 fellow servicemen, six young Marines hiked to the top of the peak and planted the second banner. Rosenthal, an Associated Press cameraman, snapped the picture. Days later, the photo appeared on the front pages of newspapers all across America and the act was hailed with all the plaudits that normally accompany great feats of heroism. It was the first step along a path that

Franklin Sousley of Kentucky, Navy corpsman John Bradley of Wisconsin, Pvt. Rene Gagnon of New Hampshire and PFC Ira Hayes, the Pima Indian from Arizona. . However, many years later, military experts announced that neither Bradley nor Gagnon were among those shown raising the flag. Instead, the actual participants were identified as Cpl. Harold Keller of Iowa and PFC Harold Schultz of Michigan. Bradley and Gagnon were probably members of the crew that carried the flag up the mountain, the researchers concluded, but both probably fibbed about being one of the six shown in the infamous photo. Strank, Block and Sousley died as the fighting continued on Iwo Jima. Hayes, Bradley and Gagnon were removed from active duty and selected to tour the United States as spokesmen for war bond rallies. Each handled the assignment differently. Bradley kept his role secret, hiding it even from his family, who never knew about it until after his death in 1994. Gagnon tried to capitalize on fame but it led to business failures, divorce and alcoholism,

As I held him and assured him that he had done a terrific job, and God was certainly not mad at him, an elderly gentleman approached the table.

Vista Native Serves Aboard Navy Warship in Everett, Washington
Petty Officer 2nd Class Nicholas Rocca, a native of Vista, California, serves the U.S. Navy aboard the guided-missile destroyer operating out of Everett, Washington.
Rocca joined the Navy 12 years ago. Today, Rocca serves as a culinary specialist aboard USS Sampson based in E v e r e t t , Washington.

And Ira Hayes, the Pima Indian from Arizona, tried to run from it only to become a martyr. Rosenthal's image (which shows Hayes at the far left) was awarded a Pulitizer Prize and eventually became the world's most reproduced photograph. And the fight for Iwo Jima stands as the worst battle in Marine Corps history with more than 22,000 casualties, more than they sustained during several months of battle at Guadalcanal. Ira Hayes was not among them. Not at first.
But he was most definitely a casualty.
These days, few people on the Gila River Indian Reservation remember him but they all know his story. He was born on the reservation on Jan. 12, 1923, and died there a little more than 32 years later. In between, an act he considered unimportant pushed him onto the national stage and eventually killed him. He was a member of the Pima tribe, the eldest of eight children. Petty Officer 1st Class Paul Delacruz, a native of Oceanside, California, serves the U.S. Navy at Navy Medicine Readiness and Training Command (NMRTC)/Naval Hospital Bremerton (NHB), Bremerton, Washington. Delacruz joined the Navy 17 years ago. Today, Delacruz serves as a hospital corpsman at Navy Hospital Bremerton.
“I was inspired to join the Navy by having friends showing me the opportunities the Navy provides,”
the Phoenix Indian School, but left high school after completing two years of study and served in the Civilian Conservation Corps for a couple of months before taking a job as a carpenter. On Aug. 26, 1942, he enlisted in the Marine Corps Reserve at Phoenix for the “duration of the national emergency.” After boot camp in San Diego, he was assigned to the Parachute Training School at Camp Gillespie, also in San Diego. He graduated a month later and was promoted to private first class. Because he was a Pima, he became known as “Chief Falling Cloud” among his fellow jumpers. At the time, there were overtones of racial prejudice against Hayes and other Native Americans in the service and the nickname was construed by some to be an example. But Hayes never spoke of it. There was a war going on and he had a duty to perform. In December 1942, he joined a parachute battalion at Camp Elliott in California and sailed with that unit for Noumea, New Caledonia, the next March. The following October, the battalion saw combat at Vella Lavella in the Solomon Islands, then moved north to Bougainville where a campaign was already underway. The parachutists saw considerable action before leaving there in January 1944. Hayes was ordered back to San Diego a month later and his parachute unit was disbanded so he was transferred to Company E, 2nd Battalion, 28th Marines, of the 5th

Woman's Club of Escondido Meeting Announced - The next meeting of the Woman's Club of Escondido will be on Monday, November 1st, starting at 10:30am, at their Clubhouse located at 751 No. Rose St., Escondido. The program will start at 11:30am, and will be given by representatives from Mary Kay Cosmetics who will share their expertise and do a "Let's Make Up" program. Lunch will be a typical "Thanksgiving" meal to celebrate the November holiday. Reservations are required by Friday, Marine Division at Camp Pendleton. The company was sent to Hawaii for more training, then shipped to Iwo Jima for the attack that began on Feb. 19, 1945. He fought on the island for 36 days and came out of the battle unscathed. Yet when the war was over and all the ensuing furor came to an end, he returned to his homeland and told his friends that he felt a deep sense of guilt because he survived the assault while so many of his comrades didn't.
And it also disturbed him that the incident which elevated him to the rank of hero was something he considered minor and relatively unimportant. But the nation that elevated him to that status saw it differently. Rosenthal's photograph restored the faith of a war-weary America and became the centerpiece for a huge fund-raising drive. The War Department needed heroes and the Treasury Department needed money. Hayes, Gagnon and Bradley were selected to fill both needs. They were taken out of their unit and sent on a national tour that eventually produced $2 billion for the war effort. The three young men were proclaimed heroes by the entire nation and drinking buddies by many of their admirers. Hayes, a non-drinker until then, was too polite to refuse when an extended hand usually held an alcoholic beverage.

Each morning I kept waking up and saying, ‘Holy cow, I’m married. We’re really married.’ You say that a lot in the beginning.”
Everyone agreed with his last statement. Again, heartily.
The elderly bagger chimed in. His voice had an old-world lilt to it. “When I was growing up in New York, I met a girl when I was 12, she was 14, she lived in my neighborhood. She was the most beautiful girl I ever saw. I told her, ‘I’m gonna marry you someday.’ And eight years later I did.” Everyone gave each other an awwthat’s-so-sweet look.
The EMT lady said, “I met my husband when I was in the military. We were nothing alike, he was sensitive, into music. And I was—well—kinda tomboyish. I knew it was meant to be when he first made me laugh.”

One Person Struck by Coaster Train
On 10/20/2021, at approximately 6:30 p.m., deputies from the North Coastal Sheriff’s Station’s Transit Enforcement Unit responded to a report of a pedestrian that was struck by a northbound North County Transit District (NCTD) Coaster Train. The collision occurred near the 1500 block of North Coast Highway 101 in the city of Encinitas, county of San Diego. Upon arrival, the subject was deceased.
Deputies are investigating the incident and manner of death will be determined by the San Diego County Medical Examiner’s Office.

Hand Grenades? In North County?
Recently a female citizen walked into the front lobby of the Oceanside Police department with a grenade in a plastic bag, wanting to turn it over to police.
Staff members had the female place the item in one of the interview rooms and evacuated the lobby.
Several offices in the main police facility were also evacuated. After sending the San Diego County Sheriff’s Bomb/Arson Unit a photograph of the item, they advised

the grenade was a “training” grenade, capable of creating a small explosion but nothing of significance and referred the response to US Marine Corps explosive unit aboard Camp Pendleton. As a reminder to citizens who may have a need to turn in found explosives, please leave those items in place and have an officer respond to where the explosive is found. Suspect Held in North County Armed Robbery Series
A man allegedly held up CVS stores in Encinitas and Carlsbad; when he showed up at a CVS in Solana Beach, deputies were waiting. Sheriff’s deputies Friday night arrested an armed man suspected of robbing, or attempting to rob, employees at CVS stores in three North County cities, a sheriff’s lieutenant said. The first two robberies happened in quick succession in Encinitas and Carlsbad, according to San Diego sheriff’s Lt. William Amavisca. Hearing those two calls, deputies in Solana Beach decided to head to the CVS in their city, just in case.
The move paid off when a man matching the robber’s description showed up at the Solana Beach store, Amavisca said. He apparently aborted the robbery attempt there and attempted to elude the deputies, but was caught after a brief foot

The first holdup was reported a little after 8:20 p.m. at the CVS on Encinitas Boulevard just east of Interstate 5, Amavisca said. As deputies were arriving there to begin investigating, a man with the same description as the Encinitas robber held up a CVS in Carlsbad.
Amavisca had few details about the second robbery, because it occurred in Carlsbad police jurisdiction. He also didn’t know if the robber was targeting the pharmacies or the front counters. A team of deputies headed to the CVS on Lomas Santa Fe Drive just west of I-5, Amavisca said. As they were observing the store a little before 8:40 p.m., a man matching the description of the suspect in the earlier robberies showed up and walked inside.
The deputies called for back up and were surrounding the store when the man came out without apparently going through with the robbery, Amavisca said. He took off running and the deputies gave chase. During the short pursuit, the robbery suspect allegedly tossed aside a handgun before he was detained, the lieutenant said. He also sustained a broken leg — it was unclear how — and paramedics took him to a hospital for treatment. SOUPS of North County:

share it with our readers. •••• Picky, picky, picky . . . while speaking of restaurants, and I just was, I have a pet peeve.
Have you noticed the “up-scale” restaurants? They go all out with interior decorations, fancy menus, and very tasty but sometimes a bit pricey meals . . and then they allow their servers to come to your table in . . . blue jeans? And/or tennis shoes? Dressed like coal miners and serving in an “upscale” restaurant? Doesn’t make sense to me.
But, many restaurants have had trouble just hiring and keeping staff - maybe they have relaxed their standards a bit . . but I notice they have not reduced their bill of fare prices to parallel the “dressing down” of their serving staff. Home town and/or mom and pop restaurant, that’s fine. Upscale restaurants? Nope. Doesn’t work for me. Upscale restaurant owners need to require their servers to dress like upscale servers.
Oh, and an aside to ALL restaurant owners and mangers. Get rid of the artifical butter. It’s offensive to those of us who require real butter. The few pennies you save on pats of margarine (grease) or artificial butter projects the image of a tight-fisted restaurateur. (All of my servers know NOT to serve me artificial butter. I hold my breath and stomp my feet! That’s what I do!)

So he drank and made polite talk because he was a Marine and it was his duty. But beneath the thin veneer of this form of idolatry, there was a shy young man who simply wished to be left alone. “He was a reluctant hero,” distant cousin Sara Bernal told The Arizona Republic in a 1998 interview. “The attention thrust upon him played a big part in his early death.”
The illustrious trio appeared at bond rallies and portrayed themselves, although very briefly, in Sands of Iwo Jima, a war movie that starred John Wayne. They were brought in as actor/consultants but were on the screen for just a few minutes, were rarely asked for advice and eventually realized they were being used by the producers to market the film because of their nationwide appeal. They also met celebrities and visited the White House where President Harry Truman called Hayes “a great American hero.” But the adulation only embarrassed Hayes. “It was supposed to be soft duty,” he later told an interviewer, “but I couldn't take it. Everywhere we went, people shoved drinks into our hands and said, 'You're a hero!' We knew we hadn't done that much, but you couldn't tell them that.” And in another interview, he said, “How could I feel like a hero when only five men in my platoon of 45

survived, when only 27 men in my company of 250 managed to escape death or injury?”
The tour continued anyway. The men were sent on a 32-city junket and a million and a half people cheered them in Times Square. The press put them on a pedestal; the public wouldn't let them get down. In his book, Flags of Our Fathers, author James Bradley (John Bradley's son) wrote, “Ira, in particular, couldn't compute. It was a Beatlemania-like tour and every handclasp was like a knife in his heart because he felt like he was living a lie.”
The bright lights, the hero worship and the glad-handing began to take a toll. Hayes started drinking heavily and was removed from the bond tour in Chicago and sent back to the 28th Marines at Hilo, Hawaii. Three weeks later, he was promoted to corporal. At the end of the war, Hayes and his company were shipped to Sasebo, Japan, where they participated in the occupation of the defeated country. On Oct. 25, 1945, he boarded ship for the eleventh time and returned to the United States, landing at San Francisco where he was honorably discharged on Dec. 1, 1945. During his military career, Hayes was awarded a Letter of Commendation with Commendation Ribbon by Lt. Gen. Roy S. Geiger, the commanding general of the Pacific Fleet Marine Force, for his “meritorious and

After his discharge, Hayes returned to his home and tried to return to the life he had known before 1942. In his vain attempt to regain anonymity, he turned more inward than ever, keeping the tortured thoughts about what he had seen and done during the war locked inside. But fame held him in an unyielding grip. People drove out to the reservation to shake his hand and have their pictures taken with him. Then they told other people, and the other people repeated the scenario until Hayes was forced to leave home because it was his only hope of finding solitude. “I kept getting hundreds of letters,” he told friends. “And people would drive through the reservation, walk up to me and ask, 'Are you the Indian who raised the flag on Iwo Jima?'” With help from a relocation program sponsored by the Bureau of Indian Affairs, he went to Chicago and found a job as an assistant lathe operator with International thought that day would ever come? Threats are now to abolish the police and law and order. I can't believe this is really happening! Harvester Company. It removed him from the public eye, but the respite was only temporary. Once his employers found out who he was, they exploited him in their company magazine with an article entitled “Hero in Our Midst,” which also included his Chicago address. Then came the inevitable. Once the public knew who he was and where he was, they wanted to meet a hero. The phone calls were endless, both day and night, and people pounded on the door of his apartment, demanding that they be allowed to speak with him. The pressure grew; so did his drinking problem. Within three weeks after the article appeared, the police picked him up in a skid row area of the Loop at 1 a.m. He was staggering, his shirt was torn and he was not wearing shoes. He was sent to jail. This time, help came from an unusual source when The Chicago Sun-Times also discovered who he was, got him out of jail and started a fund-raiser to help with his rehabilitation. That led to a job in Los Angeles where everyone involved hoped he could make a fresh start and forget the reason for his situation. Hayes was grateful and said he was “cured of drinking.” But the cure lasted less than a week. He was arrested by Los Angeles police on the familiar charge of public drunkenness.

Davis, you have just presented to the world, a magnificent testimonial of raw truth and beauty with Friedrich Gomez's masterpiece cover story titled, "If America falls, the cause must spring within us" (a quote from Abraham Lincoln). It is a true masterpiece because it addresses real lives, our children's real lives, and the very real future survival of our America! Lyle, that cover story needed to be told! As a nation we can't continue to live in a "bubble bath of fantasy and delusion" that everything is okay, when our country is actually slowly dying. I can't imagine how hard it was for both you and Friedrich being former military men, and both of you defending this very country, only to see it eroding, fading, raped by rioters holding cities captive for 100 days, and now our churches and statues of Jesus Christ desecrated! And now our children's minds are in danger of being brainwashed and forever made to feel guilt and shame -which they don't deserve to have thrust upon them in their formative years and which will follow them to their graves. “I was sick,” he told his family and friends. “I guess I was about to crack up, thinking about all my good buddies. They were better men than me and they're not coming back, much less back to the White House, like me.” Frustrated at both himself and the circumstances that surrounded him, Hayes returned to the reservation once more. But this time, there was no hero's welcome and only one reporter took the time to interview the fallen idol. He was despondent and appeared to have given up on himself. “I guess I'm just no good,” he told the reporter. “I've had a lot of chances, but just when things started looking good, I get that craving for whiskey and foul up.” He thought that going back to his family might help. In the meantime, Rene Gagnon became the darling of the media. He supposedly had carried the flag up Mount Suribachi, was the youngest survivor of the episode, and willingly cooperated with interviewers. So his handsome face helped sell a lot of newspapers. But the same media that made him a hero later turned on him, producing lurid stories about his problems.
John Bradley, the Navy corpsman, avoided all the heartbreak by remaining silent, apparently feeling remorse that he had not actually raised the flag. His family never knew of his involvement until James Bradley started digging into his father's past prior to writing his book, which was published before the elder Bradley's non-involvement was revealed. And Ira's downward spiral continued. He was arrested 55 times on drunkenness charges and could find neither work nor peace. He returned to the spotlight infrequently. The first time was in 1950 when he went to Washington to plead for more assistance for his tribe. There was another momentary break in his torment in 1954 when he was invited back to Washington to attend the dedication of the Iwo Jima Monument. During the ceremony, President Dwight Eisenhower lauded him as a hero. Afterwards, a reporter asked how he liked all the pomp and circumstance that goes with being a famous person. “I don't,” was his only reply. Three months later, he was dead.
An editorial in The Phoenix Gazette on Jan. 26, 1954, declared: “Ira Hayes was a victim of war as surely as though he had died on Iwo Jima with his buddies. The peace he fought to win never brought him personal peace. But he is no less a hero for that. Arizona will always honor his memory and the proud symbol he helped create.”
However, not even death could bring about the solitude he pursued so vainly. State lawmakers decided

he should get a state funeral. Thousands of Arizonans paid respects as his body lay in state in the state Capitol before his burial in Arlington National Cemetery. In 1960, Hollywood stepped in to convert a reluctant hero into a largerthan-life hero by casting Lee Marvin as Hayes in a telefilm entitled The American. A year later, Tony Curtis portrayed Hayes as a man destined to become a tribal leader in a full-length film, The Outsider. The movie was based on a segment of Wolf Whistle and Other Stories, a collection written by William Bradford Huie. In that selection, also called The Outsider, Huie was the first to recount Hayes' reactions to his unwanted fame. Years later, in the 2006 movie Flags of Our Fathers, based on James Bradley's book and directed by Clint Eastwood, Adam Beach appears as Hayes.
Songwriter Peter LaFarge and country singer Johnny Cash then added more misguided laurels. LaFarge wrote The Ballad of Ira Hayes and Cash recorded it in 1963. It went to third place on the music charts. The refrain called him “drunken Ira Hayes” and referred to him as a “whiskey drinkin' Indian.”
However, in an interview conducted shortly before his book was published, James Bradley noted: “I've spoken to many of Ira's Marine buddies who fought with him, who shared foxholes with him and who depended upon Ira for their lives. They don't talk about an out-of-control guy or a drunk. No, when these veterans speak of Ira, they do so with respect and tell of an honorable warrior. And that is what killed Ira Hayes. A conflict of honor.”
Bradley also presented some reliable evidence that Hayes was more than likely suffering from Post Traumatic Stress Disorder, an affliction common today but one that did not receive major attention until the 1960s, much too late to help Ira Hayes. Typically, many kind words were spoken about him after his death. At his funeral, Gagnon eulogized, “Let's say he had a little dream in his heart that someday the Indian would be like the white man (and) be able to walk all over the United States.”
And on Nov. 10, 1993, in a speech delivered at the Iwo Jima Memorial, Marine Corps Commandant Gen. Carl Mundy declared:
“One of the pairs of hands that you see outstretched to raise our national flag on the battle-scarred crest of Mount Suribachi so many years ago are those of a Native American, Ira Hayes, a Marine not of the ethnic majority of our population. Were Ira Hayes here today, I would tell him that although my words on another occasion have given the impression that I believe some Marines, because of their color, are

What is Red Ribbon Week?
We can all agree about the importance of keeping kids away from illegal drugs. Red Ribbon Week, which is held each year from October 23rd through the 31st, is the oldest and largest drug prevention awareness program in the United States.
Red Ribbon Week began as a tribute to Enrique “Kiki” Camarena, a DEA agent who was kidnapped and tortured to death by drug cartels in 1985 during his investigation of a marijuana operation in Chihuahua, Mexico. After the murder, citizen’s of Camarena’s hometown, Calexico, California, began wearing red ribbons in his honor. Congressman Duncan Hunter Sr. and teacher David Dhilon launched “Camarena Clubs” in many California high schools, and in 1988 the first national Red Ribbon Week was organized by the National Family Partnership, with First Lady Nancy Reagan serving as chair. Data recently released by the CDC shows that 93,331 people died of drug overdoses in 2020, setting a new record, more than 20,000 deaths above the previous record set in 2019. There’s no doubt the nation faces a flood of potent new drugs, including fentanyl. In California
alone, there were 6,592 drug-related deaths last year, an increase of over 20%, and 36% of those deaths were fentanyl-related.
Since joining the Legislature in 2012, I have been a strong supporter of Red Ribbon Week, and have provided hundreds of thousands of certificates to students throughout the 75th Assembly District to recognize them for pledging to live drug-free lives. While the legislative certificate program has been impacted by the pandemic, Red Ribbon Week remains a major drug abuse prevention effort in our local schools, an effort I will continue to support.
The struggle to reduce drug abuse and addiction must continue. Helping to save just one person from addiction will make the effort worthwhile. Programs like Red Ribbon Week may help save thousands. Getting Fentanyl Off Our Streets
There’s a crisis in our country. Fentanyl is impacting our streets and tragically killing many of our kids. In late August, two San Diego teenagers overdosed on clandestine prescriptions laced with fentanyl they purchased via social media. Sadly, one of those teenagers pasted away. This is just one of the many stories happening across San Diego County. Through mid-July, there were 413 fentanyl deaths, compared to 177 in 2020.
There has been a wave of deaths among teens and young adults who bought what they believed to be a prescription pill — like Adderall or Xanax — that turned out to be a counterfeit pill containing a deadly dose of fentanyl, a synthetic opioid a hundred times more potent than morphine. Many of these pills are being traded openly via social media and have been linked to the sale of fentanyl-laced counterfeit pills that have caused the deaths of teens and young adults.
With this problem continuing to grow, it’s time for the County of San Diego to step up and address this problem. At our last Board meeting, I led the action to direct our Chief Administrative Officer to
work with the educational community, parent-teacher associations and student representatives to develop a substance use prevention campaign, that focuses on fentanyl awareness. Many kids and young adults are unaware of the deadly effects fentanyl can have on their life and I believe this campaign will save lives. I have always felt – if people knew better, they would do better, and I want to make sure these young people know about fentanyl and how it’s a threat to their life.

Q: I recently bought a clothing item online from T.J. Maxx and returned it in its original condition. I paid online through PayPal. I contacted T.J. Maxx countless times to ask about a refund. First, a representative promised to refund me in "10 to 15 days." Then the company said it would be another five days. Then another five days. Then it was "one to three days" to show up in my account. It did not happen.
We went back and forth for over a month. Almost two months after I returned the item, I filed a dispute with PayPal. I enclosed the evidence, including tracking showing the delivery and their signature, email logs, photos of the item in original packaging, and photos of the return shipment with the label attached). PayPal sided with T.J. Maxx. Why wouldn’t they just refund me? This money is nothing for a huge retailer. And if they said they would, why wouldn’t they? Please, let me know if this is something you can help with. The help in my case would be figuring out why T.J. Maxx and PayPal have been treating me this way after the seller allegedly agreed to return the money. Thank you kindly. -- Ekaterina Quinones, New York A: You're right, this is a strange case. T.J. Maxx agreed to a refund -- you have the emails to prove it -- but then ghosted you. Then, when you tried to retrieve a refund through PayPal, T.J. Maxx fought the dispute and won.
Based on the information you sent me, it looks as if this is the product of automation gone awry. I think T.J. Maxx had every intention of returning your money, but its systems just didn't follow through the way they should have. That's no excuse, but maybe it's a consolation. At least there wasn't an evil mastermind on the other end intentionally denying your refund. I'm troubled that PayPal sided with T.J. Maxx, though. You sent PayPal extensive documentation of your purchase and return. Why didn't it do what it promised under its vaunted PayPal Protection program, which assures you that "We investigate and stay involved every step of the way"? Again, it looks like no human laid eyes on your claim. How disappointing.
I think a brief, polite email to both companies might have helped. Q: Last year, I bought tickets to fly from San Francisco to Stockholm on Air France. I booked the tickets through Cook Travel, a travel agency in New York. I paid for the tickets with my credit card.
Air France canceled the flight because of the pandemic. Cook Travel promised me a full refund. That was one year ago. Cook Travel has asked me to be patient, but now they are not responding to my inquiries. I've tried to dispute the charges with Citibank, my credit card issuer, but a representative told me too much time has elapsed. I've tried to reach out to executives at Air France and Cook Travel but have gotten no response. Can you help me? -- Jim Shea, San Mateo, Calif. A: If an airline cancels a flight, it has to send you a refund within seven business days. That's not my rule; it's <a href="https://www.transportation.g ov/individuals/aviation-consumerprotection/refunds">the U.S. Department of Transportation's</a>. If I had my way, I'd make them refund it as quickly as they took your money, which is within a few seconds. So, for Air France to make you wait one year is outrageous.
Your travel agency should have fought for your refund. After all, aren't travel agents supposed to represent you? And how about your credit card? Citibank could have easily accepted your dispute. The Fair Credit Billing Act, the law that protects credit card customers, does not prevent your bank or credit card issuer from getting involved in a dispute, even if it's been longer than 90 days. Citibank could have done better. Based on the correspondence between you, Cook Travel and the airline, here's what happened to your money. Air France tried to refund the ticket directly to your credit card. For some reason, that failed. Then an Air France representative told you that your travel agent had the money. The travel agency says it does not have the refund. It appears that they just pointed the finger at each other until they lost interest in resolving your case.
You could have reached out to someone higher up at Air France to resolve this. Axis Sally: A Traitor or Not?
In 1933, well into the Great Depression, Ohio-born Mildred Gillars followed her lover to Europe looking for work. When she finally landed a full-time job as an Englishspeaking broadcaster with the Nazicontrolled German State Radio, her fate as an American traitor was sealed.
Axis Sally Mildred Elizabeth Gillars, born Nov. 29, 1900, and nicknamed "Axis Sally," was hired to disseminate Nazi propaganda during World War II.
Following her capture in post-war Berlin, she became the first woman to be convicted of treason against the United States. Born Mildred Elizabeth Sisk in Portland, Maine, she took the surname Gillars in 1911 after her mother remarried. Her family resided in Bellevue, Ohio, where her father was a dentist. At 16, she moved to Conneaut, Ohio, with her family. In 1918, she enrolled at Ohio Wesleyan University to study dramatic arts, but left without graduating.
She then moved to New York City, where she worked in various lowskilled jobs to finance drama lessons. She toured with stock companies and appeared in vaudeville but she was unable to establish a theatrical career. She was unable to find regular employment, so in 1929, she moved to France, living in Paris for six months. In 1934, Gillars moved to Dresden, Germany, to study music, and was later employed as a teacher of English at the Berlitz School of Languages in Berlin.
In 1940, she obtained work as an announcer with the German State Radio. By 1941, the U.S. State Department was advising American nationals to leave Germany and German controlled territories. However, Gillars chose to remain because her fiancé, Paul Karlson, a naturalized German citizen, said he would never marry her if she returned to the United States. Shortly afterwards, Karlson was sent to aid the German war effort on the Eastern Front, where he was killed in action. Gillars' broadcasts initially were
mostly non-political. This changed in 1942 when Max Otto Koischwitz, director of programming for broadcasts aimed at America, cast Gillars in a new English language show called “Home Sweet Home Hour.” She soon acquired several names amongst her GI audience, including the "Bitch of Berlin," Berlin Babe, Olga, and Sally, but the one most common moniker was "Axis Sally." This name probably came when, asked on air to describe herself, Gillars said she was "the Irish type … a real Sally."
The “Home Sweet Home Hour,” began on Dec. 24, 1942, and ran until Germany surrendered in 1945. It was a Nazi propaganda program aimed at making U.S. forces in Europe feel homesick. Gillars insisted all of her broadcasts were written and directed by Joseph Goebbels, the chief Nazi propagandist. None of her words were her own. Gillars said she was a virtual prisoner because Goebbels had taken her passport and travel documents, prohibiting her from leaving Germany. The running theme of those shortwave radio broadcasts was the infidelity of U.S. soldiers' wives and sweethearts while the listeners were stationed in Europe and North Africa. She posed questions as to whether soldiers’ sweethearts would remain faithful, "… especially if you boys get all mutilated and do not return in one piece.” Opening with the sound of a train, the broadcasts attempted to exploit the fears of American soldiers about the home front. The broadcasts were designed to make soldiers feel doubt about their mission, their leaders, and their post-war prospects. After D-Day (June 6, 1944), Gillars visited German hospitals, interviewing Allied POWs, while falsely claiming to be a representative of the International Red Cross. In 1943, she reportedly toured POW camps interviewing captured Americans, recording their messages for their families in the U.S. The interviews were then edited for broadcast as though the speakers were well-treated or sympathetic to the Nazi cause. Gillars last broadcast was May 6, 1945, just two days before Germany’s surrender. U.S. authorities found her living in Berlin. Gillars was flown back to the U.S., charged with 8 counts of treason. On March 10, 1949, the jury convicted Gillars on just one count of treason. She was sentenced to 10 to 30 years in prison. On July 10, 1961, after 12 years, Gillars was released.
She returned as a student to Ohio Wesleyan University to complete a bachelor’s degree in speech. Japanese-American counterpart, Iva Toguri D’ Aquino, a.k.a. “Tokyo Rose,” also was convicted of treason, spending 6 years in prison. She later was pardoned by President Ford. Today, history has dubbed both women as traitors. Aquino’s story, to be told in next week’s column, is even more complex than Gillars.
On June 25, 1988, at age 88, Gillars died of colon cancer in Columbus, Ohio, in relative obscurity. Aquino died on Sept. 27, 2006, of natural causes in Chicago at the age of 90.

Rebuilding New Orleans after Katrina often caused residents to be challenged to prove home titles back hundreds of years. That is because of community history stretching back over two centuries during which houses were passed along through generations of family, sometimes making it quite difficult to establish a paper trail of ownership. A New Orleans lawyer sought a FHA rebuilding loan for a client. He was told the loan would be granted upon submission of satisfactory proof of ownership of the parcel of property as it was being offered as collateral. It took the lawyer 3 months, but he was able to prove title to the property dating back to 1803. After sending the information to the FHA, he received the following reply. (Actual reply from FHA):
"Upon review of your letter adjoining your client's loan application, we note that the request is supported by an Abstract of Title. While we compliment the able manner in which you have prepared and presented the application, we must point out that you have only cleared title to the proposed collateral property back to 1803. Before final approval can be accorded, it will be necessary to clear the title back to its origin."
And here is the great letter the lawyer responded with: (Actual response): "Your letter regarding title in Case No.189156 has been received. I note that you wish to have proof of title extended further than the 206 years already covered in the present application. I was unaware that any educated person in this country, particularly those working with real property, would not know that Louisiana was purchased by the United States from France in 1803 , the year of origin of title identified in our application. For the edification of uninformed FHA bureaucrats, the title to the land prior to U.S. ownership was obtained from France, which had acquired it by Right of Conquest from Spain. The land came into the possession of Spain by Right of Discovery made in the year 1492 by a sea captain named Christopher Columbus, who had been granted the privilege of seeking a new route to India by the Spanish monarch, Queen Isabella. The good Queen Isabella, being a pious woman and almost as careful about titles as the FHA, took the precaution of securing the blessing of the Pope before she sold her jewels to finance Columbus 's expedition. Now the Pope, as I'm sure you may know, is the emissary of Jesus Christ, the Son of God, and God, it is commonly

On the 19th of October, the City conducted a Community Advisory Group (CAG) meeting on Homelessness. If you are not familiar, we have six CAG groups each with different focus areas – Arts/Culture, Climate Action/Environment, Health, Economic Development, Homelessness, Recreation/Youth Activities. The purpose of these groups is for the residents to interact with the City staff on a particular subject. It helps keep people informed, and offer ideas without the formality of a Board or Commission.
This meeting discussed strategies for homelessness prevention for the local business owner. I thought it was really well done, and if you are interested in watching it, you can find it on the city website at https://homelessness.cag.escondido.org/pages/meeting-notes I think you would be surprised how some minor changes in your business surroundings can change things.
Upcoming meetings will deal with services available, and enforcement challenges. This is a great way for the community to come together and solve problems. I would hope to see you at the next one. PC sales began to show signs of resuming their decline. PC marketers and the big box retailers hoped to slow the slide in retail sales by convincing naïve retail shoppers that their older PCs were obsolete and that they needed to buy new Windows 11 PCs.

What you need is what we got
Last week’s column covered the October release of Windows 11 in depth. We will continue to get questions and concerns about Windows11 and the hype will continue to build as PC marketers like Lenovo, HP and Dell try to convince retail buyers that Windows 11 has value and that their old PCs are obsolete. In summary, under pressure from PC marketers and retailers Microsoft reluctantly agreed to rename a routine Windows 10 update by calling it “Windows 11.” This allows the computer marketers and retail stores to announce that windows 11 could only be installed on computers made in the past three years. Computer sales had been in decline since 2011 but “work from home” requirements created an upward bump in 2020 and the first half of 2021. After mid 2021
Windows 11 is a strategy aimed solely at bamboozling naive retail computer shoppers into buying new PCs. Win 11 is a waste of time and money and much of the cash generated by new retail PC sales goes straight to China. The professionals who manage commercial, government and school computer networks are laughing. If the status of Win11 changes we’ll let you know and if you have questions about Win11 or upgrading to it give us a call.
There are many collectors in the United States and elsewhere who collect Cracker Jack items. Of course, most of us remember eating out of the box and waiting for the prize to come. In fact, the prizes have been so valued that a gentleman named Alex Jaramillo wrote a book titled “Cracker Jack Prizes”. There is even a Cracker Jack Collectors Association
When we hear the words “Cracker Jack” we think of a boy in a sailor suit and cap holding boxes of Cracker Jack with his dog “Bingo” next to him. However, the history of Cracker Jack is interesting. Actually, two German immigrant brothers invented the snack. Frederick Rueckheim was selling popcorn made with steam machinery in Chicago. He bought out his partner in the early 1870s, and brought his brother Louis from Germany to help him. They bought some candymaking equipment and called their business F.W. Rueckheim & Brothers. Their candy was made of popcorn, peanuts, and molasses. The dry, crispy and tasty molasses coating was appealing. To this day, the recipe is a secret. The moisture-proof box to add freshness was added in 1902 by a third partner Henry

How the name “Cracker Jack” came about is a bit of a mystery. One story is that one of the brothers gave the snack to a salesman who tasted it and said “That’s Crackerjack”.
The snack stuck, and was even included in the popular song “Take Me Out to the Ball Game”. That song, written by Jack Norworth and put to music by Albert Von Tilzer in 1908, includes the line “Buy me some peanuts and Cracker Jacks”. Ironically, neither one of those two men actually saw a baseball game until years later. Toys were first included in 1912, and the phrase “A prize in every box” was added. Most of the prizes have been of plastic. In fact, Cracker Jack has given away more than 23 billion prizes over the years, of which 18 billion have been plastic whistles. Some of the early prizes included watches, whistles, and even piggybanks complete with five pennies (the price of a new box). Many of the prizes have come in different colors, and some collectors specialize in just that--collecting one prize in many colors. There are guidelines for prizes, including no sharp objects, nothing that can be swallowed, and a
prize that must appeal equally to boys and girls.
Sailor Jack and Bingo were first on the front of the boxes in 1918. The logo “The more you eat, the more you want”, was added in 1931, nine years after the company’s name was changed to the Cracker Jack Company. The company was sold to Bordens, and the plant was moved from Chicago to Columbus, Ohio in 1964. Paper prizes took the place of plastic prizes during the 1980s, and Butter Toffee Cracker Jack and Fat Free Cracker Jack were added in 1995. These types are not made today. After owning the company for more than 30 years, Borden sold Cracker Jack to Frito-Lay in 1997.
Unfortunately until the 1960s most Cracker Jack items did not contain dates. Some original Cracker Jack baseball cards from 1914-1915 depicting such famous players as Honus Wagner and Shoeless Joe Jackson in pristine condition have sold for thousands of dollars each. Lyle. Being a dog lover and reading the sad but well written story of The Ballad of Buddy always brings a tear to my eye and this one is no different as I sit here the tears well up. A sad day in my life developed a few weeks ago. My old Pug, Hank, my dear friend of 14 years was ready. I knew it. He knew it. He was going blind, almost deaf, pooping, peeing, where he shouldn't and I knew it was time to take him down.
But my wife, who's been at my side for sixty years, threatened me with divorce. Anyway, old Hank beat us to it.
One night having dinner, I looked down at my feet where he always sits, waiting for a morsel, and he wasn't there.
I looked up in alarm. Where's Hank? He's always where the food is. I searched the house and finally the garden, where it was quite dark, and finally found him, floating in the pool .

And in Bapchule, where he received his early education, Ira Hayes High School stands as the only upper level school on the Gila River Reservation.
In Arlington National Cemetery, his remains lie in Section 34, Plot 479A. And the huge Iwo Jima Memorial is a never-changing reminder of an incident that gave a nation hope during a tragic time in history. Two days after Rosenthal's photograph appeared, lawmakers rose from the floor of the Senate to call for a national monument honoring the flag-raising. State legislators passed similar resolutions and thousands of Americans wrote to President Harry Truman, urging him to act in a hurry. A mere 72 hours after seeing the photograph, artist Felix DeWeldon sculpted a clay replica of the picture and brought it to the White House. Truman approved and gave the order to start the design and creation process. Hundreds of artisans worked on the project, which was dedicated on Nov. 10, 1954. The figures of the six men stand 32 feet tall, and the flagpole rises 60 feet.

“I met my wife when I worked at a skating rink. I was 19. I had a summer job, she came in with her friends one night. We didn’t skate together, but I drove her home and she refused to kiss me because she said she didn’t know where my mouth had been.” Then someone asked the newlyweds how they met. The couple stared at each other and beamed.
“He lives next door to me,” the woman said.
Everyone laughed. Although, looking back, I don’t really know why. It wasn’t funny. The old bagger said, “I asked my wife to marry me when she was working at a library. I walked in at lunchtime, she saw me and said, ‘What’re you doing here? I didn’t think you knew how to read.’ I was so nervous I was shaking in my shoes.
There's more to this story but I got to leave. The tears are flowing.

“I got down on my knee and I said, ‘You light up my life, Sandra.’ Everyone in the library saw me kneeling and they were telling her, ‘Say yes!’” He looked into the distance for a moment and smiles at nobody in particular. “My wife was great.” The EMT lady said, “There was no popping the question for us. Actually, I was the one who asked my husband
to marry me. We were at a bar, I told him that it just made sense. Him and me.
“He laughed and said, okay, sure, let’s get hitched. Then he was like, ‘Hey, I’ll even bear your children if you want me to.’ We have two kids, I do wish he woulda been the one to go into labor. ‘Cause that part sucked.” While these strangers were talking I became lost in thought, thinking about when I first met the feisty woman who shares my name. I remember the blouse she wore the night I asked her to marry me. Jawbreaker red. After she said yes I had to hurry off to Wednesday night church because I was filling in for our pianist who had the flu. During that service I messed up every hymn in the book until the minister finally whispered, “What the heck is wrong with you tonight?”
So I told him I was getting married. He turned and announced this to the congregation. They gave us a standing ovation.
That’s a night I don’t want to forget.
After the newlyweds finished checking out, someone asked if they planned on having kids. The young couple was quick to shake their heads in unison and laugh.

COGG Meeting Advocating School Choice in CA - The Conservative Order for Good Government (COGG) meeting will be on Tuesday, November 9th. The speaker will be Todd Maddison, the parent of three children in San Diego. He is a founding member of the San Diego Schools and Parent Association and also the San Diego Chairman of the California School Choice Foundation. Our present school systems in California vary in quality throughout the state and from district to district. Since we voted to increase taxes for school funding on our citizens with Prop 30 in 2012, school funding per student has increased by $5,000 to $14,000, a rate over twice that of inflation. These tax increases were expected "to provide a better education for our kids!" The result, however, has been that California ranks near the bottom of all states. The 'highest' California rank in 2019 was 41st in 8th grade reading. The California

Therefore, they are working to put an initiative on the 2020 ballot, the Educational Freedom Act, an amendment to the state constitution guaranteeing parents the right to choose the best education for their kids, to be funded by the state. Basically, this would provide a state funded Educational Savings Account for each child of $14,000 per year (currently), and should not increase the cost of education to our taxpayers. PUBLIC NOTICE IS HEREBY GIVEN that IDS Real Estate Group and the City of San Marcos (City) request proposals from qualified contractors for the above stated project. DESCRIPTION OF WORK The Work includes renovations on two floors of existing tenant suites. The work will occur at One Civic Center Drive, San Marcos, CA.
