So off we went into the wild blue yonder . . .
With my blue eyes, a basic blue biplane, blue skies, blue ocean and 46 other shades of blue somewhere or other.
Taking off from Palomar Airport in an open cockpit biplane that is older than I am (it was built in 1929, which makes it 86 years old. I'm not quite that ancient; I came along sometime after that.) Technically, it's a Travel Air 4000 . . . but we all just call her “Olive.” She flies at a whopping 80 mph and with her auxiliary tanks filled she can probably fly for 7.5 hours, which would probably get us from here to Santa Barbara if one's bladder would hold out that long. But mostly she just flies a 25 mile radius around Palomar Airport, taking happy people for happy, fun flights.
We were suitably attired in helmet and goggles and had headsets and a push to talk button so we could communicate with each other and with the pilot, the legendary Captain Biggles . . aircraft historian, pilot of many hours, veteran of showbiz . . . and proud hubby of his trophy wife, Janene (one of the five most beautiful women in the entire world [see photo below] (and, yes, Evelyn is included amongst those five.)

Olive is a good looking old girl a deep blue . . . yellow wings, one wing on top, one below . . . that’s why they call it a biplane. There are two cockpits . . . the forward one, immediately below the top wing, seats two, side by side - or, if you wish to fly alone, you will be allowed to take the controls and see what it’s like to fly one of these old birds. I’m a private pilot but had not flown for about 20 years, when I first flew with Fun Flights out of their neat location at Palomar Airport. This was about a year ago. Once airborne I took over the controls and while I still remembered how to fly, I was tentative in my turns. I would probably have to fly two or three more times before I had my old flying skills back. Flying is
something you ought to do regularly so as not to get rusty (and tentative).
But today there would be no piloting of the aircraft by me. Captain Biggles was handling all the hard work. We just had to sit back, relax, and enjoy the ride. The engine is a big black beast,

a Continental rotary engine that is loud. It churns out 220 horsepower and goes 80 mph. You have a pilot’s helmet with a headset, a microphone, and the aforementioned push to talk button; however, once airborne I had great difficulty hearing via the push to talk microphone and headset. I could hear a bit . . . but not a lot.

I remember while airborne that Evelyn turned to me with a great big grin and announced it was “Slappy Ballantynes Day.” I don’t know any guy named Slappy Ballantyne but I’m glad he had a day named after him.
I think she had a good time though because later, after we were on the ground, I got a nice kiss. Imagine that.
We had lots of photos taken by Janene, some of which are contained within this story. It’s one of those service after the sale they offer to all clients.

Once we taxiied out onto Runway 24 we were ready to go and Captain Biggles fired up the big rotary engine and we rumbled down the runway with a very short take-off roll before we were airborne and climbing nicely into the west. I don’t think we were more than 300-400 feet above ground when

In time we made a 180 turn and headed back. A bit later I could see Palomar Airport approaching as we began our descent (I know, I know, technically it’s called Palomar-McClellan Airport. So sue me. I’m an old guy and I remember it as Palomar Airport. That, in fact, is where I earned my private pilot’s license many years ago, training on a Cessna 150 and a Cessna 172.)
The Travel Air, however, is a plane that requires you to fly it. It doesn't do it for you like some of the modern day aircraft. That's what pilots like about it and all its cousins. You actually FLY! By the seat of your pants sometimes.

The wife was a romantic type and the husband was more of a no-nonsense guy. One afternoon the wife went out to meet a friend for coffee.
She decided to send her husband a romantic text message and she wrote: "If you are sleeping, send me your dreams. If you are laughing, send me your smile. If you are eating, send me a bite. If you are drinking, send me a sip. If you are crying, send me your tears. I love you." The husband texted back to her:
"I'm on the toilet. Please advise." ••••• A man had two of the best tickets for the Augusta Masters. As he sits down, another man comes along and asks if anyone is sitting in the seat next to him.. "No", he says, "the seat is empty."
I found that the plane was a lot heavier to respond to my turning of the joystick and rudder pedals. With a Cessna 150 or 172 you barely nudge the wheel and rudder to the left and the plane responds easily. With one of these marvelous old birds you have to hold the joystick to the left and hit the rudder pedal a little more firmly. It actually is a bit like work to fly these . . . at least for a rusty old pilot like me. Landing a Travel Air 4000 is considerably different than landing a Cessna 150 or 172. In those aircraft you have a tricycle landing gear and thus have a good view of the runway as you make your final and somewhat level approach. The Travel Air, however, is a ‘tail dragger.’ You land with the nose elevated a bit higher in the air so you cannot see the runway. Instead, you line up with the runway, as you fly over the outer marker you throttle back a bit more and let the aircraft sink on its own. You have to rely on your view of the left and right sides of the runway to keep you lined up with the center line. As it settles, you level the aircraft out into its ‘flare’ and you gently sink as you move forward and, soon, you’ve made a gentle landing with a “squeak” as one tire, then the other, hits the runway. Slowly, Captain Biggles drops the tail wheel and you taxi back to the taxi-way and the hangar area. Sure enough, there, waiting for

"Oh... I'm sorry to hear that. That's terrible. I guess you couldn't find someone else?.. a friend or relative or even a neighbor to take the seat?" The man shakes his head... ...."No. They're all at the funeral. ••••• Morning Sex She was standing in the kitchen, preparing our usual soft-boiled eggs and toast for breakfast, wearing only the tee shirt that she normally slept in. As I walked in, almost awake, she turned to me and said softly, "You've got to make love to me this very moment!" My eyes lit up and I thought, "I am either still dreaming or this is going to be my lucky day!" Not wanting to lose the moment, I embraced her and then gave it my all; right there on the kitchen table.

I thought it remarkable that Valentine’s Day fell on the exact same day as Slappy Ballantyne’s Day. He’s one lucky guy, that Slappy fella. We rode with Janene and Stephan back to the office and chatted a bit. Janene told me they had been flying passengers back to back on this special Saturday. As nice as the weather was I suspect they were equally busy on Sunday. They tend to be busy on weekends. If you can break away during the week you should have no problem at all getting a flight booked.

A rather elderly gentleman (mid-eighties) walks into an upscale cocktail lounge. He is very well-dressed, smelling slightly of an expensive aftershave, hair well-groomed, great-looking suit, flower in his lapel. He presents a suave, well-looked-after image. Seated at the bar is an elderly fine-looking lady (mid-seventies).

Flights are $199 for a half hour flight, whether for one or two persons. Some of the other flights offered are the 60 minute La Jolla Jewel Flights at $399, and the 60 minute Sunset Flights at $499. Sometimes, when the circumstances and weather are just right, you can see not one but two sunsets. You see one . . . Captain Biggles then climbs the aircraft and voila! You see a second sunset.

And then Janene bought him flying lessons. He became hooked on flying, became a flight instructor, started up an Air Charter Company in the UK, later coming to America, where today he is the Director of Training at ProFlight in Carlsbad during the week and barnstormer pilot for Fun Flights Biplane Rides at weekends. As for Janene, she’s been an actress for years; met Brian when he was with Capitol Records in LA. They hit it off and began their global adventures together, going to Holland, then Jolly Olde England . . . came back to where they got married . . .but returned to England to live for 20 years . . . where she worked steadily as an actor. They returned to America and has acted from time to time, also does public relations work, and today, is the pretty face behind Fun Flights, LLC. Many more adventures they got involved in . . . so many that we’ll be doing a feature article on them one day soon. After driving home from Palomar Airport, our quest for flying like a bird temporarily satisfied, we prepared for the
second part of a Valentine’s Day weekend. ••••• Come Sunday morning we had reservations at the Crown Room at the Hotel Del.
This was quie an experience for a simple ol’ country boy from the midwest. The Crown Room is a huge restaurant. Everything about the Hotel Del Coronado seems huge. And old. And classical. And expensive.
Parking, for example, is $28 for the first two hours. If, however, you dine at the Crown Room you get your parking validated. I have a hunch we paid for that parking, one way or t’other. Our waiter, Hank, introduced himself and he couldn’t have been nicer. (Obviously, he had heard that lyle has been known to tip as much as a dollar on occasions.) The Feast
I don’t recall how many stations they have. Had to have been six, seven, maybe eight. Hank pointed them all out to us but the memory grows dim when you are an elder.
One station offers traditional breakfasts with omelets or eggs prepared any style, to your order; all types of muffins, cook-
ies, Belgian Waffles, whatever you wanted.
Another station was the seafood section. My first choice. I loaded up with oysters on the half shell, crab legs, and shrimp. Still another was the carving station with lamb, prime rib, turkey, home made sausage. They’d cut as much as you wanted for your plate.
A pastry station had pies, cakes, desserts, yet another station had breads of all descriptions, there was an international station with foods from around the world . . . and your own personal waiter and a block of bus persons, both guys and gals, ensuring you always had everything you wanted. You could drink all you wanted, it was included in the price, Mimosas, Champagne, Bloody Mary, wines, cocktails, beer . . . this was how Kings and Queens must have dined . . . thus the name, the Crown Room. Our waiter, Hank, was a handsome, blonde fella. Looked Dutch, German, Scandinavian. Turns out he was of Austrian heritage. Been with Hotel Del for a year . . . formerly worked in Phoenix. Much prefers San Diego’s weather and laid back

The Paper • Page 4 • February 19, 2015 Vista Says No to Street Peddlers of Newspaper
As of tomorrow, February 20, you will not be able to purchase copies of the UT, a San Diego newspaper, on the streets of Vista. This as a result of a one month hiatus ordered by the Vista City Council. It is possible the hiatus may become permanent.
In a unanimous vote the council voted to enforce an existing city ordinance that prohibits such sales to motorists. The sales program, a fund raising and recovery project for the clients of the non-profit Alpha Project, provides for clients to sell the U-T San Diego newspaper three days a week as part of a recovery program. Complaints arose over allegations that the vendors had become too aggressive in their sales efforts, as well as impeding traffic.
Council members Amanda Rigby and John Franklin wanted to end the sales program completely. Others felt there might be adjustments made in how the sales effort was handled. This could include moving to less heavily traveled streets and prohibiting sales unless and until motorists asked to purchase. The matter will be revisited by

A Marine, Lee Trahan, who was working at Miramar Marine Air Station, prepared to go to work in late April, 2012.
He claims that in trying to feed one of his two twin childrren he accidentally lost his balance while trying to retrieve a pacifier and fell forward; Willow, his infant daughter, struck her head against the door frame and the infant began to cry. After examining and calming the child, he and his wife chose to monitor her and not take her to hospital as the injury did not appear to be serious. Three days later, the baby stopped breathing and was rushed to a hospital. Ten days after that, she died.
The District Attorney’s Office, doesn’t buy the story. They say something other than an accidental bump against a door frame must have caused the severe injuries that caused the baby to die. They filed murder

We enjoyed it so much we came back two days later with good friend, Tim Cunning. He, too, enjoyed the food.
Man About Town
Strange.
The Man About Town gets around to a lot of restuarants throughout North County yet only recently discoverd “Intertwined,” a superb restaurant on Grand Avenue in Escondido.
We were also surprised to learn they had been open for two and a half years. One would think I would have discovered them long before this. However, I have discovered them. And I love the place!
We stopped for lunch (twice) last week. I had the BLP (bacon, lettuce and pear) sandwich on Panini bread, along with sweet potato french fries;
The place is upscale, lovely dark wood paneling, beautiful drapery, simple, easy menu with a good variety of offerings; reasonably priced.
The owner, Kristy McGee, is an attractive young lady with a ready smile and super personality. Personality seems to run within the service staff. Our waitress, Brittney, also had a big smile and was easy to talk to. You can mark this down as another restuarant where you are likely to find me dining fairly frequently.

Dear Mr. Davis,
Just wanted to thank you for writing the most comprehensive article on the puppy mill industry that I have ever read. Clearly, you conducted some extensive research. You did an excellent job of connecting the dots between the puppy mill industry and the pet shops, while also answering common questions people have about puppy mills. We depend on our lawmakers to protect our community from harmful business practices. Pet shops are the biggest perpetrators of consumer fraud. Legislation is the only way to stop the puppy mill industry and to protect consumers. Thank you for bringing some much-needed attention to this

I also have tons of footage of the Hunte truck delivering the puppies to some of the local pet stores. It is heartbreaking.
For the last 10 years, I have been a volunteer at the County Animal Shelter in Carlsbad and have worked in animal rescue for more than 20 years. I also worked with the Oceanside City Council and the City Attorney to help pass the puppy mill ban in Oceanside. Once again, thank you so much for writing this great article! Bravo! Mammograms
Many women are afraid of their first mammogram, but there is no need to worry.
By taking a few minutes each day for a week preceding the exam and doing the following exercises, you will be totally prepared for the test and best of all, you can do these simple exercises right in and around your home. EXERCISE ONE: Open your refrigerator door and insert one breast in door. Shut the door as hard as possible and lean on the door for good measure. Hold that position for five seconds. Repeat again in case the first time wasn't effective enough. EXERCISE TWO: Visit your garage at 3AM when the temperature of the cement floor is just perfect.
Take off all your clothes and lie comfortably on the floor with one breast wedged under the rear tire of the car. Ask a friend to slowly back the car up until your breast is sufficiently flattened and chilled. Turn over and repeat with the other breast.

Very attentive . . . right there whenever you needed something. Interesting chap to visit with. Great smile. He was so good looking and charming he could easily be a movie star. Dunno if he can act, but he sure would get the attention of the girls. About halfway through breakfast I told Evelyn I was getting upset. “Why?” she asked.
“Because I’m getting full. I wanted to eat for two or three hours. Look how much food there is to choose from. No way will we get to sample all of this great food!” Fortunately, I wasn’t upset very long because the tastiness of the food had somehow soothed the savage beast within me.
It’s a funny thing about great dining . . . no matter how hungry you are when you arrive, no matter how lovely and tempting the food looks . . . as you fill up you are more and more able to resist ordering and eating more. That ain’t right!
A feller ought to be able to eat, and eat, and eat, and eat.
Neither Evelyn and I are much in the way of imbibing alcohol. She had a Mimosa . . . I had a Bloody Mary. That was it. I wanted to save room for the great food items and not take up any precious room in my tummy with alcohol or water. But, as all good things, must, our breakfast finally ended. Voluntarily. We simply couldn’t eat another bite. At least that’s what Evelyn said. Then she went to the dessert bar and brough back orange crepes and peach cobbler. I went “tsk, tsk, tsk. Didn’t you just say you couldn’t eat another bite?”
“Yes,” she said. “But I’m gonna try a bit more.”
I said “tsk, tsk,” a couple more times.
Then I got up and went to the dessert bar and got some orange crepes and peach cobbler. Monkey see, monkey do.
I ordered a coffee, she had a nice cup of tea . . . and I asked Hank for our check. Before he left our table to fetch the check, however, I said to him, “Very impressive. But I couldn’t help

ceremony recently, the Rancho Buena Vista Chapter of Daughters of the American Revolution (DAR) honored four local high school students. The winners of this nationally sponsored contest were recognized for their outstanding efforts and accomplishments. This award recognizes the outstanding student who displays dependability, service, leadership and patriotism. This year’s deadline for final bill introduction is fast approaching. All potential new bills must be drafted by the Legislative Counsel’s office this month so that final legislation can be introduced by the February 27 deadline.
This is the time of year we start to get inklings about what the new legislative session may entail. Rumors about what’s being introduced, requests from colleagues to co-author legislation, and media reports about new bill proposals all start to circulate. It is possible that by the end of February around 1,000 new bills may be introduced.
Many of these will die quickly, often pulled by their author when they fail to generate support. Many more will create no controversy whatsoever, and will eventually pass by an overwhelming margin.

Bills being introduced this year include legislation requiring school children to be immunized, raising California’s minimum wage (again), and a bill that would strengthen California’s already stringent emissions regulations. Other legislation would require parental notification when minors seek abortions, and still another establishing the legal right for doctor-assisted suicides.
Less controversial bills are also on the table. One would encourage families to save for their children’s education through tax incentives, while another attempts to reform perceived flaws in the state’s election recount process. Obviously, many of these bills will soon be generating debate and commanding public attention. The Legislative Counsel’s office has a lot of work to complete by the end of the month. When that work is finished, the Legislature’s work begins in earnest.

Nikola Tesla was born in Serbia on July 10, 1856. He was an inventor, electrical and mechanical engineer, as well as a futurist best known for his contributions in the design of the modern “alternating current” (AC) electrical system.
In 1882, Tesla began working for Thomas Edison’s Continental Edison Company in France, designing and making improvements to electrical equipment. In 1884, Tesla came to America where he was hired by Edison to work for his Edison Machine Works. Tesla's work began with simple electrical engineering and
quickly progressed to solving more difficult design problems.
Tesla was offered the task of completely redesigning the Edison Company's “direct current” (DC) generators. Tesla said he could redesign Edison's inefficient motor and generators, making an improvement in both service and economy. Edison reportedly replied: "There's fifty thousand dollars in it for you if you can do it.” Edison was notoriously stingy and probably didn’t have that sort of money.
After months of work, Tesla fulfilled the task and inquired about his $50,000 payment. Edison declared he was only joking.
"Tesla, you don't understand our American humor." Instead, Edison offered Tesla a $10 raise over his $18 per week salary, but Tesla refused the offer and immediately resigned.
Tesla was rightly concerned any innovation or discovery he made while under Edison’s employ would be claimed by his employer. So the innovator struck out on his own, setting up laboratories and companies to develop a range of electrical devices. His patented AC induction motor and transformer were licensed by George Westinghouse, who also hired Tesla as a consultant. Tesla’s work in electric power

I’m aware the law will not allow you to donate it to a food bank . . . so what do you do?” He cringed and answered, “yes, that is correct. We are not allowed to donate it to needy people. I think you probably know the answer to that question . . . “ I nodded.
“When I see that exquisite food being dumped into the garbage it just kills me.” I understood. (Seems to me, after all the premium paying customers finished the buffet they could invite in military, both active duty and retired, and charge them $20 for all they could eat. A lot better than sending to the garbage dump . . . and it would make a lot of military folks happy. And full.) Hank then presented us with the check. I knew it was gonna be expensive but didn’t know how much. $90 per person.

It was worth every penny.
The food, the service, the atmosphere. Besides, we don’t splurge all that often (we probably ought to do it more often, in fact.)
Thoroughly sated, we retrieved our car and headed for the Travel and Adventure Show at the Convention Center. Big disappointment.
Most of the vendors we were familiar with . . . Catalina Island, Sequoia National Park, Yosemite, Hawaii, Lawrence Welk Timeshares . . . we watched a presentation by the Taiwan Tourist Bureau . . . a little bit interesting but not enough to cause me to dash out and buy an airline ticket.
We had missed Rick Steves, the television travel host on PBS and someone whose work I admire. We were busy feeding our faces while Rick’s program was being presented. We did sit in on a presentation by Pauline Frommer of the Frommer (Travel) Guides. It was okay. But just okay. Evelyn roamed the aisles and checked the vendors while I was content to remain in the audience seating area and rest up. I’d had a huge breakfast and I

When this mechanism is not working properly, the spinal discs will begin to die causing bulges, herniations, and eventually spinal stenosis.

The only way that the disc gets the circulation of water, oxygen and nutrients for self-repair is via this specific disc pump mechanism. The plant is unhealthy and needs water and nutrients. You could spray paint the leaves green but it just covers up the condition. development was involved in the corporate struggle between the Tesla-Westinghouse group against Edison’s company, controlled by financier J.P. Morgan, making alternating current (AC) or direct current (DC) the power transmission standard, referred to as the “War of Currents.” Tesla’s AC power system won out, but in reality it was a bitter victory. Westinghouse, who had control of Tesla’s developments, was going broke. He had to sell Tesla’s AC patents to financier Morgan, who promptly turned Edison’s company into General Electric. Bottom line: Tesla, Edison, and Westinghouse all lost out on reaping the electrifying rewards that had developed.
Tesla went on to pursue wireless lighting and electrical distribution in his high-voltage, high-frequency power experiments and made early pronouncements on the possibility of wireless communication with his devices.
In his lab Tesla also conducted a range of experiments with mechanical oscillators/generators, electrical discharge tubes, and early X-ray imaging. He also built a wireless-controlled boat, one of the first ever exhibited. All of this is to say that Tesla was decades ahead of everyone else in his thinking and dreaming. Tesla was renowned for his achievements and showmanship, eventually earning him a reputation in popular culture as a "Mad Scientist." His patents earned him a considerable amount of money, much of which was used to finance his own projects with varying degrees of success. He lived most of his life in a series of New York hotels.
Tesla died on Jan. 7, 1943. His work fell into relative obscurity after his death, but in his honor, the 1960 General Conference on Weights and Measures named the SI unit of magnetic flux density the “Tesla.”
Tesla’s name and memory has experienced a resurgence in interest in popular culture since the 1990’s. Today, the leading allelectric automobile company is called “Tesla Motors.” The car is considered one of the top luxury vehicles in the world.

Recently I was pumping gas and the line was a bit long. As it turns out, the pump didn't dispense a receipt as usual. I had to go inside to retrieve it. As I was coming out, I passed a patron that had been standing there as I went in. She asked me “can you give me one dollar?” Everything in me wanted to say “not today.” But I thought about it for a second and took out a dollar and was ready to give it to her. I asked her “what are you going to do with the dollar?” She quickly replied “I’m gonna get something to eat.” I took out $5 and handed it to her. She simply said “thanks.” Just then, Matthew 25 passed through my mind. I don’t know if it was a spiritual prompting or not, but I

This will be my final “Letter from the Mayor” in The Paper. I have been concerned for some time about the editor’s journalistic practices. He frequently writes stories that are based on rumors, false information, and speculation rather than facts. Escondido has been the target of some of those opinion pieces presented as news. Last summer, when the Union Tribune accused him of plagiarism, a serious issue for a newspaper, he used the unique excuse that it wasn’t plagiarism but an “anthology” or a collection of stories.
The turning point for me occurred just last month. “The Paper” has had a history of publishing jokes that often are in poor taste and offensive to various groups of people in our community. However, the January 29, 2015 issue contained a so-called joke about the sad events in Ferguson, Missouri that was blatantly racist and distasteful. Because this kind of irresponsible and unprofessional journalism does not reflect the values of our great city, I am discontinuing my weekly letters in “The Paper.” If you are interested in continuing to read my weekly letters, they will appear on the City’s website, www.escondido.org

San Marcos • Mayor Jim Desmond January traffic impacts for Bent Avenue and Discovery Street
During the month of January, motorists can expect some traffic delays along Bent Avenue and Discovery Street near the San Marco Creek area to accommodate geological work and soil testing. As part of an early step in Phase I of the San Marcos Creek District Project, this work will generate the necessary information to begin environmental infrastructure improvements in the area. The following streets may be reduced to one lane in each direction Monday
through Friday between the hours of 9 am and 3 pm during the construction period: Via Vera Cruz between Discovery Street and San Marcos Boulevard; Bent Avenue between Discovery Street and San Marcos Boulevard; and Discovery Street between Bent Avenue and Via Vera Cruz. Traffic control teams will be on site during lane closures to safely direct oncoming traffic flowing in each direction. To avoid traffic delays, motorists are encouraged to use alternate routes. We appreciate your patience as we work to move one step closer in creating a downtown San Marcos.

Microsoft, Operating Systems and Windows 10 Part IV conclusion
Previous columns in this series revealed how Microsoft’s monopoly position in PC OS (operating systems) often encourages them to put their own strategic gambits ahead of their user’s needs.
Previously we covered Microsoft’s OS strategies through Vista. In 2009 Windows 7 succeeded the unmitigated disaster called Vista. Not only did Vista fail to invigorate PC sales, by mid 2009, two and a half years after its release it had garnered less than 20% of the PC market. Its predecessor XP still held 80%. Fast clean and stable, Win 7 was an immediate success. In a matter of months it passed Vista in market share and overtook XP in a little over two years. Today XP is still the second most

It does everything its users need. 90% of PC activity is Internet related. A ten-year old PC with XP does banking, e-mail, shopping, paying bills, Twitter, Facebook, Skype, genealogy or just plain surfing the WWW just as fast as a brand new computer. Internet speed is not affected by PC speed or OS. Many off-line activities like bookkeeping, taxes, spreadsheets, word processing, music and video are easily handled by older PCs. Using a lightning-fast PC for e-mail is like taking a Ferrari to an Easter egg hunt. XP will eventually fade away for lack of software and security support. Windows 7 appears to be the new XP. Already five years old with 56% market share and growing, it has everything and does everything that businesses and home users need. So why would Microsoft release Windows 8 in May of 2012? It certainly wasn’t because the industry was clamoring for a new OS, everyone was happy with Win 7. The Windows 8 release was based on corporate strategy, not customer need.

Finish Chelsea’s Run – On Saturday, March 7th, the 5th Annual “Finish Chelsea’s Run/Walk” will be held through Balboa Park. The original grassroots Run was such a moving and healing experience for the community that the King family decided to make it an official, annual tradition, hosted by the Chelsea’s Light Foundation, the organization they founded to make positive change for children. This annual 5K run/walk is now the primary fundraiser for the Chelsea’s Light Foundation Sunflower Scholarship Fund, providing scholarships for San Diego County college-bound teens who have embraced characteristics that embodied Chelsea’s academic prowess and service-over-self ethic. PUBLIC NOTICE IS HEREBY GIVEN that the City of San Marcos, hereinafter referred to as Agency, invites sealed bids for the above stated Project and will receive such bids in the offices of Agency (Front Counter on first floor of City Hall), at San Marcos City Hall, Engineering Division, 1 Civic Center Drive, San Marcos, California 92069-2918, up to the hour of 10:00 a.m., on Thursday February 26, 2015 at which time they will be publicly opened in the “Valley of Discovery” Room at City Hall. Bids received after the hour and date for the bid opening will not be accepted and shall be returned unopened.
The work to be done is described in these Bid and Contract Documents for the above stated Project. The general Scope of Work is as follows: DESCRIPTION OF WORK
The work generally consists of City inspected and contractor performed installation of an underground storm drain improvements within the public right of way to re-route storm water from Starstone Drive at Commodore Drive, into a City Vallecitos Water District Easement, then along the entire length of La Rosa Drive, then southwesterly along Rancho Santa Fe Road towards the intersection with Linda Vista Drive, and southeasterly into an existing channel at the northwest corner of Bradley Park. The work will also consist of the vertical relocation of a section of Vallecitos Water District water main within the intersection of Rancho Santa Fe Road and Linda Vista Drive, abandonment of existing CMP storm drain piping and storm drain clean outs, installation of new PVC piping within existing CMP storm drain piping, repair and replacement of all existing paving and public improvements, installation of new fencing at an existing headwall, installation and refurbishment of private improvements (trees, stairs, redwood retaining wall) along the new storm drain alignment on La Rosa Drive, erosion control, and all other associated work to complete the project per the Plans. COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)
This project is partially funded by a Community Development Block Grant (CDBG). CDBG is a program funded by the U.S. Housing and Urban Development. This CDBG program allocates grants funding to larger cities and urban counties to address community development needs principally for low-and moderate-income persons. Additional CDBG requirements are included in the Appendices to this Bid and Contract Documents. Certain forms in Appendix B must be submitted with Bid Package. NOTICE IS HEREBY GIVEN that, pursuant to the San Marcos City Charter and the San Marcos Municipal Code, payment of prevailing wages and compliance with the California Labor Code Sections 1770 et seq IS REQUIRED for this project. The greater of the State and/or Federal Prevailing Wage Rates will apply. (See Appendix for more information). LOCATION OF WORK
The work to be constructed is located on Starstone Drive between Commodore Drive and La Rosa Drive, along the entire length of La Rosa Drive, and on Rancho Santa Fe Road between La Rosa Drive and Linda Vista Drive in San Marcos, CA, Thomas Guide Page 1109, Grid C-7 and D-7. TIME OF COMPLETION Time is of the essence in the performance of the Work under this Contract. All work shall be completed in every detail to the satisfaction of the Agency within ONE HUNDRED SIXTY (160) WORKING DAYS after
the date specified in the Notice to Proceed. Liquidated Damages shall conform to the latest edition of the Standard Specifications “Greenbook” subsection 6-9. GENERAL
One Copy of the Bid and Contract Documents are available for review at no cost to the bidder at the front counter of the Development Services Department on the first floor of City Hall, 1 Civic Center Drive, San Marcos, California 920692918. NO BID SETS WILL BE AVAILABLE FOR PURCHASE. In conformance with State of California Assembly Bill 2036 complete bid sets will be available electronically, at no cost, at http://www.san-marcos.net and http://www.ciplist.com. It shall be the responsibility of the prospective bidders to download and print the bid documents for review and bid. Bidders shall also check the website for addendums which will be posted no later than 48 hours prior to the bid opening. Each addendum will include a conformation sheet indicating receipt of the addendum. This sheet must be signed and included with the bid for each addendum issued. Bids which do not include the conformation sheet(s) for each addendum, if any, may be rejected. The City of San Marcos does not warrant, represent, or guarantee the accuracy, completeness, or adequacy of information provided from any third party source. Pre-Bid Conference A Pre-Bid Conference will be held for this project at the project site at the intersection of Starstone Drive and Commodore Drive, San Marcos, CA 92078 at 10:00 am on Thursday, February 12, 2014. Attendance is not mandatory but highly recommended. Bids shall be written clearly and legibly in ink in conformance with the Instruction to Bidders. All bids shall be submitted to the Engineering Division in a sealed envelope plainly marked on the outside with "SEALED BID FOR THE STARSTONE/LA ROSA ROAD DRAIANGE IMPROVEMENT PROJECT DO NOT OPEN WITH REGULAR MAIL." If using Federal Express or other such service for bid submittal, the contents of the submittal must be noted on the outside of that envelope as stated above. Each bid must be accompanied by cash, a certified or cashier's check payable to the City of San Marcos, or a satisfactory bid bond executed by the bidder and an acceptable surety, in an amount equal to ten percent (10%) of the total aggregate bid amount. The successful bidder will be required to furnish and pay for performance and payment bonds acceptable to the Agency. The Contractor to whom the Contract is awarded, and any subcontractor under such Contractor, shall hereby ensure that minority and women business enterprises will be afforded full opportunity to submit bids for subcontracts. Further, there shall be no discrimination in employment practices on the basis of race, religious creed, color, national origin, ancestry, physical handicap, medical condition, marital status, age, or sex. Attention is directed to the provisions of the Bid and Contract Documents which require retention from payments to the Contractor to secure performance under the Contract. Pursuant to California Public Contract Code Section 22300, and at the request and expense of the Contractor to
whom the contract is awarded, acceptable securities (securities listed in Government Code Section 16430, bank or savings and loan, certificates of deposit, interest bearing demand deposit accounts or standby letters of credit) equivalent to the retention amount shall be permitted in substitution of money withheld by the Agency to ensure performance under the Contract. Such securities shall be deposited with the Agency or with a California or Federally chartered bank or savings and loan as escrow agent who shall return such securities, along with any interest thereon, to the Contractor upon satisfactory completion and acceptance of the Work by the Agency. The Agency reserves the right to reject any or all bids, to waive any irregularity, and to take all bids under advisement for a period of sixty (60) calendar days after the date the bids are publicly opened. All costs incurred by bidders as a result of preparing bids under this Notice Inviting Bids shall be the sole responsibility of each bidder. This Notice Inviting Bids neither creates nor imposes any obligation upon the Agency to enter into a contract. Liquidated damages for this Project will be per the Special Provisions. Education Is Not A Crime
Iran’s government stops Baha’is from teaching or studying at public universities. But they do teach. And they do study. The Baha’i Institute for Higher Education (BIHE) was established in 1987 as an informal university to give young Baha’is a chance to learn. The BIHE followed a tradition of Baha’i educational initiatives that dates back to the 19th century – when the Baha’is opened some of Iran’s first modern schools.
The Baha’is are Iran’s largest religious minority. More than 200 Baha’is were executed between 1979 and 1987, after the Islamic revolution, and over 100 Baha’is are currently imprisoned because of their faith. The community was also periodically persecuted in the decades before the revolution. Baha’is today are still routinely harassed, denied livelihoods, arrested, and jailed on false charges. The story of the persecution of Iran’s Baha’is, and the creation of the Baha’i Institute for Higher Education, are the subject of the film To Light a Candle, produced by the IranianCanadian filmmaker Maziar Bahari. The film uses personal stories and dramatic archival footage to explore the persecution of the Baha’is and the role of their peaceful resistance in Iran’s democratic movement.
