Singin’ in the Rain Comes to Life at Broadway Palm By Nicholas Connell Singin’ in the Rain returned to the East Valley this weekend at the Broadway Palm Dinner Theatre in Mesa. If you remember the classic MGM film starring Gene Kelly, Donald O’Connor, and Debbie Reynolds, you’ll love the stage version of this musical set in the late 1920’s Hollywood. It’s been a hit with audiences everywhere, and Arizona was no different, as theatre goers cheered this all new production when it came to life once more! The story focuses on Don Lockwood (Michael VanGemert), his sidekick Cosmos (John Ramsey), an aspiring actress Kathy Selden (Megan Wean), and Lockwood’s leading lady Lina Lamont (Katie Rochon), who can’t carry a tune. These four set the stage for a wild and insightful look at the old days of Hollywood while serenading and dancing into our hearts with the music of Nacio Herb Brown and Arthur Freed. The fun begins when the Producers at Monumental Pictures must come up with a talking picture and accompanying music to keep up with the new Jazz Singer picture from a rival studio. The problem is Lina, our leading lady, can’t sing. So in

steps Ms.Seldon, who dubs the picture for her new bosses, and a star is born. Katie was a perfect fit as Ms.Seldon, falling in love with Michael, our leading man Don Lockwood, who was a charmer all night. The two were in love and harmony in “All I Do is Dream of You”, “You Were Meant for Me/You Are My Lucky Star” and “Good Mornin”. Also keeping our story interesting and entertaining is John Ramsey as Cosmos. His likable nature was irresistible in “Fit as a Fiddle”, “Make Em Laugh” and “Moses Supposes”. But all of this wouldn’t be possible if it weren’t for lovable and ditzy Katie Rochon as Lina Lamont, our troubled blonde star. She was pure Tinsel Town in “Temptation” and “Would You”. But the best was saved for last, as this talented company rose to the occasion in toe tapping renditions of “Broadway Melody”, “You Are My Lucky Star”, and the show stopper, “Singin in the Rain”. Catch this classic musical live at the Broadway Palm. You’ll find yourself singing and dancing all night with old Gene and the hits of Broadway! For tickets and reservations call (480) 325-6700 or go to BroadwaypalmWest.com.

Rock Paper Scissors

Presented by Childsplay Tempe Center for the Arts February 28 – March 8 Saturday - Sunday 1pm & 4pm Childsplay continues the tradition of bringing new plays to the Valley’s children and beyond. This World Premiere will examine creativity and storytelling through the lens of The Sorcerer’s Apprentice. Rock Paper Scissors is a theatrical adventure for young audiences rendered through live drawing and paper sculpture. Combining the hilarity of slapstick with the creative possibilities of paper sculpture, Rock Paper Scissors explores 21st Century storytelling as two comic characters get caught in a conflict between analog and digital culture. In this brand new theatre event filled with games, visual images, music, and sound, a master craftsman and his young protégé grapple with their colliding creative styles as they try to live and work together.

Stray Cat Theatre Presents An Impending Rupture of the Belly By Nicholas Connell The Stray Cat Theatre’s new production of An Impending Rupture of the Belly conjures a story of fear and revenge that is intense and thought provoking. Set in present day Pasadena, the play is an exploration of values and paranoia gone awry in a decade of easily misled people.

Led by a deeply affected Michael Peck as Clay Stilts, this soon to be father is bent on making sure his family is safe from the dangers of war and terrorism spewed on the airwaves around the world. Except, we are in Pasadena and this is just the beginning of his delusional nightmare. First, he must prove to his pregnant wife Terri, played gently and lovingly by Courtney Weir, that the neighbors’ roving dog that is leaving his mark on their lawn must be stopped from intruding on their space. Soon, doggie world war unfolds. But there’s more to Clay’s malaise than just his wife. His rock star obsessed brother. Ray, played addictively by Tom

Laveen, is always around to remind him of family, failure, and the virtues of being a “drifter who walks alone”. Tom is wired to the hilt, and gives us just enough insight into the demons haunting his brother. Even more bizarre is Eugene, Clay’s friend, played thoughtfully by Scott Jeffers, who like a good extremist, feeds the fear factor in Clay until his darker side rises to the top. His flurry of self defensive moves, made to keep his wife and child safe from the enemy, is part fun and part insanity. But Clay is finally driven to make his belly rupture when his neighbor/prisoner, played sarcastically by Larry Penunuri, sets him up for the grand finale in his mission. Throw in some golf, Marines, and American music, and you have an intense piece of theatre meant to humor and reveal the dangers of paranoia and fear mongering. “An Impending Rupture of the Belly” is playing through March 1st at Tempe Performing Arts Center. For tickets, call (480) 820-8022 or go to StrayCatTheatre.org.

There’s great expectation and anticipation for Watchmen, based on the popular DC comics. The story, set in the 80’s, is an alternate world to our own. Costumed superheroes are commonplace, watching over mankind. When a retired ex-superhero is murdered, a masked vigilante sets out to uncover a plot to kill and discredit all past and present superheroes. As he reconnects with his former crime-fighting colleagues, only one of whom has true powers, he begins the investigation into the murder. He finds that the

In the recent release The International, which earned my first “A” rating for 2009, we have a look at the world of international banking and how it affects wars. In Duplicity, we’re given another look into the world of corporate espionage. The movie follows two spies turned corporate operatives in the midst of a secret love affair. They also discover the toughest part is deciding how much to trust the other. American ex-CIA officer Claire Stenwick (Julia Roberts) and English ex-MI6 agent Ray Koval (Clive Owen) have left the world of government intelligence in order to cash in on the highly profitable cold war raging between two rival multinational corporations. Their mission? Secure the formula for a product that will bring a fortune to the company that can patent it first. If the supernatural movie genre is “your cup of tea” (it’s mine), Knowing is being served! The movie centers on a teacher, John Koestler (Nicolas Cage), and his son, Caleb (Chandler Canterbury). The time has come to open a time capsule buried years before by students at the elementary school Caleb attends. Besides the usual time

capsule items, the teacher discovers some chilling predictions, some of which have already come to pass. The startling revelation is that his family just might play a major role in events that are forecasted in the capsule, and those that are about to unfold. The race is on for the teacher and his son to decipher the clues, convince the unbelieving, and prevent the ultimate prediction! The latest technological upgrades in digital animation and the 3-D process are utilized by DreamWorks for Monsters vs. Aliens. Just recently they presented a “first look” at the process with their 3-D TV commercial for the film that aired during the Super Bowl when they provided 3-D glasses through various outlets nationwide. Now you can experience the movie on the big screen in digital 3-D! When a meteorite from outer space hits a young California girl named Susan Murphy and turns her into a giant monster, she is taken to a secret government compound where she meets a ragtag group of monsters also rounded up over the years. As a last resort, under the guidance of General W.R. Monger, on a desperate order from The President, the motley crew of Monsters is called into action to save the world from imminent destruction from the Aliens that have come to Earth! Featuring the voices of Seth Rogan, Reese Witherspoon, Hugh Laurie, Paul Rudd, Kiefer Sutherland, Rain Wilson, Will Arnett, Stephen Colbert, and Jimmy Kimmel. If the supernatural film genre is one of your favorites, The Haunting in Connecticut is just what you could be looking for. This movie is based on the true story of a family that is forced to relocate near a clinic where their teenage son can be treated for cancer. They begin experiencing violent, supernatural events that the parents first blame on stress from the illness, but later discover that it just might be because their new home is a former mortuary with a dark past. For the WWE fans of wrestling superstar John Cena, who last starred in 2006’s high action movie The Marine, he’s back in the non-stop action movie 12 Rounds. Here, he is detective Danny Baxter, and discovers his girlfriend (Ashley Scott) has been kidnapped by an ex-con tied to Baxter’s past. In order to save her, he has to successfully complete 12 challenges to secure her safe release.

murder is only the tip of the iceberg, which is a wide-ranging and disturbing conspiracy with links to their shared past that spells catastrophic consequences for the future of the planet! Love the tagline: “Their mission is to watch over humanity... but who is watching, the Watchmen?” There’s also an IMAX version for release: Watchmen: The IMAX Experience In this re-interpretation of the Disney classic Escape to Witch Mountain (1975), the theme of the classic stays intact in Race to Witch Mountain (also a Disney production) when a UFO expert coerces the help of a cab driver (Dwayne “The Rock” Johnson) to protect two siblings with paranormal powers from an organization that wants to use the kids for their own ominous plans. Here’s some inside info: actor Ike Eisenmann, who starred in the original as one of the siblings, returns in this version as the sheriff! On the lighter side, Miss March is the story of a young man and his childhood sweetheart. It’s prom night, and he accidentally falls down a flight of stairs and passes out. The accident turns into a four-year coma. When he wakes, the world he knew has changed. Most of his friends have left his hometown, and his girlfriend has moved on as well, as she is now a Playboy Bunny. A cross-country road trip to crash a party at the famous Playboy Mansion and win back his girlfriend is inevitable.

Digital Dave Tells You When to Repair vs. When to Buy New With the economy in the state it is in right now, I’d like to help our readers save some money by understanding when it is time to repair an old broken machine and when it’s time to purchase a new one. Many times an older computer can be repaired at a fraction of the cost as long as you know what to look for and when it makes sense. Laptops A common problem with laptops is the failure of the DC Jack. This is the little hole where you plug in

computer, it is understandable why these fail after many years of use. A new CD/DVD drive can be replaced for about $80, including parts and labor. This is almost always worth the repair. Hard Drive Failure (it will happen to you!) If you’ve read my articles before you know that I stress having a backup of your data. Always! With that said, the failure of a hard drive is catastrophic to a Laptop or Desktop system, and this is one of those occasions when you will have to do the math. Most repair shops charge around $200 to install an operating system on a new hard drive, if you add in the cost of a new hard drive at approximately $80 you are looking at around $300 to fix your aging computer. Now if you had all those baby pictures of the kids on that old hard drive, you may want to retrieve the data, and you are again facing about a $190 bill for data recovery. My advice is to backup your data often, and if your computer is worth more than $500, then go ahead and do the repair. Otherwise, it is time to start shopping for a new PC.

It’s time to think differently about Computer Service

the power cord. These DC Jacks can crack loose and keep the computer from getting a good connection to power. Symptoms of this problem are a battery not charging and a computer just not turning on at all when it is plugged in. A good repair shop will remove the motherboard and completely replace the DC Jack for about $129. This is worth the repair. Another issue with laptops is related to the LCD screen. If you get white lines, odd coloring, or weird pixels showing on the screen, you are looking at a failing LCD screen and these will run about $150 for the parts and another $89 for the labor. If your machine is worth more than $400, then it would make sense to replace the screen. One other common problem with the LCD screens in the backlight failure. The image is there but it is just super dim and hard to see. This is caused by the failure of the inverter and can be replaced for approximately $90 for parts and labor. This is almost always worth the repair since you can’t find many laptops for less than $100 these days. Hinges on the laptops often break too, as long as there isn’t damage to the LCD screen, the hinges can usually be replaced for around $20 per side plus $50 in labor.

Infiniti QX56

Review and Picture by Chad Haire

Now that gas prices have come down, we can enjoy the giant

SUV again. This time I got an Infiniti QX56. On the street, this rig has all the stuff for luxury driving: A 12-speaker Bose stereo, leather trim, dual zone climate control, heated seats, DVD players, and all the power goodies.

For off-roading, the equipment is here too. The four-wheel drive system has low range gearing for creeping on rough trails. Skid plates protect the bottom, and there is plenty of ground clearance. That massive V-8 engine has 320 horsepower and pulls strong.

Gripes? The ride is a bit firmer than I would like, the gas mileage is only 12-15 mpg, and at $61,885, it isn’t cheap. But a fun ride never is.

It’s Training Bats and Thongs!

The Valley has its own version of ‘March Madness’, and though lacking the frenetic pace of the more well-known athletic hoops spectacle, the MLB Cactus League is nonetheless a sporting phenomenon unlike any other on the planet (with apologies to Florida, but remember, the dry heat is over on the left side, baby). Early spring in Arizona is perhaps the most sublime weather anywhere in the world, and people travel from all longitudes and latitudes to take it in; the young, the old, the ‘bling’ed out, and the bold. While mild breezes and intermittent clouds cool the skin as the sun performs its intoxicating magic, the all-demographic accessibility of baseball serves as the all-purpose excuse for anyone to get out and enjoy the day (and for anyone to get out and drive or fly across continents to enjoy the day, for that matter). For a complete listing of the 2009 Cactus League Schedule, log onto www.cactusleague.com.

The Family

Spring training is candy for kids and grown-ups alike, when the crack of the bat and the smell of hotdogs and peanuts instills fresh new wonder in one while evoking nostalgic bliss in the other. Though classic imagery is still vibrantly alive in Phoenix and Tucson ballparks, where it takes the form of fathers and sons worshiping together at the altar of baseball, a bright day at the diamond also holds immense appeal for mothers and daughters, as Arizona is a renowned center of softball talent and fanaticism.

The Party

Ahhh, March in Arizona; when the consumption of beer and hot pretzels goes up while the wearing of clothing goes down. The Cactus League is not merely a draw for baseball fans, it is a giant mojo magnet for those ready to throw down the party gauntlet. Grass seating is a feature at some ballparks, and in these green fields the power players mix with average Joes in a universal salute to two treasured American past times; baseball and

merrymaking. Some parks promote party decks and VIP areas, where corporate types and socialites dominate the revelry scene. Spring training games in ’09 are sure to be particularly attractive to ‘those about to rock’ due to their typically affordable price points, so if you’re looking to score big this year at the ballpark, bring your belly, liver, and enough money for a cab ride home.

The Shift

This year the Cactus League invites two new clubs into its paradisiacal fold, the Cleveland Indians and Los Angeles Dodgers. In 2010, the Cincinnati Reds will also wander westward, making the split between Grapefruit and Cactus Leagues even at 15 teams each. According to an April ’08 article by Peter Corbett of the Arizona Republic, the Cactus League generated $313 Million in ’07 for Arizona and the Grapefruit League took in an estimated $450 Million for Florida; clearly the exodus of popular teams from the east indicates a future shift in the ratios of these figures, spelling big spikes in the bottom line for local businesses.

Mysterious Mixology at Morton’s Phoenix– Morton’s The Steakhouse in Phoenix is hosting ‘Absinthe, The Green Hour’, an event on Friday, March 13th at 6 pm that will give guests a chance to experience the mystique, allure, and ritual of tasting Pernod Absinthe, a high proof distilled spirit made from grande wormwood and a blend of aromatic herb extracts. Pernod gained notoriety in the 19th century when prominent patrons of Paris cafésamong them artists, poets, and writers- popularized the pleasures of absinthe. Controversy about the effects of absinthe led to it being banned in France, the United States, and other countries in the early 1900’s. In 2007, the U.S. followed other nations by easing restrictions on distilling and selling absinthe, which was often called the “Green Fairy” at the height of its popularity due in part to its characteristic green color. Priced at $45 per person including tax and gratuity, the event in Morton’s private boardroom will feature three Pernod Absinthe cocktails and Pernod Absinthe served in the traditional ritual, which involves dripping ice water very slowly over a sugar cube that is placed on a slotted spoon over a glass of absinthe. The water passes through the spoon slots into the drink, resulting in a green and flavorful concoction. Morton’s guests will also enjoy Oysters Rockefeller made with Absinthe, Crabstuffed mushrooms, Sliced Tenderloin on Crostini, and Morton’s famed Miniature Prime Cheeseburgers. An expert will guide guests through this unique tasting event and each guest will receive a complementary gift. To reserve your place at this event, call (602) 955-9577. Morton’s The Steakhouse is located at The Shops at The Esplanade at 2501 E. Camelback Road. For more information on Pernod Absinthe, visit www.pernod.net.

Light Rail Pub Crawl Supports DUI Awareness

Valley Wide- RPM’S is at it again! RPM’S, the membership limousine service designed to decrease DUI’s, is putting on the largest pub crawl Metro-Phoenix has ever experienced in order to highlight the need of a responsible transportation alternative, the METRO Light Rail. On Saturday, February 28th, Valley residents will experience a variety of nightlife flavors. Stretching from Phoenix’s Camelback/Central light rail station to Tempe’s Apache/McClintock station, crawlers will enjoy local nightlife diversity, ranging from the authentic British pub George and Dragon to the dynamic, musical atmosphere of the Big Bang piano bar. “We want to promote the METRO light rail as an alternative to drinking and driving,” said organizer of the event, Merlin U. Ward, “and demonstrate to the cities of Phoenix and Tempe why the light rail should run until 2 am.” February 26th - March 4th, 2009

Around the metropolitan area, 16 nightlife locations will offer exclusive drink specials during the event to patrons wearing the official RPM’S pub crawl T-shirt. In addition to special prices, extended happy hours and food discounts are all part of the festivities. Patrons are invited to tour some or all of the crawl hotspots. T-shirts can be purchased for $10 at three locations on the day of the event: Doc’s Place (40 E. Camelback, Phoenix), Silver Lounge (136 E. Washington, Phoenix) and the ROC bar (1400 S. McClintock, Tempe). T-shirts may also be preordered online at www. RPMSLightRailPubCrawl.com. A portion of the proceeds go to the St. Mary’s Food Bank. Each person who purchases a shirt will help feed 7 people!

Noah Wylie

djnoahwylie@gmail.com www.myspace.com/djnoahwylie Where and when do you spin?

Sunday nights starting at 8pm, I host a downtempo night at Zen 32 in Phoenix. Saturday nights starting at 11pm, I spin electro-house at Blue Martini. You can also catch me at GeishaA-Go Go, The Hidden House, The W, Chronic Tacos, and various other clubs and restaurants around the Valley.

How did you get started in the industry?

I have always been an avid music collector and eventually decided to make it into a career by being a DJ. I got in the mix a couple years ago by throwing a party at The Hidden House with a few DJs that I know.

What’s the funniest thing that ever happened while performing?

One time I got a little overzealous during a hiphop show and decided to get on the mic and sing along with the chorus. Let’s just say there is a reason I normally speak with my hands.

What will people hear when they listen to your music?

Depends on what venue I’m at, but it will always be funky. Music has to have soul.

If there were a “Golden Rule” for being a DJ, what would it be?

To remember that it’s not about you; it’s about the people listening to what you’re playing.

Your favorite place to play?

That’s a tough one. I would say anywhere with a solid sound system and a room full of people that want to dance and have a good time.

If you could change one thing about the DJ-club scene, what would it be? It would be nice if it wasn’t so political.

What would you be doing if you weren’t DJing?

Working in a recording studio or as a live sound engineer. Music is my life.

Tell us a secret about yourself or your show:

I would tell you, but then I’d have to kill you....

What’s the biggest misconception people have about DJs?

That it’s easy. I challenge anyone that thinks that to give it a try.

‘Dancing With the Stars’ Benefits AZ Kidney Foundation Phoenix- Some of Arizona’s finest community-minded celebrity stars are set to showcase their fancy footwork on Friday, March 6th at the Arizona Biltmore Resort and Spa. Arizona Kidney Foundation presents ‘Dancing with the Stars 2009’, and this year’s theme is Swing into Action – 1940’s style. Guests of the gala event will be treated to ballroom competitive dance exhibitions where daring individuals will be partnered with professionals from Fred Astaire Arizona. Revelers will be able to hit the dance floor to the sounds of The Two O’clock Jump Swing Band. Now in its third year, this year’s ‘Dancing with the Stars Arizona’ event is co-chaired by Libby Cohen, Jan Clayton, and Patricia “Patsy” Livi. All three co-chairs were celebrity star dancers at this event in 2008, the signature gala of the Arizona Kidney Foundation. Unlike some charity events that involve a lot of sitting around and waiting between speakers, guests of this event will walk into a 1940’s style atmosphere featuring dramatic staging and live auction items. They may recognize Eulia Baranovsky and Steven Dougherty, 2007 World American Smooth Showdance Champions and 2006-2007 U.S. and World American Smooth Finalists, who will be presenting spectacular exhibition performances.

Immediate past chair Linda Pope was initially inspired by the passion of Arizona Kidney Foundation supporters Marguerite and Jack Clifford, and Glenna Shapiro, CEO Emerita. Pope smiles when she reflects upon her involvement with the event and notes: “I had such a great time dancing in 2007 – ballroom dance is now one of my passions – that I became chair in 2008. I firmly believe in the AZKF’s many programs, not only for Arizona’s children and adults coping with kidney failure, but also for the greater community, as we provide education about disease prevention, including the ‘Know Your GFR’ public service campaign that dramatically emphasizes the need for kidney health awareness.” Glomerular Filtration Rate, or GFR, is considered to be a key indicator of kidney condition. 1 in 9 American adults (26 million) has Chronic Kidney Disease, and, of those, 90% don’t know they have it, according to the Arizona Kidney Foundation. GFR offers everyone a way to check their kidneys with a simple blood test. For more information on ‘Dancing with the Stars Arizona 2009’, including premier reservations, please call the Arizona Kidney Foundation at (602) 8401644.

Oh, the Valley is warm, warm, warming up baby! This is the time when we get to enjoy some of the best weather on Earth, and there’s a lot that we can do to celebrate. Spring training is here, there are beer and music festivals and just about everything, well…under the sun. Keep reading to find out our professional ebony (Efia) and ivory (Brent) social take on what happened, is happening, and will happen in the Valley. Light Rail Pub Crawl: Have you gone a light rail pub crawl yet? I did on the first day of the light rail, but that is a different story (and a rant on lack of public bathrooms). Anyways, for those looking for a light rail pub crawl “The Great Arizona Beer Festival Pub Crawl,” will be taking place this Saturday, February 28th, so leave the driving to the conductors and have a grand ole time. The pub crawl kicks off at noon at the Sonora Brewing Company (12 p.m.-1 p.m.). After the first stop at Sonora, it heads to George and Dragon (2 p.m.-3 p.m.), Jackson’s on 3rd (4 p.m.-5 p.m.), and ends at Macayo’s Depot Cantina (6 p.m.-7 p.m.). There is an added bonus; if you buy food or drinks at any of the locations you’ll be entered into a drawing for general admission and VIP tickets to the Great Arizona Beer Festival. It is free to participate so just ride and drink and make friends. Go to PAGE 16 for more details. Celebrity Martini Casino Night: Lady Gaga may have her poker face down, but mine still needs work. If you’re unlike this Night Owl and you know when to hold ‘em and know when to fold ‘em, the Celebrity Martini Casino Night is for you. It’ll be held Saturday, March 7th from 6-9pm, and will feature casino gaming, auctions, a Ganem Diamond raffle, martinis, and a cure for those post-All Star weekend celebrity withdrawals by bringing together local luminaries. Come watch Channel 3’s Bruce and Lisa

Haftner and Olivia Fiero, AZ Cardinals Scott Peters and a few of his teammates, Mix 96.9’s Chris Parker, and Former NFL Redskin and Bengal Mike Westbrook and many more mix martinis to compete for the title of “2009 Master Mixer.” The Celebrity Martini Casino Night will be held at North Scottsdale’s Devil’s Martini with all proceeds benefiting The Leukemia & Lymphoma Society. Tickets are $75, $125 per couple, or $90 at the door, and include food, martinis and $100 in gaming chips. Get your tickets at www.CelebrityMartini.com and remember to bring your poker face. Medievalism: Fashion’s Romance with the Middle Ages: Let’s face it; the luxurious life is out of reach for most of us but that doesn’t mean that we should cut it out of our lives completely. You may not be able to buy designer fashions, but you can still enjoy their aesthetics. The fashion starved can indulge in Phoenix Art Museum’s exhibit Medievalism: Fashion’s Romance with the Middle Ages. The exhibit explores the influence of Medievalism on contemporary fashion by featuring more than 40 ensembles, including wedding and evening dresses, ball gowns, capes and day wear. It’s not quite New York’s fashion week, but you can still revel in opulent and classic styles from hundreds of years of influential Medievalism fashion at the Phoenix Art Museum. Close to home and under $10, see the exhibit from now until July 5th, 2009. For more information visit PhxArt.org. Night Owls on Twitter: Who’s on Twitter? Not the “F” Word. . .

By Kevin Breger, Esq. www.TheAZCriminalLawyer.com

Heather had a traumatizing night and was glad that it was all over. She dropped her two children off at elementary school and spent the morning shopping, then met her good friend for lunch and they shared a bottle of wine. Straight after lunch, Heather went to get her children from school. With the kids in the car she was pulled over for “speeding in a school zone”. Upon further investigation, the officer found out that she had been drinking and ultimately arrested her for a DUI – not just a regular DUI but a Felony (Aggravated) DUI. Zack failed to appear at court in response to a traffic citation that was issued to him personally by a police officer. He got a notice from the Motor Vehicle Division that his license was suspended. He blew it off and drove anyway – after he had been drinking at a friend’s party. He was pulled over for taking a “wide right turn” and the officer could smell an “odor of intoxicating beverage”. The officer subsequently arrested him for a DUI – not just a regular DUI but a Felony (Aggravated) DUI. John had DUI convictions from 2003 and 2005. He just got a promotion at work and his coworkers threw him a surprise party. He drank. Then he drove. He was pulled over and was subsequently arrested for a DUI – once again, not just a DUI but a Felony (Aggravated) DUI. Naturally, the common theme to all of the above stories is that a DUI can be a misdemeanor, or as described above, can be a Felony Aggravated DUI. What makes Heather’s DUI a felony is that there were children in the car at the time. What makes Zack’s a felony is that his license was suspended at the time of his arrest. What makes John’s a felony is the fact that he had two prior DUIs that took place less than seven years before. It goes without saying that the consequences, direct and collateral, are more serious for a felony and they can be life altering.

DUI (misdemeanor and felony DUI’s) laws are complex and nuanced depending on numerous factors, including but not limited to: which court you are in; whether you were sick at the time of the “stop”; whether you were taking any medication; the exact level of your blood alcohol concentration; what method was used to determine your blood alcohol concentration (different methods have different variables and margins of error); whether there are any maintenance issues with regards to the machine used to test your blood alcohol concentration; whether there was “probable cause” to stop your vehicle in the first place; whether there was “probable cause”, after a stop, to conduct an investigation for a DUI; the way your blood may have been drawn; whether field sobriety tests were involved, if so which ones; your age; whether you had a fever at the time of the stop; whether any statements were taken from you; whether the statements were taken in a way that violates the Constitution. . .and the list goes on. The bottom line is if you or a loved one is facing a DUI (be it a misdemeanor or a felony aggravated DUI) it is not worth going it alone – be sure to get the best possible legal representation you can to help.

Is that a sparkle in his eye or is he just confused? With his innocence and friendly demeanor, Mitch Fatel quickly engages the audience and then catches them off guard with his mixture of mischievous dialog and off-color comments. While laughing at observations only Mitch can get away with we are left wondering if he truly understands what he just said. We never really know.

Mitch has been showcasing his talent to rave reviews for the past 15 years. Since then both appreciative audiences and comedy executives have made the same observation about Mitch¹s rise to stardom, “It’s just a matter of time.” Well his time has come. The number one requested comedian on Satellite Radio, Fatel has appeared numerous times on both the “Late Show with David Letterman” and the “Tonight Show with Jay Leno”. One of the few performers to appear on Dr. Katz, Professional Therapist twice, his episodes are still in demand and traded around the country. In 2006 he took home honors as “Best Comedian” at the prestigious HBO Aspen Comedy Festival and on April 6th his new half hour stand up special debuted on Comedy Central to rave reviews. Mitch is currently in negotiations with several networks for his new TV show, which will be in production soon. In addition, his CD “Miniskirts and Muffins” is a Top 10 comedy CD on Apple’s iTunes further cementing his status as a bona-fide comedy star. Catch him now while you still can. ** This Show Is Not For The Easily Offended ** Call 480-921-9877 or log onto www.tempeimprov.com Location: 930 E University Dr Suite D1-201, Tempe AZ 85281 AZWeeklyMagazine.com

Scottsdale- Esperanza Spaulding will be performing at the Scottsdale Center for the Performing Arts on Saturday February 28th at 8pm. If “esperanza” is the Spanish word for hope, then bassist, vocalist and composer Esperanza Spalding could not have been given a more fitting name at birth. Blessed with uncanny instrumental chops, a multi-lingual voice that is part angel and part siren and a natural beauty that borders on the hypnotic, the 23-year-old prodigy-turnedpro might well be the hope for the future of jazz and instrumental music. This intimate, cabaret-style performance includes table seating for two to four and wine and food available for purchase. Visit www. ttsdale Censcottsdaleperformingarts. By Becky Poe Superior- The 1st annual ‘Superior Has Heart’ cancer benefit was held on Sunday, February 15th at the Los Hermanos Restaurant & Bar in the small community of Superior. Cancer survivors Michael Mckee and Fred Murrieta, along with their wives Deb and Karen, had the idea to hold a music jam to raise money for the American Cancer Society. “Cancer is a disease that will touch all of us in one way or another throughout our lifetime” said Deb Mckee. “Funding is vital for cancer research to discover better, more effective treatment, and hopefully in our lifetime, a cure”. Local musicians came together to donate their talents, while raffles awarded everything from wine baskets to Phoenix Suns tickets and a trip to Cancun, Mexico. Approximately 250 people showed up to show their support, dance, enjoy the homemade menudo, and visit with old friends. With the help of the committee and concerned donators, $7400 was raised for the American Cancer Society. For more information, call (800) ACS-2345 or visit www.cancer.org

One Night of Queen Brings Freddie Mercury Back to Life

Chandler- On Sunday, March 1st at 7pm, Gary Mullen & The Works will recreate and pay tribute to “the greatest rock band of all time”, in One Night of Queen at the Chandler Center for the Arts. Tickets are $36-$48. Gary Mullen started his career fronting bands around Scotland in 1992 when he was only 19. Since winning the UK’s “Stars In Their Eyes” competition with his impression of Freddie Mercury, Gary has been in constant demand performing sell out concerts throughout the UK. His uncanny performance of Queen songs will make you think you’re listening to Freddie Mercury himself. Hits like “We Will Rock You”, “Radio Ga Ga”, “Bohemian Rhapsody”, “I want To Break Free” and “Somebody to Love” are just a few of the songs that will bring you to your feet and crying out for more!
