Her screams alerted the neighbours, who contacted the Nigel police as the woman’s landline was out of order. The oxygen bottle was found outside and the man had fled. The woman was not injured but shock only set in later. Her niece was in the lounge when the intruder came in and her sis-
ter inlaw was also in the house. “Everything happened so quickly”, she said. She still does not know how she managed to throw a heavy oxygen bottle three metres. The only thing stolen was a bag near the window, which contained a Bible given to her for her birthday. “The police and my neighbours were wonderful, she said. I only realise now that something terrible could have happened if I had stayed in the bedroom”.

Why did it happen to me? Why did God allow this to happen to me? Why did God take this person from me? These are all questions that are quite often asked in our (sick) world today. Together with this there are many people who actually blame God for something bad that happened in their lives. In coming back to the truth of the Bible we find peace and understanding. We also find explanations for many of the “unanswered” questions we have when looking at disasters in the world. I would first like to highlight that in the Old Testament God was a God of punishment trying to get His people to live a life of God. But once Jesus had come and lived with us, died for us, was buried and raised from the dead God could be the God He always wanted to be – a God of LOVE. I believe that God hurts just as much as we do when people get hurt or people pass away before the age of 120 years old (God’s plan was that we should live to be 120 years old – see Genesis 6). You may be asking “Why does God punish us or take away our lives like he does”. I do not believe that He does this at all. Mag wheels stolen
Stop this kitten cruelty! The dumping of kittens is continuing in the Nigel area. One kitten – about six weeks old was found on a blanket at the side of the Nigel, Dunnottar Road, with a handful of pellets on the blanket. Fortunately the SPCA picked the kitten up but realized there must have been more than one.A search in the veld by several people produced another three terrified kittens.
The strange thing is that the kittens were dumped only about 200 metres from the turn-off to the SPCA. People have been seen stopping their car at the side of the road and dropping kittens on the road, then driving away. Some people have just dumped them at the gates of the SPCA. This type of animal cruelty is a criminal offence and those who do it could be identified.
Thieves entered the premises of a house in Bartle Frere Street, Nigel and stole the mag wheels from a Toyota Hi-Lux bakkie, leaving the vehicle standing on bricks. They also smashed a side window of the bakkie and tried unsuccessfully to steal the radio. But the dashboard was severely damaged. The owner of the bakkie, Wikus Murphy, said the family did not hear any sounds during the night, when the wheels were stolen. At 06:00 he was shocked to see what had happened overnight. The replacement of the wheels is estimated at more than R15 000 and recently there has been a spate of such thefts in Nigel. Police warn residents to keep their vehicles with mag wheels out of sight and anyone with information can contact Nigel SAPS. A closer look at how the mag wheels are removed.

Thieves target railway lines Cables on the railway line between Sharon Park and Dunnottar, even extending to the Servaas station, have been repeatedly stolen. This has caused a disruption in some services. As soon as the cables are replaced, it isn’t long before the thieves take them again. Now there is a helicopter which patrols the area even through the night to try and catch those responsible. Anyone with information should contact the police.

It is a long time since there were any lights on the Nigel-Dunnottar Road, which is very busy and used by trucks, as well as a major turn-off much as the one to Alberton. Cables have been stolen and in cases where light poles have been knocked down, they have not been replaced. Many of the actual lights are missing as well as poles and some cables are just hanging. Drivers say the unlit road is a nightmare at night or just before dark, when many drivers do not put on lights and trucks turning into the road from Alberton often face oncoming traffic. Councilor comments on unlit road DA councilor for Nigel and Sharon Park, Wally Labuschagne says he has investigated the problem of no lights on the NigelDunnottar Road and has been informed that the relevant department has not got the finances to replace the cables which have been stolen numerous times. “I am not happy with this explanation, says Labuschagne” and I am going to establish an interview with the Customer Care Centre Manager in Nigel, to give more feedback.” He says he shares people’s concern about the danger of travelling on this road at night. He said the good news is that new light fittings are being placed in the entire area (street lights), replacing new bulbs on old light fittings is not viable. Therefore council decided on this route. “We plead for patience from our residence, as this is a time consuming process,” says Labuschagne.

Sy het verder foutiewelik opgetree om te vereis dat Senekal “buitengewone uitsonderlike omstandighede” moes voorlê om sy borgaansoek te steun. “Daar is gevind dat die landdros die bewyslas te hoog gestel het en gevolglik was dit vir mnr. Senekal onmoontlik om op ‘n regverdige wyse vir borgtog aansoek te doen. Die staat het na die regter se bevinding toegegee dat daar geen rede bestaan om die appèl te opponeer nie. “Deur dit te doen, het die staat

“Lawyers” or “liars”- by JP Okes
Teacher: What work does your Daddy do? Little Girl: He is a “liar”. Teacher: You mean a “lawyer”? Little girl: That is what I said. That much said I believe that there are very few professions where one can bring about as much change and can make as much difference, as one can in the Attorney’s profession. Even if I have to say so myself, our profession is an honourable one. Attorneys are required to be members of their relevant Law Societies. The Law Societies have issued a number of rules and guidelines dealing with the “ethical code” of Attorneys. An Attorney may be suspended or even barred from practicing as an Attorney where he contravenes these rules and guidelines. Unfortunately, as with any profession, there are always a few unscrupulous individuals who are an embarrassment to the rest of the profession. The good news is that the Law Societies have various procedures in place to deal with legitimate complaints. Hardly a month goes by without an Attorney being suspended or “debarred” from practicing. Potential clients can take some comfort

in the fact that the Attorney’s watchdog, the Law Society, is both wide awake and has some very sharp teeth. This fact helps to prevent honest Attorneys from acting in an unprofessional and unethical manner. Remember, however, that Attorneys present their clients’ cases, and therefore their clients’ interests. Insofar as the facts of the case are concerned, it is the client who either lies or tells the truth. An Attorney must apply the law to the story told to him by his client. An Attorney does not “make up” a story for a client. To do so would be unethical and dishonest. Attorneys have to resist the temptation of recommending “changes” to their clients’ versions, no matter how strange the version may seem. I have on a number of occasions successfully defended clients where I have not believed their versions. On trial, however, and as the matter progressed, their versions made more and more sense, and they were ultimately acquitted. Had I recommended “changes” to their versions, my clients may very well have been convicted. If a client is to go to jail it must be on his own version, and not because of a version made up by his Attorney. Accordingly very few Attorneys “make up” stories for their clients. If there is a “lie” told, it is told by the client and not the Attorney. At the very most, an Attorney may be accused of repeating the lie. It is the Magistrate’s task to make credibility findings, not that of the Attorney. In any event, as I have said before, Courts are “Courts of law”, and not “Courts of truth”. Where a client gives his Attorney conflicting and mutually destructive versions, the Attorney is ethically compelled to withdraw as the client’s Attorney. Likewise where a client admits to the Attorney that he did have sex with the Complainant, the Attorney may not, during a questioning of the Complainant, state to the Complainant that the accused did not have sex with her. The Attorney may however put it to her that his client did not “rape” her, as rape entails sexual intercourse without consent. Where a client tells his attorney that he is guilty, but does not want to plead guilty, it is completely acceptable for the Attorney to enter a plea of not guilty on behalf of his client. The Attorney may then proceed to test the strength of the case against his client. The Attorney’s argument at the end of the case would then be that the State had not proved the case against his client “beyond reasonable doubt”. The Attorney may, however, not at any point during the case put it to witnesses that his client denies having committed the offence. This approach is in accordance with the rights of the accused, as entrenched in our Constitution. Some Attorneys may lie from time to time on behalf of their clients, they are not permitted to do so. If they are found out they run the risk of being “debarred” and have to find work elsewhere. JP Okes is a practicing attorney, who has specialized in criminal law for more than twenty years.

Balfour gets Small Claims Court Balfour now has its own Small Claims Court which was opened on February 17 and dedicated to the memory of Gert Sibande also known as, “The Lion of the East”, by Mr Andries Nel MP, the Deputy Minister of Justice and Constitutional Development. Sibande was a trade unionist and leader of the ANC who played a leading role in the 1959 Potato Boycott, protesting to the treatment of farm workers, as well as the campaign leading to the adoption of the Freedom Charter in 1955. Nel emphasized the importance of access to justice for all in ensuring that the provisions of the Constitution are realised. Mpumalanga now has 27 Small Claim Courts, with five that still have to be established. Coutrywide there are now 241 such courts in the 384 magisterial districts. Small Claims Courts provide accessible and cost-effective justice to those seeking adjudication of dispute involving amounts up to R12 000,00. Claimants are assisted by Clerks of the Small Claims Courts to initiate proceedings. The parties represent themselves as no legal representatives are necessary or allowed. The Balfour Small Claims Court sits every Thursday and has since its establishment successfully heard various cases ranging from money lending to society disputes. Nel thanked legal practitioners who serve as Commissioners of Small Claims Courts on a voluntary basis, without any compensation. From planes to pegs! Drugs Take a packet of wooden clothes pegs and give it to 72-year-old Bertus Henrico of Nigel and he will soon transform it into a miniature set of tables and chairs. Bertus, a resident at the Nigel Home for the Aged, has made many things from the simplest of materials. The demand for his peg models is amazing and with the money he gets, he just goes and buys more pegs. But Bertus also has a talent for turning pieces of cardboard cartons into model ships, aeroplanes (with windows) and even a miniature Volkswagen Beetle, which he has decorated with sequins! He has also turned his attention to working with wood and so far one result has been a miniature pool table. He only started his hobbies two years ago but says it keeps him busy and happy. Asked what his next project will be Bertus said, ”I don’t know because I am too occupied with making little chairs from pegs for people.”

Pigeons are for the birds! Definitely not for the house, as I discovered the other day. It got in through a security door and then decided to explore every room, taking time off to whizz around my head. Frightening! I cornered it in the kitchen. Opened the window and the door. It seemed to fancy the top of the kitchen door, but when I stood underneath it

Weggooi stukkies teëls, planke, penne, knope, proppe, toiletpapier, boomblare en goedere wat in hardeware winkels te koop is, kan alles benut word om pragtige kunswerke soos skilderye, kruise, figuurtjies, blombakke en wat nog al vir jou huis te ontwerp, het Liezel Sadler, kunstenaar van Heidelberg, gesê toe sy die vroue van Rensburg VLU op 15 Februarie toegespreek het. Liezel het van haar pragtige skeppings ten toon gestel en die vroue gemaan om orals rond te kyk vir iets wat in kunswerke omskep kan word. Gewone blikkies kan bv. met pleister sement geplak word om ‘n pragtige plantehouer te skep. Dan is daar iets beskikbaar wat net soos piouter (tin) lyk en waarop ‘n mens die pragtigste patrone kan aanbring vir boekoortreksels. Dis baie goedkoper as piouter en kan in die hardeware winkel gekoop word. Wat dit is, kan ‘n mens uitvind as jy een van Liezel se klasse bywoon! Sadler bied veelsydige kunsklasse aan. Die mosaïek kursus duur drie ure lank. Jy kan ook leer hoe om op stukke planke of hout te verf en hoe om ‘n versierde kruis te maak.

Vier rekords is verbeter toe altesame ses honderd atlete van laerskole in Balfour, Heidelberg en Nigel op die John Vorster Stadion in Nigel deelgeneem aan die jaarlikse Suikerbosrand Atletiekbyeenkoms. Rekords is opgestel deur Bianca Erasmus
van Hannes Visagie, Pieter Kriel van A. G. Visser in 80m seuns o/8 60 m seuns o/8, en Elani van Tonder van Laer Volkskool in verspring dogters o/10. Die medaljes was geborg deur NTT Volkswagen Heidelberg. Op die foto is verteenwoordigers van die borg afgeneem.
Hengelaars triomfeer Pro Social Hengelklub se maandelikse byeenkoms was by Biermans op 11 en 12 Februarie 2012. Altesame 29 hengelaars het ‘n totaal van 115 visse geland. Die volgende kompetisie is op 10 en 11 Maart 2012 by Aqua Via – Vaaldam.
