Another suspect in foiled US embassy bombing nabbed By Perfecto T. Raymundo

MANILA, Dec. 6 (PNA) – National Capital Region Police Office (NCRPO) Director Chief Supt. Oscar Albayalde on Tuesday confirmed that operatives of the NCRPO have arrested another suspect in the attempted bombing along Roxas Boulevard near the United States Embassy last November 28. Albayalde said that one of the five suspects was arrested outside of Metro Manila. He added that the said suspects have not yet returned home in Marawi City, Lanao del Sur, who brought

the improvised explosive device (IED) in Metro Manila. The PNP have arrested the two suspects identified as Ryson Kilala and Jiaher Guinar Wednesday last week. However, Albayalde refused to identify the newly-arrested suspect because it will be presented by PNP chief Director General Ronald “Bato” Dela Rosa in a press conference in Camp Crame, Quezon City set on Wednesday. As of Tuesday, two other suspects are still at-large and authorities are continuously hunting them down.

Agri chief returns gift Rolex watch worth P450-K MANILA, Dec 7 (Mabuhay) – “It is the season of giving, but sorry, we can’t receive.” So said Agriculture Chief Emmanuel Piñol on Wednesday as he shared how he returned a Rolex luxury watch worth P450,000. On Facebook, Piñol wrote he received the gift during a dinner hosted by the executives of “a very Sec. Emmanuel Piñol large agricultural company” that he declined to name. He said he did not give much importance to the box containing the gift since he often receives small tokens and handicraft items as part of the courtesies during formal meetings and events. “The one I received recently was just stuffed in a bag along with the other mementos which I usually receive during ceremonial exchange of gifts,” he narrated. “It was not until I was in my farm in Kidapawan City, when I decided to open the box and I almost fell off my seat when I saw what was inside the box. Muralist vows to restore defaced Pinoy Mural in LA By Abner Galino

The angry reactions that followed after vandals recently defaced a 21-year-old Filipino mural in the Historic Filipinotown in downtown Los Angeles, showed that the artwork has attained quite a prominence among Filipino Americans here. Titled: “Gintong Kasaysayan, Gintong Pamana (A Glorious History, A Golden Legacy)” the mural, completed in 1995, can be found inside Unidad park (a pocket park). around 150 feet by 50 feet,it has provided backdrops to countless photographs of political and civic leaders during their speeches and cultural activities in the said park. Eliseo Silva, 44, the artist who created the mural 20 years ago, said it was the first time that the mural was vandalized since the artwork became enclosed at Unidad park. He was convinced that the act was a hate crime. Vandals attacked the mural

many years ago when the pocket park was not yet established. In an earlier interview with silva, he recalled that the property would have been a parking space today had its original owner, Dr. Carmencita Chuateco, agreed to sell it to a commercial entity. The mural depicts Filipino cultural designs and as well as Filipino american labor leaders Larry Itliong and Philip Vera Cruz who were significant personalities in the forming of a multi-racial coalition of farm workers that eventually led to the famous Delano grape strike and boycott in 1965. The section of the mural that has been scrawled commemorates september 16, 1965, the day laborers from the National Farm Workers Association (NFWA) and the agricultural workers organizing committee (AWOC) joined forces to form what would eventually be known as the united farm workers (UFW) union. there even before the park was established in 2007 and unveiled in september 2009 as Unidad park. In a recent interview in his house in the city of Corona, Silva said he is willing to work on a comprehensive restoration and enhancement of the mural. the artist said the Los Ange-

les neighborhood land trust and the social public art resource center are generating funds for the project. He estimated that around $10,000 would be needed to repair the damaged part of the mural or $50,000 to restore the entire mural and apply a protective coating on it.

Criminal raps ﬁled against ex-DOTC chief Abaya, 7 others By Christopher Lloyd T. Caliwan MANILA, Dec. 6 (PNA) – Watchdog, Citizens Crime Watch (CCW), have filed criminal charges against former Department of Transportation and Communication (DOTC) Secretary Joseph Emilio Abaya and seven others for their alleged involvement in the anomalous Php 3.8-billion license plate deal. Along with their legal representative, former Metro Rail Transit-3 (MRT-3) general manager Al Vitangcol III, the CCW filed the complaint Tuesday at the Department of Justice (DOJ) for violating Sections

3 (b) and (e) of Republic Act 3019 (Anti-Graft and Corrupt Practices Act) and Section 7 (a) and (d) RA 6713 (Code of Conduct and Ethical Standards for Government Officials and Employees). Aside from Abaya, those named in the complaint are Transportation Assistant Secretary Dante Lantin; Land Transportation Office (LTO) Alfonso Tan Jr.; and former DOTC Bids and Awards Committee (BAC) members Jose Perpetuo Lotilla, Rene Limcaoco, Julianito Bucayan Jr., Catherine Jennifer Gonzales. The complainant noted that in

2013, the LTO embarked on a Php 3.8-billion Motor Vehicle License Plate Standardization Program (MVLPSP). The project was awarded to Power Plates Development Concepts Inc. and J. Knieriem BV-Power Plates (PPI-JKG Joint Venture). However, the complainant said that “post qualification of the winning bidder was not done, contrary to the recommendations of the DOTCBAC Technical Working Group (TWG).” “Had the BAC allowed the post qualification, DOTC could have established that PPI-JKG Joint Venture does not have the financial

capability to manufacture the license plates under the MVLPSP Project,” it explained. Due to this, many vehicle owners who gave their payments “have not been issued the corresponding plates” and the non-availability of the motor plates “resulted in the myriad of problems--carnapping, violation of traffic laws--among others.” The complainant cited that the Commission on Audit (COA) disallowed the project in July 2015 on the ground that the same was awarded without the required allotment in the 2014 General Appropriations Act.

PHL, Pakistan execs pledge to enhance economic cooperation

MANILA, Dec. 7 (PNA) – Manila and Islamabad executives have pledged to work on broadening and diversifying the economic cooperation between the Philippines and Pakistan, with both sides expressing interest in enhancing agriculture, defense, information technology (IT) and pharmaceuticals. In a meeting with Finance Secretary Carlos Dominguez III, Pakistani Ambassador to Manila Safdar Hayat said pharmaceutical firms in Pakistan want to invest in the Philippines, while other companies have expressed interest in exploring areas for cooperation on technology transfer, in fruit processing and IT, where the Philippines has greater expertise. “My efforts from the very beginning have been to concentrate on enhancing trade between the two countries,” Hayat said. Death toll in Indonesia earthquake climbs to over 97, more than 600 injured JAKARTA, Dec. 7 (PNA/Xinhua) – At least 97 people have been killed and over 600 others suffered from wounds after a powerful and shallow underland quake hit western Indonesia’s Aceh province earlier Wednesday, top military officer and disaster relief officials said. “We have found several bodies since hours ago, so that the total casualty rises to 97 now,” Military Commander for Iskandar Muda Command Maj. General Tatang Sulaiman told Xinhua by phone from Pidie Jaya district, the hardest hit area. The 6.4 magnitude quake had left 613 people injured and more than 200 houses, shop buildings, school buildings, mosques and buildings damaged, Heni Nurmaini, press officer for emergency affairs at the provincial disaster agency told Xinhua by phone. Most of the casualties and injured persons were found in Pidie Jaya district, she said.

Search and rescue operation is underway now, involving soldiers, police personnel, those from local disaster management agency, local search and rescue office and volunteers, General Tatang said. “We dispatched around 1050 military personnel for this operation, and about 900 personnel from police, disaster agency and search and rescue office are also deployed,” the general revealed. NBI spokesperson Ferdinand Lavin on Tuesday said their parallel investigation, under the instruction of Justice Secretary Vitaliano Aguirre II, showed testimonial and forensic evidence that the actions of policemen, who served the search warrant on Espinosa in the wee hours of Nov. 5, â&#x20AC;&#x153;showed a community

Recognizing the signs and symptoms of Depression during the holidays In spite of the holidays, when everyone gets excited on giving or receiving gifts, recent statistics have shown that a lot of people become depressed. Recognizing the signs and symptoms of Depression is key in overcoming it. According to a Mayo Clinic study, depression is an illness which requires treatment, because it is a “mood disorder that causes a persistent feeling of sadness and loss of interest It is an illness, which, if recognized early maybe treated. It involves the body, mood and thoughts which affects a person’s eating, sleeping and feelings about themselves and this person sometimes thinks about negative things.” Most of the time, depression cannot be mistaken as a “passing blue mood. social withdrawal, unusual fatigue, low energy level, a feeling of being slowed down, sleep disturbance with insomnia, early morning awakening or sleeping, trouble concentrating, remembering or making decisions, unusual restlessness or irritability, persistent physical problems such as: headaches, digestive disorders. or chronic pain that do not respond to treatment, and thoughts of suicide or suicide attempts. “ There are online research studies available to those who think they have the symptoms of depression. Some of these studies include surveys and questionnaires which a person can participate in. Surveys include answering simple questions such as: “do you feel like there is nothing to look forward to, when you wake up in the morning;” “do you get mad at yourself if you do not achieve the goals you have set out to reach;” “I have recurrent thoughts

about ending my life;” do you blame yourself when forces are beyond your control, which prevents you from reaching your goal;” “do you feel worthless;” “do you feel like you mess up everything you touch and hurting people by just being around them;” “do you feel like a failure in society;” do you become overly sensitive and notice one single negative remark even if a vast majority of people approve your work” and “do you act based on what others think of you.” The surveys mentioned are just examples which can assist someone when necessary. Various groups laud pro-mental healthcare senators MANILA, Dec. 6 (PNA) – Various groups have expressed appreciation to the senators who filed bills which aim to address the problems of national mental healthcare in the country. On Tuesday, the Senate committee on health and demography chaired by Senator Risa Hontiveros started its public hearing on six proposed Senate bills seeking to establish a national mental health policy to enhance delivery of integrated mental health services. “We are sincerely grateful for our senator’s effort to give national mental health its long overdue recognition and for their generous attempt to address this issue by proposing mental health legislations,” Psychosocial

Disability-Inclusive Philippines founding chairperson Janice Cambri said during the hearing. Dr. Donald del Castillo of the University of the Philippines (UP) College of Public Health said the presence of multiple Senate bills “suggests that mental health is gaining ground on its place on the health agenda” of the government. “A mental health legislation is the way forward. This offers an excellent opportunity to push for its momentum and to refine its aims,” Del Castillo said. At present, Del Castillo said Filipino with mental health problems and their families experience health and healthcare disparity.

They are less likely to receive the treatment they require, and access to mental healthcare is also far-reaching -- physically, financially and culturally. The bills that have been discussed include Senate Bill No. 9 filed by Sen. Vicente Sotto III, No. 415 by Sen. Loren Legarda, No. 1155 by Sen. Juan Edgardo ‘Sonny’ Angara and No. 1190 by Hontiveros, all entitled Philippine Mental Health Act of 2016. On the other hand, Senator Antonio Trillanes IV filed SB No. 522 or an act establishing a comprehensive adult mental health program and SB No. 657 or an act creating a mental health program for the adolescents and youth in local government and academic institutions.

“It is important to have access, facilities and regional with emphasis going to the barangays available for the mental health patients,” Hontiveros said. Senator Sherwin Gatchalian, for his part, admitted that mental healthcare was the priority at least when he was mayor of Valenzuela City. According to the Philippine Statistics Authority (PSA), one in five adult Filipinos suffer from mental or psychiatric disorders, resulting in an average of 88 reported cases of mental illness per 100,000 Filipinos. Despite the prevalence of mental disorders, Hontiveros explained in her bill that only 490 psychiatrists are currently licensed to practice in the Philippines.

MANILA, Dec. 6 (PNA) – President Rodrigo Duterte has said he will only order the release of 130 political prisoners if the government peace panel and the National Democratic Front (NDF) sign a bilateral ceasefire deal during talks in Oslo, Norway this week. “Produce to me a signed bilateral ceasefire agreement and I will release them within 48 hours. You can

take my word for it,” Government peace negotiator Silvestre Bello III quoted the president as saying. In a press statement released by the Office of the Presidential Adviser on the Peace Process (OPAPP) Tuesday, the president the government has already conceded far enough to the NDF. But he also promised to release a number of elderly and sick detained rebels before Christmas Day.

Due to this, many vehicle owners who gave their payments “have not been issued the corresponding plates” and the non-availability of the motor plates “resulted in the myriad of problems--carnapping, violation of traffic laws--among others.” The complainant cited that the Commission on Audit (COA) disallowed the project in July 2015 on the ground that the same was awarded without the required allotment in the 2014 General Appropriations Act.

So, whatever the source of the stress, I guess you should remove that source of stress from your life if you want to keep your

sanity and live longer; makes sense. So avoid people who are nasty and mean to you, and you should feel better because the source of harassment disappears, right? So client must be on the right track. What does he do now for work? He drives for Uber. Thereâ&#x20AC;&#x2122;s no stress. He makes decent money but nowhere near $150K, but he has peace of mind and he keeps his sanity. Wife makes $3,500 a month. Their household income has been reduced by 50% but they are happy with their decision to give up the higher income. The problem now is that they owe $145K of unsecured debt of which $100K is credit cards and $45K is student loans. The cards need minimum monthly payments of $3K a month. They donâ&#x20AC;&#x2122;t have the income to make that payment anymore. They actually want a Chapter 7 discharge of all credit card debt of $100K. Is this possible? Letâ&#x20AC;&#x2122;s see. They have an older house built in 1920 that has equity of $140K. This fact alone knocks them out of Chapter 7. In Chapter 7, they will lose the house and get $100K of cash as their exempt homestead equity. I donâ&#x20AC;&#x2122;t think they want to lose their house for credit card debt. They confirm to me that they want to keep their house. They also have a car loan in which they pay $250 for a small new car. Chapter 13 will reduce the car payment to $85 a month. They have a car lease for a luxury car, a Lexus, which they lease at $585. The lease ends in 2018. At the end of the lease, they have the option of converting to purchase at the same payment. Chapter 13 will allow them to assume the lease and do the conversion in 2018.

Considering all relevant factors, debtors plan payment will be $680 a month for 60 months. It pays 16% or $16,000 of the $100,000 credit cards; pay the new small car in full at $85 a month. Clients will pay the Lexus lease payments directly to Toyota at $585. Student loans of $45K will also get paid 16% during the term of the plan. The $100K credit cards will be discharged after $16K is paid through the plan. However, 84% of the student loans are not dischargeable. They will own the new small car after the end of the plan and they will keep the Lexus lease. Their residence will not be affected. They keep it. They have no arrears on the house. They just continue their mortgage payments. The bankruptcy court protects their house from judgment liens from credit cards as well as wage garnishments on wifeâ&#x20AC;&#x2122;s salary. The pending lawsuits for two credit cards will get dismissed. Order and peace of mind out of chaos will be achieved with Chapter 13. Client gets to keep his sanity. He doesnâ&#x20AC;&#x2122;t want to enter sanitarium. I am very glad to help him keep his sanity. Next client is 61. She is single. Never got married. Her problem is she just got sued for $2,500 for a credit card debt. Her total debt is only $10K. However, her income is only $600 a month. She has a part time job doing inventory work. She counts inventory for an accounting firm. She rents a room for $250. Well, even though she only owes $10K, she obviously canâ&#x20AC;&#x2122;t pay $10K of credit card debt because the minimum monthly is $300, which is half her income. PHL mango industry attracts UK investors MANILA, Dec. 7 (PNA) – Philippine mangoes will soon be seen in supermarkets in the United Kingdom as the Department of Agriculture and the Philippine mango farmers engaged U.K. investors to patronize and invest in the growing mango industry in the country. Say that you have $100.00 in disposable income. You would have to pay that into a plan for 60 months. After 60 months, the balance of your debts would be discharged in full, even if they are far from being paid off. One should keep in mind that there are intricate details to the legal process that need to be taken into consideration before decisions are made to file for bankruptcy. Who qualifies? Which kind would apply to you? Will you be able to keep all of your property? There are many such questions that arise in such a situation. In this situation, you need to consult with an experienced bankruptcy law firm that can guide you through these complicated decisions and procedures. Filing for bankruptcy may not be the solution to all your financial problems though. In fact, bankruptcy does not cover all debts. It will be recalled that President Rodrigo Duterte ordered the arrest of Lam for economic sabotage in relation to the recent arrest of 1,316 Chinese nationals illegally working in Lam’s online gaming operations at the Fontana resort. The DOJ chief also disclosed that 600 of the arrested Chinese nationals have already posted bail after they were charged in court for violation of the country’s immigration laws.

PHL’s foreign reserves decline to $82.7B in November ‘16 By Joann Santiago

MANILA, Dec. 7 (PNA) – The Philippines’ foreign reserves fell to USD82.73 billion by end-November 2016, its lowest since last February. Data released by the Bangko Sentral ng Pilipinas (BSP) showed that the preliminary gross international reserves (GIR) level to date is the lowest after the USD81.88 billion last February and a decline from last October’s USD85.11 billion. The central bank breached its GIR target of USD82.7 billion this year last March when the foreign reserves amounted to USD 82.98 billion. BSP Governor Amando Tetangco

Jr., in a statement, attributed the drop in the foreign reserves to the national government’s payments of its maturing foreign debt, the impact of the central bank’s foreign exchange operations and revaluation of the central bank’s gold holdings. Central bank data show that value of the BSP’s gold holdings as of last November amounted to USD7.4 billion, lower than the previous month’s USD8.1 billion. Tetangco said these outflows were countered by the national government’s net foreign currency deposits and the central bank’s income from investments abroad.

In a press briefing at the Batasang Pambansa Complex in Quezon City, Minority Leader Danilo Suarez said that it is obvious that 2016 was about the war on drugs. “If we are to describe the first year of the present administration in one word, it would be ‘bloody.’ This is the word used by the President himself in several speeches about the ongoing campaign against narco-politics,” the Quezon lawmaker said. Abaya is the second official from the Aquino Administration to face graft charges under the the Duterte regime. Former Metro Rail Transit Line General Manager Al Vitangcol has pending graft charges with the Sandiganbayan on allegations of an attempt to extort $30 million from representatives of Inekon Group based in Czechoslovakia. Like Abaya, Vitangcol was also the handpicked choice of former President Noynoy Aquino and former DOTC Secretary Mar Roxas to head the Metro Rail Transit. The criminal complaints against Abaya and his former two DOTC Undersecretaries Jose Pertuo Lotilla and Rene Limcaoco, and former LTO Chief Alfonso Tan, were filed by members of the Citizens Crime Watch (CCW). It was in 2014 that the DOTC and the LTO required all motor vehicle owners to replace their old plates once they renew their registration. The fee was P450 for cars, trucks, and public transport vehicles and P150 for motorcycles. After the anomalous deal was exposed in the media, COA ordered the LTO to stop paying the JKG-PPDCI, the firm that won the contract to supply 5.23 million motor vehicle plates and 9.97 million motorcycle plates. JKG-PPDCI should not have been allowed to participate in the bidding, which of course was rigged by Abaya’s men of course. Abaya and his two undersecretaries, as well as the former LTO chief, should be held accountable for the controversial vehicle plates deal. Subsequent inquiries showed that DOTC did not conduct a post qualification evaluation on JKG-PDDCI. The firm was also found out to be financially incapable and didn’t have the capacity two undertake such a gargantuan project. No wonder, up to this time, millions of Filipino motor vehicle owners are still waiting for their new license plates which they have paid two years ago. This scam is another form of fund-raising scheme done by the Liberal Party during President Aquino’s term in preparation for the 2016 presidential candidacy of former Interior Secretary Mar Roxas. This, I believe, is the same thing that Senator Leila De Lima did when she was the Secretary of Justice during the Noynoy administration. She also reportedly solicited campaign funds from high profile drug lords through her lover/bodyguard/driver, to bankroll

and De Lima won as a senator by coming in as the 12th placer in the Senate. Abaya should not take the blame if he has nothing to do with the scam. He should learn from what happened to Vitangcol when he tried to shield his superiors when the alleged extortion was brought to light by the Czech ambassador to the Philippines. Vitangcol was made a sacrificial lamb to deflect public attention away from Balsy Aquino Cruz, President Noynoy’s sister, and her husband Eldon, who tried to swing a deal with a Czech ambassador in the supply of light train from Inekon, a Czech train fabricator. Optimism may help people live longer: study WASHINGTON, Dec. 7 (Xinhua) – People who have an optimistic view on life are more likely to live longer, a US study said Wednesday. The study, published in the American Journal of Epidemiology, analyzed data from 2004 to 2012 from 70,000 women enrolled in the Nurses’ Health Study, a long-running US study tracking women’s health via surveys every two years. The researchers looked at participants’ levels of optimism and other factors that might play a role in how optimism may affect mortality risk, such as race, high blood pressure, diet, and physical activity. It found the most optimistic women, or the top quartile, had a nearly 30 percent lower risk of dying from any of the diseases analyzed in the study compared with the least optimistic women, or the bottom quartile. The most optimistic women had a 16 percent lower risk of dying from cancer; 38 per-

cent lower risk of dying from heart disease; 39 percent lower risk of dying from stroke; 38 percent lower risk of dying from respiratory disease; and 52 percent lower risk of dying from infection. Previous studies have linked optimism with reduced risk of early death from cardiovascular problems, but this was the first to find a link between optimism and reduced risk from other major causes. “While most medical and public health efforts today focus on reducing risk factors for diseases, evidence has been mounting that enhancing psychological resilience may also make a difference,” said Eric Kim, research fellow at the Harvard T.H. Tourism chief says Cesar Montano not her choice for Tourism Promotions Board

MANILA, Dec 7 (Mabuhay) – Tourism Secretary Wanda Tulfo-Teo on Wednesday admitted that actor Cesar Montano was not his personal choice to head the Tourism Promotions Board (TPB). “I have another choice, and, in fact, I already submitted the name. But when I saw him (Montano) in China, he said, ‘Secretary, I will be the head of the Tourism Promotions Board, can I meet with you for a courtesy call?’,” Teo told the Committee on Appointments (CA) committee on tourism and economic development. Teo said he told Montano then to “defer” his request for a courtesy call until he has his appointment papers. Montano’s appointment came this

week, and Teo said he “cannot do anything about it since it is already there.” Montano will be inducted on December 15, Teo said. Consequences of failing to disclose material assets, income, facts and information in a divorce case There is a natural tendency among divorcing parties to hide their assets from their spouse and understate income. This is a common problem that I have observed from practicing law for many years. A common question I hear from clients is “my spouse doesn’t know I have an account in this bank, do I have to let him/ her know of this account?” Parties to a divorce proceeding have a duty to disclose financial information to each other. This duty arose based on California’s policy (1) to marshal, preserve, and protect community and quasi-community assets and liabilities that exist at the date of separation so as to avoid dissipation of the community estate before distribution, (2) to ensure fair and sufficient child and spousal support awards, and (3) to achieve a division of community and quasi-community assets and liabilities on the dissolution or nullity of marriage or legal separation of the parties as provided under California law. To promote the above public policy, the family code requires a full and accurate disclosure of all assets and liabilities in which the parties have or may have an interest be made in a divorce or a legal separation, regardless of the alleged characterization of the property as either community or separate. Parties are also required to disclose all income and expenses of the parties. The parties also have a continuing duty to update and augment that disclosure to the extent that there has been a material change to their financial position. The purpose of the duty to augment and update the disclosures is so that at the time the parties enter into a settlement agreement, stipulated divorce judgment, or trial, each party will do so with full and complete knowledge of all relevant underlying facts of the case. The disclosures are made by the parties by serving each other with a preliminary declaration of disclosure and a final declaration of disclosure. The preliminary declaration of disclosure should be served within 60 days of serving the divorce, separation, or nullity petition. The commission of perjury on the preliminary declaration of disclosure may be grounds

for setting aside the judgment in addition to other remedies available under the law. The preliminary declaration of disclosure is not filed with the court but only exchanged by each party. The preliminary declaration of disclosure shall set forth 1) the identity of all assets and liabilities which the declarant may have an interest regardless of the characterization of community, quasi-community, or separate property; 2)The declarant’s percentage in the asset or liability; 3) the declarant’s characterization of the asset or liability. In addition, the declarant shall also provide the other party with a completed income and expense declaration. The declarations may be amended without permission from the court. The parties shall serve each other with a final declaration of disclosure at the time the parties enter into a settlement agreement, stipulated divorce judgment, or if the case goes to trial, at least 45 days prior to the first assigned trial date. The final declaration of disclosure shall include (1) All material facts and information regarding the characterization of all assets and liabilities(2) All material facts and information regarding the valuation of all assets that are contended to be community property or in which it is contended the community has an interest. (3) All material facts and information regarding the amounts of all obligations that are contended to be community obligations or for which it is contended the community has liability.(4) All material facts and information regarding the earnings, accumulations, and expenses of each party that have been set forth in the income and expense declaration. The parties may agree to mutually waive the final declaration of disclosure requirement but not the preliminary declaration of disclosure. A party who fails to comply with the disclosure requirements under the family code may be held in breach

of the party’s fiduciary obligation to the other spouse under family code section 721, 1100, and Marriage of Feldman. The party that failed to disclose material assets, income, facts, and information may be sanctioned by the court by awarding attorney’s fees and sanctions to the other spouse under family code section 271. Caregiver overtime law becomes permanent In September Governor Jerry Brown signed SB 1015 into law. This law is critically important because it permanently guarantees caregivers the right to overtime compensation. Originally, the Domestic Worker Bill of Rights (DWBR), which guarantees overtime pay for in-home caregivers, was set to expire on January 1, 2017. Under the DWBR, in-home caregivers must be paid overtime compensation when working more than 9 hours a day or 45 hours a week. In my experience, very few 24-hour caregivers are paid correctly. With California’s increase in the minimum wage to $10 an hour, non-exempt caregivers who work 24-hour shifts must be paid a minimum of $315 a day. If you are working as a caregiver and paid a day rate less than $315, under California law, you are not being paid any overtime and may have a substantial unpaid overtime claim. Often, employers attempt to avoid overtime liability by claiming the caregiver is an “independent contractor.” However, the DWBR defines in-home caregivers and personal attendants as domestic work employees, meaning that employers cannot

lawfully classify them as independent contractors. Therefore, the law will likely invalidate any agreement that wrongfully classifies an inhome caregiver as an independent contractor. The change in the overtime rules for caregivers first became effective on January 1, 2014, when the DWBR became law. Previously, employees who worked in a private household and qualified as “personal attendants,” including caregivers and nannies, did not qualify for overtime. The DWBR eliminated the overtime exemption for personal attendants and provides that personal attendants “shall not be employed more than nine hours in any workday or more than 45 hours in any workweek unless the employee receives one and one-half times the employee’s regular See CHALEF, page 19

Q: Chapter 7 BK, what’s the timeframe needed before they are eligible for FHA Mortgage? Chapter 13 Bankruptcy There must be 12 consecutive months of on time payments on all accounts (including utilities, cell phones etc) from the filing of the chapter 13 bankruptcy. Chapter 7 Bankruptcy There must be 24 months of perfect credit from the disposition of a Chapter 7 bankruptcy. Foreclosure There must be 3 years of perfect credit from the foreclosure. A: Document 12 months of good payment history on rents, utility bills, cell phone, furniture rental, car or insurances, etc. Q: How long does a student loan need to be deferred for you to leave it out of the debt to income ratio calculation? A: 12 months from the expected closing date. Q: Can you use Child Support income? A: Yes, As long as the borrower will be receiving this child support for the next three years verified by court papers. Q: What income documentation are required for a self-employed borrower?

A: 2 years of 1040’s and a current YTD Profit and Loss statement. The P&L does not need to be audited unless required by the underwriter. If there is a declining income factor, the underwriter will only average out the recent 12 months of income. Q: If someone has recently returned to the work force after an extended absence ( possibly even for a year… for example: a woman returning to work after have a child and have decided to stay home for a year) do they need to wait for 2 years to re-establish an employment history? A: No, if they are back to work for a minimum of 6 months and can document, prior to leaving the work force, that they had a complete 2 year full time history, the income will be used. The beneﬁts of stipulated judgment in divorce The most common reason why married couples file for divorce is irreconcilable differences. They have arrived at a point in a relationship where they cannot agree on anything. Such being the case, it becomes very difficult, if not impossible to reach an amicable settlement in divorce proceedings. The thing is; agreeing on how to settle things may save divorcing couples a significant amount of legal fees and costs. Getting a final divorce decree through a stipulated judgment may mean savings of several thousands in legal fees and costs as compared to going through trial. In a Stipulated Judgment, the Court adapts the parties’ agreement as the final judgment. If the parties’ cannot agree and the matter goes to trial, it is the court that makes the decision. The judge often admonishes the parties that, he or she prefers that they resolve their own issues but that if they cannot, then that’s the time he or she comes in because he/ she is aware that divorce trial is more costly, more stressful and more

adversarial. Unfortunately, proceeding amicable or reaching a stipulation in a divorce setting is easier said than done. In property division alone, although everybody seem to know that each party is entitled to half of whatever community asset, several issues and disagreement arise as to what are community assets, what are its values, who should pay who and how should it be divided. In many cases, the house is a major issue. The first issue is usually the valuation of the property. Who gets to keep it? If the wife will keep it, how much should she pay the husband for his share? How will they equalize the party? Same thing is true if the husband gets to keep it. How much should he pay the wife? If only the two of them can agree on who

should keep and how much the other one is to be paid for his interest, then resolving the division of the asset becomes easier. If they don’t, then they will have to spend on a lot of things to resolve the issue. They will have to file a motion, make a determination as to value of property, set it for hearing, pay legal fees and other costs. If they can agree, all they have to do is file their agreement in court. It is the same thing when it comes to the issue on retirement. Again, how it should be divided is the problem, although everybody knows that each party is entitled to half, where should the half be drawn if the divorcing couple are in their 40’s, 50’s 60’? What if one of the parties want their share now instead of waiting until he or she reaches the age of 65? What about if one of the parties kept giving gifts to other people while they were married? How should that be resolved, too? Regardless of what the issue maybe, it is more efficient and effective for the parties to try to reach an agreement as to how they will resolve their issues instead of

litigating each one. It will mean a significant amount of savings in terms of time, money and sparing one’s self from additional stressful situations. Even with an agreement, the lawyer can help you understand the issues, write your agreement in the proper language as required by courts and guide you through all the paper works and proceedings needed to get your final decree. We’re hoping for the best but we want people to prepare for the worst. That means making sure that they

have plans, making sure people are aware where important documentation is – birth certificates, marriage certificates, tax returns, evidence of their presence here in the United States. Documentation of one’s life here, letters of support documenting that they’re a person of good moral character. All these things might be very important in getting somebody released from detention or perhaps applying for some sort of relief. If they have children, they should make sure they’ve talked to family members about what happens should they be detained. They should

identify trusted individuals who may be able to take care of family members, make sure that they have emergency contact phone numbers available. Often times we’ve even had people apply for powers of attorney not just for their children, but for their resources and assets, so that they have somebody to step in and be able to pay rent, sell vehicles, do all the things that might be necessary in a circumstance where things move quickly. MANILA, Dec 2 (PNA) –The E-trike (electric tricycle) manufacturing industry is losing its momentum after the Department of Energy (DoE) stopped its E-Trike Program. Electric Vehicle Association of the Philippines (EVAP) President Rommel Juan told the Philippines News Agency in a phone interview Friday that investors

remained interested in the country’s e-vehicle industry despite the cancellation of the E-Trike Program. But Juan noted that the DOE program played a significant role in rolling out e-vehicles in different parts of the country as well as in attracting investors in the industry. “There are companies that expressed their interests; from China,

Japan, and United States,” he said. “It (cancellation of E-Trike Program) is not really affecting the investment plans of companies. However, it is a big loss of momentum,” the EVAP chief added, noting that rolling out some 6,000 units of e-trike are set for the next bidding, should the program continue. Instead of scrapping the entire program, Juan said the ADB funding could be diverted as loan for other e-vehicle projects nationwide which can also be implemented by other agencies such as Department of Transportation or Department of Tourism. “We implore the government to please help us sustain the momentum of the initial success of e-vehicles in the country and help make the Philippines the e-vehicle hub of Asia,” Juan stated early this week. “We have a sunrise industry in our hands.
