A Letter From The E.C.M.S. President
This is the sixth edition of the Escambia Medical Society Membership Directory. It includes our physician’s name, specialty, NPI number, practice address, phone number, fax number, and email address. Additionally provided are hospital contacts, managed care company contacts, and county health department contacts. Specifics on CME requirements and licensure renewal are listed as well as ancillary services and pharmacies are listed in the back of the book. The Escambia County Medical Society encompasses Escambia and Santa Rosa Counties and we host important CME meetings on: risk management, domestic violence, medical errors, and more, which provides our physicians with needed mandatory hours for re- licensure. Annually, we host a Women in Medicine celebration. ECMS members receive many benefits including: DocBookMD at no cost (a phone application with physician’s names and ease of contacting them), discounted malpractice and workers compensation insurance, the ability to get free consultation from The Florida Health Care Law Firm, and interaction and networking with other physicians in the community at our monthly meetings. We recently created a mobile application so our members can RSVP for our events conveniently from their mobile device. Our society has strong representation at the FMA level with Dr. Wendy Osban currently serving on the 2014-2015 Council on Healthy Floridians; Dr. George Smith serving on the 2014-2015 Advisory Group on Scope of Practice Issues, Medicaid Expansion Task Force, and Council on Medical Education and Science; and Dr. Christopher Burton serving on the 2014-2015 Council on Medical Services and Healthcare Delivery Innovation. Escambia County Medical Society (E.C.M.S.) The Escambia County Medical Society in conjunction with Santa Rosa County [E.C.M.S.] is a local professional association of medical doctors and doctors of osteopathy (M.D.’s & D.O.’s), that addresses political, social, and economic issues concerning the level and delivery of healthcare for patients and physicians. Started in 1873, the non-profit E.C.M.S. represents over 400 physicians living or working in Escambia and Santa Rosa counties of Northwest Florida. The E.C.M.S. supports the Florida Medical Association (FMA) and the American Medical Association (AMA). Mission: The mission of the Escambia County Medical Society is to promote the art and science of medicine in order to improve the health of our community. Vision: Tradition – Honoring the history of medical care in Escambia and Santa Rosa counties. Service – Serving the needs of our community through the service of our members in the practice of medicine. Leadership – Meeting the challenges of the future and safeguarding our community’s health through organized collaboration on the local, state, and national level. E.C.M.S. Foundation The Escambia County Medical Society Foundation is a non-profit organization dedicated to providing healthcare services on a volunteer and funding basis through its members. The Foundation was created in 1994. • Primary goal is to assure access to adequate healthcare for the medically indigent citizens of the area • To study and promote improved methods and facilities for healthcare • To pursue the protection of public health • Implement the means of financing healthcare at reasonable costs • To cooperate with other organizations and institutions interested in pursuing these goals • Disseminate information concerning healthcare in general • Current Foundation programs include: We Care and GoSeniors! Voucher Transportation Program, which are a Project of the Foundation • We Care Program: Founded in 1992 and now implemented by the Health Department, the We Care program assigns medically indigent patients to physician specialists who provide in-kind medical care as volunteers. Physicians may call 595-6500, ext. 1081 for more information. • Sponsorship of the “WE CARE” Program offering free medical specialty care to those in need. In 2014, approximately $6,809,001.76 million of free care was given to indigent patients in our community, provided by Baptist Health Care, Sacred Heart Health System, and West Florida Healthcare. Approximately 146 physicians volunteered as providers • The 2014 Bell Shippey We Care Doctor of the Year Award was given to Dr. Ian Weisberg at the 2015 ECMS Inaugural Ball. His total donated services were $50,959.00. • Support of new medically-based projects that seek to improve the quality of life for all citizens • GoSeniors! Voucher Transportation Program: The ECMS Foundation operates the GoSeniors! Transportation Program with the financial assistance from the Fellows Memorial Fund. The program started in 2011 to benefit healthcare continuity and has provided local residents, 60 years of age and older with transportation to physician appointments. Escambia County Medical Society Foundation has limited funds to support the We Care Program’s patients. In the past, funds have been used for medications, equipment and transportation to care settings. To donate to these causes, mail your check to the ECMS Foundation at the address below. You have a right to be proud of the work of the Escambia County Medical Society Foundation. Not every medical society has a charitable arm, and not all charitable arms are as active as yours and you should be very proud. The older of these two programs is the We Care Program. This is the program that was initiated by the Medical Society Indigent Care committee under the Leadership of Drs. Donna Jacobi, Stuart Shippey, Reed Bell and others. The work of setting up the processes, of enrolling physicians and getting the kinks in the system worked out was enormous. As you know, doctors are masters of hard work. To their credit, they got it done. The first patients were seen in March of 1992. The program had a clinic one day a week. From that clinic, referrals were made to specialists on a rotating basis, as needed. In 1994 the next big step forward was made. The Escambia County Clinics opened their doors in a new facility on Palafox and the We Care Clinic, being no longer needed, was closed. That same year, the name of The West Florida Medical Foundation, Inc. was changed to The Escambia County Medical Society Foundation, Inc and its bylaws were rewritten to cover the mission of the We Care program. Under the new bylaws and incorporation, an agreement was struck with the County Health Department to manage the screening of patients and assignment to specialists. The administrative costs were shared by agreement. We Care was a very complex operation to set up. It has been running more or less smoothly for so long now, that we may forget all the work that actually still goes on within it. Its service to our community still depends on your participation. Patients who are seen in the clinics or in private physician offices who cannot afford the specialty care or treatments are still processed out to the doctors and facilities in the community who donate their time on a rotating basis. If not enough specialists in one specialty volunteer then the ones who do have a disproportionate burden. The more who volunteer, the easier it is for the patient to be seen and the less the burden on any one physician. The more of us who volunteer, the better the outcomes for everyone. Last year, physicians and hospitals in our community donated $6, 809, 001.76 through the We Care Program. That is an amazing figure. The 2014 Bell-Shippey We Care Doctor of the Year was Dr. Ian Weisberg who contributed $50, 959.00 in services. The Health Care community is a good community full of good people. The more recent program, begun in May 2011, is called Go Seniors. This is a voucher program funded by a grant from the Fellows Memorial Fund. The Foundation issues vouchers worth up to $20 each to doctor’s offices. These vouchers are to be given to selected senior patients to provide cab fare to and from medical appointments. After a successful first year in which $30,000 in vouchers was distributed, the program was reviewed and the grant renewed for another year and another $30,000. It works through the doctors’ offices that give the vouchers to the seniors who need them. Without your help for the seniors, it does not get done. Over the years the Foundation has initiated and participated in various charitable activities. At different times the Foundation has sponsored other charitable causes. It has given prizes to winners of the local science fairs for students. It provided money for a public service billboard. It piloted a project designed to bridge the gap between hospital and home care for elderly patients living alone. The two current projects are keeping the Foundation fully engaged. It is your participation in the programs and your tax deductable donations that keep it all going. By the way, if you see a need in our community that might fit with the Foundation’s purpose, please let us know.. The money for the Foundation comes largely through tax deductable donations from the members of the Escambia County Medical Society.

In the event a patient fails to show up for an appointment, a physician can be left with a void in her schedule and a loss of billable time. To alleviate this problem, a physician may charge the patient for the missed appointment or an appointment cancelled 24 hours in advance if the patient is fully advised that physician will make such a charge. AMA Medical Ethics Code Opinion 8.0, Appointment Charges According to Chapter 12, section 30.3.13 of the Medicare Claims Processing Manual, which is attached to Change Request 5613 (CR5613), CMS’ policy is to allow physicians and suppliers to charge Medicare beneficiaries for missed appointments, provided that they do not discriminate against Medicare beneficiaries but also charge non-Medicare patients for missed appointments. The charge for a missed appointment is not a charge for a service itself (to which the assignment and limiting charge provisions apply), but rather is a charge for a missed business opportunity. Therefore, if a physician’s or supplier’s missed appointment policy applies equally to all patients (Medicare and non-Medicare), then the Medicare law and regulations do not preclude the physician or supplier from charging the Medicare patient directly. Medicare Claims Processing Manual, Chapter 1 - General Billing Requirements; Medicare Claims Processing Manual Chapter 12 - Physicians/Nonphysician Providers The other key points of CR5613 are: • The provider may bill the Medicare beneficiary directly. • Medicare does not make any payments for missed appointment fees/charges that are imposed by providers, physicians or other suppliers. • Claims for missed appointments sent to Medicare will be denied with the reason code 204 (This service/equipment/drug is not covered under the patient’s current benefit plan.). • In most instances, a hospital outpatient department can charge a beneficiary a missed appointment charge. • In the event, however, that a hospital inpatient misses an appointment in the hospital outpatient department, it would violate 42 CFR 489.22 for the outpatient department to charge the beneficiary a missed appointment fee. Unlike Medicare, Medicaid does not allow patients to be billed for missed appointments. If a patient routinely skips scheduled appointments, the office should consider discussing the situation with the patient. Florida Medicaid Provider General Handbook Chapter 1.5. Every physician is aware of the need to maintain adequate medical records for each of their patients. Such records are crucial to providing quality health care by serving as a basis for planning the patient’s care and recording essential medical information concerning the patient’s condition and treatment. Moreover, the records protect the physician legally by documenting the patient’s changing medical condition and evaluation, as well as actions taken by the primary care and consulting physicians. Furthermore, the need for adequate medical records is recognized not only by physicians themselves, but also by the federal and state governments, which have passed statutes and rules regulating the content, retention and accessibility of medical records. Federal privacy standards to protect patients’ medical records and other health information provided to health plans, doctors, hospitals and other health care providers took effect on April 14, 2003. Developed by the Department of Health and Human Services (HHS) to implement the Health Insurance Portability and Accountability Act of 1996 (HIPAA), those new standards provide patients with access to their medical records and more control over how their personal health information is used and disclosed. They represent a uniform, federal floor of privacy protections for consumers across the country. State laws providing additional protections to consumers are not affected by this new rule. HHS has produced many materials discussing and explaining the provisions of the privacy standards. These materials are available at http://www.hhs.gov/ocr/hipaa. Unless expressly stated, the provisions of Florida law discussed below are not preempted by the federal privacy standards. According to Section 458.331(1)(m), Florida Statutes, a physician may be disciplined for “[f]ailing to keep written medical records justifying the course of treatment of the patient, including, but not limited to, patient histories; examination results; test results; records of drugs prescribed, dispensed, or administered and reports of consultations and hospitalizations.” Moreover, Rule 64B8-9.003, Florida Administrative Code, in addition to the above, mandates that the records be legible and contain sufficient information to “identify the patient, support the diagnosis, justify the treatment and document the course and results of treatment accurately...” Finally, the physician should be aware that failure to keep written medical records could subject the physician to penalties ranging from a mere reprimand to a combination of a two-year suspension, followed by probation and a $5,000 fine. Section 456.057(14), Florida Statutes. Having created an appropriate record, physicians frequently are unsure of the time period during which they must maintain these files. While Rule 64B8-10.002, Florida Administrative Code, mandates that a physician retain these records for at least five years, the rule also recognizes that this time frame “may well be less than the length of time necessary for protecting the physician.” Under the Statute of Limitations and Statute of Repose, a claim of malpractice in certain instances may be brought against a physician up to seven years after “the date the incident giving rise to the incident occurred.” Section 95.11(4)(b), Florida Statutes. For this reason, it is recommended that physicians retain medical records for at least seven years. Admittedly, the storage of seven years’ worth of medical records may be both expensive and burdensome. Therefore, some physicians have chosen to store patient records electronically for easier storage. \While many courts allow www.escambiacms.org 45
Medical Records cont. reproductions of medical records to be admitted as evidence, even these courts require that several precautions be taken. First, the physician must have a written policy explaining which types of records are to be stored electronically and this policy must be applied to all records uniformly. Secondly, a custodian of the records must be appointed. Overall, extreme care must be taken prior to instituting any electronic record reproduction/storage system. Therefore, before instituting any document storage conversion, a physician should seek the input of qualified legal counsel. Finally, having properly created and preserved a medical record, a physician must ensure the record remains confidential. Section 456.057(5), Florida Statutes. Nevertheless, the physician must, upon request, furnish the patient or its legal representative with a copy of “all reports and records relating to [the patient’s] examination or treatment ... (other than AIDS, mental and substance abuse records),” although a psychiatrist or psychologist may substitute a report of the examination in lieu of the medical record. Section 456.057(4), Florida Statutes. If a patient requests a copy of his/her medical records, it is very important that the physician provide the patient with a complete copy of all the records, which would include, at a minimum, patient histories; examination results; test results; records of drugs prescribed, dispensed, or administered; reports of consultations and hospitalizations; and copies of records or reports or other documentation obtained from other health care practitioners at the request of the physician and relied upon by the physician in determining the appropriate treatment of the patient, even those records obtained from another physician. Section 456.057(4) and (13), Florida Statutes, Rule 64B8-9.003(3), Florida Administrative Code. Failure to do so may subject the physician to disciplinary action. Moreover, a physician must release copies of the medical record to parties authorized by the patient, and the physician must release copies of the record, even if not authorized to do so by the patient, if the records have been subpoenaed for a deposition, evidentiary hearing, or trial. Section 456.057(5), Florida Statutes. It should be pointed out, however, that HIV/AIDS records, sexually transmissible disease records, alcoholic drug abuse records and psychiatric and psychotherapeutic records are extremely confidential medical records and are not to be disclosed pursuant to a general release. The disclosure of these types of records require a written release by the patient identifying the specific records to be released or a court order to the same effect. Even a subpoena signed by an attorney is ineffective to release these super-confidential records. In maintaining a patient’s medical records, it is a good idea to clearly indicate a presence of super-confidential materials to avoid inadvertent disclosure. Physicians are required to keep a record of all disclosures of information contained in the medical records to third parties, including the purpose of the disclosure. Physicians must maintain the record of the disclosure in the patient’s medical records. The party to whom the physician disclosed the information may not disclose the patient’s medical information without the expressed written consent of the patient or the patient’s legal representative. Section 456.057(10), Florida Statutes.

Medical Records cont. When furnishing such copies, a physician may charge as follows: 1. For patients and governmental entities, the reasonable costs of reproducing copies of written or typed documents or reports shall be no more than $1 per page for the first 25 pages and 25 cents for each additional page. Rule 64B8-10.003, Florida Administrative Code. 2. For a workers’ compensation case, a physician may only charge up to 50 cents per page for the records and the direct cost for X-rays, microfilm, or other non-paper records. Section 440.13(4)(b), Florida Statutes. 3. For other entities, the reasonable costs of reproducing copies of written or typed documents or reports shall not be more than $1 per page. 4. Reasonable costs of reproducing X-rays, and such other special kinds of records shall be the actual costs. Rule 64B8-10.003, Florida Administrative Code. While a physician can condition the release of medical records upon payment of the copying costs, the release cannot be conditioned on payment of the physician’s bill for services rendered. Upon the receipt of a written request, the physician must provide the patient with a copy of his medical records within a reasonable time, regardless of whether or not he has outstanding charges due on his account. As has been shown above, medical records certainly are subject to a variety of federal and state statutes and regulations, all of which the physician must be aware of in order to avoid potentially drastic state action. In order to minimize this risk, it is recommended that the physician’s medical record procedures be reviewed for compliance with the aforementioned laws. The physician may wish to enlist the aid of a qualified health care attorney in this endeavor, as the input of informed legal advice may well aid the physician in the development of a medical record program which is workable and in compliance with state mandates. Participating in group savings programs could bring heavy costs

Last week, I receive a Groupon alert for a local restaurant I like. For those of you living under a rock, Groupon is a social networking group discount program. Here’s how it works: A local business, such as a restaurant or hair salon, offers a discount — often 50 percent off or more. This gets a lot of attention, but the discount isn’t activated until a critical mass of Groupon subscribers “tips” the deal. Enough people must commit to “paying” for the discount. That’s how Groupon gets paid. For the restaurant, the deal was $60 off. However, you had to pay Groupon $30 for the $60-off coupon. If you’re good at math, you recognize the deal is really $30 off, which is still a nice discount. The deal didn’t activate until it tipped with 20 people. By the end of the day that the coupon was available, more than 1,100 people ultimately took advantage of the deal. You now see the power of a rip-roaring discount. If the restaurant’s goal was to draw a large number of people to come try it out — and potentially become repeat customers — this Groupon deal could be a smashing success. Onward to health care. Some physicians and dentists have jumped in by offering Groupon discounts to subscribers for services, with the same goal as the restaurants. Think of the discount as a loss leader: Introduce new patients to the office. If they are happy with the service and care provided, perhaps they will become loyal, longterm paying patients. Some doctors are already reporting eye-popping results. More than 900 new patients for a cosmetic procedure in California. More than 100 new dental patients. Are these doctors losing money on the heavily discounted procedures? It’s difficult to tell. Will these people become long-term patients? Who knows? Here’s what we do know: Most medical and dental licensing boards have updated long-established policies that might create headaches for doctors embracing Groupon and other online daily discount websites as marketing tools. A scant few are tackling the issues, but most are sitting on the sidelines. More on that in a minute. Most licensing boards, if not all, have strict policies prohibiting fee-splitting. Fee-splitting occurs when a patient is “induced” to visit a provider and the doctor “kicks back” a referral fee to the referrer. There are safe harbors that don’t trigger enforcement of fee-splitting penalties, such as when a doctor refers to another doctor in his multi-specialty practice and they are both employees in the same facility. If they split profits at the end of the year, then, in a sense, the referral has generated extra fees split by all. Fortunately, as a safe harbor, this does not trigger any action. But if two unrelated doctors have a handshake agreement whereby referrals will be paid a cool $300 for every surgery, that’s likely against the law and probably violates licensing board fee-splitting policies. On its face, doctors who sponsor Groupon discount deals are giving Groupon a cut of their professional fees for the referrals. And since there is no safe harbor for Groupon deals, a doctor could end up on the wrong side of a Board investigation.

In the earlier example, it’s easy to see how a doctor abuses the trust of his patient by getting paid for referring to a surgeon and receiving cash for the referral. The cash taints the doctor’s judgment and puts his or her financial interest above the patient’s interest. But do payments to Groupon promote that same type of abuse? Doubtful. With Groupon, the prospective patient is being given information and a discount. The patient is free to make his or her own decision as to whether to accept the advertised discount. There is no pre-existing doctor-patient relationship whereby misplaced trust can result in a bad outcome. The Groupon model is consumerdirected health care in action. The federal government has laws on the books that also prevent “kickbacks.” The Office of Inspector General for the U.S. Department of Health and Human Services (OIG) issued an Advisory Opinion on an analogous program – pay-per-lead or payper call-program. There, OIG concluded that a pay-per-lead program did indeed violate the plain language of the Anti- Kickback Statute. And such a program did not qualify for any statutory safe harbor. That said, OIG concluded that it would not enforce the statute against participants in those programs, because such programs did not promote the type of abuse the statute was meant to curtail. While helpful in giving a doctor comfort, a doctor making a decision whether to participate in Groupon must also pay attention to the policies of his or her state professional licensing board. As noted, most licensing boards have explicit prohibitions against “fee splitting.” The Oregon Board of Chiropractic Examiners (OBCE) appears to be the first to tackle the issue. At a recent meeting, it formed a committee to draft language bringing its fee-splitting policy into the Internet age. Such language, if adopted, would narrowly allow doctor participation in Groupon-like programs without opening the floodgates for other practices that abuse the doctor-patient relationship for personal financial gain. It is unlikely that professional licensing boards would take a strong stand against individual doctors for promoting Groupon deals. After all, the model voluntarily pushes down the cost of health care. But Board investigations are often complaintdriven. So if patients complain to the Board for any number of reasons, an investigation might broaden to include allegations of fee-splitting. Doctors who want to test the waters with social networking group discount programs would be well advised to proactively lobby their licensing bodies to update their fee-splitting policies. If a Board takes action against a doctor for feesplitting, one can be sure that any assessed penalty would not be at a Groupon discount rate.

Courtesy of Medical Justice The observation that social media is experiencing explosive growth is hardly novel. Moreover, social media is significantly influencing the medical profession. CNNMoney. com reported that Facebook passed the milestone of half a billion signed-on users halfway into 2010. The professional and legal ramifications from the rapid growth of social media touch almost every aspect of medical practice today. One of the most challenging of these ramifications is a physician’s online reputation. The Pew Internet and American Life Project recently released numbers that document just how important a source of information regarding medicine and physicians the Internet has become. Among American adults, 61 percent look online for health information. Fortynine percent of Internet users report researching a specific disease or medical problem on the Internet. Forty-seven percent report seeking information about their physician or other health care professionals online. Finally, 5 percent of “e-Patients” have posted a review of a doctor online. It is these very reviews from a small subset that form the basis of a physician’s reputation online. “Reputations are forged when people make judgments upon the mosaic of information available about us.”5 Viewed in this light, ratings, blog postings and web pages are the pieces of the reputation mosaic. Unfortunately, all it takes is one or two bad pieces for the mosaic to be marred. The implications of a damaged online reputation are extensive. Most physicians equate a tainted online reputation with a direct loss of business. The analysis is simple: The worse the online reputation, the fewer the patients. There are certainly many examples to support this reasoning. Linda Morrison, M.D., a physician practicing in Indiana, experienced firsthand the harm that arises from an online reputational attack. In July 2000, Dr. Morrison noticed that an anonymous individual was posting defamatory statements about her via the Internet. Dr. Morrison received e-mails from this individual under a pseudonym “Surfycity45,” which, among other things, made threats against her medical license. The attacks continued into the fall of 2000. Dr. Morrison ultimately learned that “Surfycity45” had been circulating defamatory comments about her while simultaneously encouraging others to do the same. “Surfycity45” worked hard to organize a “cyber--mob,” with Dr. Morrison as its target. Dr. Morrison, via counsel, attempted to enjoin Defendant American Online Inc. to stop continued posting of the defamatory statements by the anonymous subscriber. For a variety of legal reasons, the U.S. Northern District Court of Indiana ruled against the injunction. Although Dr. Morrison alleged that Surfycity45’s statements were false, defamatory and resulted in damage to her professional reputation as a physician, she was unable to have these remarks removed from the Internet in a timely fashion. The damage was done. The implications of a physician’s online reputation now extend beyond patients. At least 27 states have a recognized cause of action for negligently credentialing a physician. Given this liability, credentialing committees will likely perform detailed background checks using all available search tools, including social network sites. “Health institutions making credentialing or hiring decisions currently face a dilemma when it comes to information about physicians contained in social network profiles. Although there may be some risks in searching against them (as discussed in the next section), the potential liability for making a panel decision in the absence of such information likely tips the balance.” It is not just patients and credentialing committees that are scrutinizing physicians’ online reputations. In any medical malpractice action, physicians should assume that the plaintiff’s attorney will be checking the doctor’s online reputation. Geoffrey Vance, a 38-year-old partner at McDermott, Will and Emry, uses social networking sites to gather facts about the opposing side for trials. “I make it a practice to use as many sources as I can to come up with and to find information about the other side” Vance said. “We used to run Lexus/Nexus; we still do that. We always look at cases, and now we use the Internet – Google, and social networking sites.” Vance is not alone. Paul Kiesel, a lawyer in Los Angeles County, admits to using social 50 E.C.M.S. CE Broker media not only to investigate the opposing side, but also to help select jurors. “Last month I had 50 jurors, and as the court clerk read out the names, I had two people in the courtroom and the third person back at the office, with all three of them doing research.” Lawyers are not the only actors in the courtroom who are using social media at trial. Courts across the country are grappling with the serious problem of “Internet-tainted” jurors. In case after case, judges and lawyers have discovered that jurors are doing independent research via cell phone during trials. Last year in Arkansas, a state court judge allowed a $12.6-million verdict to stand, even though a juror sent eight messages via Twitter from his cell phone. In another case, a juror decided to seek the wisdom of the masses by holding a Facebook online poll. “I don’t know which way to go, so I’m holding a poll,” wrote the democratic juror. Upon learning of this misadventure, the juror was dismissed and the case proceeded. Physicians’ online reputations are being examined with increasing frequency at crucial moments in their professional careers. It is no longer prudent for a physician to fail to monitor his or her online reputation. “Physicians should carefully monitor their online reputation. I have seen examples of exspouses, past employees, and competitors all posing as disgruntled patients in an online effort to damage a physician’s reputation. This is a real threat that is not going away,” said Internet defamation attorney Domingo Rivera, J.D. Whether physicians work through organizations such as Medical Justice, Search Engine Optimization (SEO) companies or go it alone, they need to guard their online reputations. In the words of Benjamin Franklin, “It takes many good deeds to build a good reputation, and only one bad one to lose it.”
