REPURPOSING & RECYCLING FOR ARTIFICIAL REEFS

ensacola is home to some of the most beautiful beaches in the country, attracting tourists, avid anglers and snorkeling/scuba enthusiasts alike. What the average beach goer may not know is what Pensacola is known for below the crystal-clear saltwater—a bolstering system of artificial reefs. Pensacola is a hotspot for artificial reefs, housing more than 500 public, man-made reef systems, including the largest artificial reef in the world, the U.S.S. Oriskany. Constructed between 1946 and 1950, the U.S.S. Oriskany is a 911-foot-long aircraft carrier that primarily operated in the Pacific in the 1970s. The ship earned two battle stars for service in the Korean War and five for service in the Vietnam War. After being decommissioned in 1976, sold for scrap in 1995 and repossessed in 1997, the 44,000ton aircraft carrier was thoroughly cleansed of toxic substances and sunk off the coast of Pensacola in 2006. The Florida Fish and Wildlife Conservation (FWC) selected Escambia County as Florida’s best candidate for reefing the Oriskany because Pensacola was a leading location for artificial reefs. Escambia County was not only one of the first counties designing, permitting and deploying artificial reefs, but it also continues, to this day, to lead the state in the sheer number of reef systems. The Oriskany is just one of twelve sunken carriers along the Florida Panhandle’s “Shipwreck Trail.” Five of the twelve sites are located in Pensacola and house thriving marine ecosystems and dive sites with varying depths and complexities. Artificial reefs are beneficial to both aquatic life and human life. Using decommissioned ships, vehicles, planes and construction rubble, manmade reefs provide hard surfaces where algae and invertebrates such as barnacles, corals and oysters can attach, which in turn boosts the

ecosystem of fish and marine animals. Reefs are built for a wide variety of reasons including promoting marine life in areas with featureless ocean floors, controlling erosion, blocking ship passages, blocking the use of trawling nets and even improving surfing. Over the years, the public popularity of reefs in Pensacola has continued to flourish as a byproduct of the increase in marine life and boosting the fishing and tourist economies. The Escambia County Marine Resources Manager Robert Turpin explained just how beneficial the reef programs are to our local economies: “In 2015, the FWC funded a study of Florida artificial reefs. The study concluded that fishing and diving on Escambia County’s artificial reefs provide for an annual economic impact of $150.8 million and supports more than 2,000 jobs.” The popularity is not trailing off anytime soon: the artificial reef program overseen by The Escambia County Marine Resources Division has plans to deploy more than 700 additional reefs off the coast of Pensacola. The new reefs are being funded partly by restitution money paid by the oil company BP in the aftermath of the massive 2010 Deepwater Horizon oil spill. Another buzzing plan in the works is the decommissioned Pensacola Bay Bridge, known by locals as the “Three-Mile Bridge.” With construction closing in on the new bridge, sections of the decommissioned bridge are set to be sunk in three locations. Escambia County partnered with the Florida

Department of Transportation and other state and federal agencies to obtain the site for the decommissioned bridge, which is now the largest permitted artificial reef site in Florida waters. “The Escambia Southeast Reef Site encompasses nearly 9 square miles of Gulf of Mexico seafloor, and is located southeast of Pensacola Pass. Water depths in the site range between 80 feet and 100 feet. The large site was needed to deploy the anticipated concrete from the Pensacola Bay Bridge demolition, as well as artificial reefs funded by the oil spill,” said Turpin. Continuing to construct new artificial reefs is paramount to the success of reef programs. Fish and wildlife respond to newly commissioned reefs almost immediately. The reefs provide shelter, food, and the growth of marine ecosystems. However, while Escambia County uses the most stable and durable reef materials that are available, reefs are prone to natural erosion. “The physical and chemical forces of the underwater marine environment cause the eventual deterioration and/ or subsidence of artificial reefs over decades. The most economically feasible long-term means of maintaining artificial reef habitat is to create new habitat at a greater rate than deterioration or subsidence,” explained Turpin. Continuing to build more reefs, just like the Marine Resources Division has set in the works with their estimated 700 new reef sites, is the solution to maintaining reef networks and oceanic life. On January 1 there are significant changes happening in county court. The judicial branch and clerks of court are working to ensure courts users in Florida are aware of what is going on. • On the first day of 2020: • Dollar limits for civil cases in county court double to $30,000 • Small claims cases are increasing to include amounts up to $8,000, an in crease of 60 percent • Civil filers must include a cover sheet that specifies the amount of money in dispute in cases valued at more than $8,000 • Filing fees remain as they have been and do not change Staff in the OSCA, in the judicial circuits, and with clerks of court are making operational and informational changes in preparation. Florida’s State Courts System and the Florida Court Clerks & Comptrollers worked together to develop a communications plan to inform the public of the changes. Public information officers in 20 judicial circuits and with 67 clerks of court along with communications staff at The Florida Bar are using coordinated messages, graphics, and video on their websites, in their offices, and on social media to make sure the public is aware what is coming. Increases in county courts’ jurisdictional limits were passed by the legislature and signed by the governor. Increases to small claims amounts and the civil cover sheet changes were adopted in rules approved by the Supreme Court. A series of videos featuring clerks of court, a county judge, and The Florida Bar President John Stewart explain different aspects of the changes and are also highlighted on websites and social media. The change should be seamless and invisible to most courts users. Lawyers and self-represented litigants who file electronically will be automatically prompted to include an amount in dispute when filing civil cases. The Florida Courts E-Filing Portal will automatically produce a civil cover sheet in compliance with new rules. Look for these messages on the websites and in the social media feeds of the OSCA and our circuits, along with clerks of court around the state. More details can be found at KnowYourCourt.org.

MAITLAND, Fla. – The 2020 Florida Pro Bono Law School Challenge will kick off on Feb. 3, 2020. The statewide competition, now in its second year, connects Florida law students with lawyers to partner on pro bono cases from local legal aid organizations. Students and lawyers can visit www.FloridaLawSchoolChallenge.org through April 3, 2020, to pick a case. All 12 of Florida’s law schools will compete to see which can take the most cases. Law students were thrilled to be given an opportunity to learn from lawyers and gain practical experience with clients through the first challenge,” Claud Nelson, the Foundation’s pro bono program director, said. “And, we heard from many lawyers that they had meaningful experiences mentoring a student and giving back to their community.” A core part of the Foundation’s mission is to promote public service among lawyers by making it an integral part of the law school experi-

ence. The Foundation launched the pilot version of the competition in January 2019. More than 300 students and lawyers were matched on cases. Florida Coastal School of Law won the top honor for matching the most students with its own alumni. Florida A&M University College of Law and The Barry University Dwayne O. Andreas School of Law were runners up. “After such a phenomenal response to our pilot, the Foundation knew we needed to continue this successful program,” Florida Bar Foundation President Hala A. Sandridge said. “It’s another unique Foundation project that has gained national attention for creative and efficient strategies that increase access to justice.” Nelson and Eli Mattern, CEO of SavvySuit, the legal tech firm that built the challenge’s online platform, will present on the challenge at Legal Services Corporation’s 2020 Innovations in Technology conference in January.

New Exhibit at Fort Pickens Will Highlight African American Soldiers in Pensacola during the Civil War

The National Park Service has just opened a new exhibit on December 14, at the Fort Pickens Discovery Center. The special exhibit highlights the 25th United States Colored Troops (USCT) that served in the Pensacola Bay Area during and immediately after the Civil War. The exhibit will be open daily from 9:00 a.m. to 4:30 p.m. through May 15, 2020. The exhibit will feature life-sized portraits of seventeen members of the 25th USCT, Company G, which were created by artist Shayne Davidson. The portraits are based on a locket-sized photo album which includes a photo of each man and all but one of their names. The original album is in the collection of the Smithsonian National Museum of African American History and Culture. The album was originally shared with Ms. Davidson by the great granddaughter of Captain William A. Prickett, the original owner of the album. “The men in the album bravely participated in a pivotal event in our nation’s history,” said artist Shayne Davidson. “It was a privilege for me to research their lives and create their portraits.” Over a six month period, Ms. Davidson created the incredible portraits and genealogical research on the men, which is displayed next to each portrait. In addition to the portraits, original artifacts from the USCT will be on display. An 1864 Fort Barrancas Muster Roll lists each of the seventeen men in the portraits as well as the other men of the company. Additional artifacts on display include a harmonica fragment, a book owned by a member of the 25th USCT, a recruitment song sheet, and more. The muster roll

and harmonica fragment are two of over 500,000 objects preserved in the park’s museum collection; other objects on display have been loaned to the park for the exhibit. The temporary exhibit, the first of its kind at Gulf Islands National Seashore, will feature the service of African Americans during the Civil War like never before. “We are proud to host these incredible works of art and artifacts which connect the stories of these brave men to the areas preserved by the national seashore,” said Superintendent Dan Brown. The timing of the exhibit is especially timely as the nation recognizes 400 years of African American history. The United States Colored Troops were segregated units of black men, led by white officers. The units were formed after the Emancipation Proclamation in 1863 officially authorized African Americans to serve in the US Army. The men of the 25th USCT were among the nearly 180,000 black men to serve during the Civil War. Learn more about the United States Colored Troops and the 25th USCT on the park’s website. The Fort Pickens Discovery Center is open daily from 9:00 a.m. to 4:30 p.m., except Thanksgiving, Christmas, and New Years days. It is located in the heart of the Fort Pickens Historic District just a short walk from the historic masonry fort. The center features exhibits on the natural and cultural history of Santa Rosa Island and the defenses built on the island over the centuries.

University of West Florida and Jikei College Group Address Global Cybersecurity Workforce Shortage with New Partnership The University of West Florida and the Jikei College Group in Japan announced a partnership that aims to enhance global cybersecurity workforce development, signing a memorandum of understanding on Monday, Dec. 2, at the UWF Center for Cybersecurity in downtown Pensacola. UWF and Jikei College Group established an educational partnership in 1989, providing American and Japanese students with opportunities to learn about each other’s country. The new agreement promotes educational collaboration in cybersecurity, which will benefit students and strengthen workforce development in the growing cybersecurity industry. The partnership includes cooperative education through the exchange of information on curricular and instructional materials, collaboration with the Center for Cybersecurity on industry events and training, and additional study abroad and faculty exchange programs. “As UWF looks beyond our successful cyber coast and thinks globally, a partnership with Jikei College Group makes sense for addressing the critical shortage of cybersecurity professionals we’re seeing on an international scale,” said UWF President Martha D. Saunders. “The UWF Center for Cybersecurity and Jikei College Group can leverage our unique educational strengths and secure the future on both sides of the globe.” The partnership agreement joins a number of established UWF Center for Cybersecurity initiatives that position the University as an international cyber hub. Existing resources include Cybersecurity for All and Florida Cyber Range, which equip organizations with cybersecurity education and train-

ing through a state-of-the-art platform. In addition, UWF serves as the Centers of Academic Excellence Regional Resource Center for the Southeast as designated by the National Security Agency and U.S. Department of Homeland Security. UWF provides cybersecurity education and training during a critical time. By 2021 there will be an estimated $6 trillion in cybercrime damages and 3.5 million unfilled jobs, according to Cybersecurity Ventures, a provider of data and analytics for the industry. FSU MEDICAL SCHOOL DRAWS WARNING Christine Sexton News Service of Florida TALLAHASSEE --- Florida State University’s medical school has received a warning from the organization responsible for accrediting medical schools across the United States and Canada. The warning said the FSU College of Medicine has failed to meet standards that, if not corrected within the next one to two years, could “seriously compromise the ability of the school to conduct the educational program.” College of Medicine Dean John Fogarty said that a Liaison Committee on Medical Education site team visited the school in April. University President John Thrasher was advised of the decision to issue a warning in an Oct. 25 letter. Fogarty said the College of Medicine is working to ensure that it addresses the site team’s concerns before the team comes back in spring 2020. “My expectation is over the next year they’ll like us again,” Fogarty told The News Service of Florida on Friday. “What we are able to say to the students is that we are fully accredited and that the LCME has some findings that we need to work on,” Fogarty said. “And we’ll get that done. And it will have no impact on their education. It should have no impact on anyone interested in coming here.” The LCME is responsible for the accreditation of educational programs

leading to medical doctor degrees in the United States and Canada. Fogarty said that before the LCME’s April visit, the College of Medicine spent 18 months reviewing the 96 LCME standards, identifying the program’s strengths and weaknesses. More than 400 pages of data were submitted to the accrediting organization in advance of the site team’s visit. “Given how well we did in 2011 with almost no findings, we were shocked that the visit team did not see or recognize how good we are and how far we have continued to advance since the last visit,” Fogarty said. LCME can make six decisions during the accreditation process. “Warning” is one of four that is considered “severe,” according to the Oct. 25 letter. A warning occurs when the accrediting body finds one or more areas of noncompliance with standards, according to the organization’s website. If left unaddressed, those deficiencies could “seriously compromise the ability of the school to conduct the educational program,” according to the website. Fogarty described the April site visit as “very unpleasant.” “We felt that team did not really understand us, did not understand our model and made a number of significant findings about our model that we felt were inaccurate and wrong,” Fogarty said. The LCME says on its website that findings are not public and don’t need to

be disclosed. While Fogarty shared the Oct. 25 letter, he told The News Service of Florida “it is clear” that the specific findings made by the site team were not a public record. But Fogarty said some findings were “picky,” such as not including on the school’s website the qualifications students need to meet to be enrolled in the College of Medicine. Another “picky” finding centered on bylaws, which Fogarty said have been corrected. Another three or four findings, Fogarty contended, stemmed from a misunderstanding about how the medical school program operates, the result of the site team not visiting the school’s six regional campuses. With backing from powerful state politicians, the College of Medicine was created by the Legislature in 2000 and designed as a community-based medical school. Unlike most schools, its students don’t train in large teaching hospitals anchored to the school. The first two years of the program are spent on the Tallahassee campus, where students enroll in required courses. After that, students are assigned to one of six regional campuses across the state where they do clinical training, partnering with physicians. Fogarty said the site team visited the regional campuses in 2011. But during this year’s review, faculty and students were brought to Tallahassee to meet with the site team, a move Fogarty said was “an error.”

“It’s very, very different from most traditional medical schools where they spend their time in a big box, in an academic medical center and hospital rotations,” he said. One area where the university fell short was the interaction of students with hospital residents. But Fogarty said that FSU medical students, “90 percent of the time” are working with board-certified physicians in doctors’ offices. Another standard cited by the LCME team, Fogarty said, dealt with medical conditions the students are required to be exposed to during training and the level of care they provide while in school. “We are all over that, but they just didn’t get it,” Fogarty said. Alan Levine, a hospital executive and member of the state university system’s Board of Governors, had not seen the LCME’s findings. Generally, though, he said the accreditation process is meant to be helpful. And while programs “hate” when they come up short, Levine said, the findings are meant to give colleges and universities “a road map of what needs to be worked on.” “FSU has been at this for a while,” Levine said. “They have a good medical school, and I think they’ll address it. I’d be more concerned if they go through another cycle and they don’t address the issues.”

FEDERAL POT LAW KEY IN FLORIDA LICENSE FIGHT Jim Saunders News Service of Florida TALLAHASSEE --- Pointing to a federal law that makes marijuana illegal, a U.S. district judge has tossed out a lawsuit filed by a Tampa firm that argues Florida health officials violated its dueprocess rights in a long-running dispute about a medical-marijuana license. Louis Del Favero Orchids, Inc., filed a notice that it is appealing U.S. District Judge Robert Hinkle’s decision to the 11th U.S. Circuit Court of Appeals. The firm contends Florida Department of Health officials violated its federal constitutional rights in not granting a potentially lucrative medical-marijuana license after Florida voters broadly legalized marijuana for patients in 2016. But while medical marijuana is legal in Florida, pot remains illegal under federal law. Hinkle wrote in his ruling last month that the federal law elimi-

nates due-process protection for Louis Del Favero under the U.S. Constitution’s 14th Amendment. “In other circumstances, this would constitute a property interest protected by the Fourteenth Amendment. Such a right can be denied only through procedures that provide due process,” Hinkle wrote. “But federal law makes it a crime to manufacture, distribute, or possess marijuana. Any interest an individual has in marijuana is not a property interest protected by the Fourteenth Amendment. Similarly, any interest in a license to manufacture, distribute, or possess marijuana is not a property interest protected by the Fourteenth Amendment.” Louis Del Favero filed the federal lawsuit in June while also pursuing state legal challenges against the Department of Health. Hinkle’s decision to dismiss the case did not address the details of the licensing dispute but focused on the interplay between federal and state laws on marijuana. As is common, Louis Del Favero’s notice of appeal, filed at the Atlantabased appeals court this month, does not provide extensive arguments. But in a September document filed in district court, Louis Del Favero’s attorneys contended that a federal law known as the Controlled Substances Act “bears no relevance to Del Favero’s constitutional claims for deprivation of a state property interest.” “While the CSA (Controlled Substances Act) prohibits possession,

manufacture, and distribution of marijuana --- it does not prohibit a person from possessing a license that affords immunity from prosecution under state law for engaging in such activities,” the firm’s attorneys wrote. But Hinkle wrote that when “Congress declares a substance contraband, an individual cannot have a ‘property’ interest in the substance within the meaning of the Fourteenth Amendment.” “Del Favero may or may not be correct that the defendants have violated its rights under Florida law,” the opinion said. “But Del Favero will have to look to state law and procedures for any redress. Del Favero possesses no Fourteenth Amendment property interest in the license it seeks.”
