Mountain Town Meets Beach Town
TELLURIDE FILM FESTIVAL COMING TO DOWNTOWN PENSACOLA

Freshly popped popcorn, a cool, crisp evening and a big white screen are perhaps the three best ingredients to a film festival—even if we happen to get more humid than crisp nights here in Pensacola. Currently, Pensacola is home to two reoccurring film festivals: the Stamped LGBT Film Fest and the Pensacon Short Film Festival. One surrounding the identities, lives, and issues of those within the LGBT community and the other celebrating all that is enveloped within the Pensacon comic convention. On February 21, a third film festival is coming to Pensacola: Mountainfilm. Mountainfilm originated in Telluride, Colorado in 1979. The festival showcases nonfiction films and shorts about environmental, cultural, political and social justice issues. While the festival was originally held in only Telluride, Mountainfilm began touring the globe in 2000 to spread their films to a larger audience and educate the public on pressing issues. Jacey J. Cosentino, Financial Advisor for The RadcliffSchatzman Group at Morgan Stanley is one of the directors for the Pensacola Mountainfilm event. The Radcliff-Schatzman Group is sponsoring to bring Mountainfilm to Pensacola. Cosentino focuses on sustainable, environmental and social governance focused investments. She is also a self-proclaimed “film-anthropist” with a passion for film and giving back to the community. “The main objective is philanthropy. 100 percent of the proceeds from the festival go to charity. Our selected organization is Healthy Gulf, so we’re trying to select a few films that reflect their work in protecting and preserving our waterways,” said Cosentino.
Cosentino’s first experience with Mountainfilm came from a family trip to Telluride. After experiencing the festival first-hand, she decided that not only would it become a family tradition to attend the festival, but that she also had to work on bringing the festival to Pensacola. “Telluride is a small town, so they block off most of it for the festival. Picture Palafox Street stretching from Main to Garden just covered with people there to watch these environmentally conscious films—walking or biking to get around. Some of the venues are in smaller theaters, similar to our Saenger or Pensacola Little Theatre. Most people stay up in the mountains and ride the gondola down the mountain to the festival. It’s a trip that you don’t leave from feeling rested or rejuvenated—you leave wanting to do so much more than you’re currently doing,” explained Cosentino.
Environmental and social activism are pillars for the film festival. The films can range from minutelong shorts to 90-minute matinees. The screen might open on a picturesque mountain view or a surfer gliding across waves, but the bigger picture is aimed at protecting and preserving those mountains and waterways for future generations. “The directors of these films work tirelessly to bring them to the masses, and they’re just beautiful. They’re not like the standard documentaries you see on TV. Sometimes it takes them years to work on them, immersing themselves in communities and staying put in one concentrated area for years to really document an issue. I think the visualization is what drives these issues home for people. I know that when I went to Mountainfilm Festival, I went into it thinking I knew so much about all of the issues on

our planet, and I just didn’t.” The films shown at Mountainfilm are curated works of art that promote sustainability and education. They also promote cultural exchange and learning about the issues affecting other people around the world. “I think that we’re in a day and age, not only globally and nationally but locally here in Pensacola, that we need to be exposed to the larger picture—the bigger view of what’s happening in our world because it’s affecting everybody. It’s all of our duties to attend events like this and educate ourselves to better relate to the problems and people in the world,” said Cosentino. The one-night only premiere of Mountainfilm will be hosted at the Museum of Commerce downtown Pensacola on Feb. 21 from 7 pm to around 9 pm, with doors opening at 6pm. End of the Line Café will be catering food and general admission tickets will cost $15. Come out for a night of cinematic adventure and learn a thing or two in the process.

Shelley Guy Reynolds Will Receive Florida Bar Bro Bono Award in Supreme Court Ceremony Jan. 30 The Florida Bar will recognize 22 lawyers for their work on behalf of low-income and disadvantaged clients at a Jan. 30 ceremony at the Supreme Court of Florida. Established in 1981, The Florida Bar President’s Pro Bono Service Awards are intended to encourage lawyers to volunteer free legal services to the poor. The annual awards recognize those who make public service commitments and raise public awareness of the volunteer services provided by Florida lawyers. Florida Bar President John M. Stewart will present the 2020 awards. Shelley Guy Reynolds, a graduate of The Florida State University School of Law in 1989, began her legal career at the State Attorney’s Office in Escambia County. Working in the
juvenile division, she felt most helpful to the families of young, troubled children. Now Reynolds, who has her own practice, works with Legal Services of North Florida on domestic violence cases and child delinquency cases, having invested seven months and more than 250 hours on a case with one child. Reynolds worked to preserve the child’s legal status within the United States and to keep the child from being housed in a Department of Juvenile Justice program. Her stubborn commitment to the child didn’t make her popular with her adversaries, but eventually, thanks to the hard work by co-counsel at LSNF and a special, out-of-town Guardian Ad Litem, they secured a favorable result for the child. Reynolds’ pro bono work changed the way the juvenile court now handles immigrant children’s delinquency cases.
ESCAMBIA COUNTY VETERANS COURT IN NEED OF MENTORS
Escambia County Veterans Treatment Court, January 10, 2020: Escambia County Veterans Treatment Court Judge and veteran of military service, the Honorable Gary Bergosh, resolves to build on previous program success by bolstering the Veteran Mentor program with a kick-off event at the Artel Gallery of Pensacola on January 29, 2020 from 5:30 - 7:30 p.m. Veterans Treatment Court was initiated in 2015 in Escambia County as a proactive response to justice-involved veterans with non-violent criminal conduct related to mental health and substance abuse issues stemming from military service. The program allows honorably discharged veterans the opportunity to engage in the closely monitored program that requires regular court appearances (a weekly minimum in the early phase of the program), as well as mandatory attendance at treatment sessions and frequent and random testing for substance use. Veterans respond favorably to this structured environment, given their past experiences in the Armed Forces.
“Since establishing Escambia’s Veterans Treatment Court, we have seen decreased incarceration for military veteran non-violent offenders and an increase in the number of veterans receiving substance and mental health assistance,” said Judge Bergosh, a retired Marine Corps officer. Current statistics reveal that one in five veterans has symptoms of a mental health disorder or cognitive impairment. One in six veterans who served in Operation Enduring Freedom and Operation Iraqi Freedom suffers from a substance use issue. Research continues to draw a link between combat-related service and/or trauma and substance use. It is hoped that by keeping veterans out of jail and prison, Veterans Treatment Court saves the lives, families and futures of justice-involved veterans, all while reducing costs to the taxpayers. ENDANGERED AFRICAN PENGUIN CHICK BORN AT GULFARIUM
The Gulfarium Marine Adventure Park is celebrating Penguin Awareness Day in the best way possible, by announcing a new addition to their endangered African penguin family. The Gulfarium, located on Okaloosa Island in Fort Walton Beach, revealed that a penguin chick hatched at the park on December 20th, 2019. The penguin chick was raised by surrogate penguin parents, Missy and Tubbs, for the first three weeks of his life. “Once an egg is laid, we remove it from the nest and replace it with a fake egg for the adult penguins to sit on. This is so that we can closely monitor the development of the fetus. We give fake eggs to multiple of our mated pairs to encourage them to learn how to care for an egg. Once the chick hatches, we place it in the nest with the surrogate parents and remove their fake egg. In the wild, it is not uncommon for eggs
to not develop, so the penguins who do not receive the chick, simply remove the fake egg from their nest when it does not hatch,” explains Bryan Martin, Director of Animal Management. “As Ninja and Jelly have successfully raised a chick in the past, we gave Missy and Tubbs the opportunity to learn, under staff supervision. Our animal care specialists would monitor the growth of the chick with frequent weight checks. Now we have further pairs of adult penguins that know how to successfully raise a chick in case we ever have 2 eggs hatch around the same time. “ “African penguins are an endangered species,” says Mary Kate Northup, Gulfarium’s Operations Manager. “They are at serious risk of extinction, so any effort we can do to help preserve the species is vital. Penguin Awareness Day is the perfect way to educate the public on how we can help to protect
this wonderful species.” The wild African penguin population has decreased at the alarming rate of over sixty percent in the last 30 years. This penguin chick will be the third chick in the Gulfarium’s penguin colony that was born to parents, Ninja and Jelly. Ninja and Jelly’s first chick, Becky, hatched in December 2016 and quickly became a well-known member of the Gulfarium’s animal family. Becky’s brother, Toto, hatched on September 12th, 2018 and recently completed his first molt, where his juvenile feathers were shed and replaced with his tuxedostyle, black and white adult feathers. “Our team is doing everything we can to not only protect this species from extinction, but also teach our guests about
what they can do to help. Through the experiences and education that we provide here at the Gulfarium, we hope to inspire our guests to respect and love wildlife as much as we do.” says Patrick Berry, Gulfarium’s Senior Vice President. The Gulfarium anticipates that the chick will begin to grow his waterproof feathers in just a little over a month and shortly thereafter, be ready to learn how to swim so that he can be out on exhibit with the rest of the penguin colony. The public is invited to follow the chick’s progress on Gulfarium’s Facebook page. All updates, including milestones will be made available via Facebook.
DIB COMPLETES SEVERAL SAFETY INITIATIVES, LAUNCHES NEW STEPS AND PURSUES OPPORTUNITIES FOR INNOVATION AND COLLABORATION WITH CITY DEPARTMENTS As downtown Pensacola continues to grow, the Downtown Improvement Board is investing in technology, partnerships and infrastructure to make the 44-block district safe and secure for those who work, live and play downtown. One of the ways the DIB is addressing safety is through collaborative relationships such as one forged with the City of Pensacola Community Redevelopment Agency in December, which put two additional dedicated patrolmen on downtown streets. The DIB also drove an initiative that paired Pensacola Police Dept. and private industry to combine police surveillance cameras with private security systems installed in and around downtown businesses. With ac-
cess to a more comprehensive view of the area, the police are able to intervene faster and more knowledgeably if and when an incident occurs. “The DIB district is rapidly evolving with a lot of moving parts,” said Lissa Dees, DIB executive director. “Our challenge is to approach difficulties and opportunities with innovative solutions so we can create and maintain a safe, secure environment for everyone who enjoys downtown.” In addition to new law enforcement officers and shared surveillance video, here are some of the other ways the DIB is addressing the important work of keeping downtown safe:

STATE UNEMPLOYMENT RATE HITS RECORD LOW
News Service of Florida Staff The unemployment rate in Florida dropped to 3.0 percent in December, the lowest mark since the current estimating process started in 1976, according to numbers released Friday by the state Department of Economic Opportunity. The December rate, lower than the national mark of 3.5 percent, represented an estimated 311,000 Floridians out of work from a workforce of 10.511 million. The seasonally adjusted estimate was down from 3.1 percent in November and was 0.3 percentage points better than at the end of 2018. Gov. Ron DeSantis, who took office in January 2019, touted the new numbers. “I remain laser-focused on ensuring Florida
is offering a world-class pool of talent to businesses and investing in our students and educators,” he said in a prepared statement. “We continue to prioritize the protection of our natural resources and water quality while also continuously searching for ways to support new and innovative industries which are helping to produce historically low unemployment in our state.” Department of Economic Opportunity Executive Director Ken Lawson pointed, in part, to policies that encourage businesses to invest in the state. “They want to hire people, and our citizens have confidence they can find a job in the state of Florida,” Lawson said. The changes over the past year were topped
by an additional 54,000 education and health service jobs, followed by 47,900 new jobs in the leisure and hospitality sector and 35,500 in professional and businessservices fields. Across the state, the Miami-Fort Lauderdale-West Palm Beach Metropolitan Statistical Area had the lowest jobless rate at 2.2 percent, followed by the Crestview-Fort Walton Beach-Destin area at 2.3 percent. Four areas — Cape Coral-Fort Myers, Orlando-Kissimmee-Sanford, Naples-Immokalee-Marco Island and Gainesville — were each at 2.5 percent. The highest unemployment rates were in The Villages and Homosassa Springs areas, each at 4.0 percent.
DESANTIS TOUTS NEW EDUCATION STANDARDS
News Service of Florida Staff Gov. Ron DeSantis announced new education standards on Friday, a year after he vowed to eliminate the “vestiges” of the controversial Common Core standards. “The new plan is done. It is going through the final editing process,” the governor said at a news conference in Naples. DeSantis did not make available full details of the new standards, which will be called the BEST Standards. But according to a summary document released by the Florida Department of Education, the standards include changes to the way students learn math and American history and will offer a reduction
in testing. The standards will also eliminate “crazy math” that DeSantis said was a roadblock for parents who wanted to help students with homework. Civics will be “embedded” into languagearts lessons at every grade level, and there will be an “civics book list” integrated across all grades, the document says. “I wanted to make sure we had a renewed emphasis on American civics and understanding the principles that make America great,” DeSantis said. The announcement came six year after former Gov. Rick Scott took aim at the Common Core standards, which were developed by officials in 48 states and have
drawn heavy criticism from Republican voters. The State Board of Education in 2014 adopted what are known as the Florida Standards, a move that involved making changes to Common Core. DeSantis’ BEST Standards, which stands for Benchmark for Excellent Student Thinking, will need approval from the State Board of Education. When adopted, the language-arts curriculum is expected to be updated for the 2021-2022 year, and the math curriculum would be updated for the 2022-2023 year, according to the Department of Education.

As is common, the notice did not detail arguments that will be raised by Moody’s office, but the appeals court last month also asked the Supreme Court to resolve constitutional questions in the case — a move known as certifying questions of “great public importance” to the Supreme Court. In the case, police obtained a warrant to seize an iPhone from robbery defendant Matthew Tyler Pollard’s car and
asked a judge to force him to turn over the passcode. The divided appeals court overturned a circuit judge’s order that would have required Pollard to turn over the passcode, pointing to 5th Amendment rights against self-incrimination and raising concerns that authorities could undertake a “fishing expedition.” Similar issues have confronted courts elsewhere in Florida and across the country.
‘PARENTS BILL OF RIGHTS’ BACKED IN HOUSE
News Service of Florida Staff A bill that would create a “Parents’ Bill of Rights” to offer parents more control over issues such as their children’s education and health care was approved by a House committee Thursday. The bill (HB 1059), sponsored by Rep. Erin Grall, R-Vero Beach, drew opposition from LGBT groups and Planned Parenthood. Opponents argue the bill could hurt gay and transgender children and prevent access to birth control for some minors. But supporters say the bill, approved by the House Education Committee, would help give parents more control over their children’s
upbringing. For instance, parents would be able to withdraw their children from “any portion of the school district’s comprehensive health education” if they find the coursework goes against their moral, sexual or religious beliefs. Under state law, health education includes sex education. The bill also would prohibit health-care practitioners from prescribing drugs, such as birth control, to children without written parental consent. A violation of that provision would be a first-degree misdemeanor, which carries a penalty of up to a year in jail or a $1,000 fine. Grall’s proposal would require all school districts to adopt

McCollough has earned many honors and awards throughout her career, including the title of 2017 Artist of the Year by Art Tour International in Florence, Italy. She maintains a studio and gallery next to the Villas at the McCollough Institute in Gulf Shores. McCullough earned her Bachelor of Science in theater and art from the University of Alabama. PHONE PASSCODE DISPUTE GOES TO SUPREME COURT

JUSTICES BACK AWAY FROM MAJOR DEATH PENALTY RULING Jim Saunders News Service of Florida TALLAHASSEE — The Florida Supreme Court said Thursday that unanimous jury recommendations are not necessary before death sentences can be imposed, as justices backed away from a 2016 decision that revamped the state’s capital-punishment system. The 4-1 ruling offered a clear picture of how much the Supreme Court has changed since last January, when a conservative majority took control after the retirements of longtime justices Barbara Pariente, R. Fred Lewis and Peggy Quince. Thursday’s majority opinion said the court “got it wrong” in 2016 when it required changes such as unanimous jury recommendations on death sentences. The 2016 ruling came as judges, lawyers and state leaders tried to move forward after the U.S. Supreme Court had found Florida’s death-penalty system unconstitutional. “Last, lest there be any doubt, we hold that our state Constitution’s prohibition on cruel and unusual punishment … does not require a unanimous jury recommendation — or any jury recommendation — before a death sentence can be imposed,” said Thursday’s majority opinion shared by Chief Justice Charles Canady and justices Ricky Polston, Alan Lawson and Carlos Muniz. “The text of our Constitution requires us to construe the state cruel and unusual punishment provision in conformity with decisions of the (U.S.) Supreme Court interpreting the (U.S. Con-
stitution’s) Eighth Amendment. Binding Supreme Court precedent … holds that the Eighth Amendment does not require a jury’s favorable recommendation before a death penalty can be imposed.” But Justice Jorge Labarga wrote a highly critical dissent, arguing that the majority “has taken a giant step backward and removed a significant safeguard for the just application of the death penalty in Florida.” “Today, a majority of this court recedes from the requirement that Florida juries unanimously recommend that a defendant be sentenced to death,” Labarga wrote. “In doing so, the majority returns Florida to its status as an absolute outlier among the jurisdictions in this country that utilize the death penalty. The majority gives the green light to return to a practice that is not only inconsistent with laws of all but one of the 29 states that retain the death penalty, but inconsistent with the law governing the federal death penalty.” The ruling came in a Polk County case in which Mark Anthony Poole was convicted in the 2001 first-degree murder of Noah Scott, the attempted murder and sexual battery of Loretta White, armed burglary and armed robbery. After years of litigation, a jury in 2011 recommended by a vote of 11-1 that Poole should be sentenced to death — a sentence that a judge imposed. But based on the Florida Supreme Court’s 2016 decision, Poole’s death sentence was later vacated because of the lack of a unanimous jury recommen-
MILITARY TRAINING COULD TURN INTO COLLEGE CREDITS
Ana Ceballos News Service of Florida TALLAHASSEE — Florida lawmakers are fast-tracking legislation that would allow service members and veterans to receive college credits for their military training, with the goal of saving time and money. House and Senate proposals were approved Thursday in their final committees and are now able to get votes in the full House and Senate as early as next week. The bills (SB 372 and HB 171) received unanimous support at all of their committees. The measures, sponsored by Sen. Tom Lee, R-Thonotosassa, and Rep. Mel Ponder, R-Destin, would direct a committee within the Florida Department of Education to determine what types of military experience and training would be able to be turned into academic credits. “It could be something as simple as mechanic work, or it could be firefighting or it could be cybersecurity or whatever the case may be, but all within the confines of the military,” Ponder told The News Service of Florida after the House Education Committee approved his bill. The bills would require the Department of Education’s Articulation Coordinating Committee to put together a 13-member workgroup to determine the minimum college credits or certification hours that would need to be awarded to service members for their experience in the military. The workgroup would have until Dec. 1 to submit coursework recommendations to the state university system’s Board of
Governors and the State Board of Education for approval. Under the bills, any college credits or clock hours awarded to service members for their military experience would follow the students if they attend more than one Florida university, college or career center. Ponder believes his bill would help “lighten” the workload of military members and help them transition back into society. “That is a great thing we can do to honor the military,” the Destin Republican said. Ponder said he has not heard from the office of House Speaker Jose Oliva, RMiami Lakes, but that the bill could be heard as soon as next week on the House floor. Lee’s bill would go a bit further than Ponder’s proposal. It includes a provision that would require Florida universities, colleges and career centers to waive all transcript fees for service members and veterans, as well as for their spouses and children. “The transcript fee waiver may further assist with making higher education more affordable for active duty members and honorably discharged veterans of the Armed Forces,” according to the Senate bill’s staff analysis. An estimated 8,000 veterans or active duty military members in the state higher-education system generate between $48,000 and $80,000 in transcript fees, according to 2017-2018 enrollment data provided by Senate
dation, Thursday’s opinion said. That spurred the state to appeal. The Supreme Court on Thursday ordered that Poole’s death sentence be reinstated. The opinion came after a long, complicated series of issues that stemmed from a January 2016 ruling by the U.S. Supreme Court in a case dubbed Hurst v. Florida. That ruling found the state’s death-penalty system was unconstitutional because it gave too much authority to judges, instead of juries, in imposing death sentences. The Florida Supreme Court in October 2016, in the similarly named case of Hurst v. State, interpreted and applied the U.S. Supreme Court ruling. In addition to requiring unanimous jury recommendations, it also dealt with a critical issue of jurors finding what are known as “aggravating factors” that can justify death sentences. The Florida court said that before judges could impose death sentences, juries would have to unanimously find that aggravating factors were proven beyond a reasonable doubt; unanimously find that aggravating factors are sufficient to impose death; unanimously find that aggravating factors outweigh “mitigating” factors; and unanimously recommend death sentences. But in Thursday’s opinion, the majority said that interpretation went too far. It said juries are required to unanimously find the existence of one or more aggravating factors, but it backed away from the other legal conclusions reached in October 2016. “Without legal justification, this court
used Hurst v. Florida — a narrow and predictable (U.S. Supreme Court) ruling that should have had limited practical effect on the administration of the death penalty in our state as an occasion to disregard decades of settled (U.S.) Supreme Court and Florida precedent,” the majority opinion said. “Under these circumstances, it would be unreasonable for us not to recede from Hurst v. State’s erroneous holdings.” In 2017, the Legislature passed a law that required unanimous jury recommendations as it complied with the state Supreme Court ruling — a move that Thursday’s opinion acknowledged. “Our decision today is not a comment on the merits of those changes or on whether they should be retained,” the opinion said. “We simply have restored discretion that Hurst v. State wrongly took from the political branches.” But in his dissent, Labarga wrote that there is “every reason to maintain reasonable safeguards for ensuring that the death penalty is fairly administered.” “I strongly object to the characterization of this court’s decision in Hurst v. State as one where this court ‘wrongly took (discretion) from the political branches.’ As the court of last resort in Florida’s third and co-equal branch of government — whose responsibility it is to interpret the law — that is what this court did in Hurst v. State. The constitutionality of a provision of Florida’s death penalty law is uniquely this court’s to interpret,” Labarga wrote.
HOUSE, SENATE TO TAKE UP GENETIC INFORMATION ISSUE News Service of Florida Staff The full House and a Senate committee next week will consider priority legislation of incoming House Speaker Chris Sprowls: a proposed ban on insurers using customers’ genetic information to make policy decisions about life insurance, long-term care insurance and disability insurance. The House is slated to take up its proposal (HB 1189) during a floor session Wednesday, while the Senate Banking and Insurance Committee on Tuesday will consider a Senate version (SB 1564) sponsored by Lakeland Republican Kelli Stargel. Federal law already prevents health insurers from using genetic
information in underwriting policies and in setting premiums. But the prohibition doesn’t apply to life insurance or longterm care coverage, which Sprowls, RPalm Harbor, has described as a “massive loophole.” Insurance companies have testified they don’t use the information now. But Sprowls said he worries they might try to use it in the future as the popularity of genetic tests, such as 23andMe, continues to grow. Florida would become the first state to have such a law if Sprowls and Stargel are successful. Sprowls is slated to become House speaker after the November elections.
STATE TOPS 100 HEPATITIS A CASES IN NEW YEAR News Service of Florida Staff After a major outbreak in 2019, Florida has topped 100 cases of hepatitis A in the new year. As of Saturday, 101 cases had been reported in January, including 40 cases last week, according to the state Department of Health. The largest concentrations this month were in Duval and Polk counties, which had 12 and 10 cases, respectively, as of Saturday. Hepatitis A can cause liver damage and is spread
through such things as fecal matter. That can include transmission by people not properly washing their hands after going to the bathroom and contaminating food or drinks. Health officials have urged people to get vaccinated against the virus. Florida totaled 3,397 reported cases in 2019, after having 548 cases in 2018 and 276 cases in 2017, Department of Health numbers show.
