We’re not picky eaters, but we’re careful eaters.” The idea is for the restaurant to be a healthy grab-and-go spot. Customers choose white rice, brown rice or quinoa as the base; organic, oven-roasted chicken, grass-fed beef or tofu as the protein; and teriyaki, barbecue, flaming hot or “P.EX Original” as the flavor. Each sauce is made in house. Pineapple

Express also sells Dole Whip, which is something like dairy free pineapple ice cream. “For our anniversary, we went to Hawaii. It was the first time we ever had the Dole Whip, and I have lactose intolerance, so I was nervous about eating it. When I tried it, it didn’t upset my digestive system, so I enjoyed it. It’s an ice cream I am able to eat.” Opening Pineapple Express is not the end of the road for Erin and Michael. They plan to open more locations in Florida, and first on their list is Navarre. They also own a food truck, so they plan to pop up around town during the lunch rush soon. Pineapple Express is located at 224 E. Garden St., Suite 6. You can stop by Mon.-Sat. 11 am – 3 pm.

KNOW YOUR COURT CAMPAIGN HIGHLIGHTS COUNTY COURT CHANGES On January 1 there are significant changes happening in county court. The judicial branch and clerks of court are working to ensure courts users in Florida are aware of what is going on. • On the first day of 2020: • Dollar limits for civil cases in county court double to $30,000 • Small claims cases are increasing to include amounts up to $8,000, an in crease of 60 percent • Civil filers must include a cover sheet that specifies the amount of money in dispute in cases valued at more than $8,000 • Filing fees remain as they have been and do not change Staff in the OSCA, in the judicial circuits, and with clerks of court are making operational and informational changes in preparation. Florida’s State Courts System and the Florida Court Clerks & Comptrollers worked together to develop a communications plan to inform the public of the changes. Public information officers in 20 judicial circuits and with 67 clerks of court along with communications staff at The Florida Bar are using coordinated messages, graphics, and video on their websites, in their offices, and on social media to make sure the public is aware what is coming. Increases in county courts’ jurisdictional limits were passed by the legislature and signed by the governor. Increases to small claims amounts and the civil cover sheet changes were adopted in rules approved by the Supreme Court. A series of videos featuring clerks of court, a county judge, and The Florida Bar President John Stewart explain different aspects of the changes and are also highlighted on websites and social media. The change should be seamless and invisible to most courts users. Lawyers and self-represented litigants who file electronically will be automatically prompted to include an amount in dispute when filing civil cases. The Florida Courts E-Filing Portal will automatically produce a civil cover sheet in compliance with new rules. Look for these messages on the websites and in the social media feeds of the OSCA and our circuits, along with clerks of court around the state. More details can be found at KnowYourCourt.org.

On Friday, January 17 from 5pm-9pm Gallery Night Pensacola will celebrate the Lunar New Year! UWF’s International Programs and the Office of Equity and Diversity have teamed up with Gallery Night Pensacola to celebrate the Year of the Rat, with more than 250 Chinese Lanterns hanging above the streets of Downtown Pensacola. This month’s theme features artistic performances by Big Green Drum Double Dragon Dance, Bayanihan Youth Group - traditional Filipino dances, Pearl of the Orient (Penscola Fil-Am) - traditional Filipino dances, Emerald

Coast Okinawa - Taiko drum, Red Envelope Parade, UWF Korean Language Class - Gayageum & fan dance, UWF Asian-American Student Union (BibimBop, Fashion Show, etc.), Tai Chi, Lion Dance and more. Seville Quarter Hosts 24th Annual Great American Chili Cook-Off

With beans, without beans, white, red, easy to eat or hottern-hell, you’ll find every type of chili imaginable at Seville Quarter’s 24th Annual Great American Chili Cook-off. Pull out your favorite recipe and gather your “Bean Team Friends” for Pensacola’s Best Chili Cook-off on Saturday, January 18, 2020 in Phineas Phogg’s. Amateur and professional teams will compete for bragging rights for the greatest chili in Pensacola. Each concoction

will be judged on taste, smell and consistency and trophies will be awarded to the top three winners. In addition there is a Showmanship trophy (decoration and entertainment) as well as the coveted People’s Choice trophy. Entry to the competition is $20 per team (three chefs per team) and is limited to the first fifteen teams. Each team must prepare their chili “from scratch” at Seville Quarter. Cooking begins at noon and the judging begins at 4:00pm. The public tasting is

UWF appoints new dean for College of Business

University of West Florida Provost and Senior Vice President George Ellenberg announced the appointment of Richard Fountain as dean of the College of Business. Fountain previously served as chair for the Department of Accounting and Finance at UWF since 2017. “We welcome Richard’s expertise with confidence that his leadership will allow the College of Business to continue thriving,” Ellenberg said. “His priorities and goals align with the institution’s and will foster an increasingly strong relationship between our students and the local community.” As dean of the College of Business, Fountain is responsible for oversight and management of six academic departments, as well as the Center for Entrepreneurship, the Center for Supply Chain Management Excellence, Louis Maygarden Center for Financial Literacy and the Florida Small Business Development Center. Fountain joined the Department of Accounting and Fi-

nance as an adjunct instructor in 2009, following a successful 30-year law career in Mississippi. During his two years as chair of the department, he has focused on recruiting for the Master of Accountancy program, more than doubling the number of new students joining the program since 2017. “While I enjoyed practicing law, I love what I do at UWF—educating people and creating opportunities for them to thrive,” Fountain said. “Anytime I see students, I introduce myself, inquire about their studies and give them my card. I love this University, and I believe it is my time to lead the College of Business and to better the lives of our students and the quality of their education.” Additionally, Fountain has strengthened and built new relationships with accounting firms and other related businesses in Pensacola to increase student internships and permanent job opportunities. He established the Accounting and Finance Advisory Council, comprised of 25 community business lead-

ers who serve as guest lecturers and mentors and aid in recruiting efforts. He’s cultivated relationships with colleges and high schools to recruit more undergraduates, resulting in the completion of an articulation agreement with Pensacola State College, as well as the repurposing of eight scholarships targeting PSC students. A soon-to-be completed articulation agreement with Pensacola Christian College will draw over 200 possible accounting students and recent graduates to the department. Prior to joining UWF, Fountain helmed the Law Offices of Richard M. Fountain, P.A., which he founded in Jackson, Mississippi, in 1987. He earned a Master of Laws in Taxation from the University of Florida, a Juris Doctor from the University of Mississippi, a Bachelor of Arts in Accounting from UWF and an Associate in Arts from Pensacola Junior College. STATE, NATIONAL GROUPS TAKE AIM AT GUN LAW

Jim Saunders News Service of Florida TALLAHASSEE --- The legal battle over a 2011 Florida gun law continues to ratchet up. State and national groups --- including two prominent gun-control organizations ---- filed briefs Thursday urging the 1st District Court of Appeal to reject the law, which threatens tough penalties if city and county officials approve gun regulations. One of the briefs described the National Rifle Association-backed law as having “unprecedented penalty provisions” that led to similar measures in other states. The brief, filed by the Giffords Law Center to Prevent Gun Violence, the Brady gun-control group, the League of Women Voters of Florida and Equality Florida Institute, Inc., said the law has “chilling effects” on city and county officials. “Most importantly, (the law’s)

harsh penalty provisions will deter local legislators from experimenting with any solutions directed to the problem of gun violence, depriving Floridians of ordinances promoting their safety and security,” the brief said. The friend-of-the-court brief, along with similar arguments filed Thursday by the Florida League of Cities and the Florida Association of Counties, were the latest salvos in a closely watched case. The briefs backed the positions of dozens of cities, counties and local officials who challenged the constitutionality of the law. State Agriculture Commissioner Nikki Fried also argues the law should be rejected. On the other side of the case are Attorney General Ashley Moody, Gov. Ron DeSantis and the NRA. Lawyers for Moody and DeSantis went to the

Tallahassee-based appeals court after a Leon County circuit judge ruled last year that parts of the law were unconstitutional. Florida since 1987 has barred cities and counties from passing regulations that are stricter than state firearms laws, a concept known as “preemption” of local gun laws. The 2011 law was designed to strengthen the preemption by adding penalties, such as the possibility of local officials facing $5,000 fines and potential removal from office for passing gun regulations. Cities, counties and local elected officials challenged the penalties after the 2018 mass shooting at Marjory Stoneman Douglas High School in Parkland. They argued that the penalties made local officials afraid to move forward with gun-related measures that might not be preempted by

the 1987 law. As examples, they have pointed to the possibility of measures such as requiring the reporting of failed background checks, barring the sale of large-capacity detachable magazines and restricting possession of firearms at certain government-owned or government-operated facilities. Among 30 cities in the case are Miami Beach, Fort Lauderdale, West Palm Beach, Orlando, St. Petersburg, Gainesville and Tallahassee. In finding parts of the 2011 law unconstitutional, Leon County Circuit Judge Charles Dodson cited issues related to “legislative immunity,” which protects local government officials in their decision-making processes. He also pointed to the constitutional separation of powers, as judges could be asked to rule on penalizing local officials.

COURT CLEARS WAY FOR FELONY CHARGES IN FRATERNITY DEATH Jim Saunders News Service of Florida TALLAHASSEE --- An appeals court Thursday said a former Florida State University fraternity president and two other men can face felony hazing charges in the 2017 death of a pledge who drank heavily at an offcampus party. A divided panel of the 1st District Court of Appeal overturned a Leon County circuit judge’s ruling that tossed out felony charges against former Pi Kappa Phi Fraternity chapter President Anthony Petagine and fraternity members Luke Kluttz and Anthony Oppenheimer. The trio were charged in the death of Andrew Coffey, 20, a pledge from Broward County who died in November 2017 after drinking a large bottle of bourbon during a party in which pledges’ fraternity “big brothers” were revealed. The appeals court cases centered on whether prosecutors showed an adequate basis to pursue felony charges against Petagine,

Kluttz and Oppenheimer. The panel, in three 2-1 decisions, said Leon County Circuit Judge Martin Fitzpatrick improperly dismissed the felony charges. The appeals court gave a full explanation of its reasoning in the case of Petagine, while reaching the same conclusions in the Kluttz and Oppenheimer cases. Petagine did not attend the party that resulted in Coffey’s death but had taken part in a meeting before the party in which the danger of pledges becoming intoxicated was discussed, the majority opinion said. Also, he had allowed liquor to be served at the party. “This alone establishes that the state alleged a prima facie case of felony hazing, as underage drinkers are clearly more likely to become dangerously intoxicated in the context of a fraternity party in which that kind of behavior is encouraged and allowed, which is precisely the conduct targeted by the statute,” said the majority opinion, written by Judge Brad

Thomas and joined by Judge Timothy Osterhaus. “The state presented sufficient facts that Mr. Petagine committed felony hazing by aiding and counseling actions and situations that recklessly or intentionally endangered the physical health or safety of the victim, which resulted in his death.” But Judge Ross Bilbrey dissented, writing that he does not believe “there are sufficient allegations of Petagine recklessly or intentionally creating a danger.” Bilbrey wrote that what is known as a “statement of particulars” offered by prosecutors did not allege that Petagine forced Coffey to drink alcohol. He also differed with the majority by arguing that a misdemeanor hazing charge against Petagine should be dropped. “Without criminal hazing or some other criminal act being committed, Florida law does not make Petagine or other fraternity officers criminally liable for college drinking culture, even when that culture has tragic results,”

Bilbrey wrote. “The trial court was correct to dismiss the felony charge and for the same reasons should have dismissed the misdemeanor charge since the definition of criminal hazing is the same for both offenses. It is the injury that results from the criminal hazing that distinguishes felony from misdemeanor hazing. Since there were no allegations that Petagine or someone on his behalf forced any of the pledges to consume liquor and since there were no allegations of pressuring or coercing the pledges by Petagine or someone on his behalf to violate state law, there were insufficient allegations of criminal hazing.” Coffey’s death drew widespread attention and led Florida State to suspend Greek life and consider reforms to combat dangerous drinking at the university. It also spurred state lawmakers in 2019 to pass a measure known as “Andrew’s Law” to try to curb hazing.
