PEN S ACOL A BUSIN ESSES ADA P T TO COVID -19 by Gina Castro

Businesses all across the nation have had to adapt every week, if not daily, to adhere to the

protocols regarding COVID-19. On March 17, Gov.

Ron DeSantis ordered that all bars and nightclubs closed immediately. Shortly thereafter, the City

of Pensacola ordered all restaurants to offer only delivery and take out and for movie theatres, bowling alleys and businesses alike to close

indefinitely. The City announced that events as far out as May 10 are canceled. Although the safety

of the elderly and the immunocompromised are of utmost concern, local businesses, business

owners and employees are struggling to keep business flowing.

“We’ve been asked, as every bar and restaurant in the community has, to either shut down or completely change our business model overnight. It causes anxiety from top to bottom,” DC Reeves, owner of Perfect Plain and Garden & Grain, said. In an effort to help Pensacola businesses, the Downtown Improvement Board (DIB) partnered with businesses to offer a curbside pickup service. Businesses can be added to DIB’s curbside pickup list by emailing dibmerchants@ideaworks. co. The Pensacola Chamber of Commerce created two Facebook pages to help local businesses spread the word about what services they are able to offer during this pandemic. The Facebook groups are Pensacola Take Out & Delivery Options Amid COVID-19 and Retail & Small Business Offers Amid COVID-19. The Mayor of Pensacola Grover Robinson announced on March 23 that he will be donating his $100,000 salary during the pandemic to the city’s sanitation department and Pensacola Energy to help those struggling to pay bills. “What I wanted to communicate to you is I’m not afraid. If I was afraid for myself, I would be doing something to retain that (salary),” Robinson said. “I’m not going to ask you to lose your salary if I’m not willing to do the same at this particular time.” Many businesses and em-

ployees in the area are feeling the economic impact of the pandemic. Tina Crowell, the owner of Ciao Bella Boutique and Salon, said that her retail store has been dealing with COVID-19 since the beginning of January. When Crowell was told by her vendors in China that their facilities were closed due to the virus, Crowell was worried about running out of merchandise, so she bought enough merchandise from her vendors in LA to get her through April, which took a great amount of capital. “Then as the virus spread and came to the US and panic sent in, the last thing people wanted was to shop and traffic got slower,” Crowell explained. Her boutique is now closed until further notice, but her online store is available at shopthebella.com, which will be offering free shipping until May 21. “Such uncertain times for us all. However, we are proud of our town and have faith that the community will continue to support each other,” Crowell said. The owner of Kingfisher Craft Sandwiches Brian Kaderavek said that his business saw a 75 percent drop in sales the weekend before March 23, which is the date the city ordered restaurants to do to-go orders only. “We’re really happy to be established in the year and the half that we were open before this happened because we have a lot of regulars who have been Social icon

supporting us,” Kaderavek said. “We’re concerned about the staff. We’re trying to give them as many hours as possible and help them if they need to file for unemployment.” Kingfisher is offering take out for its full menu. Since Kingfisher’s sales have dropped, Kaderavek has had to make the tough decision to cut his staff by 50 percent. Kaderavek and his wife are doing their best to give their staff additional hours by having their employees renovating and cleaning the building and updating the menu. A major concern for the majority of these businesses is their employees. Jason Taylor, the owner of the East Hill Barbershop, tried to keep his employees working by doing outdoor house calls, but after two days, Taylor realized that though being outdoors slimed down the risk of exposure, these house calls could potentially prolong this pandemic. So, the barbershop stopped all cuts. “It was the most difficult decision I have had to make since opening the shop,” Taylor said. “It affects not just the fellas who work in the shop but their families as well. It’s heart-wrenching.” Although closed temporarily, East Hill Barbershop is selling gift certificates online at vagaro.com/easthillbarbershop/ gift-certificates. Perfect Plain has been selling hand sanitizer, crowler cans, bottled beers, and packaged margaritas and other cocktails on the curb. “Our focus is to withstand and maintain our business as long as we can to keep our employees employed. We have not laid anybody off,” Reeves said. “We’re trying to support our people the best we can, but our community has certainly made it a lot easier for us.” Perfect Plain has sold hundreds of hand sanitizers throughout the community, which 100 percent of proceeds go to the brewery’s staff. Perfect Plain also donated hand sanitizer to the Pensacola Po-

lice Department, Covenant Hospice, Rally Foundation for Childhood Cancer Research and the Baptist Home Health Care, to name a few. Reeves is also donating all proceeds from his Save Pensacola Beer t-shirts to employees in need from any Pensacola brewery. The shirts cost $31.18 each and are available for presale at perfectplain.com and eventually curbside pickup. If you, or someone you know, work at a Pensacola brewery and are in need, email DC@perfectplain. com. “That grant money isn’t just for Perfect Plain employees,” Reeves said. “This is about helping people's lives.” Businesses that have always been a to-go food model are also experiencing a slow business. Randy Russell, the owner of the food truck Nomadic Eats, said that he feels very lucky to already be a to-go restaurant, but he has noticed that business has slowed down. “Right now, it’s not about adapting to increase sales,” Russell said. “It’s about changing our methods to operate as safe for us and the public as possible and, hopefully, continuing to do enough business to stay afloat.” A fair number of businesses are taking advantage of the Internet and social media to help them stay afloat. Physical trainers Sherilyn Sperling-Charvat, owner of Tiwala Fitness, and Tuck Massey, owner of Tuck Training, have been offering

online fitness classes and athome workouts to avoid spreading COVID-19. “In order to stop the spread, it takes trainers, like myself, to be responsible about training their clients and where they are training their clients during these uncertain times,” Sperling-Charvat said. Local artists are working around social distancing by creating online art galleries to showcase their work. Artist Kreg Yingst said that he makes 95 percent of his income from art festivals, which have all been canceled or rescheduled for the fall. “I’ve brought the art festival indoors as a virtual exhibition where people can view snapshots of the art gallery,” Yingst said. “I’ve invited many of my friends, who are in the same predicament, with the hopes of generating greater interest for all.” You can view Yingst’s virtual exhibition on his Facebook page @kregyingst and his Etsy page etsy. com/shop/kkyingst. ESRBA'S COVID-19 CONTINUITY OF OPERATIONS PLAN – PHASE 2 Amidst concerns about the spread of COVID-19 and necessity to practice social distancing, we want to let you know that serving our members still remains our top priority. However, we are taking precautionary actions that may require us to deliver those services in a different manner for a while out of concern for our members, staff, and the community at-large. We have now implemented the infrastructure and work processes to take our office completely virtual, with all staff working from home with few exceptions. We will monitor all new information as it becomes available and reassess at that point. I want to assure you that our commitment and high-standards of service to

our members will go unchanged. You will be able to reach us via our regular ESRBA emails and phone numbers during normal office hours. (Staff contact information is listed at the end of this message.) Noah and I will work with Ballinger Publishing to ensure your subscription to The Summation Weekly goes uninterrupted. I will be coming into the office regularly to check the drop box (located to the left of our front door), mail, and handle other essential administrative tasks. STATE UNDER PRESSURE TO REVAMP BALLOT ORDER RULES DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — State elections officials will have until June 1 to decide how they want to comply with a federal judge’s ruling that rejected a decades-old Florida law requiring candidates who are in the same party as the governor to appear first on the ballot. U.S. District Judge Mark Walker, who held a hearing in the case Friday, ruled in November that the law is unconstitutional because it “imposes a discriminatory burden on plaintiffs’ voting rights.” The effect of being the first candidate listed on the ballot — known as the “primacy effect,” the “windfall vote” or the “donkey vote” — is especially meaningful in Florida, where narrow margins are common in statewide elections. Walker’s decision could play an important role in the November 2020 elections, including the presidential election. “By systematically awarding a statistically significant advantage to the candidates of the party in power, Florida’s ballot order scheme takes a side in partisan elections,” Walker wrote. Secretary of State Laurel Lee, who was appointed by Gov. Ron DeSantis, filed an appeal at the 11th U.S. Circuit Court of Appeals in November. The Atlanta-based appeals court heard arguments in February in the case, filed by the Democratic National Committee, other national Democratic organizations and the Priorities USA super-PAC in 2018. Walker and the appellate court have refused to put the district judge’s November decision on hold while the appeal is pending. In December, Walker, who had asked the Legislature to fix the issue, gave Lee until after the legislative session ended in March to inform the court about how she in-

MIAMI-DADE ROLLS OUT COVID-19 SURVEILLANCE PROJECT NEWS SERVICE OF FLORIDA STAFF Miami-Dade County has launched a multi-week surveillance project to measure the rate of coronavirus exposure in the community and better direct resources to respond to the pandemic, MiamiDade Mayor Carlos Gimenez said Friday. “Our goal is to be able to get a snapshot of where the virus is going and how many people are reacting to it,” Gimenez said during a virtual press conference Friday. Miami-Dade County, one of three communities that are conducting the surveillance, is “the largest by far that’s taken this endeavor on,” the mayor said. The Florida Department of Health reported Wednesday that MiamiDade County, with 3,029 cases of COVID-19, leads the state in the number of cases of the respiratory disease caused by the coronavirus. The University of Miami Miller School of Medicine and Disaster Management Group, the South Florida-based business that devel-

tends to proceed. Since the Legislature did not address the ballot-order issue, Lee’s lawyers last week asked Walker to put his order on hold until seven days after the appeals court issues an opinion “or until June 1, 2020, whichever comes later.” “An opinion appears imminent,” Lee’s lawyers wrote. “That opinion might prove dispositive of the issues in this case and make further guidance from the secretary unnecessary.” But, in a response filed Tuesday, the Democrats’ lawyers scoffed at Lee’s contention that the appeals court’s decision is looming, saying “there is no guarantee that the 11th Circuit decides this matter this week, this month or in the next two months.” In addition, the novel coronavirus pandemic “has led to significant disruptions of daily life and the judicial system,” the Democrats argued. “Even in ordinary times appellate rulings can take a significant amount of time to be issued … and these are hardly ordinary times,” they wrote. During Friday’s telephonic hearing, Walker said it’s unknown when the appeals court will rule. “Only time will tell,” he said. Walker said he wanted more information to make a “thoughtful choice about how much time we really have to address the issue before us.” State elections officials have said ballots for the general election need to be sent to the printer by Sept. 1, so elections supervisors can begin mailing overseas ballots on Sept. 19. The secretary of state could issue an emergency rule, a regular rule or a directive to local supervisors laying out a new method of listing candidates on the ballot, Lee’s lawyer, Mohammad Jazil, told Walker. The

The surveillance will allow the county to estimate the burden of the disease, including among individuals who are asymptomatic. “It will also help us understand how some of the initiatives that were put in place are affecting our curve of infection,” she added.

Legislature could also hold a special session to come up with new ballot-order requirements, he said. “How much time does that emergency rulemaking process take and what does it look like?” Walker asked, noting that an emergency rule would only last for 90 days, meaning the regulation cannot be issued too early for it to remain in effect for the Nov. 3 election. Under pressure from Walker to come up with a date, Jazil said the secretary of state should be able to tell Walker how she intends to proceed by June 1. “If there’s no opinion from the 11th circuit by June 1, I think it’s incumbent upon the state to have a plan in place to run an election in November, with … ballots going out as early as mid-September,” Jazil said. “That’s a deadline for the state to have a plan, whether it’s an emergency rule, whether it’s a regular rule, whether it’s a directive, whether it’s some kind of legislation during a possible special session.” June 1 is a “placeholder,” Jazil said. “There’s no magic to that one particular date,” he added. But Walker appeared frustrated about time running out before the deadline to print and mail ballots for the fall election. “My concern is that in in these election cases everyone wants to do everything at the last minute and then there’s a great weeping and wailing and gnashing of teeth that the courts have gotten involved and somehow that we’ve asked to get involved at the eleventh hour,” the judge said. If the appeals court hasn’t ruled by June 1, Lee would “be just where we’re at today,” he added. “It seems to me that we’re just kicking the can down the road and then suddenly we’re going to have an emergency potentially on June 1

He ordered Lee to employ a county-by-county rotational system “until such time as the state adopts a new ballot order scheme on a permanent basis.” In last week’s court filing, Lee’s lawyers also noted that the secretary of state had concerns about “the limits of her emergency rulemaking powers” to develop a new ballot-order system. “Waiting makes sense,” her lawyers argued. But the Democrats disagreed. “While the secretary may prefer a wait-and-see approach to address the constitutional violation found by this court, plaintiffs — and Florida’s electorate writ large — are entitled to a timely resolution to ensure that general election ballots in November 2020 employ an appropriate ballot ordering scheme,” the Democrats’ lawyers wrote.

TWO FLORIDA INMATES TEST POSITIVE FOR COVID-19 DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — Two inmates at a Northwest Florida prison have tested positive for COVID-19, the Florida Department of Corrections said Sunday. The inmates are housed at Blackwater River Correctional Facility, a prison operated by The Geo Group Inc., a private contractor. Five employees at the Milton prison have also tested positive for COVID-19, according to corrections officials. Blackwater has a maximum capacity of 2,000 inmates, the state agency’s website says. The two cases at Blackwater are the first time corrections officials have said inmates in the nation’s third-largest prison system have tested positive for the highly contagious and rapidly spreading respiratory disease caused by the novel coronavirus. But the spread of COVID-19 within Florida’s prison system --which has 143 facilities, roughly 96,000 inmates and more than 23,000 employees, and where visitation was shut down in mid-March --- has been a major concern for corrections workers, inmates and their families and state lawmakers. “The problem with the prisons is that we are a little gated community --- and once it hits there, it’s going to hit. And the window is closing on the department (Florida

Corrections officials have not revealed how many inmates have been tested for the virus. In an announcement posted on the agency’s website, the corrections department said it is “closely monitoring developments associated with COVID-19” in conjunction with the Florida Department of Health and the state Division of Emergency Management.
