INVESTING IN A GREENER TOMORROW:
S USTAINABL E + E CO- F R I E N D L Y I NV ESTI NG by Dakota Parks
Sustainability is sweeping across the globe, changing the way we live, travel, shop, consume—and invest. As social and cultural consciousness toward protecting the environment and natural resources thrives, so too does the demand for green investing. Sustainable investing, often called impact, green or eco-investing, puts environmental sustainability at the forefront of investment strategies and portfolios. Since 2012, sustainable investment assets managed in the U.S. have more than tripled from $3.7 trillion in 2012 to $17.1 trillion at the beginning of 2020, according to the Forum for Sustainable and Responsible Investment’s 2020 trends report. This surge of assets not only accounts for 33 percent of total U.S. assets under management but also demonstrates the global forces changing the future of investments. For Jacey J. Cosentino, a financial advisor for the RadcliffSchatzman Group at Morgan Stanley, her focus on sustainable investment solutions allows her to help clients align their core values with the way they invest and grow wealth. It was this shift toward what she describes as compassionate capitalism that supports causes like climate change mitigation, diversity and inclusion, social equity, food and water scarcity and cruelty-free investing that first interested Cosentino in sustainability back in 2012. “Sustainable investing can incorporate a theme, like climate change mitigation or social equity, or even screen out certain investments like fossil fuels, tobacco or companies that have had human rights violations,” Cosentino explained. “For me personally, I want to support companies that have fair wages, non-discrimination policies in place, methods in place to lessen the damage to our environment, waterways and communities or implement processes that remove negative impact to our environment all together.” Climate change mitigation and legislative policies like the Paris Climate Agreement in 2016 and global leaders setting goals to eliminate greenhouse gas emissions are some of the driving forces to the rise in sustainable investing. As more and more people embrace a green lifestyle, they want to support companies and investment
opportunities that promote a healthy environment and future. Financial advisors, like Cosentino work with analysts to choose investments that consistently score high on Environmental, Social and Governance (ESG) metrics. The ESG categories can be broken down into the three pillars: Environmental criteria considers how a company performs as a steward of nature, which might include action on climate change or greenhouse gas emissions and reductions; Social criteria examines how a company manages relationships with employees, suppliers, customers and the communities where it operates, which includes labor standards and health and safety; Governance criteria explores a company’s leadership, executive pay, audits, internal controls and shareholder rights to include anti-corruption measures or tax transparency. “Companies that focus on sustainability are less volatile and score higher on ESG metrics,” Cosentino elaborated. “Whether its fixed income, equities, private equity, REIT’s, or alternative investments, we have options to build out portfolios that echo the changes you want to see in the world.” On a presentation co-hosted by local organizations 350 Pensacola and Healthy Gulf, called “Climate Change Investment Opportunities: Decarbonizing Your Portfolio,” Cosentino discussed how companies are
pledging to decarbonize in an effort to reduce global greenhouse gas emissions, which coincides with investing in new technologies and renewable energy. According to data from the Morgan Stanley Institute for Sustainable Investing, 4 in 10 global companies across multiple industries have a confirmed emission target, including 37 percent of companies within the real estate industry. “In my opinion, renewable energy is the new real estate,” she said. “Investments in solar, wind and hydropower through equities, ETF’s, mutual funds, SMA’s, REIT’s, bonds and alternative investments all offer an investor the ability to not only support the most pressing issue of our time, climate change mitigation, but also continue to invest in what they like best: real estate. Many of my clients are real estate agents and real estate investors and incorporate renewable energy into their investment portfolios. I have several clients who have

Not only do returns in sustainable investments perform in line or better than traditional investments, but as Cosentino explained, during a down economy like the 2020 market experienced at the height of COVID-19, sustainable investments can even capture greater returns: “While COVID-19 induced a global recession and market volatility in the first half of 2020, sustainable funds—across stocks and bonds—in general, helped investors weather the period bet-

ter than many of their traditional peers,” she said. The Morgan Stanley Institute for Sustainable Investing found that U.S. sustainable equity funds outperformed their traditional peer funds in 2020 by a median total return of 4.3 percentage points and that U.S. sustainable equity funds’ median downside deviation was 3.1 percentage points less than traditional peer funds. As the world grapples with impacts of climate change and economic recovery after COVID-19, investors around the world are demanding environmentally conscious options. Sustainable investing doesn’t just stop at protecting the environment, either. Through restriction screening, thematic exposure and impact investing, investors can tailor their portfolios to specific social impacts too, including socioeconomic issues, such as advancing racial equity and combating systemic racism through investment decisions. THE SECOND EAST HILL YARD SALE TO BENEFIT GULF COAST KID’S HOUSE Gulf Coast Kid’s House (GCKH) announces they will be hosting the second East Hill Yard Sale that will benefit their victims of child abuse and neglect on May 15, 2021, from 8 AM to noon. The sale will take place at 3401 North 12th Avenue, Pensacola Fl., 32503, in the GCKH parking lot. The event will consist of over 40 vendors selling items such as home goods/décor, artwork, baked goods and much more. Vendors will be spaced accordingly to ensure social distancing. MI SU Street Food will be on site cooking up breakfast and lunch items to purchase. The event is free to attend, and parking will be available across the street at Rev. H. K. Park. “Imagine the Palafox Market and a yard sale met in East Hill,” said GCKH Director of Philanthropy, Megan Chapman. “Our first East Hill Yard Sale was such a success that we decided we needed to do it again! We are hoping to bring our supporters and community
members together in a fun yet safe way while raising much needed funds for our organization.” Vendor spots are available for this event, and vendors can signup at https://www.gulfcoastkidshouse.org/ child-abuse-prevention-events/. The vendor fee is $25.00, and each vendor will receive one parking spot to sell their wares with an empty parking spot spaced in between vendors to ensure social distancing. PENSACOLA MESS HALL LAUNCHES CITIZEN SCIENCE INITIATIVE April 16, 2021 – The Pensacola MESS Hall is recruiting members of the general public to become citizen scientists. Armed with phones and computers, these citizen scientists will gather observations about extreme precipitation. This information will be shared with local officials to help plan for a more resilient community that can withstand the increased precipitation and flooding expected from our changing climate. The US is experiencing more heavy rainfalls than ever before. Each year, Pensacola has a 1% chance of receiving more than 16 inches of rain in a day. These 100-year rain events have occurred more frequently, resulting in flooding and significant infrastructure damage. By recording observations during extreme precipitation events, citizen scientists can highlight the areas most at risk. “Citizen science is a collaboration between scientists and curious, concerned, and motivated people,” notes Megan Pratt, executive director of the Pensacola MESS Hall. “Documenting our observations about our changing environment helps us individually notice changes and provides information now and in the future about the local environment. This data can be used by planners to determine how best to meet the needs of our community.” Interested individuals can participate by visiting SciStarter.org/NOAA-

that morning, a formal program will take place in Museum Plaza (Historic Pensacola Village), exactly 200 years after the exchange of Spanish and American flags. Navy musicians will play The Star Spangled Banner; for many in Pensacola that day it was the first hearing of our national anthem. Hispanic musicians will drift through the Village and, just as they did 200 years ago, performers of African descent will dance in the plazas. Spanish and English military reenactors will mingle with the audience and Historic Pensacola Village will be open to the public at no charge. A number of additional programs and performances will take place throughout the Village. Programing is structured to reflect our community’s rich and diverse heritage and the collective influences that make our community what it is today. Founded in 2012, the Pensacola MESS Hall is not a typical science museum. It’s all hands-on science. Visitors to the facility enjoy exploring math, engineering, science, and stuff with an ever-changing menu of mess kits, activities and exhibits. Ron DeSantis on Monday signed into law a controversial law-and-order measure sparked by nationwide protests that erupted last year after George Floyd’s death. The law, which went into effect immediately, creates a new crime of “mob intimidation,” enhances riot-related penalties and makes it harder for local officials to reduce spending on law enforcement. The measure (HB 1) has been one of the 2021 legislative session’s most contentious issues, with all Republicans but one — Sen. Jeff Brandes, R-St. Petersburg — supporting it and all Democrats opposed. At a bill-signing ceremony in Polk County, where he announced the framework for the plan in September, DeSantis boasted that the measure “is the strongest, anti-rioting, pro-law enforcement piece of legislation in the country.” The law, which also makes it a felony to tear down statues or monuments, includes giving the governor and Florida Cabinet authority to override local officials’ decisions to reduce law enforcement spending. Under the law, state attorneys and members of governing bodies who object to reducing operational budgets of municipal law enforcement agencies can appeal to the state Administration Commission, made up of the governor, the attorney general, the chief financial officer and the agriculture commissioner. DeSantis has staunchly defended the provision, saying Monday that it came in response to a nationwide move-
ment to “defund the police” amid protests that erupted after Floyd’s death. Floyd, a 36-year-old Black man who was unarmed, died in May after thenMinneapolis police officer Derek Chauvin kneeled on his neck for at least eight minutes. Chauvin is on trial for Floyd’s death. The plan “tackles head-on this idea that we’ve seen last summer and then we still see today that there should be a movement to defund law enforcement,” DeSantis, who is running for re-election next year, said at Monday’s event. “This bill actually prevents against local government defunding law enforcement. We’ll be able to stop it at the state level,” DeSantis said. “It’s an insane theory. It’s not going to be allowed to ever carry the day in the state of Florida.” But critics of the measure say it will impede local officials’ efforts to redirect law-enforcement spending toward other services, such as mental-health workers. The process to challenge police budgets creates “an unfunded mandate to our local governments requiring them to have to participate in this crazy, just very weird funding appeals process if they decide to make changes to their law enforcement budget,” state Rep. Fentrice Driskell, a Tampa Democrat who is a lawyer, told reporters during a video conference call Monday. Democrats also questioned part of the law that takes away legal protections for municipalities if they prevent law enforcement’s ability to respond to “a riot or unlawful assembly.” Under the new law, a municipality “has a duty” to allow local police “to respond appropriately to protect persons and property during a riot or unlawful assembly based on the availability of adequate equipment.”
DESANTIS SIGNS ONLINE SALES TAX BILL JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — Gov. Ron DeSantis late Monday signed into law a plan to require out-of-state online retailers to collect sales taxes on purchases made by Floridians, with the estimated $1 billion a year in revenue going to curb a pair of taxes on Florida businesses. While the proposal (SB 50) was widely supported by Tallahassee business groups, DeSantis’ signature came with far less fanfare than when he appeared Monday morning in Polk County to sign a controversial bill (HB 1) about cracking down on violent protests. During the Polk County appearance, DeSantis was flanked by Republican lawmakers and unformed law-enforcement officers. But the signing of the online sales-tax bill was announced by the governor’s office just before 11:30 p.m. in an email without comment. The bill was one of five measures DeSantis signed Monday, including the protest bill. DeSantis faced a Monday deadline for signing, vetoing or letting the online tax bill become law without his signature. Florida business groups have lobbied for years to require out-of-state retailers to collect and remit sales taxes, saying it is a matter of fairness. But past proposals failed because of concerns by Republicans that they could be viewed as increasing taxes on consumers. Scott Shalley, president and CEO of the Florida Retail Federation, said in a statement that the law creates a “level playing field” for all businesses. The sales-tax revenue will be used to replenish a depleted unemployment trust fund and then will go toward reducing a commercial rent tax. “The tax cut on business rent is an added bonus,” Shalley said. “With this cost-savings, Florida businesses across all sectors of the economy can reinvest in their community, create jobs and grow their businesses.”
Retailers that have a “physical presence” in Florida are already required to collect and remit sales taxes, But retailers without such a presence haven’t faced the requirement when they make sales to Floridians, who have been technically supposed to send in sales taxes on their purchases — though few do. Proponents of the bill maintained that requiring collection isn’t a tax increase and that Florida retailers have been hurt by out-of-state businesses being able to sell products with tacking on taxes. “We’ve created an unfair competitive advantage for foreign players and out-of-state retailers on the backs of our local retailers,” Senate sponsor Joe Gruters, R-Sarasota, said last month. But Democrats argued that working Floridians will be hurt by the proposal because of “regressive” sales taxes. The final package was approved 27-12 by the Senate and 93-24 in the House. “Governor just signed a bill into law to increase your taxes and give the new revenue of $1 billion to businesses,” Rep. Anna Eskamani, D-Orlando, tweeted after the bill signing was announced. The bill is estimated to produce an estimated $1 billion a year, with the money first earmarked for the unemployment trust fund, which became depleted because of massive job losses during the COVID-19 pandemic. Businesses pay taxes that go into the trust fund and, without another source of money, would have faced higher taxes to replenish the fund. Before the pandemic, businesses paid $7 per employee in unemployment taxes. The rate went to $49 this year and could have jumped to $87. After the fund is replenished, the revenue will be used to make a major cut in the commercial-rent tax, long a target of business lobbying groups. Senate President Wilton Simpson, R-Trilby, and House Speaker Chris Sprowls, R-Palm Harbor, agreed to reduce the commercial rent tax from 5.5 percent to 2 percent.
A governing body that “breaches that duty” is “civilly liable for any damages including damages arising from personal injury, wrongful death, or property damages proximately caused by the municipality’s breach of duty,” the law says. The provision holds local government officials accountable, DeSantis said Monday. “If you’re derelict in your duty … if you tell law enforcement to stand down, then you’re responsible for the damage that ensues, and if someone’s been harmed or their property has been destroyed, then they can sue you for compensation,” he said. In addition to Democratic lawmakers, dozens of civil-rights organizations and left-leaning groups have opposed the crackdown on protests, which was such a priority to GOP legislative leaders it earned the designation as House Bill 1. Black Democrats especially have lashed out at the measure, which they say is rooted in racism and is evocative of Jim Crow-era laws targeting Black people. Critics say the law gives too much leeway to law-enforcement officers to decide whether to arrest peaceful protesters who have participated in rallies that might have erupted in violence unrelated to their actions. “Unfortunately, laws are not applied equally. And when law enforcement has complete discretion, as you saw on the insurrection at the (U.S.) Capitol, you see how laws can be applied differently depending on your background, depending on the color of your skin,” Agriculture Commissioner Nikki Fried, Florida’s only statewide elected Democrat, said Monday, during a conference call with reporters. Fried, a lawyer, is considering a run against DeSantis next year.
SOCIAL MEDIA CRACKDOWN MOVES FORWARD NEWS SERVICE OF FLORIDA STAFF A Senate committee Monday narrowly approved a measure that would crack down on social-media companies, an issue that is a priority of Gov. Ron DeSantis. The Appropriations Committee voted 10-9 to move forward with the bill (SB 7072), which includes barring social-media companies from removing political candidates from the companies’ platforms. Companies that violate the prohibition could face fines of $100,000 a day for statewide candidates and $10,000 a day for other candidates. The proposal also would require social-media companies to publish standards about issues such as blocking users and apply the standards
Democrats also raised questions about the costs of the new law, which requires people who are arrested on riot-related charges to be held in jail until their first appearances before judges, a process that could leave protesters behind bars for days. The measure also creates a new felony crime of “aggravated rioting” that carries a sentence of up to 15 years in prison and a new crime of “mob intimidation” which makes it unlawful “for a person, assembled with two or more other persons and acting with a common intent, to use force or threaten to use imminent force, to compel or induce, or attempt to compel or induce, another person to do or refrain from doing any act or to assume, abandon, or maintain a particular viewpoint against his or her will.” Critics of the measure contend that it unconstitutionally infringes on the right to freedom of speech and to assemble and will result in lawsuits. A number of organizations issued statements Monday condemning DeSantis’ approval of the law. The bill “criminalizes peaceful protest,” American Civil Liberties Union of Florida executive director Micah Kubic said in a statement. “Each and every provision harkens back to Jim Crow. Constitutional lawyers and scholars have called the bill overbroad, vague, and warned it will chill free speech,” Kubic said. “Every single Floridian should be outraged by this blatant attempt to erode our First Amendment right to peacefully assemble. It is outrageous and blatantly unconstitutional. Gov. DeSantis’ championing of and signature on this law degrades, debases, and disgraces Florida and our democracy.”

LAWMAKERS WEIGH CHANGES IN PROGRAM FOR INJURED INFANTS CHRISTINE SEXTON NEWS SERVICE OF FLORIDA TALLAHASSEE — As the 2021 legislative session nears the end, the Florida House and Senate are tackling medical malpractice, with lawmakers moving forward with bills that would change a longstanding no-fault insurance program for infants with neurological injuries. The proposals deal with the Florida Birth-Related Neurological Injury Compensation Association, widely known as NICA, that was set up in the 1980s to pay for care of children born with brain or spinal-cord injuries. The program has drawn heavy attention recently because of a series of stories in the Miami Herald. The House and Senate bills have differences, but they both contain provisions that representatives of NICA and the insurance industry say are problematic. The House Judiciary Committee on Monday put an amendment on its bill (HB 1165) that would require the state Agency for Health Care Administration to develop policies making clear that NICA is a third party responsible for payment of services and that Medicaid is the payer of last resort. The change would apply retroactively and direct the agency to determine how much money Medicaid could recoup from NICA. Steve Ecenia, general counsel for NICA, said the retroactive application would be a problem because it could affect a lawsuit pending at the 11th U.S. Circuit Court of Appeals. “If the Legislature wants to make a decision and treat NICA differently prospectively, that’s your prerogative to do. I would just plead with you not to take action that could potentially cost hundreds of millions of dollars to the NiCA program, potentially put it in financial jeopardy and really derail where we are trying to go,” Ecenia said. The House bill would raise the payment from $100,000 to $250,000 for parents or legal guardians of infants who sustained birth-related neurological injuries. That would apply to petitions of claims filed since the beginning of this year. The bill would raise the death benefit for an infant who suffered a neurological injury from $10,000 to $50,000. The Senate Appropriations Committee, meanwhile, approved a bill (SB 1786) on Monday that also contains a provision about Medicaid third-party liability, though it is not identical to the House version. But the Senate bill also would eliminate NICA effective Dec. 31, 2026,
unless the Legislature passes a law to re-enact the program. That move — known as a “sunset” — drew concerns from the insurance industry. “Those of you who have been around a few years know that tort reform is extremely, extremely difficult. If you put the termination provision in, the ability to get it back will be World War III … Once that sunset sets in, it’s armageddon.” said lobbyist Mark Delegal, whose clients include The Doctors Company, which provides medicalmalpractice coverage for physicians. NICA was created by lawmakers in 1988 as a no-fault system to pay for the care of children so long as the physicians participate in NICA and pay yearly assessments. Participating physicians are required to pay $5,000 each year for coverage, and all licensed Florida physicians pay a mandatory fee of $250, regardless of specialty. Hospitals pay $50 for each live birth during the previous calendar year. In 2019, NICA collected $26,989,960 in hospital and physician assessments; in 2020, NICA collected $27 million, according to a legislative staff analysis. Another provision in the Senate bill that Delegal and William Large, president of the Florida Justice Reform Institute, oppose would say it is not the intent to “shield physicians who engage in willful misconduct, gross negligence, or recklessness or to preclude individuals from filing legitimate claims of medical malpractice against such physicians.” Delegal said that proposed change is a “clear shift” in policy and said NICA would not survive because it would encourage litigation. Like the House bill, the Senate version would increase the death benefit to $50,000 and would up the parent or guardian award to $250,000 for claims filed after Jan 1. But the Senate bill would direct NICA to make retroactive payments to parents or guardians who received awards before this year. The proposed changes to NICA come after a Miami Herald and ProPublica investigation that showed NICA has amassed nearly $1.5 billion in assets but has denied or delayed help for struggling families. The Herald also reported that NICA paid its lawyers $16.9 million between 1989 and 2020 but spent $10 million during the same period on therapy, doctors and hospital visits for children covered by the program. NICA Executive Director Kenny Shipley told members of the House Judiciary Committee that there’s “another side to this story than what you saw come out of the Miami Herald.”
