For Rebekah Snyder, that love for nature began in her childhood. Growing up in the Tampa Bay Area in Central Florida and later the Poconos Region in Pennsylvania, Snyder would rush through homework to get more time outside. In college, she studied biology at East Stroudsburg University while working as a field technician at Pocono Avian Research Center. From there, she worked as a seasonal coastal bird technician at Audubon Louisiana, where she fell in love with the birds she continues to work with and advocate for today: Least Terns. As the Panhandle Rooftop Nesting Biologist with Audubon Florida, Snyder oversees rooftops in the five-county Northwest Florida region with around 40 suitable nesting roofs. Suitability means that they are flat, gravel rooftops that have been nested on in the past by seabirds or shorebirds on the focal species list. In Florida there are six focal species that nest on gravel rooftops: Least Terns, Black Skimmers, Gull-billed Terns, Killdeer, American Oystercatchers and Roseate Terns. “Least Terns are the most common, and they are statethreatened birds in Florida. They’re only here specifically to breed and raise their young and then migrate back home to the Caribbean and South America,” Snyder explained. “They are ground nesters, so they make a scrape in the sand or gravel substrate to lay their eggs unlike birds that build their own nests. These birds are nesting on roofs because of increase pressure on their natural habitat.” As Snyder explained, over 50 percent of Florida’s state population of Least Terns are nesting on gravel rooftops because of negative human interaction and habitat loss. They began nesting on these roofs as far back as 1950. Beach front property development, disturbances from beachgoers, increased predators like dogs and cats and rising sea levels are all issues affecting beach nesting birds.

“Protecting these birds is important to maintaining biodiversity. But, something most people don’t realize is that coastal birds serve as habitat indicators too,” Snyder said. “When we have birds nesting in a location, you can use them as an analysis of the habitat around them. What type of food are they eating and is it readily available? Or, if you’re losing birds, that can be an indication of erosion and the loss of landscape. When we examine our coastlines, it becomes a bigger issue than solely protecting our birds. Losing our beaches to erosion means losing businesses and homes and losing the land that protects us from hurricanes.” Although these beach nesting birds have found gravel rooftops to breed and nest, the rooftops also pose another problem. Gravel roof tops first grew to popularity in the 1950s to 1960s and now, they are becoming obsolete and replaced with new roofs. Bird conservationists are constantly thinking of new ideas and methods to combat habitat loss and diminishing gravel rooftops. On one of Synder’s monitored rooftops in Panama City Beach, Audubon Florida has installed rooftop nesting boxes,

which are square enclosed boxes filled with gravel substrate. They are actively monitoring this location to determine the effectiveness of the nesting boxes. In addition to gravel roofs being replaced, baby chicks that are used to growing up on the ground also pose a risk of falling off the roofs, and the rooftops provide little shelter to escape the sun or predators. These compounding issues make Snyder’s work a round-theclock job, even outside of nesting season. During nesting season from March through late August, Snyder is out in the field every day doing surveys and checking for falling chicks. “In the winter, I’m out on Pensacola Beach and Navarre Beach doing non-breeding surveys on wintering birds,” Snyder said. “But I also have to maintain outreach with landowners, HVAC companies and roofing companies. All of the rooftops are privately owned, so I have to get the landowner’s permission to install something like chick

fencing, which prevents the chicks from falling off. And, I have to do all of that before the birds come back to nest, so I don’t disturb them.” Minimizing disturbances is a big part of Snyder’s work. She conducts surveys from the ground of her sites waiting for a flush count, where all of the birds erupt into flight at once. In most locations, she also has vantage points, where she can access a nearby building to look down on the rooftops with binoculars. She also does outreach to help educate landowners about the birds and what to do if a chick falls. “All of the landowners have my number to call if they find a chick on the ground, as well as local rehabbers incase the chick is injured, but I provide them with chick kits too,” Snyder said. “Chick kits help people care for the bird until I can get there. They have a small shoebox, a piece of cloth to throw over the bird to pick it up and Pedialyte if the bird is dehydrated.” Snyder then uses a chicka-boom tool, which is a milk carton on an extension pole to place the birds back on the roof without disturbing

the other chicks. Last year, one of the chick kits was put to use by one of the local rooftop locations, the Publix on West Nine Mile Road. A chick had fallen off the roof and an employee found it and safely put it in the box and contacted Snyder. With all of the intricacies of protecting and monitoring the birds, Snyder said that volunteers help out a great deal. “Volunteers help us out a lot in monitoring and doing surveys. We also have people help us with making decoys, which are little wooden replicas of the bird, and they’re painted to look like the bird. We use them on the beaches and rooftops to help attract birds to nest there,” Synder said. “Other people have helped build chick shelters, which help shade the birds since rooftops don’t have vegetation or dunes to provide shade. There are a lot of ways volunteers can help out.” Audubon Florida is still accepting volunteers following CDC guidelines. CANCELLATION OF SEPTEMBER 2020 EVENTS: DAY OF PLAY AND SENIOR GAMES Due to the rise in cases and ongoing concern of the COVID-19 pandemic, the City of Pensacola Parks and Recreation Department will not host 5-2-1-0 Day of Play and the Pensacola Senior Games this September. Each September, Play Pensacola hosts 5-2-1-0 Day of Play, a partnership with the Florida Department of Health in Escambia County and 5-2-1-0 Healthy Escambia!, as well as its athletic competition, the Pensacola Senior Games presented by Humana. The 5-2-1-0 Northwest Florida! program encourages children and their families to adopt four healthy behaviors associated with achieving and maintaining a healthy weight. This can help prevent conditions such as diabetes, high blood pressure, and heart disease. The 5-2-1-0 messages are defined as: • 5 or more fruits and vegetables every day Five or more servings of fruits and vegetables every day helps children get the vitamins they need to support growth and development and a healthy immune system. • 2 hours or less recreational screen time Children who watch more than two hours of screen time have an increased risk to unhealthy weight, lower reading scores, and attention problems. It

is best to limit screens such as television, video and computer games, and handheld devices such as tablets and smartphones. • 1 hour or more of physical activity Being active helps manage weight and reduces the risk of osteoporosis and heart disease. Children are encouraged to be active. Physical activities can be enjoyed as a family through games such as relays, hula hoop, or sports. • 0 sugary drinks, more water and lowfat milk Drinking soda and other sugarsweetened beverages puts children at risk for unhealthy weight gain and dental cavities. Low-fat milk is a great source of calcium, which is important for growing strong bones and teeth. Water is important to maintain a healthy immune system. Fruit, such as strawberries or lemons, can be added to receive natural sugars. The Pensacola Senior Games presented by Humana is an athletic competition open to athletes 50 years of age and older who compete in a series of sporting events over the course of two weeks each September. Events include, but are not limited to: bocce, basketball, darts, golf, tennis, track and field and swimming. The City of Pensacola has hosted the Senior Games since its inauguration in 1991.

DEVILLIERS STREET REVITALIZATION PROJECT EXPECTED TO BEGIN AUG. 17 Construction for the City of Pensacola Community Redevelopment Agency DeVilliers Street Revitalization Project Phase I from Main Street to Garden Street is expected to begin Monday, Aug. 17. This project is intended to make streetscape improvements that include sidewalks, lighting, landscaping and traffic calming. SUPERINTENDENTS ASK STATE TO ADDRESS COVID-19 TESTING ISSUES ANA CEBALLOS NEWS SERVICE OF FLORIDA TALLAHASSEE — As Florida schools reopen this month, district superintendents are calling on state officials to address two major challenges: the need for rapid testing for COVID-19 and a statewide plan to handle students and staff members who test positive. Florida Association of District School Superintendents President Michael A. Grego told Education Commissioner Richard Corcoran on Friday that “state direction is imperative” to ensure school districts have access to rapid test results and school officials know what to do when people show symptoms or test positive for the deadly respiratory illness. “Clear and articulate processes for the role of the Department of Health as the lead in case investigation, contact tracing and quarantine direction, length and implementation are essential and must be consistent across all school districts,” Grego, the Pinellas County superintendent, wrote in a letter to Corcoran. Grego added the availability of tests and rapid results for students and staff members will be “critical” when school campuses reopen. “The support of all state and private health care agencies to prioritize the availability of testing and rapid results of students and staff members will be critical,” he wrote. “The availability of these tests could significantly reduce the time students and school personnel

are absent from school and corresponding disruptions that come from the need to wait days, or weeks, for results.” The requests for statewide guidance came as teachers, students and school employees in a dozen counties return to in-person instruction this week amid the pandemic and as districts across the state prepare to start classes later this month. Gov. Ron DeSantis and Corcoran have been resolute that all school districts need to offer in-person instruction to parents who want to send their kids back to school, after the pandemic forced campuses to shut down in March and required students to shift to online learning. DeSantis and Corcoran reiterated that view Monday during a news conference in Riverview. “When you don’t offer any in-person instruction … that would be denying a huge swath of parents the ability to make a meaningful choice,” DeSantis said. In pressing Corcoran for statewide guidance on rapid testing and contact tracing, superintendents said statewide protocols would help with “public transparency and trust.” “As the lead for all case investigation, contact tracing and quarantine processes, it is my understanding that the state surgeon general is in the process of developing such statewide guidance,” Grego wrote. “As superintendents, we feel it is imperative that we have these statewide protocols to guide our collaboration as soon as possible so we can

RULES REQUIRE ACCESS TO LONGTERM CARE FACILITIES NEWS SERVICE OF FLORIDA STAFF Saying that there have been “multiple instances” where long-term care providers have barred state health officials from entering facilities, Gov. Ron DeSantis’ administration Monday issued a pair of emergency rules making clear access isn’t optional. One rule addresses the 693 licensed nursing homes in the state and the other applies to the 3,107 assisted living facilities. In separate notices, the state Agency for Health Care Administration said the rules are necessary “to ensure the health, safety and welfare of residents and staff in Florida’s nursing homes.” In addition to mandating that the facilities allow Department of Health officials into the buildings, the rules require facility staff members to comply with any COVID-19 testing offered by the Department of Health or its agents,

INMATE, PRISON WORKER COVID-19 CASES SOAR NEWS SERVICE OF FLORIDA STAFF Florida’s prison system recorded more than 1,500 new COVID-19 cases and two inmate deaths over the weekend, according to data released Monday by the state Department of Corrections. The number of prisoners who had tested positive for COVID-19 climbed to 12,438 on Monday, an increase of 1,463 cases since Friday. With the coronavirus beginning to hit the state in March, enrollment for the 2019-2020 fiscal year ended down 965 students when measured on what is known as a “full-time equivalent” basis. In January, the panel projected that the program would have 159,799 students on a fulltime equivalent basis in 2020-2021 but reduced that number to 144,053 last week, the report said. Enrollment is projected to bounce back to a more-normal level in 2021-2022, though it will still be below earlier expectations.

APPEALS COURT SIDES WITH TRANSGENDER STUDENT IN BATHROOM BATTLE JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — Weighing privacy issues, a federal appeals court has sided with a transgender student who argued his constitutional rights were violated when the St. Johns County school district prevented him from using boys’ restrooms at his high school. The 2-1 decision Friday by a panel of the 11th U.S. Circuit Court of Appeals upheld a lower-court ruling that the district violated the equal-protection rights of recent Nease High School graduate Drew Adams and ran afoul of a federal anti-discrimination law known as Title IX. Judge Beverly Martin, in a 45-page majority opinion joined by Judge Jill Pryor, wrote that the record in the case “reveals no substantial relationship between privacy in St. Johns County School District restrooms and excluding Mr. Adams from the boys’ restroom” and, as a result, violates the Equal Protection Clause of the U.S. Constitution. “Mr. Adams, for his part, does not question the ubiquitous societal practice of separate bathrooms for men and women,” Martin wrote. ”Instead, Mr. Adams argues the School Board’s bathroom policy singles him out for differential treatment on the basis of his gender nonconformity and without furthering student privacy whatsoever. The record before us has persuaded us to his view. The School Board has demonstrated no substantial relationship between excluding Mr. Adams from the communal boys’ restrooms and protecting student privacy.” But Chief Judge William Pryor, in a 28-page dissent, wrote that the majority opinion “purports to allow only plaintiff Drew Adams, a female who identifies as a male, to use the boys’ bathroom, but the logic of this decision would require all schoolchildren to use sex-neutral bathrooms.” “Not long ago, a suit challenging the lawfulness of separating bathrooms on the basis of sex would have been unthinkable,” the chief judge wrote. “This practice has long been the commonsense example of an acceptable classification on the basis of sex. And for good reason: it protects well-established privacy interests in using the bathroom away from the opposite sex.” Adams was a female biologically at birth but came to realize he was transgender in eighth grade, according to the majority opinion. He was diagnosed with gender dysphoria, a condition that causes anxiety as people identify with a gender that is different from their physical gender.

Adams began transitioning to living as a boy, including obtaining a prescription for testosterone to make his body masculine and eventually undergoing a procedure to remove breast tissue, the majority opinion said. He also amended legal documents to reflect a male sex designation. For the first six weeks of ninth grade at Nease High School, Adams used the boys’ restrooms. But school administrators, pointing to complaints from two girl students who saw Adams go into a boys’ restroom, told him he needed to use a gender-neutral bathroom in the school office or girls’ facilities, the majority opinion said. Adams and his mother, Erica Adams Kasper, sued the school district in 2017, with U.S. District Judge Timothy Corrigan later ruling in their favor on the equal-protection and Title IX arguments. The school district then took the case to the Atlanta-based appeals court. Friday’ s majority opinion said, in part, the school district policy is administered “arbitrarily” and that the district’s concerns about Adams’ use of boys’ restrooms were hypothetical. “After extensive evidence was presented at trial, the District Court found that Mr. Adams’s presence in the boys’ bathroom does not jeopardize the privacy of his peers in any concrete sense,” Martin wrote. “When Mr. Adams uses the restroom, he ‘enters a stall, closes the door, relieves himself, comes out of the stall, washes his hands, and leaves.’ The School Board received no reports of privacy breaches during the six weeks Mr. Adams actually used the boys’ restroom at Nease. Indeed, the School Board could not produce any ‘complaints of untoward behavior involving a transgender student’ in the restroom. Nor could the School Board point to any incidents across the country in which allowing transgender students to use the restroom according to their gender identity compromised other students’ privacy.” But William Pryor, in his dissent, wrote that the bottom line is that “there is nothing unlawful, under either the Constitution or federal law, about a policy that separates bathrooms for schoolchildren on the basis of sex.” “When shorn of the majority’s misunderstandings of the school policy and the legal standards that govern sex-based classifications, this appeal is straightforward,” he wrote. “The school policy protects longstanding privacy interests inherent in using the bathroom, and it does so in an ancient and unremarkable way — by separating bathrooms on the basis of sex. That policy is not unconstitutional.”
