Ron DeSantis recently signed a bill to protect domestic violence survivors and their pets. The Domestic Violence Injunctions bill ensures that pets are included in protection orders so that domestic violence victims can keep their pets. More than 30 other states have enacted meaningful public policies to safeguard both humans and pets from violence in the home. As domestic violence cases rise during COVID-19, this law is providing relief to survivors and their pets. Research indicates that up to 89 percent of pet-owning women in domestic violence shelters report that their abuser threatened, harmed or killed a family pet. Additionally, as many as 48 percent of domestic violence survivors with pets delay seeking safety, fearing what would happen if they left their pets behind. “Under normal circumstances, adults, children and pets living in an abusive home often face major obstacles to escape harm’s way. Unfortunately, the necessity of staying at home to prevent the spread of COVID-19 has made this situation substantially more dangerous for both people and pets,” Jennifer Hobgood,

Senior Director of state legislation for the ASPCA Southeast Region, said. “As our nation responds to this pandemic, reports of increasing rates of domestic violence have surfaced in many areas, including Florida. This lifesaving law now makes it clear that courts may include family pets in temporary restraining orders, and we thank Governor DeSantis for signing this bill to help domestic violence survivors and their pets reach safety.” Jennifer Bitner, Executive Director of the Pensacola Humane Society, was involved in getting the bill signed. “The desired outcome to protect pets and their people drew me to get involved,”

Bitner said. “At our shelter, we helped one victim who shared her story. She came to relinquish her dog and she had all of her personal belongings in her vehicle. She had fled a violent home. The staff came and brought me to the front porch where the lady was with her dog. I made the decision we would offer to foster her dog until she could get help and assistance and find a new place for her and her dog to live happily. They were reunited in a short period, less than 30 days. Jennifer shared this story with legislators on several occasions while supporting the passage of this bill. The Pensacola Humane Society is currently helping another client in a similar situation. Bitner attended multiple legislative committee meetings to support the bill and testify to the urgent need for such. protections. CITY COUNCIL TO HOLD VIRTUAL RECODIFICATION WORKSHOP AUG. 26 The Pensacola City Council will host a virtual public workshop Wednesday, Aug. 26 at 4 p.m. to review recodification of the Code of the City of Pensacola. If necessary, there will be a second workshop reviewing recodification on Friday, Aug. 28 at 4 p.m. The meeting agenda and background materials are available on the City of Pensacola’s website. The workshop will be held in Council Chambers located on the first floor of City Hall, 222 W. Main St. Some Council Members may be attending by telephonic conferencing. Further, no public may physically be in attendance. This change in format is consistent with Executive Order 20-69 issued by Gov. Ron DeSantis and has been adopted at the direction of Council President Jewel Cannada-Wynn in consultation with the City Attorney. Members of the public may attend and participate via live stream and/ or phone only.

The proposed concept plan includes pedestrian walkways and seating walls that will provide a pleasant passive use park for neighborhood use and enjoyment, and will include shaded lawns, walking paths, seating areas, native landscaping and a transit stop that meets ADA accessibility standards. A plaza at the intersection is planned, which will provide access to the existing safe pedestrian crosswalks. The site concept proposes landscaping with native trees and grasses along a bioswale/rain garden that will handle stormwater management in a low impact, natural, sustainable form. A sidewalk along North Palafox Street is proposed to connect the site to space for an ECAT transit stop.

The best source for up-to-date information regarding confirmed cases of COVID-19 in Florida is the Florida Department of Health website and the associated Data and Surveillance Dashboard and Daily Report. The site is currently updated once daily, at around 3 p.m. ET. • The total number of COVID-19 related deaths in Escambia County residents is 171 individuals. • The Department releases a list of long-term care facilities in Florida associated with COVID-19 cases with active cases and number of deaths in each facility in order to provide realtime data. • The Department is providing a report detailing surveillance data for every Florida county. ESCAMBIA COUNTY BOARD APPROVES CARES ACT FUNDING DISTRIBUTION FOR RENT AND MORTGAGE ASSISTANCE, RAPID TESTING, FOOD DELIVERY AND ADDITIONAL PUBLIC HEALTH CAMPAIGNS At the regular board meeting today the Escambia County Board of County Commissioners approved moving forward with rapid testing, food delivery and additional public health campaigns using CARES Act funding provided by the Florida Division of Emergency Management. The Board, working under a quorum of three members, passed all measures 3-0. Commissioners previously approved rent, mortgage and utility assistance in response to the COVID-19 pandemic through an agreement with the Florida Housing Finance Corporation to receive $903,834 in Coronavirus Relief Funds. These funds will cap at $3,000 per family for qualifying tenants and homeowners affected by COVID-19. There is a 10-day advertising period required before online applications can be submitted. More information will be released as soon as possible. The Escambia County Rapid Testing Program will allow for 30,000 tests to be administered by Ascension Sacred Heart Hospital through December 30, 2020. These tests could be used for residents without COVID-19 symptoms and for residents without insurance. This funding will also provide 20,000 ID NOW Rapid Test Kits administered by Community Health Northwest Florida.

The Board also approved food delivery through nonprofit partners and churches as part of the Escambia Serves Food Assistance and Relief Program, allowing Escambia County to continue to serve residents through food distribution programs. Funding in the amount of $500,000 was approved for public health campaigns through Visit Pensacola as it relates to Coronavirus-related resources for out-of-town visitors. Efforts will focus on publicizing the resumption of activities and steps taken to ensure a safe experience during COVID-19. A special board meeting will take place on Thursday, Aug. 27 at 9 a.m. to continue the discussion about the Escambia County CARES Act plan and implementation. The Board of County Commissioners will meet to address and put forth additional details and requirements for its residents and businesses seeking the more than $14 million from the Florida Division of Emergency Management. Additionally, the special meeting will include discussion on Accenture’s report about the strategic organizational assessment of Escambia County’s procurement processes. The meeting will be held in the Board Chambers of the Ernie Lee Magaha Government Building, 221 Palafox Place.

SUPREME COURT OFFERS STOPGAP FOR LAW SCHOOL GRADS DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — The state Supreme Court on Monday released a supervisedpractice program for law school graduates who have been unable to take the Florida Bar exam amid the coronavirus pandemic, but critics said the program doesn’t go far enough. Chief Justice Charles Canady last week issued an apology after the Florida Board of Bar Examiners postponed a plan to offer the exam online, after canceling an in-person exam in July. In calling off the online exam, the board blamed problems with software — but the move touched off an outcry from law school graduates who must pass the test to be licensed in the state. On Monday, the Supreme Court released a temporary program that will allow law school graduates to work under the supervision of Florida attorneys who have been practicing for at least five years. The program will be available to law school graduates who were signed up to take the test this summer and will exclude people who previously have taken the bar exam.

COURT SETS ARGUMENTS IN EPSTEIN VICTIM CASE NEWS SERVICE OF FLORIDA STAFF A federal appeals court has scheduled December arguments in a lawsuit filed by one of notorious sex offender Jeffrey Epstein’s numerous victims. The 11th U.S. Circuit Court of Appeals on Friday slated an “en banc,” or full court, hearing for Dec. 3 in an appeal by Courtney Wild, a Florida woman who as a teen was one of Epstein’s victims. For more than a decade, Wild has been challenging a secret non-prosecution agreement hatched by federal prosecutors and attorneys for Epstein, a wealthy financier who had a home in Palm Beach County. Epstein died of an apparent suicide last year while in jail after being arrested on sex-trafficking charges involving minors in Florida and New York. Epstein was arrested last year after reporting by the Miami Herald led to heavy scrutiny of the 2008 plea deal. Under the agreement, Epstein pleaded guilty to two state prostitution charges in Florida, including procuring a minor for sex. The plea deal also provided

INMATE COVID-19 DEATH TOLL REACHES 84 NEWS SERVICE OF FLORIDA STAFF Three Florida inmates died from complications of COVID-19 over the weekend, bringing the death toll among prisoners to 84, according to data released Monday by the state Department of Corrections. August has been the deadliest month in Florida’s prison system since the start of the pandemic, with 33 inmates and three correctional officers dying of COVID-19. In July, the second deadliest month, 25 inmates died of COVID-19. As more inmates and workers get sick, Gov. Ron DeSantis’ response has remained focused on testing and isolating symptomatic people. As of mid-day Monday, 15,366 inmates and 2,424 corrections workers had tested positive for the virus. Over the weekend, 66 prisoners and 35 workers were diagnosed with the disease. The program will last until the results of the February 2021 bar exam are released. “It creates a way for applicants to work despite delays caused by pandemic conditions and online testing failures,” the Supreme Court said in releasing Monday’s order, which gives the Board of Bar Examiners until Aug. 31 to set up the supervisory program. But critics of how the board and the court have handled the summer exam said the temporary program doesn’t go far enough because it still requires prospective lawyers to take the exam. “These folks really need to work. They need to get a job. It’s hard enough to take the exam. It’s even harder taking it while having a job and be successful in the job,” Miami lawyer Matthew Dietz told The News Service of Florida in a telephone interview Monday. Dietz co-authored a petition last week that asked the Supreme Court, which oversees the Board of Bar Examiners, to waive the test requirements for people who had signed up for the July in-person exam. Dozens of Florida lawyers signed onto the proposal, which would

But Wild filed a lawsuit challenging the agreement, alleging that the deal violated her rights under the federal Crime Victims’ Rights Act to confer with the government’s lawyers and to be treated fairly by them. In a split decision earlier this year, a three-judge panel of the Atlanta-based appeals court reluctantly held that Epstein’s non-prosecution agreement with prosecutors did not violate the 2004 federal act. But this month, the full court agreed to reconsider Wild’s appeal. In a May 5 motion requesting a full-court hearing, Wild’s attorneys argued that the lawsuit is “perhaps the most important case in our nation’s history involving crime victims’ rights in the criminal justice process.” The 11th Circuit in Friday’s order noted that, under the court’s “rules and customary practices,” Wild’s case would be heard during the week of Feb. 21. “In view of the unique circumstances recounted in Ms. Wild’s motion, and the government’s non-opposition, we will depart from those practices to hear the case earlier,” the court wrote in setting oral arguments and detailing a schedule for briefs to be filed.

fered testing to inmates and workers at 49 correctional facilities that have experienced outbreaks. Corrections workers, who can be transmitters of the disease, are encouraged but not required to get tested. As of last Wednesday, 7,416 workers had been tested for the virus. As of Monday, four prisons — Santa Rosa Correctional Institution, South Florida Reception Center, Everglades Correctional Institution and Dade Correctional Institution — each have had at least 100 workers who have tested positive for the virus. In July, Dade Correctional began to ask employees to work 12-hour shifts up to six days a week to maintain adequate staffing levels due to the high number of sick workers. Infections among inmates have also spiked at several prisons within the last month. For example, Columbia Correctional Institution has had 1,338 inmate cases; Lowell Correctional Institution has had 993 cases; Mayo Annex has had 948 cases; and Santa Rosa Correctional Institution has had 806 cases.

have allowed law school graduates to be admitted to The Florida Bar after working under a “supervisory attorney” for six months. “When you’re dealing with somebody who’s supervised, who’s getting handson training, you’re dealing with a much more competent attorney than one that memorizes (issues for a bar exam),” Dietz said. The program announced by the court Monday rankled law school graduates. Prospective attorneys say they are facing financial hardships, job-offer retractions and emotional distress due to the fluctuating test dates and uncertainty about their futures. “Decision makers don’t seem to understand how hard it is to stop and start studying for the bar exam repeatedly, especially when they continue to insist on a closed-book exam. This process has become dehumanizing, and temporary licensure provides relief to very few. We deserve so much more for what they have put us through during a pandemic,” Johnny Carver, who graduated from the University of Miami School of Law this spring, told the News Service

on Monday. The Board of Bar Examiners called off the July exam after graduates, law school professors and legislators argued that holding the test in person would be contrary to health officials’ socialdistancing recommendations and would pose a danger to test-takers with underlying medical conditions who have a higher risk of complications from COVID-19, the respiratory disease caused by the coronavirus. The board rescheduled the exam for last Wednesday and said it would be held online. Three days before the scheduled exam, however, the board called it off, pointing to problems with ILG Technologies software. In an unusual move, Canady apologized last week in a video released by the Supreme Court. “We acknowledge and accept the criticism that has been directed at the court and the Board of Bar Examiners,” Canady said. “I can’t guarantee you that the path forward will be flawless, but I can guarantee you that we have learned from this mistake and that it will not be repeated.”

REPORT SHOWS COVID-19 CASES POPPING UP ON CAMPUSES ANA CEBALLOS NEWS SERVICE OF FLORIDA TALLAHASSEE — More than 700 coronavirus cases have been linked to K-12 schools and higher-education institutions over the course of two weeks as students and employees began returning to campuses across the state, according to a Florida Department of Health report released Monday. The report breaks down the number of cases tied to elementary, middle and high schools, as well as colleges, universities and trade schools. Altogether, 714 people, including students and employees, have tested positive for COVID-19 since Aug. 10, according to the report. The cases reflect a two-week period in which thousands of students throughout the state returned to classrooms or began moving into dorm rooms at colleges and universities. Gov. Ron DeSantis and Education Commissioner Richard Corcoran have been resolute in their weeks-long push to reopen K-12 schools and higher-education institutions in Florida, which has been one of the hardest-hit states by the coronavirus pandemic. Campuses shut down in March as the pandemic grew in Florida, forcing students to finish the spring through distance learning. During the past two weeks, 25 school districts reopened in accordance with a July 6 order issued by Corcoran that required schools to offer in-person instruction by the end of the month. In that time period, 205 students and 342 employees at elementary, middle and high schools tested positive for the virus, according to the report. Health officials also reported a dozen “unknown” cases of COVID-19, the respiratory disease caused by the coronavirus.

Fourteen of the cases have led to hospitalizations, with 85 percent of the hospitalizations tied to people who are 35 years old or older, according to the report. No children have been hospitalized after testing positive for the virus. While pushing to reopen schools, DeSantis and Corcoran have said children are at an “extremely, extremely low” risk of getting sick fromCOVID-19. Over the past two weeks, 64 children between the ages of 5 and 10, and 122 children between the ages of 11 and 17, have tested positive for the disease, the report says. Post-secondary schools have reported fewer coronavirus cases than K-12 schools since Aug. 10. Part of the reason is that universities and colleges had not resumed inperson classes during that time period. Most universities and colleges began in-person courses on Monday, and the move-in process for students began earlier this month. The state report, however, appears to be inconsistent with the number of infections that universities have reported in the last two weeks. For example, the state report says 90 students and 61 employees at universities, colleges and trade schools have tested positive for the virus, along with four “unknown” cases. But Florida State University and the University of Central Florida have reported 42 and 94 positive cases among students, respectively. The cumulative number of cases at those two universities surpasses the statewide total in the state report. State officials did not explain their methodology in the report.

The industry in Bay, Calhoun, Franklin, Gadsden, Gulf, Hamilton, Holmes, Jackson, Jefferson, Leon, Liberty, Madison, Okaloosa, Suwannee, Taylor, Wakulla, Walton and Washington counties was awarded $380 million in federal grant money as part of the storm recovery efforts. JUDGE SIDES WITH UNIONS ON REOPENING SCHOOLS DARA KAM NEWS SERVICE OF FLORIDA STAFF TALLAHASSEE — Accusing the state of ignoring the Florida Constitution, a Leon County circuit judge on Monday sided with teachers unions that challenged a state order mandating that schools resume in-person instruction this month amid the COVID-19 pandemic. The Florida Education Association and the union representing Orange County teachers filed lawsuits last month, alleging that Education Commissioner Richard Corcoran’s July 6 order requiring brick-and-mortar schools to reopen five days a week in August violates the Constitution’s guarantee of “safe” and “secure” public education. Schools districts risk losing funding if they don’t comply with Corcoran’s order, which teachers’ attorneys called “financial bullying.” Circuit Judge Charles Dodson, who held a hearing in the case last week, ruled Monday that Gov. Ron DeSantis, Corcoran and state education officials who are defendants in the lawsuits “have essentially ignored the requirement of school safety by requiring the statewide opening of brick-and-mortar schools to receive already allocated funding,” Dodson wrote. “Schools should reopen when the local decision-makers determine upon advice of medical experts, that it is safe to do so. Our Constitution requires safe schools,” the judge said in Monday’s 17page order. DeSantis’ office quickly said it would appeal, which would put the ruling on hold. “We intend to appeal this ruling and are confident in our position and in the authority of the commissioner and the governor to do what is best for our students,” DeSantis spokesman Fred Piccolo said in an email. Dodson’s ruling came as students continue to return to classrooms in districts throughout the state, after learning shifted online in March because of the pandemic. About 150,000 of the state’s 2.8 million schoolchildren had resumed face-to-face instruction as of last week,

Jacob Oliva, the chancellor of the K-12 school system, told Dodson on Thursday. Lawyers for the state argued that nearly all school districts have complied with Corcoran’s order requiring them to submit reopening plans for August and that no school districts joined as plaintiffs in the lawsuits. No school officials said they were coerced into reopening this month, the state said. “But the school boards have no choice,” Dodson wrote Monday. “The districts have no meaningful alternative. If an individual school district chooses safety, that is delaying the start of schools until it individually determines it is safe to do so for its county, it risks losing state funding, even though every student is being taught.” The policy “runs afoul of the Supreme Court’s long-standing admonition that the government may not deny a benefit to a person on a basis that infringes his constitutionally protected interests,” the judge said, quoting from another court decision. “Because defendants cannot constitutionally directly force schools statewide to reopen without regard to safety during a global pandemic, they cannot do it indirectly by threatening loss of funding through the order,” he wrote. Corcoran’s mandate ordered schools to reopen in August “subject to advice and orders of the Florida Department of Health, local departments of health” and executive orders issued by DeSantis. “Although that language sounds good, it is essentially meaningless,” Dodson wrote. “Local school boards wanted to know — is it safe to open our schools in our county? Defendants reduced the constitutional guarantee of a safe education to an empty promise, in violation of the Florida Constitution.” Dodson pointed to Hillsborough County, where the school board consulted with seven doctors during an Aug. 6 special meeting on whether to reopen. School board members asked each of the doctors if they believed it was safe to reopen classrooms. Five of the seven doctors said it was not safe at the time. One physician said it was not safe that

day but it might be in a few weeks. The seventh doctor, who serves as the director of the local health department, refused to give an opinion. Based on the doctors’ responses, the county decided to delay the first day of in-person instruction from Aug. 24 to Sept 14. Distance learning was still slated to begin on Aug. 24. But Corcoran told Hillsborough school officials they would lose funding if they did not reopen classrooms in August. The county eventually settled on restarting face-to-face instruction on Aug. 31. “They had no real choice. Defendants arbitrarily prioritized reopening schools statewide in August over safety and the advice of health experts; and all school districts complied in order to avoid a drastic loss of state funding,” Dodson wrote in Monday’s order. The judge also agreed with the plaintiffs’ claim that Corcoran’s order is “arbitrary and capricious,” acknowledging that such a finding is “a very high burden” to meet. Dodson noted that Corcoran allowed Miami-Dade, Broward and Palm Beach counties to begin the school year remotely, due to high positivity rates for COVID-19 this summer, but rejected similar plans proposed by Hillsborough and Monroe counties. DeSantis and Corcoran have steadfastly insisted that families need to be able to choose whether to have children return to face-to-face instruction or learn remotely. But Dodson found Corcoran’s order did not take a number of important factors into consideration. “It fails to mention consideration of community transmission rates, varying ages of students, or proper precautions,” Dodson wrote, adding “what has been clearly established is there is no easy decision and opening schools will most likely increase COVID-19 cases in Florida.” The Florida Department of Health reported Monday that nearly 560 coronavirus cases have been linked to Florida public and private schools since students and employees began reporting to classrooms two weeks ago. More than

200 elementary, middle and high school students and 342 school employees have tested positive for the virus since Aug. 10. The department also reported a dozen “unknown” school-related cases. Dodson’s order pointed out that last week’s hearing, which lasted for more than two days, was conducted remotely. “That is because it has been decided it is unsafe to hold in-person trials in the Leon County courthouse during this highly dangerous pandemic. That was a local decision based on local conditions. Because of COVID-19, jurors and witnesses are not allowed to come into our courtrooms, almost all of which are larger than classrooms in our schools,” he wrote. During two days of testimony, teachers said they would retire and lose benefits or resign rather than risk being exposed to the COVID-19. Under Dodson’s temporary injunction Monday, districts could reopen schools later than August without risking the loss of state education funds. The judge said the injunction “allowing local school boards to make safety determinations for the reopening of schools without financial penalty” is in the “public’s interest.” “This is what the local school boards were elected to do,” he added. Union leaders and lawyers hailed Dodson’s order in a Zoom press conference Monday afternoon, calling it a major victory that could send ripples throughout the nation. They also asked Corcoran and DeSantis to work with them on school reopenings and closings instead of appealing. “You lost today, Mr. Commissioner and Mr. Governor, because you’re wrong,” said Florida Education Association President Fedrick Ingram, who was joined by Randi Weingarten, president of the American Federation of Teachers. “We won because we’re on the side of right, the side of right about public health and public safety and keeping people alive in this pandemic.” — News Service staff writer Ana Ceballos contributed to this report.
