PEN SACOL A INT E R N AT I O NAL AIR PO R T INT R OD U C E S NEW NON- STOP FLIGHT At the onset of the global health crisis, industries across the globe began ceasing operations to reexamine safe business practices. In the airline industry, international travel bans were initiated, leisure travel came to a halt and airports quickly turned into ghost towns utilized only for postal cargo shipments and essential travel. When stay at home orders were first implemented, airports including Pensacola International Airport (PNS) witnessed a 92 percent drop in passenger count. Despite the closures and constant changes following CDC guidelines, the Pensacola International Airport has remained above the national averages for the airline industry across America experiencing only a 30 percent drop in last year’s numbers while the national average sits around a 60 percent decrease. flights are crucial to keeping an airport competitive, helping lower the cost of flights for travelers and increasing connections to other destinations,” Garvin explained. “We already had a direct flight to Washington, DC through American Airlines to Ronald Reagan Washington National Airport, but this allows us to open up more flights and bring more opportunity to Pensacola too. We want to see a lot of people come to Pensacola and enjoy our beaches, our culture and experience what Pensacola has to offer. Dulles is a great hub for international travel as well, so once international travel opens back up, we have positioned ourselves with a great new connection.” Garvin also explained that Dulles is a crucial location to meet increasing demand for flights to Washington, DC and helps connect Pensacola

to the Navy Federal Credit Union headquarters in Vienna, Virginia. As we approach the holiday season, PNS is closely anticipating increases in travel and working to ensure that the airport is prepared and maintains its social distanced protocol. Part of that preparation is tracking surveys conducted that estimate 60 percent of normal holiday travelers anticipate traveling while 30-40 of normal holiday travelers are opting not to travel this season. “We are going to continue enforcing masks, keeping seats and lines spaced out by six feet and cleaning the airport and cabins to ensure that we are a safe and easy place to travel. We are constantly aiming to create the best air travel experience on the Gulf Coast,” Garvin said.

FLEMING FOUNTAIN CONTINUES TO SHINE A BRIGHT LIGHT ON PENSACOLA’S HISTORY Pensacola, Fla.-December 10, 2020This holiday season, residents and visitors can enjoy the newly lighted Fleming Fountain in Seville Square while they walk through Downtown Pensacola. The new lighting was provided by a donation from the Fleming family to the University of West Florida Historic Trust as a memorial honoring Bill and Phyllis Fleming for their contributions to the community. The Fleming Fountain was made in 1984 as a gift to the people of Pensacola and a memorial to James and Earnestine Fleming, a prominent Pensacola family dedicated to community service. Their daughter, Babette Fleming, a leading educator in Escambia County, conceived the idea for the project and provided the funding. The terracotta tiles of the fountain base, designed by artist John Yauger, perfectly capture the history and spirit of Pensacola. The clay art panels depict mockingbirds, dogwood blossoms, red snapper, Seville Square, the Pensacola Bay Bridge, the Blue Angels, the Florida State seal and the Five Flags of Pensacola. Fort Pickens is also shown on one of the panels with an entwining trumpet vine covering its crumbling ramparts. An image of shrimp boats tied up at a fish house with their drying nets provides a warm sense of nostalgia. Another panel, featuring a piney

SECOND, THIRD AND FOURTH RED BULBS PLACED ON FIRE SAFETY WREATH Escambia County Fire Rescue has placed three additional red bulbs on the “Keep the Wreath Green” fire safety wreath, bringing the total to four residential structure fires so far during December. Last year’s campaign concluded with 13 red bulbs. The second fire occurred in the 5800 block of Tripp Trace on Friday, Dec. 11. Escambia County Emergency Communications received a call at 6:31 p.m. about a residential structure fire. Escambia County Fire Rescue units L12, E11, SQ3, E17, E16, BC11 and BC2 arrived on scene to find flames and smoke showing. Their rapid response time with aggressive interior fire attack saved most of the occupants’ personal items. The incident was brought under control by 6:48 p.m. There were no occupants home at the time of the fire; however they will be displaced until repairs can be completed. There was heavy fire damage to the kitchen and smoke damage throughout the home. ECFR conducted the cause and origin investigation and determined the fire started due to an electrical failure from an appliance located in the kitchen. Assistance was provided by the Department of Defense Fire Services. The third and fourth fires occurred in the 1700 block of Dogwood Place Apartments on Sunday, Dec. 13. Escambia County Emergency Communications received multiple calls at 1:55 p.m. regarding a multi-family dwelling fire. Upon arrival, ECFR units E11, E17, E16, Sq3, L12, TRK34, Tanker 11, BC2 and BC3 saw a working fire from two of the four units in the complex. The incident was brought under control by 2:33 p.m. There were no occupants home at the time of the fire; however, the American Red Cross is assisting two adults. The pet cat did not survive the incident. The two units appear to be a total loss, and no smoke alarms were present. The fire appears to have been started by an unattended burning candle. If your home does not have a working smoke detector, please call Es-

cambia County Fire Rescue at 850595-HERO (4376) or 850-436-5200 for city of Pensacola residents. The “Keep the Wreath Green” fire safety campaign is a collaborative initiative with the city of Pensacola to promote fire safety during the month of December. During the month-long campaign, five-foot wreaths are on display at 21 county fire stations and five city fire stations, as well as Escambia County’s Ernie Lee Magaha Government Building downtown, the Escambia County Public Safety Building and Pensacola City Hall. Each time firefighters respond to a residential fire with damage, a green light bulb will be replaced with a red one to remind citizens of the dangers posed by fires in residential home. RESIDENTS REMINDED THAT ONLY HURRICANE SALLY GENERATED DEBRIS WILL BE COLLECTED Contractors with Escambia County are continuing to collect Hurricane Sally generated debris. Unfortunately, they are finding a lot of non-storm debris and will mark it orange. The resident or business is responsible for the removal of debris unrelated to Hurricane Sally. Non-eligible debris includes: • Landscaping/beautification • Fresh cut vegetation • Land clearing • Garage cleaning • Debris located on right of way in front of commercial property • Debris generated by businesses • Reconstruction debris (new construction and repairs/remodeling) • Debris that appears it would not come from that location (illegal dumping) “First, we would like to thank residents who have properly kept debris separated and away from storm drains and utilities,” said Pat Johnson, Escambia County Waste Services director. “Their efforts enabled contractors to work more quickly. Debris monitors have been documenting what debris

has looked like throughout this collection process, and unfortunately, they have discovered a lot of debris that has been set out that was not generated from Hurricane Sally. FEMA has rules for reimbursement that the county needs to follow. Federal and State agencies are involved with monitoring debris removal. We are near the end of this process and are proud of the work that has been accomplished to clean up Escambia County after Hurricane Sally.” Please do not place additional items out for pickup. The last date to set out Hurricane Sally debris was Dec. 1. Contractors estimate final pickup to be completed by Christmas. As of Wednesday, Dec. 9, Escambia County contractors have hauled 76,868 loads, collecting 3,933,057 cubic yards of debris. This equals 616 football fields with debris stacked 3 feet high. That’s enough debris to fill 85% of the Mercedes-Benz Superdome in New Orleans! For more information about Escambia County Waste Services, visit myescambia.com/wasteservices.

DESANTIS BACKS SANCTIONS IN BEACH CLOSURE CASE

FLORIDA TOPS 20,000 COVID-19 RESIDENT DEATHS

JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — Pointing to what they called “baseless” legal arguments, lawyers for Gov. Ron DeSantis have urged an appeals court to sanction a Northwest Florida attorney who filed a lawsuit to try to force DeSantis to close beaches to prevent the spread of COVID-19. DeSantis’ lawyers filed an 11-page document Friday at the 1st District Court of Appeal contending that Santa Rosa Beach attorney Daniel Uhlfelder filed a frivolous appeal after a circuit judge ruled against him in the beachclosure case. The Tallahassee-based appeals court last month rejected the appeal and raised the possibility of sanctioning Uhlfelder and attorneys who represented him. It subsequently said DeSantis’ lawyers could file arguments on the issue. “The many hours spent by this court and the attorneys of the Executive Office of the Governor on this appeal could have been spent on innumerable other pressing matters related to the health, welfare, and safety of Floridians,” DeSantis’ lawyers wrote in the document Friday. “Appellant (Uhlfelder) knew or should have known that filing this appeal was frivolous. Appellant and his counsel should be sanctioned accordingly.” But Uhlfelder and his attorneys in a Nov. 27 court document disputed that the appeal was frivolous or filed in bad faith. They focused, in part, on comments that Leon County Circuit Judge Kevin Carroll made in April when he ruled against Uhlfelder in the case. As an example, they quoted Carroll as saying that Uhlfelder “has an understandable concern that he has raised

JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — As Gov. Ron DeSantis and health officials celebrated the arrival of a COVID-19 vaccine on Monday, Florida reported that more than 20,000 residents have died from the disease, offering a sobering reminder of its continuing toll. With 137 additional resident deaths reported Monday, the total jumped to 20,003 since the start of the pandemic, according to a report from the Florida Department of Health. Also, 268 nonresidents have died in Florida. The updated numbers were released hours after DeSantis held a news conference at Tampa General Hospital to tout the arrival of the first doses of a Pfizer vaccine and to witness the inoculation of a registered nurse at the hospital. “This is a game-changer,” DeSantis said. “It’s a great day for the United States. It’s a great day for the state of Florida.” But while the state plans to move quickly to vaccinate front-line health care workers and residents of longterm care facilities, COVID-19 continues to tear through Florida — and many other parts of the country — and it could be months before many members of the public can get shots. Florida has seen a soaring number of cases and deaths this fall. On Sept. 14, for example, it reported 665,730 total cases and 12,642 resident deaths. On Monday, it reported 1,134,383 total cases and 20,003 resident deaths — translating to a 70 percent increase in cases and a 58 percent increase in deaths during the past three months. Miami-Dade County had 4,002 resident deaths as of Monday. That was more than the deaths in 25 states, according to a Johns Hopkins University website that compiles pandemic numbers from across the country.

‘INTELLECTUAL FREEDOM’ PROPOSAL REEMERGES NEWS SERVICE OF FLORIDA STAFF A Senate Republican on Monday began a renewed effort to pass a controversial proposal that would require state colleges and universities to conduct annual assessments of “intellectual freedom and viewpoint diversity” at the institutions. Sen. Ray Rodrigues, R-Estero, filed the proposal (SB 264) for consideration during the 2021 legislative session, which starts in March. Rodrigues, who was elected to the Senate last month, unsuccessfully tried to pass such a measure during the 2019 and 2020 sessions while he served in the House. He ran into opposition from powerful Senate Appropriations Chairman Rob Bradley, R-Fleming Island,

STATE, DELOITTE SAY UNEMPLOYMENT CASE SHOULD BE TOSSED NEWS SERVICE OF FLORIDA STAFF The Florida Department of Economic Opportunity and Deloitte Consulting LLP are asking a Leon County circuit judge to toss out a revised class-action lawsuit that seeks damages because of problems with the state’s unemployment-compensation system during the COVID-19 pandemic. The agency and Deloitte filed motions last week to dismiss the case, saying, in part, that the plaintiffs are making largely the same arguments that Judge John Cooper rejected in an earlier version of the lawsuit. “Simply put, the third amended complaint (the latest version) is substantially indistinguishable from the one the court found to be deficient and provides no basis for the court to revisit its prior conclusions,” Deloitte attorneys wrote in their motion. The revised lawsuit, filed last month, came after Cooper dismissed the earlier version in September. In the dismissal, Cooper

here, and I believe he has pursued this matter in good faith and is seeking what he believes to be an appropriate response to the COVID crisis.” “The trial court explicitly recognized Mr. Uhlfelder’s legitimate ‘concern for the people of the state of Florida,’” the Nov. 27 document said. “While the learned trial judge did not explicitly direct Mr. Uhlfelder to take the appeal for which he and his lawyers now must show cause why they should not be sanctioned, the trial court plainly encouraged the appeal. Thus encouraged, Mr. Uhlfelder promptly instituted an appeal.” Uhlfelder filed the lawsuit in late March, contending that the governor should be required to close beaches statewide and issue a “safer at home” order to prevent the spread of the virus. DeSantis issued a “safer at home” order but refused to close beaches statewide, though some local governments temporarily imposed beach closures. Carroll rejected the lawsuit, saying, in part, that “second-guessing” DeSantis’ actions about beach closures and stay-at-home orders would violate separation-of-powers restrictions established by the Constitution. Uhlfelder has drawn national media attention during the pandemic by dressing as the Grim Reaper and criticizing the state’s handling of COVID-19 — actions that DeSantis’ lawyers cited in a footnote in Friday’s document. DeSantis’ lawyers described the appeal as an “axiomatic example of abuse of the justice system. Appellant’s empty political posturing warrants repercussions.” If the appeals court decides to impose sanctions, they could include requiring Uhlfelder and his lawyers to pay legal fees.

and from some higher-education faculty members. But Bradley left the Senate last month because of term limits. Under the bill, the State Board of Education and the state university system’s Board of Governors would require state colleges and universities to conduct the annual assessments, using surveys that consider “the extent to which competing ideas and perspectives are presented and members of the college community feel free to express their beliefs and viewpoints on campus and in the classroom,” said the portion of the bill involving state colleges. Nearly identical wording is in the universities portion of the bill. Rodrigues has said in the past that it is important to know whether people feel free to “express their beliefs and viewpoints on campus and in the classroom.” But critics, in part, have raised questions about whether the results of the surveys could affect hiring practices at colleges and universities.

allowed the plaintiffs to file a revised complaint. The revised version makes a series of allegations and contends, in part, that the department and Deloitte were negligent and breached a fiduciary duty to the plaintiffs, who lost their jobs during the pandemic and faced problems getting unemployment benefits. The department administers the unemployment program, while Deloitte was a contractor that helped put in place the CONNECT online system, which could not handle the crush of unemployment applications this spring. But attorneys for the Department of Economic Opportunity and Deloitte argue that the lawsuit should be dismissed for several reasons, including that it would violate the constitutional separation of powers between the judicial and executive branches of government. “The nature of plaintiffs’ claims against the department in the third amended complaint are unchanged from their previous complaint; the clear constitutional defects in those claims have not been addressed,” department attorneys wrote in their motion last week.

Neighboring Broward and Palm Beach counties have combined for another 3,521 deaths, the Department of Health report shows. Also hard-hit in Florida have been long-term care facilities, which have had 7,745 reported deaths of residents and staff members. The overwhelming majority of those deaths have involved residents of nursing homes and assisted living facilities, as the virus attacks seniors and people with underlying medical conditions. Overall, 16,535 of the Florida resident deaths as of Monday involved people age 65 or older — a nearly 83 percent rate that has remained relatively constant throughout the pandemic. As the number of cases have surged in Florida this fall, more COVID-19 patients also have required hospitalization. The Agency for Health Care Administration reported Monday afternoon that 4,932 patients were hospitalized because of “primary” diagnoses of COVID-19, compared to 2,637 on Sept. 14. Amid the increasing numbers, DeSantis and other officials who gathered for the news conference Monday at Tampa General Hospital pointed to vaccines as key to beating back COVID-19 and returning to a sense of normalcy. Tampa General received 20,000 doses of the Pfizer vaccine Monday and began vaccinating hospital workers. “This is 20,000 doses of hope,” Tampa General President and CEO John Couris said. “This is the beginning to the end. This is monumental, if you are sitting in our shoes caring for the patients.” — News Service Assignment Manager Tom Urban contributed to this report.
