The West Main Master Plan project is a journey that started to take shape 15 years ago when voters approved a referendum to develop the former JANUARY 15 2020 Trillium property along Pensascola’s waterfront. Since then, the site has seen significant development. This 27.5 acre property, known as Vince J. Whibbs, Sr. Community Maritime Park, features the successful Blue Wahoos Stadium, which was named America’s Best Double-A Ballpark this year, Maritime Place, an amphitheatre, playground and festival grounds. Even after those developments, there were still nine acres left unused. In 2015, Studer Properties purchased the 19-acre Main Street site formerly home to an Emerald Coast Utilities Authority (ECUA) wastewater treatment plant. These large undeveloped parcels of land along Main Street offered endless potential. Studer Properties had many goals for this land, but among the most important were to connect the downtown core to the waterfront and meet the community’s needs. Studer Properties funded a marketability study and master plan to help them discover the most successful uses for the bayfront property. In 2019, DPZ Design and Speck and Associates developed a master plan for the former ECUA site and the maritime parcels, which included a marketability study by Weitzman Associates. The marketability study included analysis of local demographic and economic trends, interviews with stakeholders and business owners and extensive housing market research. There were more than 400 people involved in the study. This study found that there was an overflowing need for downtown housing, positive demographic trends and increased employment growth. So, the West Main Master Plan was created, and the Pensacola City Council adopted it
at the end of 2019. It has been a long time coming for this project, but Studer Properties recently announced its three development teams that will be bringing this vision to fruition. An independent 8-person selection committee reviewed the development proposals and recommended the following three development teams: The Dawson Company & EJ Smith Enterprises, LLC; Edwards Communities Development Company & Silver Hills; and Valencia Hotel Group. All of the selected businesses, aside from The Dawson Company, are based outside of Pensacola, which Studer Properties President, Andrew Rothfeder said is a good thing. “The goal is to always bring outside capital and outside money into your community for investment. If you don’t get that, then any community is just trading its dollars around to each other, and it never grows,” Rothfeder explained. “If outside investors want to put money into real estate or businesses, it is a huge signal of positive growth for any community.” The Dawson Company & EJ Smith Enterprises, also known as Inspired Communities, have the ECUA parcel and Maritime parcels 3,6,8 and 9. Downtown has been undergoing a renaissance and needs a quality full-service hotel to round out its offerings,” Keeling said. “The Valencia hotel will be the highest quality hotel in either Pensacola or Pensacola Beach. It will attract a moreaffluent leisure traveler and provide an impressive location for businesses trying to recruit professionals or relocate to Pensacola.” The three development teams are in the predevelopment agreement phase with the City. At this point, the developers are having exclusive negotiations with the City, and once they come to an agreement, each developer will come before the city council for approval. Rothfeder estimates that this step will be complete by November. After that step, the developers will begin site control, which is when they meet with architects, engineers and consultants to study the site. Rothfeder explained that this step is the most time consuming. He estimates that it will be complete by the end of 2021 and construction will begin one to two years later. Although this project’s completion date is distant, the West Main Master Plan gives Pensacola a great deal to look forward to. These developments will create more jobs and opportunities for the community.

The Summation Weekly FIRST JUDICIAL CIRCUIT TO HOLD DRIVER’S LICENSE CLINIC TO ASSIST PARTICIPANTS IN RESTORING DRIVING PRIVILEGES – REGISTRATION NOW OPEN The First Judicial Circuit will host a Driver’s License Clinic on Friday, March 26, 2021, to assist individuals whose licenses have been revoked, suspended, or cancelled. The event will be held from 9 a.m. until 2 p.m. at the M.C. Blanchard Judicial Building in Pensacola. Due to COVID-19 restrictions, many if not most participants will be assisted virtually. Only certain participants who need to see a judge or hearing officer will be seen in the courthouse, and social distancing protocols will be carefully observed. Registration is opening early – December 1, 2020 at 9 a.m. – in order that more services can be provided in advance of the actual clinic day. Staff from the Florida Department of Highway Safety and Motor Vehicles, Escambia County Tax Collector’s Office, Florida Department of Revenue, Escambia County Clerk of Court, Escambia County Sheriff’s Office, Office of the State Attorney, and the Office of the Public Defender, along with judges and court and community corrections staff, will be available to assist registrants and provide individualized information relevant to each participant’s personal circumstances. The goal of
the clinic is to provide “one-stop shopping” for citizens to interact with the appropriate state agencies and/or the court, so they can determine how to regain their driving privileges. Drivers’ licenses may be suspended for a variety of reasons, including: 1) failure to pay traffic tickets; 2) the accumulation of too many points on one’s driving record; 3) failure to pay child support; 4) failure to pay or work off fines, fees, and costs imposed as part of a criminal sentence; 5) failure to maintain automobile insurance; 6) failure to register a vehicle or keep or renew the registration; 7) failure to obtain, renew, or return a car tag; or 8) designation as an habitual traffic offender. Licenses may also be revoked as a consequence of entering a plea to certain crimes, such as driving under the influence or certain drug-related offenses. Registrants should use care to enter the precise weblink for registration, as search engines or inaccurate entry may result in access to an incorrect webpage. Availability is limited, so interested persons should register as soon as possible. Participants must be pre-registered in order to receive service at the clinic; walk-ins will not be accepted. PORT OF PENSACOLA JOINS GREEN MARINE ENVIRONMENTAL STEWARDSHIP PROGRAM The Port of Pensacola on the Gulf of Mexico is the newest Green Marine participant and the third Florida port authority to become part of the largest voluntary environmental certification program for North America’s maritime industry. “Joining a key stewardship program such as Green Marine is consistent with the directed goals of sustainable development identified in the Port’s renewed vision plan,” Port Director Amy Miller said. The vision plan, adopted in 2019, seeks to establish a hybrid port, balancing clean cargo seaport trades with new investment geared to creative knowledge and expertise. “We are committed to achieving a revitalized, sustainable Port of Pensacola and securing long-term economic and social benefits to Northwest Florida,” added Miller. “We will accomplish this by safeguarding core maritime infrastructure and activities while engaging with the community.” “We’re so pleased to welcome the Port of Pensacola into the Green Marine program where it can benchmark its progress along with more than 50 other U.S. and Canadian ports,” said David Bolduc, Green Marine’s executive director. “The Port of Pensacola is already conveying its genuine commitment to sustainability through its vision plan inclusive of science, technology, education, research, and blue economy.” Green Marine offers a step-by-step roadmap for port authorities, terminal operators, shipping lines and shipyard managers to voluntarily and measurably reduce their environmental footprint. The comprehensive program addresses key environmental issues using 13 performance indicators that include lowering air emissions, minimizing community impacts, and demonstrating environmental leadership. “I am proud of the Port of Pensacola and its leadership for taking this proactive step toward becoming a more sustainable port,” Pensacola Mayor Grover

NASC MEMORIAL SERVICE, AWARD CEREMONIES HONOR VICTIMS OF NAS PENSACOLA TERRORIST ATTACK Naval Aviation Schools Command (NASC) held a memorial service and wreath layingand Purple Heart Medal ceremonies at Naval Air Station (NAS) Pensacola, Dec. 4. The memorial service and wreath laying marked the one-year anniversary of the Dec. 6 NAS Pensacola terrorist attack that left four killed, including the shooter, and eight injured. “It was almost one year ago today during a despicable and cowardly act of terrorism that Ensign Joshua Watson, Petty Officer 3rd Class Mohammed Haitham and Petty Officer 3rd Class Cameron Walters paid the ultimate sacrifice in service to their nation,” said Rear Adm. Pete Garvin, commander, Naval Education and Training Command (NETC), who was the ceremony’s guest speaker. “As we lay thiswreath for our three fallen shipmates, we honor their bravery and their sacrifice.” The ceremony also recognized those who were wounded during the attack – Ensign Kristy Lehmer, Ensign Brianna Thomas, Airman Ryan Blackwell, Airman George Johnson, Jessica Pickett, Capt. Charles Hogue, Deputy Matthew Tinch and Deputy Jonathan Glass. “Today, we continue to mourn those who lost their lives,” said Garvin. “We also pay tribute to the eight Sailors, Marines, government civilians, Naval Air Station Pensacola security forces and Escambia County Sherriff’s Office deputies who were injured. They all exemplify honor, courage and com-
mitment.” Garvin commented on the strong relationship between the Pensacola community and the military at NAS Pensacola. “Here in Pensacola, in the ‘Cradle of Naval Aviation,’ we are a family with an unshakeable foundation, a family that stands the test of time and is unwavering in our defense of the constitution and the country whose course it directs,” said Garvin. During three separate ceremonies at the National Naval Aviation Museum, Garvin and Capt. Edgardo Moreno, NASC’s commanding officer, presented the Purple Heart Medals posthumously to the families of Watson, Haitham and Walters. “In these times the war zone is no longer limited to battlefields, it all too often finds its way to bastions where it is least expected,” said Cmdr. Michael Lofgren, NASC’s executive officer, who provided remarks at the ceremonies. “These heroes, selflessly and tirelessly preparing for a battlefield, suddenly and unexpectedly found themselves in a war zone.” The Purple Heart Medal is a United States military decoration awarded in the name of the President tothose wounded or killed while serving, on or after April 5, 1917, with the U.S. military. EXPLORATION OF MARITIME HISTORY AVAILABLE THROUGH EFFORTS BY UWF, PARTNERS Exploration of the maritime history and heritage of the Gulf Coast is now readily available through the Gulf Coast Digital History Project, featuring a digital portal established by the University of West Florida and various partners. One touch of a screen or click of a mouse allows users to explore thousands of digitized photographs, maps and other historic documents, along with a curated list of books and articles. The digital history project seeks to foster research, teaching and learning about the northern Gulf of Mexico by creating an accessible clearinghouse of history and heritage resources. Featured collections include articles on Harold J. Brow, a commander in the U.S. Navy who earned the title of the fastest flyer in the world in 1923, images of the Port of Pensacola from the 1970s and letters Navy officer Mark X. Benson sent from the Pacific Theater to his wife in Gulf Breeze during World War II. “This collection is a one-stop shop for students, scholars and researchers to delve into the rich maritime history of the Gulf Coast,” said Dr. Jamin Wells, UWF Digital Humanities Lab director and assistant professor of history. “The collection is robust and we are working to further expand this resource.” The project will launch the portal with a virtual event from 11 a.m. to noon on Thursday, Dec. 10. Registration is open to the public and the event will showcase the portal along with a panel discussion and live Q&A session. “High school teachers often are given a very basic or bland curriculum as the foundation for history courses, and many of them spend hours upon hours searching for and piecing together resources to supplement their
curriculum and enrich their students’ academic experience,” said Williams, a Pace High School teacher and UWF history graduate student who will serve as a panelist for the virtual event. “This database provides an easily accessible and searchable tool that teachers can use to pull primary sources relevant to their coursework and to their students’ lives as residents of the Gulf Coast area. BOARD OF MEDICINE BACKS STIFFER PENALTIES CHRISTINE SEXTON NEWS SERVICE OF FLORIDA TALLAHASSEE — Despite warnings that the proposed regulations are too broad, the state board that regulates physicians has agreed to move ahead with new rules that would increase financial penalties for Florida doctors caught breaking the law. The Board of Medicine on Friday agreed to press ahead with several proposed changes to rules that lay out administrative and financial consequences physicians would face for violating state laws. The board recommended that fines be increased from $1,000 to $5,000 for a variety of first-time practice of care violations, including aiding in illegal abortions; leaving foreign objects in patients’ bodies; making deceptive, untrue or fraudulent statements; accepting kickbacks; illegally soliciting patients; and improper prescribing. The board forged ahead with the rule-making process, despite concerns flagged by Joint Administrative Procedures Committee chief attorney Marjorie Holladay. In a Sept. 16 letter to Board of Medi-
JUSTICES TAKE UP APPEAL IN GIRL’S MURDER JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — More than seven years after an 8-year-old girl was abducted from a Jacksonville Walmart, raped and murdered, the Florida Supreme Court will hear arguments this week about whether a man sentenced to death in the slaying should receive a new trial. The June 2013 murder of Cherish Perrywinkle drew huge amounts of news coverage and public attention in Jacksonville, with a jury in 2018 finding Donald James Smith guilty and a judge sending him to Death Row. The Supreme Court will hear arguments Wednesday in an appeal by Smith, whose attorney contends, in part, that the trial should have been moved out of Duval County because of the heavy pretrial publicity. Attorney H. Kate Bedell wrote in a brief this year at the Supreme Court that Circuit Judge Mallory Cooper erred in denying a change of venue. “Specifically, the pretrial publicity was so expansive that it saturated the community for years, provided a one-sided and continuous narrative leading to one conclusion at trial, Mr. Smith’s inevitable conviction, and death sentence,” the brief said. But Senior Assistant Attorney General Charmaine Millsaps argued in a brief that Smith’s trial attorneys did not meet legal tests for a change of venue. Also, Millsaps pointed to the long period of time between the murder and the trial. “There was over four years between this crime and jury selection,” Millsaps wrote. “Furthermore, Duval County is a large diverse county with hundreds of thousands of eligible jurors of which it is difficult to believe that twelve unbiased jurors, uninfluenced by the publicity and indifferent to, or even totally unaware of, social media posts, could not be found.” Smith, now 64, was accused of murdering Cherish Perrywinkle after a series of events that began when he met her mother, Rayne Perrywinkle, at a Dollar General store. Smith told Rayne Perrywinkle that he would take her and her daughters shopping at a Walmart. While at Walmart, Smith said he

Smith was convicted of first-degree murder, kidnapping of a victim under age 13 and sexual battery on a victim under age 12. In addition to the death sentence for the murder, he received life sentences on the kidnapping and sexual battery charges. Smith’s appeal to the Supreme Court seeks a new trial and raises a series of issues, including arguing that the circuit judge erred by allowing autopsy photos of Cherish Perrywinkle to be used during the trial. “Specifically, Mr. Smith argued that it would be error to admit these photographs because each was so graphic,” the brief on behalf of Smith said. “These photographs depicted a naked child with severe injuries to her vagina and anus, as well as skin removed from the front of her throat to show deep bruising around the trachea. The probative value was substantially outweighed by the prejudicial effect because, to show these images to the jury, would ‘shock’ them and ‘inflame their passions.’” But Millsaps, in her brief to the Supreme Court, wrote that the circuit judge “properly admitted the autopsy photographs, which were relevant to establish both premeditated murder and sexual battery.” Also, she indicated any error by the circuit judge in allowing the photos to be used would have been “harmless error.” “Smith’s DNA profile matched the DNA found on the victim’s neck and anus at one in 35 quintillion which is 35,000,000,000,000,000,000. And Smith’s DNA profile matched the semen from the victim’s vagina at one in 12 quadrillion, which is 12,000,000,000,000,000,” the senior assistant attorney general wrote. “Furthermore, there is a videotape of the beginning of the kidnapping from Walmart’s surveillance cameras showing Smith leaving the store with Cherish and walking through the parking lot with her toward his white van. Any rational jury would have convicted Smith of kidnapping, sexual battery, and murder based on the DNA evidence and the videotape without being shown a single photograph.”

The sanctions are required under a 2020 state law regarding service animals and public housing. The law requires physicians who certify the need for service animals to have direct knowledge of a person’s disability. In an Oct. 14 response to Holladay, Tellechea noted that the proposed rules include sanctions for physicians who violate the 2020 service-animal law as well as a new law that requires physicians to obtain informed consent before conducting a pelvic examination on a woman. “Because the Board (of Medicine) seeks to ensure disciplinary guidelines are in place as expeditiously as possible regarding these matters, it intends to proceed at this time,” Tellechea wrote. The proposed rules are still under development. Before being finalized, the Board of Medicine must give physicians who are impacted by the changes an opportunity have a public workshop. Physicians affected by the new fines also could request a rule hearing. Meanwhile, Jacksonville health care attorney and lobbyist Christopher Nuland supports the board’s move to increase financial penalties for physicians who make deceptive, untrue and fraudulent statements. Nuland represents a number of specialty physician groups,
STUDY: RECOVERY A YEAR AWAY FOR TOURISM BUSINESSES JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — Effects of the coronavirus pandemic on state tourism decreased in October, but recovery for Florida’s vital revenue-generating industry is still at best a year away, according to an association study released Monday. The Destinations Florida study indicated that businesses in October were having fewer problems finding supplies than in June. The research for Destinations Florida, an association of local tourism promotion organizations, also found a slight uptick in people planning Florida trips. But more than half of the state’s tourism-related businesses anticipate that COVID-19 impacts will continue until sometime between the third quarter of 2021 and the first quarter of 2022, according to the study. “Slowly but surely, we are seeing signs of a recovery and Florida’s tourism industry, which is a key driver of employment and our economy, continues to work hard to ensure our communities are able to rebound,” Destinations Florida Executive Director Robert Skrob said in a press release Monday. “There is no magic fix for an economic recovery but what we have seen, and what we know works, is the efforts of local tourism promotion organizations that have been providing critical resources, information and opportunities for local tourism businesses to welcome visitors back in a safe and secure manner.” The study, the association’s fourth survey of the state’s travel industry this year, involved 244 tourism-related businesses interviewed between the end of October and early November. The survey was conducted as advancements involving coronavirus vaccines were being announced, but prior to a recent uptick in positive COVID-19 cases and deaths in Florida. The Destinations Florida study, conducted by Downs & St. Germain Research between Oct. 27 and Nov. 10, also found: — Bookings being made 30 days out were 42 percent lower on Oct. 27 than a year earlier. On June 9, bookings being made a month in advance were 59 percent below the 2019 mark. — Employment at tourism-related businesses is 72 percent of pre-COVID-19 hiring levels. — Revenue was down about 40 percent for tourism businesses so far this year — through Oct. 27 — from the same time span in 2019, with profit off 55 percent. — Half of the businesses contacted received federal Paycheck Protection Program money, while one out of three drew other forms of financial assistance. About 40 percent claim they would still qualify for a second round of COVID-19 funding.
