H ow Con s e r va t ion and Sus t a in a b ility Promote H e a lt hy Ecosys tems by Dakota Parks Fishing along the Gulf Coast is more than just a hobby or a job—it’s a way of life and a cultural thread that unifies our coastal communities. According to the Florida Fish and Wildlife Conservation Commission (FWC), there are more than four million anglers licensed in the State of Florida, and saltwater recreational fishing accounts for a $9.2 billion economic impact. These marine ecosystems provide us with important food sources, jobs and economic stability, recreation and cultural identity. However, demand for seafood and advances in technology have led to overfishing, which endangers and depletes fish and shellfish populations. Moreover, the entire ocean is under stress from environmental pollution and climate change, which is driving increases in water temperatures, acidity, rising sea levels, stronger and more frequent storms and habitat destruction. Marine conservation and sustainable fishing practices are fundamental to curbing human impact on marine life and ensuring there are fish for the future. At the non-profit Pew Charitable Trusts, established in 1948, sustainable fishing requires two major things: science-based catch limits and “ecosystem-based fishery management,” which builds upon the traditional method of U.S. fishery management that focuses on one species at a time when setting fishing regulations. Ecosystem based fishery management also considers the broader ecosystem and recognizes that each population is interconnected with other fish, ocean wildlife and habitats, which are directly affected by human activities and changing environments. This approach allows Pew to focus work on habitat conservation, managing bycatch, protecting forage fish and advocating for fishery ecosystem plans. “Sustainable fishing means that we’re fishing for the future so that we can maintain the economic and recreational benefits from these natural resources for the long term,” Tom Wheatley, a senior manager for The Pew Charitable Trusts’ U.S. southeast ocean conservation work, explained. “We partner with different stakeholders that are interested in these resources—folks from the scientific community, from the resource user community, state government and federal government—to find ways that we can work together to mitigate these problems through a good management plan.” As Wheatley explained, much of his work on overfishing shifted to this ecosystem-based approach after The Pew Charitable Trusts supported changes to the Magnuson-Stevens Fishery Conservation and Management Act in 2006. These changes implemented science-based catch limits and accountability measures for those catch limits. According to data by NOAA, as many as 47 fish stocks have been rebuilt from 2000 to 2019, illustrating a positive trend in federally managed fisheries.
In December 2020, Congressman Jared Huffman submitted a draft reauthorization bill for the Magnuson-Stevens Act. The draft bill addresses new and emerging management issues, such as the impact on fisheries from changing ocean conditions and implements an ecosystem-based fishery management, which Pew has long advocated for. The proposal also seeks to improve data collection and monitoring, increase transparency around how fisheries management decisions are made, provide additional opportunities for public engagement and support fishing communities. “We’re making a lot of progress with science-based catch limits to the point that overfishing does not occur as often as it once did. I think you can see that in the Gulf of Mexico especially with red snapper,” Wheatley said. “We’re not fully out of the woods yet, because we still need older fish, which produce more eggs and have more spawning potential. We measure the health of the red snapper stock with how many eggs are being produced on an annual basis, but we do need some patience to ensure some of these fish actually make it to an older age and larger size.” According to the March 2021 Great Red Snapper Count conducted by Harte Research Institute, there are triple the number of estimated red snapper in the Gulf of Mexico. The study found an estimation of more than 110 million red snapper in the waters of the Gulf of Mexico, compared to the estimated 36 million by the 2018 NOAA count. While previous surveys focused on fishery concentration on artificial reefs and natural hard bottom, the new study also looks at uncharacterized bottom, which has no structures or vertical relief and resulted in higher numbers of fish counted. Robert K Turpin, a marine biologist, fisherman and expert diver with 50 years of experience in the local waters, has witnessed the rebounding red snapper population firsthand but worries there is still more that could be done to manage reef fisheries. Turpin explained that when monitoring artificial reefs, he will regularly find a boat above the reef with a mass pile of dead red snapper floating around the boat due to regulatory discards that die from barotrauma. “In this particular case, they were trying to catch triggerfish and only catching red snapper, so they were throwing them out. Meanwhile, the porpoises, sharks and barracuda are coming in and picking these dead red snappers off the surface like candy,” Turpin explained. “So,

It was completely surrounded by red snapper and not a single triggerfish. So, we’re killing dozens of non-target species and teaching learned behavior to these porpoises and sharks that boats equal an easy meal. This not only makes these animals more susceptible to injury through interaction with fishing gear, but it also poses a danger to humans as the sharks get bolder in approaching boats and spear fisherman.” According to a South Atlantic stock assessment by SEDAR 41, an estimated 28.5 percent of recreationally caught red snapper die after release, which means that more than 460,000 red snapper perished after being thrown back in 2017. For commercially caught red snapper, the mortality rate is 38 percent. The condition, known as barotrauma, is similar to the bends, which can afflict scuba divers who ascend too fast. “More and more people are looking for ways to reduce the number of fish that they’re not going to take them home to eat. They don’t want to just kill them. That’s not part of our ethos here in the Gulf of Mexico,” Wheatley explained. “So, we are seeing more and more people adopt new technologies. With education on how to use descending devices and how to properly vent fish, I think we can reduce the amount of released mortality, or bycatch. One idea that has been explored is creating seasons for fishing bottom fish with regulations put in place that reduce the amount of discards you would have to begin with by opening up more fish at the same time. It’s not ready to go yet, but it’s certainly something we have explored at Pew and funded research for.” A recent requirement set by NOAA Fisheries, called Regulatory Amendment 29, set new gear requirements to help prevent these mortality rates from barotrauma. Beginning on July 15, 2020, anglers from North Carolina through the Florida East Coast that are targeting snapper or grouper species are required to have a descending device on board and readily available for use. These weighted, reusable tools typically clip to a fish’s jaw and help it quickly return to the depths it was caught. “Many of the techniques and regulations for freshwater fisheries were simply applied to the deep-water reef fisheries,” Turpin said. “You can’t regulate the harvest of grouper from 200 feet of water the same way that you do with bass in 12 feet of water because of the hyperbaric difference between the water depth and the surface. and release does not work on reef fish like triggerfish, snapper, grouper and amberjack. The better question is how can we regulate these fish in a sustainable way that allows anglers to harvest without waste? In my opinion, a more equitable and ethical way would be to make it illegal to throw reef fish back, and instead, create a reef fish aggregate bag limit. Each person or boat would get a daily bag limit based on the stock numbers, rather than killing thousands of fish from size regulation discards.” Turpin explained that a safety valve for this approach to management could come in the form of designated marine reserves, which serve as a “harvest refugia,” where fish cannot be harvested. While artificial reefs can help provide shelter, food and other necessary elements for biodiversity, Turpin explained that they can be exploited in a way that reserves cannot. “They call this attraction vs. production. Every artificial reef exists on a continuum between an artificial reef that everybody knows about and overharvests, to reefs that are lost or moved by storms, where no one ever harvests fish from,” Turpin said. “We know that if we deploy artificial reefs in substantial quantities over broad areas, however, that there is less pressure on any individual artificial reef, so the fish that do aggregate around that reef may be exposed to less pressure. If we set up marine reserves throughout the system, these same reef fish could live in areas where they aren’t harvested, just like an artificial reef lost from our maps by a hurricane.” Creating designated conservation areas and aquatic preserves are also one way that Pew mitigates habitat loss and promotes healthy ecosystems. One such preserve, Pew recently helped advocate and successfully pass a bill to create is The Nature Coast Aquatic Preserve, located off the waters of Citrus, Hernando and Pasco counties. This preserve was created in June 2020 and protects about 800 square miles along the Gulf Coast and is the first new preserve to be designated in more than 30 years. It covers part of the Gulf of Mexico’s largest seagrass bed and still allows traditional activities such as boating, fishing and scalloping. “We’re definitely seeing changes in habitat due to climate change.” Wheatley said. “Some of the habitat

issues that we are currently working on is seagrass on the west coast of Florida and oysters in the northern Gulf of Mexico. The new marine preserve protects around 400,000 acres of seagrass, so we are working to maintain that seagrass and all of the economic benefits that we get from it including recreational and commercial fishing. The state designation prohibits any type of oil and gas drilling and helps maintain the resources for the future.” Part of maintaining resources for the future and abiding by ecosystem-based fishery management, as Wheatley concluded, is developing a fishery ecosystem plan (FEP) that serves as an instruction manual for how to factor in ecosystem considerations that influence fish populations using the latest science, fishermen’s expertise, and other available data to inform management decisions. The Gulf of Mexico Fishery Management Council is in the process of developing one. By monitoring indicators of ecosystem health such as water temperatures and including impacts on spawning seasons or species’ seasonal movement patterns, the Gulf of Mexico Fishery Management Council could forecast trends, determine research and data needs and identify risks before they become problems. The FEP could also include guidance requiring managers to incorporate effects from a lethal algal bloom (red tides) or major oil spill into management decisions, such as catch limits and fishing season changes. “I don’t know a single angler, fisherman or person that would say it’s not important for us to manage these marine species and fisheries,” Turpin explained. “They’re phenomenally important for the ecology of the ocean and maintaining a productive and biodiverse environment in the Gulf of Mexico. They’re important to our diet, our recreation, our economy and to our culture.” Sustainable fishing practices, marine habitat conservation and ecosystem-based fishery management all ensure that our Gulf Coast communities and oceans will thrive for generations to come. As increased pressure is put on our oceans by pollution, climate change, illegal and unreported fishing, invasive species and changing habitats, the work to conserve and protect these ecosystems is more important than ever.

CITY AWARDED $500K GREEN STORMWATER INFRASTRUCTURE GRANT FROM FDEP The City of Pensacola has been awarded a $500,000 grant from the Florida Department of Environmental Protection’s Green Stormwater Infrastructure Program, which will allow the city to incorporate green infrastructure concepts into a flood mitigation project on Barrancas Avenue, continuing the city’s ongoing efforts to improve water quality of local waterways. The city will use this funding to implement environmental features in the flood mitigation project that will ultimately reduce the flow of pollutants into the environmentally-sensitive Bayou Chico, which will help maintain a cleaner and healthier bayou. “I am so proud of our Public Works and Engineering staff for pursuing this grant opportunity and successfully securing this vital funding for the City of Pensacola,” Mayor Grover Robinson said. “To be awarded a grant of this magnitude is no small feat, and I am especially excited that the money will help us implement stormwater concepts that support our ongoing efforts to be a greener, more environmentally-conscious city.” Through the grant award, the city’s project will be part of a Green Stormwater Infrastructure Case Study with FDEP, which will help collect data to develop future case studies on green stormwater infrastructure in Florida. The Barrancas Avenue Flood Mitigation Project will incorporate green
infrastructure concepts by providing treatment of stormwater through the installation of bioretention cells along the right of way of Barrancas Avenue, which will not only provide stormwater benefits, but also enhance aesthetics along the roadway through landscaping. These cells will be designed to capture stormwater from Barrancas Avenue along with adjoining properties, with native plant landscaping to help slow waterflow and assist in reducing pollutant levels in stormwater runoff. This stormwater runoff would otherwise discharge to local waterways like Bayou Chico, ultimately entering Pensacola Bay and the Gulf of Mexico. “We are very grateful to FDEP for this grant award and the opportunity to help lay the groundwork for future case studies on green stormwater infrastructure throughout the state of Florida,” City Engineer Brad Hinote said. “This project is just one example of the city’s aggressive efforts to address regional stormwater impacts as part of our Stormwater Master Plan, and we look forward to continuing to work to improve our local waterways and environment.” This grant application effort was led by City of Pensacola Sustainability Coordinator Mark Jackson, with significant contributions from City Engineer Brad Hinote and Engineering Specialist Chris Mauldin.
PEN AIR PARTNERS WITH MANNA AND FIRST RESPONDERS TO FIGHT HUNGER On Tuesday, June 29, Manna Food Pantries announced the results of the 4th Annual Donut Strike to “arrest hunger” in Escambia and Santa Rosa Counties. This year’s strike collected 20,233 lbs. of food and $21,582.05, the equivalent of 34,074 healthy meals over the course of the three-day campaign. The Donut Strike originated as a joint effort of the Pensacola Police Department, Escambia County Sheriff ’s Office, Pensacola Fire Department, Escambia County Fire Rescue, local businesses, and the community to turn hunger into hope. With a front row view of hunger and the impact it has, first responders vowed to put the donuts down and do something to help, and the community stood behind their efforts. “Childhood hunger has worsened; one in three children in our community will go to bed hungry tonight,” said DeDe Flounlacker, Executive Director of Manna. “We so appreciate the support of our local first responders during these critical summer months, when children are out of school and the need for help increases.” In the spirit of Communerosity, Pen Air Federal Credit Union joined the fight again to turn hunger into hope by donating $10,000 towards the 30,000 healthy meal goal.

Capital projects are a major driver of tourism to the area for both locals and visitors, benefiting both Santa Rosa County and the project owners. The goal of the Capital Project Funding Program is to create a sense of place and deliver a unique experience that enhances tourism visitation, economic impact and community vitality. The program is open to county projects, municipalities and non-government organizations (privately owned) in Santa Rosa County. Funding may be applied for new construction, expansions, renovations or major equipment. Applications are available at the Santa Rosa County Tourist Development Office, 8543 Navarre Pkwy. in Navarre and online. Applications are due by Sept. 30.
• If funded, applicant must wait three years before requesting additional and/or new capital project funding. • Projects must be past design phase to qualify for funds. • Permits must be attainable by applicants. • Match funds must be in hand. ESCAMBIA COUNTY TO HOST A SCUBA DIVING SAFETY SYMPOSIUM AUG. 9 The Escambia County Marine Advisory Committee will host a special Scuba Diving Safety Symposium Monday, Aug. 9 from 5:30 - 7 p.m. in room 104 of the Escambia County Central Office Complex, located at 3363 West Park Place in Pensacola. The event will facilitate discussion between divers, diving professionals, diving emergency responders and diving medical professionals. The purpose of the symposium is to improve awareness of prevention, safety measures and emergency response procedures for recreational diving. ESCAMBIA COUNTY’S MOBILE COMMAND CENTER TO REMAIN AT CONDO COLLAPSE THROUGH JULY 30 Escambia County’s mobile command center will stay at the Surfside condo collapse through July 30. The state requested use of the vehicle as a command post for search and recovery efforts. The command center, nicknamed “THOR” was set to return from Surfside today Wednesday, July 7, but it will now remain through the end of the month. The emergency management employee returned from his deployment and will return to South Florida to retrieve THOR. “It takes a strong partnership during

FDOT: NIGHTTIME LANE RESTRICTIONS ON PENSACOLA BAY BRIDGE The Pensacola Bay Bridge will be reduced to one lane in each direction from the bridge approach in Gulf Breeze extending for approximately 3,500-feet from 8 p.m. to 5 a.m. Monday, July 12 through Saturday, July 17. KEY WEST COMMISSIONERS REVISIT CRUISE SHIP RESTRICTIONS JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — Key West commissioners on Monday directed their attorney to draft ordinances limiting local cruise ship operations, mirroring city voterapproved measures recently overturned by state lawmakers. During a special meeting Monday evening, commissioners said that, despite the threat of lawsuits and further preemptive legislation, they had to support the 2020 referendums. Amid the coronavirus pandemic, backers pushed the measures as a way to protect area waters and coral reefs surrounding the tourism-dependent community. “We’ve got 63 percent of our voting population that said enough is enough. We have to have their backs,” Commissioner Jimmy Weekley said. “We have to stand here and find a way in which we can defend that referendum question that was passed. And we’ve got to tell the state of Florida, you can preempt this all you want, we’re going to keep coming back with ordinances or resolutions in a way that we can get what our constituents want.” With cruise ships set to return to the state’s southern-most port in September following more than a year-long shutdown due to the pandemic, Key West City Attorney Shawn Smith said the new state law would allow the commission to implement the will of voters through ordinances.
Smith said his interpretation of the law is based upon a bill signed into law by Gov. Ron DeSantis, which tossed out the results of three November 2020 Key West referendums. The measures limited the size of ships using the Port of Key West and the number of passengers allowed to disembark daily. But Smith also advised commissioners that ordinances restricting cruise ship activity, which the commission is expected to consider in August, could result in lawsuits from negatively impacted businesses — which the city likely would have faced without the new state law — and spark more state legislation next year. “What was passed by the voters is one thing. What is sufficient for you to pass an ordinance is something different,” Smith said. The new law, passed by state legislators this spring, prohibits local ballot initiatives that restrict maritime commerce involving such things as vessel sizes and points of origin. Those supporting the Florida law argued the state has a federal responsibility to keep ports open for business and that the citizens of Key West are trying to make the community more exclusive, rather than being concerned about the environmental issues promoted by the advocates of the 2020 referendums. But the Key West Committee for Safer, Cleaner Ships, which sponsored the 2020 measures, garnered the
support of city commissioners before a crowd that overwhelmingly supported the cruise ship restrictions during Monday’s meeting. The committee’s backers argued that the new law — tucked into a contentious transportation bill as the legislative session drew to a close in late April — only applies to ballot measures and doesn’t prevent port authorities from regulating their facilities. One issue the city will have to deal with is Pier B, a private cruise port which has operated for the past three decades under a contract that annually provides 25 percent of its net revenue to Key West. The city estimates that it receives about $1.5 million a year from Pier B, which would put the company’s annual gross proceeds around $6 million a year. DeSantis’ political committee received nearly $1 million in donations from companies owned by Mark Walsh, the owner of Pier B Development, before the 2021 legislative session. Commissioner Samuel Kaufman said he wants to scrutinize a draft ordinance to determine its potential impacts. “I think all the commissioners would like to see an ordinance in place if it’s enacted within and permissible by law, and if it will hold up to court scrutiny,” Kaufman said, adding that the commission was unable Monday evening to make a determination about how to move forward. “All of this is hypothetical until we see a drafted ordinance. So,
I’m all for it. I’m all for review. I’m all for analysis.” Asked what it would take to end the city’s contract with Pier B Development, which runs into 2025, Smith replied, “We pay.” “I think Pier B sues us. I don’t think it’s a threat. I think it’s legitimate,” Smith said. “I think it’s a breach of contract claim and an interstate commerce claim.” Bart Smith, representing Pier B Development, told the commission that the company invested millions of dollars into building and strengthening its facilities. “We hope and expect the city to continue to honor the agreement,” he said. Several residents called the 2020 referendum a compromise, noting they would have favored more severe restrictions. Arlo Haskell, treasurer of the committee that backed the 2020 measures, called on commissioners to approve ordinances that prohibit cruise ships carrying more than 1,300 people, limit disembarkations to 1,500 a day, and give priority to cruise ships based upon environmental and public health records. “There should be no special carve outs and no exemptions,” Haskell said. “Allowing a single pier to continue to operate without limits would allow for 365 large cruise ships a year, one each and every day. This would barely be an improvement from the status quo, and is certainly not the change that the people of Key West have asked for.”

TALLAHASSEE — A Northwest Florida judge has refused to toss out a lawsuit seeking possible sanctions against a Santa Rosa County attorney who drew national attention for dressing as the Grim Reaper to criticize Gov. Ron DeSantis’ handling of the coronavirus pandemic. Prosecutors in March filed a motion in Walton County to pursue sanctions against lawyer Daniel Uhlfelder, who traveled throughout the state in the macabre costume to call attention to issues such as the Republican governor’s refusal to close beaches amid the pandemic. The probe into possible sanctions came at the direction of a three-judge panel of the 1st District Court of Appeal, which took the rare step of ordering State Attorney Ginger Bowden Madden to pursue discipline against Uhlfelder. Uhlfelder’s lawyer, Richard Greenberg, asked Santa Rosa County Circuit Judge Scott Duncan to dismiss the case, arguing that the appeals court’s order for the possible sanctions fails to comply with a disciplinary rule cited by the three-judge panel. The seldom-used rule allows judges to direct state attorneys to file a motion seeking discipline if a lawyer “has been guilty of any unprofessional act” laid out in Florida Bar regulations. During a June 7 hearing on Uhlfelder’s request to have the case dismissed, Greenberg told Duncan that the appeals court’s order does not comply with the rule because Uhlfelder has not been found guilty of any wrongdoing. But a month later, Duncan refused to scuttle the case. “Having carefully considered respondent’s motion, the state’s response, the respondent’s reply, the record, the arguments at the hearing, and applicable law, the court finds that respondent’s motion should be denied,” the judge wrote in a brief order issued Friday. The legal wrangling is rooted in a lawsuit Uhlfelder filed in March 2020 to try to force the governor to close beaches to prevent the spread of COVID-19. Leon County Circuit Judge Kevin Carroll ruled that he lacked the authority to order the governor to shut down beaches and encouraged Uhlfelder to ask a higher court to weigh in on the issue. Uhlfelder took the case to the Tallahassee-based appeals court. But the three-judge panel on Feb. 5
asked the Bar to consider imposing sanctions against Uhlfelder, saying there was “no good-faith basis” for the appeal and accusing Uhlfelder and his lawyers of using “this court merely as a stage from which to act out their version of political theater.” The News Service of Florida wrote about the order in a story that was published online by the Tallahassee Democrat, a News Service subscriber. The story, as published by the Democrat, also included comments that Uhlfelder made during a brief interview with the USA TODAY NETWORK-Florida Capital Bureau, which is affiliated with the Democrat. “I do find it interesting that this opinion attacking my critiques of Gov. DeSantis appeared just two days after I launched a (political) committee to remove Ron DeSantis,” Uhlfelder said during the interview, referring to what is dubbed the Remove Ron political committee. After the story was published, the three-judge panel ordered Bowden Madden’s office to file a motion seeking to discipline Uhlfelder for “putatively unprofessional conduct.” In a motion filed in March, Assistant State Attorney Anne N. Izzo accused Uhlfelder of “violating rules of professional conduct” for lawyers “as well as violating the oath of admission to The Florida Bar.” The motion did not specify what type of discipline prosecutors are considering. Greenberg, in a response to the motion, said that Uhlfelder hadn’t done anything wrong and asked a judge to dismiss the case, arguing that the state lacks a basis to pursue sanctions. The appeals court’s Feb. 8 order requiring Bowden Madden to file a motion regarding Uhlfelder “contains no assertion” that Uhlfelder has been found guilty of any unprofessional conduct, Greenberg wrote in the sixpage response. In addition to the rare move of ordering Bowden Madden’s office to pursue sanctions against Uhlfelder, the three-judge panel ordered the Panhandle prosecutor’s office to file monthly status reports on the case with the appeals court. An evidentiary hearing in the case has not been set, according to Walton County court records. The court records also show that three judges from the 1st Judicial Circuit were recused from the case, which is now assigned to Santa Rosa County Circuit Judge Scott Duncan.
TALLAHASSEE — Two major online platforms have dropped $20 million into an effort to legalize sports betting in Florida and direct the state’s proceeds from the popular activity to education. DraftKings and FanDuel each contributed $10 million to the Florida Education Champions political committee late last month, according to the state Division of Elections website. The committee filed a proposed constitutional amendment to legalize sports betting, in a move that could unravel a $2.5 billion deal struck by Gov. Ron DeSantis and the Seminole Tribe of Florida. “Thank you to DraftKings and FanDuel for stepping up to the plate in an incredible way to kick off our amendment process that stands to help all Floridians. Our amendment will direct hundreds of millions of additional dollars toward Florida’s Educational Enhancement Trust Fund and open up the market for online sports betting to competition,” David Johnson, chairman of the political committee, said in a press release issued Monday. The sports-betting behemoths’ $20 million contribution comprised the total amount of money collected by the committee in a campaign report filed on Monday, when campaign finance reports were due. The onslaught of funds comes as committees try to head off a new law aimed at making it harder to pass constitutional amendments. The law, passed by Republican legislators this spring, would place a $3,000 limit on contributions to political committees as they collect petition signatures for ballot initiatives. The limit would make it much harder — critics say impossible — to collect the required petition signatures. The law (SB 1890) was slated to take effect July 1, a week after the multimillion-dollar contributions to the sportsbetting initiative. But U.S. District Judge Allen Winsor blocked the law, saying it runs afoul of the First Amendment. The proposal would authorize sports betting at professional sports venues, pari-mutuel facilities and statewide via online platforms. If betting revenues are taxed, the tax dollars would have to go into what is
known as the state Educational Enhancement Trust Fund, according to the proposed amendment, which was posted June 25 on the state Division of Elections website. The contributions from DraftKings and FanDuel were made on June 23 and June 24, respectively. “It is our shared goal to have a safe, legal and regulated market for offering online sports betting in the Sunshine State. Once passed by Florida voters in November 2022, this initiative will ensure that the State of Florida shares in the sports wagering revenue that is currently going entirely to the offshore, illegal market,” Cory Fox, FanDuel vice president of government affairs, said in the press release. The sports-betting proposal would undo an agreement, known as a “compact,” signed by DeSantis and Seminole Tribe of Florida Chairman Marcellus Osceola Jr. in April that would put the tribe in control of sports betting in the state. Lawmakers approved the compact during a special legislative session in May. Under the compact, the Seminoles have pledged to provide $2.5 billion in payments to the state over five years, with additional money in the ensuing years. The proposed constitutional amendment would allow other entities to host sports betting in addition to the tribe, and would result in a decrease in the Seminoles’ payments to the state. The compact has been submitted to the U.S. Department of the Interior, which oversees Indian gambling issues. The Bureau of Indian Affairs can approve the deal, reject it or allow it to go into effect without taking any action. Under the compact, the tribe would serve as the hub for online sports betting throughout the state, with pari-mutuel operators contracting with Seminoles. The plan would allow people in the state to place sports bets using apps on cell phones, with the Seminoles hosting the sports-betting activity through computer servers on tribal lands. Seminole Gaming spokesman Gary Bitner blasted the sports-betting ballot initiative. “This is millions of out-of-state corporate dollars to try and manipulate the people of Florida, who are smarter than that. They think they can buy their way into the state. Our team intends to use our Florida dollars to protect the interests of the people of Florida,” Bitner told The News Service of Florida.
